SECTION 2 INTRODUCTION
CELLCO PARTNERSHIP, d/b/a Verizon Wireless as applicant, is requesting a Use
Pennit under Hawaii County Code, Chapter 25-4-12 for the construction of a new
telecommunication facility consisting of a new 120' steel monopole, on a 750 s.f. portion
ofa 5.371 acre parcel located at 14.4970 Kaimu Kapoho Road, Pahoa, Hawaii 96778,
TMK (3) 1-4-091:004.
The parcel is owned by Orchid Plantation Inc. The parcel is located within the State
Land Use Agricultural District and zoned AG-I0-A by County of Hawaii. According to
section 25-4-12 of the Hawaii County Zoning Code, this proposed use is pennitted within
the Agricultural Zoned Districts with the approval of a Use Pennit.
During the 2007 State Legislative Session, the legislature adopted Act 171, which allows
the construction and operation of wireless telecommunication facilities as pennitted uses
within the State Land Use Agricultural District. The County of Hawaii Planning
Commission continued to require a Special Pennit for the construction of a
telecommunication facility within the County Agricultural District until late 2009.
In early 2010, the County of Hawaii passed Bill 186 which amended the County Zoning
Code. The amendment requires that wireless telecommunication facilities in the RA, FA,
A and IA Districts obtain a Use Pennit from the Planning Commission before
constructed.
In accordance with the above said ruling, Verizon Wireless is requesting approval of a
Use Pennit.
SECTION 3 - PROPERTY LOCATION
The subject Property is a 5.371 acre parcel owned by the Orchid Plantation Inc. and
located at 14-4970 Kaimu Kapoho Road, Pahoa, Hawaii 96778, TMK (3) 1-4-091:004.
The property is accessed via Kapoho Kalapana Road. The proposed monopole and all
improvements is located in the eastern central portion of the subject parcel and is
comprised of a 25-foot by 30-foot cinder and grass-covered lease area. Access to the
proposed project site is thru a locked gate via Kapoho Kalapana Road. The surrounding
areas are cleared, grassy area with trees between 25' to 40'. The vegetation surrounding
the project site is not native, rare or endangered. A more complete discussion of the site
is included in the Institutional Consideration portion of this application.
SECTION 4 - PROJECT DESCRIPTION
Verizon is seeking approval ofa Use Pennit pursuant to 25-4-2 of the Hawaii County
Zoning Code for the Project, which includes installing a 120' monopole with twelve (12)

cabinets and an outdoor emergency generator will be installed within a 25' X 30' lease
area. The generator will allow for continued operations during power outages which is
critical for safety in times of emergency. Please see Exhibit "E" for propagation maps
prepared by Verizon.
The area of the proposed site is clear and grassy. An existing road from Kapoho
Kalapana provides access to the Owner's parcel. Except during the construction ofthe
proposed Verizon site, virtually no traffic is generated by the operation of the antenna
site, as it is a low-maintenance facility that is not continuously staffed. Except for
maintenance and repair, the Project is self-operating. Verizon Wireless technician
periodically monitors the transceiver radios, antennae and its appurtenant equipment.
There are no long-term traffic impacts resulting from this Project.
The tower will meet County's 100 mph wind load requirement and adhere to all FAA and
FCC regulations. Due to the short height and distance from any airport, lighting ofthe
pole is not required.
SECTION 5 - ADDITIONAL INFORMATION REQUESTED FOR
TELECOMMUNICATION TOWER APPLICATIONS
In accordance with the County of Hawaii Planning Commission, additional criteria and
documentation must be addressed in the establishment of a telecommunication tower.
1. Schematic Plan for Tower Development on the Big Island:
Currently Verizon owns and operates more than 75 communication tower throughout the
County of Hawaii. As a leader in Hawaii's telecommunication industry, Verizon Wireless
has an ongoing goal of providing a high level of service to all of our communities
including those in lower-traffic rural areas especially in Hawaii County. In order to
continue to meet the ever growing demands of the public as well as the private and
government sectors, it is often necessary to locate antenna facilities on agricultural
designated areas.
2. Subject Site's Role in Overall Plan:
The object of this site is to provide the infrastructure necessary for wireless coverage
throughout Kapoho Beach area as well as travelers along Kapoho Kalapana Road.
Currently there are spotty coverages along Kapoho Kalapana Road. The installation of
this proposed new facility will allow for Verizon Wireless Services as well as the colocation of up to 2 more additional wireless service providers. The facility will hand off
wireless signals to existing facility at Pahoa.
3. Building Plans:

All plans and specifications have been produced by state licensed engineers at Cascadia
PM. Structural Calculations and certificate of wind resistance for the proposed monopole
will be submitted along with applications for Plan Approval if our Use Permit is
approved. All Federal, State, and County regulations will be compiled with in the design,
construction and operation of the proposed tower. Please see Exhibit "D" for the site
plan.
4. Design Plan:
The new monopole is to be constructed of structural galvanized steel and will
accommodate Verizon's twelve (12) 8' panel antennas. The tower will also be design for
future collocations.
The monopole will not be lighted. There will be 6' tall chain link. fence with an entry
gate. The gate will be locked to prevent public access. The antennas will be inaccessible
due to the height of the tower. All hazard signs will be installed as mandated by the FCC.
5. Federal Aviation Administration Determination:
Verizon adheres to strict Federal Aviation Administration rules governing antenna
installation, maintenance, and safety to its facilities.
6. Federal Communications Commission Requirements:
Registration with the FCC is not required for this tower. However, Verizon and all
subsequent co-locators will be responsible for complying with the radio frequency
emission standards set by the FCC.
7. Statement of Non-Interference:
The proposed use will not interfere with the County of Hawaii public safety radio system.
8. Co-location:
Co-location of antennas or attachments will be made available to at least two providers.
Currently, Verizon will be the only occupant at the facility.
9. Feasibility of Using Existing Towers:
There are no existing cell towers within a 5 miles radius. Therefore, co-location is
impossible.
10. Justification for Height:

The proposed Verizon 120' monopole with antennas tip height at 124' will allow Verizon
to provide adequate wireless telephone service to the Kapoho Beach Residence and along
Kapoho Kalapana Road. The height will allow sufficient handoff of signals to existing
telecommunications towers at Pahoa
11. Landowner I Community Involvement:
I contacted Vacation Land Community Association and Kapoho Beach Lot Association.
Both Associations welcome Verizon to improve coverage in the Kapoho Beach areas.
As in accordance with procedures for filing a Use Permit request, all adjacent landowners
within a 500-foot radius of the site shall be notified and provided with information on all
application submittal and public hearing dates. Please see list of property owners in
Exhibit "D".
SECTION 6 - INSTITUTIONAL CONSIDERATION
A. State Land Use Classification:
The State Land Use classification of the subject site is Agricultural. According to HRS
Section 205-4.5 (IS), telecommunication facilities are permitted within the State
Agricultural District.
B. County General Plan:
The County of Hawaii General Plan Land Use Pattern Allocation Guide Map Designates
the subject area as Extensive Agricultural Land. The General Plan describes Extensive
Agriculture Land as "lands that are not capable of producing sustained, high agricultural
yields without the intensive application of modem farming methods and technologies due
to certain physical constraints such as soil composition, slope, machine tillability and
climate. "The General Plan also states the Economic and Land Use Agriculture element,
goals and policies which are in support of the request in the Use Permit Application.
These goals and policies are stated in the rationale portion of this request for approval
statement.
C. County Zoning Code:
The site of the proposed Monopole, antennae and related structures is zoned Agricultural
IO-acre (A-lO-A), by the County. Telecommunication sites are listed as a permitted use
under Hawaii County Code, Chapter 15-4-12, with the approval of a Use Permit.
D. Special Management Area
The proposed site location is located outside of the SMR and approximately 2 miles from
the coastline. Therefore, the County of Hawaii SMR rules do not apply.
E. Hawaii Revised Statutes. Chapter 205A. Coastal Zone Management Act:
The Subject property is located approximately 2 miles from the shoreline. The proposed
sue of the subject property will not negatively impact recreational resources, visual
resources to or form the shoreline, including access to and along the shoreline or coastal

