October 2014 Large Lots, Natural Florida, Varied Architecture and a Strong Community By DeSoto Acres Association Board UNIQUE IN SARASOTA COUNTY, DESOTO ACRES IS THE OLDEST SUBDIVISION ESTABLISHED OUTSIDE of Sarasota city limits. Covering over 850 acres, DeSoto Acres is the largest one-house per two acres (RE-1) Low-Density Residential area in Sarasota County. DeSoto Acres encompasses the area between University Parkway & 47th St and between 301 & Lockwood Ridge Rd. Our community is made up of 369 parcels classified as DeSoto Acres Subdivision and Unincorporated Sarasota County. Our community slogan is “County Estates in the Heart of Town.” As a reporter once wrote, “Close enough.” Our large residential lots and location, convenient to many amenities, makes our community an attractive place to live. Our history is also far longer than most subdivisions in Sarasota County. DeSoto Acres was founded by William Van Dame, a Chicago businessman who moved permanently to Sarasota in 1923. During the 1925 Florida land boom, he bought large tracts in North County including the solid block of land from the Seaboard Air Line Railway (now the Seminole Gulf Line) to Lockwood Ridge Road, and County Line Road (now University Parkway) to 27th St. He was responsible for bringing many large investors to Sarasota. Active in the local Chamber of Commerce, Van Dame raised significant funds for the Chamber’s promotion of Sarasota County. He served as a director for many years and as president in 1932. Van Dame was also very interested in athletics. An avid golfer, he was one of the pioneers in the development of the Bobby Jones and Sarasota Bay golf clubs. Van Dame donated part of his land holdings for use as a recreational park, school, day nursery and the site of the African-American Galilee Cemetery on the east side of Washington Boulevard, south of Myrtle Street. His greatest accomplishment was in bringing about the construction of U.S. Highway 301 linking Tampa to Sarasota. In 1928 he gave Sarasota County the right -of-way connection from 27th St. to the county line. DeSoto Acres started with William Van Dames’ vision for what he called Van Dame Estates. It was an unusual vision even for the time. As the 1928 ad above states, “ideal for suburban homes - poultry ranches, small farms…” Van Dame Estates was legally established on Feb 3, 1921 with the deed execution. The estates slowly grew from inception through the 1940’s. County records show a total of 8 homes which still exist from that time. Van Dame Estates changed its name to DeSoto Acres when the County replatted the area on March 5, 1945. Interest in our community picked up in the 1950s and 1960s. The majority of our existing homes were built during this time, followed by homes built during the 1970s. The earliest home dates from 1925, the Continued on Page 5, see Large Lots, Natural Vegetation Message from Association President Robert Heere I HOPE EVERYONE HAD A GOOD SUMMER and was able to venture to faraway places, or at the very least, found a getaway from the heat. A summer adventure I remember, and many other DeSoto Acre residents can remember, is a time when there was no University Parkway, or the traffic and growth that arrived with it. It was a time when the Parkway was known as County Line Road and riding your horse through the trails and down the Road was a great way to spend a hot Sunday afternoon. Times certainly have changed. We now have large plazas on each corner with the development of apartment complexes behind them. We see other large development all along this Parkway, particularly east, all the way to the interstate. The Desoto Acres Board and you active residents have vigilantly watched and worked through all of the development around us to maintain our identity as a neighborhood of “country estates in the heart of town.” We recently went before the Board of County Commissioners to note that we did not have any objections to the rezoning of what was the Hubble property on University Parkway as it was inline with the University Parkway West Corridor Plan. Several commissioners thanked us for our involvement, and acknowledged Sam Miller, our past association president, for his many years and extraordinary efforts to protect our neighborhood. Very soon the new University Town Center mall will be opening and I am sure it will be a wonderful addition to the SarasotaBradenton area. Still, we will have to watch the impact the mall may have on our neighborhood. We must continue to work together with the county to preserve and protect Desoto Acres, the great neighborhood it is. A looming priority is to maintain the peaceful nature