Community Shows Support For Pioneer Hardware

With time running out on
Pioneer Hardware to nail down
a rent deal with the City of Beverly Hills, residents turned out
in droves Tuesday to let the City
Council know just how important they feel the hardware
store is to the community.
Nearly 20 community
members, everyone from store
employees, to regular Beverly
Hills residents, to legendary entertainer Pat Boone spoke out
in support of the store that has
served Beverly Hills since
1926.
“I’m very proud of Beverly
Hills tonight as this is democracy is in action,” Boone said.
“We pay taxes in Beverly Hills
for service and (Pioneer) renders a service, a service we
need, want and treasure.”
The issue at hand deals
with the rent Pioneer pays the
City and an increase set to take
effect in January 2013. Pioneer
had been paying about $9,858
per month in rent, but that
number was began reducing
three years ago after construction on the Annenberg began,
as well as Crescent Drive closures to build the Crescent
Parking Garage.
After the street re-opened,
Pioneer owner Jeff Tilem says
his business was never able to
recovered. Pioneer’s rent was
reduced to its current rent of

Judge Orders Former BHUSD
Superintendent Remain On Probation

Superior Court Judge Stephen Marcus ruled today that former Beverly Hills
Unified School District Superintendent
Jeffrey Hubbard stay on probation. Hubbard, who was found guilty of two
counts of misappropriation of funds in
February and served four days of a 60day sentence, has been on probation
since June.
Deputy District Atty. Max Hunts-
man said that while Hubbard has completed his 280 hours of community
service and paid the $9,932 in fines and
$23,500 in restitution to the BHUSD,
Judge Marcus said it was a little early to
release Hubbard from his probation and
told him to come back June 7, 2013.
Hubbard’s attorney Salvatore Ciulla
told The Courier he was surprised by the
judge’s decision.

Beverly Hills Set To Become Bike
Friendly With Pilot Bike Routes

Beverly Hills took its first big step
toward becoming a “bike friendly” city
Tuesday with the City Council’s unanimous approval of a pair of pilot bicycle
routes.
The pilot bike routes were approved for Burton Way, between N.
Crescent Dr. and the east city limits,
and N. Crescent Dr. between Wilshire
and Sunset Boulevard’s.
The discussion of pilot bike routes
has been going on for months within
the City. The Traffic and Parking Com-
mission Bicycle Ad Hoc Commitee provided five proposed routes at its May 9
meeting: Beverly Drive, Burton Way,
Carmelita Ave., Charleville Blvd. and N.
Crescent Dr. From there, the council
narrowed their choices down to N.
Crescent and Burton.
Burton Way’s “Class II” bike lane
will be a 6-foot lane. The westbound
lane will begin by N. Oakhurst Dr. and
the eastbound lane will end near
Robertson Blvd.

completed today. Conservators
have passivated areas of corrosion on the sculpture, primed them
and repainted them as well as filling in minor areas of loss, also
due to corrosion. A protective
coating will be applied over the
existing bronze to complete the
project. The sculpture was gifted
to the City by W.D. Longyear.

Choicelunch Set To Start Serving
Beverly Hills Students On Monday

This Monday, Choicelunch will begin serving Beverly Hills students some
16 organic entrée choices daily, including sushi, following the Board of Educations 4-1 vote on Tuesday to approve an
amended agreement with the food service provider.
Board president Brian Goldberg
was the lone no vote, stating concerns
that the expense projections were overly optimistic.
The board tapped Choicelunch to
serve the K-8 schools last month after its
current provider, Chartwells, terminated
its agreement with the district, effective
today. At its meeting, the board voted to
have Choicelunch also provide meals at
the high school at a daily rate, billed to
the district, of $5.20 per meal for free
and reduced lunches, which BHUSD is
mandated to provide.
“I can’t wait for Choicelunch,”
boardmember Lisa Korbatov said. “And
I’m sorry about Chartwells.”

