CORPORATION OF THE TOWN OF SAUGEEN SHORES
BY-LAW 51 - 2013
A By-law to Regulate and/or Control the Parking, Stopping and
Standing of Vehicles in the Town of Saugeen Shores.
WHEREAS Section 11, of the Municipal Act, 2001. S.O. 2001 c.25 and the provisions
of the Highway Traffic Act, R.S.O. 1990 H.8, as amended authorize a Municipal
Council to pass by-laws to regulate and control traffic;
AND WHEREAS Section 100 of the Municipal Act, 2001 , S.O. 2001 , c.25, as
amended confer upon a local municipality may, in respect of land not owned or
occupied by the municipality that is used as a parking lot, regulate or prohibit the
parking or leaving of motor vehicles on that land without the consent of the owner of
the land or regulate or prohibit traffic on that land if a sign is erected at each entrance
to the land clearly indicating the regulation or prohibition;
AND WHEREAS the Fire Prevention & Protection Act, 1997, Chapter 4, Section
7.1 (c), provides that a municipality may pass by-laws designating private roads as fire
routes along which no parking of vehicles shall be permitted and providing for the
removal and impounding of any vehicle parked or left along any of the fire routes at the
expense of the owner of the vehicle;
AND WHEREAS Sections 63 and 101 of the Municipal Act permit such by-law to
authorize the impounding of vehicles improperly parked;
AND WHEREAS Section 102(2) of the Municipal Act allows that the municipality shall
prescribe the conditions of use of the Disabled Parking Permit and shall prohibit the
improper use of the permit;
AND WHEREAS Section 425 of the Municipal Act permits a municipality to pass bylaws providing that a person who contravenes a by-law of the municipality passed
under this Act is guilty of an offence;
AND WHEREAS Section 427, of the Municipal Act, 2001, S.O. 2001 c.25, "A by-law
establishing a system of disabled parking shall provide that every person who
contravenes the By-law is guilty of an offence and on conviction is liable to a fine of not
less than $300 .00"
AND WHEREAS Section 170(15) of the Highway Traffic Act states that "A police
officer, police cadet, municipal law enforcement officer or an officer appointed for
carrying out the provisions of this Act, upon discovery of any vehicle parked or
standing in contravention of subsection (12), of a regulation made under subsection
26(3) of the Public Transportation and Highway Improvement Act or a municipal bylaw, may cause it to be moved or taken to and placed or stored in a suitable place and
all costs and charges for the removal, care and storage of the vehicle, if any, are a lien
upon the vehicle, which may be enforced in the manner provided by the Repair and
Storage Liens Act, 2005, c.26, Schedule. A, s.28 (2)
AND WHEREAS the Council of the Corporation of the Town of Saugeen Shores
deems it expedient to pass a by-law to regulate and control parking within the Town of
Saugeen Shores;
NOW THEREFORE the Council of the Corporation of the Town of Saugeen Shores
enacts as follows:
This by-law may be cited as the "Parking By-law".
1.
DEFINITIONS
In this By-law
1.1
"Authorized emergency vehicle" means,
(i)
a Fire Department vehicle, including an emergency crash
extrication vehicle, while proceeding to a fire or emergency call or
responding to, but not returning from, a fire alarm or other
emergency call;
(ii)
(iii)
(iv)
a vehicle while used by a person in the lawful performance of their
duties as a police officer;
an ambulance or cardiac arrest emergency vehicle while
responding to an emergency call or being used to transport a
patient or injured person in an emergency situation, or
an emergency vehicle of a public or private utility, or Federal,
Provincial or Municipal Department when such a vehicle is being
used in the performance of emergency duties;

"Authorized sign" means any sign or roadway, curb or sidewalk marking
or device placed or erected under the authority of the Town of Saugeen
Shores for the purpose of regulating or controlling traffic and includes
official signs;
1.3
"Bicycle" includes a bicycle, tricycle, a unicycle and a power-assisted ebicycle but does not include a motor-assisted bicycle;
1.4
"Boulevard" means that part of the highway between the roadway and
the property lines of the lots abutting the highway and includes the
shoulder but does not include a sidewalk, if any.
1.5
"Beach" means that portion of public property that is an unopened road
allowance at or near water and any part therefore not covered by water;

"Boat" means a water craft that is intended for use on water for
recreational or vacation purposes which is capable of being drawn by a
motor vehicle and includes canoes and row boats;

