DOREPOLL HEREFORDS Reduction Sale Saturday 26th September 2015 at 1.00pm To be held on the farm at 41 Divis Road Dundrod, Crumlin, Co Antrim. Northern Ireland BT29 4UB The Haire family would like to extend a warm welcome to you for our reduction sale. Our association with Hereford cattle goes back over 40 years during which time we have worked hard to build a herd which delivers for not only us but also our customers. The success which our customers have had has given us as much pleasure as it no doubt has for them. There have been many developments & changes in the breed & market place. Our goal has always been to supply genetics that would make a positive & lasting contribution to the herds they enter. Our selection has always been strict and we strive to look beyond current trends to market developments In the sale you will find many long standing families from within our herd backed up with a number that have originated from our very successful Embryo Transfer project. We are giving you the opportunity to add practical and profitable genetics to your herd that we feel are coming from the very top of the breed in Europe. Our management is quite straight forward. The aim is to get the most out of our herd with a minimum of inputs. Our selection and breeding criteria is very basic. Our stock all have to be structurally correct to cope with our farm conditions, they have to calve easily (as we have better things to do), they must have good udders and more than adequate milking ability, they have to be efficient feed converters and carry enough muscle as is economically efficient to produce. Over and above this repeatability is key to not only genetic progress but also profitability. We are achieving these aims. The farm is located on the west side of Divis Mountain on the outskirts of Belfast city. The farm extends to almost 100 acres of heavy clay and moss at almost 1000ft with a predominantly northern aspect. The cattle are accustomed to fending for themselves and receive minimal supplementation and the best quality silage we can make in our limited growing season. This is more than a reduction sale. With only a few exceptions, every animal in the herd is being offered for sale, even some that we had vowed never to sell! The change in our circumstances necessitates the sale so rest assured the quality is second to none. There is no bottom end in this sale. All the cattle offered will be serious assets to their new owners. We look forward to welcoming you on the 26th September 2015. General Sale Information Travel- The farm is situated 15 mins from Belfast International Airport (Aldergrove) & 25 mins from The George Best Belfast City Airport (car hire is available from both), Belfast ferry terminal is also 25 mins with the ferry terminal in Larne being 40 mins. All major car hire companies operate from both the International & City airports. Pickup at Belfast Int Airport- We are happy to collect visitors to the sale from Belfast international Airport, please let us know well in advance of you travel arrangements & flight number to make this run smoothly. Viewing- For anyone attending from outside N Ireland the cattle will be available for viewing on Friday from 4.00pm to 6.00pm. Stock will be available for viewing on sale day from 11.00am Herd health- As with all herds in NI the herd is annually tested for bTB and has not had any problems for over 25 years. We are members of HiHealth herdcare and are accredited free for BVD and IBR. WarrantyFrozen Embryos- Due to different management practices, ET technicians, etc there is no guarantee on the conception rate of frozen embryos. We do guarantee that you will receive the number of embryos purchased and that they are the mating published in the catalogue. Only grade 1 embryos were frozen by accredited technicians and have been stored in approved premises Payment Terms- The sale shall be conducted in Guineas. Settlement should be made in full with the sale staff immediately after the sale Export- All animals sold for export will be retained on the farm to complete their health tests. All animals sold for export that realise 2500 gns or more will be kept, tested and in the case of GB cattle transported to a central point free of charge for your collection. Animals no reaching the 2500 gns figure will be kept and tested free of charge but will incur a charge for transport to GB if relevant which must be paid at the time of collection. We will try and keep costs as low as possible. We would ask that animals staying on the farm be insured. Arrangements for onward delivery and cost is the responsibility of the purchaser. The family has produced many notable successes, winning many show over the 25 plus years they have been here, the most recent being Dorepoll 1 499 Einstein, joint GB Poll bull of the year 2013. Tessa Misters 19D Tessa 126J was purchased as a heifer calf from