AUTHORITY The rules and regulations for MOTT-SMITH LANILOA are based on the following documents: I. Chapter 514A of the Hawai'i Revised Statues, "Condominium Property Act" is the basic condominium law, Important in the document are the provisions that all persons who enter upon and use the project must obey the provisions of the I)eclaration, the By-Laws, the I-louse Rules and all other lawful determinations of the Association. 2. The Association By-Laws provide that the Board of Directors may adopt House Rules that are binding upon all residents, mortgagees, tenants, occupants and any other persons who may use the property. The By-Laws also provide that these rules may be modified and amended at any time by the Board of Directors. 3. These [louse Rules are supplementary to and not an exclusive or exhaustive list of the limitations and restrictions set out in the Declaration and By-laws governing the use of the project. DEFINITIONS RESIDENT A person living at the MOTT-SMITH LANILOA TENANT Any person renting or leasing an apartment at the MOTT-SMITH LANII.,OA GUEST Persons who are on the premises for a period of time at the invitation of a resident. All guests must be registered with the Resident Manager's/Security office. They are subject to all rules and are required to check out upon departure. VISITOR Person-who is on the premises with the permission of ,eresident. AGENT Any Hawai'i licensed real estate broker, salesperson, company or individual who is empowered to act on behalf of any owner and has provided the Association with evidence of that authority. ASSOCIATION OF APARTMENT OWNERS(AOAO) All the owners acting as a group in accordance with the By-laws and the Declaration of Condominium Property Regime (CPR). BOARD OF DIRECTORS The Board of Directors is comprised of (9) persons duly elected to represent the Association of Apartment Owners in all matters relating to the operation of the property and has the power to suspend or amend these rules in the interest of furthering harmony MANAGING AGENT The management firm under contract to the Owners Association responsible for the management of the project. RESIDENT MANAGER The person authorized to exercise the duties set forth by the Board of Directors under the supervision of the managing agent including enforcement of all rules. OCCUPANCY AND USE OF THE PROJECT A. Apartments 1. All residential apartments shall be used only as private dwellings and shall not be used for business or other purposes. The owner shall not use (or permit the use of) his/her apartment for any purpose that will injure the reputation of the building or project. Such owner shall not suffer anything to be done or kept in the apartment or elsewhere on the project which: will jeopardize the soundness of the project; will interfere with or unreasonably disturb the rights of other residents; will obstruct the common hallways or stairways of the building; will increase the association's fire insurance or reduce the value of the building. 2. The apartments shall not be rented for transient or hotel purposes which are defined as (a) rental for any period less than six consecutive months, or (b) any rental in which the occupants of the apartment are provided customary hotel services such as room service for food and beverage or bellboy service. 3. No one without the prior written permission of the Board of Directors or Resident Manager is permitted to display any signs, poster, printed material or any device in or upon any door, window, wall or other portion of the premises, including lobby directory, or otherwise so as to be visible from the interior/exterior of common areas. 4. Apartment owners shall not remove the acoustical ceiling material in such owner's apartment without giving ten (10) days' written notice to the Board of Directors, together with a description of the method of removal to be used, the dates on which the work will be done, the name of the company contracted to do the work and such other information as the Board shall request. No work shall commence without prior written approval from the Board. Approval will in all cases be subject to monitoring and/or inspection, for which, procedures have been established and will be administered by a private consulting firm selected by the Board. The fees of such firm shall be paid by the apartment owner and approval shall be conditioned by the apartment owner's agreement to pay such fees, 5. No changes or renovations of any type (excluding painting and redecorating shall be permitted in a unit without prior approval and written consent of the Board of Directors. Ceramic tile and other hard surface flooring material may be installed ONLY on front door entrances, kitchens, bathrooms and lanais. Floor plans of each unit type may be obtained from the Manager's Office, which are highlighted to indicate the only areas that may have hard floors. 