the holiday season is here
W
ith every passing year,
we all seemingly try
to fit more and more
into our schedules the
last few months of each year. Even
with end-of-year schedule overload,
we’ve seen more and more volunteers
making Delivery Day for the Doc
and Gayle Young Food Drive an
annual tradition. In some cases it’s a
family affair as recently we’ve seen
volunteers get their families involved
on Delivery Day. We absolutely love
seeing everyone come out and support
our efforts in everything AAA does
as an organization, but this event is
especially important for what we are
able to accomplish as a team, while
giving back to our own community. We
help feed over 1,300 families in Austin
and this would not be possible without
the tireless efforts and man hours put
into this event by everyone involved;
especially our Food Drive Chairs, Kim
McGregor, Ben Wells and Stephanie
Naylor. This year’s Delivery Day will
take place on Tuesday, November
24th and if you can be there, we could
sure use your help! Perhaps more
importantly, the last day for you or
your company to contribute monetarily
to the food drive is Friday, November
13th with every dollar counting here as
we strive to make this event larger year
after year. As I’ve heard for years now,

dinner will taste even better. Join us
to help make this the most successful
fundraising year yet for the food drive!
Our Annual trade show took place
in October and once again we played
host to over 1,400 attending guests
that evening with over 170 exhibitors
in attendance! Congratulations to our
tradeshow chairs, Terri Needham,
P.S. Landscapes, and Sam Levassar,
Camp Construction, for putting on an
excellent show and continuing a strong
tradition of awesome magazine covers
by our Tradeshow Chairs! Without
a doubt a huge thanks is owed to all
our exhibiting vendors as well. The
costumes, enthusiasm and energy that
our exhibitors bring to our annual
trade show helps to make it an exciting
event to attend year in and year out; we
definitely couldn’t do it without them
and the effort that they put into this
event does not go unnoticed.
The next event that will be taking
place is our annual Holiday Gala
where we honor our industry’s shining
stars and chances are good that you
will know at least one of the finalists,
so come show your support and help
to recognize their accomplishments
from this past year. Each year, AAA
gives Professional of the Year awards
in seven categories: Property Manager

of the Year, Assistant Manager of the
Year, Leasing Professional of the Year,
Maintenance Professional of the Year,
Supervisor of the Year, Independent
Rental Owner of the Year and Supplier
of the Year. This year’s event will take
place on Thursday December 10th and
will be held at the Hyatt Regency.
Discounted registration costs will be
in place up until November 26th, so
register early and save some money.
During this time of the year
everything seems to start slowing down
for all of us. We make more time to
stop and smell the cinnamon pumpkin
flavored mocha chai latte frappuccinos
a little more so than we do at other
times of the year; and that’s definitely
not a bad thing. With temperatures now
comfortably under 100 degrees, the
holiday season just around the corner
and the year beginning to wind down,
I would like to take this opportunity
to say thank you to the countless
volunteers that help to make this a top
notch organization to be a part of. You
are without a doubt the heart and soul
of this organization and in the spirit
of Thanksgiving; I can say without
hesitation that I am thankful for all of
you.

Congratulations to the Solt Scholarship Finalists
CAM Solt Finalists
A
special tradition began in 1987: the implementation
of the James E. Solt Memorial Scholarship. Mr.
Solt, a Past President of the Austin Apartment
Association, was an exemplary role model with a particular
love of the skills required for on-site management and for
education. This fund was created to honor his memory
and promote education in the rental housing industry. The Solt Scholarship Fund offers recognition and scholarships
for worthy members and/or their employees who participate
in the Austin Apartment Association’s education programs. The scholarship is open to all AAA members who are interested
in attaining their professional designation(s). The application
consists of a short essay, resume submission, and brief
interview. The scholarships awarded pay for a portion of the
total cost of each designation course. Scholarship recipients
will be announced at the Holiday Gala, December 10 at the
Hyatt Regency Austin on Lady Bird Lake.

