Moreland Boulevard. According to Stephen Holowicki, community redevelopment planner for the Buckeye Shaker Square Development Corporation, it is a tragedy for its remaining residents and a small victory for the community. Doug Williams, one of the residents, cursed the owners who had left the residents without heat during one of Cleveland’s coldest winters on record. Williams was able to find another apartment, but he said most of the elderly residents would most likely have to go to homeless shelters. “I&R Properties are the worst. Never, never rent from them,” Williams said. According to Cuyahoga County property and tax records identify the people behind Shakertown as Daniel and Deborah Inks and Gerald and Carol Reagan, with Daniel Ink listed as the president of I & R Properties. James Costello, the lawyer for Shakertown Apartments LTD (a I&R Property) wanted to put off repairs. His clients hoped to sell the property to an owner who promised to bring the buildings up to code. During the Board of Building Standards and Building Appeals, Costello provided the board with a signed purchase agreement which the board rejected. More than one property owned by Shakertown Apartments LTD is in distress and community groups from Buckeye Shaker Square Development Corporation to the Western Reserve Land Conservancy’s Thriving Communities Institute have been working together to have the buildings condemned. Another Shakertown property on Drexmore Avenue needs to be razed or immediately repaired. City officials did not grant Shakertown Apartments LTD more time, and the building was condemned. Residents were given five days to vacate the premises before the property will be boarded up. Holowicki said that since the absentee landlords had let the building fall into decay leaving many doors unsecured and crime became rampant. Costello didn’t dispute the conditions of the buildings. He said the owners just want to get rid of the buildings. Neighborhood activists complained that the unsecured building al- Gordon visits Obama concerning city schools Eric Gordon, superintendant of the Cleveland Metroplitan School District, was one of 11 U.S. superintendents and board members who as members Council of the Great City Schools were invited to meet with President Barack Obama at the White House on Monday to discuss urban education and efforts to strengthen educational opportunities for students in city schools. . The national average tends to moves higher this time of year because refineries conduct planned maintenance, which can limit fuel production. Refineries are also beginning to transition to summer-blend fuel in advance of the May 1 deadline. Gas prices should remain relatively cheap because crude oil costs are much lower than recent years and U.S. inventories have risen for nine straight weeks. The possibility of geopolitical events in major production regions is likely keep the market relatively volatile in the near term. Speculation is beginning about the agenda for OPEC’s first scheduled meeting of the year, and whether the cartel will intervene to cut oil production in order to pressure prices higher in the global market. The divergence between Brent and West Texas Intermediate, the two most cited oil benchmarks, remains approximately $10 per barrel, just shy of February’s 14-month high of $13 per barrel. At the close of Friday’s formal trading on the NYMEX, WTI fell $2.21 and settled at $44.84 per barrel. The board’s decision to reject Shakertown’s appeals means the city can prosecute the company if it fails to act soon, which will force Shakertown’s owners into Cleveland Housing Court. A sign to vacate has been posted, and according to the city, the building will be boarded up by the end of the week. Homicides on the rise with 20 in the city she saw someone in a black hoodie get out of a black car and open fire at a red car whereupon someone in the red car fired back at the person in the black hoodie. When she ran from the scene, she felt a sharp pain in her side and realized she was injured. Eight people were injured and two were killed in a violent week according to police reports. The two homicides were: Curtis Avent III, 29, who was shot and killed on a sidewalk at Aetna Road and E. 91st Street on Sunday. A passerby discovered his body, and notified police. Avent was pronounced dead at the scene. The second homicide was L’Shawn Brooks, 15, who was killed in a drive-by shootout on the corner of Lee Road and Harvard Avenue on Tuesday at 3:00 p.m. According to police, EMS transported Brooks to MetroHealth Medical Center where he died a short time later. Six other people were injured by gun violence according to police reports: One man was shot inside a Broadway Avenue Marathon gas station early Saturday and another man was shot while pumping gas after shots were fired following an argument inside the station; someone inside a dark-colored car shot three people on East 135th Street early Saturday; a man was shot in the leg outside of Club Tiko on East 93rd Street after a bar fight Saturday morning. The victim said he couldn’t identify the shooter; a 28-year-old Warrensville Heights man told police Saturday morning he heard a gunshot as he walked to his car on East 119th Street and realized he’d been shot in the leg. The man said he didn’t see who shot him; and a St. Patrick’s Day shootout injured a 17-year-old girl as she walked behind the Glenville Recreation Center, 680 E. 113th Street, at 5:00 p.m. According to the victim, She ran to the recreation center