of its streets. I know of several families here in the Acres, that now have their grown children taking over the houses they were raised in. Legacies such as these speak clearly of the success we have as an active group keeping our DeSoto Acres the special place to live that it really is. I encourage everyone to stay vigilant so when others look back years from now, they will still be living in the recognizable jewel known as DeSoto Acres, our “country estates in the heart of town. 2 Would you Like A Fall Yard Sale? SEVERAL RESIDENTS HAVE EXPRESSED INTEREST in a fall DeSoto Acres Community yard sale in addition to our spring yard sale. A questionnaire / flyer is enclosed in this newsletter with a return envelope for you to voice your opinion for a fall yard sale or not. We all have a say in this, as it takes a full community to commit to a community yard sale. It also takes volunteers to make a yard sale .successful. Please indicate on the questionnaire if you can help, put out the five community yard sale road signs, create the yard sale location map and / or provide a central location for table top sales. Participation in the map and / or central location is free with your DeSoto Acres Association membership. If we have enough interest and support, the first fall community yard sale would take place in September or October, 2015. DeSoto Acres Association Board voted in favor of this rezone. This rezone is in University Parkway line with the County’s Future Land Use Designation which prior DeSoto Acres Boards and residents worked hard to put in place. The OPI -PD designation minimizes the impact on our low-density Johnson Ln / 61st St. residential area. At the Aug. 27th County Commission Hearing your Association President Bob Heere stated the Boards support of the rezone and acknowledged the successful execution of OPI-PD along our residential border. Commissioners’ Patterson and Mason acknowledged the DeSoto Acres Community for their active involvement, “how many times you have packed the chamber when you are not happy with what is being proposed … we thank you for coming to express your approval of this project...” Mr. Barbetta added, “Special thanks to Desoto Acres Neighborhood Association which is a model of an active association over the years.” He also acknowledged the work of our former president Sam Miller. Ms. Mason stated how she is encouraging developers to talk with the DeSoto Acres Community before proceeding with an official land-use change petition. Per Ms. Mason, “DeSoto Acres opinion is valuable.” DeSoto Acres acknowledged the benefit of these talks, citing two developers that initiated informal discussions with the Board and residents, both deciding to adjust their locations based on our input. Other activity: Potential ALF on University Parkway has not proceeded. Potential rezone of 8 acres between 53rd and 51st West of Shade Ave is inactive at this time. SITY 4 Large Lots, Natural Vegetation continued from Page 1 most recently built in 2014. DeSoto Acres had deed restrictions. A deed from the 1950’s had such restrictions as: “(a) The buildings to be constructed or erected on the lot … limited to a one family dwelling and one private garage...all business, occupational and commercial enterprises are hereby expressly prohibited… except that commercial poultry and agricultural enterprises may be established in Block “D” and “H”..., (b) No tourist camps … no trailer camps…, (k) No hogs shall be kept or raised…” Current zoning no longer allows farm animals. Horses have been a constant in DeSoto Acres as they are not considered farm animals. Our community’s character was defined by these early deed restrictions. The most defining character is our large lots. How did our two-acre lots come about? It was assumed this was because of the original Van Dame plat of two-acre lots. That’s partly true, as the majority of DeSoto Acres was platted into two-acre lots. Research into Sarasota County’s historical zoning maps between 1960 to 1975 show all of the DeSoto Acres area, whether included or not in the Van Dame plat, was zoned E for Estate. The big surprise about the E Zoning designation is it was for one house per one acre. The County updated its zoning code in the ‘70s. The new zoning designation for DeSoto Acres area was RE-1, Residential Estate – One, meaning one house per two acres. For a short period of time, DeSoto Acres’ residents were given the choice to keep their parcels one house per one acre rather than automatically changed to the new one house per two acres zoning. Our current zoning of RE-1 became effective Nov. 11, 1975 in the County Zoning Code, formally