President’s Message

Let me first say thanks
to our Board of Directors for their hard
work thus far, and
thank you to our
members for their
willingness to speak
honestly and with
passion about our
industry…it’s good to talk with Auctioneers who know what they believe and care
as much about our profession as their own
careers.
John Kramer is at the end of his term as
NAA Director. John, thanks for your
service, leadership and for representing
the State of Ohio well. As John Kramer
finishes his term this summer, we will
have the opportunity to help elect Jerry
Stichter as the next representative from
the State of Ohio in the capacity of the
NAA Directorship. Let’s support and encourage Jerry by attending this year’s
National Conference and Show in Kansas
City.
While you are making plans, don’t forget
to attend the OAA Summer Seminar on
August 3, and the Bid Call Contest on
August 4. Your Board has decided that
due to the lack of Education Funds for the
Spring Seminar, we would instead put on
a Summer Seminar that would be in cooperation with the OAC, as to not unnecessarily use education funds for separate
events. We believe that this might be, and
I believe should be, a trend for the future.
This will encourage attendees at the FREE
summer seminar to spend the night in
Columbus and attend the State Bid Call
Contest at the State Fairgrounds. As a
matter of fact, I would suggest you bring
the family and spend some additional time
at the State Fair. In addition, we have
changed some of the rules this year. There
will be no repeat Champions. This will
encourage those from past years from
feeling like they compete against the same
group year after year. We are also changing the number of years licensed requirements for the Junior and Senior Groups as
well as judging.
As always, there are a few things happening at the State House. We have a very
involved membership in State Government. A commitment made by Past President Doug Walton to change the laws that
will allow the Auctioneers in Ohio to sell
Titled Vehicles at a public consignment
auction, is still a high priority for this
association. This is not going to be a sprint
— it’s going to be a marathon. It can be
done and I really believe it will be done.
We have had some help from a lawsuit
filed by Richie Brothers against the State
of Ohio and recently from some members
communicating with their State Representatives and Senators.
If you’ve attended any OAC meetings
recently you know that there has been a
committee formed to address changes to
the Ohio Licensing Law concerning Apprentice licensing. Your Executive Committee is currently reviewing some requested changes to the law as desired by
the OAC and the Department of Agriculture.
The bed bug police are on patrol and
coming to an Auction near you. Be aware
that if you move any upholstered items
from the place of origin to any auction
location, you are required to obtain a
license from the State of Ohio that will
allow you to sell those items after they are
sprayed and tagged.

Last time I presented the first installment
of a two-part discussion of negligence.
We saw that negligence is comprised of
four essential elements: (a) a duty to
exercise ordinary care, (b) a breach of that
duty, (c) the proximate cause (i.e., a natural, probable, and reasonably foreseeable
consequence) of the breach being (d) damages to the claimant. If any one of these
four elements is missing from a case, there
is no negligence. Negligence can result
from either an act or an omission.
This time we’ll look at the test for determining negligence. We’ll also consider
several important issues for auctioneers.
Test.
Negligence is usually a question for a jury
to decide. The legal test starts with whether
a defendant acted as a “reasonable person” would have acted under the same
circum-stances. If a jury finds the defendant did the same thing that the fictitious
“reasonable person” would have done,
then the defendant would not have
breached any duty owed to the plaintiff.
However, if the jury finds that the defendant did not do what the “reasonable person” would have done, that would be a
breach of duty and might be negligence
for which the plaintiff could recover damages from the defendant.
Example of Negligence.
Let’s consider an example. The driver of
an automobile has a duty to operate his
vehicle with ordinary care. When he
approaches an intersection controlled by a
stop sign, the driver has a duty to stop,
look, and not proceed until the way is
clear. If he fails to do these things and
causes a wreck with a truck, he has
breached his duty to the truck driver and
will be responsible for all damages caused.