ROXBURY PARK —The Beverly Hills Architectural Commission viewed a rendering of the
Roxbury Park Community Center at its meeting, Wednesday. The new center, which will
be located on the same footprint as the current building, will include space for community
programs, a library annex, meeting rooms, exercise studio and a vending and lounge area.

to authorize a lawsuit against
Metro.
However, sources tell The
Courier that the effort has been
weak, late and half-hearted.
Brien is the Executive ViceChairman of the Department of
Surgery at Cedars-Sinai Medical Center.

of Cedars, as well.
The renowned medical
center is well known as an advocate for the Metro project.

School and that Brien’s appearance at the ceremony gives
Metro the wrong idea.
“While our community has
always supported the subway
in general, we have been very
clear in our opposition to
Metro’s current plan to tunnel
under our high school,” Rosenstein said. “I do not believe that
participating in the groundbreaking ceremony sends the
message to Metro that our
community is emphatically opposed to their current plan.

Krasne, who has pulled papers
to run again for council, said
that as a former mayor, she
couldn’t imagine representing
Beverly Hills and sitting sideby-side with Villaraigosa at a
Metro press conference. She
said Metro’s desire to tunnel
under Beverly Hills High is “totally unacceptable”.
“With the climate the way
it is, and with the bait and
switch that Metro has pulled,
there is no way I would sit next
to Villaraigosa as he puts our
school children in harms way,”

should be speaking as one
voice. Anything that would undermine that combined voice is
not acceptable.”
School board president Brian Goldberg denounced the
appearance, saying, “Anytime
an elected official from Beverly
Hills is seen speaking on behalf
of this project, it gives the impression to MTA and others
that our community is divided
regarding the issue of a subway
underneath instructional buildings at Beverly Hills High
School.”
“I’m disappointed that the
mayor didn’t use that public
opportunity to remind the MTA
board and the broader Los Angeles community about our
concerns regarding safety and
tunneling underneath Beverly
Hills High School. My contention from the beginning of
this has been that we have to
present a united front and
make it as difficult as possible
for Metro to tunnel underneath
the high school.”
“The only way for us to do
that is if we’re working in close
collaboration with our partners
at City Hall and this was not a
collaborative effort. Publically
praising a plan that is designed
to disrupt the educational
process of our students in Beverly Hills is not helpful and is
contradictory to all of the public comments that the elected
officials in Beverly Hills have
made.”
Brien is expected to run for
reelection to the Beverly Hills
city council in March.

“We’re burdening this
community with taxes,” she
said. “I’d like to pick struggles
that we might succeed in. I just
don’t think it’s the right time.”
Beverly Hills voters will
also likely be asked to accelerate bond sales for the $334
million Measure E bond passed
in 2008 to save over $1 billion
at a later date.
On Wednesday, the district’s Finance Committee said
it supported a parcel tax but
emphasized that in order to
succeed, the measure needed
to be messaged to the community in a cohesive manner that
underscored the City’s need to
have successful public schools.
“I assume there’s no slam
dunk that you’re going to get
two-thirds vote for 500 bucks,”
committee member Terry
White said. “At some point we
all have to come to grips with
our resources. But to continue
to wish for things we don’t
have, it’s just not sound management.”
The “elephant in the
room” is the California
Supreme Court decision of Serrano v. Priest in 1968. The
Court struck down local taxation to support local schools,
ruling that pubic K-12 education is a state responsibility and
that each child in California
constitutionally is entitled to
the same amount of money.
The constitutionality of parcel
taxes, which are now imposed
in Manhattan Beach, Palo Alto
and elsewhere, has never been
tested. If the parcel tax is
passed but then the Court demands equal money across district lines, Beverly Hills would
have its state funding reduced
by the amount of the parcel
tax. This issue was not brought
out at the meeting.
Goldberg said a parcel tax,
in concert with short-term employee concessions, a fiscally
disciplined board, and raising
funds on an annual basis, is an
essential to securing the district’s financial stability and
getting off the state’s dime.
“One of the ironies of
school funding is that we’re required to project the budget
three years out, even though
we never know month to
month what [Sacramento] is
going to do,” Chief Administrative Officer Dawnalyn Murakawa-Leopard said.

