BUYERS – prior to the auction you should attend the
horse workouts and inspect, and talk to the vendors of,
the horses you intend to bid on. The Selling Agents are
happy to supply you with vendor contact details prior to
the sale, and photographs of lots can be viewed online
www.gdlrural.com.au
BUYERS PLEASE NOTE
Intending buyers should make arrangements to pay for their
purchases by CHEQUE, CASH or CREDIT CARD on Sale day.
Credit card payments attract 1% fee.
Purchasers intending to invoice their purchases to their
Stock & Station Agent must ensure that authority to invoice
is received in writing by the Selling Agents. Delivery of
lots may be delayed until written authority is received.

Purchasers of horses should proceed to the Agent’s Sale
office adjacent to the Sale ring immediately after they
have finished buying to complete settlement and
delivery instructions. Do not leave the Horse Sale area
without attending to the instructions for your purchases.
Delivery of horses from their Sale pen will only be
authorised by the Selling Agents once buyers have
completed payment and delivery instructions at the office.

SALE INFORMATION – IMPORTANT
Bid Cards – Intending bidders are required to register and
obtain a bid card prior to the commencement of this Sale. Bid
Cards will be available from the Selling Agents office adjacent
to the horse sale arena from 7:00am on Sale morning.
PERSONAL PHOTO ID MAY BE REQUIRED
Procedure – Before any horse is removed from its designated
pen, buyers must have attended to their settlement and
delivery instructions in writing at the Selling Agents office
adjacent to the horse sale area. Movement of horses from
their pens without a “delivery authorised” docket is not
allowed. Buyers or their representatives will be issued with
a “delivery authorised” docket upon completion of their
instructions at the Selling Agents office.
Payment – Cheque, cash, credit card or written authority
to invoice to another Stock & Station Agent acceptable,
immediately upon completion of the Sale, unless credit
arrangements have been authorised by the Selling Agents
prior to the Sale. Credit Card payments attract 1% fee.
Inspections – All lots in the Sale will be available for
inspection from 7:00am on the morning of the Sale. Vendors
will be in attendance with their horses so that buyers can
talk to them and assess all lots as fully as possible to ensure
they meet the requirements and suitability desired.
Insurance – Insure the horses you buy today. After making
significant investments in horses at this Sale, we strongly
recommend you insure your purchases.
We will have
our insurance representative in attendance at the Sale to
immediately issue a policy cover to protect your investment.
Details can be finalised at the Selling Agents office.

BUYERS PLEASE READ
CAREFULLY
1. As all lots will be available for ample time prior to the
commencement of the Sale, we strongly recommend
that you examine fully all horses on which you intend to
bid and read carefully the Terms and Conditions under
which the Sale will be conducted and bids accepted.
2.All information on the lots in this catalogue has been
provided by Sale Vendors. The Sale Agents accept no
responsibility for its accuracy or otherwise and intending
bidders should satisfy themselves regarding the pedigree,
age, registration status, performance, potential, suitability
and other claims made for lots in this catalogue before
bidding.
3.
PAYMENT. The full purchase price for each lot shall
be due and payable to the Auctioneer on the fall of
the hammer and prior to delivery unless prior credit
arrangements have been made with the Auctioneer.
Introductions to invoice purchases to other agents should
be made in writing to the Auctioneer prior to the Sale.
4. Following purchase, buyers should proceed to the Sale
office and attend to settlement and delivery instructions
BEFORE ANY LOT IS REMOVED FROM ITS
ALLOCATED SALE PEN. A “Delivery Authorised”
form will be issued by the Sale Office personnel to allow
relevant lots delivery from their pens.
5. All lots are to be removed from the Ag-Grow Field Days
site by 6pm on Sale day.

BUYERS PLEASE NOTE
GST
The GST Status of the Vendor of each Lot is indicated next
to the Lot Number on the catalogue page.
This Sale will be conducted on a “GST exclusive” basis
whereby the final bid price on each Lot does not include GST.
-
If the Lot is (Plus GST), then GST of 10% will be added
to the purchase price of that Lot.
- If the Lot is (No GST), then no GST will be added to the
purchase price of that Lot.
Please note – GST registration details as printed in the
catalogue have been provided by the Vendor to the Selling
Agents. Should any change of GST details be notified to the
Auctioneer prior to the offering of a particular Lot, that change
will be announced by the Auctioneer. Announcements made
from the Auctioneer’s box take precedence over printed
matter in this catalogue.

