The celebration was a semi-formal winter wonderland. Guests were asked to wear black and white and the venue was adorned with snowflakes and silver snowy decorations. Cocktails and appetizers were served prior to the dinner and program followed by an evening of dancing and fun. The association, whose jurisdiction covers Mahoning County, Columbiana County and parts of Trumbull County, was formed as a not-for-profit organization in 1910. Currently, membership consists of 537 REALTOR® members and 61 Affiliate Members. The installation of 2016 President Sue Filipovich of Keller Williams Chervenic Realty was conducted by her father, Leon Turek of Burgan Real Estate. The installation of the association's President-Elect Wes Chandler of Zid Realty & Associates, Treasurer Maureen Cline of Agency Real Estate and Directors: Karen Ament of Burgan Real Estate, Sharon Flask of Keller Williams Chervenic Reality and reinstated Directors Charley Altof of Mayo & Associates, and Betty Belding of Gallagher Clark & Carney. Also installed was Affiliate Director Tony Carosella of Assurance Land Title. The Installation was conducted by the Ohio Association of REALTORS® 2016 Treasurer, Tiffany Meyer. Continuing to serve on the 2016 Board of Directors are Immediate Past-President, Dan Dull of Community First Real Estate, John Burgan of Burgan Real Estate, Debbie Parisi of Howard Hanna, Janice Stevens of Evenbay Real Estate and Joe Zidian of Zid Realty & Associates. The event honored 2015 President Dan Dull and retiring Directors, Debbie Barber of Altobelli Real Estate, Patrick Burgan of Burgan Real Estate, Chris Roman of Northwood Realty Services and Affiliate Director OJ Thomas of All Ohio Land & Title Agency. Participating in the traditional “Passing of the Gavel of Leadership to the Incoming President” ceremony were past presidents John Burgan (1981), Tom D’Amico (1982), Leon Turek (1986) Joe Zidian (1992), Paul Bevilaqua (2000), Karen Ament (2004), David Klacik (2010), Joan Zarlenga (2011), Debbie Parisi (2012), Charley Althof (2014) and Dan Dull (2015). The funds were raised from 50/50 raffles throughout the year as well as an annual community service project chosen each year by the incoming president. The YCAR Agent January 2016 6 NAR adds service requirement to ‘Realtor emeritus’ status for dues waiver Leadership service in local or state associations will fulfill qualification, but only through 2019 SAN FRANCISCO — It’s official: Forty years of membership in the National Association of Realtors is no longer enough to qualify members for “Realtor emeritus” status to have their national dues waived. As of 2015, in addition to 40 years as a dues-paying Realtor or Realtor associate, members will have to have put in at least one year of service at the national association as an officer, director, committee member, federal political coordinator, president’s liaison or regional coordinator to a country with which NAR has a reciprocal agreement. Through 2019, members will have met this requirement if they served at the local or state level. While NAR’s leadership team proposed allowing service at local or state associations to fulfill the requirement indefinitely, NAR’s Finance Committee disagreed. “The Finance Committee felt strongly that the requirement for one year of national service as part of the eligibility for national emeritus status, approved in May of 2013, was appropriate. The committee recognizes that, proactively, a phase-in period where state and local service is allowed in lieu of national is necessary but only for a five-year time frame,” the committee said. NAR’s board of directors and delegate body approved the change, which amended Article III, Section 10 of the NAR Constitution. Out of 1 million members, NAR currently has 8,149 active Realtor emeritus members, including 1,067 approved Monday by the board. The median age of a Realtor is 57. At least part of the reasoning behind the amendment was that many more members could qualify for a free ride in the near future. “A lot of our members are getting up there, completing the 40 years,” NAR CEO Dale Stinton said at the trade group’s midyear conference in May. “There was a concern that we could have 50,000 people” qualify to have their dues waived, Stinton said. NAR raised national dues by 50 percent in 2011, in order to generate funds for political advocacy, bringing national dues to $120 a year. A dues waiver for 50,000 Realtor emeritus members translates into a potential loss of $6 million in annual revenue. An Inman News article about the Realtor emeritus proposals last week prompted mixed reactions. “I began a career as a Realtor in 1977 and have always considered the ‘Realtor emeritus’ designation as a badge of honor. To require a one-year service provision seems a small price to pay for such a prestigious award,” said Paul Pastore. But David Strauss, who said he had been a NAR member since 1979, faulted what he said was NAR’s lack of commitment and loyalty to its members. “Like many dubious corporations, their word doesn’t mean too much and they are quite willing to renege on their word when it fits them. I am willing to bet that if they wanted to take the time they could come up with ways to offset the cost of the program without overburdening any member drastically. I believe it shows their true colors and concerns over their own compensation packages over the membership,” he said. 7 The YCAR Agent January 2016 Federal Spending Bill Awaits Presidential Signature December 18, 2015. Today the Congress has passed sweeping legislation of more than two-thousand pages to fund the Federal Government Fiscal Year 2016. The legislation is expected to be signed into law by the President when it arrives at the White House later today. The new legislation will put an end to the series of stop-gap funding measures known as “Continuing Resolutions” that have funded the government the start of FY 2016 on October 1, 2015. This new bill will expire in September 2016. The real estate related provisions are listed below: Federal Tax Policy Mortgage Debt Forgiveness: Authority extended for two years (2015 & 2016). Mortgage Insurance Premium Deductibility: Provisions allowing the deductibility of mortgage insurance premiums were extended for two years (2015 & 2016). Immediate Expensing of Business Equipment and Certain Real Estate: The expensing provision for equipment and certain real estate used by small- and mid-sized businesses is made permanent (section 179). The real estate includes leasehold improvements, certain restaurant improvements, and certain retail improvements. Moreover, the $250K cap on this qualified real estate (which is half that of personal property) is being removed starting in 2016, so all business assets (real and personal) will have the same $500K