President’s Letter
Heroes Are Among Us
W
ith the hard work of a lot of people, we have prevailed on the residential sprinkler
bill, by striking a three-year compromise delay on implementation, despite an
impassioned and sometime ugly campaign on the part of the Fire Fighters
Association and sprinkler industry. One of the unintended benefits of this effort was that our
lobbying stirred up reform fever on the Senate floor and subsequently an amendment that makes
all changes in the building code subject to legislative approval. With this new ammunition we can
hopefully keep sprinklers out of new homes until the cost becomes more affordable, or better
technologies are developed along with anything else new and onerous that they throw at us.

Look for significant restructuring of the Building Codes Council in the coming months also.
The state legislature has correctly sorted out this issue and decided that affordable new
housing is a better way to prevent fire deaths than residential sprinklers. Had we been unsuccessful, the economic impact
on our industry would have been between $100-200 million each year. While the firemen like the label of “heroes” and used that image shamelessly in their lobbying effort, we had some of
our own “heroes.” Knowing this would be a tough year for the association budget, we wondered how we could financially afford this very expensive fight. The cost of losing was astronomical and far-reaching. All builders would be affected
and many more would be put out of business by this added, unrecoverable expense. Subsequently, I started making calls
to some of the state’s largest builders, who would be the most impacted, with a plea to help build a supplement to the
Issues Mobilization Fund for fights like this. Loosing this particular battle would have a more profound affect on the
higher volume builders, and I hoped that they would all be forthcoming with additional support. While not everyone “got
it,” Michael Nieri of Great Southern Homes, Karl Haslinger of Essex Southeast and a few of the Executives from NVR/
Ryan Homes understood the impact and offered to help. Without their help and the resources of a few others, we might
not have had the wherewithal to win and most certainly would have been left unable to mount any other effective battles
this year. These folks are OUR heroes. Please take the opportunity to thank them.
Some of our other “heroes” were the members who took their time to come to the State House the day of the Senate debate
and line the corridors, and the EO’s who put out the rally cry . Their presence was really felt and we learned that it takes large
numbers to get the legislators’ attention. I would especially like to recognize Earl McLeod and Nick Nicholson for their efforts.
Our overall association effort on this was impressive too. Andy White, our legislative chairman, did an extraordinary job
learning the issue and testifying on our behalf, as did Mike Lowman. Many others called their senators and house
members and even though you might not be named you get the satisfaction of knowing that you were one of the keys to
victory. Even with the best efforts of our members, we could not have done this without our professional lobbyist and we
would like to thank Richard Davis and his staff and Darrell Campbell, as well as our own Julian Barton for their tremendous professionalism and ability to get the legislators to understand this issue.
While it feels good to win, we must be mindful that there are many battles in front of us. It would be wonderful to be
able to sit back, relax and congratulate ourselves, but there are so many other challenges to our industry that we can’t
afford to rest. The choices are clearer than they were before. If we want to stay in this industry we must work harder and
smarter and do more to affect regulation, legislation and zoning. It will take lots of time, money and effort again and again
to keep us viable and profitable. Unfortunately, failure is not an option.

ccording to the latest Moore Business
School Housing report, new homes sales
have increased across the country over
several months as consumers sought to take
advantage of the homebuyer tax credit, which
expired in April, but has now been extended to
September 30, 2010. The extension only applies,
t
however, to those homebuyers who had a
binding sales contract in place prior to May 1,
2010. According to the Internal Revenue Service,

approximately 27,000 taxpayers in South
Carolina have received over $197 million from this tax credit.
Nationwide, new home sales have increased by 26.9 percent,
and re-sales are up 6.8 percent. Housing starts in South

