In connection w i t h the current problem as to the
regulation of warehouses by the Indiana State Public Service
Commission, and s p e c i f i c a l l y in connection with that Commission's
r u l i n g that Class B warehouses must accept without d i s c r i m i n a t i o n ,
i f space is a v a i l a b l e , goods customarily stored by them in the
normal operation of t h e i r b u s i n e s s , from any i n d i v i d u a l or company tendering such goods for storage; I have examined the law on
the subject and inquired i n t o the action of the Attorney General
wherein the Commission in conformity w i t h an opinion by the Attorney General assumed j u r i s d i c t i o n of warehouses and has proceeded with the regulation of the same.
My f i n d i n g s in the matter are set forth below and I
suggest that they be forwarded to Mr. Goldberg in order that
he may oe kept current on the developments i n s o f a r as t h e i r legal
aspects are concerned.
An Act r e l a t i v e to c l a s s i f i c a t i o n of warehouses passed
in 1 8 7 5 (Section 67-202 Burns' ^nd S t a t u t e s ) provides that c l a s s
A warehouses s h a l l embrace a l l warehouses, elevators and grana r i e s in which g r a i n is stored i n bulk - - - public warehouses of
class 3 shall embrace a l l other warehouses or places where propert y of any kind i s stored for c o n s i d e r a t i o n .
It is c l e a r t h e r e f o r
that t h e warehouses involved in the present controversy f a l l into
the class 3 group.
Section 67-203 Burns' Indiana Statutes describes the
d u t y of the c l a s s A warehouses sndamong other things provides
that c l a s s A warehouses must:
" r e c e i v e f o r storage any g r a i n that may a*
tendered to them in the u s u a l manner in which
warehouses are accustomed to receive the same
in the ordinary and usual course of b u s i n e s s ,
not making any discrimination between persona
d e s i r i n g to a v a i l themselves of warehouae
facilities - - - -
It should be noted that there ia no section dealing with
the duties of warehouses which fall into class 3 group.
Section 67-201 "urns' ndiana Statutes (Act passed in
1975) provides that a H nubile warehouses both class A and Claaa

B shall be operated under a permit granted by the Auditor of the
County in which the warehouse shall be operated.
Apparently the warehouses here involved, operated under
County A u d i t o r ' s permits until some time in 1 9 4 6 .
I find that
the Public Service Commission of Indiana requested an o f f i c i a l
opinion from the Attorney General on June 9th of this year, and received an opinion (a copy of which is attached hereto) wherein the
Attorney General ruled that the regulation of warehouses properly
was in the jurisdiction of the Public Service Commission.
It
should be noted that the Commission was created by the Act of 1913
and in Section 54-105 Burns Indiana Statutes, the Public U t i l i t y
was d e f i n e d , the d e f i n i t i o n including as a Public U t i l i t y , Warehouses, therefore warehouses as of that time were removed from the
jurisdiction of the County Auditor as described above and placed
within the jurisdiction of Public Service Commission.
It is
apparent however as a result of t h i s request for an opinion by the
Commission that no action was taken insofar as the issuing of permits to warehouses by the County Auditor, and the latter continued
to issue such permits.
It would seem obvious that the regulation by the County
Auditor was at best a very loose one, and that the warehouses
were, in f a c t , free to pick and choose t h e i r customers.
The warehouses once being c l a s s i f i e d as Public U t i l i t i e s
and placed within the j u r i s d i c t i o n of the Public Service Commission
are thereafter, as Public U t i l i t i e s , bound by the orders of the
Commission and also by their status obligated to service the public
on demand and without discrimination and where space is available
accept goods for storage which they normally would accept in the
normal operation of t h e i r business and to deliver the same upon
rightful demand of the owner.
As I told vou previously in a conversation w i t h Mr.
Picks of the Public Service Commission I was advised that that
Commission was, at that time, one week ago, preparing to conduct
an investigation for the purpose of fully advising the Commission
members as to the problems Involved in the regulation of warehouses, with a v i e * that such Information would enable to more
properly f u l f i l l their duties in the regulation of the warehouses
as public u t i l i t i e s .
I further informed you that it was my lntuotlon to
attend an informal hearing on October 2 5 t h , conducted by the
Commission at which time the various warehousemen would be heard
in respect to the problems involving the regulation of their
industry.
It was agreed that our objective would be to persuade the Commission not to prohibit the warehousemen from
picking and choosing t h e i r customers.
In view of the foregoing