"Bus stop" means that portion of a highway, designated by an authorized
sign, for the use of buses as a point for loading and unloading
passengers and including an area sufficient to accommodate the length
of the bus;

"Chief of Police" means the Chief of the Saugeen Shores Police Service
or their designate;
1.9
"Chief Fire Official" means the Fire Chief of the Corporation of the Town
of Saugeen Shores or their designate;
1.10
"Commercial motor vehicle" means a motor vehicle with a permanently
attached truck or delivery body and includes an ambulance, hearse,
casket wagon, fire apparatus, buses and tractors used for hauling
purposes on the highways;

"Corner" means the point of intersection of curbs or edges of the highway
used for vehicular traffic;
1.12
"Council" means the Municipal Council of the Corporation of the Town of
Saugeen Shores;
1.13
"Crosswalk" means:
(i)
that part of the highway at an intersection that is included within
the connections of the lateral lines of the sidewalks on opposite
sides of the highway measured from the curbs, or in the absence
of curbs, the edges of the roadway, or;
(ii)
any portion of a roadway at an intersection or elsewhere distinctly
indicated for pedestrian crossing by signs, lines or other markings
on the road surface;
1.14
"Driver" means a person who drives a vehicle on a highway;
1.15
"Designated disabled parking space" means a parking space approved
for the exclusive use of a vehicle displaying a current and valid Permit, in
a public parking lot owned by the Town or being on private property or on
a highway under the jurisdiction of the Town;
1.16
"Disabled person" means an individual that meets the requirements of
such as set out in the regulations;
1.17
"Enforcement Officer" means:
(i)
a Police Officer and/or Provincial Offences Officer for the Town of
Saugeen Shores, or
(ii)
a person appointed by Council to enforce or carry out the
provisions of this By-law, or any part or parts thereof, who is by
virtue of their appointment a Provincial Offences Officer when
enforcing the provision or provisions of this By-law;
1.18
"Fire Route" means any access route, public or private roadway, lane,
ramp or other means of vehicular access being 5 metres in width into or
egress from a building and it may include part of a parking lot set aside
for use by authorized emergency vehicles unless otherwise authorized
by the Chief Fire Official;
1.19
"Gross weight" means the combined weight of a vehicle and its load;

"Highway" includes a common and public highway, street, avenue, public
lane, parkway, driveway, square, place, bridge, viaduct or trestle, and
any part of which is intended for or used by the general public for the
passage of vehicles and includes the area between the lateral property
lines thereof;
1.21
"Intersection" means the area embraced within the prolongation or
connection of the lateral lines, curb lines, or if none, then of the lateral
boundary lines of two or more highways that join one another at an
angle, whether or not one highway crosses the other;
1.22
"Median" means a portion of a highway so constructed as to separate
traffic traveling in one direction from traffic traveling in the opposite
direction by a physical barrier or an unpaved strip of ground;
1.23
"Minister" means the Minister of Transportation;
1.24
"Ministry" means the Ministry of Transportation;
1.25
"Motor assisted Bicycle" means a bicycle:
(i)
that is fitted with pedals that are operable at all times to propel the
bicycle;
(ii)
that weighs not more than fifty-five kilograms;
(iii)
that has no hand or foot operated clutch or gearbox driven by the
motor and transferring power to the driven wheel;
(iv)
that has an attached motor driven by electricity or having a piston
displacement of not more than fifty cubic centimetres; and
(v)
that does not have sufficient power to enable the bicycle to attain
a speed greater than 50 kilometres per hour on level ground
within a distance of 2 kilometres from a standing start;

"Motor vehicle" includes an automobile, a motorcycle, a motor-assisted
bicycle and any other vehicle propelled or driven otherwise than by
muscular power, but does not include a street car or other motor vehicle
running only upon rails, a power-assisted bicycle, a motorized snow
vehicle, a traction engine, a farm tractor, a self-propelled implement of
husbandry or a road-building machine within the meaning of the Highway
Traffic Act;

