has a 90+ accuracy in predicting industry trends and events.
Among the publications he writes for are Wards Dealer Business Magazine,
Automotive Retail, F&I/Showroom magazine, as well as for ADM Community and
Dealer Elite online communities. He is also the author of the best-selling book, The Prosperity Equation,
where he reveals his secrets of what it takes to be a success in the business world, and is a highly

Dealerships are prime candidates for Federal Trade Commission (FTC) and the
Business Software Alliance (BSA) action. These organizations are identifying
and pursuing the risks associated with lax security and software licensing best
practices in dealerships. A recent action by the FTC found a that a dealership
did not take “reasonable measures” to protect customer data which was
accidentally shared online. The BSA, a nonprofit which represents key software
industry players such as Microsoft and Apple, has pursed enforcement action
against several dealers with settlements approaching $1 million. Join a dealership
technology expert for a frank discussion of the risks dealers face with security
and licensing. He will explore tell tale signs of security holes and copyright
infringement and suggest action to take today to protect the dealership.

While the desire to buy a dealership is based on economics, the decision to
sell a dealership is based on economics and the desire to retire, downsize or
move to a different activity. The metrics used must encompass, operations, past
and anticipated financial performance, real estate, and the reinvestment of
proceeds. The specific metrics used in any transaction may vary, based on buyer
and seller profiles. This session will provide the tools to evaluate a buy/sell
opportunity from both the seller and buyer perspectives. The metrics used by
different classes of buyers and sellers will be identified and defined so buyers
will know who is most likely to sell. The application of different metrics are
applied and the benchmark values used for evaluation will also be covered.

Sullivan v. Oracle held that an employer with “California based operations”
and out-of-state employees who work in California (even for a short time) must
pay those employees under California’s overtime laws. What!? Learn how the

With the issuance of the temporary Tangible Property Capitalization
regulations in late 2011, automotive dealers now have more options and
in some cases more concerns with respect to capitalizing and expensing
dealer image upgrades and improvements. The new regulations are lengthy
and cover many topics. The areas specifically relevant to dealers include the
sections addressing dispositions and repairs and maintenance. As dealerships
undergo mandated and voluntary image upgrades, a keen understanding