6. Requests for modifications must be submitted to the Board of Directors for approval with detailed plans and specifications prepared by a licensed architect in conformance with existing building codes and local ordinances and be accompanied with the owner's written request for approval. The Board of Directors reserves the right in all instances to have an inspection by a licensed contractor, licensed architect, and/or building inspector performed at owner's expense 7. Any contractual work to be conducted must be scheduled at least three (3) business days prior to the start date through the Manager's Office. Contractors name, license number and approval letter as outlined in Section A, paragraph 6, must be provided. Written details of work to be done including any maintenance items must be provided. 8. All residents shall avoid excessive noise of any sort and consideration for other residents at all times. aintain respect and 9. Radio. TV, stereos, musical instruments, tape recorders, etc. must be played so as not to unreasonably disturb residents of other apartments at any time. Particular attention must be paid to volume between the hours of 10:00 pm. and 8:00 a.m. B, Common Areas 1. NO sign, poster, advertisement sign or lettering of any type shall be placed on any part . . of the common elements or the building. 2 NO projections shall extend through any door or window opening into any corridor or beyond the exterior face of the building including lanais. 3. NO radio, Satellite dish or TV antenna shall be erected or maintained outside of the physical confines of any apartment. 4. NO additions, alterations or modifications to the original design of the apartment will be permitted which are visible friom the exterior of i h I !;j 5. The sidewalks, passageways, stairways and corridors must not be obstructed or used for any purpose other than ingress and egress. 6. Entrance to and exit from property shall be through established entrances and passageways only (see paragraph 7 below). 7. Fire stairwell exits should not be used as aroutine means of entering/exiting the building except for emergencies or in the event of a power failure or mechanical breakdown. 8. Smoking in the elevators, hallways, stairwells and in all lobbies (main building entrance on 411, floor, P-1, P-2 & P-3 parking level lobbies) is expressly prohibited. II. GENERAL A. No vendor shall be permitted to work in the building prior to 8:00 a.m. or after 5:00 p.m. (Monday - Saturday) except in an emergency. B. Only emergency repairs will be permitted on Sundays and holidays. C. Each apartment owner shall be responsible for the conduct of his/her lessees, renters, or guests and shall upon the request of the Board of Directors, Managing Agent or the Resident Manager, immediately abate and remove, at his expense, any structure, thing or condition that may exist with regard to the occupancy of his apartment by his lessees, renters, or guests contrary to the interest and meaning of the provisions herein; or, if the apartment owner is unable to control the conduct of such persons so as to conform with the interest and meaning of the provisions hereof, he shall upon the request of the Board of Directors or the Managing Agent immediately remove such lessees, renters, and guests from the premises without compensation for lost rentals or any other damage resulting there from. D. All owners shall be responsible for designating a local agent to represent their interests if their residence is outside of the isanti of Oahu or if they will be absent from the apartment for more than 30 days. Such owners shall file with the Resident Manager their out-of-town address and telephone number and the name and telephone number of their agent. E. The hallway side of each apartment door shall remain free of any personal property including footwear of any type. E The use of any type of fireworks is expressly prohibited throughout the project, G. All garbage deposited in the trash bins must be securely wrapped. H. No bulky or inflammable objects shall be placed in the trash chtte. Boxes, glass, newspaper, plastic and aluminum cans shall be disposed of in the appropriate recycling containers (located on P-1, P-2, P-3) and shall not be put down the trash chute. I. Use of the trash chute should be limited to the hours posted. J. Feeding of birds (doves, pigeons, etc.) from the common areas and/or lanais is prohibited. K. Waterbeds that are not self contained are prohibited. L. Residents are responsible for ensuring that entry/exit doors are secured after entering or exiting. Residents should take care not to let unknown persons into the building. M. Furniture placed in common areas by Mott-Smith Laniloa Management for specific use may not be removed. N. All apartment owners shall observe and conform to these rules and ensure that their lessees/ renters and their guests also observe and abide by these same rules. Residents will be responsible for their guests' observance of all House Rules as set forth herein. In the event expenses are incurred due to violation of the House Rules by guests or licensees lessees, the owner shall be responsible for payment of such charges. 