"Multi-Use Trail" means that part of a highway with surface improved with
asphalt, concrete or gravel for the use of pedestrians and non-motorized
vehicles.
1.28
"Municipality" means the Corporation of the Town of Saugeen Shores;
1.29
"Municipal vehicles" includes but is not limited to vehicles owned by the
Town and/or contractors having a valid contract with the Town to supply
municipal services. These services may include road building, road
maintenance, emergency services, garbage collection, recycling, hydro,
water, etc.
1.30
"Occupant" means:
(i)
the tenant of the property or part thereof whose consent shall
extend only to the control of the land of which he is the tenant and
any parking spaces allotted to him under the lease or tenancy
agreement; or,
(ii)
the spouse of a tenant; or,
(iii)
a person authorized, in writing by an occupant as defined in
subsection (i) or (ii) to act on the occupant's behalf for requesting
the enforcement of this section.
1.31
"One-way street" means a street upon which vehicular traffic is limited to
movement in one direction only;

"Owner" when used in relation to property means:
(i)
the registered owner of the property or the spouse of that person;
or,
(ii)
a person authorized, in writing by the property owner as defined in
subsection (i) to act on behalf of the owner in requesting the
enforcement of this section.
(iii)
where the property is included in a description registered under
the Condominium Act, the Board of Directors of the Condominium
Corporation.
1.33
"Park or Parking" when prohibited, means the standing of a vehicle
whether occupied or not, except when standing temporarily for the
purpose of and while actually engaged in loading or unloading
merchandise or passengers;

"Parking Space" means an area that has been designated and marked
for the temporary parking of motor vehicles;
1.35
"Parking Infraction Notice" means a Notice authorized by the Provincial
Offences Act and handed to the driver or placed on any vehicle parked in
contravention of this By-law.
1.36
"Pedestrian" includes a person on foot, in a wheelchair and a child in a
wheeled carriage.
1.37
"Pedestrian crossover" means any portion of a roadway, designated by
By-law of a Municipality, at an intersection or elsewhere, distinctly
indicated for pedestrian crossing by signs on the highway and lines or
other markings on the surface of the roadway as prescribed by the
regulations under the Highway Traffic Act;

"Permit" means a current and valid Disabled Person Permit issued by the
Ministry pursuant to the Highway Traffic Act and the regulations made
there under or a Permit, numbered plate or other marker or device
issued by another jurisdiction and recognized under that Act;
1.39
"Police Officer" means a member of the Saugeen Shores Police Service
or a person authorized by the Chief of Police to regulate or direct traffic;
1.40
"Private property" means any property within the Town not owned by or
occupied by the Town but rather someone else;
1.41
"Private road" means any road, lane, ramp or other means of vehicular
access to or from a building or structure that is not owned by the Town,
County of Bruce or Province of Ontario and may include part of a parking
lot;
1.42
"Public parking lot" means any open public area or portion of a structure
other than a street or highway, intended for the temporary parking of
vehicles and on which there are designated parking spaces, whether
their use involves the payment of a fee or otherwise, which is owned by
or leased by the Town;
1.43
"Public Park" means any public area used for park purposes or public
beaches, which is owned or leased by the Town;
1.44
"Provincial Offences Officer" means a Police Officer, Municipal By-law
Enforcement officer or persons designated by Municipal Council for the
purposes of enforcing all or any class of offences.
1.45
Regulations" means regulations made under the Highway Traffic Act;
1.46
"Roadway" means that portion of a highway that is improved, designed
or ordinarily used for the passage of vehicles, but does not include the
shoulder and where a highway includes two or more separate roadways
the term "roadway" refers to any one roadway separately and not all of
the roadways collectively;

"Sidewalk" means that portion of a highway between the curb line or
edge of a roadway and the adjacent property line that is designed and
intended for the use of pedestrians;
1.48
"Standing" means the halting of a vehicle, whether occupied or not,
except for the purpose of and while actually engaged in receiving or
discharging of passengers;
1.49
"Stop or Stopping" when prohibited, means the halting of a vehicle
momentarily, whether occupied or not, except when necessary to avoid
conflict with other traffic or in compliance with the direction of a police
officer or a traffic control sign or signal;
1.50
"Time" where any expression of time occurs or where any hour or other
period of time is stated, the time referred to shall be Eastern Standard
Time, except during a period when daylight saving time is in effect in the
Town of Saugeen Shores, when the time referred to shall be one hour in
advance of standard time;

