UPPER MARLBORO – The
mother of a man shot and killed by
Prince George’s County deputy
sheriff last fall has filed a $10 million lawsuit against the county after a grand jury decided not to
move forward with an indictment.
Gregory Lattimer, the attorney representing Michele Minor,
Michael’s mother, has gone so far
as to call the case the “Ferguson of
Prince George’s County.”
“Michael Minor is Michael
Brown and Michael Brown is
him,” Lattimer said, referencing
an unarmed African American
who died at the hands of police a
officer in Ferguson, Missouri last
summer that gained national me-
dia attention. “I have been dealing
with police shootings for years
and years and years. So everything that people are now starting
to focus on is what has been going
on for years. Now the general
public is finally getting a view of
what I have seen for years.”
On the evening of Oct. 22,
2014, Michael Minor, 38, left his
Suitland home to walk his dog,
Lattimer said. According to the
lawsuit filed on April 6, on Oct.
23, 2014, Minor returned home
shortly after midnight, where
Deputy Sheriff Kendal Wade and
another officer parked outside of
his home.
According to the lawsuit, Minor, unarmed at the time, approached his home and officers
arrived as a result of a domestic
dispute call to the area. Lattimer
said no video evidence exists
showing Minor being involved in
any domestic dispute.
Prince George’s County police, however, said at the time
deputies responded to a call for a
domestic dispute reportedly involving a gun.
After arriving on the scene
and speaking with a woman inside, deputies learned Minor had
left the home prior to their arrival,
police said. The woman told the
deputies she called 911 after Minor assaulted her and she believed
he retrieved a handgun before he
left. While they were still on the
scene, Minor returned home and
confronted the deputies. During
the confrontation, one of the
deputies discharged his duty
weapon, striking Minor. Minor
was taken to a hospital where he
died several hours later.
Police said in a blog post on
Oct. 24 that the preliminary investigation “suggests Minor failed to
obey verbal commands and made
furtive movements during the encounter. No weapon was recovered on the scene.”
According to the lawsuit filed
by Michele, Wade drew his gun
and fired it several times at Minor,
hitting him at least once in the
chest and once in his shoulder.
Minor succumbed to his gunshot
wounds five hours later.

COLMAR MANOR – County
Executive Rushern Baker III and
the County Council may find themselves at odds once again.
Baker announced last Wednesday he has endorsed Congressman
Chris Van Hollen (D-8) for the U.S.
Senate in the upcoming 2016 election, but some members of the
County Council have chosen to go a
different route and elected to endorse Donna Edwards (D-4).
Baker said he chose to endorse
Van Hollen rather than Edwards, a
Prince George’s County representative and native, because of their experience working together in the
state legislature. The two have a
history of working together, he
said, and “rolling up [their]
sleeves” on difficult issues.
“That’s the type of relationship
I’ve had with Senator (Barbara)
Mikulski. I know that Chris, going
over to the Senate, will do that,”
Baker said. “It was an easy decision
in this respect. I don’t just know
him as a name or as a congressman—I know him personally and I
know the working relationship.”
However, all members of the
Prince George’s County Council
except for Councilman Todd Turner
and Councilwoman Deni Taveras
announced their support for Edwards at Prince George’s County
Community College Wednesday.
Edwards thanked the councilmembers for their support and
said she looks forward to working
with them at the Senate level.
“I am thrilled to stand with my
partners on the Prince George’s
County Council,” Edwards said.
“Together, we have worked tirelessly to improve education, expand economic development, and
stand up for our seniors. I thank
them for their support, and look forward to continue working with
them in the United States Senate.”
Mel Franklin, Chairman of the
Prince George’s County Council,
said he will stand with Edwards as
works to stand in Senator Mikulski’s “trailblazing” shoes in her senate seat.
“Donna's experiences and values have made her who she is today,
a principled, progressive fighter
with a unique, proven record of improving the lives of working families,” Franklin said. “That is what
she has done in Prince George’s
County, and that is what she will do
for all Marylanders."
Van Hollen said he is happy to
have the support of Baker, as well
as Montgomery County Executive
Ike Leggett who also attended the
press conference where Baker
made his announcement.
Van Hollen represents Congressional District 8, which used to
include part of Prince George’s
County as recently as 2013. In
Congress, Van Hollen said he has
done his best to give citizens the
best opportunities to “live the

County shuts down bridge in Bowie due to safety concerns

BOWIE – The county has shut
down the more than 100-year-old
Governor’s Bridge Road due to
problems identified by engineers
from the Prince George’s County
Department of Public Works and
Transportation (DPW&T).
According to department, the
closure comes as the result of deficiencies recently identified on the
bridge which crosses over the Patuxent River. Message signs will alert
traffic of this new road condition and
drivers are advised to stay alert and
use an alternative route to Governor’s Bridge Road to drive to Anne
Arundel County.
Paulette Jones, a spokesperson
for DPW&T said the county has an
agreement with Anne Arundel
County that any calls for maintenance associated with the bridge are
shared between Prince George’s
County and Anne Arundel County.
Governor’s Road Bridge is a
one-lane truss bridge built in 1907
that accommodates at least 900 vehicles daily, Jones said. The county’s
engineers conduct inspections of
bridges in six-month cycles.
“There are some areas of the
bridge that over time have deteriorated even more and because of the
age of the bridge, I’m not necessarily surprised at some of the repairs
that are needed,” Jones said. “But I
will say that at the interval of the sixmonth inspections, the bridge is
deemed safe and passable but at this
particular last inspection that we
had, there were portions of the
bridge that had deteriorated beyond
being safe and passable.”
This is not the first time the
bridge has been closed due to structural problems.
“The bridge has had to be in repair again in the past due to the age
of the bridge. I know for instance,
in 2014, DPWT provided there
were several beams identified as
failing and so they replaced those
beams,” Jones said. “Those beams
supported the bridge deck. So
there’s been ongoing maintenance
of the bridge.”
The county made its decision to
deem the bridge unsafe in March after conducting another six-month inspection.
“We just want to again express
to the constituents that we’re sorry
for the bridge being closed but that
we make it our number one priority
for everyone to be safe,” Jones said.
City officials say they do not
expect the closure to have much of
an effect on the lives of city residents. George Stephanos, director of
the city’s public works department,
said he did not even know of the
bridge closure until the county made
its announcement.
“The Governor’s Bridge Road
Bridge is actually a Prince George’s
County asset, not a City of Bowie asset,” Stephanos said. “So Prince
George’s County is the one who
made the decision to close the
bridge.”
David Deutsch, Bowie city
manager, said the bridge’s closing
will not affect the city economically.
“It doesn’t immediately serve a
business area. It doesn’t necessarily
limit access,” Deutsch said. “There
is limited access at one point but
there are alternates…It’s an inconvenience for folks more than anything, but I don’t see how it’s going
to affect commerce at all.”
Stephanos said traffic from
Anne Arundel County into the city
will not be affected because it is not
a central route.
“Governor’s Bridge Road,
when it hits there it kind of turns
very park-like and that bridge can
only handle one lane,” Stephanos
said. “So you have to stop and wait
for the oncoming guy to go through.
It’s not a main road,”
Bowie Town Center manager wants to host more carnivals

BOWIE – The manager of
Bowie Town Center has proposed a
change to the city code to allow the
center to host more than one carnival
a year.
Simon Property Group, proposed the change because last year
the city council changed the code to
restrict shopping centers to host just
one carnival per year.
“In the past, we have typically
hosted two carnivals per year and
are currently working with the city
to finalize our community engagement plans for 2015,” said Steven
Andrews, mall manager for Bowie
Town Center.
Attorneys representing Simon
sent a proposed ordinance to city
staff following a briefing of the city
council on March 2 regarding the
status of the town center.
According to Bowie City Manager David Deutsch, the city code
was changed “about six months
ago” and the company is asking it to
be changed back. The original code
did not restrict the number of carnivals held at Bowie Town Center. Under the original code, the city could
have more than two carnivals per
year if they wanted.

that carnivals and similar events
benefit the community by providing a family-friendly and safe experience that is unique while at the
same time, helping retailers financially.
“Bowie Town Center is committed to providing the community
with engaging events and entertain-
ment offerings, including our Friday
Night Live concert series, Santa Arrival events, Easter events and
more,” said Andrews.
Deutsch said he thinks the request is “workable.”
“I think that the company has
recognized the concern that the city
had and they’ve committed to making sure that there’s appropriate
preparation in place when these
events occur to minimize possible
problems,” Deutsch said. “The last
time that they had one, we had no
problems in terms of police activity
or noise complaints.”
At events years ago problems
occurred, such as noise issues and
need for police, but over the last
couple of years, the company has
done a “better job” in preparing and
working with the city police,
Deutsch said, and ensuring the carnival operator adheres to time constraints.
“I think it (the proposal) reflects a spirit of cooperation between
the city and Simon,” Deutsch said.
“I expect that the council is going to
support the request.”