Brillinger farms from Ontario Canada unseen. She was RUAS champion as well as NI Female and Poll Female of the year. She is the Dam of Dorepoll 1 10H Headliner and several others in the sale. Journey Hill BNC 22J Journey 57L was purchased as a heifer calf from Hills Poll Herefords in Ontario, Canada. Due to FMD in the UK it was decided to leave her in Canada and collect embryos, which produced our Jonathan and Online bulls as well as Journey 497 the dam of two females in the sale. Classic Kim Kim was purchased as an embryo from the Remitall Cattle Co in Alberta Canada. She is a flush mate to Remitall Kim 10L who had a half share sold in her for $40,000 and went on to become Canadian National Champion in 2003. Catalina The result of embryos purchased from Remitall Cattle Co in Albert Canada. From the same family as the world famous Remitall Catalina 24H, the mother of Remitall Online, 122L, Remitall Olympian 262L, Remitall Pounder 204P, Remitall Nationwide 93N and Remitall Route 66 346R. Need we say more? Sadie Goes back to the purchase of Costhorpe 1 Sally H29 from the herd of HW Coates Ltd, originating from the Onondaga Herd in Ontario Canada. HEREFORD. HR1 2LL BULL WARRANTY (a) All Bulls 12 months old and over on the day of the sale shall be sold as being fertile and capable of natural service as at the date of sale. (b) No claim in respect of infertility: (i) Shall be made during the first month after the date of sale or after the expiration of three months from the same date. (ii) Shall be valid where a Veterinary Surgeon, nominated or appointed as in Regulation (c) (i) below, certifies in writing that infertility is due to illness contracted, or injury suffered, after the fall of the hammer on the day of sale. (iii) Of bulls purchased for export (including the Republic of Ireland and Northern Ireland) shall be valid unless such claim shall have been admitted or proved correct prior to the shipment by sea or air, or before the expiration of the time allowed by clause (c) hereof whichever shall be the earlier date. (c) If, during the second and third months after the date of sale, or as provided in clause (b) (i), notice in writing of the bull's infertility be given by the Purchaser to the Society, then, subject to the provisions of clause (b) of this regulation, to establish a claim for infertility the following provisions shall have effect, namely:Upon receipt of such notice: (i) If, and only if, both the Vendor and the Purchaser so agree in writing, the bull shall be examined either by an independent Veterinary Surgeon to be agreed upon by both the Vendor and the Purchaser or in default of agreement to be appointed by the Society, and the decision of such Veterinary Surgeon as to fertility or otherwise shall be final and binding on both parties, such decision to be given within three months of the receipt of the notice under clause (c), such decision to contain a certificate as to whether or not, in the case of infertility, such infertility is due to illness contracted or injury suffered after the fall of the hammer; or (ii) The Vendor may take the bull back and shall have three months from the receipt of such notice in which to prove whether or not the bull is fertile for and capable of natural service, such proof to be the decision (which shall be binding on the parties) of an independent Veterinary Surgeon agreed upon or appointed as in sub-para (i) hereof. (d) In this Regulation the words "fertility" and "infertility" shall mean "fertile and capable of natural service" and "infertile or not capable of natural service" respectively. All references to "months" shall mean "calendar months". (e) The expenses of proving fertility or otherwise shall fall as follows:(i) In the event of the Vendor exercising his right of having the bull returned to him under clause (c) (ii) hereof, the cost of carriage shall be paid by the Vendor in any event. (ii) All other expenses of carriage and independent Veterinary Surgeon shall follow the decision of fertility or otherwise. (iii) There shall be no claim by either party for maintenance of a bull. (f) In no case shall the Vendor be liable, under this regulation, for a sum exceeding the amount for which the Bull was sold (and any expenses awarded under the preceding paragraph) less its realisable value at the time of the decision of the Veterinary Surgeon. The Purchaser shall not unduly reduce the bull's condition without the Vendor's consent. (g) Notwithstanding the provisions of the clause (c) of this regulation, the Vendor shall, upon receipt of a notice of claim of infertility, have the option, to be exercised within fourteen days of receipt of such notice, of taking the bull back and refunding the full purchase price to the purchaser. (h) Any examination by a Veterinary Surgeon under this regulation shall be conducted at the place where the bull is kept at the time of the Veterinary