"Town" means the Corporation of the Town of Saugeen Shores;
1.52
"Traffic" includes pedestrians, ridden or herded animals, vehicles and
any other conveyances either singly or together, while using any highway
for the purpose of travel;
1.53
"Traffic control signal" means any device, manually, electrically or
mechanically operated for the regulation of traffic;
1.54
"Travel trailer" means a structure designed, intended and used
exclusively for travel, recreation and vacation and which is capable to
being drawn or propelled by a motor vehicle or is propelled and includes
tent trailers or similar transportable accommodations excepting mobile
homes;
1.55
"Trailer" means a vehicle that is at any time drawn upon a highway by a
motor vehicle.
1.56
"Vehicle" includes a motor vehicle, motor assisted bicycle, trailer,
motorcycle, travel trailer, boat trailer, motorized snow vehicle, traction
engine, farm tractor, bus, road-building machine and any vehicle drawn,
propelled or driven by any kind of power, including muscular power;

"Wheelchair" means a chair mounted on wheels driven by muscular or
any kind of power, this includes motorized scooters and other personal
mobility devices used for the carriage of a person with a disability;
1.58
"Words" where any word or expression used in this By-law is not defined
herein reference shall be made to the Highway Traffic Act R.S.O. 1990,
Chapter H.8., the Municipal Act R.S.O. 2001, as amended or re-enacted
from time to time or generally accepted dictionary and the interpretation
that best reflects the spirit and intent of this By-law shall be accepted.
The provisions of this By-law are subject to the provisions of the Highway
Traffic Act R.S.O. 1990, Chapter H.8, as amended or re-enacted from time to
time, and the regulations made there under.

APPLICATION AND ENFORCEMENT
2.1
This By-law applies to all Highways under the jurisdiction of the Town,
and Municipal and Private Property in so far as it applies to parking
regulations.
2.2
The Director of Public Works or their designate is authorized to place or
erect and maintain such Authorized Signs and traffic control signals as
are required to give effect to the provisions of this By-law.
2.3
All measurements of distance relative to an "intersection" shall, where
possible, be taken to or from a point where the prolongation or
connection of the lateral curb lines meet on the side of the highway
relative to said measurement.
2.4
No person shall place, maintain, display upon or in view of any highway
any sign, signal, marking or device which purports to be or is an imitation
of or resembles an authorized sign or traffic control signal, or which
conceals from view or interferes with the effectiveness of an authorized
sign or traffic control signal.
2.5
The provisions of this By-law will be enforced by an Enforcement Officer.
PARKING
3.1
Where Authorized Signs or markings have been erected or are on
display, no person shall park a vehicle in disobedience to the direction
given by the said sign or markings as follows:
a)
on any section of any street or property in the ownership of the
Town when Authorized Signs have been approved and are on
display prohibiting parking;
b)
on any section of any street or property in the ownership of the
Town when Authorized Signs have been approved and are on
display, a time limit on parking.

Where parking spaces have been established by suitable markings on
the road surface, no person shall park a vehicle except within the space
designated by markings.
3.3
Where parking is permitted, no person shall park a vehicle on any
highway, except on a one-way street or where angle parking is required,
except on the right side of the highway having regard to the direction in
which the vehicle had been proceeding and unless the right front and the
right rear wheels of the vehicle are parallel to and distant respectively not
more than .15 meters from the curb or edge of the roadway.

ANGLE PARKING

Angle parking is permitted, where Authorized Signs are erected and on
display, in those areas designated in Schedule "A" attached to and
forming part of this By-law on the highways described in Column 1, on
the side or sides set forth in Column 2 opposite thereto within the
boundaries set out in Column 3 opposite thereto respectively.
ONE-WAY STREETS

