MCL 28.243 – Required to Print
Law Enforcement agencies are required to submit prints for:
• Felonies.
• Misdemeanors – 93 days confinement and above (except DWLS 1st
offense).
• 90-Day Misdemeanors that require DNA collection –
MCL 750.1671B – Common Prostitute;
MCL 750.1671C – Window Peeper;
MCL 750.1671F – Obscene Conduct;
MCL 750.1671I – Loitering at House of Ill Fame.

• Protection order violations.
• Local ordinance violations that “substantially correspond” to any of the
above state mandatory-reporting offenses.

• MCL 257.9041B – DWLS 1st offense.

Law Enforcement agencies shall NOT submit arrest prints for:
• Misdemeanors – Motor Vehicle Code violations punishable by 92 days
confinement and below.
• Juvenile status offenses.
• Local ordinance violations that “substantially correspond” to one of the
above state disallowed reporting offenses.
• Local ordinance violations that do NOT correspond to any state
offense.
• Bench warrants, hearing dates, and probations violations – if prints
were already submitted for the case.

Live Scan Fingerprinting
• Live Scan fingerprinting biometrically verifies a subject’s identity.
• Begins an arrest build on the Criminal History Record (CHR) system.
• Searches the latent database for prints related to unsolved crimes.
• Performs Identification-Only queries to verify identity.
• Creates a Transaction Control Number (TCN).
• Transmits fingerprints and arrest data to the Michigan State Police
(AFIS), Federal Bureau of Investigation (IAFIS), and the U.S.
Department of Homeland Security.

• In the LOOP pattern there are two focal points: The CORE, or the
center of the loop, and the DELTA. The delta is the area of the pattern
where there is a triangulation or a dividing of the ridges. When
recording fingerprints, the delta and the area between the delta and the
core must be completely recorded.

Palm Prints
• If your agency has palm print capabilities, then you are required by law
on all Live Scan arrest transactions to submit palm prints.
• Palm prints are not required by law on applicants, but are highly
recommended.
• Left and right upper palms and fingers.

Annotating Prints
• Annotation of fingerprints is when you document that it is physically
impossible to capture fingerprints on a subject.
• Reasons to annotate include:
– Amputated fingers/hand
– Claw Grip
– Arthritic
– Drug use
– Occupational reasons
– Injured/bloody/bandaged
– Overactive sweat glands

• RI-7 Michigan Arrest (MSP warehouse)
• Contact FBI to get blank card stock.
• Do not need to use card stock – can use plain paper.
• Can still mail in copies of print cards and we can manually enter arrest
information; however, we are discouraging this and only allow if
NEEDED.

• Also known as Complaint #, Arrest Case #, Police Incident Number (PIN)
• OCA on prints must EXACTLY match number given to prosecutors and courts

Fingerprints
• One set of prints can be used for up to 15 different arrest charges with
up to 99 counts of each of the 15 charges.
• Cannot add arrest data to subject’s record without a set of prints to
document that arrest information.

Do Not Build Arrest Segments for the Following:
• Hearing Dates
• Probation Violations
• Bench Warrants (if the original arrest was built)
– On LEIN Warrants enter ***PNT*** if prints need to be taken on
out-of-custody warrants, thus notifying the correction staff that
prints need to be taken.
– At any time a Live Scan agency can run an “ID-only” on a subject
to determine if an arrest has been built or to determine a subject’s
arrest history.

• MAC – Michigan Arrest Code – Similar but not the same as MICR
codes
• PACC – Charge codes created by the Michigan Prosecuting Attorneys
Coordinating Council – These are the most specific CTCs
• AFC – Arrest File Class – 50 codes total and the least specific
• Without a criminal tracking number (CTN) only the AFCs will be
retained in the CHR system.

Violating a PPO
• Violation of a personal protection or foreign protection order is a
printable offense.
• Many judges do not want their protection order violators printed, so
check with the courts in your jurisdiction to see what their policy is.
(Oakland County does want theirs printed.)
• Build the arrest/charge with complaint number.
• Notify the court of the TCN/OCA from the arrest build.
• This is not the same as a bench warrant/failure to appear.

Ordinance Violations
• When submitting prints, use “NTA – Notice To Appear” as the arrest
disposition and do NOT include the County Prosecutor ORI.
• If arrest prints are received and the ordinance case does not go to court, the
police must report the arrest as “REL – Released No Prosecution”.
• If arrest prints are received and an ordinance case goes to court, the court
must report a disposition on it.
• Use the state PACC code with the ordinance flag and the regular
disposition code if there is a state-corresponding statute.
• If there is no state-corresponding statute, enter the disposition using the
PACC code “111.111” and the disposition code “NSC – No State Code” as
well as the ordinance flag so the case can be removed from the CHR.

Things to Remember
• A TCN number does not ensure the arrest was built; the following reasons
cause TCN #s to be created without prints being sent to MSP:
– Sending the print to MSP as ID-Only or as an applicant.
– Clicking “Save” or “Print” instead of “Send”.
– Not checking return code to see if prints were accepted or rejected.
• Arrest corrections may sent to [email protected].
• Enter correct court of jurisdiction:
– Use Circuit ORI for cases booked by order of Circuit Court.
– User Juvenile ORI for arrestees age 16 and under.
– All other arrests use District Court ORI.
• Prosecutors and courts can submit corrections to arrest records.

• Frontal (head centered) – most common
• Left profile – 90 degree (subject turning to right)
• 18% gray background and smooth
• Lighting – without glare/shadows
• Eyes open, quit crying, no glasses
• Should include visible scars, marks and tattoos
• Up to 19 images can be submitted

DNA Notification
• When looking at the CHR, look at the mug shot / DNA availability
section in the identifiers at the top. If DNA Record Available = Yes,
the CODIS laboratory has a sample on file and a DNA sample does
not need to be collected.
• The LEIN response for Live Scan arrest print submission will indicate
whether DNA is or is not needed and whether DNA is or is not
already on file.
• Agencies wanting DNA training materials or on-site training should
contact the state CODIS laboratory.

When to Collect DNA
If DNA is not already on file, collect DNA for Arrest or Adjudication for
the Following:
• Felonies and attempted felonies.
• Violations of MCL 750.1671B (Common Prostitute); 750.1671C
(Window Peeper); 750.1671F (Obscene Conduct); 750.1671I
(Loitering at House of Ill Fame); 750.335A (Indecent Exposure);
750.335A2B (Aggravated Indecent Exposure); 750.451-C (Prostitution
– 2nd Offense); 750.454 (Prostitution – Leasing House Of).
• NOTE: SID numbers are only generated by fingerprints, so if DNA is
required so are fingerprints.

DNA Collection – General Notes
• Rolling motion – After swabbing the subjects mouth, transfer the sample to
the pink paper by:
• 1) Pressing the swab down onto the pink card and try to get the swab
within the circle. Do not rub the swab into the pink paper. The paper is
soft and will crinkle.
• 2) Maintain a slight pressure on the card and roll swab. The swab should
fold over and the swab stick should be pressing out the subject’s saliva.
Repeat if necessary. Please note that you are collecting the subject’s
cheek cells and the saliva is just to aid the transfer of the cheek cells to
the pink card.

• This card is for the database collection ONLY! DO NOT USE this card for
collection evidence or for collecting suspect known samples.
• Wear disposable gloves to keep your DNA from the pink area of the card.
• Please keep the pink part of the card protected, the flap folds over to keep the
pink paper covered while you fill out the offender’s personal information.
• Do not forget to fill out the reverse side of the card and to check either the
arrestee or convicted offender box.