the heirs of Hannah Carter to
permanently halt the Regents
from selling the parcel they
contractually agreed to “maintain in perpetuity” in 1982. The
trial is scheduled for May and
the Court of Appeals is unlikely
to hear the University’s appeal
before August 2013.

the university behaved in a
“duplicitous” manner by failing
to notify Hannah Carter’s heirs
in 2010 when the Regents petitioned the Attorney General in
Alameda County Superior
Court to sell the Garden.
The garden and adjacent
residence were willed to the
University by former UC Regent Edward Carter in 1964
and had been listed for sale by
Coldwell Banker for a total of
$14.7 million.

‘Black Pearl’ On Its Way To St. Thomas
Fort Lauderdale-based Yacht Path
Marine Group has been awarded the
contract to transport the 270-ton, 140foot custom-build pirate ship “The Black
Pearl” from Barbers Point, Hawaii to St.
Thomas, USVI.
The replica pirate ship is most
famously known for its role in Disney’s
blockbuster Pirates Of The Caribbean
franchise.
The reproduction tall ship set is constructed over the hull of another vessel,
the “Sunset,” which was once used to
service the oil fields in the Gulf of
Mexico. Oil-rig service vessels are typically about 110 feet long.
“We are honored to have been
awarded this contract,” said Dennis
Cummings, principal and managing
director of Yacht Path. “We are one of
the few companies in the world with the
experience and knowledge to safely perform such a complex transport project.”
“We performed the loading of
‘Black Pearl’ utilizing both ship’s cranes
in a lift most commonly known as a
“tandem lift,” said Oliver Edwards, head
Loadmaster for this project.
The entire operational process –
loading, blocking, cradling, welding and
sea-fastening took approximately six
hours from start to finish. The M/V “BBC
Pearl” departed Barbers Point, Hawaii
on Nov, 12 for a three-week voyage to
St. Thomas.

Tissue-Engineered Human Large Intestine
Children’s Hospital Los Angeles
(CHLA) scientists, led by principal investigator Tracy Grikscheit, M.D., have for
the first time grown tissue-engineered
human large intestine. The effort is part of
ongoing projects in Grikscheit’s laboratory to help babies born with congenital
problems of the intestine or who have
part of the intestine removed soon after
birth because of complications of prematurity.
The human tissue-engineered colon
includes all the required specialized cell
types found in the human large intestine.
The research team grew the large intestine from specific groups of cells, called
organoid units that were derived from
intestinal tissue normally discarded after
surgery.
The organoid units grew on a
biodegradable scaffold. After four weeks,
the colon contained the differentiated
cell types necessary in the functioning
colon, and included other key components such as smooth muscle, ganglion
cells and components of the stem-cell
niche.
Identification of a human-specific
protein
confirmed that the
tissue-engineered
large
intestine grew
from
human
cells.
This
proof-of-concept experiment
is an important
step in transitioning tissueengineered
colon to human
therapy.

LAWSUIT
The lawsuit alleges that FTA did not sufficiently examine how the vibration and
noise caused from the tunnel would impact both the educational and community uses of the campus. The tunnel under the high school will run between 50
and 70 feet underground, but at some
place may be as close as 35 feet to the
foundations of the main instructional
building. According to Metro, the tunnels are generally 50- 70 feet deep
though in some areas extend to depths
of greater than 100 feet. This could
cause damage to the historic buildings
on campus and the educational environment of the school.
The complaint alleges in part, “FTA
violated NEPA by failing to independently evaluate the environmental impacts analysis conducted by Metro in
connection with the FEIS for the Project
– analysis which was based on faulty
and incomplete information . . . This tunneling will affect the character of the
campus, impair current school operations, and render impossible Plaintiff’s
long-standing, previously approved
plans to expand the High School . . . A
subway tunnel under the Campus jeopardizes the current school uses and the
planned future uses. In the short, mid
and long term, Plaintiff’s ability to serve
the community will be thwarted by a
subway tunnel under the property.”

