Introduction
1.
At the Committee's meeting of 11-12 November 1980, the Chairman noted
the broad consensus that work with regard to tropical products should proceed
on a step-by-step basis. As a first step in this connexion, the secretariat
was requested to provide detailed data on the commercial policy situation and
trade flows for products listed in the Annex to document COM.TD/W/319. The
hope was expressed that in the light of the information provided, the
Committee would be in a position to exchange views on the post-Tokyo Round
situation for these products in each country and thus focus on particular
issues and problems which continued to affect access to markets for exports of
developing countries. It was understood that such information would be
furnished without prejudice to the question of the definition of tropical
products or to the position of any delegation with regard to the treatment of
issues in this area. As an additional step, the Committee would be expected
to examine the possibilities for making further progress towards trade
liberalization taking into account any factors which might have affected
action in the Tokyo Round.

This paper provides data on trade flows and commercial policy measures
with respect to the following products:

developed country markets in 1978 and 1979 and main suppliers to those markets
in 1979. A summary of the data in Annex 1 is given below:

Annex 2 provides data on both the pre- and post-Tokyo Round tariff rates
of nine developed country markets at the tariff line level together with
corresponding trade flow data available in the Tariff Study files. Developed
country markets (including Australia and Canada not included in the Annex for
technical reasons) provide a majority of the tariff items covered by this
paper with duty-free treatment on an m.f.n. basis as a result of successive
rounds of trade negotiations in the framework of GATT. In most cases, where
such items continue to be dutiable on an m.f.n. basis, GSP free rates apply to
imports from developing countries. However, for a number of items, tariffs
continue to apply in certain markets. No specific information is available in
the secretariat with respect to the application of non-tariff measures to
these items.

The post-Tokyo Round tariff situation is summarized below according to
CCCN headings.

Plants used in perfumery, pharmaceuticals or for
insecticidal, fungicidal or similar purposes

Austria, New Zealand, Finland, Norway and Sweden grant all tariff items
falling withing CCCN heading 1207 duty-free treatment on an m.f.n. basis.
Other developed country markets also permit duty-free entry on an m.f.n. basis
or under the GSP for most of these items. Information is provided below on
dutiable tariff items.

Australia grants plants not put up for retail sale falling within CCCN
heading 12.07 duty-free entry on an m.f.n. basis (bound). With respect to
plants put up for retail sale, Australia maintains an m.f.n. rate of 7.5 per
cent (bound), SPARTECA developing country members being entitled to duty-free
treatment (cf. L/5100). Suppliers of the latter item to the Australian market
include the EEC, the United States, the Republic of Korea, Switzerland,
Yugoslavia, Hong Kong and China.

Canada provides duty-free treatment (unbound) for crude herbs and plants
for medicinal purposes. Other plants falling within heading 12.07 are
dutiable under a Canadian tariff heading covering products not specifically
enumerated in the Canadian tariff. An m.f.n. duty of 15.7 per cent and a GSP
rate of 10 per cent for these items applied in 1981 are scheduled to be
reduced to a Tokyo Round final m.f.n. rate of 10.2 per cent and a GSP rate of
8.5 per cent respectively.

The EEC maintains an m.f.n. rate of 3 per cent on pyrethrum.
The main
suppliers of pyrethrum to the EEC market such as Kenya, Morocco, Ivory Coast
and Senegal have duty-free entry under the Lome Convention or other special
preferential arrangements. The EEC maintains m.f.n. duties of 2 per cent and
8 per cent respectively on liquorice roots and tonquin beans, but grants
imports from developing countries duty-free treatment under the GSP. In
general, products covered by the GSP scheme of the EEC enter duty-free when
imported from least-developed countries.

Japan applies a temporary m.f.n. duty of 5 per cent (general rate: 10
per cent) on cannabis plant and poppy straw, which could be used for
manufacturing narcotic drugs, and a bound m.f.n. duty of 5 per cent on
ginseng, which is exported primarily by the Republic of Korea. Imports of
insect flower (pyrethrum) from developing countries (Kenya, Tanzania, etc.)
have been granted duty-free treatment under the GSP with effect from 1 April
1979. Japan had previously applied an m.f.n. rate of 20 per cent on imports
of this item from developing countries. Sandalwood and miscellaneous products
falling within CCCN heading 1207 are also granted GSP duty-free treatment
(m.f.n. rate: 5 per cent).

While unprocessed products are m.f.n. duty-free, Switzerland maintains
an m.f.n. rate of SwF 0.075 per kg. (1.1 per cent) on processed products
falling under CCCN heading 12.07. These items are, however, granted GSP dutyfree treatment with the exception of basil, borage, rosemary and sage.

The United States applies m.f.n. duties of 6.5 - 10 per cent on
manufactured basil, manufactured mint leaves and digitalis (purpurea). US
imports of manufactured basil come mainly from the EEC and Thailand. The
United States grants origanum other than crude, sage ground or rubbed, tonka
beans, advanced aconite, aloes, etc. duty-free treatment under the GSP (m.f.n.
rates: 0.9 - 9.7 per cent).
Items other than the above covered by heading
CCCN 12.07 are duty free on an m.f.n. basis in the United States.

