year this event symbolizes the unity of
LIBI and provides

our leaders. This
year we honored
our past President Artie Cipoletti and Associate of the Year, Denise Angiulo and it was
our pleasure to recognize them both for
their leadership and tireless dedication to
our organization. The Dinner Dance was a
huge success and very well attended. We
are all looking forward to next year’s event,
the spectacular LIBI 75th Anniversary Gala.
For over 74 years LIBI has been providing
for the housing needs of Long Islanders.
74 years ago the issues were more about
production, and how to meet the housing needs of our communities. Back then,
25,000 permits were issued in a typical year!
Single family homes popped up throughout Nassau and Suffolk. Now, we are still
challenged to meet the housing needs of
our community by providing more diversified housing stock in multi-family units,
Mixed Use buildings and “workforce housing”. Our latest challenges include a litigious society bent on thwarting these goals
as well as the lack of infrastructure where
housing density is sought and necessary.
In the last few years our organization has
grown its membership to include the larger
commercial and mixed use builders as well
as large regional developers as we fight the
same battles everyday. Our Associate members, who are so important to the strength of
our organization, have been and will always
be the best in the industry.
Challenges will always present themselves to
us as developers, builders and as an organization. Many of our current issues have similar foundations as those that faced our predecessors. Let’s look to our past and come
together to help solve our present issues and
let’s keep LIBI strong for another 74 Years.

As the State Legislature moves into its final month with new
leadership in both
houses, it will be very
interesting to see
what types of legislaMitchell Pally

between now and the middle of June. Along
with its statewide partners, LIBI is very hopeful
that both houses will move these very important legislative initiatives as soon as possible:

LIBI is working with NYSBA to support
legislation that would provide financial incentives for the construction of new affordable
housing based upon the use of green design
and building techniques while maintaining
affordability.

LIBI is moving to amend Article 78 of the
Civil Practice Law and Rules to require a bond
to be posted by someone who files an appeal
on such litigation with regard to residential
components. Sponsored by Senator Jack Martins
and Assemblyman Chuck LaVine.

LIBI continues to work with NYSBA to
support legislation that would amend the Environmental Conservation Law to make the time
periods in SEQRA mandatory unless the applicant or project sponsor agrees to an extension.

LIBI continues to comment upon legislation which is sponsored by Assemblyman Fred
Thiele to create a workforce housing fund for
the East End towns. While we agree with the
concept and need for the fund, we disagree
with one of the mechanisms for funding,
which would be a new tax based upon the
square footage of the house over 3000 square
feet.

LIBI continues to support a statewide initiative to amend the Scaffold Law to provide
for comparative negligence as the standard
for awards rather than the current standard
which holds the employer liable in almost all
situations.

LIBI continues to work with NYSBA on
legislation which would provide that a completed application for development would be
governed by existing municipal zoning and
planning ordinances and regulations.

LIBI continues to work with NARI to oppose
legislation which would set new standards and
powers for interior designers and would allow
such to certify new changes in design without the
need for review.
During May, your LIBI Community Outreach
program testified in the Village of East Hampton
against a village resolution which would significantly limit the size of certain houses in certain
areas of the village. LIBI did not believe that
such a resolution was in the best interests of our
customers who would be penalized by not being able to build what they could legally put on
the size of the lot at the present time.
I had the pleasure this month of moderating a
panel discussion on new development opportunities on Long Island at the annual Hauppauge
Industrial Association trade show. The panel
consisted of Patchogue Mayor Paul Pontieri,
Renaissance Development principle Don Monti,
Bob Counghlan of Tritec Real Estate and Russ
Albanese of Albanese Organization.
A l l o f these individuals have been very successful in transforming old downtowns into
new and vibrant lifestyle communities for our
young people and the discussion was both
engaging and informative. I thank the HIA for
letting me participate in the discussion.

Does anyone know what happened to May 2015
– did we really have it? It’s probably because so
much took place. Here are just a few of the events:
Lobby Day in Albany – I know it was technically
April (the 28th), but it’s close enough, and besides, I’m the one writing the article…all you have
to do is read. While we would have preferred (and
needed) more LIBI members in attendance, we
combined forces with the rest of the NYSBA locals
and made our presence felt. We can’t emphasize
enough the importance of this day for our industry. For 2016, we will work on a plan to get more
of the membership to attend.
Associate Council meeting on May 6 was beyond
standing room – some members were in the parking lot!! Not really, but it sounds good! Congrats
to Paul, Will and Nick, our Associate leaders, for
keeping the momentum from 2014.
The Dinner Dance honoring Past President Artie
Cipoletti (my sponsor @ LIBI) and Associate of the
Year Denise Angiulo on May 16 was a fitting tribute
to both of them. Their recognition was well earned
for serving the past (3) years on the respective
Builder and Associate ladders. This event should be
an automatic on your LIBI calendar.
As you can see, we are an active organization. It
calls to mind the now trademarked quote of past
president Ira Tane, “We are an economic, political
and social (Eco Po So) juggernaut”. All the more
reason to join, participate and contribute!
In the midst of all this action, we’ve moved forward
on membership total – 452 members! We are still
working the membership drive through the end of
May – get out there and bring in a new member.
Tip of the Month - Take the time to read the LIBI
News – it’s a well thought out and put together
publication that will give you insight on who we
are and what we do. And look for your photo (if
you’re new) in the New Members’ Gallery!