Notwithstanding the other provisions of this By-law, no person shall park
a vehicle on a highway in such a manner as to interfere with the
movement of traffic or the clearing of snow from the highway.
Where parking is permitted on both sides of a one-way street, in addition
to the provision of Section 3.3, a person shall park a vehicle facing only
in the direction allowed on the lane with the left front and left rear wheels
of the vehicle parallel to and distant respectively not more than .15
meters from the curb or edge of the roadway. This mode of parking also
applies where parking is only allowed on the left side of a one-way street.
PARKING PROHIBITED - SIGNAGE REQUIRED
6.1
Where Authorized Signs erected are on display, no person shall park a
vehicle on the highways or part of highways set forth in Column 1 of
Schedule "B" attached to and forming part of this By-law, on the side or
sides set forth in Column 2 opposite thereto within the boundaries set out
in Column 3 opposite thereto respectively.
6.2
Where authorized signs are erected or are on display, no person shall
park a vehicle on the highways or parts of the highways, on the side(s)
and between the limits set our respectively in Columns 1, 2 and 3 of
Schedules "C, D, E and F" attached to and forming part of this By-law
during the prohibited times or days set out in Column 4 of the said
Schedules "C, D, E and F".
PARKING PROHIBITED- SIGNAGE NOT REQUIRED:
7.1
No person shall park a vehicle :
(a)
on or over a sidewalk or posted bike path;
(b)
on or within a crosswalk or pedestrian crossover;
(c)
within 9 meters of any intersection. Additional distance may be
required at certain intersections and parking would be prohibited
from the location of a sign reading "No Parking Here to Corner" to
the intersection;
(d)
on a median strip or on any boulevard (unless otherwise posted);
(e)
within 15 meters from any intersection controlled by traffic control
signals. Additional distance may be required at certain
intersections and parking would be prohibited from the location of
a sign reading "No Parking Here to Corner" to the intersection;
(f)
on a bridge or approaches thereto;
(g)
on a highway within 3 meters of a point or edge of the roadway
opposite a fire hydrant;
(h)
on a highway in such a position as to obstruct traffic;
(i)
on a highway within 15 meters of a crosswalk or pedestrian
crossover;

U)
in such a position as to interfere with the removal of any vehicle
previously parked or standing;
(k)
in front of the entrance or exit to a lot or building where a fire
department vehicle, public utility emergency vehicle, police vehicle
or other emergency vehicle is kept stored, in such a manner as to
impede the movement of such vehicles when responding to an
emergency;
(I)
at a public or private driveway in such a manner as to impede
ingress and egress;
(m)
at a public or private driveway in such a way as to impair visibility
of driveways as it intersects with the highway;
(n)
on a highway for the purpose of displaying the vehicle for sale;
(o)
on a highway for the purpose of washing, greasing or repairing the
vehicle except for emergency repairs required to remove the
vehicle;
(p)
on the roadway when it is practicable to park the vehicle off the
roadway;
(q)
in a public park between the hours of 12:00 midnight and 6:00
am;
(r)
on a beach, save and except those beach areas established for
that purpose;
(s)
on any highway between the hours of 2:00 am and 8:00 am
commencing November 1st of each year and ending on March 31st
the following year;
(t)
in a place as to interfere with the formation of a funeral
procession;
(u)
alongside any curb upon which yellow paint has been applied.
(v)
in such a position so as to interfere with the removal of snow from
any Highway, sidewalk or Parking Lot in the Municipality.
(w)
no person shall park on public property without valid vehicle
registration with the Ministry of Transportation.
(x)
no person shall park on public property without current insurance
coverage.
Notwithstanding the provisions of any other section of this By-law, no
person shall park or leave standing any vehicle, upon any part of any
highway or property under the jurisdiction of the Town for a period in
excess of 24 hours.
PARKING IN SPECIFIED AREAS
8.1
No person shall park a vehicle:
(a)
In the center portion of High Street between Victoria Street and
Huron Street, except for commercial vehicles while loading or
unloading goods and merchandise
(b)
In the center portion of High Street between Victoria Street and
Huron Street, except for commercial vehicles for a period not to
exceed 15 minutes;
(c)

STOPPING PROHIBITED

No person shall stop a vehicle in any of the following areas, unless
otherwise posted:
(a)
on or over a sidewalk;
(b)
on or within a crosswalk or pedestrian crossover;
(c)
beside another stopped or parked vehicle;
(d)
on a highway within 3 meters of a point on the curb or edge of the
roadway directly opposite a fire hydrant;
(e)
within a school bus loading zone, excepting school buses;
(f)
in any area designated for disabled parking only, unless the
vehicle is identified with a disabled person parking permit
prominently displayed on the dash or sun visor.
(g)
In a Fire Route.
BUS AND TAXI STOPPING AND PARKING
10.1
No bus or taxi shall stand, stop or park upon any highway in any
business district other than at a bus or taxi stand, except that this
provision shall not prevent the driver of any such vehicle from temporarily
stopping in accordance with other stopping or parking provisions
contained herein at any place for the purpose of and while actually
engaged in loading or unloading goods or passengers.
10.2
No vehicle shall stand, stop or park a vehicle other than a bus at a bus
stop or taxi at a taxi stand when such stop or stand areas has been
designated and appropriate signs have been erected and are on display,
except that a vehicle may temporarily stop therein for the purpose of
loading or unloading passengers when such stopping or standing does
not interfere with any bus or taxi waiting to enter or exit such a zone.
BICYCLES