for help. EMS transported the girl to MetroHealth Medical Center where she was treaed and released. Police arrested three people, including 18 year old twin brothers, in connection to the shooting, and arrested a teenager and a 30-year-old man following separate shootings in Cleveland and Garfield Heights on Saturday. Anyone with information is asked to call Cleveland police homicide detectives at 216-6235464. According to Cleveland police, there have been 20 homicides in the city this year. Ohio House Bill 61, aimed at reducing nutrient runoff in the Western Lake Erie Basin (WLEB), has earned the support of the Ohio Farm Bureau Federation (OFBF). As legislators looked to respond to algal blooms in Ohio’s waters, Farm Bureau worked with lawmakers to improve HB 61 and make it more practical for farmers. Because HB 61 meets these goals, OFBF has designated it a “key vote” and is asking legislators to pass the measure. HB 61 will restrict the application of nutrients on frozen, snowcovered or saturated ground in the Western Lake Erie Basin while addressing two Farm Bureau priorities: farmers are allowed the necessary time to come into compliance and realistic standards are established for how farmers can operate under certain weather conditions. Also crucial to the bill gaining Farm Bureau’s support was lawmakers’ assurance that resources will be provided to help farmers comply with the bill’s provisions. Further, the bill meets Farm Bureau policy that seeks comprehensive water quality initiatives. The legislation addresses non-agricultural concerns including publicly owned water treatment facilities and dredging issues. Farm Bureau believes lawmakers achieved an appropriate balance between protecting natural resources and creating workable rules for farmers. The organization thanked Speaker Cliff Rosenberger, the bill’s sponsors, the committee chairman, committee members and other lawmakers who contributed to this important legislation. The House is expected to vote on the measure this week. HB 61 and similar legislation from the Senate will be considered by both chambers. Legacy of Naomi Adams eulogized at funeral By PAT WHITE Naomi Adams, a civil rights activist and the longest standing secretary on the board of the National Association for the Advancement of Colored People (NAACP), recently died. She was 85. Services for Adams were held at Antioch Baptist Church, and Rev. Wesley Toles officiated. Adams, who was born on January 10, 1930 in Cleveland, was the only child of the late Augustus Adams and Jessie Hobson Adams. Adams attended the Cleveland Public School System, and she graduated from John Adams High School. Following graduation, she was employed as a stenographer at the Division of Child Welfare (now Job and Family Services). Adams received a bachelor of arts degree from Cleveland College (now Case Western Reserve University) where she was an active member of the Lambda Pi Omega chapter of the Alpha Kappa Alpha Sorority, Inc. Adams worked as a supervisor in the Redevelopment Divison of the Community Development Department until her retirement in 1989. Adams Adams family was a founding member of Mount Gillion Baptist Church, and she remained a member of the church until 1961 when she joined Antioch Baptist Adams was active in her service at Antioch, and she served on its board of trustees where she served as the first female chair of the trustee board. She served the community by volunteering to read to the blind at the Cleveland Sight Center. Her most influential role was as an advocate for social change and civil rights as a lifetime member of the NAACP. According to the Environmental Protection Agency, health problems associated with poor indoor air quality include eye irritation, allergies, headaches, and respiratory problems such as asthma. These can be directly related to the presence of mold and dust mites in the home. Research has found that common household dust mites may be a factor in as many as 80 percent of asthmas, hay fevers and other allergic ailments. Along with respiratory symptoms, high levels of dust mite allergens have also been correlated with atopic dermatitis, characterized by itchy, irritated skin. Dust mites are microscopic but hardy creatures that live and multiply easily in warm, humid places. They thrive at temperatures at or above 70 degrees with a relative humidity of 75 percent to 80 percent, but, according to the American Academy of Allergy, Asthma and Immunology, you can reduce dust mites if you keep your home’s humidity below 50 percent. Mold is a fungus that feeds on organic substances and survives in moist conditions. Besides causing allergies, they produce harmful chemicals such as VOCs (volatile organic compounds) and mycotoxins. The Spring-like weather has been pleasant, but it does come at a cost. As the snow melts winter away, more potholes are popping up- some that could cause major damage to your car. Because it’s impossible to avoid all potholes, and swerving around them can lead to a crash, AAA East Central offers advice in order to protect you, and your car from potholes caused by severe winter weather. “Major winter storms have affected much of the country this season,” said Steve Popovich, managing director of automotive services. “While many cars have made it through the winter without a scratch, damage still could be done because of a pothole left in the aftermath,” he added. Potholes form when moisture collects in small holes and cracks in the road surface. As temperatures rise and fall, the