SWFWMD RAI Responses PROJECT: US 17 from DeSoto C/L to CR 634 (Sweetwater Rd) COMMENTS BY: Robert Dasta; Patricia Frantz DOCUMENT: Environmental Resource Permit Application NO. 1 COMMENT PROJECT NO.: App. No.: 664926 RESPONSE BY: Robert Garrigues/Alex Aycrigg DATE: October 2012 RESPONSE Please provide documentation that show the proposed use of US 17 is a regional north-south principal arterial traversing Hardee Sovereign Submerged Land (SSL) is not contrary to the public interest County. This project involves the improvement of US 17 from the as required by Chapter 18-21.004(1)(a) F.A.C. DeSoto County line to CR 634 in Hardee County. A public information workshop was held on July 21, 2005 at the Zolfo Springs Community Center. A Public Hearing was held on March 30, 2006 at the Hardee County Agri Civic Center. Notification of the Hearing was achieved through publishing two display advertisements in the Herald-Advocate newspaper, in both English and Spanish, on Thursday, March 9, 2006 and Thursday, March 23, 2006 and two display advertisements in the Highlands Today newspaper, in both English and Spanish, on Sunday, March 12, 2006 and on Tuesday, March 21, 2006. A legal notification of the Hearing was published in the Florida Administrative Weekly published on Friday, March 3, 2006. Invitational letters were mailed to elected and appointed officials and invitational newsletters were mailed to over 550 property owners and interested parties within the study area. Location Design Concept Acceptance was advertised in the Tampa Tribune on July 29, 2006. Due to the extensive coordination with local governments, businesses, neighborhoods and the public throughout the study, there is no appreciable opposition to the project. A Type 2 Categorical Exclusion under 23 C.F.R. 771.117(d) was approved on July 11, 2006 by the Federal Highway Administration. A reevaluation in accordance with 23 C.F.R 771.129 was approved on July 6, 2012. A copy of the final Environmental Determination dated July 11, 2006 is included with this response as Attachment A. Since the project has undergone intensive scrutiny by both Federal and State agencies and public need has been demonstrated, the District has reasonable assurance that the activities to occur over sovereignty submerged lands are not contrary to the public interest. According to Chapter 18-21.004(3)(b), F.A.C, satisfactory evidence of sufficient upland interest is required prior to beginning construction; however, it is not required as a completeness item of any application when the applicant is a governmental agency proposing to construct bridges and other structures. The applicant, the FDOT, is in the process of acquiring right-of-way for the project. 4 Please provide the $595.00 non-refundable processing fee. [Chapter 18-21.009(1)(g), F.A.C.] As previously responded and confirmed with Mr. Cliff Ondercin on October 4, 2012, this fee may be waived for state agencies established pursuant to Chapter 20, F.S.
