6A—Elk Valley Times, Wednesday, October 12, 2016 Obits Continued from Page 5A Johnnie L. Sims, 90, of Elora, passed away Tuesday (Oct. 3, 2016) at Tennova Healthcare Harton in Tullahoma. Mr. Sims was born on Oct. 5, 1925 to the late Warren and Martha Clark Sims and was a United States Navy veteran of World War II. A sweet man that always had a positive attitude and smile on his face, he was an active member of Oaklawn Baptist Church while he was in good health. After a lengthy career, Mr. Sims retired from TVA, but later decided to go back to work with a finial retirement at the age of 81. In his spare time, he enjoyed gardening and bee keeping. He was born in a time of the greatest generation and knew what unconditional love was, as well as commitment and family. Mr. Sims was strong and brave, yet gentle. In addition to his parents, Mr. Sims is pre- ceded in death by his wife of 66 years, Annie D. Sims, whom he took care of until her passing three years ago; son, Eric Sims; brothers, Vernon, Boyd, Bob and Paul; sisters, Ilene, Ruth and Margaret. He leaves behind to cherish his memories, daughters, Sharon (Steve) Guntherberg and Karen Sims, both of Elora; grandsons, Chad Guntherberg of Elora and Craig Guntherberg of Huntsville; great- grandchildren, Rilan and Callie Guntherberg; sister, Barbara Britton; brothers, Clark Sims, David (Dixie) Sims, Woodrow (Judy) Sim, and James Robert Henshaw. He also leaves behind a host of nieces, nephews and other relatives. Funeral services were Friday afternoon at Moore-Cortner Funeral Home with interment in Elora Cemetery with military honors. Moore-Cortner Funeral Home in charge of arrangements. review and consideration,” said Alderman Gwen Shelton, noting that she had voted against the sale of the school property, but now, with the situation as it is, she sees the responsibility as being somewhat of a burden on the homeowners. The association spends approximately $400 a year maintaining the retention pond, which is basically the cost of having it mowed. “I think we’d be opening ourselves up to the next homeowners’ group wanting us to take up responsibility for things of this nature,” said Alderman Anna Catherine Cowley. “It’s private property,” said Alderman Danny Bryant, adding, “I don’t think we can do that.” Alderman Michael Whisenant noted that there were issues related to the property of which the city didn’t advise developers — “The city sold the property to the developers for $100 and didn’t tell them about these issues, so I do think it merits discussion,” he said. Underground drainage feeds into the property, other officials said. “It’s not a black and white issue,” Shelton said, adding that she was simply bringing the association’s request before the board. Other business Board members will also consider a $5,000 budget amendment to accommodate an early literacy grant that will supplement four positions and provide resources at Askins School. Also, the board discussed during the work session a contract with ESRI, a mapping software company the city is considering doing business with along with the county. Placement of the contract, which would call for a three-year commitment, was pushed back to the board’s November meeting, following additional review. A final point of discussion related to an appointment to the Fayetteville Board of Public Utilities. The city mayor noted it was his intent to again move Eddie Hall’s name forward for appointment to FPU’s board of directors. The seat up for appointment is currently held by Janine Wilson, who has agreed to serve another term on the FPU board. According to discussion, the proposed appointment will be delayed to December. be deemed guilty of a misdemeanor and fined up to $50. It also reads that each day the violation is committed constitutes a separate offense. “The ordinance applies to all signs in the city,” Seifert said. “I want people to know that I am available to answer any questions about the ordinance if they call my office Monday through Fri- day from 7:30 a.m. until 4 p.m.” Even holiday decorations are subject to the ordinance, but they do not require a permit. Seasonal displays fall under the temporary decorations section and cover things like the Host of Christmas Past, the Slawburger Festival and the Cruzin’ Downtown. According to the ordinance, holiday banners must be fastened to a wall, board or inflexible surface so that the wind cannot move it, or it can be hung in a vertically and firmly held at two opposite edges by horizontal brackets. Holiday decorations that are used to advertise the name of a product, service or business such as the privately-owned county fair are considered temporary signs and require a special events permit. “The small 18-inch prayer signs found in various yards are fine just the way they are,” Seifert said. “They do not solicit anything from anyone. They are only there to draw awareness and ask for prayer so I may have to move one if it is on a rightof-way, but I generally leave those alone.” The sign ordinance covers just about every type of sign conceivable in today’s times. To call the sign ordinance complex is an understatement. Seifert said that a representative of the state, Dan Hawk, helped officials draft the sign ordinance. Seifert can be reached at his office to answer any questions regarding the sign ordinance at 4332565. Johnnie Sims Dorothy Louise Reed, 85, of Balch Springs, Texas, passed away on Tuesday (Oct. 4, 2016) at her residence. She was born in Madison County, Ala., and was a homemaker. Graveside services were conducted on Friday morning in Shady Grove Cemetery, Toney, Ala. Gallant-Riverview Funeral Home is serving the family. Deed Continued from Page 1A Robert E. Lee school was once situated, over to Main Stream Development. Ultimately, after 10 of the anticipated 25 townhouses were constructed, the property ended up in bankruptcy, with Green Bank acquiring it. Green Bank then deeded responsibility for the pond to the association, but instead of 25 homeowners sharing the responsibility, only 10 share it now. “I think it warrants our Signs Continued from Page 1A days. After five to 10 days are up, I will remove it, and I usually hold it for six months so they can pick it up. I try to work with people and only use the court option as a last resort. The person would have to be defiant before I would go that route.” The ordinance reads that a violator can be issued a citation to municipal court, NOTICE OF TRUSTEE’S SALE WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated March 3, 2009, and the Deed of Trust of even date securing the same, recorded March 4, 2009, in Book No. TD624, at Page 73, in Office of the Register of Deeds for Lincoln County, Tennessee, executed by Brad R.