rental property owners

ultifamily property owners
in the City of Austin will
see a new Drainage Charge
appear on their November utility bills
and once received it will be their
responsibility to allocate and recover
the charge from multifamily tenants. A
property having five or more units is
considered a multifamily property. For
tenants living in duplex, tri-plex and
four-plex units, the Drainage Charge
will still be billed directly to them on
their individual utility bill.
The City’s Drainage Charge
is authorized by the Texas Local
Government Code and funds functions
related to reducing the impacts of
flooding, erosion and water pollution.
Under the City’s old system,
commercial and industrial properties
paid a Drainage Charge based on the
amount of impervious area on their
property and received discounts for any
storm water controls they had installed
while residential properties, regardless
of size, paid a flat rate of $9.80 per
month. Residents living in high-rise

Lease Addendum that can be used for
new and renewing leases to clearly
communicate how the City of Austin
Drainage Charge will be handled. The
TAA Drainage Fee Addendum does
provide that a nominal administrative
charge can be applied for the allocation
and collection of the Drainage Charge.
The City of Austin sent information
to each customer alerting them about
the revised Drainage Charge and
billing procedures. The City also
posted information about the new
change, (including a Drainage Charge
estimator and Frequently Asked
Questions (FAQs) document), in the
Watershed Protection Department’s
section at www.austintexas.gov.

Efforts continue to
house veterans

Austin
Apartment
Association is continuing its
efforts to help house veterans as
part of the national program known as
the Mayors Challenge to End Veteran
Homelessness.
The AAA role is to help find rental
housing owners and managers with
units for veterans and is working with
many housing experts and stakeholders
residential buildings were given a
discount and paid $4.90 per month.
The new Drainage Charge will not
include any discounts or adjustments,
rather will be calculated the same way
for everyone based on the amount and
percent of impervious area found on the
property such as rooftops, driveways,
parking lots, patios and walkways. It
is anticipated that the new calculation
method will result in a Drainage
Charge to multifamily residents that is
lower than the current charge.
As stated, multifamily property
owners will receive a Drainage Charge
on their water bill that has been
specifically calculated for the property,
and it will be their responsibility to
allocate the charge among tenants.
The allocation of utility services and
fees are covered under Section 7 of
the Texas Apartment Association’s
(TAA) Lease Contract. Unless
indicated otherwise, this section
provides that the resident will pay any
utility charges and fees. There is also
TAA promulgated Drainage Charge
including the Ending Community
Homelessness Coalition (ECHO).
ECHO is an organization dedicated to
planning, prioritizing, and developing
strategies to end homelessness in
Austin and this organization is ready
to partner with owners and managers
with units that want to participate in
the effort to house veterans.

in this effort will have access to a fund
created to cover some of the costs
associated with holding the unit for
a veteran as well as any minor unit
repairs needed prior to move-in.

In general, the process is
as follows:
• Property manager completes form to
begin the process.
• Property manager uploads their own
screening criteria or accepts the ECHO
Alternative Screening Criteria

to the property listing.

finding my passion

t all started the way everything
seems to start these days: on
Facebook. I saw a post by an old
middle school friend (because at
some point you tracked yours down too,
right?). She said how much she loved
her job and that they were hiring.
Fast forward a year and a half and
I am still in a profession that I never
really knew existed or thought I would
be in. I would guess no one reading this
now grew up saying, “I want to be in
Residential Management when I grow
up,” and that’s okay; I am glad I found it.
Curiosity is what led me to the industry
and it is what has me kept me hooked.
After just the first year with my
company I found myself achieving
awards. I like to think these trophies were
a result of my charismatic personality or
friendly demeanor, but they weren’t –
that was just a part of the whole. How
they pick the winners was based purely
on numbers and metrics, as I am sure
most awards given are. So, how did I
get to be so good at this role in relatively
such a short time? I do my job just like
everyone else I work with, so why did I
deserve this? I’d like to think my success
is because of one simple thing alone: my
love for this industry and my job. I care
and have a genuine passion for what I
do, and as a byproduct it produces better
results.
My passion, and that curiosity that
I first mentioned, a supervisor, and this

professional designation. (For those
unfamiliar with the SOLT scholarship
or professional designations, some