moisture expands and contracts due to freezing and thawing. This breaks up the pavement and combined with the weight of passing cars, eventually results in a pothole. AAA recommends these safety tips to protect you and your vehicle: Inspect Tires – The tire is the most important cushion between a car and a pothole. Make sure tires have enough tread and are properly inflated. When checking tire pressures, ensure they are inflated to the manufacturer’s recommended levels, which can be found in the owner’s manual or on a sticker on the driver’s door jamb Inspect Suspension – Make certain struts and shock absorbers are in good condition. Changes in vehicle handling, excessive vibration or uneven tire wear can indicate bad shocks or struts. Have the suspension inspected by a certified technician if you are unsure Look Ahead – Make a point of checking the road ahead for potholes. An alert driver may have time to avoid potholes, so it’s important to stay focused on the Federal income tax refunds totaling $1 billion may be waiting for an estimated one million taxpayers who did not file a federal income tax return for 2011, the Internal Revenue Service recently announced. To collect the money, these taxpayers must file a 2011 tax return with the IRS no later than Wednesday, April 15. “Time is running out for people who didn’t file a 2011 federal income tax return to claim their refund,” said IRS Commissioner John Koskinen. “People could be missing out on a substantial refund, especially students or part-time workers. Some people may not have filed because they didn’t make much money, but they may still be entitled to a refund.” The IRS estimates half of the potential refunds for 2011 are more than $698. In cases where a tax return was not filed, the law provides most taxpayers with a three-year window of opportunity for claiming a refund. For 2011 tax returns, the window closes on April 15. If no return is filed to claim a refund within three years, the money becomes property of the U.S. Treasury. The law requires the tax return be properly addressed, mailed and postmarked by that date. There is no penalty for filing a late return that qualifies for a refund. The IRS reminds taxpayers seeking a 2011 refund that their checks may be held if they have not filed tax returns for 2012 and 2013. In addition, the refund will be applied to any amounts still owed to the IRS, or their state tax agency, and may be used to offset unpaid child support or past due federal debts, such as student loans. By failing to file a tax return, people stand to lose more than just their refund of taxes withheld or paid during 2011. Many low-and-moderate income workers may not have claimed the Earned Income Tax Credit (EITC). For 2011, the credit is worth as much as $5,751. The EITC helps individuals and families whose incomes are below certain thresholds. The thresholds for 2011 were: $43,998 ($49,078 if married filing jointly) for those with three or more qualifying children, $40,964 ($46,044 if married filing jointly) for people with two qualifying children, $36,052 ($41,132 if married filing jointly) for those with one qualifying child, and $13,660 ($18,740 if married filing jointly) for people without qualifying children. This event definitely attract a lot of attention from within the Muslim community and outside of it. Within the Muslim community it has become the topic of number of discussions and debates because of its unprecedented nature. Outside the Muslim community any story with the words Islam and women automatically becomes headline fodder. The purpose of this article isn’t to question or critique the sincerity, intentions and objectives behind the all-female Friday prayer; this is not an attack. Rather, the purpose is to explore the legal basis for having such an event and to suggest other ways of achieving the same outcome. Permissibility of women Imams in womenonly congregations: There’s a difference of opinion amongst the four schools of thought regarding whether or not a woman can be the imām of an exclusively female congregation. According to the Hanafis, Shafi’is and Hanbalis it’s permissible. The Hanafis add that although it may be permissible it’s disliked (makrūh), but the disliked nature doesn’t affect the validity of the prayer. The wording from Abdul Razzāq is that “Umm Salamah led us (women) in ‘Asr prayer and stood among us.” There are a few other narrations that explicitly mention that ‘Aisha (ra) and Umm Salamah (ra), the wives of the Prophet (saw), led women in either obligatory or voluntary prayers. Another narration that is used as evidence is the hadīth of Umm Waraqah (ra) narrated in the Sunan of Abu Dawūd, Musnad of Imam Ahmad, and Mustadrak AlHakim. Umm Waraqah (ra) said that I said, “O Messenger of Allah! Grant me permission to participate in battle with you. I’ll nurse the sick and perhaps Allah (swt) will grant me martyrdom.” He (saw) said, “Stay in your house. For very Allah will grant you martyrdom.” She sought permission from the Prophet (saw) to appoint a muadhin for her home and he granted her permission.” In another version recorded in Abu Dawūd it mentions that the Prophet (saw) used to visit her at her house. He assigned a muadhin to make the adhan for her and ordered her to lead the people of her home. According to the Malikis it’s not permissible for a woman to lead other women in congregational prayer, regardless of whether it’s obligatory or voluntary. Based on the above, according to the majority it’s permissible for a woman to