Dear Sir and Brother:
With reference to your letter of June 2 4 , 1949, con
ceming Hennis Trucking Company, ve do not have an
agreement with that firm but they do operate into
Cincinnati. However, they do not maintain a dock
here and when they reach Cincinnati, the drivers
call our office for city drivers to make deliveries
and pick-ups and pay them our regular hourly city
rate.
As you no doubt are aware, this firm is located at
Winston-Salem, North Carolina, and the drivers are
members of Local No. 3 9 1 .

Gentlemen;
h r . Jones and ?<r. Krugel have asked me to recognize the Union as bargaining agent
for the tractors and/or trailers. This I an not required by lav.' to do and an not ^ '
going to do. I had just as veil recognize the Union as the sole salesman of all
tires and other equipment and supplies I have to buy.
.'he o.vncr of a tractor or trailer is a business man just like I am. Any and all
contracts I make for the use of a tractor or trailer rill be )iade with the owner
and not with the Union.
I have been leasing tractors and trailers from the o'vners with drivers furnished.
I shall continue to do this. If the Union rants these drivers recc^nized as Company employees so t e y can enjoy the seniority and other provisions of the contract
Mennis makes '.ith the Union, that is satisfactory with me, but I ao not and shall
not recognize these ^rivers as Company employees for tle purpose of relieving the
Leased Operator of thu expense of furnishing a driver with his equipment. Tiatever
Hennis has to pay that driver as salary or has to nay in the way of taxes on account of recognizing that driver as a Mennis employee shall be charged to the
Leased Operator. I shfll be ^lad to keep all of ny Leased Operators, but if they
can make a better deal sotucvhcre else it is their privilege to do so. I!o other
truck line has been rccuired by the Union to recognize the Union as bargaining
agent for the tractors and trailers and I do not thin!: it should try to force me
to do so.
I am comparatively new in business as an operator. Yru fellows know that. I also
a truck * r i v n . I am now trying to develop a truck line. lelievc me, it is a
hard job. I am not making any money. I have encpaixlcd rapidly and am heavily in
d^bt. ven this short work-steppage has hurt nc tremendously, nnd I n*v never
recover fron i t . I f , however, the Union sees fit to let you drivers sttrt pulling
freight again I will do my best to survive and treat all you fellows fair.
I m perfectly trilling to recognize the Union as your bargaining agent, but there
is no need of ue urkin.: a contract that I cannot survive under. Heither t.ill there
bv any need of ut{in; any kind of contract unless it is oouc s^on. Unless I can
use the eouipneut I have to cam <oney to or';e nay^cnts on it, I will h; ve to let
^ r . Heich and the trailer companies have it back.
In an effort to get going fgain, after nany oral conversations about ter*a and conditions of a contract, without getting one, I hfve reduced to writing a contract
that I am wi ling to sign with the Unten for you fellows, and have today S l i v e r e d
a copy to
jonts. A copy of it is attached hereto, .lead it and see if you
dont think it is f a i r . I understand it offers more than the Union has gotten
fron nty competitors or any other trucking canpeay in this itrte.
I hope you and the Union will tc<* fit to accept i t .
