for Loaning Machinery
for Disease and Insect Control

Article
1. The loaning
of machinery
for disease
and insect
control
(hereinafter
referred
to as
"control
machinery**)
under the provisions
of
Article
2 item {6)-2 of the Law concerning
Gratuitous
Lending
and Transfer,
etc. of State
Goods shall be in accordance vwith this Ministerial
Ordinance.
(Sphere
of Loaning)
Article
2. The Minister
of Agriculture
andForestry may, when he deems it necessary in order to
control extraordinary
outbreaks
or spreadings
of
diseases or injurious
insects,
loan control machinery to the local public
body, farmers* organizations or person engaged in the control of disease
and injurious
insect as business.
(Application)
Article
3. Any personwho wishes to borrow control
machinery
shall
submit to the Minister
of
Agriculture
and Forestry
an application
(in triplicate)
in accordance
with Annexed Form No. 1.
2 The Minister
of Agriculture
and Forestry
may,
in case he deems it necessary,
request
the presentation
of additional
information
in making a
decision.
(Loaning)
Article
4. The Minister
of Agriculture
and Forestry shall,
upon the receipt of the application
under
the preceding
Article,
examine the same and
report his decision
to the applicant
by Notice of

writing
in case he disapproves.
(Period
of Loaning)
Article
5. The period
of loaning
of the control
machinery shall be decided
by the Minister
of
Agriculture
and Forestry.

2 The Minister
of Agriculture
and Forestry
may
extend the period of loan upon request.
3 Any borrower shall request

an extension of the period
of
loan by re-present
the application
in accordance
with Annexed Form No. 3 (in triplicate),
at least
five days prior to expiration
of the original
loan(Compensation
for Loaning)
Article
6. The loaning
of the control
machineryshall be without
compensation.

Article
7. Control machinery
shall be delivered
on?
the day and at the place specified
in the notification of approval
of loaning
under the provision'
of Article
4.
2 Any borrower shall,
upon receipt
the control
machinery under the provision
of preceding
paragraph, submit to the Minister
of Agriculture
and
Forestry
a receipt for the same (Annexed Form
No. 4).
(Duty of Borrower)
Article
8. Any borrower shall take good care of
machinery in his custody.
2 Machinery
loaned by the Ministry
of Agriculture
ancj Forestry
under the provision of this Ordinance
shall not be reloaned.
Article
9. Any damage or loss to borrowed
machinery
shall be reported
to the Minister
of Agriculture
and Forestry at once stating
cause and
' extent of damage or loss, in detail.
In this case
if the cause of the said damage or loss is due to
fire or robbery,
certificate,
issued
by an official
concerned
verifying
damage or loss and reason
therefor,
'shall
accompany the report.
Article
10. Any borrower shall,
in case he has lost
or damaged his borrowed control
machinery
for
causes to be attribute
to his responsibility,
be
required
to replace
lost article
or repair
such
damage. Compensation
may be made in lieu of
replacement
or repair of lost or damaged article.
2 The compensation
of the preceding
paragraph.
ishall be paid in accordance
with the payment
notice
issued
by the revenue collector
of the
Ministry
of Agriculture
and Forestry.

Article
II.
Any borrower shall return his borrowed control
machinery
at the time and to the
place designated
(Form 2) junder
Article
4 not
later than the day of expiration
of loan (includes
the renewed period in case the renewal has been
made;
hereinafter
referred
to as "returning
date*').
At the same time returning
notice
(Anjnexed Form" No. 5) shall
be submitted
to the
Minister
of Agriculture
and Forestry.
Article
12. The Minister
of Agriculture
arid Forestry'may,
in case he is in urgent
needofthe
control
machinery,
order the return
thereof
appointing
such date 6ven before the returning
date.
Article
13. The Minister
of Agriculture
and Forestry may, in case any borrower has violated
this
Ministerial
Ordinance
or committed
any act
which makes loan improper, order the immediate
return of equipment
appointing
date and place
even before the returning
date.

Article
14. Any borrower shall, in case he fails to
return his borrowed control
machinery
by the
returning
date,
(in the case of the preceding
Article,
the date appointed
to return the same),
pay the default
money by each type of the control machinery,
tjie amount of which is fixed by
the Minister
of Agriculture
and Forestry,
with
Annexed Form 1

to the number of days counting through

However, this shall
not
apply to the cases beyond the control
of the
borrower.

Article
15. All the expenses necessary for receiving,
use, custody
and return
of the control
machinery shall be borne by a borrower.

16.
Any borrower
shall
submit
to the
Minister
of Agriculture
and Forestry a report on
the results
of control
works (in triplicate)
in
accordance
with Annexed Form No. 6 within a
month after the return of his borrowed control
machinery.

Article
17. All documents presented to the Minister
of Agriculture
and Forestry
in accordance
with
this Ministerial
Ordinance
shall go through the
chief of Animal and Plant Quarantine
Station
which exercises
its jurisdiction
over the district
where the controlling
works in question
have
been performed.
Supplementary
Provision
This Ministerial
Ordinance shall
as from the day of its promulgation.