Impact Statement (EIR/EIS) with station
location at Constellation Boulevard and
Avenue of the Stars in Century City and
a tunnel underneath Beverly Hills High
School. The FTA released their Record of
Decision, approving the EIS/EIR as
Metro submitted it, in August.
The court action names the FTA,
FTA Administrator Peter Rogoff, FTA Regional Administrator Leslie Rogers and
Secretary of Transportation Ray LaHood
as defendants. The District asserts that
the EIS violates the law. The suit seeks to
force the FTA to consider options for the
Century City station other than the one
that requires tunneling under the BHHS.
The lawsuit alleges the FTA failed
when it relied solely on the Metropolitan
Transportation Authority’s (Metro) conclusions. The District has demonstrated
multiple instances of inaccuracies and
unsupported conclusions in Metro’s
work. Federal law allows the FTA to
consider work done by a local agency,
such as Metro, but also requires a federal agency to conduct its own analysis.
Under the Transportation Act of
1966, Beverly Hills High School qualifies as a protected property. That means
the FTA must determine whether the
tunnel will negatively impact the campus, which the EIR/EIS said it would not.

CHLA’s Ford Helps Open Haitian Hospital

Los Angeles’ chief of surgery, returned
from Haiti last week where he took part
in the ribbon-cutting ceremony for the
new $17 million University Hospital of
Mirebalais, just north of Port-au-Prince.
But his presence was far more than
ceremonial, Ford has played a key role in
the creation and development of the badly needed medical center. For the new
University Hospital, Ford consulted on
resource allocation and development of
the trauma care and surgery practices.
Ford, also the vice dean of medical
education at USC’s Keck School of medicine at USC, has been tapped by the hospital and the leadership to recruit its
board of directors, develop standards of
surgical care (Ford was just elected to the
Board of Regents to the American
College of Surgeons and develop a medical education training program, in particular for pediatric medicine and critical
care of children and adults.
There is a critical need for pediatric
care in Haiti. He says in this country of
10 million, with 50 percent of the population under the age of 15, there are just
two pediatric surgeons, and they aren’t
even well-trained by American medical
standards. “We want to set a course of
excellence, reminiscent of a great hospital in the U.S.,” he says. ”And we hope to
replicate this elsewhere in the country.

