Q. What do I do about having the tenant inspect my list if
I don’t have a forwarding address or they never show up
to check my list? The

A. If your tenant leaves without a forwarding address,
there is a good chance he doesn’t expect to get any of
the security deposit back. However within thirty days
you must mail either the security deposit or your list of
reasons why you are deducting from the security deposit
to the tenant’s last known address (even if that happens
to be your vacant unit). If there is no forwarding address
with the post office and your mail is returned, money
owed to the tenant, after ninety days, becomes property

Q. I met with my tenant within five days of him moving out
and went over my list of damages with him. When I got
the actual bills for repairing the damage, the cost was
more than I estimated. My tenant says I cannot collect
the difference because it has been more than five days
since we met. Is he right?
Q. How many days do I have to check for damages if the
tenant skips and I’m not sure when he moved out?
A. When a tenant moves out without notice you are not
bound by the three business day rule. You still must
inspect and make a list, but you have a reasonable
amount of time after finding the tenant gone to do
so. Nothing prevents you from withholding damages
for abandonment of the unit or unpaid rent from the
security deposit.
A. Fortunately, the tenant is wrong. Although the law
requires you to check the unit for damage within three
business days of a tenant vacating, and the tenant to
reinspect within five days to make sure your list is
accurate, you only have to give a reasonable estimate
of the cost of repairs. If more damage was discovered
when the carpet was cleaned or if the cost of rehanging
a door was more than you first estimated, you have the
right to charge the tenant for the cost overrun as long
as you are reasonable.

Kurt Gatch with Fox Appliance Parts has taught numerous classes in appliance repair. He boasts that his class comes
straight from the “school of hard knocks” but still provides a great technical training that covers all aspects of appliance
repair. This hands-on program provides students with the skills and experience to service all major appliances, from
dishwashers to ranges and refrigerators.
Be sure to bring any questions you have (even if it’s about a 20-year old appliance model!) and Mr. Gatch will be sure to
address each question before the course concludes.
