His practice emphasizes the representation of developers and general contractors in construction
defect claims. Over the last 34 years, he has defended several thousand claims asserted against
various members of the construction industry, totaling well in excess of several billion dollars.
After studying economics at Southern Oregon College, Mr. Lorber earned a Doctor of
Jurisprudence from the University of San Diego Law School in 1976. He is admitted to practice

Mr. Polito joined the firm in 1990. He has devoted his practice to defending large corporations and

Polito acts as Judge Pro-Tempore for the Two Attorney Panel Settlement Conference Board in
the Vista, California Superior Court.

Ms. Cappelluti opened the Northern California Office for the firm in 2005, and serves as the
managing partner for the office. Her practice emphasizes the representation of developers and
general contractors in construction disputes and contract consultations. She has represented
clients in a wide variety of cases, for both residential and commercial construction projects.
In 2013, Ms. Cappelluti obtained a defense verdict in trials on two separate construction litigation
matters, one involving mold and toxic tort claims. Specifically, she has defended her clients in
construction defect claims, delay claims, construction site injuries, contract disputes, toxic tort and
mold claims. In addition, Ms. Cappelluti has been instrumental in assisting clients in forming
corporations, preparing residential development documents for associated real estate
transactions, and preparing contracts for construction clients. She also has advised her clients on
the procurement and administration of WRAP/OCIP insurance policies.
Ms. Cappelluti earned a Doctorate of Jurisprudence at the University of San Francisco, after
obtaining a bachelor degree from Santa Clara University in Art History and English. She lectures
to members of different contractor groups on construction issues, contract disputes, and risk
allocation issues facing the construction industry. Ms. Cappelluti has also published several
articles for the industry. Born in Madera, Calif., Ms. Cappelluti is now a resident of San Francisco.

Erin Kennedy Clancy, a partner based out of the Southern California office, specializes in the
representation of businesses and individuals in complex construction, contract and fraud-based
disputes throughout the State of California. This includes representation ranging from a Fortune
500 company to national builders to individual board members of nonprofit corporations. Erin’s
extensive litigation practice has encompassed multimillion dollar and multi-home/unit residential
and commercial construction defect claims, property damage and contract claims, and fraud
claims relating to alleged financial transactions. In addition, Erin offers assistance to her clients
with regard to contract negotiations, business formation and dissolution, assistance with all
aspects of entity governance, risk management and insurance needs, trademarks, assistance
with Green Building Standards and LEED certification, as well as general civil litigation and
business transactional matters.
Erin has argued successfully before the Fourth Appellate District of California after successfully
obtaining a judgment against the plaintiffs three months prior to trial wherein costs were awarded
to the client after the litigation had been active for almost five years and appearing at the
eleventh hour as the third defense counsel in the case.
In Erin’s spare time, she volunteers as a ‘Symphony Sweetheart’ for the San Diego Symphony, a
volunteer attorney member of the Animal Legal Defense Fund, a volunteer with the San Diego
Humane Society, and supports numerous additional nonprofit organizations. Erin has studied
Spanish, French, German, Latin and Japanese and has traveled extensively throughout all
continents, even traveling to Antarctica. Raised in Long Island, New York, Sydney, Australia, and
Sebastopol, California, Erin now lives in La Jolla, California with her husband and bulldog, and
devotes her surplus time to her extended family.

Ms. Davies was born and raised in Tucson, Arizona. Ms. Davies joined the firm in 2004. After

Davies returned to Arizona and joined a sports representation firm, where she handled the PR
and marketing for professional athletes. She then decided to go back to school and attended the
University of Arizona College of Law, earning a J.D. in 1997. She is admitted to practice in the

Her practice focuses on construction defect, construction contract disputes, bodily injury litigation,
and pre-litigation on behalf of developers and general contractors. In addition, Ms. Davies also
handles matters in the fields of premises liability, personal injury, general contract disputes,
administrative law/regulation compliance, and coverage issues. Her practice includes matters
from small pre-litigation disputes to large complex litigation. Her focus on every case is to work
with the client to determine a strategy for the matter that best suits that individual client’s needs.