0. All driveways, corridors, and walkways are to be used for purposes of ingress and egress only, and shall not be used for recreational purposes of any nature whatsoever. P. Bicycles shall be serviced only in designated areas. Surfboards shall be not transported in the elevators, stairwells, or main lobby areas of the building. Q. Bicycles and surfboards shall not be stored within the common elements except in the following designated locations; (a) bicycles may be stored within the resident's assigned parking stall(s); (b) bicycles may be stored within any of the three (Parking levels P-I through P-3) specifically designated bike storage cages; and (c) surfboards may be stored in special racks provided in the parking level elevator lobbies. All surfboards must be secured with the use of a padlock. III. ADMINISTRATION A. All residents are required to register with the Resident Manager's office prior to their initial move-in. Residents will be required to fill out a Resident Registration Form and provide complete and accurate information as requested. B. Residents may schedule the use of the elevators for move in/move out, deliveries or removal of bulky items on a first come, first serve basis. All reservations must be made a minimum of 48 hours in advance except in emergencies that will be determined at the sole discretion of the on-duty security personnel. Reservations can be made through the Security staff in person or by telephone at 523-1794, Monday through Friday, from 8:00 a.m. to 5:00 p.m. and on Saturdays from 8:00 a.m. to 12:00 p.m. Moving hours are 8:00 aim. through 4:00 p.m., Monday through Saturday. There will no moving allowed on Sundays or holidays. C. There is a $75.00 move-in/move-out fee charged for all residents payable in advance. D. Use of the "Association" dolly/push cart is authorized from 8:00 a.m. to 10:00 p.m. daily, however, during non-moving hours, use shall be limited to three (3) loads per household. E. Mott-Smith Laniloa residents shall not request employees to perform personal errands or any work within the area of any private apartment, or ask any employee to leave the premises for any reason during his/her regular scheduled duty hours. Requests for work/services for building related matters must be made in writing directly to the Resident Manager. E Personal property such as flowers, gifts, messages, etc. may not be left with security personnel or left at the Resident Manager's office for pick up by others. G. Residents and/or their guests shall at no time interfere with or impede association employees in the completion of their assigned duties. H. Residents should direct any comments or complaints to either the Resident Manager and/or the Board of Directors. Written comments may be put in the suggestion box located by the mailboxes. I. Residents are expected to conduct themselves in a mature, civil manner. Rude, disrespectful, or obscene behavior will not be tolerated. IV. PETS A. No animals whatsoever shall be allowed or kept on any part of the project except small domestic birds, fish, trained guide dogs, signal assistance animals or those pets grandfathered in by April 19, 1993 document amendment. Residents are responsible to ensure that all established rules and/or conditions/stipulations are strictly followed. B. Dogs must at all times be maintained on a leash when located within the common elements (outside of the living unit) and shall be accompanied by a resident to whom they belong. All pets must be carried/held while in the elevators and. may not be transported through the lobby. C. In the event that the resident is unable to ensure the safety and quiet living of all other MottSmith Laniloa residents, the Board of Directors, at their discretion reserves the right to have the offending animal removed from the premises, with or without the right of replacement. D. Residents are responsible for the cleaning of their animals' excrement on building grounds. All excrement must be double bagged before being thrown. down the trash chute. E. All residents maintaining pets on the premises must ensure that their animal is properly licensed and tagged in accordance with city, county and state laws. This includes all required shots and vaccinations, and must be properly documented. F. All unit owners must ensure that residents maintaining pets provide: (I) a signed statement acknowledging that they have read, understand and agree to abide by these rules; (2) provide a written description and color photo of the resident's animal, and (3) copy of the documentation outlined in paragraph EB above. G. Upon registering your animal with the Manager's Office, an identification tag will