General Assembly approves Public Information Act reform

ANNAPOLIS – The Maryland General Assembly passed a
bill before the end of its legislative
session Monday night that provides reform of the Maryland Public Information Act (MPIA) which
advocates of the bill say will provide greater transparency and access to public information.
On April 10, three days before
the last day of this year’s legislative session, the amended Senate
Bill 695 unanimously passed the
House of Delegates after passing in
the Senate on March 24.
The Senate bill, sponsored by
Sen. Jamie Raskin (D-20), passed
the House 138-0 and will create a
state Public Information Act compliance board. It will also create a public access ombudsman position in the
Attorney General’s Office. The bill
passed both chambers unanimously
on Monday night after a conference
committee amended the bill.
Both additions to the law,
Raskin said, will improve the
process of gaining access to public
information.
“This is an awesome victory
for public transparency and good
government,” Raskin said. “I’m
thrilled the legislation passed
unanimously—in the House and in
the Senate—and we have succeeded in amending Maryland’s Public
Information Act for the first time in
four decades to improve the pub-
lic’s access to public records.”
The compliance board will include five members – a combination involving an attorney, a nonprofit representative and someone
who has previously been a custodian of public information. Board
members, appointed by the governor, will serve three-year terms and
may not serve more than two terms.
According to the bill, the
board will review complaints of
charges of more than $350 and
mandate custodians to lessen the
fee if it determines the fees are unreasonable.
The board will also present an
annual report of all its actions to
the governor and the General Assembly by Oct. 1 for an audit.
According to the bill, the ombudsman, who the attorney general
has the power to appoint, will serve
a four-year term and “make reasonable attempts to resolve disputes
between applicants and custodians” regarding public information
requests.
According to the bill, disputes
include:
• The custodian’s application of an exemption
• Redactions of information
• Failure by a custodian to
produce records in a timely manner
or to disclose all records relevant to
the request
• Overly broad requests of
public records
• The amount of time a cus-
todian needs, given available staff
and resources, to produce public
records
• A request for or denial of
a fee waiver
• Repetitive or redundant
requests from an applicant
The bill continues to allow
agencies up to 30 days to provide
public records, but requires custodians to let the requestor know if it
will take more than 10 days to produce the records. If it will take
more than 10 days to provide the
information, the custodian must
explain the reason for the delay.
“We always have to remind
ourselves the government works
for the people and not the other
way around,” Raskin said.
On Dec. 31, 2016, the Office
of the Attorney General must report back to the governor how the
bill is working and what else can be
done to reform the act, according to
the bill.
Attorney General Brian Frosh
said he was happy to see the bill
pass.
“My office worked hard on
this legislation, because access to
information has long been a priority of mine. We all know that Maryland can do better to make sure the
public, as well as the media, have
ready access to legally available information. The best government is
an open government, and this legislation is a good step in the direction of more openness.”
The General Assembly ap-

proved another related bill that
would require state agencies to allocate one representative in charge
of completing PIA requests. Senate
Bill 862, sponsored by Sen. Ronald
Young (D-3), passed the third reading in the House 138-0 on Friday.
Raskin said this bill will ultimately meet the goal to make documents publicly available while
ensuring there is no extra burden
placed on employees who retrieve
the documents.
“This information is supposed
to be available to citizens, nonprofits, the media – whoever is looking
at it – and (the bill) is taking steps
to ensure that access is there,” said
Rebecca Snyder, the Maryland
Delaware D.C. (MDDC) Press Association executive director.
In Maryland, Snyder said, it
has been increasingly difficult for
people to get access to public information for both media workers and
nonprofit organization members.
Citizens can now view this information as completely open.
Although the bill underwent
several revisions, consensus remains that the bill will help provide
more transparency.
“Some people see this as a media issue, but it’s so much more
than that,” Snyder said. “It’s a huge
step forward.”
MDDC, along with several
groups in the state that came together as a coalition, has been
working diligently to advocate for
this bill. The Marylanders for Open
Government coalition formed this
year, which is a network of about
30 organizations that have been
pushing for changes to the MPIA.
Common Cause Maryland Executive Director Jennifer BevanDangel, whose organization is part
of the coalition, said the existing
45-year-old law needs this reform.
“It’s a tremendous step forward,” Bevan-Dangel said. “This
is something that we’ve seen as a
huge barrier for citizens, for journalists, for everyday people to find
out what the government’s doing.”
Bevan-Dangel said though
different groups looked at different
parts of the problem with the
MPIA for years – such as some
people trying to fix the fee discrepancy or looking into denials – no
one took the time to fully come together to achieve cohesive reform.
“For the first time ever, we’ll
have oversight with these public information act requests,” she said.
“And that alone … is going to make
a real culture change in the state.”
Bevan-Dangel said the bill’s
passage is an opportunity to review
how this goes and to further analyze later whether there needs to be
more reform. Bevan-Dangel said
there are more problems with government transparency, such as the
issue behind clarifying exemptions.
“It’s a great day for good government in Maryland,” Raskin
said. “Democracy depends on the
public having access to its own
documents.”

“There was no threat. (Wade)
had no basis to fear Mr. Minor and
there was no basis to say that he
was a threat,” Lattimer said. “But,
my understanding is that he used
the tried and true method that the
police have used for years and that
was the end of it.”
After an investigation into the
shooting in the Prince George’s
County Sheriff’s office, a grand
jury decided during the week of
March 30 to not indict Wade, said
John Erzen, spokesman for the
Prince George’s County State’s
Attorney’s Office.
“The grand jury declined to
indict, so our office declined to
prosecute because the grand jury
did not indict,” Erzen said. “I
don’t know why they chose not to
indict, but after hearing all of the
evidence they chose not to indict.”
Lattimer said he did not expect an indictment to come
against Wade for Minor’s death.
There are often no indictments or
prosecutions in cases against police officers because they are normally associated with shootings
caught on video, Lattimer said.
“Police officers engage in
conduct that results in the death of
black men every day,” Lattimer
said. “And, usually, they say the
magic words – that they fear for
their safety – and that is the end of
it.”
According to Lt. Jarriel Jordan, a spokesman for the Prince
George’s County police department, PGPD conducted their own
homicide investigation on the
shooting and ended up with the
same results as the grand jury’s investigation.
Jordan said the police department reviewed the case with the
State’s Attorney’s Office and decided to pursue no charges against
Wade.
“This case was reviewed with
State’s Attorney’s Office, who
presented all evidence to the
grand jury. The grand jury declined to go forward with any
charges,” Jordan said.
Michele Minor filed her $10
million civil lawsuit against
Prince George’s County, Sheriff
Melvin High and Wade on eight
counts, including wrongful death,
police brutality, assault and battery and deprivation of civil
rights.
Lattimer said the lawsuit did
not come as a result of no indictment on Wade but from the desire
to “have the truth come out and
vindicate his death in the only
way we can without criminal
prosecution.”
There has yet to be any proof
of a domestic situation, Lattimer
said, and he has been trying to obtain a copy of the 911 call over the
last few months, but it has not yet
been presented to him despite efforts and requests to officials for
evidence.
“The only thing known for
sure is that Mr. Minor was unarmed when he was shot. That is
the only thing we are absolutely
certain of,” Lattimer said.
Minor death is not a “black
and white issue”, Lattimer said
but an issue of police violence
against the black community.
With more evidence coming out
every day against police officers,
Lattimer said he hopes to see a
paradigm shift where people do
not side with officers just because
they are officers.
“Police officers are no better
than any other human being. Human beings do things, sometimes,
that they should not do. Police officers do things, sometimes, that
they ought not do,” Lattimer said.
“That is the way it should be
looked at.”
Bruce Branch, a community
activist and representative of the
Prince George’s County Business
and Contractor Association, said
he is disappointed in the failed indictment of another officer.
“I know the police have a
hard job to do, but I have a problem with unarmed black men being shot across the nation and
nothing being done about it,”
Branch said. “It is particularly
troubling for me in Prince
George’s County, where we have
black leadership. We’re no better
than Ferguson. We’re no better
than North Charleston. We’re no
better than New York City where
Eric Gardner was killed.”
Elected officials must be held
accountable for incidents such as
the one that resulted in Minor’s
death, Branch said.
Bob Ross, president of the
Prince George’s County Chapter
of the NAACP, said Minor’s death
is an “unfortunate incident,” but
an anomaly in Prince George’s
County. Alsobrooks has indicted
officers before, Ross said, so he
trusts should have been able to get
an indictment if enough evidence
existed.
“I think this is a tragedy,
don’t get me wrong. But here in
the county last year we had four
indictments against police officers,” Ross said. “A loss of life is
a tragedy and like some of the
facts indicate, it’s a difficult case.
Our heart goes out to the Minor
family.”
This is not a pattern in Prince
George’s County, Ross said. The
case is different from cases in Ferguson, Ohio, New York and other
places where unarmed African
American men have been shot.
“There’s a little different of a
pattern here,” Ross said.

