APRIL 2011 Scott Short REAL ESTATE FINANCE FORUM CHAIR This month I am giving you the Federal Reserve System’s Regulation Z - Loan Officer Compensation Rule. To fully appreciate this, I need to give you a bit of context. Starting April 1 the lending world changed for everyone -- depository banks, credit unions, mortgage banks and mortgage brokers. Prohibitions related to mortgage originator compensation • Prohibits compensation to a Mortgage Loan Originator (MLO), paid by any person other than the consumer, that is based on the loan’s terms or conditions. The amount of credit extended (loan amount) is not deemed to be a term or condition provided it is a fixed percentage (may have floor/ceiling). • Terms and conditions include interest rate, annual percentage rate (APR), loan-to-value (LTV) and pre-payment penalty (PPP). A bout the M ar k et Depending on who is paying, the mortgage loan originator rules. If the lender pays the MLO, then rules apply differently than when the consumer pays the MLO. (Each mortgage broker must have a separate agreement with each wholesale lender.) • When a mortgage broker brokers a loan to a creditor, the creditor will pay the mortgage company’s broker of record. That broker would pay the MLO. The new rule states this would be considered dual compensation, meaning the mortgage broker of record could only pay their MLO a salary or hourly when a loan is brokered. • Dual Compensation prohibits a MLO from receiving compensation from a consumer while also receiving compensation from others. Prohibition on Steering Provides a safe harbor to facilitate compliance. The safe harbor is met if the consumers is presented with loan options for each type of transaction in which the consumer expresses an interest (e.g. fixed rate, adjustable rate loan, etc), and the loan options presented to the consumer include: 1) the loan with the lowest interest rate for which the consumer qualifies starting with YOU! Sacramento REALTOR® 3 ETHICS CORNER Pathways to Professionalism While the Code of Ethics and Standards of Practice of the National Association establishes objective, enforceable ethical standards governing the professional conduct of REALTORS®, it does not address issues of courtesy or etiquette. Based on input from many sources, the Professional Conduct Working Group of the Professional Standards Committee developed the following list of professional courtesies for use by REALTORS® on a voluntary basis. This list is not allinclusive, and may be supplemented by local custom and practice. I. Respect for the Public 1.Follow the “Golden Rule” – Do unto others as you would have them do unto you 2.Respond promptly to inquiries and requests for information 9.Never criticize property in the presence of the occupant 3.Schedule appointments and showings as far in advance as possible 10.Inform occupants that you are leaving after showings 4.Call if you are delayed or must cancel an appointment or showing 11.When showing an occupied home, always ring the doorbell or knock – and announce yourself loudly – before entering. Knock and announce yourself loudly before entering any closed room 5.If a prospective buyer decides not to view an occupied home, promptly explain the situation to the listing broker or the occupant 6.Communicate with all parties in a timely fashion 7.When entering a property, ensure that unexpected situations, such as pets, are handled appropriately 8.Leave your business card if not prohibited by local rules. 12.Present a professional appearance at all times; dress appropriately and drive a clean car 13.If occupants are home during showings, ask their permission before using the telephone or bathroom 14.Encourage the clients of other brokers to direct questions to their agent or representative 15.Communicate clearly; don’t use jargon or slang that may not be readily understood. 16.Be aware of and respect cultural differences 17.Show courtesy and respect to everyone 18.Be aware of – and meet – all deadlines 19.Promise only what you can deliver – and keep your promises 20.Identify your REALTOR® and your professional status in contacts with the public 21.Do not tell people what you think – tell them what you know. II. Respect for Property 1.Be responsible for everyone you allow to enter a listed property 2.Never allow buyers to enter listed property unaccompanied 3.When showing property, keep all members of the group together 4.Never allow unaccompanied access to property without permission 5.Enter property only with permission even if you have a lockbox key or combination 6.When the occupant is absent, leave the property as you found it (lights, heating, cooling, drapes, etc). Local governments rely heavily on property taxes and sales taxes for revenue, which are both dramatically down from 2005. Compounded with this fact, the State of California, struggling with it’s own financial difficulties, has borrowed much of the revenue that traditionally goes to local governments (to be paid back… at some potential date in the future). Local government advocacy groups release a report to their constituencies every few years detailing new revenue generating measures. One popular proposal, which has gotten some traction throughout the State, is changing the business license structure to require every individual real estate agent to carry a business license. Under the present structure the broker holds the business license and individual agents are considered employees. Several REALTOR® Associations in Southern California are fighting such proposals. It may soon be discussed in certain Northern California jurisdictions. Organized real estate advocates that REALTORS® should be viewed as employees for business license purposes. A REALTOR® is required to hang their license with a broker, and cannot legally operate without a broker unless they themselves have a broker’s license. Additionally, brokerages must purchase and maintain workers compensation insurance for each agent working under that broker’s license. This fact alone certainly suggests that REALTORS® should be treated as employees rather than as totally independent business entities. There has not yet been a push to expand business licenses in the Sacramento region to individual REALTORS®, but it is always possible. If you receive a business license renewal form which you have not gotten in past years, please let us know. This is an important issue to stay on top of and requires educating local staff and elected officials on why REALTORS® should not be considered individual businesses. Respect for Peers 1.Identify your REALTOR® and professional status in all contacts with other REALTORS® 2.Respond to other agents’ calls, faxes, and e-mails promptly and courteously. 