Being in a room full of judges for
an interview is no easy task, and I still
get nervous thinking about it. I was up
against people I knew were more active
in the Association than me. I was new
to imagine life 5 years from today, even
though we all should be. What role did
I want? I tentatively replied, “I want to
be a Regional Manager, I think. I think
I would really like that role; I don’t just
want my residents to be my customers,
but also my co-workers.” As I went on in
my answer, I started to see what I truly
wanted: I want to train my peers; I want
to educate people about this scholarship;
I want to inspire and motivate people
to love this industry as much as I do. I
think it is fascinating that people do not

realize the amount of energy and effort
that goes in to residential living. I myself
was naive about this industry before I
took my job.
In that interview they had asked me
about my involvement in the industry
& the classes that I had taken, what I
had done to educate myself, and while
I didn’t have some long impressive list I
noted that I wanted to do more and how,
even if I didn’t get the scholarship, I

seminars and classes. The 15 minute
interview ended rather quickly, but the
next 6 months went by even quicker.
Today I find myself not only
attending more classes, but also going
to Association committee meetings,
telling my co-workers about Association
happy hours, and encouraging office
involvement in community outreach. I
don’t simply look forward to going to
work every day -- it’s more than that. I
am excited by my future involvement
with Association activities. To think
how I may secretly spread joy by
recruiting volunteers to decorate baby
pools as donation containers, or creating
matching volleyball shirts that say, “If
you wanted a soft serve, you should
have gone to Dairy Queen.” While the
realist in me knows not everyone is
excited about those things as much as
I am, it is one of things that inspire my
passion for this industry and the Austin
Apartment Association. For those that
enjoy playing sports, drinking a drink
or “two,” decorating and bringing out
their creative side, or just getting out
of the office, I say, “Go for it!” Let the
association be your excuse.
Find your love, find your passion,
find what motivates you and gets you
excited to get up every morning. I’m sure
it isn’t spreadsheets, reports, clogged
toilets, or resident complaints and issues
(because we know they all have them).
It’s the feeling that you helped someone,
be it your co-worker or one of the many
new transplants to Austin. Get involved
outside your apartment community; care
beyond the entrance door and the hours
8 to 5, and you might just find another
passion like I did.

Suppliers are important liaisons to
the multifamily housing industry. This

each other. So why is it so hard
to get students to attend these parties?
Undergrads have a short attention span
and what little there is, is consumed by
their everyday activities. Today’s student
demographic is known as the ADHD
generation. Author Maggie Jackson
describes society and this generation
by saying “our techno-dependent, splitfocus, hyper-mobile and cyber-centric,
multi-tasking culture is creating not just
individuals, but an entire society with
attention deficit disorder.” (Jackson 113)
The key to having a successful event is
to provide something that will grab the
student’s attention, that is free, and is
readily available.”
In order to get a good showing of
students in attendance, you must think
like a student. What are their priorities?
Does the benefit out weigh the costs of
attending? The most critical problem is
creating an event that is entertaining and
appealing. It doesn’t matter if they can
get there, or pay for it, or if it fits into
there schedule; students still will not
show up unless it benefits them.
Successful events stem from
incorporating
general
mainstream
college student interests. A great
example is CollegeHumor.com, a
website that is specifically designed
to entertain the college student
demographic. Granted, there will
always be exceptions, but most college
students share common characteristics
that render them an easy demographic to
market to. These characteristics include
a short attention span, unintended
frugality, and a tendency to follow their
hormones. College/youth marketing is
no exception to the success of sex appeal
in advertising; all you have to do is look
at The Kardashian franchise.
As always, your budget is a critical
piece of your marketing plan. A costbenefit analysis can help determine if

either don’t have a job or if they do, it
is a part time job. Most students will not
attend if it is not free, with the exception

students don’t usually plan anything too
far in advance without it being a priority
to them. Besides festivities that require
a ticket purchase or an advanced RSVP
you should promote it the week of. It is
imperative that you do your homework,
so make sure you do your research
before solidifying the event date. Check
with the University calendar to make
sure that there isn’t a campus wide event
occurring also. Make sure that the date
does not conflict with popular student
organization dates, such as fraternity/
sorority mixers. Make sure you know
whom you are targeting and what you
want to get out of this event. Keep in
mind that you can’t and won’t please
everyone.