On the south side of High Street first parking spot east of Albert
Street in that area designated by authorized sign indicating "Police
Parking Only" except police or other emergency vehicles or those
vehicles for which reserved parking is indicated;
No person shall park a bicycle on any boulevard or sidewalk except in an
upright position and in a manner as not to impede the intended use of
the boulevard or sidewalk.
PARKING-PRIVATE PROPERTY
12.1
No person shall park a motor vehicle:
on private property without the consent of the owner or occupant
(a)
of the property; or
on property owned or occupied by the municipality or any local
(b)
board thereof without the consent of the municipality or local
board , as the case may be.
12.2
In addition to any other penalty that may be imposed, any vehicle parked
in contravention of this section shall be removed and impounded at the
owner's expense and all costs become a lien against the motor vehicle.
12.3
The driver or owner of a motor vehicle parked on private property is not
liable to a penalty to have the motor vehicle removed from such property
or impounded under this section except upon written complaint of the
owner or occupant of the property given to the Enforcement Officer
appointed to carry out the provisions of this By-law.
12.4

Where an owner or occupant of property affected by this section has
posted signs stating conditions on which motor vehicles may be parked
on the property, or prohibiting the parking of a motor vehicle on the
property, a motor vehicle parked on the property contrary to such
conditions or prohibition shall be deemed to have been parked without
consent.
PARKING- DISABLED PERSON
13.1
The location of designated parking spaces, to which this By-law applies,
are described in Schedule "G" attached to and forming a part of this Bylaw.
13.2
When designated disabled parking spaces have been provided at
locations described in Schedule "G" and Authorized Signs have been
erected and are on display, no person shall park a vehicle in a
designated disabled parking space except when the parking is for the
convenience of a disabled person and the vehicle displays a Permit.
13.3
In addition to the designated parking spaces provided by the
municipality, the owner or operator of a parking lot or other parking
facility to which the public have access shall provide designated parking
spaces. The designated parking spaces shall be in accordance with the
applicable Zoning By-law and shall include the following for each
disabled parking space:
(a)
parking stall markings as per Schedule "H" attached to and
forming part of this By-law.
(b)

a disabled parking space sign as per Schedule "H" attached to
and forming part of this By-law.
13.4
Designated disabled parking signage in contravention of Schedule "H"
may remain in effect if existed as of the date of the passage of this Bylaw.
13.5
In addition to any other penalty that may be imposed, any vehicle parked
in contravention of this section may be removed and impounded at the
owner's expense and all costs incurred become a lien against the motor
vehicle.
13.6
In addition to the designated parking spaces provided by the
municipality, persons or organizations hosting special events shall
provide designated parking for disabled persons.
13.7
Authorized Signs and parking stall markings for spaces for use by
disabled persons shall be in the form and content as set out in Schedule
"H" attached to and forming part of this By-law.
FIRE ROUTES
14.1
Designated Fire Routes are described under Schedule "I" attached
hereto and forming part of this By-law.
14.2
Where a private roadway or parking lot, or part thereof has been
established as a fire route under the Fire Code and approved by the
Chief Fire Official, it is hereby designated as a fire route.
14.3
Each and every designated fire route shall be distinctly indicated by a
sign , which is in a form and content as prescribed by the Chief Fire
Official or their designate.
14.4
No person shall park at any time in a Fire Route.

Notwithstanding any other provisions of this By-law, no person shall
park, stand, or stop a vehicle on a highway or any other property owned
or occupied by the Town for a period exceeding 72 hours, it shall be
deemed to be abandoned, and upon complaint or discovery by an
Enforcement Officer, may cause it to be moved to, or stored in a suitable
place. All costs or charges for removing, care and storage thereof, if
any, are a lien upon the vehicle which may be enforced in a manner
provided by the relevant provisions of the Repair and Storage Liens Act.

