A statewide initiative in the June primary would allow open primaries, and water bonds are on the November general election ballot. There is sure to be a great deal of shakeup in our local jurisdictions as well. Dave Jones is termed out after serving six years in the State Assembly. Running to replace him are Sacramento County Supervisor Roger Dickinson, Sacramento City Council Member Lauren Hammond, Sacramento City Council Member Kevin McCarty, and budget analyst Chris Garland. Jones would like to continue in public service, and is running for State Insurance Commissioner, a position currently held by Steve Poizner, who is leaving that seat to run for governor. This 9th Assembly District seat has a rich history in Sacramento. Jones was elected to this seat in 2004 when Darrell Steinberg, who is now Pro Tempore of the State Senate, was termed out. Both Jones and Steinberg started their political service on the Sacramento City Council. Dickinson is giving up his supervisorial seat to run for the State Assembly. Running to replace him is Grantland Johnson, who served on the Sacramento City Council and Sacramento County Board of Supervisors before serving as the Secretary of the California Health and Human Services Agency. Running against him is project manager Phil Serna, son of former Sacramento Mayor Joe Serna, Jr. Hammond is also giving up her council seat to run for the State Assembly. Running to replace her is education consultant and former Sacramento City Unified School District member Jay Schenirer. Running against him is Sacramento City School Board member Patrick Kennedy. Sacramento City Council member Kevin McCarty has a safe seat. Should he not win, he can hold his City Council seat until 2012. If he does win the Assembly seat, there will be a special election to replace him on City Council. The Sacramento Association of REALTORS® has a great working relationship with all of these individuals, and will continue to work with them in any capacity they serve. REALTORS® are sure to have a plethora of issues come before government in 2010, including income tax withholding and point of sale. 2010 REALTOR® Action Fund Investors (as of 01/27/10) Political success is paramount to REALTORS® ability to do business unhindered. In 2008, successful political campaigns saved REALTORS® in California an average of $12,303. Imagine if you were $12k short at the end of the 2008 fiscal year! Webb Linda Wood The mission of the Sacramento Association Government affairs and lobbying are a service that our national, state and local Associations provide you; a job that would be almost impossible for you to do on your own. Protecting private property rights and private property values, and protecting your ability to do business, underlie everything they work on. Caylyn Brown, the government affairs manager at SAR, and Eric Rasmusson, our political consultant, monitor every government body in the county from Citrus Heights to Elk Grove, from West Sacramento to Folsom, and all county offices. They keep their fingers on the pulse of what is going on so that we can address issues before they are enacted to our, or to our clients’, detriment. They work to mitigate the effects of some laws which would be far more onerous but for their efforts. Alex Creel and the other excellent state lobbyists at C.A.R., do the same for us at the state level. NAR works on national laws and with federal agencies. Although they are focused on issues concerning private property rights and values, they vet 1000s of laws and regulations that might affect us. They put forth our point of view. They protect our industry and our clients. Can we afford not to support these efforts? If we don’t, who will? It is very important that we all pay our fair share and support the Political Action Fund. We are each asked to invest $49 or better yet, the true cost of doing business, $197. But if times are too tough, how about $10 for every escrow each of us closes? Change is constant – market trends, construction and mortgage rates are a few of the many facets of real estate, of which REALTORS® are keenly aware. The political aspects of the industry can affect all involved, both positively and negatively. For this reason, it is crucial for associations to have a strong political presence in their jurisdictions. The group responsible for SAR’s political posture is the Local Candidate Recommendation Committee, or LCRC. The LCRC is part of CREPAC (California Real Estate Political Action Committee – the state version) and is composed of appointed politically-minded REALTORS®. This committee is key in making political decisions with the best interests of REALTORS® in mind. Regular updates from Eric Rasmusson, Legislative Advocate and Caylyn Brown, Government Affairs Director keep the LCRC informed of issues that could impact the local real industry. Through a process of interviews, the LCRC speaks with local candidates and decides on which candidate/issues to support. Through voluntary contributions, REALTORS® can invest in the REALTOR® Action Fund (or RAF). These contributions support local and state candidates who support private property rights and private property values. Allowing more families to become home owners and eliminating burdensome regulations that inhibit healthy real estate workers are the fundamentals issues. You can do your part by investing: standard investments of $49 are the most common, but the “true cost of doing business” is defined by the $197 investment. FEBRUARY 2010 Sacramento REALTOR® 3 ETHICS CORNER CODE OF ETHICS ARTICLE 4 REALTORS® shall not acquire an interest in or buy or present offers from themselves, any member of their