Example Without
Negligence.
Let’s return to the example of the motorvehicle wreck and assume the driver of the
automobile suffered an unpre-dictable
heart attack and lost consciousness as he
approached the intersection. His car then
proceeded into the intersection and collided with the truck. If the fictitious “reasonable person” had been operating the
automobile, would he have done anything
differently than the driver did? No, the
“reasonable person” would have been in
the throes of a heart attack and unconscious, too, so he would have had the same
wreck. Since the driver did just what the
“reasonable person” would have done
under these circumstances, there would
be no breach of duty and, therefore, no
negligence. Here, the truck driver would
be damaged but have no basis for recovering anything from the automobile’s driver.
Not responsible for
Accidents.
Have you seen this disclaimer of liability
in auction ads? Sure you have – plenty of
auctioneers use it. They should drop this
disclaimer and advertise something that
would help the auction, because this won’t.
It’s worthless and an example of auctioneers copycatting instead of thinking.
Auction Threats.
When auctioneers think of negligence,
they typically envision someone tripping
over something at an auction site and
being injured. That can happen and it
might be negligence, but there are other
goblins lurking. Here are several I have
encountered that may have escaped your
radar.
Many auctions are held at sites where the
premises can pose substantial risk – old
farmsteads, buildings, warehouses, fields,
etc. I’ve seen dilapidated houses, open
wells, rickety structures, crumbling outbuildings, dangerous equipment, broken
glass, jagged metal, junk piles and the like
at auctions that should have worried the
auctioneers, but apparently didn’t. Auctioneers should carefully search for site
hazards and either cure them or clearly
mark them for the public to avoid. Special
precautions are needed for young children
who are incapable of appreciating these
dangers. You just can’t be too careful.
There are two problems with using this
disclaimer in an effort to avoid liability for
negligence. First, parties with equal bargaining power can contract away liability
in limited instances, but those who attend
auctions don’t enter into contracts just to
be there. Second, since most auctions are
public, numerous jurisdictions would hold
such a disclaimer to be contrary to public
policy.
I read that up to one percent of the population is susceptible to suffering a fatal
insect sting. In one recent year, 84,000
people suffered anaphylactic shock from
stings and 500 nearly died. Around 100120 people do die annually from insect
stings. My wife was stung on the leg by a
bald-faced hornet at an auction and it was
a nasty wound. We were standing with a
lot of other people beside a fir tree. After
she was stung, I spotted the nest on an
inside limb just four feet off the ground.
The hornets had become agitated and the
crowd suddenly realized the danger and
started to move quickly away from the
tree. It was only then that the auctioneer
said, “Y’all watch out for them hornets in
that tree.” He knew about the hornets and
had done nothing to get rid of them. That
was negligence.
Think about it – how many stores, restaurants, theaters, and the like do you see
disclaiming liability for negligence? None.
Don’t you think they’d do it if the law
allowed it? If you still believe in this
disclaimer, try hanging a sign on the front
of your car that reads: “Not responsible
for accidents.” Then see where that gets
you if you have a wreck that’s your fault.
Here’s a biggie. Auctioneers are agents
representing principals. This brings them
under a legal doctrine called respondeat
superior. When an agent acts within the
scope of the agency and is negligent, liability can be vicariously related back to
the principal – the seller. Most auctioneers don’t know that and neither do their
sellers … until a lawyer becomes involved!
Not always.
Harm does not equal negligence. Causing
someone to be hurt and suffer damages is
not necessarily negligence and the mere
happening of an accident is not proof of
negligence. So one person could be injured by another and still not recover
damages if the other person wasn’t negligent. The “reasonable person” test is the

NAA Conference and Show in Kansas
City July 13 thru 18. New NAA CEO,
Hannes Combest and her staff wants to
make our 60th Anniversary a special time
for us all, and headquarters will have the
red carpet out for one and all. I hope you
take time to go and visit your NAA Headquarters, the museum, HOF wall and the
NAA staff.
Ohio … we need your help electing Jerry
Stichter to the NAA Board. Jerry will
need about 180 to 200 votes to get elected,
and Ohio should be able to provide 50 of
those if our usual numbers attend the business meeting. Please, take the time and
vote.
As I wind down my 3-year term, I can only
say how wonderful an experience serving
as Ohio’s representative to the NAA has
been. Our Board listened to the members
and addressed many hard issues, eliminated programs, cut budgets all to assure
the NAA will move forward for everyone!
I spent the weekend of April 25th in Kansas
City for a Board meeting. I am pleased to
announce that we now have a member
driven association again, not an executive
driven association! Many changes have
occurred this last 12 months to assure the
association is members first! For example, the rotation of convention sites is
coming back as it used to be (although we