Elected officials in Prince
George’s County work hard, Van
Hollen said, and Baker has a history
of being a hard worker. If elected to
the Senate, he said he looks forward
to continuing to work with Baker to
help Prince George’s County residents.
“When it comes to working
hard to get things done for the community, the person I think of from
my days in the General Assembly is
Rushern Baker,” Van Hollen said.
“As the county executive said,
when we were in the General Assembly together we saw eye to eye
and our hearts were in the same
place.”
While serving in the Maryland
House of Delegates, Van Hollen
said the two partnered on initiatives
such as the Bridge to Excellence
Act which requires school systems
to develop master plans and tobacco regulation legislation.
If elected to Mikulski’s seat,
Donna Edwards would become the
first African American woman to
represent Maryland in the Senate.
But as county executive, Baker
said, he has to make decisions regardless of their historical context
and race and gender do not matter
when deciding who to endorse.
“My job as county executive is
to figure out what is in the best interest of Prince George’s County,”
Baker said. “The second thing, as a
resident in the state of Maryland, I
have to figure out what is in the best
interest of the state of Maryland…That’s why I’m comfortable
endorsing (Van Hollen); because I
know with this person if I’m not on
Capitol Hill watching him, I know
that he has the best interest of this
county and state.”
Leggett said discussions about
race when making endorsements
are “inappropriate.” The citizens
have to make a choice about who
they want elected, Leggett said, and
the choice is difficult but they must
make the right choice.
“It is (something) that we
should look at, but we have come a
very long way,” Leggett said. “We
are not quite there yet but we have
come a very long way. And that
long way says to us that we have the
opportunity to elect the best person
for the job, someone that has
demonstrated leadership on local
and state levels. I think that person
is Mr. Van Hollen.”
Society is not “post-racial”,
Leggett said, but Van Hollen will
fight to ensure society does reach
that point.
Colmar Manor Mayor Sadara
Barrow, who also attended the conference, said she does not feel any
pressure to vote one way or another
between Edwards and Van Hollen.
Both make good candidates, Barrow said, but she has more experience working with Van Hollen, who
helped provide financial aid to the
Colmar Manor Community Center.
“When I talked to Congressman Van Hollen, I told him that he
will make a fabulous senator, and I
think Congresswoman Edwards
would also make a fabulous sena-
tor. I really do believe in both of
them,” Barrow said.
Ben Gerdes, campaign
spokesman for Edwards, said even
with Bakers’ endorsement of Van
Hollen, Edwards is confident she
will still be able to win over Prince
George’s County and get the votes
needed to win because of her experience fighting for the constituents
in Congress.
“She fought for historic investments in historically black colleges, led the fight against balancing the budget on the backs of federal workers, and ensured women
and minorities have access to science learning,” Gerdes said. “She’s
had their backs time and time again
and that’s why Prince George’s
County will vote for her again in
this election.”

“Lou” Felton, Sr., named to the
Maryland Volunteer Fireman’s
Hall of Fame, died March 3. He
was 75.
Eddie was born in Washington Nov. 6, 1939, and began volunteering at the Silver Hill Fire
Department when he was only

surgery—could keep him from
volunteering. He served with the
Ritchie VFD and finally at
Morningside where he was President and Chairman of the Board
of Directors and helped run bingo. In 2003 he was honored for
Dedicated Service and last November Morningside firefighters
surprised him with a 75th birthday party at the firehouse.
On March 3, 1962 he mar-
ried Lena Smith. On their 53rd
wedding anniversary, March 3,
2015, he died. For the past 45
years they’ve lived at Fernwood
Mobile Home Park, near
Ritchie-Marlboro Road. Eddie
enjoyed hunting and fishing and
taking his Street Rod to car
shows. His 1931 Model A is now
in his son’s garage in Prince
Frederick.
He was a member of the
Prince George’s County Professional Fire Fighters & Paramedics Association and the
Prince George’s County Volunteer Fire and Rescue Association.
Eddie is survived by his
wife Lena, daughter Tina Maske
and son Louis Jr. who has followed in his father’s footsteps
(he has 30 years as firefighter).
Eddie also leaves four grandchildren and a great-grandson. He
had a fireman’s funeral at Cheltenham Veterans Cemetery, with
Tommy Grooms, Les Hedrick
and Air Force buglers doing the
honors.

William Cavitt, community
activist, dies at 74
William H. Cavitt, a federal
executive who in retirement became a Prince George’s activist,
died Jan. 6 in Silver Spring. He
actively opposed development
that would dramatically alter the
character of his neighborhood,
including the widening of Oxon
Hill Road, development of National Harbor and the casino.
Once he lost those battles, however, he tried to influence the
best possible development.
He lived in the Riverbend
Estates neighborhood of Fort
Washington, near the Potomac
River, and was president of the
Indian Head Highway Area Action Council and the Riverbend
Estates Neighborhood Association.

He was born in Wichita,
Kans., on April 14, 1940. After
serving in the Navy, he graduated from the University of Nebraska. An economist, he spent
34 years with the Commerce Department and retired in 1990 as
director of the import policy division.

of 43 years, Sarah Toelle Cavitt,
two brothers and a sister. We’ll
greatly miss his activism; we
need more of them.

Roosevelt blasts Bowie 11-4 in battle of county’s top teams

In the lone league meeting between the two longtime rivals this
spring, the Eleanor Roosevelt High
School baseball team broke open a
close contest with Bowie by scoring six runs in the sixth inning en
route to an 11-4 win on Monday afternoon.
Roosevelt (7-1) got nearly a
complete game from junior lefthanded hurler Clark Reese, who allowed three runs, two earned, on
eight hits while fanning seven Bulldogs in 6 2/3-innings of work.
Reese threw strikes on 65 of 98
pitches and was lifted with two outs
in the seventh before hitting the
100-pitch plateau and before facing
Bowie leadoff batter Willie Hines
for a fourth time.
“I still felt pretty confident in
my pitches,” Reese said. “I thought
I could have gone another batter or
two. But I was happy with the way
that I threw today. I was able to get
ahead of the hitters and keep the
ball down. Bowie has a lot of good
hitters. We know we will probably
see them again during the playoffs.”
Bowie senior starter Sage
Davis was nearly as good on Monday, allowing three runs, two
earned, on seven hits while fanning
five Raiders in five solid innings of
work. But Roosevelt turned the momentum of the game in its favor by
turning a double-play to end the
fifth and then by responding with
six runs on six hits in the top of the
sixth against Bowie reliever
Thomas Stewart.
With two on and none out,
Reese helped his own cause with a
two-run single to left and he later
scored on a grounder by Jacob
Farmer. With one out, Quinn Valentich and Tyler Chotoo singled, then
Griffin Devlin followed with a
three-run home run to left for a 9-2
lead. Roosevelt added two more
runs in the seventh, with Farmer
collecting his third hit of the day.
“Jake [Ewing] got things started for us, then Clark and Quinn had
hits,” Devlin said. “I was just looking to drive in somebody with a hit
and I got a good pitch to hit. I really
didn’t think it was going out. Clark
did a great job pitching for us and
we made some plays behind him.
We know we’ll probably see them
again at our place.”
Monday’s meeting marked the
seventh straight contest in which
the visiting team has prevailed in
the series, with the next meeting
potentially at Roosevelt in the 4A
South Region playoffs. Neither
coach or the players on either team
could explain the trend, completely
countering the home field advantage adage.
“I know that streak is going to
end sometime,” Devlin said. “But
we’re not concerned about the
odds.”
“One of these days the home
team is going to win,” said Bowie
coach Bryan Harris. “But since the
next game is going to be at their
place, I hope the trend continues.
We gave them one or two too many
chances today. When you do that
against a good team like Eleanor
Roosevelt, they’re going to take advantage of it. That’s what they did
today.”
Roosevelt gained the upper
hand early with a run in the first on
a two-out single by Chotoo, but the
Bulldogs countered with a run in
the home half of the inning on a
one-out single by Darren Blackmon
that scored Willie Hines. But with
the bases loaded and one out, Diallo
Adams attempted to score on a
shallow fly ball to right, but Farmer
made the catch and fired home to
nail Adams for the final out.
Roosevelt scored an unearned
run against Davis in the fourth, then
forged a 3-1 lead in the fifth when
Farmer scored on a groundout by
Chotoo. Bowie answered with an
unearned run against Reese in the
fifth, but that inning ended when
Hines was doubled up at second on
a fly ball to center by Adams. Harris
vehemently argued for an appeal,
but was denied and Roosevelt
seized the momentum.
NFL star makes donation to Oxon Hill