immediate families, their firms or any member thereof, or any entities in which they have any ownership interest, any real property without making their true position known to the owner or the owner’s agent or broker. In selling property they own, or in which they have any interest, REALTORS® shall reveal their ownership or interest in writing to the purchaser or the purchaser’s representative. REALTOR-ASSOCIATE® B, a sales associate in REALTOR® A’s office, exclusively listed a suburban house and subsequently convinced the seller to accept $20,000 less than the listed price. Several weeks after the transfer of title, the seller filed a written complaint with the Board, charging REALTOR-ASSOCIATE® B with a violation of Article 4 in that REALTORASSOCIATE® B had sold the property to his mother without disclosing this relationship to his client, the seller, and that REALTOR-ASSOCIATE® B got the price reduced for his mother’s benefit. The complaint was reviewed by the Grievance Committee which, with the complainant’s concurrence, named REALTOR® A as an additional respondent. At the hearing, REALTOR-ASSOCIATE® B stated that he saw nothing wrong in selling the property to his mother and that the seller would have accepted the contract at the reduced price, even if the buyer had not been REALTORASSOCIATE® B’s mother. REALTOR® A stated that REALTOR-ASSOCIATE® B was an independent contractor licensed with him. REALTOR® A acknowledged that he was accountable under the Code for the actions of other REALTORS® and REALTOR-ASSOCIATES® associated with him but shared with the panel information on his firm’s orientation program. He noted that he required each licensee joining his firm to complete board-sponsored Code training. In addi- tion, he required everyone in his firm to read Professionalism in Real Estate Practice, and produced a form signed by REALTOR-ASSOCIATE® B stating that he had carefully read and understood his personal obligation under the Code of Ethics. The panel found that REALTORASSOCIATE® B should have made his relationship to the buyer, his mother, unmistakably clear to the seller. He should have disclosed in writing that the buyer was his mother so there would have been no misunderstanding. The Hearing Panel found REALTORASSOCIATE® B in violation of Article 4. The Hearing Panel noted that REALTORS® are not presumed to be in violation of the Code of Ethics in cases where REALTORS® or REALTORASSOCIATES® associated with them are found in violation. Rather, their culpability, if any, must be determined from the facts and circumstances of the case in question. It was the conclusion of the Hearing Panel that REALTOR® A had made reasonable efforts to ensure that REALTOR-ASSOCIATE® B was familiar with the Code and its obligations, and that it would have been unreasonable to expect REALTOR® A to have known the purchaser was REALTOR-ASSOCIATE® B’s mother. Consequently, REALTOR® A was found not have violated Article 4. Ethnic Chamber Mixers Organized Members are invited to join the Equal Opportunities Committee and the Russian American Media Group of February 25 for a mixer at SAR. Association of REALTORS® enjoyed a mixer at the SAR office on December 9, 2009, also organized by SAR’s Equal Opportunities Committee. By Susan Harrold I learned this news as I was interviewing Marge Reid of Lyon Real Estate. She qualified for this club in 1969, which was the first year she was in real estate. Soon thereafter, the name of the club was changed to the Masters Club because the public mistakenly thought the REALTORS® were earning one million dollars! also Lyon agents with over 20 years in the business. Marge has continued in her strong sales and has qualified for Membership every year. She spends 50-60 hours per week working and credits all of her business to her satisfied clients sending her referrals. She also gives back to the community by serving on the public relations committee at UC Davis Medical Center. Three of her family members are In her spare time, she enjoys golfing. For Marge, the real enjoyment of her long career in real estate is solving problems – she thrives on these challenges and says that the more complicated the problems the better. She hasn’t lost her enthusiasm for real estate even in these challenging times. Marge has 6 children and 13 grandchildren. Her goal has been to work hard so that she can plan family trips. Her favorite was a recent trip to Disneyland where she surprised everyone as 26 family members boarded a plane to spend Christmas at Disneyland. In a world where almost anything is a quick search and click away, it has become important for REALTORS® to keep an eye on how they are perceived online. How many times have you googled someone? Chances are they are googling you as well. With more and more real estate clients using the internet in their search for a home, it is a safe bet that they are doing just that: googling you! But do you know what they see? Once you know what is already out there, how do you keep on top of what is being posted? Well Google already has a solution: Google Alerts (http:// www.google.com/alerts) “Google Alerts are email updates of the latest relevant Google results (web, news, etc.) based on your choice of query or topic.” alerts where your full name appears. Otherwise Google will send you an alert any time either your first name or your last name appears anywhere on the Internet… which can be a lot! Next Google allows you narrow down what “Type” of alerts you are interested in receiving when it finds a match. You can choose between News, Blogs, Web, Video, Groups, or the all encompassing Comprehensive. Now depending on the “Search Terms” this can lead