Carolina jumped 39.5 percent and are
nearly 47 percent over this time last year.
This is all good news for the housing
sector, but what will happen now that the
tax credit has expired?
In the short-term, the expiration of the tax
credit is expected to lower the sales of
homes in South Carolina. On the demand
side, the expiration of the tax credit can be
thought of as having a similar effect to an
increase in the cost of the median house.
Prospective homebuyers, in effect, are subjected to a price
increase. On the supply side, sellers who may have been able to
command a higher selling price knowing that buyers had
access to a tax credit will now be forced to lower their asking
prices. Yet, this is not the whole story.
Overall economic conditions are continuing to improve,
which will partially offset the negative effects of the expiring
tax credit on home sales. Employment levels in South Carolina
increased in the first quarter in most major industries except
manufacturing–construction, education, government, leisure,
and professional services. The unemployment rate in South
Carolina dropped for several consecutive months to 10.4
percent despite the fact that the size of the labor force
remained unchanged over the same time period, implying
that the reduced unemployment rate was not simply the result
of people dropping out of the workforce. For the housing
industry, an increase in employment points to an imminent
increase in housing demand in the coming months. Private
investment is also beginning to recover and has increased by
9.7 percent over the last quarter, marking the first increase
since 2007. This has positive implications for long-term
economic growth and further job creation. The economic
growth that has occurred since July of 2009 has been largely
due to the national fiscal stimulus and is not sustainable.
Private investment and consumer spending are the largest
components of GDP and are what is needed to drive longterm growth–both are currently increasing.
There is a path to long-term economic growth being
established in 2010. Private investment, the one piece of GDP
that had yet to recover, now appears to have stabilized and
will help prevent the economy from relying on the fiscal
stimulus for the majority of its growth in coming months. In
South Carolina, employment in most job sectors increased in
the first quarter of 2010. Both of these factors will help offset
any adverse impact of the expiring homebuyer tax credit.
Though foreclosures have increased in the coastal areas of the
state, this is primarily a reflection of the second homes market.
Foreclosures have decreased elsewhere in the state and sales
figures are increasing. Overall decreases in the housing supply
combined with job creation will lead to increased housing
demand, but housing starts will continue to rise slowly until
credit restrictions are eased and loans become more accessible
to residential builders. SCBJ

The premise behind the bill was to allow projects that had
been begun, or whose permit was running out, to have some
breathing room as the economy slowly recovers. The bill was
introduced by Rep. Dwight Loftis and Senator Ray Cleary in
response to the downturn in the construction industry.
Permits that normally would have been completed in a timely
manner are not being completed on schedule due to the
lingering recession.
The bill resurrects development and building permits by
state and local government agencies that were valid on or after
January 1, 2008, but have since expired. It allows the resurrected permits to remain valid until December 31, 2012. For
permits that were still valid on May 19, 2010, the bill provides
a “tolling period” which stops the clock on the permit until
January 1, 2013 when the clock starts running again.
The additional time provided by the bill insures that the
permit doesn’t expire and that a new permit does not have
to be purchased. While this is a temporary solution, it
provides some much needed help as the construction
industry recovers. SCBJ

he 2010 General Assembly session will go down in
the history books as one of the more contentious
sessions in recent memory. Legislators were facing a
perfect storm – pending election in November and declining
state revenues. As a result, every decision and vote was seen
through the prism of election-year politics.
Part of the problem was that the normal practice of loosening the purse strings around election time to soothe the
electorate was not an option this year. Continuing declines in
state tax revenue left a very lean state budget with no money
for frills. In fact, the state budget was not passed until
June 28—two days before the state fiscal year began and six
weeks late. Compounding the problem was the fact that the
electorate was unhappy with the continuing recession. The
growing sentiment among many of the rank and file voters
was to “throw the bums out!”
With this as a backdrop, the SC General Assembly pushed on
and addressed a number of important issues -- several of
interest to home builders. Two issues of particular interest were:

Permit Extension Bill (H.4445)
The permit extension bill (H.4445) was signed by Governor
Sanford and went into effect May 19, 2010. This bill will be
proactive in helping our state’s economy recover.