OXON HILL – New helmets,
shoulder pads and other equipment
could be on the way soon for the
Oxon Hill High School football
team after Indianapolis Colts cornerback Vontae Davis chose to donate $1,000 to the school through
USA Football.
Davis donated the equipment
grant after USA Football, the
sport’s national governing body and
a partner of the National Football
League, selected the Pro-Bowl corner to its All-Fundamentals team.
Davis did not graduate from
Oxon Hill, but his former coach at
Dunbar High School in Washington, D.C., Craig Jefferies, now
leads the helm for the Clippers.
“Coach Jefferies was instrumental in helping my development
as a player and I wouldn’t be where
I am today without him,” Davis
said. “I’m thrilled to have the
chance to give back to his program.”
Jefferies, heading into his third
season at Oxon Hill, said he remem-
bers Davis as one of the most fundamentally sound players he has ever
coached. He said he hopes to guide
Oxon Hill back among the county’s
elite squads. Davis’ donation, along
with the renovation of the school
and installation of a turf field last
season will help that cause.
“Needless to say, I am honored
that Vontae chose Oxon Hill for his
donating site,” Jefferies said. “He
was always a great player who
worked hard to get better. He understood the importance of the fundamentals, especially tackling. I
am always proud of my former
players who make it to the next level and Vontae has gone from high
school to college to the NFL.
That’s a very, very difficult feat to
accomplish. I’m glad to know how
much he thinks I helped in his development.”
Davis was one of only 26 players selected to the USA Football
All-Fundamentals team, a group
that includes recognizable names
such as Denver Broncos quarterback Peyton Manning and Rob
Gronkowski, tight end for the Super
Bowl champion New England Pa-
triots.
Davis, also was not the only
player selected with ties to a county
school as Miami Dolphins’ defensive end Cameron Wake, a DeMatha High School graduate, was
also chosen.
USA Football is the sport’s national governing body and trains
more high school and youth football organizations than any other
organization in the United States.
More than 5,500 youth leagues and
750 high schools, comprising over
one million athletes, participated in
USA Football’s Heads Up Program
in 2014.
A five-member committee assembled the 2014 USA Football
All-Fundamentals team. Charles
Davis, a football analyst for two
networks, Herm Edwards, a former
NFL defensive back and coach,
Merrill Hoge, a former NFL player
and current analyst, Carl Peterson,
the current USA Football chairman
and Bill Polian, a Pro Football Hall
of Famer and former General Manager of three NFL teams, including
the Colts, comprise the selection
committee.

BOWIE – With the bases
loaded and no outs in the fifth inning, it seemed like a formality that
the Riverdale Baptist baseball team
would take the lead against DeMatha Catholic High School.
However, as he did all game
long, Stags pitcher Jack Alkire got
out of the jam by retiring the next
three batters to maintain his team’s
2-1 lead. The Stags went on to win
4-1 while Alkire finished the night
having thrown 118 pitches and
picking up nine strikeouts, giving
up three hits and four walks in six
innings of work.
“He’s been really good. Coming into tonight he hasn’t let up a
run in 17 innings,” said DeMatha
head coach Michael O’Connor.
“Tonight he lets up one unearned
run in six. That’s a pretty impressive stretch. He did a phenomenal
job buckling down there. As crazy
as it sounds and as a good as he
was, he didn’t have a lot of control.
He’s normally got control and
when he throws at the knees he is
pretty unhittable.”
Along with Alkire’s fine pitching performance, the Stags also
benefitted from their own ability to
put the ball in play with runners in
scoring position.
While the Crusaders stranded
two runners in the top of the first
inning, the Stags took advantage in
the bottom half of the inning by
playing small ball. The first run of
the game scored on a sacrifice bunt
by Brad Thaxton. Then Chris Jeletic, who had singled earlier in the
inning, scored on a double steal.
“We might have jumped on
them a little baserunning wise,”
said DeMatha head coach Michael
O’Connor. “That was the difference. Our bunts got down and even
sometimes our bunts cost us outs.
We put the ball in play and put
pressure on them.”
Riverdale Baptist squandered
a chance to score in the second inning, stranding two runners on
base. The Crusaders finally got on
the board in the third inning when
centerfielder Zech McPhearson
scored on a throwing error, but the
team stranded two more runners.
Meanwhile, Alkire, who has
already committed to Virginia
Commonwealth University and
threw as hard as 96 miles per hour
on Monday, continued dealing. After striking out four hitters in the
first two innings, Alkire made
quick work of the Crusaders in the
fourth inning with two more strikeouts.
In the fifth inning Alkire got
into a jam when McPhearson
reached base on an error and followed by catcher Joey Mendez
reaching on an infield hit to put two
men on with no outs with Seth
Williams, the Crusaders’ cleanup
hitter, coming to bat. The Crusaders then executed a double steal,
but O’Connor came out of the
dugout arguing that Williams interfered with the catcher’s throw.
“I thought there was interference on the contact. He basically
said the throw was at second base
so there was not going to be an interference call even though the batter did interfere,” O’Connor said.
“He said there was contact at home
plate. I was going for an interference in that situation and obviously
it didn’t happen.”
O’Connor then called for an
intentional walk, loading the bases
with no outs Alkire would prevail
by forcing a short flyout to leftfield, then a fielder’s choice with
the first baseman throwing a runner
out at home and a groundout to second base.
“You’ve got to give a lot of
credit. High school kids—a routine
ball to first base to come home is
not routine,” O’Connor said. “To
be able to make that play and get
out of it really took a lot of pressure
off of us.”
Alkire said he did not have his
best curveball and he did not have
complete control of his fastball, but
with the bases loaded he knew he
had to give his defense a chance to
make plays.
“I was a little bit wild there but
I beared down, made some pitches
and let my defense play,” Alkire
said. “I’ve been pitching for a long
time. I’m used to the situation and I
don’t feel too much pressure in that
situation. I just say myself, ‘Get the
next pitch.’”
Alkire pitched one more inning before giving way to reliever
Austin Weber, who notched the
save after the Stags added two insurance runs in the bottom of the
sixth inning on a sacrifice fly by
pinch-hitter Christian Minus and an
RBI-single by shortstop Joe Hall.
The teams, matched up in the
Versus Cancer Classic, played in
front of about 100 fans at Prince
George’s Stadium, home of the
Bowie Baysox. Both teams honored cancer survivors at the start of
the game, while players from both
sides raised a total of more than
$10,000 leading up to the game.
“We got to meet the people
there and they told us what the
money is going towards. When you
have an effect of actually donating
money and you know where it is
going to go and how it is going to
help,” O’Connor said. “For us, we
know this money is going directly
to people of D.C. and that is a huge
opportunity for fundraising.”