As we approach the mid-way point of our year we
gratefully express our sincere gratitude for the outstanding year LIBI has had thus far. We feel the
bond between the Associates and Builders has never
been stronger (even though as the current Associate
Council Board, we may be a little biased). Our AVP
Jay Ratto has helped us forge a successful route of
communication between the Builders and Associates. If our Associate Council meeting growth is any
indication of the type of year we are having, it is a
tremendous success.
.
Our Associate Council meetings which normally take
place on the first Wednesday of the month at 8:30
a.m. at the LIBI office will take place this month at the
Hamlet Windwatch Golf & Country Club at 8:00am.
Our “Guest Builder” this month has drawn a tremendous amount of interest and the development he
will be presenting to us will directly or indirectly affect
almost every member of LIBI, their families and all of
Long Island. Our next guest builders for our June 3rd
council meeting will be Gerald and David Wolkoff of
Heartland Town Square in Brentwood. A proposal
is moving forward that would transform a wide expanse of fields and oak trees in Brentwood, once the
grounds of the state’s largest psychiatric hospital, into
the site of a $4-billion project that would be among
the largest in Long Island history. If developer Gerald
Wolkoff can pull it off, the 451-acre Heartland Town
Square project will become product of Long Island’s
can do attitude.
Our May 6th meeting was superb as we had Peter
Florey of D&F Development Group make a presentation regarding their current projects in construction.
The three projects D&F discussed, Village Walk at
Patchogue, the Highland Green in Melville, and
Nick Dalvano

Brooke Point in Valley Stream. Their assisted living
project in Patchogue will be another positive addition on to the wonderful development Patchogue
has made in general. Patchogue has become an example of what is “right” with development on Long
Island and D&F, as well as our previous Guest Speaker and LIBI President, Mike Kelly, are very much responsible for the positive building development . In
Melville, the for-sale cooperative development D&F
will be an extremely beneficial community targeted
towards the working class and could provide a reasonable cost of living and allow these older-working
class individuals a means to retire comfortably. Their
affordable housing project near the Valley Stream
train station is another staple of current development
visions on Long Island being built near transportation hubs across the Island. Along with the Albanese
Organization’s “Wyandanch Village”, Brooke Point
should increase population near the Valley Stream
transportation hub in Nassau County allowing easy
access to jobs in the City.
Other Events which were great successes this month
which were Albany Lobby Day, which LIBI had a fantastic turnout at, and the Annual LIBI Dinner Dance.
The Dinner Dance was absolutely outstanding, and
consisted of many moving speeches, as well as a lot
of laughs and an all around good time. Congratulations again to past President Artie Cipoletti and past
Associate Council President Denise Angiulo!

Windwatch Country Club on June 3rd at 8:00am

(PV) and wind,are
poised to be influenced by a couple
of new developments.
Governor Cuomo and
John Barrows
NYSERDA announced
a plan to bring
down the costs of PV in an incentive program for installers. A possible bigger consequence was the announcement by Tesla
of their move into household storage batteries. The NYSERDA program will reduce the
installation cost of PV and the Tesla battery
can reduce, or totally eliminate the need for
a household to be tied to the grid.
At first glance, both of these programs seem
to be good for the consumer. Lower costs for
installation and mass produced storage capabilities would reduce the dependence on grid
tied power supplies. But, what are the unintended consequences? Both the PV installation and now the storage batteries are not
available to the entire consumer public. Even
with incentives they are available only to those
consumers who can afford to pay for them. If
more people go “off the grid” what happens
to the costs of producing power and maintaining the grid that ultimately gets passed on
to those consumers who remain on the grid?
Additionally, what happens when an “off-grid
household” experiences a catastrophic loss of
PV from a storm and they are not tied into the
grid?
Utilities are searching for ways to maintain viable revenue in the face of these new realities.
One of these strategies is to charge, and control, based on usage at peak times. A smart
grid will provide for monitoring of peak demands, controlling use, and charging accordingly. The potential impact on consumers,
who are accustomed to using power anytime they want, may be to drive more consumers off the grid; and further impact costs.
So it becomes an issue of “be careful what
you wish for”. The ultimate solution lies in an
overall plan that promotes alternative sources
of power generation and preserves the grid
for all to use. It is a complicated equation that
requires input from all sides.

family in 2014 and has been very busy since. He currently chairs
the Outside Trade Show Committee, is active on the LIBI Trade

every dinner meeting and event and very rarely misses a meeting
in the office for all the committees & councils he volunteers for.
Phil takes time from his own company to come to the LIBI office
to help in any way he can. He has run back & forth to LIBI’s storage facility for various reasons and does so with a smile. He is a

Mike kelly

Mike Kelly has been a member of LIBI since 2005 when he joined under
the Pulte name. In 2008, Mike ventured out and started his own building company. He has over 20 years’ experience in the building industry
with over 1500 homes developed on Long Island and most recently is
involved in the Riverwalk, 163 condominium community in Patchogue.
Mike climbed the LIBI ladder to become President in 2011 and stepped
up with Alec Ornstein to be Co-Presidents of LIBI in 2015. Besides LIBI,
he is also a board member on the Down Syndrome Advocacy Foundation, is a member of the NYS Bar and its Committees on Land Use and
Real Estate Legislation. Mike is a licensed real estate broker and a Long
Island Board of Realtors member, Suffolk County Planning Commission member and Patchogue Business
Improvement District member.
Mike is a Co-Chairman of LIBI PAC and has been Chairman of the Golf Committee in past years. He is Chairman of the Brookhaven Committee and attends LIBI events regularly. He has supported every dinner dance
and LIBI event since becoming a member. Mike can always be depended upon to come forward and show
his support of LIBI by taking sponsorships for various events.
Mike is always there with a smile and good natured joke. His warm and friendly personality make him the
life of any party he is at. He is a true asset and firm supporter of LIBI. We look forward to many more years
of having Mike as a member and a friend.