The Home Builders Association commends Governor Sanford
for signing the bill. It received an overwhelmingly affirmative
vote in the SC Senate (38-0) and the SC House voted to concur
with the Senate (100-1). It had been clear for some time that the
General Assembly had no appetite for the state government
mandating residential fire sprinklers. Back in the Spring, the SC
Building Codes Council voted to implement a statewide
residential fire sprinkler mandate effective January 1, 2011. This
bill blocked the SC Building Code Council mandate.
The sprinkler choice bill contains a number of positive points:
1. The SC Building Codes Council’s sprinkler mandate
set to begin January 1, 2011 is blocked! A regulation
mandating residential sprinklers can’t be enforced
before January 1, 2014 — at the earliest.
2. A study committee will be formed this fall to look at
ways to expand the use of integrated smoke detectors in existing homes and increasing participation of
local governments in the tax credit incentive program
passed two years ago.
3. Building codes will be treated like any other regulation promulgated by a state agency. This was the
practice when the IRC code was first adopted in
South Carolina in 2000!
4. Existing law requiring water utilities to provide water
service for sprinklers “at cost” was reinforced.

Three Men Join Group of Sixty Hall of Famers

members from across the
state gathered for the
Celebration of Excellence at the Hilton
Head Marriott Resort & Spa recently
to honor the achievements of their
friends and colleagues and to witness
the S.C. Housing Hall of Fame
induction ceremony for three
deserving individuals.
The Hall of Fame honors individuals
who have made a lasting contribution to
the housing industry through their work
in building and development, public
service and housing-related areas, such as
education, architecture and planning. The
Hall of Fame was established in 1995, and
has since accepted 63 outstanding
individuals from all over the state.
Harry Dill may be best known for the
three builds he and his team completed for
ABC-TV’s Extreme Makeover: Home
Edition. Yes, the Myrtle Beach builder is a
local celebrity due to his appearances on
television and in the newspapers, but don’t
let that fool you. According to his colleagues,
he has a huge heart for helping others in
need, and most of the time, he helps
anonymously. Dill doesn’t agree to build
homes in seven days on television because
he wants the notoriety. He does it because he
cares, and he wants to make a difference in
the lives of many — the deserving family
and the volunteers. Dill also supports the
Make-A-Wish Foundation, and serves on the
SC Chapter Board of Directors.
Part owner of Sterling Homes, Dill
serves the housing industry in many
ways, taking on leadership roles at the
Horry Georgetown HBA and the HBASC,
and he serves his county as chairman of
the Horry County Board for Construction
Appeals. Professionally, Dill’s career has
been exemplary, but it’s his commitment
to his community that has set him apart.
His tireless and exceptional work within
the homebuilding industry and his
community has elevated the credibility
and professionalism of the industry.
Since establishing RESH Marketing in
1979, Hal Von Nessen, MIRM, has
assisted in the marketing of over 15,000
new homes nationwide. He has provided
marketing assistance and strategy to
home builder associations across the
country, working to strengthen the
member services they offer. Von Nessen is
a strong supporter of the home building
industry and seeks to contribute to its
betterment nationally, regionally and
locally through educational efforts.
Greater Columbia HBA member Von
Nessen has written, produced and
presented educational programs to support
the housing industry. If you’ve ever taken
the National Association of Home Builders’
course IRM III: Lifestyle Merchandising,
Advertising and Promotion Strategies, you
can thank Von Nessen for writing the
course and providing guidance on model
homes and sales. Emblematic of these
efforts, he was elected by his peers to serve
as president of the NAHB Institute of
Residential Marketing (IRM), the first from
SC to serve in a national leadership
role. This education guru holds several
NAHB designations and teaches most, if
not all, of the courses associated with his
designations in an attempt to empower
HBA members with the knowledge and
tools necessary to be successful.
Since the beginning of his real estate law
career, Congressman Joe Wilson has been
an unrelenting champion of the housing
industry, both statewide and nationally. He
was first recognized for his efforts with the
prestigious HBASC Hammer & Trowel
Award during his State Senate days. He has
since continued his support of the housing
industry in the U.S. House of Representatives. Following his election to Congress,
Wilson was recognized for his outreach to
the NAHB on housing issues. His efforts to
support the industry have included the
defense, the introduction and the passage of
several notable and timely pieces of
legislation including the homebuyer tax
credit. He was the only S.C. Republican to
support the first key vote to establish the
tax credit, and he followed it through to the
final vote. Congressman Wilson has
supported other key issues of the homebuilding industry, even going against his
own Republican party. An active member of the Greater
Columbia HBA, Congressman Wilson
strives to keep the “American Dream”
affordable by supporting the housing
industry and its critical role in the economy. If there is one thing that sets
Congressman Wilson apart, many would
say that it is his personal interest in
housing. According to many friends, he
recognizes the critical impact the housing
industry has on the economy as a whole,
and has an understanding that housing’s
role in the economy is unparalleled. SCBJ