Vice Mayor John Mirisch Talks About His Run For Re-Election
Beverly Hills Courier:
What did it mean to you to
have Lili Bosse with you lending support as you pulled your
campaign papers?
John Mirisch: It meant the
world to me because Lili is one
of the most caring, Community-minded people I've ever
met. I think we've been a mutual source of support for each
other and I was so honored that
she was the first person to sign
my papers. We understand that
the way business is done at city
hall needs to change. Lili is
willing to stand up and fight for
the residents and make those
changes, as am I, but we're
unfortunately very often outvoted.
BHC: Has pushing reform
in city hall been more of a
struggle than you originally
thought it would be?
JM: It's difficult; there are
tremendous entrenched interests. Within any institution of
this size, there's an inertia toward the status quo. The system is set up to protect itself
and perpetuate itself. It's a
source of frustration not to
have gotten the necessary leadership at the council level to
make these reforms.
BHC: What are you most
proud of from your first term
on the City Council?
JM: The fact that we created a Cultural Heritage Commission is one major source of
satisfaction. It will help preserve and honor our city's history and architecture. I got
quite a bit of push back on
that, but it's something that
was sorely needed. That's a
lasting legacy for our City.
We've also made incremental
progress when it comes to unsustainable pensions and bene-
fits for city employees, which is
absolutely necessary for the
city to achieve long-term financial stability. Not only have I
worked towards meaningful
pension reform with the employee relations policy committee of the League of California Cities, but I also have made
it clear to the council that we
absolutely needed to reverse
the trend of 40 years of the piling of a goodie bag of benefits
and entitlements, most of
which are not available in the
private sector. Things have gotten out of whack.
BHC: You've been beside
the school board and residents
in their fight against Metro.
Why has that been so important to you?
JM: We need to stand by
our schools and protect their
ability to serve future generations of our kids. It's not only
an existential question for them
but also one which deals with
the principles of good government and local control. Metro
has blown off our School District and City -- not to mention
numerous other communities it
is supposed to serve. The more
we have dealt with Metro, the
more we see how the organization and process is deeply
flawed. I'm the only candidate
running thus far who actually
has a child in our schools. My
son is a third-generation
BHUSD student who just entered kindergarten. He has another 12 years to go. This is
personal. I feel I was elected to
represent and protect our community, our kids and our City.
BHC: You've consistently
voted against utility rate increases and tax hikes. Can residents expect you to continue
that stance?
JM: Yes. That's part of demanding that we provide the
residents with great value for
money. It seems government at
all levels keeps treating residents and businesses like
ATM's. There's still so much
wasteful spending going on. If
we deal with that, we'd have
plenty of money to do many of
the things we'd like to do for
our city and our residents without jacking up rates or raising
the already substantial tax burden. I'm not someone who
dogmatically says "Don't ever
raise rates or taxes, no way, no
how," but if we're going to be
asking the residents for more
money, there needs to be a
darn good reason for it and we
need to demonstrate that we
are providing the very best value for the tax dollars we already have been entrusted
with.
Brian Rosenstein Discusses His First Run For City Council
Beverly Hills Courier:
How specifically has your
commissions
experience
helped prepare you for this?
Brian Rosenstein: My experience as a commissioner
has given me invaluable experience that will help be a
knowledgeable, well prepared,
sensitive and sensible councilmember. Working with residents closely on the Traffic &
Parking Commission was an
amazing experience that really
helped me understand the concerns of the residents and the
unique issues that effect our
different neighborhoods. The
Planning Commission is by far
the best experience in preparation for City Council. The Planning Commission is a lot of
hard work, but so rewarding in
that we really get to make a difference and help shape the future landscape of our community
BHC: What is the biggest
concern(s) you hear from residents when you are speaking
with them?
BR: As I’ve been walking
door to door and doing coffees, the biggest concern I hear
is about traffic, public safety
and our schools. I have some
ideas of how to reduce flow
through traffic in our residential neighborhoods. One simple one is just by putting up
signs on Carmelita and
Charleville that say “No thru
traffic 7-9 a.m. and 5-7 p.m.”
With just a little enforcement, I
bet those signs, which are
cheap to make, will help deter
commuters and reduce flow
through traffic in our residential neighborhoods. I think we
need to ensure that our public
safety remains the best and it is
a priority to me to make sure
that they always have the resources they need. I also want
bring our school resources officers and DARE program back
for our schools as soon as possible.
BHC: What are the three
biggest issues facing the City.
How do you plan to approach
those?
BR:The three biggest issues
facing the City currently are
our local economy and reinvigorating our business community, making sure we our fiscally responsible with our taxpayer dollars and the Subway.
As a member of the Chamber of Commerce’s Economic
Development Council and the
City Council Small Business
Task Force, I have developed a
keen understanding of local