and your property, long after the party

of what your property has to offer. Get
your team members to wear their event
t-shirts the week of the gathering in
order to rouse enthusiasm.
Promoting a planned event to
students can be simple and effective if
you understand the demographic you are
marketing to. Remember that it can be
hard to attract awareness and keep them

So, how do you get the word out
there? Social media is the key to taking
advantage of the new hyper-mobile and
cyber-centric culture. Create an event on
Facebook and invite everyone you can
to join. Make sure you have total buy in
from your team members and encourage
them to help drive attendance. Having a
high number of members on Facebook
attending, lends credibility and curiosity
that will get others to RSVP yes. Have
your team members champion the event
by expressing enthusiasm on their
Facebook wall so that it shows up in the
news feed. Students will jump on the
bandwagon if you can manage to market
the gathering as the “hot spot.”
Twitter is another key element to
event marketing. If your property has a
Twitter account make sure to tweet about
the event the day before and a few hours
before the start time. If your property
does not have a Twitter account, consider
signing up for one because it is a great
way to communicate not only parties,
but to talk about leasing incentives and
showcase your property to residents and
non-residents. Recently there has become
a shift to visual social media meaning
that more and more communities are
starting to communicate visually with
their fans, followers and customers.
One of the most popular platforms
that will enable you to leverage the
power of this shift is Instagram. Make
sure to incorporate pictures and videos
promoting the gathering and during the
event as well. Having a limited lifespan
makes Snapchat the perfect tool to deliver
a call to action that creates excitement
and a sense of urgency. You can use a
resident party to encourage fans from
other social platforms, including your
website, to add your brand on Snapchat
and get their friends to add you as well.
You can track your new subscribers with
a simple hashtag that reinforces your
brand.
Besides social media, it is also a good
idea to list the event on your property
website to ensure maximum attendance.
You should have a list of your resident’s
email addresses and in addition to social
media outlets, make sure you email
them an invitation also. Encourage
them to invite their friends so that you
are promoting your property to as many
people as possible. College students are
more likely to attend something if they
are able to come in packs.
A way to incorporate traditional
and low cost marketing into your
planned event is flyering door to door.

community. I checked the Internet, however,
and found that you have a registered sex
offender living on your property.”
“Really. What makes you think that?”
“I am a prospective tenant. I do not
want to live at your community if you
have a registered sex offender there.
What are you doing about this?”
“Are you sure your facts are correct?
I’m not aware of any sex offenders
living on our property. I will look into
this. Do you want to leave your phone
number with me?”
“No. I will check the records again
if I have not found a suitable apartment
in the course of my search. You really
ought to do something about this sex
offender, you know, for they may commit
the same crime again.”
Consider yourself fortunate if
you have never been involved in a
conversation like this. Sadly, they are
occurring more and more frequently.
Alarmingly, the situation of an unknown
sex offender being an unauthorized
occupant on your property is more
common than you think.
According to the National Center
for Missing & Exploited Children as
of December 2014, there were 819,218
registered sex offenders in the United
States. As of October 7, 2015, there
were 1,379 registered sex offenders
living in the City of Austin. A search
of the database maintained by www.
homefacts.com for Travis County
showed 1,901 registered sex offenders
living in the county. A search of the
same database for Williamson County
showed 238 registered sex offenders
living in the county. For Hays County,
290 registered sex offenders were
shown to be living in that county. The
problem, as you can readily see, is both
noteworthy and troublesome.
How does one define a sex offender?
Sex offender is a general term used
to describe an individual who has
been convicted of a crime involving a
sexual act. Researchers have developed
classifications of sex offenders based
on offense patterns and types of victims
and offenses. These classifications
include rapists, child abusers, internet
offenders, and female sexual offenders,
among others. It is also a person who
has been adjudicated to be a sexually
dangerous person.
Sex offenses include sexual assault,
kidnapping, trafficking of persons,
compelling prostitution, and indecency
with a child by exposure or contact.
Other offenses include possession of
child pornography or promoting child
pornography. There are many more
than the foregoing. This list simply
scratches the surface of the types of
offenses which require registration by
the perpetrator as a sex offender.
The Texas Department of Criminal
Justice is responsible for the sex
offender screening tool used to
determine the level of risk a person
subject to sex offender registration poses
to the community. Not all registered sex
offenders, however, are required to have
a risk assessment. In addition, if one is
a registered sex offender due to a sex
offense committed in a state other than
Texas, a risk level may not be assigned,
or may be quite different than the risk
levels utilized in Texas.
The Adam Walsh Child Protection
and Safety Act is a federal statute that
was signed into law by President George
W. Bush on July 27, 2006. The Walsh
Act organizes sex offenders into three
tiers according to the crime committed,