ecosystems. Therefore no scenic or open space resources to the shoreline coastal view
plane or coastal ecosystem will negatively impacted by the proposed action. Please see
Section 9 of this application for a more complete discussion of Chapter 205A objectives
and compliance. The proposed project will not have any impact on access to the Coastal
areas.
F. Access:
The subject property is surrounded by the regional roadway systems and agricultural and
rural residential lots. The property is not used for access to the mountains or any
mountain feature, therefore no public access to these areas will be impacted by the
proposed action.
G. Historic District:
The subject parcel is not located within any Historic District. No historic or cultural
features will be impacted by the proposed action.
SECTION 7 - INFRASTRUCTURE CONSIDERATION
A. Traffic!Access
The proposed telecommunication site will take access off a paved road from Kapoho
Kalapana Road, through a locked gate onto an existing, approximately 800 feet long, 40'
wide dirt road into the project site. Minimal traffic will be generated by the proposed
action as site visits will occur from approximately one to four times per month utilizing a
van -type vehicle. There is adequate area approximately on to four times per month
utilizing a van-type vehicle. There is adequate area for the vehicle to park during these
visits. This is an unmanned facility that is self-monitored.
B. \-Vater Availability
Water is not required for the proposed telecommunication tower and related structures.
C. Sewage Disposal
There is no requirement for sewage disposal by the proposed telecommunication tower
and related structures.
D. Utilities
Electrical and phone services are available from HELCO and Hawaiian Telcom via
existing overhead lines from Kapoho Kalapana Road which cross the parcel to the project
site.
E. FirelPolice Services
Both services are currently available in the area. Both Fire and Police services are
located in the Pahoa area.

F. Solid Waste Management
Construction waste will be transported to the County's land fill by the contractor. No
household type waste in generated by the proposed use. Any green waste will be
disposed of on-site.
SECTION 8 - ENVIRONMENTAL CONSIDERATIONS
A. Surrounding Land Uses:
The 5.371 acre parcel encompasses a small area in southwest area of Kapoho. The areas
surrounding the subject parceVproperty consist ofundeveloped land and residential areas.
The areas surrounding the subject parceVproperty consist of the following:
North: Undeveloped land, beyond which is farm land
West: Farm land, beyond which is Kapoho Crater
South: Undeveloped Land
East: Residential areas, beyond which is the Pacific Ocean
B. Soil Characteristics:
The United State Department of Agriculture Soil Survey classifies the soil as Lava Flows,
Pahoehoe (rLW). This Land type consists ofbillowy, glassy face that is relatively
smooth, though in some areas the surface is rough and broken with hummocks and
pressure domes (USDA, 1973, Plate 130, p. 34).
C. Flora/Fauna:
The parcel is sparsely vegetated. There are grasses, dirt in the project vicinity. No rare
of endangered species of flora and fauna were found on the proposed tower site. A letter
of concurrence was sent to Ms. Loyal Mehrhoff, a UF Fish and Wildlife
D. Natural Beauty or Environmental Resources:
The County General Plan Natural Beauty element does not list the subject property or the
immediate area as being an example of Natural Beauty.
E. Archaeological Resources:
The General Plan Historic Sites element does not identify any archaeological resources
on the subject site. 1 0 Historic or cultural resources will be impacted by the proposed
action. The applicant's environmental consultant will send a letter to the State DLNR
Historic Preservation Division requesting a concurrence of "no effect" including
supporting documentation.

F. Cultural and Historic Resources:
No Valued cultural, historical or natural resources exist on the subject property and no
gathering is taking place. To the extend which traditional and customary native Hawaiian
rights are exercised, the proposed action will not affect traditional Hawaiian rights;
therefore no action is necessary to protect those rights.
G. Drainage:
According to the U.S. Corps of Engineer Flood Insurance Rate Map (FIRM), the subject
site is designated "X", an area outside of the 500-year flood plain.
SECTION 9 - RATIONALE FOR THE ISSUANCE OF A USE PERMIT
The Project is an "unusual and Reasonable Use "That Complies with the Guidelines
Set Forth in the BAR Section 15-15-95(b) and with the Criteria Set Forth in the
Planning Commission Rules.
A. The granting of the proposed use shall be consistent with the general purpose of
the zoned district, the intent and purpose of the Zoning Code and the County
General Plan:
1. HRS Chapter 205:
The granting of this request would promote the effectiveness and objectives of Chapter
205, Hawaii revised Statues, as amended. The State Land Use and Regulations are
intended to preserve, protect and encourage the development oflands in the State for
those uses to which they are best suited in the interest of the public health and welfare of
the people of the State of Hawaii. In the case of the Agricultural District, the intend is to
preserve or keep lands of high agricultural potential in agricultural use. The land is
presently used as an orchid farm. There will be no impact to the use of an orchid farm.
In recognizing that lands within agricultural districts might not be best suited for
agricultural activities and yet classified as such, and in recognition that certain types of
uses might not be strictly agricultural in nature, yet reasonable in such districts, the
legislature has provided for the Use Permit process to allow certain unusual and
reasonable uses within the Agricultural District.
The subject property is situated within the County Agricultural-l O-A acre zoned district.
The proposed telecommunication site would be situated on a 750 s.t: portion of the 5.371
acres parcel of land. The proposed use will take minimal lands out of the agricultural
inventory for this area and will not significantly affect the agricultural resource of the
area. The proposed use will be confined to the 750 s.t: portion of the subject property.
No additional surrounding lands are to the developed.