No person shall park a vehicle on the highways or parts of the highways
set forth in Column 1 of Schedule "K" to this By-law, on the side or sides
set forth in Column 2 during the hours of 6:00 am to 6:00 pm. during
Pumpkinfest weekend.
The provisions in this By-law shall not apply to any vehicle owned by the
Town, ambulances, military, police or fire department vehicles, vehicles
owned by other public authorities and any other vehicle while actually
engaged in performing works for the Town.
EMERGENCY PROHIBITIONS
18.1
Notwithstanding any other provisions of this By-law, the Chief of Police
and/or the Chief Fire Official and/or Chief Emergency Management
Coordinator, during an emergency or special circumstances, may
declare a period of emergency parking prohibition and by use of
appropriate signs or other clear directions may suspend parking of
vehicles on any streets or portions thereof.
18.2
A vehicle parked previously to the declaration of the Chief of Police
and/or the Chief Fire Official and/or Chief Emergency Management
Coordinator, may be deemed to be parked in contravention of this
section providing the owner or operator of the vehicle has been
personally notified of the emergency parking prohibition and has been
allowed a reasonable period of time to remove the vehicle. Any person
who fails or refuses to obey the direction of the Chief of Police and/or the
Chief Fire Official and/or Chief Emergency Management Coordinator
shall commit a violation of this By-law.

No person shall park a vehicle during a declared emergency parking
prohibition.
PENALTY PROVISIONS

This By-law shall be enforced by Enforcement Officer(s) who enforce the
provisions of this By-law. ·
In addition to any other penalty that may be imposed under this By-law,
where a vehicle is parked in violation of any provisions of this By-law an
Enforcement Officer may cause the vehicle to be taken and placed or
stored in a suitable place and all costs and charges for removing, caring
and storage thereof are a lien against the vehicle which may be enforced
under the provisions of the Repair and Storage Liens Act, R.S.O. 1990,
Chapter R, 25.
The owner of a vehicle found parked in violation of this By-law may be
charged and convicted of an offence for which the driver of the vehicle is
subject to charge, unless, at the time of the offence, the vehicle was in
the possession of some person other than the owner without the owner's
consent and on conviction the owner is liable to the penalties prescribed
for the offence.
19.4
The owner of a vehicle found parked in violation of this By-law may be
charged and convicted of an offence for which the driver of the vehicle
has been charged.
19.5
An Enforcement Officer who finds a vehicle parked in violation of any
provision of this By-law shall serve the owner or driver of the vehicle with
a Parking Infraction Notice indicating:
(a)
the license plate number of the vehicle;
(b)
that the vehicle was unlawfully parked;
(c)
the date, time and place of the alleged infraction;
(d)
that the owner or driver of the vehicle may attend or send
payment of the "Set Fine" to a location specified on the Notice;
(e)
that the failure to make payment of the "Set Fine" will result in
further enforcement action .
19.6
The issuing Enforcement Officer shall serve the Parking Infraction Notice
on the owner of the vehicle by affixing the Notice to the vehicle in a
conspicuous place at the time of the alleged offence or by delivering the
Notice personally to the person having care and control of the vehicle, or
by sending Registered Mail.
19.7
A person receiving a Parking Infraction Notice shall pay the "Set Fine"
indicated at the location on the Notice.
19.8
The terms and procedures in this section are pursuant to Part II of the
Provincial Offences Act and for clarification or particularity reference
should be made to the provisions of that Act.
19.9
Every person who violates a provision of this By-law is guilty of an
offence pursuant to the provisions of the Provincial Offences Act, R.S.O.
1990, Chapter P. 33, as amended.
19.10 All By-laws inconsistent with this By-law are hereby repealed as of the
date of this By-law coming into effect.
19.11 That this By-law shall come into force and effect upon receiving set fine
approval from the Ontario County of Justice.

DISABLED PARKING SIGNAGE
The following Rc-6 (30x 40) em signage is the approved disabled
parking signage for the Town of Saugeen Shores.

SIGN INSTALLATION
(a)
Where a parking space is designated for use by disabled
persons is designated for parallel parking the Rc-6 sign shall be
erected adjacent to the parking space within its longitudinal
limits. It shall be erected such that it is clear to which parking
space the designation applies, but not so as to interfere with
access to and from parked vehicles.
Signs should be mounted at a height between 1.5 and 2.5
meters, measured from the top of the curb to the bottom of the
sign.
(b)
Where a parking space is designated for angle parking or
parking perpendicular to the roadway, signs designating the
parking space for use by disabled persons shall be erected at
the front of the parking space, midway between its lateral lines.
Signs should be mounted at height of between 1.5 and 2.5
meters, measured from the top of the curb to the bottom of the
sign.

PARKING SPACE MARKINGS
In all cases signs should be augmented, but not replaced by,
pavement, markings. Pavement marking shall be the blue reflective
background and outline with the white reflective symbol and border as
set out below.
