Dworken & Bernstein’s Ohio Lawyers Give
Back program, unclaimed monies from class
action settlements are now being directed
to charities and nonprofits across the state,
including Flying Horse Farms.
Because class actions take years to resolve,
when it’s time to give back settlement
monies, many class members can’t be
found. Some have passed away. Others have
moved or remarried. With no other place for
it, the unclaimed monies are returned to the
defendant. To address this situation, courts
are using an ancient legal doctrine from the
third century called cy pres. Cy pres means
“as nearly as possible.” It allows the court to
put a beneficial use to monies, where the
payment as intended has not been made.

As a leader in plaintiff class action litigation,
Dworken & Bernstein founded the Ohio
Lawyers Give Back program 10 years ago to
promote the use of cy pres in class action
settlements in Ohio. Almost $25 million
has already been distributed to charitable
causes —and Flying Horse Farms was
a beneficiary in 2013 for the Cleveland
Flyathlon. Proceeds from the event funded
Flying Horse Farms programs, making it
possible for many children to experience
the magic of camp.
Dworken & Bernstein was made aware
of Flying Horse Farms by an advocate at
a non-profit fundraiser last summer. The
cause resonated with Barbara Marlowe, who
oversees Marketing and Public Relations at
Dworken & Bernstein, because of its service
to families and children who are seriously ill
and Flying Horse Farms’ many connections
to the medical community in Cleveland.
Marlowe suggested to Mimi Dane that the
camp fill out an application to the Ohio
Lawyers Give Back website for a future cy
pres distribution. Not long after, Flying Horse
Farms was selected to receive funds.
Dworken & Bernstein has been a trailblazer
in the state of Ohio in using cy pres for
the benefit of non-profits. While settling
claims with cy pres can be a more difficult
process, Dworken & Bernstein believe it’s
well worth the additional time. “What’s a
little extra of your time when you’re talking
about distributing hundreds of thousands
of dollars to charities in a single case?”

Healing through distraction: it’s something the Columbus
Blue Jackets Foundation and Flying Horse Farms both
know a lot about. The Foundation is the charitable arm
of Columbus, Ohio’s beloved hockey organization.
It focuses on supporting kids and families affected by
pediatric cancer.
“When a Blue Jackets player visits a child in the hospital or
a child has an opportunity to attend a game and visit with
players behind the scenes, it brightens their day, provides
a different focus, and gives the child respite from being
sick,” explains Foundation Executive Director Jen Bowden.
“That’s where our mission aligns with Flying Horse Farms,
because camp also gives kids respite from being sick,
allowing them to just be kids.”
Because of this special commonality between the
organizations, Flying Horse Farms has been the
beneficiary of several gifts from the Foundation, including
a $50,000 capital contribution for the development of the
Columbus Blue Jackets Sport Court on the Flying Horse
Farms property and a $25,000 grant to support
oncology camp in 2013.
The Sport Court at camp is connected to an issue that’s
near and dear to the Columbus Blue Jackets. “All of our
athletes started in their careers by playing sports early
in life,” says Bowden. “Even if a child will not become a
professional athlete, the life lessons they gain by playing
sports are invaluable—lessons on teamwork, character,
and dealing with adversity.”

And at Flying Horse Farms, the Sport Court is often the
setting for exactly that: games and activities that allow
campers not only to have fun and exercise, but also to
gain confidence and important skills.
Beyond providing generous donations, the Foundation
is actively engaging Flying Horse Farms campers who
have oncology illnesses. At the Black Tie Blue Jackets
Style Show on February 25th, the organization’s annual
fundraising gala, two Flying Horse Farms campers and
their families had the opportunity to let loose and
celebrate for an evening while modeling the latest
fashions from local independent retailers alongside
Blue Jackets players and their spouses and significant
others. Leading up to the big event, campers participated
in special hockey activities, attending and being a part of
games and behind-the-scenes activities with players.
“Another important piece of the annual gala is that we
are able to evangelize about the importance of funding
pediatric cancer research,” Bowden says. “Right now, grant
funding from the National Institute of Health contributes
only 4% of all federal cancer research funding dedicated
to pediatric cancer research. We believe it’s important to
help raise funds to support the cause, and to partner with
organizations like Flying Horse Farms that provide great
opportunities for people to get involved.”
Flying Horse Farms is proud to join the Columbus Blue
Jackets Foundation in raising awareness of pediatric
cancer—because it’s an illness and a reality that affects
many of our amazing campers every day. We are grateful
for the Foundation’s support and look forward to a
continued partnership, filled with fun both on the ice in
Columbus and on camp’s grounds in Mt. Gilead.
2014 JUST GOT A LOT MORE FUN.
“We just wanted
to be a family
and have fun.
And that’s what
we got to do.”
One afternoon in September 2012, everything changed
for the Henderson family.
“We took our daughter, Addison, to the doctor because she’d
had several low-grade fevers, bruising, a severe ear infection,
and a rapid 10-pound weight loss,” remembers Addison’s
mom, Jody. “We knew something wasn’t right but never
guessed it to be cancer.”
That day, 8-year-old Addison Henderson was diagnosed with
Acute Lymphoblastic Leukemia, a cancer that invades the
blood and can spread throughout the body to other organs.
While Addison is technically in remission from the leukemia
now, her treatment continues. To get rid of all the leukemia
cells in her body, she must stay on a treatment regimen
for two and a half years. For nine months, she received oral
chemotherapy, IV chemotherapy, and lumbar punctures.
She will continue with monthly treatments until January 2015.
“Addison developed pancreatitis at one point and was very
sick,” Jody says. “The hardest part is that the treatment wreaks
havoc on her body, and she functions at a lower level. She tires
easily and has limited muscle movement.”
But in 2013, little could hold Addison back from having the
time of her life at Fall Family Camp, which she attended with
her mom, dad, and two younger sisters. At Flying Horse Farms,
Addison zip-lined for the first time, spent hours upon hours
at Angie’s Arts and Crafts making animals out of recycled
materials, and tried her arm at the bow in archery. She and her
sisters had so much fun in archery at camp that their parents
recently gave them all practice bows—with suction-cup
arrows—for Christmas.
Addison especially enjoyed canoeing with her family, since the
port in her chest used to deliver drugs to her body prevents
her from being able to get in the water at the lake or ocean.
“Being able to at least be on the water was really awesome,”
Addison says.
“We’d never camped before and, honestly, we weren’t sure
what to expect,” Jody says. “The counselors explained all the
activities so well. There were plenty of people to teach the kids
and make it fun for them. Everything exceeded our wildest
dreams. I joked that showers are better at camp than at the
hospitals—but they truly are. It was so nice and not at all what
I thought camping would be like.”
The Hendersons enjoyed camp so much, and felt so
comfortable at Flying Horse Farms, that they’ve registered
Addison for summer residential camp this year—which she’ll
attend on her own, this time without her family’s company.
“Yes, it’s a serious decision to let her go on her own,” Jody
says. “But it’s a pretty easy one to make. During family camp,
we spoke with the medical staff and interacted with them a
lot, they sat with us at our table, and it was clear they knew
everything about what was happening at camp with the kids.
After that experience, we knew she could go away for the
week and be safe.”

Earlier this winter Addison strutted her stuff as a participant
in the Blue Jackets Black Tie style show and pediatric cancer
research fundraiser hosted by the Columbus Blue Jackets
Foundation. And in just a few short months, she’ll be back
at camp.
“Even after just two days at camp, we loved it and didn’t want
to leave,” Jody says. “It’s very emotional—you are happy and
your kids are happy. You forget everything and have fun.
There’s no TV, no cell phones, no iPads. Everyone just plays
with each other. We had one goal when we came to camp: we
just wanted to be a family and have fun. And that’s what we
got to do.”

Our campers heart duct tape.
Because of in-kind contributions from ShurTech Brands, the
makers of Duck brand duct tape, Flying Horse Farms and other
SeriousFun camps are able to provide our campers with more
wallet-making, flower-fabricating, accessory-creating, and hours
of crafting fun.
Through its partnership with the Alcoa Foundation,
Flying Horse Farms developed a summer staff fellowship
program in 2011. In this program, Alcoa Fellows work as
counselors and camp leaders to campers, while helping
to establish environmental and sustainability-infused
learning opportunities.
The partnership between Flying Horse Farms and the
Alcoa Foundation has been such a success for the past
three years that the program is expanding to six additional
camps in The SeriousFun Children’s Network.
The following camps will be launching the Alcoa Good
& Green Fellowship program at their camps in 2014:

· DOUBLE H RANCH, NEW YORK
· OVER THE WALL, GREAT BRITAIN
· THE HOLE IN THE WALL GANG CAMP, CONNECTICUT

Flying Horse Farms is thrilled to share this meaningful
program with our broader network of camps. And we look
forward to welcoming our fourth class of Alcoa Good and
Green Fellows in Mt. Gilead this summer.
ShurTech Brands is just one of our many in-kind partners that
help enhance the lives of our campers.
From HVAC cleaning to toilet paper to garage doors, each in-kind
contribution, large and small, helps defray our operational costs so we
can bring more children with serious illnesses to camp.
