BACKGROUND
On June 18 2007 the Planning Commission unanimously approved 4 0 vote 3 absent
Special Conditional Use Permit No 2007 08 This application is a request by CGM
Development Company to establish a private dance studio a private exercise and dance
club and a banquet facility that occupies four rooms totaling 13 126
square feet within
the Golden Palms commercial development located at the southwest corner of Schaefer
and Roswell Avenues
This report is an appeal of the Planning Commission s decision
to approve the project The appellant is Steve Ross with Krikorian Premiere Theaters

ISSUES ANALYSIS
The
subject of the appeal is a request to impose conditions of approval to minimize
impacts to parking on adjacent properties See Exhibit A
As noted above the specific
action being appealed must be raised at the meeting at the time the item is heard
by the
Planning Commission Krikorian did not specifically raise this issue at the meeting See
Exhibit B
He did raise parking issues related to a parking easement with CGM and
requested a continuance to review all the parking information but he did not request that
the Commission add a condition to minimize
impacts to the proposed theater use as
noted in his appeal application This is a legal technical issue that has been reviewed
by
the City Attorney
Since the
Planning
Commission
s action staff worked to better describe the
parking
s concerns raised at the
impacts
Planning Commission meeting In
considering these concerns staff reviewed parking information from multiple sources
including the Krikorian Theater proposed expansion and parking analysis submitted in
2005 the City s parking ordinance standards the Institute of
Transportation Engineers
ITE trip generation manual and CGM s project parking study
In addition Krikorian
has studied the CGM report statistics and provided their independent
analysis
Essentially staff s evaluation of each of the parking studies indicates that if Krikorian
were to
develop his project as envisioned there would be an overall peak hour 8 00
p m weekend Friday Saturday parking shortfall of between 200 to 250 parking spaces
depending on which analysis is being considered
This amount of parking shortfall
would normally create significant concerns however there are several aspects to the
parking issue as noted below that need to be considered to better evaluate the merits
to address Krikorian

of their property to Krikorian for the purpose of accommodating the theater
expansion Subsequent to the sale CGM and Krikorian recorded a shared
parking easement which covers the area sold and grants both parties the non
exclusive right to park anywhere on either site
There currently is no approved plan for the theater expansion The application
for the theater expansion was originally filed in January 2005 but the applicant
decided not to
proceed
with entitlements at that time
More
recently
Steve Ross
has been in discussions with staff about revising and resubmitting the theater
expansion plans in the near future Given the absence of an approved plan for
the
the
expansion staff believes it is not appropriate to restrict the CGM use because
timing of the theater expansion is unknown and may never be realized
propose theater expansion does occur the analysis indicates that a
significantly higher demand of the available parking at the peak period is created
by the Krikorian site as compared to the CGM site There are 907 parking spaces
within the project area 405 on Krikorian site 324 on CGM site and 178 in
shared parking area The parking analysis from CGM suggests that there is a
peak parking demand for both uses of 1 116 parking spaces which creates a
parking shortage of 209 spaces CGM s portion of the peak demand is 372
and Krikorian s portion of the peak demand is 744 spaces
spaces 33 3
In essence CGM can accommodate their parking demand using the
66 7
parking available on their site and only a small portion of the shared parking
area
27
Comparatively the Krikorian expansion would need all of the
on
the
theater
site all of the parking in the shared parking area and 50
parking
of the parking on the CGM site
This leads to the question as to which entity
to
Staff believes
should have priority
the spaces within the shared parking area
that it is not reasonable to further restrict the CGM use without the ability to also
take into account the specific details of the expanded theater operations at this
If the

The
City
Council finds that the
City Council finds that the concerns raised by Krikorian regarding parking
impacts from CGM s dance banquet facility are not justified because the
analysis indicates that the Krikorian proposed site as compared to the CGM
proposed site creates a significantly higher demand on the available parking
at the peak period Therefore it is not appropriate to require modifications or
restrictions to the dance banquet facility

And I could n

conclusion basically wha
appening is they are requiring more with this use it does require more
peak parking demand later in the evening that is consistent with Krikorian but they re within their
parking easement allowance or parking shared parking allowance Staff really doesn t feel that there
is enough to warrant much concern of this letter
We re more than willing to work with the CGM
Group to come up with a strategy that might facilitate get them all three together and say with the
City of course and say maybe there s a management plan where we could work with CGM to park

they re the qualified member Put it this way So when they come they bring their friends we don t

hard time

don t want to approve anything that is going to
and I am concerned about the senior condos as well
this as
Chiang If I may add something Actually we look at
ther
then allow people to learn dance ballroom dance and for

you know all senior

But you know
hese
ofdances
ent types
including you
e envision
all sorts of st

And

so
Plus
we re
selling
it s kind of hard for
conceptualize
what this is
us
going
e re
to kind of visualize how this is
having a hard
get
to end up
a
as
this could just be you know a bunch of senior
party And we re not sure where you know
g to have exercise lessons
r us
beer and wine
I think to
going
fencing
to
play
yoga
so
out in that
time with here
Actually there are two components One we emphasize on the dance
And on the other side I think we try to
dance lessons group practice
And for the hours stuff like that it s more
use this as especially in the evening a banquet facility
are
two
two
front ofthis business concept I believe
geared toward banquet facilities Because there
as

confusion
comes
from

In the event that the

COUNCIL MEETING DATE JULY 17 2007
SUBJECT NAMING OF NEW PARK SITES
PAGE 2
BACKGROUND
As
stipulated in the College Park Development Agreement SunCal Companies is required to
construct a number of neighborhood park sites in lieu of paying park fees as a condition of
the College Park development project
Further as adopted by the City Council SunCal is
required to follow specific design guidelines for parks that include elements and themes in
order to blend the academic environment of Chafffey College with the community creating the
feeling of a college town The first park developed as part of the Phase I development of
College Park is a three acre site located on Eucalyptus Avenue Per the design guidelines
the park was designed with an astronomy theme and incorporates a series of concrete
spheres that represent our solar system s planets
seating and picnic areas play structure etc
in addition to
typical park
elements
ie
the City is in the process of designing our first equestrian facility to be located
the northeast corner of Mountain and Edison Avenues
The concept plan includes an
exercise arena round pens wash racks parking lot landscaped areas and the like Pending
Concurrently
on
design completion
construction of this site should be
completed by Spring
200S
ISSUES ANALYSIS
The
City
park naming guidelines allow a park or facility to be named after an individual living
provided a significant contribution to the development or improvement
of the quality of life in the City such as Ruben S Ayala Park Fred Aguiar Civic Square
Further park site names can be based on themes that characterize the individual park sites
such as neighborhood street names or significant site landmarks or vistas such as Liberty
Park Walnut Park Mountain View Park
The naming of the parks thereby becomes an
of
a
integral part
establishing specific identity for the individual sites
or
s
deceased who has
The
City s park naming guidelines provide a number of steps that are followed during the park
naming process First a list of potential park names is compiled from suggestions submitted
The suggestions are then forwarded to the
by the public City staff and the developer
Community Services Commission for review The Commission s final recommendation is then
reviewed by City Council prior to final adoption
However during the College Park
construction
neighborhood park
process the developer named the site Constellation Park and
constructed a monument sign on the corner of the park
The developer thought that the
approval of the College Park design guidelines authorized them to name the park site as long
as they followed the design guidelines
A
Services Commission sub committee was convened to review this issue as well
several names recommended for consideration for the Mountain Edison equestrian site At
their June meeting the sub committee recommended the following names to the full
Commission for consideration
Community
