Students who are seeking articling positions in Windsor, Ontario may use this book as a
reference when putting together their applications. This book does not contain
complete firm profiles, however, it simply provides an overview of each legal employer
who is accepting applications for articling in 2015-2016. The information may have
changed since publication, so you are encouraged to speak to employers directly and
review employers’ websites for a more extensive profile.

The firm carries on its practice in virtually all areas of law, including labour and
employment law, corporate and commercial law, litigation, municipal law, corporate
finance, banking, insolvency and receivership, taxation, franchising, estates and trusts,
matrimonial law, commercial and residential real estate and construction law. The firm

in both the public and private sector, including arbitration, negotiation, representation
before the Ontario Labour Relations Board and the Courts, as well as proceedings
under the Human Rights Code. In addition, the firm carries on a comprehensive
litigation practice, including general commercial litigation and personal injury litigation on
behalf of both plaintiffs and defendants, including the insurance industry.
We view the articling experience as your fourth year of law school. It is the first
sustained opportunity that most students have to apply the theoretical knowledge
acquired in law school to practical use, assisting in finding legal solutions to actual legal
issues. Our responsibility is to help the student make the transition from law student to
practicing lawyer.
We assist the student in developing the practical application of legal knowledge and the
appropriate business/management skills relevant to the practice of law, including:

appropriate interaction and communication with clients, support staff, witnesses,
the court and other counsel;
appropriate file management procedures;
appropriate time recording practices;
orientation to appropriate bookkeeping methods as required by the Law Society
of Upper Canada;
thorough understanding and compliance with the Law Society of Upper Canada’s
Rules of Professional Conduct.
We believe that the two primary methods by which a student learns are observation and
participation (i.e. learning by doing).
Our student will have the opportunity to observe by attending at various file events
including meetings (client, expert, witness), examinations for discoveries, mediations,
motions, arbitrations, settlement/pre-trial conferences, trials, transactional closings (and
preparation for such closings).
Advocacy and interaction styles are different from lawyer to lawyer. Accordingly, the
student is encouraged to attend as many of these types of events with as many different
lawyers as possible in order to observe different styles at work. Over the course of

time, the student will develop his/her own style. The student will have the opportunity to
draw on the elements of each style which she/he feels are effective.
The student will also have a tremendous opportunity to participate actively in the
conduct of legal matters at the Firm (all within scope of tasks which are permitted to be
delegated to articling students by LSUC). For instance, the student will be primarily
responsible for the conduct of the Firm’s Small Claims Court files, including opening the
files in accordance with the Firm’s file procedure, direct communication with clients, all
legal matters (from pleadings to judgment and all steps in between, including the
conduct of a trial, if necessary), as well as time tracking and account preparation.
While that may sound intimidating to some, fear not. The student will perform all of
these functions under the direct supervision of a lawyer at all times. In other words, the
student does not work without a net. The student’s work is reviewed at each stage with
constructive feedback from the supervising lawyer. By the time the finished product
reaches the client, the court, or opposing counsel, it will be well polished, having been
vetted internally prior to release.
We operate with an open door policy at our Firm. We encourage our students to ask
questions, no matter the issue, and each of our lawyers is generally available for
questions/discussion. We consult one another informally on a day to day basis and our
student is encouraged to do so as well.

The Crown Attorney system is responsible for
prosecuting the vast majority of Ontario's criminal
cases. Organized on a local basis, each office is
supervised by a Crown Attorney and staffed by
Assistant Crown Attorneys. In becoming a proficient
prosecutor, an Assistant Crown Attorney must master
all aspects of trial practice including such matters as
case preparation, witness examination and crossexamination, the use of forensic evidence, legal
argument, and the art of addressing the jury. There is
no better way to develop a barrister's skills than to
embark on a career as an Assistant Crown Attorney.
Apart from trial work, Assistant Crown Attorneys may
provide a range of related services. They give legal
advice to police during the course of investigations;
they assist police in obtaining search warrants; they
review police briefs and conduct `charge screening`
(by which they endeavour to eliminate charges where
there is no reasonable prospect of conviction); and
they try to facilitate reasonable resolutions of cases
prior to trial whenever possible.
Description of
Program:
The Crown Attorney's Office provides its students
with an excellent articling experience devoted to
criminal law. After articling many of our students go
on to become Assistant Crown Attorneys while some
go into private practice as part of the defence bar. In
either case, articling with the Crown Attorney's office
is an ideal way to start a career in criminal law.

In prosecutions, articling students work with Assistant
Crown Attorneys. The student works closely with
counsel in all facets of trial process, including legal
research, disclosure, pre-trial conferences with
defence counsel, witness interviews, preparation of
examinations-in-chief
and
cross-examinations,
preparation of closing arguments, and much more.
During their articling year, students also have regular
opportunity to prosecute a variety of provincial
offences, learning the rudiments of most trial skills.
By the end of a student's articling year, it is
anticipated that he or she will be sufficiently well
trained to work as a junior prosecutor.