and mandates that offenders continually
update their whereabouts.
Tier I sex offenders
Tier I sex offenders, convicted of the
least serious offenses in this statutory
scheme, are required to register for 15
years, and must renew their registration
once annually. Tier I is essentially a
“catch-all” category for sex offenses
which do not fall under the higher risk
Tier II or Tier III categories. It includes
both misdemeanor and felony offenses.
Tier II sex offenders
Tier II sex offenders are required to
register for 25 years, and must renew
their registration every six months. A
person previously convicted of a Tier
I sex offense, who is subsequently
convicted of another felony sex offense
(regardless of its tier), will be classified
as at least a Tier II sex offender.
For those with no prior sex offense
convictions, Tier II offenses will
generally cover the following felony
crimes under a state’s statutory scheme:
(a) offenses involving the use of minors
in prostitution; (b) offenses against
minors involving sexual contact; (c)
offenses involving the use of a minor in

a sexual performance; and (d) offenses
involving the production or distribution
of child pornography.
Tier III sex offenders
Tier III sex offenders are required
to register for life, and must renew
their registration every three months. A
person previously classified as a Tier II
sex offender, who is later convicted of
another felony sex offense (regardless
of its tier), will be classified as a Tier
III sex offender. Tier III sex offenses
are those punishable by more than one
year in jail and are comparable to the
following crimes: (a) sexual acts with
another by force or threat; (b) engaging
in a sex act with another who has been
rendered unconscious or involuntarily
drugged, or who is otherwise incapable
of appraising the nature of the conduct
or declining to participate; (c) sexual
acts with a child under the age of 12;
and (d) non-parental kidnapping of a
minor.
These are the recognized risk levels
for sex offenders in Texas. Generally,
a statement of the risk levels appears
on the databases frequently searched
to determine whether sex offenders
reside in a particular area. You may

also encounter the term “not available”,
indicating the offender is either not
required to have a risk assessment, or
the offender’s risk assessment has not
been reported to the Texas Department
of Public Safety.
A Tier I sex offender designation
suggests that person poses a low danger
to the community and will not likely
engage in criminal sexual conduct.
A Tier II sex offender designation
suggests that person poses a moderate
danger to the community, and might
continue to engage in criminal sexual
conduct. A Tier III sex offender
designation suggests that person poses
a serious danger to the community and
will continue to engage in criminal
sexual conduct.
The following information is
required to be placed in a jurisdiction’s
sex offender registry:
• Criminal History
• Date of Birth
• DNA Sample
• Driver’s License or Identification Card
• Employer Information
• Fingerprints

Keeping sex offenders
off your property is a two
pronged process.
First, in the application process,
applicants must be screened carefully
to avoid renting to the sex offender in
the first place. Second, if you discover a
sex offender is living on your property,
do your best to get them off the property
quickly. Removal of the sex offender