Surgeon's appointment whether this be by agreement of the parties or by the Society. (i) A copy of all notices and decisions under this regulation shall be forwarded to the Secretary through whom also all payments other than expenses under clause (e) shall be made. Failure to comply with this regulation may mean that the claim cannot be substantiated. FEMALE WARRANTY The Vendor shall pay to the Purchaser compensation at the following rates except that in cases (a) and (b) where a female is sold with her calf at foot as one lot, the value of the calf shall be 30% of the total sale price, thereby determining the value of the adult female on which a claim can be made as 70% of the sale price of that lot. In the case of:- (a) Females sold as being served which shall come into service within two months of Sale, and which are last served not less than ten weeks prior to the Sale:(i) In the case of females realising 600 guineas or over, an allowance of 25 per cent of the cost of the animal: (ii) In the case of females realising 1,000 guineas or over, the Vendor shall allow the Purchaser an additional 15 per cent on the amount exceeding 1,000 guineas. Notice of any claim under 12 (a) must be made by the Purchaser to the Vendor or his agents in writing, immediately the animal shows signs of being in service. (b) In the case of females sold as being in calf and subsequently proving to be not in calf for reasons of abnormality of the genital system, the following conditions and procedures shall apply. Notice shall be given in writing by the Purchaser to the Vendor, immediately the animal shows signs of being in service, or failing this, within 10 calendar months of the date of service or of the last date when running with the bull where a warranty of pregnancy is given. Upon receipt of such notice: (i) If, and only if, both the Vendor and the Purchaser so agree in writing, the animal shall be examined by an independent Veterinary Surgeon, to be agreed upon by both the Vendor and the Purchaser, or in default of agreement, to be appointed by the Society, and the decision of such Veterinary Surgeon shall be final and binding on both parties. (ii) In his certificate the independent Veterinary Surgeon must state that the animal is barren and has not been in calf to the stated service, giving details of the abnormality. Where a claim is established under this clause the Vendor shall pay to the Purchaser compensation at the following rates: (iii) In the case of females realising 600 guineas or over, an allowance of 25 per cent of the cost of the animal: (iv) In the case of females realising 1,000 guineas or over, the Vendor shall allow the Purchaser an additional 15 per cent on the amount exceeding 1,000 guineas. The expenses of such independent Veterinary Surgeon's examination shall be borne by any Vendor paying compensation under this Clause but otherwise by the Purchaser. (c) In the case of any females sold as being unserved and afterwards proving to be in calf, then an allowance of 25 per cent of cost shall be made by the Vendor and in the case of females realising 600 guineas or over the Vendor shall allow the Purchaser an additional 15 per cent on the amount exceeding 600 guineas. Claims under Rule (c) to be made within six calendar months of date of sale. (d) No compensation will be paid if carelessness or ill-treatment on the part of the Purchaser can be proved by the Vendor. (e) The term "running with the bull" implies no warranty of pregnancy unless specifically stated in writing at the time of Sale. When a warranty is given then the above Rule 12 (a), (i), and (ii) and 12 (b), (iii) and (iv) will apply irrespective of service date. (f) Any Vendor required to pay compensation under this Rule shall have the option of taking back the animal concerned and in this event shall refund the full purchase price. (g) In the event of the Vendor exercising the right of having a female returned to him under this Rule the cost of carriage shall be paid by him in any event. In the event of the independent Veterinary Surgeon deciding in favour of the Purchaser, thus making it necessary for the animal to be slaughtered, cost of carriage shall be paid by the Vendor. (h) If it is found that a female gives calf to a different bull from that stated, then compensation will be payable at the following rate: (i) In the case of females realising 600 guineas or over, an allowance of 25 per cent of the cost of the animal. (ii) In the case of females realising 1,000 guineas or over, the Vendor shall allow the Purchaser an additional 15 per cent on the amount exceeding 1,000 guineas. Claims under this rule must be received within one month of the birth of the calf. N.B. Any female (cow or heifer) that has been flushed for embryo transplant will be EXCLUDED from the terms of any warranty, but individual vendors of such animals shall have the option of giving their personal warranty to be announced at the time of sale SALE OF GOODS BY AUCTION – GENERAL CONDITIONS 1. Lots 1.1 The Buyer is deemed to have inspected any lot he buys and accordingly the lots are not sold by sample. 