So I hope Ohio considers hosting a convention again. Currently, 2010 is Greensboro, small venue; 2011 is Florida again
(sorry); 2012 is exciting, but far away
Spokane and 2013 is Indianapolis; 2014
and 2015 have requests being studied.
That would put Ohio about 2016 or 2017
for consideration. Our last convention was
1989, so 30 years is long enough. Put this
on the back burner, but OAA Board, put it
on the burner now.
Our BOD meeting had 17 reports; 4 scheduled action items and 11 scheduled discussion items, plus additions. So you can
imagine, it was two very full days. However, we took time to have dinner at the
Golden Ox, in the heart of old Kansas City
stockyards and in the same building where
Missouri Auction School started. Great
steaks and we had a good time looking at
photos and the old school rooms for those
of you who attended MAS.
Concerning the Lifetime Membership, it
will remain as it currently is, with changes
made for future LM. Two things happened: first interest rates went down, and
secondly, membership fees went up. The
original format was not put together in the
NAA’s best interest, but after solicitation
of member’s opinion, the Board made the
hard decision to stay status quo. Ohio, you
may want to study your program as well.
We have IRS rules to follow too.
This coming year, I believe the NAA will
have one of its best Presidents in Scott
Musser. Scott came to Ohio and was very
well received a year ago, so make sure you
say hello to him in KC.
Again, the NAA is returning to a member
driven organization, and I am proud to
have helped the NAA get back on tract
with family values and financial stability.

years on the NAA board. See you at an
auction!

Conclusion.
This has been a brief introduction to negligence and not a comprehensive treatment. Space limitations preclude covering many topics, including defenses to
negligence actions. Nevertheless, the information presented here and in my previous column should assist you in better
understanding this important body of law.
Finally, when auctioneers ask me
what their greatest risk is of being hit with
a negligence claim, the answer is simple.
It’s the same as it is for every other citizen
– operating a motor vehicle. Nothing we
do is more likely to cause serious injury
and death. So buckle up, drive defensively, and be careful … very careful!

TOPIC:
“More than we really need to know”
These comments will probably add humor to your Cashier’s
job. 1. When a potential buyer comes to the cashier to get a
bidder number, sometimes, they tell you more than their
correct name, address & phone number.
For instance: They will tell you the REASON they are at your
auction. By explaining the items they want & then asking
questions. Where is it? What condition is it? Why they want
it. When will it sell? (because they have to leave at a certain
time today to pick up somebody, drop off somebody or watch
a child play ball etc.) If they don’t get what they want, WHO
did? (name & phone number, please)
You might not want to ask a question like “How are you
today?” Because they will tell you. It could be lengthy.
(never minding the people behind them) OR If you ask “How
have you been”? That could be anything from a major
operation, starting with all the operating room doctors to the
removal of some organ, including their recovery. (again,
never minding the people in line behind them, who are rolling
their eyes, tapping their toes, with their Ids in their hands.)
There are even those people who DON’T want a number &
still feel it necessary to tell you what they’ve been doing since
your last auction. Where they moved & Why. And why they
are not interested in the real estate that’s being sold today. But
they will stay, just to see what $$$ it brings. (as they move
around the crowd of potential buyers while they are making
comments about the real estate.) This will be another lengthy
conversation later. (after the Auction is over.)
The weather is another favorite topic. Good or bad. But a
conversation, none the less.
Don’t get me wrong. I enjoy auctions. I love my job. I like my
cashier friends. But sometimes, I am “testy” after a looooong
day.
Before I close, (for those who don’t know) I have had cataract
surgery on both eyes. Want to hear all about it? WHAT???
O.K., I won’t tell you. But I can see you better now. And
don’t forget, I’m just around the corner.
Get Familiar with Reverse Mortgages