Imports of these items into Australia, New Zealand, Finland, Norway, and
Sweden are duty-free on an m.f.n. basis; Canada, the EEC and Switzerland
provide duty-free treatment either on an m.f.n. basis or, for developing
countries, under the GSP.

Austria, Japan and the United States grant most of the tariff items
falling within this CCCN heading m.f.n. duty-free treatment. Exceptions are
as follows: Austria maintains an m.f.n. duty of S 0.55/kg. bound (6.5 per
cent) on crude resins and of S 0.84/kg. (3.7 per cent) on common resins.

While stick lac has m.f.n. duty-free treatment and seed lac GSP dutyfree treatment (m.f.n. rate: 10 per cent), Japan maintains an m.f.n. duty of
20 per cent or Y 50/kg. whichever is the higher, on shellac and other refined
lacs. India is the main supplier of shellac and other refined lacs. The
United States maintains an m.f.n. duty of 3.7 per cent (bound) on styrax, a
variety of balsam. Suppliers of styrax to the US market include Honduras,
Brazil and Mexico.

Canada, New Zealand, Finland, Norway and Sweden grant these products m.f
duty-free treatment and Australia, Austria, EEC and Switzerland provide dutyfree entry either on an m.f.n. basis or under the GSP. Japan and the United
States grant most of these products m.f.n. duty-free treatment or zero duty
under the GSP, except the following:
Ad valorem incidence based on 1977 imports.

No separate import data are available for Switzerland. Import data of
certain other markets show suppliers of some of these products. Basil - EEC,
Egypt, Hungary, Bulgaria, Thailand and Yugoslavia. Rosemary - Yugoslavia,
Portugal, Spain and the EEC. Sage - Albania, Yugoslavia, EEC, Turkey and
Mexico.

Carnauba wax

All eleven developed country markets except the EEC and Japan provide
m.f.n. duty-free treatment to imports of carnauba wax. The EEC grants
unprocessed carnauba wax m.f.n. duty-free treatment and maintains an m.f.n.
rate of 4 per cent (bound) on processed carnauba wax.
Japan maintains an
m.f.n. rate of 5 per cent (bound) on unprocessed and processed carnauba wax.
Both countries, however, extend to developing countries duty-free treatment
for these items under the GSP.

EXPLANATORY NOTES
With respect to tariff items of nine developed country markets (Austria, the EEC,
Japan, New Zealand, Finland, Norway, Sweden, Switzerland and the United States), the
tabulations attached provide information on: (i) pre- and post-Tokyo Round (MTN)
tariff rates (m.f.n. and GSP with indications of limitations, if any); (ii) imports from
all sources and from developing countries (each sub-divided by imports from countries
granted m.f.n., GSP and other preferential treatment in the market concerned), as well
as the percentage share of developing country suppliers; and'(iii) main suppliers.
Import figures refer to the year 1977 (1976 for Austria and Norway and 1977/78 for
New Zealand) and are indicated in thousands of US dollars.
Details are given Delow on the information included in each column of the tabulations.

CCCN heading and tariff line number
Description of product (in English except for EEC - in French). In
this column, a symbol showing pre-Tokyo Round GSP treatment of the
product is also given. The symbols used are indicated oh the next page,
specific duty rate is also indicated.
Pre-Tokyo Round (MTN) base rates of duty. M.f.n. and GSP rates are
shown. Duties shown are ad valorem rates, or the ad valorem equivalent
of specific duties calculated in relation to total imports of the
tariff line concerned.
This column also contains symbols denoting the type of duty and
GATT binding status of each m.f.n. tariff rate. The symbols used are
indicated on next page.
Column U.
Post-Tokyo Round (MTN) final rates resulting from negotiations. M.f.n.
concessions and GSP contributions made in the context of negotiations
are shown. Final m.f.n. rates are those to be applied at the end of
the staging period of tariff reductions.

Imports from all sources. Total imports are sub-divided by imports
from countries granted m.f.n., GSP and other preferential treatment
on the product in the market.
Column 6.
Imports from countries on the statutory list of GSP beneficiaries
for each market. This information is again sub-divided by the type
of tariff treatment granted to GSP beneficiary countries for the
product concerned.
Column 1.
Imports from developing countries as a whole, shown by the type of
tariff treatment granted to these countries for the product concerned.
Note that figures for imports in GSP terms do not. necessarily
reflect the extent of GSP utilization by beneficiaries. The value of
actual imports under the GSP may be smaller than those figures.
Column 8.
Percentage share of developing countries in total imports of the tariff
line into the market.
Column 9.
Main suppliers of products covered by the tariff line concerned to the
market. The four main suppliers within each type of tariff treatment
are shown in descending order of import value.