to a lot of emails very quickly! So Google gives you a choice of “How often” you would like receive a Google Alert. You can choose between “once a day,” “once a week” or if you really want to be on top of things “as-ithappens.” Bella Terra at Fiddyment Farms in Roseville To help you keep your email size manageable you have a choice of the “Email length” that you would like to receive. Currently you can choose to have Google send you up to 20 results in an email or up to 50 results in an email. searches for the “term”. Google doesn’t care what it is searching for just that it found a match. It may be handy to setup another alert with information that is unique specific to you, an email address for example. After you have made your choices all that is left is to enter the email address you want to have the alerts sent to. Now just click the “Create Alert” button and you are almost done! Another consideration for setting up alerts on your name or company is if they are commonly misspelled. You may want to consider setting up a separate Google alert for the misspelling of the name as well. Google will send you a “Click to confirm your Google Alert” email, where you can click a verify link or you can cancel your request if you change your mind. Our Association lost an unusually high number of long-time Members recently. We will miss them all. Evelyn Morgan, Coldwell Banker Born in Crowley, Colorado, Evelyn passed away quietly on December 10th after a brief battle with pneumonia. Her 97 years touched, enhanced and inspired the lives of many. She will best be remembered in Sacramento for her remarkable 34 years of service as a REALTOR® with Coldwell Banker in the Sierra Oaks office. She started at age 59, won all four top awards for CB Northern California at age 71, and didn't retire until age 94. She was proud also to be President of the Women’s Council of REALTORS®. Her strength and success stemmed from true compassion for others and living each day of her life based on the Golden Rule. A memorial service was held on January 14. (Adapted from sacbee.com) Alice Judish Murphy, Realty World-Sterling Calif. Alice joined SAR in 1998 and had worked for almost 30 years as an agent and resource coordinator. She had been retired for a short time, spending time with her granddaughters, doing arts and crafts and cooking. Family and friends remembered Murphy on January 9. Tragically, Murphy was murdered in her Folsom home on December 21. Her attacker remains at large. Dick Shelton, Dick Shelton Investment Properties Dick Shelton was a well-respected and highly professional real estate broker who actively participated in the Association. He joined SAR nearly forty years ago. Shelton taught real estate for years and eagerly mentored those new to the business. Last year, he shared his experience and knowledge during a SAR Broker Training Institute panel designed to acquaint new brokers with the realities of managing an office. Shelton also served on several SAR committees and was a Masters Club Past President, as well as one of the founders of the annual Masters Club Golf Tournament. He loved the outdoors and could frequently be found golfing, fishing and hunting. Friends and family attended Shelton’s memorial service on January 21. Lee Storms, JSL Real Estate Services Lee Storms, Broker, GRI, had been in the Real Estate industry since 1965 and an Association Members since 1966. He owned Red Carpet/ Lee Storms Properties, Lee Storms Property Management and was coowner of JSL Real Estate Services, Inc. As a longstanding SAR Member, Storms achieved the 40-year Emeritus Award from SAR. Lee Storms held a general contractor license in the state of California from 1979 until July 2009 and had over 25 years of experience in building and rehabilitation of properties. He passed away during the first week of January and services were held January 16. Sue Vogel-Heaney, Prudential Dunnigan RE Sue Vogel-Heaney had been an SAR Member for more than 25 years. About 9 years – as long as I’ve been in real estate. 2. What did you do before you were in real estate? I was a sales manager for companies like Brita Water Filters and Bausch and Lomb. And, I was Director of e-Commerce for a gourmet cookware company – right before the dot-com implosion. 3. What do you like best about being in real estate? Real estate has very personal results. When I solve a problem for a client, or negotiate an important agreement, the results are very visible and personal. There’s a bit of psychology in there, too, that gets my attention. 4. How have you adjusted to changing market conditions in the past couple years? Have I? I see the changing market as a good opportunity to work more with the Association and improve my skills and education. I went to grad school and earned an MBA. I’ve chaired the Education Committee, the Fall Conference Committee, been in the Leadership Series, taught some classes, participated in SAR’s strategic plan, and ran for a position on the Board. I find the work very rewarding, and I really enjoy working with the people who make SAR the great organization it is. 5. You are new to SAR’s Board of Directors. Why did you decide to join the Board? During grad school, I became most interested in the subject of leadership, which is both art and science. SAR had just launched the Leadership Academy, and I was immediately attracted. The Board of Directors position was a natural extension of my interest in leadership and strategic planning. I didn’t really want to campaign against other very successful candidates; I was really humbled by the amount of talent that ran for the office. But, I had a lot of support from people who knew me