limit each year, and indexed for future inflation. Bonus Depreciation: extends bonus depreciation treatment for five years. Moreover, the provision now includes a new category called “Qualified Improvement Property,” which is defined as an improvement to the interior portion of an existing non-residential commercial building (except for elevators, escalators, or enlargements). Thus, most leasehold improvements will now generally be eligible for immediate expensing for the smaller and mid-size businesses and for bonus depreciation (50% expensing) for the bigger companies. Charitable Deduction: The expired provision that gives a charitable deduction for contributions of real property for conservation purposes is made permanent. Foreign Investment in Real Property Tax Act (FIRPTA): The bill includes two significant FIRPTA provisions. The first allows overseas investors to own up to 10% of a publicly-traded U.S. REIT (up from 5%). The second provision allows foreign pension funds to own U.S. real property interests without triggering FIRPTA withholding tax. These changes are estimated to bring billions of dollars of foreign investment into the U.S. commercial real estate market. Energy Tax Credit for New Homes: The expired credit of $1,000 to $2,000 for energy-efficient new homes is extended for two years (2015 & 2016). Business EB-5 Program Extended: A clean extension (no reforms) until Sept. 30, 2016. Net Neutrality: No amendments limiting implementation of net neutrality rules were included. Internet Access Taxes: The Internet Tax Freedom Act (ITFA), which bans state and local governments from imposing taxes on Internet access, expired October 1, 2015. The Omnibus extends the ban through October 1, 2016. American Communities Survey (Census Bureau): Does not convert the American Community Survey to voluntary status. Experts warn that making the ACS a voluntary survey would undermine the validity of the survey’s results. NAR and other private entities depend upon the ACS in their day-to-day business planning. NAR uses the Survey to benchmark its housing data series. Commercial Leasehold Improvement Depreciation: The 15-year depreciation period for leasehold improvements provision is extended permanently. Only t a two-year extension was expected on this priority item. Energy Efficient Commercial Buildings (Section 179D): The agreement extends for two years (2015 & 2016) the energy-efficient commercial buildings deduction. Internet Sales Tax Fairness: Advocates of Internet Sales Tax Fairness bills had hoped their language would be attached to the Omnibus, but it was not included in the package. Conventional Finance. Housing Finance Reform: Explicitly prohibits the sale, transfer and liquidation of the Treasury Department’s senior preferred stock holdings in the GSEs without legislative action; provision sunsets January 1, 2018. Mortgage Servicing Asset Study: Provides funding for a federal government study of the appropriate capital requirements for mortgage servicing assets. Study to examine the effects of Basel III and the National Credit Union Administration’s capital requirements on mortgage serving assets. Environment/Land Use Waters of the U.S. (WOTUS) Prohibition: No provision was included to prohibit the EPA from spending funds to implement the EPA’s Waters of the U.S. rule. Wildfire Funding: Additional funds were provided to fight wildfires, during the worst wildfire season in the nation’s history. Land and Water Conservation Fund (LWCF): The LWCF was funded at $450 million, with 50% provided to state and local governments for land acquisition and recreational activities. Federal Housing Direct Endorsement for Rural Housing: Today, every guaranteed loan must be individually reviewed by Rural Housing Service staff. This is time consuming, and slows the loan process. Both the Veterans Affairs loan guaranty and the FHA mortgage insurance program utilize approved private lenders for direct endorsement. Bill provision provides RHS with the authority to approve direct endorsed lenders which will accelerate loan processing time. HAWK Program: Continues exiting ban on HUD implementing the HAWK program, which would have allowed homeowners to participate in housing counseling and receive a reduction in their mortgage insurance premiums. Eminent Domain Seizure of Mortgages: Provision prohibits FHA and Ginnie Mae from insuring or securitizing a loan on a home that has been seized through eminent domain. This mirrors a policy of the GSEs, and is designed to eliminate the local practice of seizing mortgages via eminent domain authority in order to prevent foreclosure. Enhanced Income Verification for Rural Housing: In the multifamily arena, public housing authorities and assisted housing managers are required to verify the income for their subsidized residents. However, rural properties were not provided the same access to IRS and Department of Labor data as similar properties insured by HUD. Language in the Omnibus allows for access to the same income verification data for both agencies. This will streamline and ease burdens on rural assisted property owners. HOME Funding: HOME funding provides grants to state and local governments to produce affordable housing for low-income families. Eligible uses of HOME include downpayment assistance, rental assistance, rehabilitation of affordable housing, and development. The Omnibus provides $950 million for HOME funding, a $50 million increase over 2015. National Flood Insurance Program: Maintains funding levels for the National Flood Insurance Program and homeowner’s advocate, with small increases for flood mapping and mitigation activities. The YCAR Agent January 2016 8 One YSU Scholarship Available in 2016 The Youngstown Columbiana Association of REALTORS® (YCAR) established an endowment fund at Youngstown State University over 19 years ago. YSU will award one (1) $1,000.00 scholarship every year until this endowment fund is depleted. Criteria for receiving a scholarship: 1) Applicant must be a REALTOR® member of the Youngstown Columbiana Association of REALTORS® or the spouse or child of a REALTOR® member of YCAR; 2) Applicant must be a high school graduate with a 3.0 GPA or higher; 3) Freshmen entering YSU and YSU upper class students can qualify on a non-discriminatory basis; 4) Applicant must apply to YSU in spring or summer for upcoming September classes. Scholarship applications will be made available to all member offices of the Youngstown Columbiana Association of REALTORS® in January each year. Applications will also be available at the association office. Scholarship application deadline is April 25th annually. Applications are to be submitted to the office of the Youngstown Columbiana Association of REALTORS® located at 5405 Market Street in Boardman.