has been raised. Your next step would
then be to verify that the disclosure by
the applicant is accurate.
There are two helpful online web sites
for you to utilize. The first is for the Texas
Department of Public Safety, found at
www.txdps.state.tx.us. At the bottom of
that website’s home page, there is a link
for Sex Offender Registry Search. One
can search by name, address, zip code,
county and even an institute of higher
education. The site provides a photo
of the offender, risk level (if reported),
the date the sex registration would end,
and other useful information to properly
identify the person in question.
The second helpful web site is www.
publicdata.com. Photographs are absent
from this website. But you can access
the individual’s personal information
from their driver’s license. Data is also
available about criminal court cases
and their details. Reading the Public
Data information in conjunction with
the DPS information gives you the most
accurate overview. Always proceed
Some sex offenders may threaten
you with a discrimination complaint;
but the absence of a protected class for
registered sex offenders would rapidly
derail such a complaint.
At the bottom of the first column,
on the front page of the TAA rental
application, there is a box where rental
and criminal history of the applicant is
inquired about. In that box, the applicant
is asked: Have you, your spouse, or any
occupants listed in this application ever
been charged, detained, or arrested for
a felony or sex crime that was resolved
by conviction, probation, deferred
adjudication, court ordered community
supervision, or pretrial diversion?
A follow-up question is also asked,
inquiring about whether any of these
individuals have ever been charged,
detained, or arrested for a felony or sex
related crime that has not been resolved
by any method.
If there is a sex offense in an
individual’s past, the applicant is to
indicate the year, location and type
of each sex crime, other than those
resolved by dismissal or acquittal. If
you obtained positive answers to any of

Certain sex offender information
will not be made public, including data
containing the victim’s identity, offender’s
social security number, passport and
immigration documents, and arrests that
did not result in convictions. At the option
of the jurisdictions, they may also exclude
the name of an offender’s employer or
school.
A sex offender must, not later than
three business days after each change
of name, residence, employment, or
student status, appear in person in at
least one jurisdiction in which the sex
offender is required to register and
inform that jurisdiction of all changes
in the information required for that sex
offender in the sex offender registry.
Jurisdictions must also require a sex
offender to provide notice if he or she
is leaving the jurisdiction prior to the
move; and the sex offender must provide
new address information to avoid any
gap in his known whereabouts.
As useful as sex offender information
may be, there is no guarantee that it
is 100% accurate. Common names
may create confusion among many
different people having the same name.
Clerical errors, committed by persons
entering data, can also undermine
trustworthiness. The records maintained
in the sex offender registration database,
moreover, cannot be easily amended or
updated, even if errors are discovered.
from your property is obviously a
more challenging process. It may, in
fact, involve evicting the person with
whom the sex offender is staying. More
often than not, the sex offender who
resides on your property does so as an
unauthorized occupant.
There may be situations where a
resident does not realize a sex offender
is occupying their apartment with them.
If this is the case, they should be glad
that you have brought the matter to their
attention. The resident should want the
sex offender gone, for their own safety
and that of other neighbors, visitors and
guests. If they are not willing to cooperate
fully with you, you should have no qualms
about proceeding with an eviction.
You cannot evict the unauthorized
occupant sex offender without evicting
the hosting resident. That is just the way
it goes. Likewise, if the resident agrees
to cooperate, you will have to monitor
the cooperation with frequent inquiries
and unannounced visits to the apartment
to verify the offender is not coming
back, either temporarily or permanently.

with caution, especially with common
names, for there can be confusion and
possible mistaken identity.
From a fair housing point of view,
there is no protected class for sex
offenders or criminals in general.
There are no questions which are off
limits when it comes to attempting to
verify whether an applicant, resident or
occupant is a registered sex offender.
Some sex offenders may threaten you
with a discrimination complaint; but
the absence of a protected class for
registered sex offenders would rapidly
derail such a complaint.
What should you do
when you discover that a
sex offender is actually
living on your property?
First, verify the relevant facts. The
two web sites mentioned above will
enable you to determine whether the
sex offender identifies your property as