As a service to our clients, Insurance Representatives will
be in attendance at the Ag-Grow Premier Multi-Breed
Beef Bull Sale and Ag-Grow Premier Invitation Horse
Sale.

and excellent service.
We sincerely recommend you insure the investment you
make in the bulls and/or horses at Ag-Grow 2016.

TERMS AND CONDITIONS OF SALE
All bids and offers to purchase shall be treated as offers made upon the following
Conditions of Sale and all persons attending the sale or bidding at the sale shall
be deemed to have notice of such conditions of sale.
1. RESERVED SALE
(a) The highest bidder shall, subject to Clause 1(b) be the Purchaser and should
any dispute arise among the bidders for any lot it shall be decided by the
Auctioneer unless one of the disputants will advance a bid on the lot failing
which the lot or lots shall be put up again.
(b) This sale shall be conducted on a ‘Sale’ or ‘No Sale’ basis whereby the lot for
sale shall be knocked down to the highest bidder, but the sale will be subject
to the acceptance of the highest bid by the Vendor who will immediately after
the fall of the hammer declare ‘Sale’ or ‘No Sale’.
(c) Should the Vendor reject the bid of the highest bidder, such bidder shall have
the right of purchase of the Lot at the Vendor’s nominated reserve. This right
must be exercised before the Lot leaves the Sale ring.
2. AUCTIONEER’S DISCRETION
The Auctioneer, whose decision shall be final and binding upon all persons,
shall have the right in its absolute discretion to:(a) withdraw any lot or lots before or during the sale.
(b) refuse any bid without indicating grounds or reasons therefor.
(c) resolve any disputes as it thinks fit.
(d) advance the bidding as it thinks fit.
(e) determine who is the Purchaser.
The booking of any lot by the Auctioneer’s Sales Clerk for and on behalf of
the Auctioneer shall be equally binding on both Purchaser and Vendor.
3. RISK
(a) Each lot shall be at the risk of the Vendor in respect of any damage or
injury whether by disease, accident or otherwise or whether caused by the
negligence of the Auctioneer for the period that the lot be in the custody of
the Auctioneer, unless such lot shall have been sold, in which case such lot
shall be at the risk of the Purchaser in all respects from the acceptance of his
bid.
(b) From the fall of the hammer the Purchaser shall be responsible for all
expenses of the care of the lot and all losses and expenses occasioned by
the death or illness of or accident to the lots and shall hold the Auctioneer
and the Vendor indemnified against any such expenses and losses.
(c) Each lot is sold with all faults (if any).
(d) The Selling Agent, on receipt of written instructions so to do will make
arrangements on the Purchaser’s behalf for the feeding, transportation and
general attendance to stock after sale but no responsibility will be accepted
by the Selling Agent and all such service will be at the Purchaser’s risk and
expense.
4. ACKNOWLEDGEMENT OF PURCHASE
On the fall of the hammer the Purchaser shall give his name and address
and the name and address of the principal for whom he is bidding
(if applicable) and at the unfettered discretion of the Auctioneer the
Purchaser will immediately complete, sign and hand to the Auctioneer an
‘Acknowledgement of Purchase’ in such form as shall be required by the
Auctioneer. The Purchaser shall also be required to provide the Auctioneer
with any such other information as may reasonably be required by the
Auctioneer in respect of the purchase.