I’m not a Banker or Mortgage Broker,
I’m a Realtor and Auctioneer working
with buyers and sellers everyday. In
Ohio, we have seen the foreclosures
taking place, the Short Sales, and the
bankruptcies. The predatory lending
during the past 5 – 10 years has caught
up to itself and landed many young
families in the hole. But this isn’t news
to us in the auction business. What I’m
truly concerned about, our seniors. Predatory lending in Ohio
has put our seniors and their families in financial stress with
what are called “Reverse Mortgages”. During the past few
months many of the properties I have looked at for auction
have reverse mortgages against them. These reverse mortgages start at $0 and add a monthly amount to the debt against
the real estate. The idea behind the reverse mortgage, gives the
homeowners who owns their home with no mortgage (after
spending their lifetime getting to that point), a monthly check.
The interest rates are higher than usual, the appraised values
they used are over inflated, and most of the seniors don’t
realize what they are getting into. Some family members use
this type of loan to pay for hiring help to take care of the
seniors in their home verses going into assisted living. But,
some are spending the money on other things that maybe
aren’t so important. Last week I looked at a fine home on 8
acres that I believed was worth $150,000 - $160,000. The
balance on the reverse mortgage was already $156,000 with
about $1200 added on each month. The mortgage can
continue like this until it reaches $313,000! The family is
frantic because “Mom”
has this mortgage and
now they can’t get her
out of it. We all know
what happens next, foreclosure. Get familiar
with Reverse Mortgages. Be sure to educate your customers of
the consequences.

Three OAA Members Part of
The Super Auction

The Super Auction was a unique collaborative auction event and brought auctioneers and buyers from across the Midwest
together on February 28, 2009 at the
Washtenaw Farm Council Grounds in Ann
Arbor, Michigan. Jade Montrie of Montrie
Auction & Estate Service, LLC, Greg
Belhorn and Peter Gehres of Belhorn
Auction Services, LLC represented Ohio
and the OAA in the field of eight firms and
three states. Over 360 registered bidders
from seven states drove bidding and prices
were reliable. The event started promptly
at 10:00 AM and the last item crossed the
block a few minutes before 3:00 PM. The
event featured collections from across the
Midwest and South and had something for
nearly every collector and enthusiast. In
the five hours of selling nearly 1400 lots of
pottery, antiques, advertising, ephemera,
firearms, sports cards, sterling silver, coins,
clocks and collectables of all shapes and
sizes crossed the auction block.
“We wanted to have both quality and
quantity and the auctioneers of The Super
Auction delivered,” stated David Helmer
of Braun and Helmer Auction Service and
The Super Auction manager. “This event
was a true collaboration and a team effort
in every sense. Each auction company
brought their skills and talents to the table
and The Super Auction exceeded expectations.”
“Our companies involvement in the National, Ohio and Michigan State Auctioneers Associations were the catalyst for this
event,” commented Montrie, OAA Director Northwest. “State meetings and NAA
Educational Institute programs provided
the back drop for much of the initial planning and discussion.”

Auction into a biannual event that the
auction community can depend on as a
consistent venue to buy and sell. We are
also leveraging new online media including an active blog, Facebook Fan Page as
well as aggressive traditional marketing
to reach as many people as possible.”

Three Ohio Auctioneers Earn CAI Designation
Peter D. Gehres (Columbus), Cynthia Kohn (Cincinnati) and Craig
Lytle (Batavia) each recently completed their third and final year
of the recognized National Auctioneers Association (NAA) Education Institute’s Certified Auctioneers Institute (CAI) designation. They will be officially awarded their designations this July in
Kansas City, Missouri at the 60th annual NAA Conference and
Show. The CAI program is an executive developmental program
offering coursework in management skills, business ethics, finance, marketing, strategic planning, negotiation, and leadership.
Many of the auction industry’s most distinguished and respected
leaders as well as university professors provide instruction to CAI
students throughout the three year program. For over thirty years
auctioneers across the United States, Canada and the world have
journeyed to Indiana University in Bloomington, Indiana to participate in the program.
The three Ohio Auctioneers were part of the class of CAI 2009
which was one of the most distinguished classes in the CAI
program. Their classmates included NAA President Elect Scott
Musser, NAA Director Monte Lowderman and their class advisor
was NAA Director Christie King. Past international and state bid
calling champions and numerous past state presidents and leaders
filled the balance of the class.
At the conclusion of this year’s program Peter Gehres was awarded
the prestigious Pat Massart Leadership Award. The award honors

