SAR Members Earn State Award for Political Action
SAR Members have received one of only two prestigious
C.A.R. statewide awards for political action in 2005. The award
was presented to SAR representatives during a C.A.R.
Board of Directors meeting
held recently in Anaheim.
The award recognizes SAR
for outstanding efforts in
increasing Our REALTOR®
Action Fund (RAF) contributions by 50% from 2004 to
2005. “This is an extraordinary achievement for an
Association as large as ours,”
said President Leigh Rutledge.
“Political issues are extremely important to our business,
and I think this award is an
acknowledgment that our
Members are better informed
and better prepared to defend
our business than some of
our peers.”
The RAF Trustee Committee has set more record-breaking
goals for the 2006 campaign. “Raising Members’ total investment for political action work
is a great accomplishment,”
noted RAF Trustee Chairman
Doug Covill, “however, this
year we’re focusing more on
increasing the number of RAF
participants than on the dollar total.” With SAR already
ranking among the top three
large California associations
in RAF participation, the
Committee has set a goal of
51% member participation in
the RAF by year-end. “That
would make SAR the Number
One large REALTOR®
Association in California,
hands down,” Rutledge added.
“It’s an achievable goal and a
critically important cause.”

Answering the Call to Action
By now, I hope I’ve reached every Member of this Association,
asking you to answer the call to political action. It was the focus of
my message in your dues renewal notices. I’ve repeated it at every
Main Meeting. I’ve asked the REALTOR® Action Fund trustees
to reach out to Members at regional meetings, SAR events and by
every means possible. This month the Sacramento REALTOR®
editors gave me one more shot at spreading the message, so I’m
taking it now.
Our industry and our Association are facing huge political challenges, from trial lawyers, misguided government regulators and
giant banking corporations, just to name a few. The only way we
can meet these challenges is through the REALTOR® Action Fund
(RAF) and I’m asking every Member - REALTORS® and Affiliates
- to contribute $197 this year to support the RAF.
Are you aware, for example, that a presidential advisory commission has recommended a phase-out of the IRS home mortgage
interest deduction? If adopted, this act would make homeownership
unattainable for tens of millions of Americans, including many
REALTORS®. Perhaps you haven’t heard the President or any
other politician talking about it because this is an election year, but
tax reforms will be on the congressional agenda shortly after the
November election. REALTORS® need to be ready with our political cannons loaded to protect this critical deduction.
Do you know the latest on the Big Banks’ efforts to take over
the real estate industry? Despite a lot of support for REALTORS®
in Congress, we remain subject to the threat of liberalized banking laws that would blur - maybe even eliminate - the distinction
between REALTOR® and lender. This has already occurred in the
United Kingdom, and could happen here as well.
Closer to home, SAR’s Government Affairs team has been
working patiently - and quietly - for over a year to defeat an onerous mandatory rental inspection ordinance proposed by the City of
Sacramento. Though well-intentioned, this ordinance could have
cost local landlords and property managers millions of dollars in
landlord registration and education programs, and tens of thousands
of unnecessary inspections. Thanks largely to our past political
groundwork and ongoing advocacy, it appears as of this writing,
that this particular ordinance is dead. As always, though, we have
to stay alert. The next bad, bureaucratic scheme or program is never
far away.
In addition to the foregoing examples, here are a few more political challenges we’ll be working on in 2006:

Fighting trial lawyers and shakedown lawsuits against
REALTORS®
·
Opposing business license fees and commission taxes
·
Opposing property transfer taxes and
conveyance fees
·
Electing pro-REALTOR® candidates
·
Opposing expensive point-of-sale mandates
·
Protecting property owners from unfair
land seizures (eminent domain)
·
Guarding against disclosure liability
·
Promoting flood protection

was my privilege to accept on your
behalf a CAR award for increasing
our political action contributions
by 50% in 2005. SAR was one of
only two large Associations statewide to receive such an honor.
My goal for this year is to
achieve at least 51% SAR Member
participation. That would be the
highest participation rate SAR has
ever achieved; in fact, it would
be the highest rate achieved by
any large California REALTOR®
Association ever. At last count,
our 2006 RAF participation was
running close to 45%, so we are
very clearly within the realm of
the achievable.