be issued for your animal (except birds/fish). rlis tag must be worn or located on the registered animal when outside of the apartment. H. Visiting pets are not permitted at any time. I. Pets are not allowed on the 41, floor recreational deck area. (See IV Recreational Amenities). V. LANAIS A. Only furniture and small potted plants appropriate to the lanais of the apartments may be used or kept thereon. Any furniture, plants, or other articles, which are unsightly in the opinion of the Resident Manager, shall be removed upon request. B. Lanais shall not be used for unsightly storage purposes of any kind. C. Appropriate banners commemorating holidays or festivals may be displayed from lanais on holidays. The United States and Hawaii State flags may be displayed at all times. D. Textile items including towels, bathing apparel and clothing, brooms, mops, cartons, etc., shall not be placed on lanais, railings, passageways or in windows so as to be in view from outside the building or from the apartment above. E. All plants shall be placed in containers so as to prevent the dripping of water or soil onto other apartments or the common elements. When cleaning lanais, residents shall prevent water run-off onto other unit lanais and to the exterior surface of the building. F. Canvas awnings shall be properly secured to avoid banging and/or pounding against the building or lanai railing. Awnings must be removed as they wear out, New and/or replacement awnings must comply with preapproved design and type (metal awning). G, NOTHING SHALL BE THROWN FROM LANAIS, WINDOWS OR DECKS. CIGARETTES AND MATCHES SPECIFICALL Y PRESENT A MAJOR HAZARD. H. Cooking on lanais is expressly forbidden. VI. RECREATIONAL AMENITIES A. General Use 1. Use of all recreational facilities on the fourth floor of the building shall be limited to residents and their guests. For the purpose of determining eligibility to use recreational facilities, when the apartment is occupied, the privilege of using the facilities will transfer to the occupant, and a non-resident owner will forfeit his privileges. Non-residents may not use the recreational facilities unless accompanied by a registered resident of the building. 2. Residents are responsible for notifying their guests that there is no pool attendant provided by the Association, and that users of the swimming pool, wading pool, and spa do so at their own risk. 3. The recreational facilities may be used during the posted and/or designated hours as identified herein. Such hours may from time to time be modified by the Board. 4. There shall be no playing ball or throwing of objects at any time. The use of profanity and excessive loud or boisterous behavior of any kind is strictly prohibited while utilizing the recreation facilities. 5, Use of skateboards, roller skates, or similar devices are not permitted. 6. Pets (except trained assistance animals relied upon by handicapped persons) are not allowed in the area of the recreational facilities at any time. 7. On the occasion of an event involving children, one (1) adult must be present to monitor activities for every five (5) children. This is to include non-scheduled events such as swimming, playing tennis or any activity on the fourth. floor recreation area. B. Tennis Court 1. Hours of play are from 7:00 a.m. to 8:00 p.m. daily. 2. Only resident occupants of Mott-Smith Laniloa may sign up for use of the tennis court. 3. A resident may not sign up for another resident, unless that other resident is an occupant of the same apartment. 4. A reservation should be cancelled immediately if the reservation cannot be kept. Cancellation may be made through the office or security guards. 5. Only non-marring rubber soled tennis shoes (no slippers) are permitted on the tennis court. 6. The tennis court will be used only for playing tennis and not used for any commercial purposes. 7. Hitting tennis balls against walls and fences shall not be permitted anywhere on the premises. C. Swimi-tung Pool/S _a 1. NO LIFEGUARD IS IN ATTENDANCE. PERSONS USING THE POOL/SPA DO SO AT THEIR OWN RISK. 2. The swimming pool and spa facilities will be available for use during the following hours of operation: OPEN 6:00 a.m. to 7:00 am. CLOSED (MAINT.) 7:00 a.m. to 8:00 a.m, OPEN 8:00 anm. to 10:00 p.m. CLOSED 10:00 p.m. to 6:00 a.m. 3. Residents are responsible for the supervision of all non-swimmers, 4. Bathers must shower before entering the swimming pool/spa and must dry thoroughly before entering the building. 5. Flotation gear and toys are not permitted, however, swinmers may use water safety devices such as water wings, flotation rings, etc, Snorkels, masks, and/or goggles are permitted for use by swimmers. Swim fins may only be used for health reasons. 6. Proper swimming apparel is required when using the pool/spa. Hairpins, bobby pins and curlers can clog and mar the pool and must be removed before swimming or using the spa. 7. Pool furniture will be utilized for its original designed purpose and may not be remo ved from the pool area. 8, No food is permitted in the pool area. Beverages in non-breakable containers are permitted but must remain a minimum of six (6) feet from the edge of the pool. No breakable containers of any type are permitted within the pool/spa. 9. The consumption of alcoholic beverages is prohibited at all times. 10. Emergency equipment and cleaning devices are to be used for their designated purpose. 11. No person with open wounds or bandages or with any disease generally accepted by the medical community as communicable may use the pool/spa. 12. All suntan oil must be removed from the body and swimming apparel before entering the swimning pool/spa, 13. The pool/spa facilities are intended for use by all residents and may not be reserved for exclusive use. Residents are permitted no more than two (2) guests, provided the rights of other residents are not inconvenienced. No resident shall take more than two guests into the pool area without prior written approval from the Resident Manager. 14. All guests must be accompanied by a registered resident at all times while in the pool area. 15. Smoking within the pool/jactizzi area(s) is restricted and shall be permitted in the designated location (see diagram 1-1 for detailed drawing of smoking area). All smokers are required to utilize the provided receptacles when extinguishing their cigarettes. Also, there will be NO smoking whatsoever allowed in the wading pool area. 16, Please shut the jacuzzi off after use. D. Wading Pool 1. Flours of use are from 9:00 am. to 7:00 p.m. daily. 2. Use of the wading pool should be limited to children, 12 years old and under. 3. Other rules as stated in paragraph C above apply 4. Swimmers in diapers must use appropriate diapers i.e. Little Swimmers. E. Shuffle Board 1. Flours of usage are from 10:00 a.m. to 6:00 p.m. daily. 2. Residents and their guests who wish to utilize the shuffleboard court must provide their own equipment. F Barbecue Areas 1. The barbecue areas on the recreation deck are available for residents' use. Grill users are requested to complete their cooking by 9:00 p.m, and ensure that the gas is turned off. 2. Residents should take care to follow the published operating instructions as indicated. 3. Grills must be cleaned after use by wire brush and/or scraper provided. G. Pavilion 1. The pavilion may be reserved at the Resident Manager's Office, on a first come, first serve basis by signing up in advance, (not less than 48 hours but no more than 30 days in advance) and leave a deposit of $50.00 at the Resident Manager's office. The deposit will be refunded upon request the following business day provided the pavilion was cleaned and returned to its original condition. Available times for reservations are 9:00 a.m. to 3:15 p.m. and 3:45 pn.m to 10:00 pm., Sunday through Thursday; 9:00 aam. to 3:45 p.m. and 4:15 p.m. to 11:00 p.m. Friday, Saturday and day preceding a holiday. 2. Residents are required to notify security or the Resident Manager prior to leaving, so that a final inspection of the facility may be conducted. 3. Hours for the use of the pavilion are from 9:00 a.m. to 10:00 p.m. Sundays through Thursdays; 9:00 a.m. to 1 1:00 p.m. on Fridays and Saturdays and any day preceding a holiday. 4. Residents who reserve the pavilion are reminded that all other rules provided herein are applicable at all times. H. Recreation Deck Use of the recreation deck shall be from 8:00 am. to 10:00 p.m. Sundays through Thursdays, 8:00 a.m. to 11:00 p.m. on Fridays, Saturdays and any day proceeding a State or Federal holiday. VII. PARKING AREAS A. Each apartment has an appurtenant parking stall(s) and residents may not use other than his or her stall(s) at any time without prior permission. B. No vehicles may be parked or left unattended at the lobby entrance, the various entry driveways or passageways. C. Guest parking stalls shall not be used for more than five (5) hours during any single occupancy. Upon the expiration of the five- (5) hour limit, guest must re-register their vehicle at the security desk. EXCEPTION: In the event guest parking facilities are being utilized near maximum capacity, and at the discretion of the Security Officer on duty, management reserves the right to prohibit guests from re-registering for a second five (5) hour period. Guests must immediately remove their vehicle from guest parking facilities or be subject to towing at the expense of the vehicle owner. This will allow all guests a fair and reasonable opportunity to utilize the guest parking facilities. D. Guest parking stalls are for exclusive use of guests, Residents are responsible for informing their guests of all applicable rules and to register their vehicle with the Security Office. E. Guest must register their vehicles at the security desk and ensure that complete and accurate information is provided on the sign-in sheet. F. Automobiles parked in Guest Parking or in a common element in violation of these rules are subject to towing at the owners' expense. C When service vendors require parking and will be performing work at an individual apartment for a period which exceeds two (2) work days, the owner shall advise them to use his/her parking stall or park on the street. .11. Automobiles shall be parked between the designated parking lines and vehicles shall not go beyond the end of the parking stall stripes so as to protrude into the common elements. I. Residents shall enter and leave vehicles parked in parking stalls in a manner so as not to damage vehicles parked on either side. All vehicles must be pared in the center of the stall so as to not impede surround vehicles or passing traffic. J. Only minor repairs to authorized automobiles, motorcycles, and/or mopeds will be permitted within the parking structure. No mechanical work will be performed on boats, surfboards or other equipment while in the parking structure. K. No inflaninmble oils or fluids such as gasoline, kerosene, naphtha, benzene, or other explosive or volatile articles shall be stored in the parking areas. L. All residents shall keep their respective parking stalls free of oil, grease, or other slippery substances. In the event a resident is issued a citation and requested to clean their perspective stall, all residents will be given seven (7) days in which to remedy such. If after seven days, said violation still exists, the Resident Manager will have said stall cleaned by maintenance personnel or by private vendor and a $25.00 charge will be assessed against the unit and the responsible resident/owner will be charged. Cleaning materials will be made available to all residents at no charge for their use in performing said maintenance. M. Visitors of residents who commute via bicycle will be permitted to park their bikes in a designated parking area on the guest parking level. Bicycles using guest-parking facilities must be properly licensed and adhere to the same rules as all other vehicles. N. The speed limit in all-parking areas and driveways shall be no more than 5 M.PH. Residents must comply with the designated traffic pattern. 0. All vehicles in the parking areas shall have current registration and safety stickers and shall be in operating condition. Small trailered boats may be parked in the stalls provided they are in operative condition and the boat displays current State of Hawai i registration stickers. No other items of personal property whatsoever shall be left or stored in the parking stalls. P. Parking levels P1, P2, and P3 include a resident car wash facility, which may be utilized between the hours of 8:00 a.m. and 8:00 p.m. daily. The use of these facilities by nonresidents is strictly prohibited. FINE SYSTEM The following is intended to provide a basic guideline for the application and use of fines imposed against residents found in violation of the Mot-Smith Laniloa Association House Rules. Subparagraphs 1 through 4 specify those circumstances in which fines may be imposed. 1. House Rule Violations, which cause damage or pose a threat to life, limb, and/or property. 2. Any resident who has been formally cited (in writing) three or more times within a one-year period, for the same type of violation. 3. Any resident who refuses to comply with the Association House Rules after verbal warning is issued by Security Personnel or the Resident Manager. 4. Residents who demonstrate or partake in verbally abusive or intimidating behavior toward any staff member or contracted vendor by this Association. Any violation described in paragraph I above will be subject to an immediate fine of $100.00 and/ or additional legal action, which may include eviction from the project. After the first fine for any violation described in paragraph I through 4, each subsequent fine will be increased by an additional $25.00. Only the Property Manager, Resident Manager, and Acting Resident Manager have the authority, but not the obligation, to issue fines. If you receive notice that a fine has been levied against you, you may appeal the fine by requesting an appeal in writing to the Board of Directors within fifteen (15) days of the date of the notice of the fine. In your written request, you shall indicate whether you want to make a personal presentation or whether you want a decision to be made without you present and based on written materials. Failure to request to make a personal presentation if the written request for an appeal shall be deemed a request for the appeal to be decided without you present. If you do not request to make a personal presentation, you should enclose with your request for appeal, a statement of facts, affidavits of witnesses, or any other written materials you wish to be considered in deciding the appeal.