Red beats White in Maryland spring game

COLLEGE PARK – Led by
three first-half touchdowns by Marcus Leak, the Red team beat the
White team 21-16 in the University
of Maryland football team’s annual
Red v. White spring game.
Leak, a senior from Charlotte,
North Carolina, had 132 yards on six
catches. On the defensive end for the
Red team, junior defensive end Yannick Ngakoue led the charge, pressuring redshirt sophomore Shane
Cockerille throughout the game and
recording multiple sacks.
With presumed starting quarterback Caleb Rowe out, Cockerille played with the first team offense and struggled during the
scrimmage completing only 25
percent of his passes, 5-20, for
102 yards and an interception.
Cockerille, a former Elite-11
prospect, missed open receivers
on multiple occasions both when
under pressure and with a clean
pocket.
Similarly, redshirt junior Perry Hills, who started at quarterback
for the Red team, was also inconsistent on the day and completed
only 12 of his 24 attempts on the
day, half of which were hauled in
by Leak. Hills threw for 214 yards
but also threw an interception.
“I told Marcus, “Let’s go back
to my true freshman year, let’s do
what we did then,” Hills said.
Both teams ran the 4-3,which
new defensive coordinator Keith
Dudzinski installed this spring,
however it took the White team
much longer to get adjusted than
their Red opponents. The Red
team only allowed three first-half
points, scored on a 50-yard field
goal by reigning Lou Groza Award
winner Brad Craddock. The White
team’s defense, led by sophomore
Antwaine Carter who had an interception in the first quarter, ended
the half on a strong note after giving up 21 points early, putting up a
goal-line stand before blocking a
field goal attempt as the half ended. In the second half the White
team pitched a shutout.
Early in the third quarter the
White team was able to punch
through and get into the end zone
on a 56-yard run by senior running
back Brandon Ross to cut Red’s
lead to 21-10. The White team was
successful running the ball in the
second half, as Ross and junior
running back Jacquille Veii helped
carry the offense for most the of
the game while Cockerille struggled. Ross and Veii finished with
102 yards on 13 attempts and 40
yards on 10 attempts respectively.
After the game, head coach
Randy Edsall said that the team
had multiple running backs that
could come in and make plays. He
also specifically praised Veii, saying that he loves his desire, passion and “what he does out there
[on the field].”
The White team scored in the
closing minutes of the game on a
three-yard run by junior running
back Kenneth Goins Jr. to cut the
score to 21-16 but was unable to
overcome Leak’s three early
scores.
“We came out, executed and
put some points up,” Leak said after the game. “That was the main
goal today.”

Bowie City Manager Proposes $50.8 Million Budget

BOWIE – City Manager
David Deutsch presented a $50.8
million budget to the mayor and
city council on Monday that will
keep tax rates level for the sixth
consecutive year and provide almost $2 million in additional
funding to the city’s police department.
According to Deutsch, the
property tax rate will remain at
$0.40 per $100 of assessed value, but the city will still receive a
2 percent increase in property tax
revenue because growth in the
assessable base, with further
growth expected in 2017 as the
economy continues to recover.
“We’ve managed to keep the
same tax rate for the past six
years with no increases which is
remarkable,” said Councilman
James Marcos.
The total budget represents a
6.8 percent increase from the
2015 budget, Deutsch said.
The police department will
receive $10 million, including
funding for three additional po-
lice officers and $70,000 for
body cameras. Deutsch has also
proposed $10,500 to begin getting the police department accredited by the Commission on
Accreditation of Law Enforcement Agencies.
The budget also maintains
the city’s triple A bond rating.
The city must maintain reserves
of 25 percent.
“It shows the strength of our
finances,” Deutsch said. “Somebody on Wall Street or one of the
rating services is not going to
give you an exact number but if
we only had 3 or 4 percent, I
don’t think we’d be Triple A.”
In addition to the operating
budget, Deutsch also proposed a
$11.7 million capital improvements program, which includes
$812,700 for improvements to
the Kenhill Center.
“We knew that the roof was
deteriorating and we realized that
the most appropriate thing to do
was to recommend that it be done
in fiscal 2016,” said Deutsch.
The proposed budget also
includes $3 million for hiring a
project management firm for a
proposed indoor sports facility,
as well as architectural and engineering design. Construction is
slated for 2018.
“We haven’t solved the site
selection issue, so we can’t get to
hiring consultants to actually begin design until we know where
we’re going to build it and what
indeed it’s going to be,” Deutsch
said. “Is it going to be a single
combined facility providing

Board of Education ruled to have
violated Open Meetings Act

UPPER MARLBORO – The
Prince George’s County Board of
Education will announce at its next
meeting it violated the Open Meetings Act after the Open Meetings
Compliance Board (OMCB) ruled
the Board’s staff failed to provide
copies of minutes to a county resident.
Thea Scarato, an activist who
opposes cell phone towers, said she
was attempting to track the history
of the school system’s cell phone
tower policy by making open
records requests and looking
through minutes of meetings by the
school board and its subsidiary
committees.
However, when Scarato went
to the Board office to look at the
minutes, she was told by a staff
member she needed to speak to the
Board’s counsel. Scarato then
called the counsel, according to the
OMCB’s opinion, who told her the
school system was still processing a
previous Maryland Public Information Act for copies of the minutes.
Scarato said she had only filed the
MPIA request because she had
called three days before her visit to
see the minutes, but was told by
staff she had to file a formal MPIA
request in writing.
“It shouldn’t be this difficult to
get information,” Scarato said.
“It’s no wonder people are not getting involved because it’s not easy
to be.”
Scarato said she sought the assistance of Craig O’Donnell, an activist and former reporter for the
Kent County News who has filed
several previous Open Meetings
complaints with the OMCB.
In his complaint, O’Donnell
said the school board failed to pro-
vide him with records upon request,
but the OMCB ruled that O’Donnell was using the Open Meetings
complaint process to subvert the
MPIA process.
“We inform complainant that
our authority extends only to Open
Meetings Act matters and that we
will not address Public Information
Act disputes,” the OMCB wrote in
its ruling.
O’Donnell also complained
that the Board did not meet the
OMA’s requirement that at least
one employee or officer meeting
the law’s training requirement. The
(OMCB) ruled in O’Donnell’s favor, and the Board pledged to come
into compliance.

come into compliance with the
Act,” said Sherrie Johnson,

Bowie budget keeps tax rates same as previous year, provides more funding for police

Marcos said he thinks the indoor sports facility is a “great”
project.
“I know there is a definite
need and the fact that it does cover 70 percent of the operating expenses,” Marcos said. “It’s one
of the few items that the city has
that almost pays for itself.”
While taxes may not be going up, residents could see an additional 30 cents added to their
water bill because the budget
proposed raises the total fee to
$10.34 per thousand gallons. The
increase will cost a typical resident consuming 15,000 gallons
per quarter an additional $4.50
on their quarterly bill, Deutsch
said.
“It’s a 3 percent increase,”
Deutsch said. “We have had a series of 10 percent increases so
we were pleased to be able to
bring it in at only 3 percent. It’s
expensive to operate a water and
sewer operation.”
The proposal is minimal,
Deutsch said, and the city needs
more money to address its aging
water and sewer infrastructure.
“It’s a costly operation in
terms of all the compliance that
we have to do in terms of environmental regulations, repairing
broken pipes and those kinds of
things,” Deutsch said.
Councilman Henri Gardner
said he is glad the city is able to
provide more funding for the police department while continuing
to maintain the other services it
provides and not increasing tax
rates.
“There are a number of mu-
nicipalities throughout the region and throughout the nation
that have failed to continue to
provide services,” Gardner said.
“We have twice-weekly trash
collection, once-a-week recycling program, we’ve maintained
our roads and highways well and
we continue to provide public
safety for our police department,
our recreation centers, our senior
center, these are a number of
items that many municipalities
have perhaps thrown to the side
because of hard times. We’ve
managed to provide all of these
services while expanding our police department, while maintain-
ing a specific lifestyle that we’ve
become accustomed to as well as
our leaf removal program that
many residents are very pleased
with in our area. We’ve been able
to do this without any increase in
taxes and it’s phenomenal.”
Deutsch looks forward to the
next sessions to be held every
Monday night until the budget is
approved on May 18.
“We’re glad to get started
and we look forward to the next
four budget work sessions,” he
said. “We’re looking forward to
moving ahead and tackling the
rest of the issues. We had a good
start last night.”
Resident questions Board of Education after it violates Open Meetings Act

