AMENDMENT TO SETTLEMBNT AGREEMDNT AND RELEASE
This Arnendrnent to Settlement Agreement and Release ("Amendment") is made
and entered into this
of Novembe r, 20l4,by Plaintiffs, for themselves and on
l4(au,
behalf of the Settlement Class, and Synovus, as provided in paragraph I29 of the
Settlement Agreetnent and Release datedNovember 10, 2014 ("Agreement").r
WI-IEREAS, the Parties entered into the Agreement on November lQ,2014;
WHEREAS, Section
VIII of the
Agreement speoifles that the Notice
to
be
provided to gettlement Class Members include Published Notice (in addition to Mailed
Notice and Lqng-Form Notice);
WHEREAS, paragraph T3 of the Agreement specifies the type of Published
Notice to be adrninistered by the Notice Aclministmtor;
WHEREAS, based on the completeness of the electronic data being provided by
Synovus relating to the identifrcation and acldresses
of Settlement Class Members, the
Notice Adlninistrator has recommended that the type of Published Notice to be provided
consist of banner advertisements placed on the internet instead of a single newspapel
advertisement; and
WHEREAS, thç Parties beiieve the Notice Administrator's recommendation
should be adopted ancl incqrporated into the Agreement,
NOW, THEREFORE,

Synovus agree to amend the Agreement as follows:
