Tuesday Volume 4 Issue 1 Issue Date: February 19, 2013 CONNECTING THE LOCAL BUILDING INDUSTRY ADOT Public-Private Venture Moves Towards Flagstaff Construction By Eric Jay Toll for Arizona Builder’s Exchange New ADOT and Motor Vehicle offices are to be developed in Flagstaff using ADOT’s first public-private partnership (P3). Vintage Partners has been selected as the developer for the project and will construct a new office building for ADOT and MVD. In exchange, Vintage will get title to ADOT’s existing building at 1801 S. Milton Rd., Flagstaff. The deal lets the two agencies move into needed new digs at no cost to the department. The arrangement adapts an existing Harkins Theatre, 1959 S. Woodlands Village Blvd., into offices. Construction will begin as soon as Harkins picks a new location for its state-of-the-art new theater. and MDV, building the roads, and redeveloping the current ADOT site—is expected to take three to five years. When the two state agencies successfully move into their new site, Vintage will take ownership of the old state property on Milton Road. 1801 S. The City of Flagstaff is a part of the overall project, adding city property to the ADOT package to create a new 18 acre parcel. The move lets the city complete an extension of University Drive. Beulah Blvd. will also be realigned, and the combined reconstruction creates a new cross-town access in Flagstaff. The new deck construction could start by the beginning of March. The 600-foot-long bridge is located about 17 miles south of Interstate 40. It was built in 1954. ADOT says the bridge’s surface has been repaired over the years but has deteriorated more rapidly recently due to an increase in traffic. Emergency repairs were made in January. “This current repair will provide an intermediate measure, but our goal is to replace the entire bridge in the near future,” said ADOT Bridge Engineer Jean Nehme. “The new bridge will feature wider travel lanes and meet today’s bridge design standards. We are working on scheduling the bridge replacement project as soon as funding will allow. The bridge replacement is estimated to cost $18.5 million, which will need to be allocated through the agency’s FiveYear Transportation Facilities Construction Program. The Tentative Five-Year Program, which requires approval from the State Transportation Board, recommends replacing the bridge in Fiscal Year 2015. It includes a 60-gate airport terminal just south of where the freeway will someday cross Ellsworth Road. It embraces the concept of a worldclass “aerotropolis” that may become one of the state’s strongest economic nodes. Creative bond plan Its vital first mile is scheduled for completion late this year, connecting a curving stretch of Loop 202 to Ellsworth and to some of the most economically fertile parts of the East Valley. The basic idea: Mesa borrows money on the bond market and turns it over to the Arizona Department of Transportation to build the freeway. Mesa repays the bonds with money it is scheduled to receive in due course from the Proposition 400 transportation sales tax that county voters approved in 2004. When the road opens, however, Mesa will celebrate far more than a new stretch of pavement. It will tout a creative financing scheme that sped freeway construction by four years while saving taxpayers tens of Ms of dollars. Mesa got the project rolling while land prices were low and recessionstricken contractors were willing to work cheaply. ADOT spokesman Doug Nintzel said the total price for land, construction, design and environmental work will be $97.3M, all covered by Mesa’s bonds. The mechanism Mesa used to accomplish this goes by the name “highway project advancement notes.” It’s a special type of bond authorized by the Legislature during the past decade at Mesa’s behest, when the city was seeking a way to speed construction on its part of Loop 202. Prime real estate Ellsworth Road, where the freeway’s first mile will terminate, bisects two of the most storied properties in Valley history: Williams Gateway Air Force Base—now Phoenix-Mesa Gateway Airport—and the old GM Proving Groups, now primarily DMB’s Eastmark development. Mesa is the only Valley city to have used the bonds. Mesa officials have said the arrival of Arizona 24 could speed development of the airport’s east side, where long-range plans call for a passenger terminal with up to 60 gates. “The biggest beneficiary is the private sector,” Scott Butler, Mesa’s government-relations director, said, mentioning specifically DMB Associates of Scottsdale, which is developing the northern 5-square miles of the former GM property. DMB has scheduled the grand opening of its Eastmark development, and its first houses, for June 1. Mesa expected the freeway’s first mile to cost up to $217M. As the recession undermined the costs of both land and construction, Mesa eventually borrowed $122.8M in two installments — nearly $100M less than anticipated. Read more at AZCentral. The agreement sets into motion efforts for Rio Nuevo to begin spending its sales tax proceeds on repairs to the aged Tucson Convention Center and pursue a public-private partnership on a downtown hotel project. Both were hallmarks of the original Rio Nuevo proposal that voters approved in 1999. The city and district are talking about a convention hotel. This is the value of the property as an in-situ copper mine, as determined by consulting firm Deloitte LLP, as of August 6, 2012, the day the Town Council passed the ordinance. This compensation demand is contained in a notice of claim from Curis legal counsel to the town dated Feb. 1. Florence has argued that it actually took nothing from Curis, and the company’s property remains viable for residential development in keeping with its zoning. But another appraiser concluded that as residential property it would be $7M in the hole, after the costs of closing the mine and accounting for archaeological resources. Curis owns 1,182 acres, plus a mineral lease on 160 acres of state land. When the Town Council refused to provide industrial zoning to allow the Florence Copper Project to operate, Curis focused its attention on the state land. But the town’s sulfuric acid ordinance, which extends for two miles beyond the town limits, takes The Florence Copper Project is designed to dissolve the copper deep underground with injection wells, and pump the solution back to the surface with recovery wells. Curis Resources President Michael McPhie said in a letter dated Feb. 4 to the Town Council, “our Phase 1 Pilot Test Facility (PTF) well field will only occupy two acres of State Trust land and contain just four injection wells. This makes the Florence Copper Project illegal to operate as it awaits permits to conduct a one-year test run. Curis responded in October with a lawsuit in federal court to overturn the ordinance. Stage Set for Dueling Appraisals Deputy Town Manager Jess Knudson said Tuesday that repeal of the ordinance is not something the council is considering at this time. As for the land values asserted in the notice of claim, Knudson said he had no comment on the numbers themselves, except that “the town believes the numbers are definitely overstated.” Curis retained consulting firm Deloitte LLP to render an opinion as to the fair market value of the state land and adjoining land. The notice further notes that Curis retained Paul Johnson, MAI, for an opinion of Curis’ land as a residential development. His firm concluded the value of the state mining lease and the adjoining land as a residential development is zero. Read more at Florence Reminder & Blade-Tribune Settlement Reached in Suit Over Paradise Valley Ritz Carlton By Paul Dionne for Vizzda.com Five Star Development, LLC and iStar Financial have filed a settlement agreement with the court, resolving their longstanding dispute over the land for the Ritz Carlton Paradise Valley. The settlement includes an amended and restated carve-out guaranty. The planned development was to include a 225-room Ritz Carlton-branded hotel, luxury condominiums, single-family residences and a retail center. It sits on approximately 120 acres at the northeast corner of Mockingbird Lane and Lincoln Drive in Paradise Valley. Five Star Development forfeits a $13.3M letter of credit currently in escrow and must pay an unspecified amount to iStar by July 2013. iStar cannot initiate foreclosure proceedings on the property until after the settlement termination date. Five Star is free to pursue entitlement action on the property, the project will not go forward as originally envisioned due to time constraints placed on the site by Ritz Carlton and the Town of Paradise Valley. The suit—as well as four others in various stages of adjudication—stems from an $112M credit facility established between Five Star Resort Development, LLC as borrower and iStar RC Paradise Valley, LLC as lender. Pima County Administrator Chuck Huckelberry calls it the “basic fundamentals of employment.” Elias said the city also has begun to focus more on economic development. Specifically, he cited a series of initiatives that helped developers Rob Caylor and Art Wadlund decide to build a $16M Class A mixed-use office tower downtown at 1 E. Broadway. A corridor of opportunity can be located south of Tucson International Airport between interstates 19 and 10. Paul Gosar and Ann Kirkpatrick once were campaign rivals. They represent opposite sides of the political spectrum and rarely vote the same. Now, the two are working hand in hand on major legislation that, if successful, would end eight years of stalemate on a proposed copper mine near Superior that is expected to create thousands of Arizona jobs and pump billions into state coffers. Experts say it’s a rare kiss-and-make-up partnership on Capitol Hill. Gosar and Kirkpatrick have put aside their differences. Opponents of the mine don’t see it that way. An array of American Indian tribes and environmental groups, many of whom Kirkpatrick will be depending on for re-election, worry about water contamination, destruction of recreational and religious sites and an unfair exchange of lands that would benefit a foreign mining company. To the tribes and environmental groups, it felt like a slap in the face when Gosar and Kirkpatrick announced Thursday that they had introduced the mine legislation in the House, along with Sens. John McCain and Jeff Flake, both R-Ariz., in the Senate. The mine bill, authorizing a swap between the federal government and the mining company of thousands of acres of Tonto National Forest for land elsewhere in Arizona, has been in the pipes of Congress since 2005. Four Arizona representatives — including Gosar and Kirkpatrick — have attempted to move it forward. Kirkpatrick says she will support the mine project but also represent the concerns of the tribes.