creating the familiar DeSoto Acres’ two-acre lots. Our large lots are home to quite a diverse domestic and native animal population. Residents have horses, dogs, peacocks, and cats. Native and migrating animals include bald eagles, ospreys, sandhill cranes, hawks, kites, owls, herons, fox, armadillos, bats, river otters (although not recently seen), coyotes and every so often a bobcat. Architecture was never part of the original deed restrictions as testified by the variety of styles we see in DeSoto Acres. This variety makes our community feel more like a natural community. And, it is a testament to the appeal of DeSoto Acres to many different types of residents. The one thing we all have in common is our choice to live in DeSoto Acres on large naturally landscaped lots, with native animals in the heart of an urban environment. We have a common interest in DeSoto Acres unique neighborhood character. We come together around this common interest to enhance DeSoto Acres by volunteering, or to preserve DeSoto Acres by organizing resident’s for our common interest. Because of your ongoing support of DeSoto Acres, we are a strong, vital community. Let us preserve Van Dame’s vision and maintain our residential community as the county continues to grow around us. A special thank you to residents Jim Gregg for his research of DeSoto Acres’ history and Jane Paquette’s research of our historical zoning. 5 DeSoto Acres Gardens - Fall Planting An Interview with Resident Gardener Sam Miller by Diana Harvey MANY DESOTO ACRES RESIDENTS HAVE VEGETABLE GARDENS INCLUDING MR. SAM MILLER ON 59TH ST. He’s been planting a vegetable garden for more than 30 years. Diana Harvey interviewed Sam for his Fall gardening tips. October is a bit late to begin planting your fall garden, but if you must, successful gardener, Sam Miller suggests using prestarts rather than seed. “It’s best to get the garden ready in late August, then fertilize and plant seeds in early September.” Fall gardens need ninety days for growth with harvesting in late November. Beginning September 1st safely avoids the chance of an inevitable frost in December destroying your plants. By using the prestarts, you would nearly make up for missing the September growth cycle seed would need. Sarasota Farm and Garden on Beneva has a good selection of prestarts. “Choose cold hardy plants,” is another Sam suggestion. His favorites include lima beans, collards, mustard greens, broccoli and onions. “Kale is popular now, and grows well in the fall.” 6 If you are more inclined to container growing, Sam says nearly anything goes. “Using a container or earthbox allows for a late start, since you can protect the plants from frosty nights with a sheet and light.” When asked to share his secrets for his success, Sam hesitates. “I really don’t mind sharing what I do; it is just that I am not a conventional gardener. I pretty much do it my way, and I have had quite a bit of trial and error along the way. Basics I can share are, use the time release fertilizer. It costs more but it really is better. Use mulch and don’t be stingy with it, especially since we have several free sources for it nearby. Andrews Tree service, a neighbor, will usually drop off mulch at your house, and it is free for the hauling at Longwood Run Park. I try for a healthy yard, and that means I want the four Bs: bees, birds, butterflies, and bats.” Candy Miller has taught Sam plenty about butterflies, but where does he go for other information? “I have a large clipping file, but with the computer, my favorite site is Florida Yards and Neighborhoods Handbook. Google that and you will find loads of information. Nine steps to a healthy yard and garden.” So any last words, Sam? “The last word is patience. You need the patience of Job to garden in Florida. You will meet every bug ever built, in your garden. And be prepared to water often, you can count on the rains stopping the day you put your seed out; yep, patience… and a sense of humor. Last words.” County Preparing Zoning for Medical Cannabis Any Impact on DeSoto Acres? SARASOTA COUNTY VIEWING ZONING THE IS REPOTENTIAL for growing, processing, research and dispensing medical cannabis. The DeSoto Acres Association Board takes no political position; the sole aim is to keep residents informed of the potential impact the ordinance may have to our residential community. The upcoming November 4 General Election ballot includes a referendum that will allow the dispensing of marijuana for medical purposes with certain restrictions. If the referendum is approved, it is expected that numerous retail dispensaries could appear within the County