economy and business community and what needs to be
done to fill our empty storefronts and help our city have a
thriving economy once again.
In regard to fiscal responsibility, I feel strongly that as our
economy improves and our
revenues improve, we must be
careful cognizant of our expenses and be prudent and prioritize based on the needs of
residential and business community. In regard to the Subway, I have always been and
continue to be opposed to
Metro tunneling under the
High School. As a ouncilmember, I plan to support the
School Board and the Council
in their fight to find an alternative to tunneling under BHHS.
BHC: Council votes these
days are often 3-2... how big a
problem is this and how do
you hope to change that dynamic if elected?
BR: I feel our City Council
needs an independent voice
that can be a consensus
builder. I feel strongly that not
only can I help bridge the divide that exists on the City
Council but also the divide that
exists between the City Council and our School Board.
BHC: What is your take on
City employee pensions? City
Treasurer Eliot Finkel has designated this as one of the
biggest financial problems the
City will have to face in the
coming years.
I agree with Treasurer
Finkel. I believe that pensions
are an important issue that
needs to be addressed in the
City. But I also believe that this
can be done in a fair and even
handed way through collective
bargaining and working together with our different organizations toward a common
goal that is the long-term financially security of the City. This
will benefit both the employees and our residents by avoiding future cuts to services and
furloughs. I believe there
should be a clear target or goal
that City wants to get to when
approaching these negotiations
and then work together with
the unions and associations toward that target or goal.
Former Mayor Nancy Krasne On Her Run For Re-Election
Beverly Hills Courier:
What is your take on how the
City has been run since you
last were on the City Council?
Nancy Krasne: The last two
years have seen a City Council
that has consistently shown a
lack of leadership from our
City Council majority. The issues are pressing and there has
been silence, passivity and
lack of representation on behalf of the residents. It’s confusing for the residents, business
people and also disheartening.
The elected officials all made
promises when then ran and
lost their voices when they got
into office. We need a Council
interested in finding solutions
through leadership and transparency with no hidden agendas. We can do better than we
have, the stakes are high.
BHC: What is the biggest
problem you see with the current City Council?
NK: This Council majority
shows a lack of courage, transparency, and accountability on
behalf of the people who put
them in public office. Our City
Council majority has been at
odds with our School Board
and only when we have one
voice, can we prevail. I proudly stood shoulder to shoulder
with the School Board against
the Metro plans to tunnel under our only high school. Fees
and water rates have risen excessively. Residents are angry
and confused. Courage, transparency, and accountability
are the attributes of what is
needed in responsible elected
officials. The crisis before us is
a definite Lack Of Leadership.
BHC: What are the three
biggest issues facing the City?
And how would you deal with
them?
NK: Lack of Leadership,
Fiscal Integrity and Transparency. We need a council that is in
harmony with the residents,
not themselves. We need a
thinking Council that will listen
to the residents, evaluate the
staff reports and make informed, honest decisions.
Whether it is about our pension plan, Roxbury Park or outrageous fees, we need to have
transparency in what is going
on at City Hall. The residents
deserve elected officials to lead
honestly, representing the residents’ interests not that of any
elected official. Without a line
item budget it is unclear where
the money is going. The City
put in new meters and now
look at the Water rates. We
have a City Budget that is unsustainable. Strong leadership
will help ensure a clear direction. Let’s look at our Schools
and Metro. Our City Council
majority was 100% silent until
residents blanketed our town
with lawn signs in outrage.
There is no margin for error in
this situation. Only when our
City Council and the School
Board speak in one voice can
we prevail. I remain steadfast
in supporting our JPA funding
in order to deliver the best education possible to our students.
BHC: How would you use
your position as a city councilmember to help the schools
and residents fight Metro's attempts to tunnel under Beverly Hills High School?
NK: My motto is one voice
and together we can prevail.
As a Councilmember I would
use my voice to represent the
city and school district. We
cannot let the Metro think of us
as divided and weak. I was in a
unique position, as a councilmember when this started. I
pleaded with the council to
hire an attorney in coordination with the school board, so
that we could speak as one
voice. The Council felt that
since we had no ligation pend-
ing, we didn’t need an attorney. I don’t hire attorneys to get
into a law suit, but to stay out
of litigation. The Metro must
run under a right-of-way (City
streets) as originally promised,
not under our schools or
homes.
BHC: Do you believe the
City staff is as transparent as
they can be with the residents?
Or can they improve in that
area?
NK: No, there is a great
deal of room for improvement
by demanding our City Manager and staff to be transparent.
All staff should serve at the discretion of a strong and transparent City Council. Unfortunately, not all staff has been
transparent with the residents
or the Council. It took the Beverly Hills Courier to get the list
of salaries that I had requested
for 4 years and publish them
before anyone was able to actually see the salaries.