3.Be aware that large electronic files with attachments or lengthy faxes may be a burden on recipients 4. Notify the listing broker if there appears to be inaccurate information on the listing 5.Share important information about a property, including the presence of pets, security systems, and whether sellers will be present during the showing 6.Show courtesy, trust and respect to other real estate professionals 7.Avoid the inappropriate use of endearments 8.Do not prospect at other REALTORS®’ open houses or similar events 9.Return keys promptly 10.Carefully replace keys in the lockbox after showings 11.To be successful in the business, mutual respect is essential 12.Real estate is a reputation business. What you do today may affect your reputation – and business – for years to come. She has been a REALTOR® since 1999, just in time for the real estate boom. Martha’s first manager, Pam Petterle, said that she took off on roller skates! When Martha was in college, she heard people talk about the real estate business as an investment and the concept always remained with her. After graduation from UC Davis with a degree in Psychology, she worked as a mental health counselor in Davis for 6 years. Then she attended CSU Sacramento and received a degree in business administration with a concentration in accounting. She was hired by the Franchise Tax Board as a tax auditor, international tax specialist and hearing officer. She retired from that field after 15 years. In 1999, she was aware of a real estate training program and she jumped in. She achieved Master’s Club status in 2004 and has been a Member ever since. One of her most interesting experience as a REALTOR® was when her client was buying a home on 25 acres. The engineering company did the four point survey and discovered almost ¾ of the home next door was on the client’s property. The neighbor had to pay for the land that his home was on ...This happened because there was a joint road to enter the property and everyone assumed that the property line was in the middle of the road. Martha sure learned that you can’t assume anything. Martha can read, write and speak Spanish at the professional level. With U.S. Hispanics making up an estimated 41.3 million and a growth of 1.7 million a year, she is not ignoring this market. She has said that Hispanics, like any other group, are not a homogenous group that can be put in a box. They have different levels of education, background and interests. She feels a significant group remains underserved. Her objective is always to treat everyone with professionalism, courtesy and respect. Apart from her real estate career, Martha enjoys cross country skiing at Royal Gorge and world travel to Hong Kong, Morocco, Europe, Costa Rica, Mexico, Istanbul and Thailand. All of these qualities and interests have certainly contributed to Martha’s success as a REALTOR® and Master’s Club member. At one end of the spectrum are the power-users who do paperless transactions, have online calendars, smart phones, blogs, online data storage, social media sites, QR codes, etc....and there are others at the opposite end who may have a desktop computer and maybe a smartphone. Think about what potential data loss could mean for your business. If you were to suddenly lose all the contacts in your smartphone, that might create an unnecessary burden to your business while you try to recover that information. Or, if the hard drive on your desktop computer crashed -- what would happen if you lost every email you ever sent, or perhaps all of your digital listing photos? Last month I had a technology meltdown of sorts. I went online to my Blogger account (which is a Googlebased service) to write a new blog post and found that my account had been hacked AND my blog had been removed from the internet. For several days, I worked with Google to restore my four years of blog content and republish my blog website. Quite simply, it had never occurred to me that I should be backing-up my online blog content. After my blog was successfully restored, I did some research and found a few online services to back-up this content in real time. I vowed never to have the blog missing for five days again. If you would like to avoid the inconvenience and financial cost of data loss on any of your devices - here are a few that might be worth looking into; I back-up the contents of my laptop on a continuous basis via an online service that is set to run its back-ups automatically in the background of whatever I am working on. After doing some research, I discovered it's possible to back-up just about any electronic content - online or offline. For example, if you use social media websites like Twitter or Facebook, there are actually online services that can be used to backup this content as well. Carbonite, Norton Online Backup, iDrive, MozyHome - online annual subscription services that automatically back-up data over the internet on your desktop or laptop computer in real time. BackupMyTweets, TweetBackup, Backupify, Blogbackupr, VaultPress, BarradudaNetworks are online services to backup your social media or blog sites. A panel of industry experts will cover emerging real estate trends for energy upgrades. The information presented will help property owners and managers understand how to increase the value of properties; leverage the billions of dollars in rebates, grants and incentives available, and achieve a better understanding of the basics of “green” to create high energy performance buildings and increase the ROI of buildings with energy upgrades and retrofits. “A solid knowledge of green building practices is now essential for all those involved in managing, occupying, leasing, financing, developing, buying and selling commercial real estate. A solid knowledge of the resources for financing energy upgrades and retrofits is the key,” Chris Little, Little Real Estate Services and Chair of the SAR Commercial Division, said. DRE takes the position that a team name must be registered as a fictitious name (dba) with DRE before it can be used. However, that only a broker can have a dba. Many of the people using a team name hold a salesperson license and therefore can not register a dba. Can their broker register the dba? Probably, but that raises two issues. If the broker registers the dba and you want to leave, the broker still owns the dba. We know there are many licensees using a team name who are not in compliance with DRE requirements. DRE is not out there looking for them. But as soon as DRE becomes aware of the name, often through a consumer complaint about something totally unrelated, DRE will sent a Desist and Refrain Order prohibiting the continued use of the team name. If the licensee does not comply, DRE will likely pursue enforcement action against the licensee which could result in revocation of their license. Broker associates come off a little better, but not much. A broker associate could have their supervising broker register the dba, but the supervising broker still owns the name. The broker associate could register their own dba. But only associates licensed to the broker associate can use the name. Salesperson associates licensed to the supervising broker can not use the team name of the broker associate because that is not the broker holding their license. ably ought to spend a relatively small amount of money for an informed advisor to determine if you will be operating in accordance with DRE requirements.