under the current zoning codes as retail sales and services. In addition it is anticipated that the growing and cultivation of Cannabis plants will appear within the County under the current zoning codes as agricultural uses. Public hearings are scheduled with the County Commission on Oct. 8 and Nov. 4. The Planning Department is proposing an ordinance requiring approval of a Special Exception for all uses associated with the cultivation, processing, research and/or dispensing of medical marijuana. A special exception is obtained through the same process as a rezone, by formal hearings before the Planning Commission and County Commission. The proposed ordinance also provides for more requirements as follows: 1. Prohibition against loitering in parking areas; 2. Prohibition against drive through facilities 3. Requirement of a 500 foot separation distances from pre-existing schools, house of worship, day care facilities, public parks, public beaches; 4. Prohibits dispensaries from being co-located on the same property with any medical office, pain man- agement clinic, pharmacy or other medical marijuana dispensary; 5. Restricts hours of operation; and 6. Requires compliance with other federal, state and local laws. The proposed zoning in which cannabis cultivation will be allowed is Open Uses Agriculture (OUA), Rural (OUR) and Estate (OUE) with Special Exception. Medical marijuana dispensary is a Retail Sales and Service function which will be allowed in Office, Professional and Institutional (OPI) and Commercial General (CG) zoning with Special Exception. Medical marijuana research and processing will be allowed in Light Industrial Service designations of Industrial Research (IR) and Industrial, Light Manufacturing and Warehouse (ILW) zoning with Special Exception. How does this affect DeSoto Acres Community? The closest Sarasota County properties zoned as Open Use A,R or E– is OUE one mile to the east. In north County, the OUR and OUA are located east of I75. The growing of cannabis is not likely to impact DeSoto Acres. The dispensing of cannabis is possible along our northern border if a Special Exception is allowed. The properties fronting University Parkway between Lockwood Ridge and 301 are OPI-PD or can be rezoned as OPI-PD. The research and processing of cannabis is possible across 301 and along part of our southwest border, if a special exception is approved. About half of the land west of 301, north of DeSoto Road and east of Old Bradenton Road is ILW. The industrial parcels at our southwest border are ILW. Allow 48 hours for reply. 7 8 A Stroll Down Memory Lane in Our DeSoto Acres From Diana, 31 years on 59th St. NEW YEAR’S EVE 1983, I was ironing in the family room, rockin’ in the New Year with Dick Clark. We had moved in about 7 weeks earlier; no curtains, little furniture, bliss. Don was working the night shift at the emergency room. The countdown had just begun on the TV, and suddenly all heck broke loose in the Acres and I hit the floor! I had no idea that it was a long held tradition that many folks stepped outside and fired off live ammo to welcome the New Year. Thankfully, folks use fireworks now. From Lance, 17 years on 49th St. WE HAD A FOX OR TWO THAT used to be seen crossing the back yard at the end of dusk. They used to cross along the back of the property line, I guess taking a short cut. They got to be so comfortable and such a part of our routine that they began to sit in the corner of the yard and rest sometimes, even with the dogs present. They developed an understanding, and would kind of acknowledge each other without an issue. This illustrates one of the things that makes this neighborhood great. More access to nature. From Sam, 41 years on 59th St. MEMORIES, AH YES, THOSE were the days and still are the days in DeSoto Acres. Years ago, horses roamed at night to forage on the neighbors lawns. Doors were seldom locked. The homeowners' association had no issues with encroaching commercialism, they got us together for a community picnic. There was less traffic and outside noise, so everyone slept with windows open whenever the temperature allowed. Candy and I love our home in DeSoto Acres! From Pat, 35 years on 53rd St. WE ENJOYED RAISING OUR daughters and all their animals and pets in the Acres. One daughter would come home from school and ride her horse to the 7/11. It was safe then, I certainly wouldn’t let her do that now. Charlie grew up in Ohio on farmland, so he has always felt at home here. We just love the wildlife we share our land with. Pat and Charlie also note: Charlie is not seeking reelection to the Board in January. The number of pending