it would seem t h a t , from the l e ^ a l point of view, our task would
be a most formidable one.
There i s , however, one point that may
be in our f a v o r , that I suggest we exhaust before the Commission,
that i s , that i f the warehouses were operating under permits
prior to the enactment of the Public Service Commission Act of
1 9 1 3 , it would be necessary by law before the Commission could
assume jurisdiction of them, that the warehouses surrender their
permit or f r a n c h i s e .
According to Section 54-605 Burns' Indiana
Statutes, an< Act passed 1 9 2 1 , such action would seem to be necessary before conferring jurisdiction upon the Commission. I
quote:
Surrender of Franchise: "Any Public U t i l i t y operating
under an e x i s t i n g l i c e n s e , permit or franchise from
any county, c i t y or town, within the State of Indiana
shall upon f i l i n g at any time prior to July 1 s t , 1 9 2 3 ,
with the Auditor or Clerk of any such County, c i t y or
town, which granted such license,permit or franchise,
and with the Public Service Commission of Indiana,
a written declaration legally executed that it surrender such l i c e n s e , permit or franchise, received by
operation of law, in lieu thereof, an indeterminate
permit as provided in the Act creating the Public
Service Commission of Indiana - - - - - under a l l the
terms, conditions and limitations of the said Act as
f u l l y and completely as i f the same had been done prior
to July 1 , 1 9 1 5 . "
If we can find that our warehouses are now and have
been since prior to the enactment of the Public Service Commission
Act operating under County Auditor permits, then it would be up
to them to voluntarily surrender such permits before the Commission
could assume j u r i s d i c t i o n .
Since we have the warehouses organized
we should be able to persuade them not to voluntarily submit to
such regulations which w i l l have the effect of limiting our freedom
to handle or not handle what we consider to be unfair goods.
It nould be true that even under the County Auditor
permit the warehouses would s t i l l , in e f f e c t , be Public U t i l i t i e s
although not so determined by Statute.
They would however be
under the common law (aee 67 Corpus Juris 449 p . 1 2 ) :
("A public
warehouseman as a public u t i l i t y
assumes an obligation or duty to the public
that e x i s t s as long as he continues as a
ubllc warehouseman.

In a practical sense the distinction would be that
i f operating under the Permit, the warehouseman, while l i a b l e
under the common law f o r discrimination in accepting goods,
would nevertheless not be bound by Statutory law and
his vulnerability to a law suit would be to that extent more
secure.

aspired October 31,1946. v * have had several meeting* with
the committee that represents the warehouse Association but
as yet have been unable to negotiate a satisfactory agreement.
At a special nesting hold for the ass&ers Tctebur 15,1946
the membership voted unanimously to serve stride notions on
the warehouses and to strike if necessary.
On OcTober 17,1946 Local Union #233 requested that strike
notices be served and have had notification by the Department
of Labor that the thirty day waiting period began October 2 1 ,

Conciliation Service D*-nertme*t in Indianapolis in which
ComolBSionar James S . Allen nresided-At that tlae the ComBittee
representing the Warehouse Operator* offered an increase of
tan (10) cents
hour which was one and one-half(li) eents
per hour over their previous offer. They also stated that
this was the final offer.
On November 6,1946 another special meeting was called for
the meebers and the second strike ballott was taken. They
voted unanimous to strike.

We have examined the By-laws of Local 233, Indianap o l l s , Indiana, and find them l e g a l and in compliance with
the International Constitution in a l l but the following
respects:
A r t i o l e VI, Section 2(a) provides that a member must
be present at the time of nomination t o be e l i g i b l e f o r
o f f i c e . This requirement i s not prescribed by A r t i c l e I I ,
Section 4 of the International Constitution and should be
changed. The Local should allow f o r members who cannot be
present by making provisions f o r suoh members to i n d i c a t e
beforehand t i n y w i l l accept i f nominated. We reocmmend the
f o l l o w i n g clause:
"Wo member shall be e l i g i b l e as a candidate
f o r o f f i c e unless he i s present at the meeting when ncminated or has indicated in w r i t ing in advanoe that he w i l l acoept i f nominated."

"Section 2 ( a ) :
This donation shall be paid
to the person whom the member has designated
as b e n e f i c i a r y , provided that such member has
n o t i f i e d the Seoretary-Treasurer in writing,
properly notarized, the name and address of
such person.
Provided, however, that from
such donation there shall f i r s t be deducted
a sum sufficient to pay for the burial of the
deceased i f the burial expense has not been
p a i d , or to reimburse any person or persons
who prove to the satisfaction of the Union's
Executive Board that he or they have paid
money for the burial of the deceased member,
after which any balance shall be paid to his
surviving w i f e ;
i f there i s no surviving w i f e ,
to his children;
i f he leaves no children,
to his parents; i f he leaves no parents to
any surviving brothers and s i s t e r s .
In the
event he leaves no such r e l a t i v e s , the donation
shall be paid to auch relatives as the Executive
Board shall decide are entitled to i t .
In the
case of a member who leaves no ascertainable
r e l a t i v e s , the Local Union shall Immediately
tatre charge of the case and arrange for a proper
burial of the deceased member.
The total donation in such case 8hall be the cost of the b u r i a l . "
The Local should note that we have consolidated Sections 2 ( a )
through 6 ( a ) .
Therefore Sections 7 ( a ) , 9 ( a ) and *!(a) should
be Sections 3 ( a ) , 6 ( a ) and 7 ( a ) .
Because of the prohibition in the Taft-Hartley Act
a g a ' n a t discriminatory action against non-union members. Article
X I I I , Section 1 ( f ) i s dangerous and should be changed to provide
for such a prohibition only In caaa the shop is under oontract.