The proposed telecommunication facility will provide wireless service from the
intersection of Kapoho Road and Kapoho Kalapana Road; 2.75 miles west, better than 3
miles north to Makaukiu Point, east to Kapoho Bay, and south approximately .5 miles to
Pohoiki. Currently there are spotty or no coverages along the listed areas. The
applicant's policy to allow co-located antennae on its tower will allow service for at least
two wireless communication service providers.
The approval of the subject request would be consistent with and not contrary to the
objectives of the State Land Use Laws defined in Chapter 205.
2. DRS Chapter 20SA (Coastal Zone Management Act)
HRS Chapter 205A is the Coastal Zone Management Act (CZMA) for the State of
Hawaii. All lands in the State, including the mountain tops are in the coastal zone
management area under HRS Section 205A-l. The objectives of the CZMA is "to
preserve, protect, and where possible, to restore the natural resources of the coastal zone
of Hawaii" by "maintain, restoring, and enhancing the overall quality of the coastal zone
environment, including, but not limited to, its amenities and aesthetic values, and to
provide adequate public access to publicly owned or used beaches, recreation areas and
national reserves" by controlling development within an area along the shoreline, the
Special Management Area (SMA).
In addition the project is not contrary to the objectives ofthe CZMA as set out in HRS
Section 205A-2.
(a) Recreational Resources:

Historic resources are discussed earlier in this application in Section 8. Applicant is
currently seeking response fonn SHPO.
(c) Scenic and Open Space Resources: (1) Protect, preserve, and where desirable, restore
or improve the quality of coastal scenic and opens space resources.
Typically no proposed utility facility or telecommunications tower completely avoids
visual impacts without excessive expenses that prevent cost-effective delivery of the
service. In this case, the property is located approximately 2 miles from the nearest
shoreline and the proposed action will not significantly impact any coastal view planes.

(d) Coastal Ecosystems: (1) Protect valuable coastal ecosystems, including reefs, from
disruption and minimize adverse impacts on all coastal ecosystems.
This objective does not apply to land outside of the SMA nor to applicant's requirements
for this Use Permit. Therefore the project is not contrary to this project.
(e) Economic Uses: (1) Provide public or private facilities and improvements important
to the State's economy in suitable locations.
The economic impacts of the proposed project are consistent with the goals and
objectives of the General Plan as identified later in this application in Section G. Such
impacts are consistent with this objective.
(t) Coastal Hazards: (I) Reduce hazard to life and property from tsunami, storm waves,
stream flooding, erosion, subsidence, and pollution.
This objective does not apply to land outside ofthe SMA nor to the applicant's
requirements for this Use Permit. The subject property is classified as Zone "X" on the
FlRM, outside the 500 year flood plain. Therefore this project is not contrary to this
objective.
(g) Managing Development: (1) Improve the development review process,
communication, and public participation in the management of coastal resources and
hazards.
This objective does not apply to land outside of the SMA nor to the applicant's
requirements for this Use Permit. Therefore the project is not contrary to this objective.
(h) Public Participation: (I) Stimulate public awareness, education, and participation in
coastal management.
Per Planning Department's suggestion, the applicant contacted Vacation Land
Community Association and Kapoho Beach Lot Association. Both Associations
welcome Verizon to improve coverage in the Kapoho Beach areas. The applicant will
comply with all public notices requirement for the Use Permit process.
(i)
Beach Protection: (I) Protect beaches for public use and recreation.
This objective does not apply to land outside of the SMA nor to the applicant's
requirements for this Use Permit. Therefore the project is not contrary to this objective.
(j) Marine Resources: (1) Implement the State's ocean resources management plan.
This objective does not apply to land outside of the SMA nor to the applicant's
requirements for this Use Permit. Therefore the project is not contrary to this objective.

