MEETING DATE July 17 2007 SUBJECT Appeal of Planning Commission Approval of Special Conditional Use Permit No 2007 08 Page 2 of 4 BACKGROUND On June 18 2007 the Planning Commission unanimously approved 4 0 vote 3 absent Special Conditional Use Permit No 2007 08 This application is a request by CGM Development Company to establish a private dance studio a private exercise and dance club and a banquet facility that occupies four rooms totaling 13 126 square feet within the Golden Palms commercial development located at the southwest corner of Schaefer and Roswell Avenues This report is an appeal of the Planning Commission s decision to approve the project The appellant is Steve Ross with Krikorian Premiere Theaters Krikorian Section No 20 03 11 0 2 a f of a Planning Commission of the Chino Zoning Ordinance require an appeal decision to be filed with the Community Development Department with the appropriate fee within ten days of the Planning Commission action The procedures limit the subject of the appeal to those matters raised the Appeals public meeting They also require that minutes of Council staff report during the meeting be provided with the City ISSUES ANALYSIS The subject of the appeal is a request to impose conditions of approval to minimize impacts to parking on adjacent properties See Exhibit A As noted above the specific action being appealed must be raised at the meeting at the time the item is heard by the Planning Commission Krikorian did not specifically raise this issue at the meeting See Exhibit B He did raise parking issues related to a parking easement with CGM and requested a continuance to review all the parking information but he did not request that the Commission add a condition to minimize impacts to the proposed theater use as noted in his appeal application This is a legal technical issue that has been reviewed by the City Attorney Since the Planning Commission s action staff worked to better describe the parking s concerns raised at the impacts Planning Commission meeting In considering these concerns staff reviewed parking information from multiple sources including the Krikorian Theater proposed expansion and parking analysis submitted in 2005 the City s parking ordinance standards the Institute of Transportation Engineers ITE trip generation manual and CGM s project parking study In addition Krikorian has studied the CGM report statistics and provided their independent analysis Essentially staff s evaluation of each of the parking studies indicates that if Krikorian were to develop his project as envisioned there would be an overall peak hour 8 00 p m weekend Friday Saturday parking shortfall of between 200 to 250 parking spaces depending on which analysis is being considered This amount of parking shortfall would normally create significant concerns however there are several aspects to the parking issue as noted below that need to be considered to better evaluate the merits to address Krikorian of the appeal Schaefer Avenue Roswell and Grand Avenues as well Freeway bound the property owned by CGM and Krikorian the Chino Valley CGM sold a portion as COUNCIL MEETING DATE SUBJECT Appeal July 17 2007 of Planning Commission Approval of Special Conditional Use Permit No 2007 08 Page 3 of 4 of their property to Krikorian for the purpose of accommodating the theater expansion Subsequent to the sale CGM and Krikorian recorded a shared parking easement which covers the area sold and grants both parties the non exclusive right to park anywhere on either site There currently is no approved plan for the theater expansion The application for the theater expansion was originally filed in January 2005 but the applicant decided not to proceed with entitlements at that time More recently Steve Ross has been in discussions with staff about revising and resubmitting the theater expansion plans in the near future Given the absence of an approved plan for the the expansion staff believes it is not appropriate to restrict the CGM use because timing of the theater expansion is unknown and may never be realized propose theater expansion does occur the analysis indicates that a significantly higher demand of the available parking at the peak period is created by the Krikorian site as compared to the CGM site There are 907 parking spaces within the project area 405 on Krikorian site 324 on CGM site and 178 in shared parking area The parking analysis from CGM suggests that there is a peak parking demand for both uses of 1 116 parking spaces which creates a parking shortage of 209 spaces CGM s portion of the peak demand is 372 and Krikorian s portion of the peak demand is 744 spaces spaces 33 3 In essence CGM can accommodate their parking demand using the 66 7 parking available on their site and only a small portion of the shared parking area 27 Comparatively the Krikorian expansion would need all of the on the theater site all of the parking in the shared parking area and 50 parking of the parking on the CGM site This leads to the question as to which entity to Staff believes should have priority the spaces within the shared parking area that it is not reasonable to further restrict the CGM use without the ability to also take into account the specific details of the expanded theater operations at this If the time approved Special Conditional Use Permit for the dance banquet facility already has a condition of approval that requires a parking management plan in In response to the Krikorian s conjunction with any special event permit concerns noted above CGM has submitted a letter that parking management activities Le valet or offsite parking will be implemented to minimize the impact on the shared If and when Krikorian submits a new parking area Exhibit C theater proposal staff will work closely with him to explore ways to facilitate the theater expansion while at the same time reducing the parking impacts to the extent practical The In summary staff recognizes the benefits of the potential theater expansion as well as the dance banquet facility and believes that it is important that the parking demand is Neither party has managed effectively for both developments to be successful exclusive rights to parking within the project area and so it is necessary to consider the demand that each development is creating to determine how the parking THE APPEAL 1 The City Council finds that the subject of the appeal is a request to impose conditions of approval to minimize impacts to parking on adjacent properties See Exhibit A The specific action determine if adjustments are warranted to as to attract and retain a solid workforce typically reviewed on an annual basis to keep pace with cost of living increases as well are ISSUES ANALYSIS survey data was collected the Consumer Price Index was reviewed and From these various internal among City position classifications were analyzed a determination was made that adjustments in employee compensation are sources appropriate These modifications to the current salary and benefits afforded to the Current salary equity affected employees take into the City s budget have on consideration the financial impact their implementation will The recommended changes are codified in Resolution Nos 2004 049 and 2004 050 which are attached and which upon adoption will implement compensation