WILLIE BRIEN, THE MAYOR OF WHERE?
This week witnessed the spectacle of our
own mayor, Willie Brien, standing with the
Metropolitan Transportation Agency to applaud
its planned subway tunnel underneath Beverly
Hills High School. The event was held near the
corner of Wilshire and La Brea in Los Angeles.
It was Metro itself which publicly bragged
about Brien’s presence on the dais with Los
Angeles Mayor Antonio Villaraigosa and Third
District Los Angeles County Supervisor Zev
Yaroslavsky (“If Beverly Hills doesn’t like it, you
can sue us”).
Last time we looked, Brien is mayor of
Beverly Hills. Beverly Hills’ schools are fighting
for the future of our high school against Metro in
both California and federal courts. The City
itself joined one of the lawsuits. So what gives?
Is Brien just being a good neighbor, or is his
loyalty elsewhere? Look at the photos. Listen
to the YouTube video of his speech and then you
decide.
His apologists try to explain this away,
claiming “we still oppose the tunnel under the
high school.” No, you don’t.
Against the votes of Vice Mayor John Mirisch
and Lili Bosse, Brien and partners Barry Brucker
and Julian Gold on the council, voted to fasttrack Metro core sampling in Beverly Hills, supported accelerated construction, and never said
one word when Metro switched its major staging
area from La Brea to La Cienega and Wilshire.
This is not “opposition.” It is complete support.
Add to that Brien’s appearance this week with
the Metro folks, and it’s now cheerleading.
We believe you will be as stunned as was
The Courier. We’re not stunned that he stood
with those who would damage our only high
school. We’re not stunned that he openly supports Metro against his own City. We were disappointed but not surprised that he refused to
oppose Measure J despite entreaties from our
school board and the overlooked minority communities of Los Angeles. What really stunned us
was that he gave up his “cover” crafted by him so
carefully over the past two years that he “is
opposed to the tunnel under Beverly High.”
That appearance and his own words end that
charade.
This newspaper learned over the past two
years from its investigations that Brien, joined by
Brucker and Gold, did everything they could
behind the scenes to back Metro against the
Beverly Hills Unified School District. This ran
the gamut from private meetings to hiring an
anti-school board PR firm, to spreading rumors
about the members of our school board, to refusing to join in the federal lawsuit against Metro, to
delaying any real opposition, and to the fasttracking of Metro testing. To our faces, they
hemmed and hawed and said they “were
opposed,” but behind the scenes – behind our
backs – they backed Metro. Now we can all see
exactly what they have done.
In response to our reporting, which was
based on Metro’s own press release, we’re told
that Brucker posted a hateful diatribe on a littlenoticed internet blog backing Brien. So, it
comes out.
Beverly Hills is not that naïve. We know
when someone’s trying to two-time us.
How in the world does anyone expect a
massive, arrogant public agency like Metro to
respect the borders, wishes, people, schools and
territory of a small city when that city’s own
mayor is out siding with that agency against his
own people? Every action (or inaction) Brien
has taken as a member of city council has caused
more litigation, weakened our City’s own position, hurt our schools, forced our school board to
spend money, and presented to Metro “a house
divided.”
So, what’s in it for him?
Will he now get an appointment from Mayor
Villaraigosa if Antonio becomes Secretary of
Transportation as has been rumored? Will he or
Brucker get a seat on a Democratic Party committee? Will he be appointed to some commission? Who knows?
(We also recall that when Brucker was
mayor, Villaraigosa would not even speak to or
correspond with him other than a “Dear
Constituent, thank you for your letter” response.
So why is Brien now up on the dais? What did
he promise to deliver?)
At the very least, this was bad form.
What Brien’s appearance and Brucker’s diatribe confirm, however, is that neither places the
interests of Beverly Hills High School and
Beverly Hills ahead of their self-proclaimed
“regional interests.”