But the more important goal is for all our Members to understand
and appreciate the magnitude of the threats facing our businesses
and livelihoods. That is why we resurrected the SAR Legislative
Committee in 2006, and why we will relentlessly seek your
support.
We’re asking for a $197 contribution from each REALTOR®
because that is the true annual cost of protecting your business. It’s
a small price to pay - less than $3.80 a week (the price of a good
latte) - for the assurance that your real estate career opportunities
will be there for you in the months and years to come. Contributing
is easy. Visit the SAR Member Services counter or log on to www.
car.org and click the REALTOR® Action Fund button. If you have
any questions, please give me a call at 916.484.2030. It’s time to
answer the call.
While I’ve got you here, let me remind you of a decidedly more
light-hearted matter: my 50th Birthday Bash at SAR. It’s coming up
Friday, March 24th at 6:30 pm. Yes, it happens to be my birthday
and, yes, we are going to have a great time eating, drinking and
rocking out to the live party band Animal House. But this is really
about getting together as SAR Members, letting our hair down a
little and raising money for the SAR Scholarship Fund. It sounded
good enough to me to invite 8,000 people to my 50th birthday party.
I hope you’ll join us.

On February 3rd, Masters Club President
Elect, Doug Covill, with his Educational
Roundtable sub-committee, sponsored
another very successful annual Educational
Round table program. The event was widely
attended and featured the theme “Success in
a Changing Market.” Attendees remarked
that the four workshops, the presenters,
and the panelists, were highly informative
and very motivational. The four workshops
were given by Kathy Chigbrow, Bruce
Slaton, Derek Kirk and Michael Brickner.
The lively forum discussion was moderated by Carlos Kozlowski, and the panelists
included Jon Nastro, Barbara Harsch, Nick
LaPlaca and Tina Deller. This annual event
allows all REALTORS®, not just Masters
Club Members, to gain insight and knowledge from some of the area’s most successful REALTORS®.
Masters Mix at the Sutter Club
The beautiful Sutter Club was the scene
of the Winter Masters Club Network Mixer
on Thursday, February 16th. As usual, the
food was wonderful. Masters Club members enjoyed an historic atmosphere to network and catch up with old friends. This
year’s event also featured vocalist, Valerie
Weinberg, with piano accompaniment, lending a cabaret feeling to the event. Masters
Club President, Linda Bennett, had the
distinct honor of presenting flowers to a
very special “charter” member of Masters
Club, Evelyn Morgan. After decades of
top performance and outstanding professionalism in the real estate industry, Evelyn
announced her retirement, at the young age
of 94. Evelyn, in addition to being one of
the founding members of Masters Club, has
also been a past President of Masters Club.
She holds the distinction of “Outstanding
Life Member” and has agreed not to forget
us as she retires.
Annual Awards Luncheon set for end
of March

Luncheon. The luncheon will be held at
the Sheraton Grand Hotel and promises
to be an exciting and fun event. Steering
Committee Members have been busy since

and rewards its existing Members for their

Sac 1st Mortgage and Friends Raise
$10,000 for CARE and Charity
Sac 1st Mortgage recently held its spirited
cabaret-themed event, Cabernet Under the Stars
and raised $10,000 for charity in the process.
The event is an evening of food, wine, cabaret
show, and silent auction.
The event was attended by 300 people from
the industry and community. $6,000 in proceeds was donated to C.A.R.E (Catastrophic
Aid for Real Estate). Another $4,000 was
donated to S.A.F.E, a local organization that
assists those who cannot afford to participate in
school activities.
Co-sponsors of the event included Davis
& Davis Real Estate, North American Title,
Fidelity National Title, Financial Title, Keller
Williams Realty and Gallaway Commercial.
This is the second year Sac 1st Mortgage
Charitable Foundation has joined other Real
Estate leaders to sponsor a charity fundraiser
party. Sac 1st Mortgage formed its charitable
foundation in 2003 specifically to help local real
estate charities and other community causes.

“Political Survival Fund” has been changed
and is now called the “REALTOR® Action
Fund” (RAF). Call them what you will,
the end game remains the same. Your contributions to the SAR PAC’s allow SAR

heard loud and clear in the County Building
and various City Halls within SAR’s
jurisdiction.

to act as a watchdog, identifying important
issues and helping develop the strategy to
deal with them.

The issues may have adjusted and
morphed over the years but the same old
political slogans that SAR chanted in the
80’s and 90’s still mean as much today
as they did then. Perhaps more. “Get into
politics or get out of business” and “If
you’re not part of the solution, you’re part
of the problem” are two of my personal
favorites. These were used many years ago
by REALTOR® organizations to motivate
their Membership to contribute to political
programs.