According to PGCPS, Board
members Carolyn Boston, Zabrina
Epps, Verjeana Jacobs, Beverly Anderson and Dinora Hernandez have
received training from the Maryland Association of Boards of Education (MABE). Three other
school system employees also received training in Open Meetings
from MABE.
The OMCB also ruled the
school board failed to provide open
inspection of its minutes during ordinary business hours.
“Those minutes should have
been provided to Ms. Scarato when
she appeared,” the OMCB wrote in
its opinion. “At the same time, it is
too bad that no one told her at the
outset that if she needed the minutes quickly she should begin by
appearing at the office. Unfortunately, by the time she visited the
office, the waters had been muddied by complainant’s and her own
multiple Public Information Act requests to the school board. Just to
add to the confusion, she arrived at
the school board’s office on a day in
which staff were preparing for a
board meeting that night and before
staff had found a flash drive on
which some minutes had been
kept.”
O’Donnell said he was not surprised by the ruling and he thinks all
public bodies should make all of
their minutes available online. He
also said he does not think public information should be so difficult to
access.
“You argue with lawyers over
minutes but the public is entitled to
them, so why are we having this argument?” O’Donnell said. “…It’s
annoying to have to be such a stickler about these things.”
Johnson said the Board received the OMCB opinion on
March 27 and will announce it violated the OMA at its next meeting
on Thursday.
“While the Board was found to
be in violation on the official OMA
training requirement, the Open
Meetings Compliance Board acknowledged on page 5 of their opinion: ‘We note from MABE's web-
site that MABE's class is an hour
longer than two live courses specified by the Act and is focused on the
issues that school boards might encounter. This is not a matter in
which a public body's members
have been operating without any
training in the Act,’” Johnson said in
an email.
Board Chairman Segun Eubanks said he takes time before each
meeting to ensure that the agenda
and minutes are in compliance with
the OMA. Despite the OMCB’s ruling, he said he is glad the Board has
met the training requirements.

Scarato, on the other hand, said
she thinks more training needs to be
done.
“Someone who is in charge
needs to know what they are doing
and how to do it,” Scarato said.
Though he encourages all
board members to undergo training,
he did not say he would make it a
requirement for all board members.
“We take our responsibility for
transparency very seriously and I
always make sure we are well within compliance, Eubanks said.
He promised to continue meeting with Berry and the Board’s
counsel to monitor compliance with
the law.

Police investigating two automobile accidents

The Prince George’s County
Police Department continues to investigate what led to a fatal motorcycle collision that took place April 6
in Fort Washington.
Furron Spivey, 26, of Evarts
Street in Northeast Washington, died
after being transported to a hospital
following the crash.
Around 6:10 p.m., police responded to a collision report at the
9300 block of Allentown Road involving an SUV and a motorcycle.
The preliminary investigation
indicates the motorcycle was heading northbound on Allentown Road,
crossed over lanes and struck an
SUV.
Officers found Spivey, the motorcycle rider, suffering from critical
injuries and officials pronounced
him dead at a hospital.

Postal service truck crashes
in Bowie
The department responded to
another crash that took place in
Bowie, which involved a United

involving a USPS truck.
Preliminary investigation indicates the truck was heading westbound on Annapolis Road approaching the intersection with Highbridge
Road. The driver, who sustained critical injuries, could have lost control
while trying to avoid another car, according to police investigation.
The mail truck driver swerved
and flipped over the median onto
Annapolis Road, eastbound. The
collision did not involve any other
cars.
Police continue to investigate

Suspect arrested, one dead after
shooting at Census Bureau

WASHINGTON – The Metropolitan Police Department continues
to investigate a kidnapping, police
chase and shooting that occurred between Prince George’s County lines
and Washington, D.C. on April 9.
Police officers arrested and
charged Ronald Anderson, 48, of
Southeast D.C. for kidnapping while
armed and assault on a police officer
while armed.
Around 5:30 p.m. District officers responded to an armed kidnapping report at the 1900 block of 3rd
Street in Northeast, D.C. Anderson
allegedly fled with the adult female
kidnapping victim in a green Honda
Accord and later arrived at the U.S.
Census Bureau office in Suitland.
Around 6 p.m., Anderson allegedly shot a guard at the bureau office, Master Security Officer
Lawrence Buckner, who later died.
The vehicle driver shot at officers at the 2700 block of Bruce Place
in Southeast, D.C. and at the 1200
block of 3rd Street in Northeast,
D.C.
Officers later tried to stop the
vehicle and the car crashed at the
1100 block of H Street in Northeast,
D.C.
Anderson and a police sergeant
suffered gunshot wounds and went
to local hospitals for treatment. The
wounded Metropolitan Police
Sergeant is recovering and the female kidnapping victim is safe.
“Yesterday’s late afternoon
shooting of a security guard at the
Suitland Federal Center was a tragic
and scary event for the Census Bureau family. We know the situation
last night was tense, especially for
the hundreds of employees who
sheltered in the building and in their
cars for several hours not knowing
when the incident would be over,”
Census Bureau Director John H.
Thompson said in a statement April
10. “The security and safety of our
employees is our top priority and we
appreciate everyone's cooperation as
law enforcement worked to clear the
scene to make sure we were safe and
free from danger.”
Thompson said the bureau
thanks the Federal Protective Service, the FBI, the Prince George's
County Police Department and the
Metropolitan Police Department for
the response and service for the incident.

Foreclosure reform bills fail

ANNAPOLIS – Bills sponsored by Senator Joanne Benson (D24) that would have reformed the
state’s foreclosure process which
she says would have granted more
protection to homeowners in Prince
George’s County failed to move
through the legislature.
Bensons bills received unfavorable reports from the Senate’s Judicial Proceedings committee.
The committee gave no explanation for the unfavorable vote, Sen.
Benson said, even though foreclosure is a well-documented issue in
Prince George’s County. There
needs to be legislation in place, she
said, to protect homeowners.
Senate bills 876 and 877 both
got voted down 6-5 in committee.
Bill 876 outlined the criteria and
document requirements for a plaintiff to foreclose on a home while bill
877 would have made Maryland a
judicial foreclosure state, enabling
courts to verify mortgages and home
notes in order to foreclose on a
homeowner given a loan.
“This problem of foreclosures
is rabid in Prince George’s County
and I am profoundly disappointed
by that inadequate support of the
Senate Judicial Proceedings committee,” Benson said. “They failed
by one vote. It’s unbelievable. I can’t
tell you how upsetting this has been.
I am so disheartened by the actions
of the general assembly. Everybody
knows that foreclosure has been a
problem in Prince George’s County.”
Sen. Benson said she drafted
the bill because currently, in Maryland, lenders are able to go after a
homeowner’s savings, investments
and assets in order to make up for
foreclosure deficiencies.
“There are 13 states that limit
the lender’s ability to do this by limiting the liability on the home,” Benson said. “This is important in ad-
dressing the foreclosure crisis. It will
strengthen the criteria used for banks
when making loans and it would enable Maryland homeowners to recover and get back on their feet
without having their remaining assets subject to seizure.”
“The bank association is very
strong with people down here.
That’s an unfortunate thing, they’re
very strong,” said Senator C. Anthony Muse, a co-sponsor of the bill. “I
voted for the bill and it’s the same
tone that is used across the board –
this tone of ‘Yes, you have a problem but this is not how we’re going
to address it.’ It’s hard to get the
votes.”
Some elected officials would
rather have the support of the
bankers more than the people they
represent, Muse said. He said the
process must be slowed down and
legislators cannot get caught up in
technicalities while residents are losing their homes.
The real estate and foreclosure
crisis hit Prince George’s County
hard, according to Reverend Delman Coates, the president of The
Black Church Center for Justice and
Equality. Protection for homeowners needs to be established to prevent
these crises from occurring again,
Coates said.
Coates said he hosted community meetings with members of his
church to keep them informed about
the legislation and the foreclosure
crisis county citizens still face. It is
unfortunate the bills were voted
down, Coates said, but the fight will
not stop here.
“While we’ve lost the battle,
we didn’t lose the war. I am encouraged that five of the 11 members of
the committee, when we had a
chance to sit them down and explain
the issues that are at hand, they got it
and understood it,” Coates said.
The well-being and protection
of citizens has been ignored during
the process of mortgage securitization, Coates said, even though the
process is completely legal. Still, he
said it needs to be regulated.
“We have an opportunity to
make sure we protect the future of
our property values and making
sure we do not turn our neighborhoods into gambling casinos,”
Coates said. “If you drive around
Bethesda or Potomac, you don’t see
the proliferation of subdivisions the
way you do in Prince George’s
County or other working class
counties. You don’t see it.”
Coates said the undermining of
the economic stability and wealth of
citizens in the county is what citizens need to be protected from.
Their wealth is being extracted
through homeownership, he said,
and elected officials these constituents vote for must step up and
stop this from happening.
African-Americans make up a
majority of the population in Prince
George’s County, Coates said, and
even though they welcome diversity, those African-American residents should not be forced to move
out because banks extracted their
wealth.
“In many communities in
Prince George’s County, you see
African-Americans being taken out
of their homes and others are moving into those very same communities,” Coates said. “It’s really fundamentally about how we strengthen
the financial base of Prince
George’s County.”
Banks will often sell the
promissory notes on a mortgage
“from one lending institution to the
next,” Coates said. If lenders who
sold the original promissory note
want to foreclose, Coates said, they
should not be able to do so because
they do not have the original note.
Maryland’s non-judicial foreclosure process allows plaintiffs to
foreclose without going through the
judicial system, Coates said. Coates
said 20 other states have a judicial
foreclosure proceeding and lenders
are required to file a lawsuit before