the memory of Auctioneer Pat Massart and her steadfast commitment to the CAI program and auction industry leadership.
Other Ohio Auctioneers attended this year’s CAI for the first time
and included Vicky L. Carlton (Fairfield), Jeremy Gregg and
Sheila Gregg (Sycamore), Jeff M. Koehler (Zanesville), Litza Li
Lee (Maumee), Cynthia Shillig (Columbus), Neil Webster (Springfield) and William R. Wells (Hamilton). Those completing their
second year of CAI included Randy Compton (Canton), David A.
Kaufman (Sugarcreek), Tim Lile (Xenia), Joseph M. Mast
(Millersburg) and Jade Montrie (Toldeo).
OAA Hall of Fame Nominations Due —
Deadline July 1
Nomination opportunities for the newest Hall of Fame positions
have officially opened. Because the OAA office keeps nominations on file for 5 years, all nominations made in 2006 will be
forwarded to the committee for consideration later this year. The
person selected must meet the criteria below, all of which is
researched by the Hall of Fame Committee Chairperson and
Immediate Past President, Barry Baker.
The nominations close early in the year in order to give the
chairman time to conduct the necessary research, and then send the
information to the Hall of Fame members, who vote on the winner.
Please think about someone you know – maybe it’s a mentor or
someone you’ve always admired – and take the needed time to
nominate that person.
The following procedures have been established for submission of nominations to the OAA Hall of Fame:
1. The nominees should be members of OAA or someone who
has made a major contribution to OAA.
2. Only members of OAA can nominate individuals for this award
and they must use the forms established and approved by the
OAA Hall of Fame Committee.
3. The deadline for nominations is July 1 each year.
4. Nominations must be in writing, signed and mailed to the Hall
of Fame Committee, in care of the OAA Executive Secretary,
17 S. High St., Ste. 200, Columbus, OH, 43215-3458.
5. Selections will be made by the members of the Hall of Fame.
In the event of a tie, the Immediate Past President, the President
and the President Elect of OAA shall vote to break the tie.
6. The criteria that will be considered by the committee in
selecting the winner is:
• Success and leadership in the nominee’s chosen auction field.
• Dedicated support of OAA and the local community.
• Adherence to the Auctioneer Code of Ethics.
• Special considerations, e.g. an unusual impact benefiting
the auction profession.
7. Induction into the Hall of Fame shall take place at the Winter
Convention.
8. Those candidates not selected will be kept on file for 5 years
and will be renominated each of these years. After 5 years, said
applications will be null and void.
The procedures for nomination are as follows:
1. Nominations will be sent to the Committee, via OAA’s Executive Secretary, on or before the first day of July each year.
Nominations are to be submitted on approved forms only.
2. The Hall of Fame Chairman is responsible for mailing all
nominations to voting members for their consideration, following the deadline date of July 1.
3. The Hall of Fame members will vote on the nominations prior
to the October board meeting following the Summer Convention.
4. The nominees selected will be announced at the Winter Convention.
5. The Executive Secretary or Hall of Fame Chairman shall:
A. Notify a member of the elected nominees’ family to assure
the elected nominees will attend the Winter Convention.
B. Purchase an appropriate award to honor the new Hall of
Fame members.
C. Provide the elected nominees with a namebadge ribbon.
D. Publish the award in the Buckeye after the January meeting
with a brief synopsis and photo of the new inductees.
E. Send a news release to the elected nominees’ local media.
F. Maintain a list of all members of the Hall of Fame and
publish in each issue of the Buckeye and the roster.
G. Present all Hall of Fame members with a ribbon for their
namebadges at all meetings.
6. The President or his appointee shall present the awards during
the Winter Convention.
7. All Hall of Fame members shall be honored with a lifetime
membership in OAA.