Honors Best of SC Homes
ome of South Carolina’s most
beautifully crafted homes were
given Pinnacle Awards at the
Celebration of Excellence award banquet
recently. This year’s Pinnacle Award
competition was close with one category
resulting in a tie. More than 19 awards
were awarded to new homes and remodel
project entries that exhibited outstanding
craftsmanship in the construction of
quality homes. Sales and marketing
awards were also given to those entries
that exhibited exceptional design and
delivery of the message. While a Pinnacle
Award was given to the entry that
achieved the highest score in each
category, finalist awards were also given
to entries that were exceptional in the
judges’ eyes. Only HBA members can
enter the Pinnacle Awards competition.

The inspiration behind the casual, yet

use of local materials and good crafts-
manship. They were typically asymmetrical in shape, often built around courtyards, and featured thick masonry walls,
sloped roofs and predominant chimneys.

sophisticated adult entertaining. Craftsmen created the mahogany cabinets,
moldings and raised paneling, as well as
many pieces of furniture seen throughout
the home. A glorious master suite
occupies the entry of the left wing. The
unique children’s quarters with custom
built-ins are located on the second floor.
Not to be overlooked is a complete

updated. The remodeling of this master
bathroom required skill and craftsmanship that took it from a very dated look to
a bathroom with spa-like qualities. The
old cave looking shower stall and its
sharply angled entry door took up a lot of
space. Aside from the shower, the
remaining bathroom appeared to have
great potential for a “Barrier Free” design
as it was spacious in general. Maintaining
the walk-in closet, a traditional soaking
tub and a separately-enclosed water
closet quickly consumed the available
space. Both entries into the his/her closets
were eliminated, allowing for additional
wall space in which to create a vanity

Inaugural Builder and Associate of Year Awards Awarded
J
ohnny Uldrick of Uldrick Builders in Greenwood and
Andy Barber of Builders First Source in Charleston are
the first recipients of the Builder of the Year and
Associate of the Year awards, two of the most prestigious Home
Builder Association of South Carolina (HBASC) awards. Both
awards are given to individuals who demonstrate service to their
community and home builders association and to the
homebuilding industry.
Johnny Uldrick
Johnny Uldrick was born and raised in Greenwood County. He
watched and helped his father build the family business, and
eventually joined his father in the homebuilding business.
During his construction career, Uldrick has been a devoted
supporter of the Lakelands HBA, serving in leadership positions
over the years and giving a large majority of his time to the
association. He’s also served in state and national assignments.
According to many in his community, Uldrick is a highly
regarded home builder and member of his community. His
customers swear by his work. In fact, he keeps a waiting list of
homebuilding projects, with some waiting for two years for him
to build their dream home. He offers mentoring and guidance to
other builders, who more than likely are his competitors. But, he
willingly offers his time and resources to them.
According to Lakelands HBA Executive Officer Nick Nicholson, “There may be no better person who exemplifies the title
‘Builder of the Year’ than Johnny Uldrick for his efforts as a
builder, member of our association, community volunteer, friend
and family man.”
Andy Barber
Since 1986, Andy Barber has
been a member of the HBASC,
first starting in Spartanburg.
Now a member of the Charleston
Trident HBA, Barber has a vested
interest in the success of the
Association. He has served on
the board of directors for nine
years; associates vice president
for five years; chairman of the
membership committee for four
years; and presently serves the
CTHBA events chairman,