3. Land Use Commission Rules:
HAR section 15-15-01 states that the Land Use Commission's Rules "Shall be liberally
construed to preserve, and encourage the development and preservation of lands in the
State for those uses to which they are best suited in the interest of public health and
welfare of the people of the State of Hawaii." Based on the discussion above that
addresses the objectives ofHRS 205 and HRS 205A, the applicant believes the proposed
project is not contrary to the objectives sought to be accomplished by the Land Use
Commission Rules.
B. The granting of the proposed use shall not be materiallv detrimental to the public
welfare nor cause substantial adverse impact to the community's character or to
surrounding properties;
Land Use Commission Rules do not describe the impacts that must be considered in
determining weather a proposed use adversely affects the community's character and
surrounding properties. The applicant will discuss several of the potential impacts.
The subject parcel is long and rectangular, approximately 5.371 acres acre in size. The
property is zoned Agricultural (A-lO-A) and used as an orchid farm. The areas
surrounding the subject parcel/property consist of the following:
North: Undeveloped land, beyond which is farm land
West: Farm land, beyond which is Kapoho Crater
South: Undeveloped Land

The applicant believes the proposed use of the subject property will not adversely affect
the surrounding properties or their present use as the existing parcel is being used as an
orchid farm.
The operation of the cellular radio antennae have filter equipment and operate in the
ultra-high frequency radio wave band, between 800 to 2000 megahertz. The propagation
pattern of the antennae is directed towards the horizon for maximum effectiveness and
not downward. Thus the radio frequency energy near the base of the tower is minimal.
Reviews of available scientific literature by Environmental Protection Agency (EPA), the
National Institute of Occupational Safety and Health (NIOSH), the American National
Standards Institute (A SI) and the National Council on Radiation Protection and
Measurements (NCRP) have been conducted. None of these agencies have identified
harmful health effects associated with low power densities and the ultra-high frequency
of the cellular radio wave transmissions.
Furthermore, Section 704 of the Telecommunications Act of 1996 (47 U.S.C. 332 (c), as
amended) recognizes the absence of health hazards from cellular radio wave
transmissions and accordingly prohibits local authorities from regulating the placement of

ceilular towers based on environmental effects as long as those towers comply with the
Federal Communication Commission's guidelines. The subject tower is so designed.
The proposed monopole and its antennae will not interfere with the police radio band
because they are on different frequency wave bands and all of the receiving devices have
filter equipment. The police radio band is at the lower 450-megahertz wave band while
the wireless technologies utilize the 800 to 2000 megahertz wave bands. While the
microwave frequencies of police radio and some wireless service provider systems could
be in the same range (6 gigahertz), the FCC will assign specific microwave frequencies to
both the police department and the wireless service provider. Therefore, users of the
proposed telecommunication tower should not interfere with the police department's
radio or microwave frequencies.
The operation of the telecommunication tower does not generate noise or dust. There
will be minimal noise and dust generation during the construction of the required
improvements, but this will be mitigated by proper construction techniques, dust control
and limiting construction to daylight hours. All construction will be permitted and
comply with all applicable governmental regulations.
Typically no proposed utility facility or telecommunications site completely avoids visual
impacts without excessive expenses that prevent cost-effective delivery of the service. In
this case, an existing telecommunication facility will be replaced. The site is located
approximately 2 miles from the nearest shoreline and will not significantly impact any
coastal view planes.
C. The granting of the proposed use shall not reasonablv burden public agencies to
provide roads and streets. sewers, water, drainage. school improvements. and police
and fIre protection:
The project site will have electrical and telephone service via overhead lines from
Kapoho Kalapana Road which cross the subject parcel to the site. The project does not
need a supply of water. The traffic to be generated by the proposed telecommunications
tower is minimal with approximately on to four trips generated per mouth.
There area no floodways or drainage ways on the subject property and it is designated by
the FIRM map as Zone "X", outside the 500-year flood plain. No wastewater
improvements are required. All construction will meet the regulations and standards
established by government agencies.
No public expenditures for road, street, sewer, water, drainage or school improvement or
increased police or fire protection are required. The project will not burden any public
agency.
D. Unusual conditions. trends and needs have arisen since the district boundaries
and regulations were established.

The proposed modification to the existing telecommunications facility will not greatly
affect the purpose for which the land is designated. There will be minimal alteration to
the landscape.
Verizon Wireless seeks to provide optimum service to its customer while working within