their residence. If you find that they are,
you should go to the rental unit to ask
questions and get answers about the sex
offender. More likely than not, the resident
will either deny that a sex offender lives
there, or will state the offender is not an
unauthorized occupant because they do
not live there permanently. You will likely
be told by the resident that the person
you say is the sex offender has the right
to spend the night on occasion. Since you
will be unable to prove when and how
often such overnight stays occur, you must
become proactive. Tell the resident that
you will begin eviction proceedings if the
sex offender comes on the property at all.
Note that paragraph 19.4 of the TAA
lease enables you to exclude from the
apartment community any guests or
others who have been violating the law,
violating the lease rules, or disturbing
residents, neighbors, or the owner’s
representatives. This right to exclude
would override the language in paragraph
three of the TAA lease which provides one
will become an unauthorized occupant if
they stay at the apartment for more than
______ consecutive days without the
landlord’s written consent, or more than
twice as many days in any one month. In
other words, you can keep an individual
off of your property altogether through
the provisions of paragraph 19.4 of the
lease.
If you plan to exclude an individual
under this lease provision, do so in
writing. Deliver that writing to the
resident who you believe is harboring
the sex offender. Make it clear that you
have the right to, and intend to, evict the
resident if they permit the sex offender to
be on the property at all.
When you have identified a sex
offender living on your property, promptly
deliver a notice of lease violation to
the resident in whose apartment the sex
offender is staying. Be specific about
what you expect to happen in response
to the notice. You want the sex offender
permanently removed, you want the sex
offender to stay away from the property
altogether, and you want the sex offender
to take your property’s address off of his
or her driver’s license, DPS registration
form, and any other document which
requires an address. You do not want
people to say a sex offender lives at your
property.
Evicting a resident for harboring a
sex offender will be a conduct based
eviction. The judge may be sympathetic
to a resident who is not the offender
themselves. You will want to take care in

assembling proper evidence to persuade
the court that the eviction is necessary
and appropriate as a breach of lease. To
effectively do this, you should have an
attorney. There are too many things which
could cause you to lose a case like this if
you tried to do it unassisted.
If you learn a sex offender
is living on your property,
you want to notify other
residents living in your
community.
There is a sample letter in the TAA
Redbook through which you can notify
your residents about a sex offender living
onsite. In the current Redbook, the letter
appears on page 713. There is another
form on page 716 of the Redbook entitled
Verification of Distribution of Notices to
Residents. In addition, on page 593 of the
Redbook, you will find an article entitled,
“What To Do If A Sex Offender or Other
Violent Criminal is Discovered Living
Onsite or Nearby?” Refer to each of these
resources as you contemplate preparing
and circulating a letter to your residents.
Extreme caution must be exercised
if you send such a letter. If any of the
information is incorrect, you will likely
have engaged in actionable defamation.
If you falsely accuse one of a crime,
the burden of proof on the victim to
establish defamation can be quite small.
Damages recoverable, moreover, could
be significant.
Most certainly, you want to avoid
identifying the individual who you believe
is a sex offender by name or apartment
number. Information on the DPS and
Public Data websites is available to
anyone, not just you. Provide the DPS web
address, www.txdps.state.tx.us, in your
letter. By simply using the street address,
without apartment number, an applicant
or someone living in your community
could discover information about the sex
offender, including photographs and a
physical description, along with details
about the crime which caused them to
register as a sex offender in the first
place. Bear in mind that the form from
the Redbook can be modified. There is
no legal requirement that it contain any
specific language. The goal is to alert those
who live on your property of a heightened
risk until the sex offender is gone.
Whenever you learn that a sex
offender is living on your property, your
risk is heightened. Between that date, and
the date the sex offender is permanently
removed from your property, you
essentially are holding your breath and
hoping that the sex offender does not

engage in criminal conduct, especially
sex related crime, on your property. If
this was to occur, and you had sent the
letter, your chances of avoiding liability
improve significantly. On the other hand,
if you do not send the letter, and something
bad occurs in the relevant time frame, you
may face liability for failing to alert other
residents of their heightened risk.
There is a saying intended to be
comical: “The only certainty in life is
death and taxes.” There is no certainty
that a sex offender will not commit any
sex related crime again. In that same
vein, there is also no certainty that one
who is not a registered sex offender will
not commit a sex crime in their future.
Outward appearances may suggest the
sex offender is a good person, who has
turned their life around. That appearance
may be accurate. You cannot take the risk,
however, that it might also be inaccurate.
If you choose to lease to a sex offender,
you place yourself at needless risk. If you
determine a sex offender is living on your
property, and do not aggressively seek
to have them promptly removed, you
are placing yourself at unnecessary risk.
The choice is yours as to the action you
will take. Never think, however, that you
have any degree of control over the action
any registered sex offender may take.
If you need further motivation, simply