Summer Student and Articling Student Opportunities in Canada
Miller Canfield hires first year law students each summer in Windsor and second year
law students in Toronto, Ontario, as well as graduating law students to work as articling
students for a 10-month period under the provincial Law Society’s lawyer licencing
program.
Although we can only hire students who will obtain law degrees from Canadian
universities or who have qualified under the National Committee on Accreditation
examination process, we are able to consider law students in joint degree programs
between Canadian and U.S. universities such as the joint degree program between the
University of Windsor Law School and the University of Detroit Mercy Law School.
Articling
Q: Will I be expected to work with one practice group or may I accept assignments from
a wide range of practice groups?

A: We encourage summer students and articling students to accept assignments from
all practice groups, but our program allows flexibility to select assignments, as well.
Q: What social activities can I expect?
A: In addition to challenging assignments, summer students and articling students have
the opportunity to get to know lawyers in the firm, as well as each other, at social
activities and continuing education programs coordinated in Ontario and with our offices
in the U.S.
Q: What is the compensation?
A: Competitive compensation is offered. Articling students are eligible to receive health
and medical benefits.
Q: Will I have a mentor?
A: Yes. Articling students are required to have a principal under Law Society rules. We
will also assign a mentor to answer questions, trouble-shoot, socialize, and, if
requested, review written work product.

student will typically deal with numerous matters during the full term of their articles,

During the articling term the articling student will be involved with various legal and

the Director of Public Prosecutions in the Ontario Court of Justice, or representing the
City of Windsor and the Ministry of Natural Resources in the Provincial Offences Court.

conduct any trials that arise out of those matters.

Section B - Governs Articling Recruitment by Firms Located Outside of
Toronto
Commentary: The general recruitment procedures outlined at Section C are also applicable to those
firms covered by Section B.
1. Employers shall not set application deadlines earlier than Friday, May 2, 2014 at 5:00pm.
Commentary: Where no other application deadline is stipulated in Section B of these Procedures, the
date of receipt of an application shall not be a factor if the application is received by May 2, 2014.
2. Interviews shall not take place prior to the application deadline. In addition, interviews may not take
place until after the student has completed all requirements of second year law school.
Commentary: Where no other interview period is stipulated in Section B of these Procedures, no
interviews shall take place prior to the application deadline of Friday, May 2, 2014.
3. Where no other offer date is stipulated in Section B of these procedures, communication of offers of
employment shall not be made prior to Thursday, May 15, 2014 at 5:00pm. Offers made at this time
must remain open until 9:00am on Friday, May 16, 2014.
Commentary: This offer date applies to all regions where no other offer date is specified in Section B
of these Procedures. Firms may communicate their intentions to make offers in accordance with these
procedures to summer
students employed with their firm in the summer months of 2014 at any time prior to this date.
However, in no case may offers be made to any such students prior to the time set out in these
procedures. Students receiving communications of intent may voluntarily communicate their own
intentions.
4. In scheduling their interviews, students are to allow at least an hour and a half on the premises of
the interviewing firm.
Section C - Governs General Articling Recruitment Procedures
Conducted by Firms Located both Within and Outside of Toronto
Commentary: The following procedures are in addition to those in Sections A and B.
1. Offers of employment shall not be made at any time on terms or in circumstances that do not give
students a proper opportunity to consider the offer before deciding.
Commentary: Offers shall not be made which are conditional upon the position still being open when
the acceptance is received.
(1) Firms may communicate their intentions to make offers, in accordance with these procedures, to
summer students employed with the firm in the summer months of 2014, at any time prior to the
stated offer deadline. However, in no case may offers be made to any such students prior to the time
set out in these procedures. Students may voluntarily communicate their own intentions. Firms shall
not put undue pressure on students to communicate their own intentions prior to the stipulated
deadline.
Commentary: Firms may also advise students in advance of events to which all interviewees will be
invited.
2. Students shall deal with offers received as expeditiously as possible regardless of the stipulated
time that offer shall remain open.
Commentary: Failure to communicate a rejection of an offer as soon as a decision to refuse is made
prejudices not only the offering firm but also fellow students to whom the offer may next be made.
3. Students who accept an offer shall immediately notify firms from whom they have an outstanding
offer or with whom they have scheduled interviews.
4. Students who accept an offer shall honour the undertaking thus given, regardless of what offers are
subsequently received and shall not thereafter take interviews with other firms.
5. Employers shall not knowingly make offers to students who have already accepted a position.
Commentary to C.4 and C.5: The offer and acceptance of an articling position constitutes a binding
contract between the principal and the student that carries professional obligations over and above
the normal contractual obligations.