Twice a year, the Fed Chair speaks to the
House Financial Services Committee. Ben
Bernanke, who replaced Alan Greenspan,
delivered his first report on the state of the
economy. He indicated that more rate hikes
will be needed to keep prices in line. Even
though it appears inflation may be a concern, by managing it in this way, long term
rates actually stay lower.

and three or more persons are $89,740.00.
The maximum purchase price allowed in
Sacramento County is $429,620.00. You

CODE OF ETHICS ARTICLE 4
REALTORS® shall not acquire an interest in or buy or present offers from themselves, any member of their immediate
families, their firms or any member thereof,
or any entities in which they have any
ownership interest, or any real property
without making their true position known
to the owner or the owner’s agent or broker.
In selling property they own, or in which
they have any interest, REALTORS® shall
reveal their ownership or interest in writing
to the purchaser or the purchaser’s representative. (Amended 1/00)

REALTOR-ASSOCIATE® B, a sales
associate in REALTOR® A’s office, exclusively listed a suburban house and subsequently convinced the seller to accept
$20,000 less than the listed price. Several
weeks after the transfer to title, the seller
filed a written complaint with the Board,
charging REALTOR-ASSOCIATE B with
a violation of Article 4 in that REALTORASSOCIATE B had sold the property to his
mother without disclosing this relationship
to his client, the seller, and that REALTORASSOCIATE® B got the price reduced for
his mother’s benefit.
The complaint was reviewed by the
Grievance Committee which, with the complainant’s concurrence, named REALTOR®
A as an additional respondent.
At
the
hearing,
REALTORASSOCIATE® B stated that he saw nothing wrong in selling the property to his
mother and that the seller would have
accepted the contract at the reduced price,
even if the buyer had not been REALTOR-
ASSOCIATE® B’s mother. REALTOR®
A stated that REALTOR-ASSOCIATE®
B was an independent contractor licensed
with him. REALTOR® A acknowledged
that he was accountable under the Code
for the actions of other REALTORS® and
REALTOR-ASSOCIATES® associated
with him but shared with the panel information on his firm’s orientation program. He
noted that he required each licensee joining his firm to complete board-sponsored
Code training. In addition, he required
everyone in his firm to read Professionalism
in Real Estate Practice, and produced a
form signed by REALTOR-ASSOCIATE®
B stating that he had carefully read and
understood his personal obligation under
the Code of Ethics.
The panel found that REALTORASSOCIATE® B should have made his
relationship to the buyer, his mother, unmistakably clear to the seller. He should have
disclosed in writing that the buyer was his
mother so there would have been no misunderstanding.
The Hearing Panel found REALTORASSOCIATE® B in violation of Article 4.
The Hearing Panel noted that
REALTORS® are not presumed to be in
violation of the Code of Ethics in cases
where REALTORS® or REALTORASSOCIATES® associated with them are
found in violation. Rather, their culpability,
if any, must be determined from the facts
and circumstances of the case in question. It
was the conclusion of the Hearing Panel that
REALTOR® A had made reasonable efforts
to ensure that REALTOR-ASSOCIATE®
B was familiar with the Code and its
obligations, and that it would have been
unreasonable to expect REALTOR® A to
have known the purchaser was REALTORASSOCIATE® B’s mother. Consequently,
REALTOR® A was found not to have
violated Article 4.

health, SAR is excited to announce we
are hosting a health fair during the Main
Meeting on April 4th. It will be held in
the Mack Powell Auditorium at SAR from
8:30-11:00am (please note extended time).
We encourage all SAR Members to attend
and learn about numerous different health
issues, from keeping yourself healthy
to expanding research to curing deadly
diseases through donations. Some of the
many organizations that will be featured
include the Leukemia and Lymphoma
Society, the American Cancer Society,
Bloodsource, the California International
Marathon, the Susan G. Komen Breast
Cancer Foundation, and the American
Diabetes Association.

Insurance Services will also be present
for information regarding the insurance
policies offered to you as an SAR Member.
Members will also have an opportunity to
sign up on the SAR Team for the RACE
FOR THE CURE on May 13th 2006, a 5K
walk or run.
Health Fair featured speaker is Helen
Klein, an extraordinary 80-year-old athlete
who has completed 59 marathons and 132
ultra-marathons. Just last December she
shattered the world marathon best for her
age-group. Aside from that, she holds
many other race records. She is a great
inspiration to anyone interested in staying fit and healthy. Make it a point to hear
Helen’s presentation.
There will also be a blood drive during
the fair, which runs from 9:00am-1:00pm.
We encourage everyone to donate blood to
help those who need it, from accident victims to cancer patients, they will be thankful to know that someone cares. If you are