Mr. Diaz joined LGP after 11 years at KB Home, where he served as Regional Counsel,
supporting divisions in California, Nevada, Arizona and Colorado. Prior to his position with KB
Home, he spent a decade as a trial attorney for various large residential homebuilders,
commercial developers, casualty insurers and public utilities. His work experience as outside and
in-house counsel provides his clients with a broad range of business and litigation expertise and
significant trial experience.
Mr. Diaz’ developed his trial experience while defending a wide variety of complex actions in San
Francisco and Denver. His trials have ranged from small, real estate disputes, to the defense of
PG&E in the Anderson litigation; made famous by Erin Brockovich. His current real estate
practice focuses on all phases of development, ranging from land acquisition and high-rise
development to homeowner, HOA and landowner litigation. His casualty practice focuses on the
representation of clients and insurers in large loss matters concerning injuries sustained both on
and off the jobsite.
Mr. Diaz has spent a career resolving conflicts and litigating matters across all aspects of property
and casualty disputes, including: Land Development (JDA disputes, easement conflicts, JV
member bankruptcy), Contract Negotiation (commercial high-rise and single-family residential),
Purchasing (trade partner contracts, indemnity, wrap insurance), Sales (contract breach, agent
commissions, escrow mistakes) and Owner Litigation (defect, mold and catastrophic injury).
Mr. Diaz provides his clients with advice and counsel on virtually all aspects of their business

securing development agreements with municipalities throughout Southern California.
Ms. Harris’ experience as a licensed California general contractor, a former co-owner of a
development/construction firm, and her work as a real estate agent, bring added dimensions to

After moving to San Diego in 2009, Ms. Miller joined the firm in 2010. Licensed in both California and New Mexico, Ms. Miller enjoys her
twentieth year of practice which has a dual focus in the areas of complex personal injury and real estate/construction. “The highest compliment from
clients is when they assume I only practice in the area of law in which I am representing them. They are surprised to hear that my practice has two
sides to it.” Her casualty practice focuses on multi-million dollar personal injury, products liability, wrongful death, and work related accidents. Her
real estate practice involves construction defect defense of master planners, developers, and general contractors with a significant focus on
common interest association cases including breach of fiduciary duty claims. The vast majority of her work includes complex multi-defendant
risk transfer and allocation, including collateral insurance coverage analysis for additional insurance issues and OCIPs.
Prior to joining LGP, Ms. Miller was a shareholder and member of the Executive Management Committee of Rodey, Dickason, Sloan, Akin
& Robb, P.A. in New Mexico. Her practice there also focused on the dual track of complex personal injury and real estate litigation. Her profession
liability practice included the defense of attorneys, physicians, hospitals, and nursing homes. However, her primary expertise was concentrated in
the professional liability defense of real estate brokers, appraisers, and inspectors. For the New Mexico State Real Estate Commission, she served
as legal defense advisor for drafting the Administrative Regulations of the Real Estate Commission and specially endorsed brokers’ insurance
defense counsel from 2003-2009. She also served as defense counsel advisor to the New Mexico Board of Realtors Forms Committee, and as
Chairperson of the ABA’s Broker and Brokerage Committee.
Ms. Miller began her trial practice in her first year as a lawyer. She has tried sixteen cases to verdict, fourteen of which were to a jury. In
2014, she tried a seven-week jury trial in the Superior Court of San Diego involving four fatalities and four seriously injured individuals. Her client
was able to limit its exposure by resolving the claim within policy limits, avoiding a $23 million dollar verdict divided evenly by the jury between her
client and the State of California’s Caltrans Division (published in the nationwide reporter "Top 100 Verdicts of 2014"). She has taught trial practice
for the National Institute of Trial Advocacy for the past ten years. Prior to that, she had the pleasure of coaching the first back-to-back state
champions of the New Mexico High School Mock Trial Program.
Ms. Miller hails from Memphis, Tennessee. She attended the University of Virginia on a full-ride scholarship for academic and leadership
achievements. After earning her law degree at the University of Richmond, she practiced law in New Mexico for fifteen years.

various litigation cases, including personal injury claims, construction defect, and mechanic’s lien
cases. He has defended his clients in disputes with state and local entities, and neighboring
property owners, in arbitrations, and in state and federal courts. In addition, he has participated in
hundreds of mediations and settlement conferences.
Prior to joining Lorber, Greenfield & Polito, Mr. Olsen practiced business, corporate, real estate,
bankruptcy, and Americans with Disability Act (ADA) litigation in La Jolla, Calif. This includes a
number of cases as counsel of record in published Federal decisions in ADA litigation.
He is one of the authors of the Construction Law Interrogatories, which is approved by the Judicial
Council of California for use in all cases.
Mr. Olsen was counsel of record, successfully arguing in the California Court of Appeal in KB
Home Greater Los Angeles, Inc. v. Sup. Ct. (Allstate) (2014) 223 Cal. App. 4th 1471, that the
builder was entitled to judgment under California’s Right to Repair Act. This decision was
published and has already been cited a number of other times in other published appellate cases.