State budget passes with disagreement by both parties

Gov. Larry Hogan and the
Maryland legislature were so near,
but yet so far.
An amended version of the
governor’s $40 billion budget
passed overwhelmingly several
weeks ago – drawing strong Republican support and thank you letters
from Hogan’s budget secretary.
But on the last day of the session, the final version working out
differences between the House and
Senate passed on a strictly party
line vote. After meeting with Hogan
Monday morning, all the GOP senators and delegates who had backed
the earlier version voted against the
final one.
Hogan had preached bipartisanship since his election, but he ultimately rejected compromises he
had initially favored.
Slices of a modest agenda
The Democratic legislature in
turn gave the new Republican governor just a couple slices of his
modest agenda.
The legislature repealed the
“rain tax” overwhelmingly, without really relieving the pressure to
fund stormwater remediation projects in a bill the Chesapeake Bay
Foundation said “caps a remarkable session for the Bay.”
Military retirees over 50 will
now get a $10,000 income tax exemption on their pensions, up from
$5,000. But Hogan wanted to exempt all of their retirement pay
phased over four years.
His proposed changes to expand the number of public charter
schools were stripped of key provisions that would have allowed noncertified teachers who weren’t
unionized.
Tax breaks for businesses contributing to public and private
schools went nowhere, while the
legislature added more funding for
private schools in the final budget.
A tax break for small business-

es exempting them from the personal property tax did not pass.
Hogan’s attempt to repeal automatic increases in the gas tax went
nowhere.
In one small success, Hogan’s
proposal to reinstitute the income
tax check-off for the public campaign finance fund that helped him
get elected did get enacted.
A freshman governor
“He’s a good guy,” said Senate President Mike Miller, an old
friend of the Hogan family. But
“he’s a first-year governor” and
never held elective office before.
“He’s got to understand what
we’ve done. … We want to work
with him.”
Miller is hopeful Hogan will
actually use the money the legislature “fenced off” for schools to fully fund the $144 million for the
Geographic Cost of Education Index.
But the legislature was taking
no chances and rushed through

legislation on the last day that will
force Hogan to spend the extra
money. But Hogan could veto that
bill, SB183.
Hogan himself was not declaring victory in his first legislative
session, but he did cite progress in
restraining spending growth while
enacting no new taxes.
“We did not get everything we
wanted and the legislature did not
get everything it wanted, but Marylanders will benefit from the passage of the repeal of the rain tax,
important improvements in our
charter school law, and tax relief
for retired military,” Hogan said.
A key sticking point for
Hogan was the legislature’s cutting
of a supplemental $75 million into
the state pension system.
Hogan proud, legislators
disappointed
“While I have reservations
about the General Assembly’s actions on the budget, I am proud to
have ended the session on a high
note by reining in spending, cutting
taxes, providing record investment
in education and changing the
overall trajectory of the state,”
Hogan said.
“I firmly believe we have
changed the debate in Annapolis
and will be able to take steps to address our concerns on spending in
the future.”
Democratic lawmakers, including House Speaker Michael
Busch expressed far more disappointment than Miller with
Hogan’s performance.
Sen. Jim Rosapepe, Prince
George’s, part of the Senate’s progressive wing, told his colleagues.
“Now we get to the 11th hour and
the governor just can’t take yes for
an answer,” with the legislature approving the vast majority of his
spending plan.
“It’s my way or the highway,”
was Hogan’s attitude, Rosapepe
said. “I’m very disappointed.”
“There’s blame on both sides,”
Miller countered.

Possession of marijuana paraphernalia decriminalized

ANNAPOLIS – After some
discussion and two failed amendments, the Maryland Senate on
Friday passed a bill decriminalizing the use or possession of marijuana paraphernalia.
The bill reclassifies possession of drug paraphernalia involving less than 10 grams of marijuana from a criminal to a civil
charge.
Offenders can be given fines
ranging from $100 to $500 depending on the number of violations. The law requires the is-
suance of citations; and a court appearance if the subject is younger
than 21 years old or has committed
three or more violations, requiring
any further adjudication of those
cases to be in district court.
The bill also creates a new
criminal misdemeanor for smoking marijuana on public property.
Violators younger than 18
charged with possession of paraphernalia would be subject to juvenile court procedures and would be
referred to a substance abuse education or rehabilitation program,
under the bill.
A decrease in local revenues
and state general funds are expect-
ed, according to an analysis accompanying the bill, and civil
penalties would be allocated to the
Department of Health and Mental
Hygiene to fund drug treatment
programs.
The bill, sponsored by Delegate Curt Anderson, D-Baltimore
City, passed through both legislative bodies.
A companion bill, sponsored
by Senator Bobby Zirkin, D-Baltimore County, on Friday evening
was awaiting a vote in the House.
Senator Stephen Hershey, RKent, Queen Anne’s, Cecil and
Caroline, was one of three to vote
against the bill on Friday.
“I’m just not on board with all
the marijuana bills yet,” Hershey,
the minority whip, said. “From a
federal standpoint, it’s still illegal.”
However, fellow Republican
Senator Justin Ready, from Carroll, decided to vote for the bill.
“I feel like this is a great balanced approach,” Ready said. “I
think if we legalize stuff, it sends a
bad message that it’s OK (to
smoke). With decriminalization,
we’re bowing to the idea that this
is not something we want to send
people to jail for.”
The Maryland State Police
Department, through a spokes-
woman, said Friday they have no
position on the legislation.
Much of the Senate discussion
Wednesday centered on a floor
amendment from Senator Brian
Feldman, D-Montgomery, proposing to decriminalize smoking marijuana in public places. The bill
would still criminalize smoking in
a vehicle.
The amendment ultimately
died by a vote of 22-24.
Senator Cheryl Kagan, DMontgomery, also proposed an
amendment that would limit police
search rights in regards to marijuana. It was quickly shot down with a
3-44 vote.
Rain tax law repealed, delegate expresses disapproval