sales declined over the summer months, typical of the area’s seasonal sales. There is only slight variation in the county-wide median sales price of $195,760, up 0.3% versus year ago. The typical sale price of single-family homes also remains steady at $180,000, about 92% of the original list price. DeSoto Acres (DSA) properties for sale, sold and foreclosured is quite active. For Sale inventory levels continue to grow with seven houses currently on the market at an average asking price of $385,400 or $153.96 per sq. ft. One property listing expired after 263 days on market and another was withdrawn after 145 days on market. The two homes that sold in DSA had an average $400,000 sale price or $129.00 per sq. ft. Two vacant two-acre lots sold for an average of $122,500. Foreclosures continue in our area with two properties transferring ownership to financial institutions. One of these properties has been in foreclosure process since 2009. Current Sarasota County property records show six properties in our community owned by financial companies. The overall real estate market should improve for the DSA community. As the county improves so will our area. As Sarasota Association of Realtors® President Peter Crowley stated, “I continue to be impressed by the staying power of this market as we have now seen five months in a row with sales above or very near the 1,000 level. If we remain at this peak activity, and I haven’t seen any indications of slowing down, we could see another historic year in 2014. Agents I have spoken to report no slow down at all for their open houses, and multiple offers on properties continue to be the norm as the available inventory continues to shrink.” Look for the next DeSoto Acres Real Estate Update in the January 2015 issue. Payment of $_________ enclosed. 13 Coyote Sighted in DeSoto Acres SEVERAL FAMILY PETS HAVE BEEN REPORTED MISSING over the past several months. The disturbance of raw land across University Parkway in Manatee County has no doubt put larger animals of prey on the move. Sam Miller reported a coyote sighting this past summer. Steve Byers, on 61st far west of Tuttle, is missing a four-year old white and black male family cat and four feral cats. The Cristiani family on 61st east of Tuttle sighted a coyote in mid-September. On Sept. 23rd, Connie on 59th St., east of Tuttle, sighted a large, lone coyote on 57th St. during her evening dog walk. Much like the bobcat, coyotes generally do not eat dogs or cats but will kill them to eliminate competition for the squirrels, rabbits, mice, birds, carrion, and wild fruit they do eat. Coyotes are active both day and night, but are usually most active at sunset and sunrise. When walking in our area in the early mornings or evenings, since we have legitimate coyote sightings, it would be a good idea to carry mace or pepper spray and some type of noise maker. Loud noise will keep the coyote afraid of humans. Do not keep uneaten dog and cat food where the coyote can find and eat it, and secure trash cans so coyotes cannot use trash nights for an all they can eat buffet! Regarding family pets, the best advice at this time is to keep your pets inside at night. The Florida Fish & Wildlife Conservation Commission has a website which offers more information and a phone number to report coyote activity. DESOTO ACRES LAND PLANNING HAS NOT HELD A RESIDENT MEETING, YET WE ARE WORKING FOR YOU. Resident Bruce Snyder forwarded information to the Land Planning Chair regarding a Sarasota County capital improvement project under review this year for sidewalks on select streets in our community. A meeting was held in July with the Sarasota County Project Team and DeSoto Acres Planning Committee members to review the project’s origination, status and next steps. The meeting determined: 1) Nothing is finalized. 2) 10 years ago, based on community input, the Sarasota County Commission approved looking into consideration of sidewalks on three streets in DeSoto Acres. 3) The three streets are Tuttle Ave., DeSoto Rd. and 47th St. 4) The only dollars approved by the County are for initial review of the costs for the project. 5) A County workshop will be scheduled before the end of the year to get DeSoto Acres residents input. 16 6) There is no coordination with County Stormwater and Drainage, Southwest Florida Water Management or Traffic regarding this project. The DeSoto Acres Association Planning Committee’s statement to the County Project Team was current resident input is vital and without coordination with the three County departments, the sidewalk project would increase drainage and traffic issues within DeSoto Acres.