1.2.1 The Buyer admits that he has not been included to bid by any description representation measurement or statement made by or on behalf of the Seller and agrees that (apart from the agreed price and any matter confirmed in writing by the Auctioneers) these Conditions constitute the whole of the contract. 1.2.2 The Auctioneers act only as agents for the Sellers and will not be liable to the Buyer in any circumstances and have no authority to make any such descriptions representations measurements or statements. 1.3 No warranty is given or implied as to fitness for purpose or the quality of lots sold. 2. Sales 2.1 The highest bidder for any lot shall be the Buyer and the contract shall be concluded on the fall of the hammer. 2.2 The Buyer may not retract his bid in any circumstances. 2.3 On the fall of the hammer the Buyer will immediately give to the Auctioneers his full name and address and if required will pay the full purchase price. 3. Payment 3.1 In any event all lots purchased must be paid for in full on the day of sale. No lot must be removed from the sale premises until it has been paid for in full. 3.2 Cheques will be accepted in payment only with references satisfactory to the Auctioneers. 3.3 From conclusion of the contract any lot will be at the Buyer’s risk in all respects. 3.4 This market is not required to comply with the requirements of the members accounts regulations of the Royal Institution of Chartered Surveyors. No monies paid to this market are covered by any scheme for the protection of clients money operated by the Royal Institute of Chartered Surveyors. This notice is published in accordance with the requirement of the Royal Institute of Chartered Surveyors from whom a more detailed explanation can be obtained by writing to the Standards and Practice Department, The Royal Institute of Chartered Surveyors, 12 Great George Street, Parliament Square, London, SW1P 3AD. 3.5 The Buyer shall not withhold payment for any Lot by reason of any right of set off or counter-claim which the Buyer may have or allege to have or for any reason whatever against the Seller or the Auctioneers. 4. Disputes 4.1 In the event of dispute as to bidding the Auctioneers may either put up and re-offer for sale the lot or lots in question or may decide the dispute. 4.2 Any other dispute arising in any way out of any lot or its sale shall be decided by the Auctioneers. 4.3 The Auctioneers’ decision in any such case shall be final and binding in all respects. 5. Title to and Removal of Lots 5.1 All lots purchased shall be removed on the date of sale at the Buyer’s expense. 5.2 The Buyer will be responsible for any damage caused in the course of such removal to other lots or to any part of the premises on any part of which the auction is held regardless whether such damage is caused by the Buyer, his employees or agents or otherwise and whether such damage is a result of negligence or otherwise. Notwithstanding Condition 3.3 and the removal by the Buyer of any Lot, title to such Lot shall not pass to the Buyer until: 5.2.1 The Buyer shall have paid the Purchase price in full and 5.2.2 No other sums whatever shall be due from the Buyer to the seller or the Auctioneer. 5.3 In respect of any such damage if so required by the Auctioneers the Buyer will pay the cost of repairing all such damage (as estimated by the Auctioneers whose estimate shall be final and binding) before removal of any lots. Until such payment is made the Buyer grants the Seller and/or the Auctioneers a lien over any lots bought by him. 6. Conduct of the Auction 6.1 The Seller may offer any lots subject to a reserve price. 6.2 The Seller or the Auctioneers may: 6.2.1 Bid up to such reserve price. 6.2.2 Withdraw from sale any lot without disclosing a reserve. 6.2.3 Rescind any sale within 3 hours of the final lot being sold if the lot has been sold under any reserve. In the event of such rescission the purchase price or any part already paid by the Buyer shall be repaid but the parties and the Auctioneers shall be under no further liability to each other. 6.3 The Auctioneers may refuse the bid of any person without giving a reason and may regulate bidding as they see fit. 6.4 No bidder may advance less at a bid than the sum named from time to time by the Auctioneers. 7. Neither the Seller nor the Auctioneers shall be liable in any way for any loss or damage on any part of the premises on any part of which the auction is held. 8. In the event of breach by the Buyer of any of these conditions the Auctioneers may rescind any contract with the Buyer and put up and re-sell any lots the subject matter of such contract and the Buyer will immediately