A lone legislator let his disapproval rain down on House delegates the last night of session, as the
Watershed Protection bill passed
with only Del. Richard Impallaria
opposed against 138 members.
“There are people who believe
that what we are doing is repealing
the rain tax,” said Del. Richard Impallaria, R-Baltimore and Harford.
“They are still going to get a rain tax
bill, every single year.”
Impallaria was alone standing
in opposition to SB 863, the Watershed Protection and Restoration
Program, sponsored by Senate President Mike Miller to allow counties
and municipalities to regulate their
own stormwater fee. Miller’s bill replaced Gov. Larry Hogan’s simpler
repeal measure, a key part of his
legislative package.
“I have to answer to them,”
said Impallaria. “How do I go back
to my constituents in Baltimore
County and tell them those businesses are going to have to pay a
two thousand, three thousand…five
hundred thousand rain tax bill?”
Impallaria fears that not only
will small business owners suffer,
but the fee, which he believes is
highest in Baltimore County, will
deter business from locating to the
county.
Fee will be optional, counties
still need to mitigate
stormwater
Impallaria is correct that the
bill does not “repeal” the fee, according to the bill’s fiscal note.
The counties will instead have
the choice of how to comply with
the federal stormwater management
requirements, whether it be with a
fee or other revenue sources.
“This bill is not perfect, but it
does change ‘you shall charge a tax’
to ‘you may charge a tax’,” said
House Minority Whip Kathy Szeliga, R-Baltimore and Harford.
Szeliga noted the success her
county, Harford, has had paying for
their stormwater fee through county
general funds.
All revenue collected from
county fees will be deposited into
the local watershed protection and
restoration fund.
Counties will need to report a
five-year projection of costs and
revenues, including specifying
funding sources, for permit compliance to the Maryland Department of
the Environment (MDE).
Delegates cheer on bill
“This is the largest growing
source of pollution in the Chesa-
peake Bay,” said Del. Kumar Barve,
D-Montgomery. “Today, this bill
has the enthusiastic support of the
environmental community and the
business community.”
Kumar adamantly supported
the passage of the bill, with other
legislators cheering him on from the
House floor.
“We, in this legislature, are not
letting the Chesapeake Bay go
down on our watch,” said Barve.
The Chesapeake Bay Foundation called it “a major victory for the
Chesapeake Bay.”
“We were holding our breath
for the past few days and hours. The
stormwater bill is a remarkable victory. What a turnaround for Bay issues this session,” said Alison Prost,
Maryland Executive Director for
the Chesapeake Bay Foundation.
“Polluted runoff is the main
source of contamination for many
urban and suburban creeks and

rivers,” the foundation said in a
statement. “Yet for years local governments have neglected upkeep to
their stormwater systems, and failed
to meet clean-up goals set by state
and federal law.”
Impallaria was not discouraged.
“This is a full punishment on
Baltimore County,” said Impallaria.
“Because the fees in Baltimore
County are higher than anywhere
else.”
The Stormwater Remediation
Fee was established by House Bill
987 in April of 2012. The law affects the largest urban jurisdictions
in Maryland, counties with the
largest pavement for stormwater
runoff. HB 987 was created to meet
the requirements of the federal
Clean Water Act.
SB 836 passed 138-1 in the
House before moving on to pass 470 in the Senate.

will receive a $75 prize, will be announced at

Welsh’s college career comes to an end

Prince George’s County athletes have long excelled in football, basketball, baseball and track
& field events, but the county also
can also boast having one of the
best female gymnasts in the nation.
Bowie resident and Penn
State University senior Krystal
Welsh recently concluded her college career with the Nittany Lions
at the NCAA Regionals at the
University of Oklahoma last
weekend. Welsh finished 11th
overall in the All-Around competition with a final cumulative
score of 38.675, highlighted by a
9.875 on the uneven bars and
identical 9.80 scores in both the
vault and floor exercise.
“I really can’t say enough
about the experience that I’ve had
at Penn State,” Welsh said. “I love
the school and I love being part of
the gymnastics team. We have
been able to do things that had not
been done before. It all started
with the seniors who were on the
team when I got here and now has
continued into my senior year.
The fact that’s over seems sort of
surreal now.”
While Oklahoma and Oregon
State University earned automatic
berths to the NCAA Championships, Penn State saw its season
come to an end when the Nittany
Lions settled for sixth. Penn State
had finished fourth in the Big 10
Championships two weeks earlier
and the Nittany Lions had performed well in the weeks prior to
that event, taking second in the
Big Five Challenge won by the
University of Michigan.
Welsh, who finished fourth in
the All-Around competition at the
Big Ten Championships one year
earlier with a career-best score of
39.5, capped her home career last
month by taking the All-Around
title with a combined score of
39.4. She attained a career-best
score of 9.925 on the vault, added
a 9.875 on the floor exercise, 9.85
on the balance beam and 9.75 on
the uneven bars. She also gar-
nered the Ann Carr Award for the
top performance of the meet.
“Knowing that was my last
home meet was a little bittersweet,” Welsh said. “But to go out
with the All-Around title and earn
the Ann Carr Award in my last
home meet was amazing. I really
could not have asked for a better
way to finish competing at Penn
State. It was the second time that I
had gotten the Ann Carr Award
and it was my second-best AllAround score ever. It was just one
of those days went everything
went well.”
Welsh helped lead the Nittany
Lions finish fourth in the Big Ten
Championships won by Michigan.
Penn State finished only 1.1 points
behind the Wolverines in the overall standings and finished onetenth of one point behind Northwestern for third. Welsh recorded
an All-Around score of 39.3, good
for third among her teammates.
But she was also the only Penn
State gymnast selected for the
Sportsmanship Award, with only
10 distributed at the Big Ten
Maryland assistant leaves to lead Florida International

Former Maryland assistant
Marlin Chinn has been named the
new women’s head basketball
coach at Florida International University.
Chinn, a Washington, D.C. native, becomes the sixth head coach
for the FIU women’s basketball program. He replaces Cindy Russo who
retired in January after more than
three decades at the Miami school.
Chinn inherits a program that
finished 3-26 including 0-18 in
conference play. However, FIU returns Conference USA Freshman of
the Year Kiandre’a Pound.
“It’s an exciting time to be here
at FIU,” said Chinn. “Just to see the
potential here and growth that is
waiting to explode. I think South
Florida and the surrounding areas
are huge as far as rich in recruiting.
It’s a hot bed for talent here in Florida, and we are going to attack it and
be very aggressive with it. I’m looking forward to it. I’m very excited.”
Chinn’s hiring at FIU comes
on the heels of Tina Langley’s hiring at Rice University and he becomes the third Maryland assistant
to leave the program in the past two
seasons. Last year, David Adkins
accepted a player development assistant position with the Washington Wizards.
“I’m really happy for Marlin to
get this opportunity,” said Maryland head coach Brenda Frese.
“He’s been a veteran assistant,
we’ve watched him grow and this is
the next step for him. Just like Tina
Langley, who just got hired at Rice,
Marlin has been a very loyal assis-
tant to our program. He’s been a
presence and a voice within our
locker room. I take great pride in
seeing anyone in this program
achieve his or her dreams. I can’t
thank him enough for all he’s given
to Maryland. We wish him a ton of
success.”
Chinn spent six seasons in College Park and helped the Terrapins
compile a 164-44 record during his
tenure. He also helped bring in four
top-10 recruiting classes.
“I am so thankful to Brenda
Frese, the student-athletes and all
the people I worked with for six
wonderful seasons,” said Chinn.
“To all of the Rebounders and fans,
it was an incredible ride. We accomplished some great things and
Maryland will always have a special place in my heart. I am a Terp
for life!”

“Ever since joining the team,
we’ve always been a close-knit
group,” Welsh said. “We’re all
very supportive of one another at
practices and at the meets. To get
recognized with the Sportsmanship Award by the Big Ten was an
amazing feeling. Every time you
head onto the floor for the beam or
the vault its really up to each person to do their best. But we’re still
very much a team and you always
have to be there to support your
teammates and we’ve always had
that sort of bond at Penn State.”
Langley leaves for Rice

Maryland’s loss is Rice University’s gain.
Associate head coach Tina Langley of the Maryland women’s basketball team has accepted the head
coaching position at Rice University
in Texas.
Langley was hired by head
coach Brenda Frese in 2008 and
spent seven seasons in College Park.
During her tenure, Langley helped
guide Maryland to a pair of conference regular season titles and three
conference tournament titles. She
also helped bring in four top-10 recruiting classes.
“Being a part of the Maryland
family has been one of the greatest
blessings of my life,” said Langley.
“I don’t know how to begin to thank
Brenda Frese for the many years of
friendship and mentoring. She is not
only one of the greatest coaches in
the game, she is also an amazing person. To her, and to all the staff and
student-athletes I have been so fortunate to work with, I will be forever
grateful. I also want to thank the fans
for their unwavering support. To be a
part of the Maryland family is something incredibly special, and the relationships fostered in College Park
will last a lifetime.”
Langley becomes just the fifth
head coach in Rice University
women’s basketball history and replaces Greg Williams who retired
last month after ten seasons at the
Houston-based school. She inherits
a program that finished 9-21 during
the 2014-15 campaign.
