Terms and Conditions Payment is for cash or good personal check to be paid in United States currency immediately after the sale. All payments for the sale must be made to the cashier of the sale. Any stop-payment order or check returned marked insufficient funds or no account or any other refusal of payment shall be deemed evidence of fraud on the part of the buyer. Buyers shall be responsible for all court costs, bank fees, etc. in order to make payment valid to Mid-West Hackney. Mid-West Hackney reserves the right to refuse any animal, vehicle or tack at it’s sole discretion for any reason or no reason. All prospective bidders are urged to carefully inspect tack or animals that they are interested in. All tack and animals are purchased “as it” and “where is” with all conditions and defects. Accuracy of the information on the catalog pages is the sole responsibility of the consignor. Auctioneer announcements shall take precedence over printed matter in the catalog. All sales are final at the fall of the hammer. The highest bidder is the buyer. If a dispute shall arise between two or more bidders, the animal or tack in dispute shall immediately be put up for advance bids. If there is no advance bid, then the animal/tack shall go to the person from whom the auctioneer recognized the last bid. The auctioneer’s resolution of all disputes shall be conclusive and binding on all parties. There will be no private selling of tack outside the sale unless a commission of 15% is given to Mid-West Hackney. Registration certificate of animals listed in the catalog as registered must be furnished by the consignor with a clear title of ownership. MidWest Hackney will withhold settlement for all sales until consignor delivers registration papers or purchaser agrees in writing to accept the animal without it’s registration papers. Transfer fees on all registered Hackney ponies that are sold on the sale will be paid by the consignor. Registration papers on all other breeds will be given to the buyer and it is their responsibility to pay all transfer fees. Registration papers will be sent to the buyer on all other breeds after all checks have cleared the bank. Mid-West Hackney reserves the right to decline any bid in it’s sole and absolute discretion, including but not limited to bids by intoxicated or disorderly parties, those who have defaulted on former purchases or any person who Mid-West Hackney believes is not a reliable or responsible party. Transfer fees on all other breeds will be sent to the buyer when all checks have cleared and it will be the responsibility of the buyer to pay all transfer fees. Anyone purchasing a Hackney Pony must be a member of the American Hackney Horse Society in order for the transfer to go through. You will be sent notice by AHHS if you are not a current member. Sale Incentive Any pony purchased on the Mid-West Hackney Fall Sale that is of futurity age and is not currently eligible for the Mid-West Hackney futurity will be offered the option to pay all fees on sale day to make the animal eligible for the 2015 futurity. Weanlings: $35.00 weanling fee, $10.00 mare nomination fee and $30.00 stallion nomination fee if stallion is not already nominated in 2014. Yearling: $70.00 Two Year Old: $105.00 Three Year Old: $140.00 Four Year Old: $240.00 All fees must be paid on the day of the sale. There must be a transaction recorded in the sale office between consignor and buyer. All fees must be paid in 2015 to keep the animal eligible for the 2015 futurity.