WATER EVERYWHERE
AND NOT A DROP TO DRINK
In addition to being distressed and sympathetic with our fellow Americans east of us who have experienced the devastating
“Sandy,” tornadoes, floods, early frost and even deep snow, we
must feel a bit embarrassed as we bask in our salubrious perpetual summer. What did we do to deserve nature’s warm embrace
here? We simply listened to the siren call: “Go West, young man
– and woman and child.”
On one hand we bemoan the lack of rainfall in this, our
essentially desert area. At the same time a few drops send us
scurrying deep into closets for such rarely used accessories as
umbrellas, raincoats and galoshes. We read the news, looking for
some encouraging words about the number of inches of rain we
have had so far. There have been very few. Those of us who are
so minded watch the reports of dams and lakes which are drying
up and wonder if some day we shall be battling our neighbors for
those precious drops coming out of the few natural springs in
Southern Cal.
These concerns should induce us all not to waste water.
Suggestions? When you open the spigot, don’t let it gush on needlessly. Limit the time for bathing and showering. Soap up before
rinsing off. Consider modifying lawns and gardens to require less
water. Rock gardens can be beautiful, too.
Above all, bear in mind that we are in an arid area by choice
and must use discretion in order to avoid disaster. When you are
moved to say: “I’ll drink to that!”–try a little Manischewitz.
LETTERS TO THE EDITOR
I have lived in Beverly Hills since 1974 and owned apartment
buildings here much of that time so have occasionally weighed in
on matters affecting apartments.
Studies show that a master-metered apartment building,
where the owner pays the entire water bill, achieves a reduction
of 25 to 30 percent in water consumption when converted to individual meters, where each tenant pays his or her own water usage.
Why are there no laws in the desert-based cities, such as ours–or
at the state level–requiring the utilities to individually meter apartments?
For most of the last century since water utilities have existed,
this was problematic because it required each apartment to have
its own exclusive water line direct from a city’s water supply in
order to get a meter. Also, the meters had to be read visually by
humans so needed to be together in one easily accessible location.
Technology has changed that. In recent years, water meters
have gone electronic and gotten smaller–about the size and shape
of plastic tub of cottage cheese. The readings are transmitted electronically to the utility via phone line. Thus, they can be anywhere and no longer need to be publicly accessible to meter-readers.
This means they may be placed between apartments.
Therefore, a single water line can service multiple apartments and
the water utility can calculate the usage of each apartment by simply subtracting the reading on one meter from the reading on the
next.
The water utilities will fight this idea because it means they
must do more work while selling 25-30 percent less water. But
water is becoming in shorter supply with changes in climate, especially in the desert states, and this is an idea whose time has come.

I was thrilled that the skating rink is coming until I read that
Crescent Drive will be closed off, again.
The businesses on Crescent have seen a catastrophic drop in
sales from which they haven't recovered due to the previous closure of the street during construction of the Crescent garage.
Closing it again during the busy holiday shopping season will be
a disaster for them.
I still love the idea of the skating rink, but why don't they put
it in the City Council parking lot facing Santa Monica Blvd?
Councilmembers could easily park in the Crescent lot during
meetings and the impact on the businesses on Crescent will be a
lot less.

Regarding the Pioneer Hardware rent situation, the only reason the business has been there since being built in 1988 is
because the City needed a convenient hardware store.
This is not a cat and mouse situation where each side is trying
to improve its financial position and the City doesn’t care whom
the tenant will be.
Please let someone who understands the importance of having a good tenant “mix” handle this type of situation, instead of
someone trying to show how clever they can be.
If you can replace Pioneer with another hardware store, forget
I wrote this letter. If not, don’t be so quick to throw out “the only
game in town” as they say.
