Yes. There are several.
Social Security Disability Insurance (Also known as SSDI or Title II Benefits) is an important benefit. Benefits are paid to those who have worked in recent years (five out of the last ten years in most cases) who are now disabled. You have paid for
this disability insurance with the FICA taxes that have been withheld from your wages over the years.
Supplemental Security Income (Also known as SSI or Title XVI) benefits are paid to those who are disabled and are also poor. It does not matter for SSI whether you have worked in the past or not.
How does Social Security determine whether or not I qualify for disability benefits?
Social Security will obtain and review the claimant’s medical records. The SSA will then evaluate the claimant’s claim using its 5-step sequential evaluation process, as follows:
Step 1: Is The Claimant Working?
SSA determines if a person is “working”, according to the Social Security Administration definition. If a person is working, their earnings must be below the level of substantial gainful activity (SGA). Earning more than the SGA amount may
disqualify a person from receiving Social Security disability benefits. There are special regulations for those that are self-employed.
Step 2: Is The Claimant’s Condition Severe?
SSA evaluates whether the claimant’s medical condition is severe enough to significantly limit the ability to perform basic work activities. The impairment must also last, or be expected to last, for a continuous period of not less than 12 months.
Step 3: Is The Claimant’s Condition Listed As An Impairment?
SSA asks whether or not the claimant’s medical condition meets or equals a listed impairment. The Social Security Administration has criteria for more than 150 categories of medical conditions, called “listings.” If a claimant meets a listing, their
condition is considered so severe that there is a presumption that work is precluded. If a claimant meets a listing, they will be granted benefits at this step. If they do not specifically meet a listing, they must pass step 4 and 5 to be granted benefits 20 16 AT TO R N E Y GU I D E | F E B RUA RY 6, 20 16
Are there different types of Social Security disability benefits?
Step 4: Can The Claimant Do Work That He/She/Ve Previously Performed?
Step 4 analyzes the claimant’s ability to perform the type of work you have done in the past, despite now having physical or mental impairments. If the Social Security Administration finds that the claimant is still able to perform your past relevant work, benefits are denied. If the claimant cannot perform past work, then the process proceeds to the fifth and final step.
Step 5: Can You Do Any Other Type Of Work?
Step 5 determines what other work the claimant is able to perform. Social Security considers a claimant’s age, education, work experience and physical/mental condition to make this determination. If Social Security finds that the claimant cannot
make a transition to other work, the claimant will be granted benefits.
What are some of the conditions that can disable a person under the Social Security rules?
Physical and mental impairments will qualify one to receive disability benefits. The Social Security Administration Federal Laws lists possible diseases, impairments, and injuries in the following categories:

• Musculoskeletal system (Example: back injuries and major dysfunction of joints)
• Special senses and speech (Examples: blindness, visual problems, and hearing loss)
• Respiratory system, (Examples: emphysema or asthma)
• Cardiovascular system, (Examples: chronic venous insufficiency, peripheral arterial disease recurrent arrhythmias)
• Digestive system, (Examples: crones disease, chronic liver disease and hepatitis)
• Genitourinary impairments (Example: kidney diseases)
• Hematological disorders, (Examples: blood diseases such as anemia, sickle cells disease)
• Skin disorders, (Example: skin lesions)
• Endocrine disorders (Examples: thyroid, adrenal glands, or pituitary gland problems)
• Multiple body systems (Example: Downs syndrome).
• Neurological disorders (Example: seizures and multiple sclerosis, Parkinson’s Disease)
• Mental disorders (Examples: depression, anxiety, schizophrenia, personality disorder, and low IQ.)
• Malignant neoplastic diseases (Examples: Cancer, HIV infection, lymphoma, carcinoma, melanoma .)
• Immune system disorders (Example: autoimmune disorders and immune deficiency disorders, lupus,
and inflammatory arthritis
What is the biggest mistake people make when trying to get disability benefits?
Failing to appeal. More than half of the people whose applications are denied fail to appeal.
Although another mistake, although much less common, is made by people who fail to obtain appropriate medical care. Some people with long-term medical problems feel that they have not been helped much by doctors. Thus, for the most
part, they stop going for treatment. This is a mistake for both medical and legal reasons. First, no one needs good medical care more than those with chronic medical problems. Second, medical treatment records provide the most important
evidence of disability in a Social Security case.
How much does Attorney Zabresky charge?
There is never a payment upfront for Social Security Disability or SSI cases. Most clients prefer a “contingency fee” wherein the claimant will pay legal fees only when benefits are awarded. The fee is usually 25% (one-quarter) of back benefits with
a maximum set by SSA. No fee comes out of monthly benefit checks.