5. PAYMENT
(a) Except at the discretion of the Auctioneer, no lot shall be delivered to the
Purchaser unless payment of the purchase money together with any
additional charges included, is first made by the Purchaser to the Auctioneer
in legal Australian currency.
(b) The Purchaser will be liable for livery, agistment and transport charges for
lots not removed on the day of the sale and they may be moved to alternative
stables or agistment at the Agent’s discretion. Payment for the lot shall not
be regarded as made until such charges have been paid.
(c) The full purchase money for each lot shall be due and payable to the
Auctioneer on the fall of the hammer and prior to delivery, unless prior credit
arrangements have been made in writing with the Auctioneer.
(d) Where delivery before payment is arranged, accounts not paid within
fourteen (14) days of the date of sale will have interest applied at the current
rate charged by the Selling Agent on its Clients’ accounts. Interest charges
will be calculated from the date of sale on daily rests and will be capitalised
monthly.
(e) The Purchaser shall pay the Auctioneer on demand all collection costs and
expenses (including legal costs on a Solicitor and own Client basis) incurred
in recovering any payment from the Purchaser.
6. PROPERTY IN LOTS
(a) Notwithstanding that delivery of any lot may be given to the Purchaser,
and/or the forbearance by the Auctioneer to require payment to be made
by the Purchaser in terms of these conditions prior to delivery, property
in the lot shall not pass until all moneys payable to the Auctioneer by the
Purchaser shall have been received by the Auctioneer and all Cheques, Bills
of Exchange tendered in payment have been liquidated.
(b) Until such time as property in the lot shall pass to the Purchaser in the terms
and conditions contained herein, the Purchaser shall hold the lot as bailee only.
(c) If the Agent accounts to the Vendor for the purchase price or the balance
of the purchase price owed to the Vendor before the purchase price and
other amounts payable by the Purchaser have been paid, title to the lot
shall thereupon pass to the Agent, and the Agent shall have all rights and
remedies under these conditions as if it were the Vendor.
(d) Until title to the horse has passed to the Purchaser, the Purchaser shall
not exercise or purport to exercise any rights of ownership or possession
including without limitation registering the horse.
7. DEFAULT BY THE PURCHASER
Should the Purchaser neglect or fail to comply with any of the above conditions,
the Auctioneer and/or Vendor may immediately retake possession of the lot or
lots for resale by public auction or private contract at the risk of the former
Purchaser who will be held responsible for all loss and expense arising out of
such resale but shall not participate in any profit accruing therefrom.
8. AUCTIONEER’S LIABILITY
(a) The Auctioneer is the Agent merely between Vendor and Purchaser and in
all disputes arising from defect of title, wrong description, pedigree, warranty
or otherwise, the Purchaser and the Vendor must adjust the matter between
themselves, and no lot is to be returned to the Auctioneer.
(b) The Auctioneer shall be under no liability for the loss, if any, incurred by the
Vendor by reason of the failure on the part of the Purchaser to complete
his purchase. In particular, the Auctioneer shall under no circumstances, be
liable in any way to the Vendor in the event that a Purchaser defaults under
any terms or credit arrangement made between a Vendor and a Purchaser.
(c) The name, address and description given by the Vendor will in all cases by
furnished to the Purchaser if required, and in case of any dispute the remedy
of the Purchaser shall be against such Vendor only and in no case or under

any circumstances against the Auctioneer, who is to be regarded for all
intents and purposes as Agent for a disclosed principal.
(d) The description, either as to quality, pedigree, engagement or otherwise for any
lot offered is supplied by the Vendor who alone is responsible for its accuracy
and the Auctioneer shall not be liable for any error in any such description.
(e) The Auctioneer shall not be required by the Vendor to account to the Vendor
for the sale price, prior to the expiration of forty-two (42) days of the date
upon which the purchase price is paid to the Auctioneer or of the date upon
which the Auctioneer has delivered the lot out of its custody, which ever date
by the earlier.
9. NO WARRANTIES OR GUARANTEES
(a) Excepting those conditions and warranties implied by any applicable
legislation which cannot be contractually excluded and further excepting
conditions expressly contained in these conditions of sale, all conditions,
warranties, guarantees and representations in respect of any lot, whether
expressed or implied (whether by statute or otherwise) are excluded and no
warranty, guarantee or representation of any kid whatsoever is made or given
by the Auctioneer or the Vendor.
(b) Without derogating from the generality of Condition 9(a), no warranty,
guarantee, representation or condition shall be enforceable only if reduced in
writing prior to the sale and signed by the Vendor or the Auctioneer as Agent
for the Vendor and the absence of such writing shall be conclusive evidence
that no warranty, guarantee, representation or condition whatsoever is made
or given or to be implied.
10. WARRANTIES AS TO CONDITION
(a) Should a lot be addicted to windsucking, the fact shall be disclosed by the vendor
to the Auctioneer and shall be announced by the Auctioneer before offering the
lot, and the lot shall be taken by the Purchaser with that or those defects.
(b) Should a lot prove to be a windsucker within seven (7) days of the date of sale
and the same was not disclosed by announcement to the Purchaser prior to the
sale of that lot, the sale shall be deemed to be rescinded upon the production
of a Certificate by a qualified Veterinarian to that effect within seven (7) days of
the date of sale. Upon the rescission of the sale, the lot shall be delivered by the
Purchaser at his expense to the Vendor’s property with that Certificate and all
moneys paid by the Purchaser shall be refunded and no further action at law or
in equity shall be taken by either the Purchaser, the Vendor or the Auctioneer.
(c) For the purposes of this condition:(i) ‘Windsucker’ shall mean a horse which suffers from the vice of noisily
drawing in and swallowing air through its mouth.
(d) The description ‘colt’ includes a ‘rig’ or ‘crypt-orchid’. (The term ‘rig’ or
‘crypt-orchid’ applies to the male animals in which one or both testes have
not descended into the scrotum from the abdomen.)
11. PURCHASER’S OBLIGATIONS
(a) The purchaser acknowledges that
(i) he has had the opportunity to inspect the lot prior to the Sale;
(ii) he makes the purchase solely in reliance on his own enquiries and
inspection;
(iii) he has not relied on any statement or representation made by or on
behalf of the vendor or the auctioneer;
(iv) all lots are sold in their present condition, subject to all faults,
imperfections or other defects whether latent or patent; and
(v) no compensation is payable by either the vendor or the auctioneer for
any faults, imperfections or other defects.
(b) Any dispute arising between the vendor and the purchaser in relation to a
lot must be resolved between them only, and a lot cannot be returned to the
auctioneer or the Sale complex.

12. JOINT AND SEVERAL LIABILITY
(a) The Purchasers, if more than one, shall be jointly and severally bound by
these terms and conditions of sale and shall jointly and severally carry out
and perform same.
(b) Any person who advances a bid on a lot shall do so on the express condition
and understanding that should that person’s bid be the highest bid and such
bid is accepted by the Vendor, then that person shall be held personally
liable for the price so agreed upon regardless of the fact that that person
may be acting on behalf of another party, either disclosed or undisclosed to
the Vendor or the Auctioneer, provided however that his condition shall not in
any way negate the Vendor’s right to claim against any principal and in such
case, the bidder’s liability shall be construed to be by way of guarantee.
13. GOVERNING LAW AND PRIVATE SALES
(a) The applicable law is the law of the State in which the auction is held and the
proper forum is in that State.
(b) These conditions of sale shall, in so far as is possible, apply to the private
sale by the Auctioneer of any lot entered for the sale.
14. GST
The GST Status of the vendor of each Lot is indicated next to the Lot Number
on the catalogue page.

15. INTERPRETATION
In these conditions:
‘Auctioneer’ means GDL and McCaffrey’s Australian Livestock Marketing and
includes their Officers and Agents.
‘Purchaser’ means the person or Corporation to whom any lot is sold.
‘Vendor’ means the person or Corporation on whose behalf any lot is sold by
the Auctioneer and where more than one shall mean each severally and any
two or more jointly.
16. DISCLAIMER
For the information of Purchasers, the Auctioneer has printed Pedigree,
Age, Notes and Suitability information on the lots catalogued for sale which
has been provided by vendors. The Auctioneer, its officers and agents
for themselves provide all information without responsibility and give no
guarantee whatsoever as to it accuracy.

BEEF CATTLE AND HORSE SALE
INSPECTION, PENNING & SELLING AREAS
IMPORTANT NOTICE
These areas will be busy with Stud Handlers, Grooms,
Vendors and Attendants preparing livestock for sale.
All persons entering these areas are advised:
1. It is a strict condition of entry to those areas that any person
who enters these areas does so entirely at their own risk.
2. Children under the age of 14 years must be accompanied
and supervised by an adult at all times in these areas and
they should not be taken anywhere near where livestock
are moving outside their allocated pens.
3. Do not attempt to enter the pen of any animal other than
with the permission of the owner of the animal, or their
authorised representative, and in their presence.
4. Each person in attendance in these areas will abide by all Rules
and Regulations as to their right to be in, and remain in these
areas, and will comply with all directions whether written or
verbal, given by the Selling Agents from time to time.
5. Each person in attendance in these areas will accept full
responsibility for any harm or injury whatsoever that may
be incurred or suffered by them or their property whilst in
these areas and expressly agrees to indemnify and save
harmless the Selling Agents, their officers and agents
against any claim, action, proceeding or legal process of