Barber is credited with beginning the CTHBA’s education
agenda. He is a certified instructor for the National Association of
Home Builders’ University of Housing and he teaches classes
across the state. Barber is also credited by many in the CTHBA
for heavily contributing to the success of many of the revenuemaking events and to the overall association.
One remarkable attribute of his character was seen during
the Carol’s Home project, a homebuilding venture of the
CTHBA to provide an ADA-compliant home for a handi-
capped woman and her family.

arc Ellis started woodworking
with his grandfather when he
was just five years old. Marc
took what he learned from his grandfather
and his love of building grew over the
years. When he moved to Hilton head 34
years ago, he started his own building
company after working with other general
contractors for a while. “The Lord gave me
a talent that I’ve tried to take and do the
best I can with,” Marc said.

with its commitment to building relationships with subcontractors and vendors.
The benefit, of course, is the ability to give

“We have subs and vendors that we’ve
worked with for a long time,” Marc said.
“It’s that combination that creates the

to build anything in the residential
housing market.”

Even with challenges, Marc has been
able to build a successful company. As a
Marc credits the home builders
associations with getting him through
tough times and giving him the tools to
create a successful business. “The key to
my success, without question, is my
membership and involvement with my
local, state and national home builders
associations,” he said.
Marc takes membership seriously, and
puts in as much as he gets back. He has
been president of the Hilton Head Area
Builders Association three times. He
served as HBASC president in 2003. He is
also the local national director, and has
been for several years, and also served as
the state representative to the NAHB for
three years.
For Marc, membership in the home
builders associations is an absolute
necessity. The single piece of advice he
would give to any builder or associate of
the industry is to get involved. “For
everyone, whether you are big or small,
the networking ability you have is a big
plus,” he said. “With all of the benefits, I
just don’t know how anyone can survive
without being a member of the local, state
and national HBAs.”

Chairman, I have the task of
assisting our local HBAs in
spreading the word about
membership, but I was doing that well
before I got involved on the state level. I
cannot stress enough the importance of not
only being a member of the home builders
association (HBA), but also the importance
of being an active member. You can’t take
advantage of the benefits unless you make
the benefits work for you.
I’ve had many opportunities at various
HBA events to talk to members from across
the state about their membership experiences. I’ve heard positive stories about
everything from education and networking
to regulatory and legislative efforts, and I
want you to hear what I’ve heard.
In an e-mail to the HBASC, Greater
Columbia HBA member Frank Norris
commended everyone involved in the fire
sprinkler mandate bill stating that their
long, hard work “made the difference
between victory and defeat.” He went on
to say, “No one should ever question their
HBA membership.” Instances like the fire
sprinkler bill are why HBAs exist. They
advocate for our industry, for you. It’s
difficult for one person to fight a battle,
but with many involved, success is within
reach. “If you make your living directly or
indirectly from homebuilding, the very
least you can do is to have an HBA
membership,” said Norris.

best chance to be successful.

wasn’t for the HBAs, we would have been

Marc said.

The HBA has also given Marc the
opportunity to gain skills and knowledge. He is a Certified National Builder
for the state of South Carolina, is
EarthCraft certified, and is also a
Certified Green Professional with NAHB.
In addition, Marc is a Certified Master
Builder of South Carolina.

he has had, Marc is quick to point out that
valuable knowledge can be gained every
day through the home builders associations. “I really praise the HBAs and what
they do for our industry,” he said.
He feels that the HBASC executive
officer and the staff members at the local,
state and national levels are well
informed and keep every member of the
associations well informed as well.
“All you have to do is pay attention to
the HBA,” Marc explained, “and you’ll be
able to do 100 times better for yourself and