Perception is More Important Than Reality

Ok, I have been racking my brain for quite a
while trying to think of something that other
Auctioneers would find interesting and informative. The hard part being, interesting and
informative from my perspective- that of a 16
year Automotive Industry Veteran and now
“Rookie” Auctioneer trying to make a name
for himself in this industry. Then it hit me; My
Perspective, of course in my mind I am better
looking then Tom Cruise and Shakespeare is
constantly getting credit for my lines!!
During the day I am the Pre-Owned Sales Manager at Germain
Lexus of Dublin, and manage a veteran sales floor. Well, we all
know how Car Sales has been the last year and like many others I
have allowed myself to fall prey to the Gloom and Doom that has
befallen most of America and my sales floor. Sales were few and
far between and tempers were thinly veiled. Then one day while
secluded in my office. (I was safe in there, salespeople & customers
have not figured out how to see through walls yet) I heard an
exchange of words between my salesperson and prospective client
that changed my perspective. The customer simply asked if he
could get the price lower since he knew sales were bad and
followed it up with “ Maybe I should think about it for the next
couple days to make sure it is the right time to be purchasing”. That
was it, it finally brought me back to the role in which I was trained
for, accustomed to and paid for- The Manager. I bolted out of my
office and all but attacked both of them in enthusiasm to lead. It
went something like this: “Mr. Customer I was sitting in my office
and I overheard your question and could sense your concern about
purchasing today. Let me set a few things straight; you are
absolutely right that this is a great time to purchase- it is slow,
prices are lower then they have ever been, rates and terms are at
historic lows and you are the center of our attention. We want your
business and the smart businesses are really finding out right now
just how important every single customer is. As a matter a fact I
recommend taking full advantage of this “Downtime” and purchasing right away!” Well he did and was just as excited as I was
to do so. What had happened? I corrected my perspective first and
allowed others the opportunity to change theirs. The next day I
called all of my salespeople into a meeting and talked about
“Perspective”. Here are a few facts that I pointed out. Fortunes are
made in either the building up or the tearing down of a civilization.
What people forget in their “Gloom and Doom” outlooks, is that
because of the Recession right at this moment there is more interest
and more people window shopping then ever before. We call them
“Intenders”, people that due to prices dropping and pent up
demand, intend on purchasing at sometime and taking advantage
of the opportunity this downturn has caused. Well lets help them.
When I went to Auction School I remember being asked “Why do
people go to Auctions?” The answer will always be because of the
prospect of a good deal. And aren’t we all taught that a “good deal”
all depends on perspective? If I am asked how the Auction business
is going I simply respond, “If there was ever a time to get a good
deal- it is now!” If a prospective client would ask me if the should
wait until things are better, I would explain right now people are
more excited then ever about the prospect of a good deal and that
they should take advantage of a down economy. Less Auctions,
Less competition and a better turn out- equals better prices. The
fact is, good items bring good money. People will still show up and
spend money if the prospect of a good deal is there. Our job as
Auctioneers is to get them there. Both Buyers and Sellers. Cheap
things will sell cheap, they always will. The truth to Marketing is
simple, and people are amazing. Paying $5 for an item that should
have sold for $6- easily justifies the other 4 items we overpay for.
I will drive halfway across town to buy crackers for fifty cents less
“on sale” not counting the other items I bought while I was there.
I concluded the meeting with my sales floor with the message that
times aren’t bad, they are simply in “flux” or “unstable” and for
people in sales this is the best economy to be in. The news,
newspapers and world are talking incessantly about how low prices
are, stocks are cheap, housing prices are down and people are
losing jobs. Its all true. Every word of it. So is the fact that it is an
incredible time to buy that big screen TV you have always wanted,
buy stocks at record lows, “up size” your home or “right size” your
address, and if you need something done, well, your worth as a
consumer has tripled in less then a year and it is amazing what you
can get done for your money. As for stress on the family, yes it has
been stressful. But we seem to find ways to amuse ourselves
together. And my children now really understand why we give
thanks at the dinner table. So how is your “perspective” now???

auction held at the CAI class in March, 2009 in
Bloomington, IN.
Jeff purchased the quilt for $350.00. The quilt has been
auctioned off before at numerous fun auctions held throughout the state. Jeff will bring the quilt to the OAA Winter
Convention January 9-11, 2010 at the Hilton at Polaris to
auction off during the annual Fun Auction.