and a very supportive company, and here I am. 6. What have been some of your favorite programs/committees/activities at SAR? The Education Committee is an incredible group to be with. We launched several programs last year which led to a 75% increase in attendance, teaching more Members than ever at SAR, without losing money. We had ambitious goals, but with a lot of creative thinking and a real dedication to “member value,” we found the right mix of subjects and programs. And the staff, Judy and Chris, really know what they’re doing. It was very exciting to chair that committee. And they’ve got great leadership again this year. 7. Technology has changed a lot in recent years – how have you kept up-to-date? A lot of technology is just plain fun – I have about 12,000 songs on my iPod. And much of technology leads to more efficient business practices, like ZipForms® 6. Once you learn the general architecture of the web, and of software, it’s much easier to learn the “next best thing.” SAR provides a lot of support in learning about real estate technology. FEBRUARY 2010 8. Words of wisdom for your fellow REALTORS®? I don’t know that I’m qualified to advise my colleagues, but I do think that product quality and customer service are the most important characteristics in any sustainable business. The happy and successful REALTORS® I know are unselfishly dedicated to their product (professionalism) and to serving their clients. Following that model is, in my opinion, the best road to sustainable success. 9. Hobbies or other activities? I spend a lot of time rock and ice climbing, cycling, endurance running, and going on long road trips and camping with my family. We have a 4-wheel drive “adventure” van that we spend a lot of time in. We’re pretty active in the outdoors. 10. How long have you lived in Sacramento? I was born and raised here, but my corporate career took me to Denver, LA, and the Bay Area before returning to Sacramento in 2000. 11. What are some of your favorite places to visit? My wife, daughter and I recently built a cabin near Donner Lake. That’s destination #1. I also go to Yosemite about a dozen times each year. And Las Vegas is another favorite because it has Red Rocks, one of the best climbing areas in the country. And I love small towns that nobody knows about, like Joseph, Oregon. 12. What would you do if you weren’t a real estate professional? I’d be teaching business to college students, without a doubt. I’ve taught classes at SAR, and guest lectured at the CSUS MBA program. It feels like a very good use of my business experience to help others develop and improve their business skills. 13. What’s a good book you’ve read recently? The Fountainhead by Ayn Rand. Her philosophy of objectivism appeals to me. 14. What would people be surprised to learn about you? I’ve climbed El Capitan (in Yosemite) four times, and Half-Dome three - the hard way, spending as many as four nights sleeping on the rock. Even when I look up and watch climbers up there, I think “those people are crazy.” But when it’s me and my climbing partner, it feels very sane and rational. It’s a very intense partnership to rely so intimately on each other’s skills. We have plans for a couple of more routes on El Cap, so I hope to get up there soon (when the weather improves!). Compared to last year, sales are down 8.1% from the 124 units sold in December 2008. REO properties made up 45.6% (52) of all sales while short sales accounted for 28.1% (32) Condominium Resale Market March Calendar 9 December’s median sales price increased slightly monthto-month, from $187,000 to $187,500, a .3% change. Conventional sales rounded out the remainder of the total, accounting for 26.3% or 30 sales. The condominium median sales price increased remained static month-to-month from at $100,000. This current price is up 7.5% from the $93,000 median sales price of December 2008. The total listing inventory increased 3.6% month-to-month from 495 listings to 513 listings. Compared with the total closed escrows, the total listing inventory represents 4.5 months of inventory in the local condominium market. this month, 177 (10.7%) had 2 bedrooms or fewer, 842 (51.1%) had 3 bedrooms, 495 (30%) were 4 bedroom properties and 130 (7.8%) boasted 5+ bedrooms. After a month-to-month decrease, sales rebounded in December, increasing 14.5% with 1,648 units sold – 209 more than November. Year-to-year, however, the current figure is 14.7% below the 1,932 sales of December 2008. Bank-owned properties continue to make up a majority of home sales, with 671 units – or 40.7% of the total sales attributed to REO units. The remainder of the sales was composed of short sales (24.5% or 403 units) and conventional sales (34.8% or 574 units). When compared with November, REO sales remained stable, while short sales showed an increase. Conventional sales showed a decrease, most likely attributed to homeowners taking their homes off the market. INSIDE December 2008, the second month in a row there has been a year-to-year increase in median sales price. Total listing inventory increased month-to-month (5,096 to 5,425), but decreased 16% from the 6,462 Total Listing Inventory of December 2008. The Housing Market Supply figure decreased slightly from 3.5 months November to 3.3 months this month. This figure is even with the Housing Market Supply figure of December 2008. This figure represents the amount of time – in months – it would take to deplete the total listing inventory given the current rate of sales. According to MetroList® MLS data, the average home spent 52 days on market (from the time it was listed to the time escrow was opened) and was 1,728 square feet.