be the imām of an exclusively female congregation for obligatory and voluntary prayers. The question that needs to be answered is does this ruling apply to the Friday prayer as well? Does the permissibility apply to Friday Prayer? The narrations that establish the permissibility of a woman leading other women in congregation are referring to the five daily prayers and voluntary prayers. None of them mention the Friday prayer or that ‘Aisha (ra), Umm Salamah (ra) or Umm Waraqah used to deliver the sermon. These narrations don’t refer to the Friday prayer. As a matter of fact there’s not a single narration mentioning that any of the female companions ever led or participated in an exclusive all-female Friday congregation. Similarly, there’s no narration mentioning that a female companion ever delivered a Friday sermon. This is something that has no precedent in history or tradition. The issue of precedence isn’t something that should be taken lightly. It plays a major role in formulating legal rulings. If this was something that was considered to be an accepted practice or normal there would be some evidence of it having taken place in the first three generations of Islam. There’s a generally accepted principle of Islamic jurisprudence that states that the default ruling for acts of worship is impermissibility. In order for an act of worship to be permissible there has to be some sort of textual evidence for it in the Qur’ān, Sunnah or even through ijma.’ Interestingly, the narration of Umm Waraqah is also used by a small minority to establish the permissibility of a woman leading men in congregation as well. The problem with that is first and foremost that this narration itself is considered to be weak by the experts of hadīth. According to the principles of Islamic jurisprudence a weak hadīth can’t be used as evidence for a legal ruling. Even if it’s assumed that the hadith is sound it still can’t be used as evidence for the permissibility of a woman leading a mixed congregation. The hadith mentions that the Prophet (saw) told her to lead the people of her house in prayer. It doesn’t mention who those people were. It doesn’t mention if it included males or not. There’s also another version of the narration that specifies she was told to lead the women of her house. To add to that the Friday prayer is not like any other obligatory prayer. That’s why it has a different set of conditions and rulings from sun up to sun down, but a woman’s work is never done.” I could have said that men do not lollygag around, but just get to the job at hand and gets it done. Different means to the same end: The Women’s Mosque of America states their objective as the following, “The Women’s Mosque of America seeks to uplift the Muslim community by empowering women and girls through more direct access to Islamic scholarship and leadership opportunities. The Women’s Mosque of America will provide a safe space for women to feel welcome, respected, and actively engaged within the Muslim Ummah. It will complement existing mosques, offering opportunities for women to grow, learn, and gain inspiration to spread throughout their respective communities.” The objectives and goals behind the idea are definitely noble and highly encouraged. Sisters should be empowered, inspired have access to scholarship and be in leadership positions. They should have spaces where they feel safe, welcomed and respected. These same objectives can be achieved by working with existing institutions. Most of the major Islamic Centers in SoCal are very accommodating. There are knowledgeable, powerful and inspiring female speakers, women led programs, gatherings and qiyāms, and women serving on masjid boards even as presidents. There’s been a lot of progress in the past several years to empower women and increase their involvement in local institutions. Of course there’s a lot more to be done. Also, there’s nothing wrong with having a Women’s Mosque of America. Historically, there have been all women’s mosques in places such as China as centers of learning, spirituality, gathering and worship. What is problematic is doing something that has no legal precedent. In 2002, Cheryl and John T. Gallenstein – Kentucky residents – purchased a 44-foot twin-engine boat that they docked at a yacht club in Aurora, Indiana. It was titled in Cheryl’s name. Between 2002 and 2005 they crossed into Ohio waters less than 12 times. The Gallensteins occasionally cruised upriver with guests to watch Reds or Bengals games from the boat, and to view Cincinnati fireworks. During those trips, Cincinnati police boarded and inspected their boat, reviewed documents, and then permitted them to continue. John asked the consultant why this was happening. “You’re just being harassed by the Cincinnati police,” she said. She recommended they get an Ohio sticker. So the Gallensteins applied for an Ohio watercraft registration and indicated that the boat would be principally used in Kentucky and Indiana waters. They received the sticker and a three-year registration certificate in May 2003. Afterward, they experienced no more instances of police boarding. But in 2005, the Ohio Department of Taxation audited Cheryl. She was asked for verification that she paid sales or use tax for the boat in Ohio or another state. She responded that she didn’t believe Ohio taxes were due, that the boat had never been moored in Ohio, and explained why they had gotten the Ohio registration. The tax agent informed her that docking and storing the boat in Indiana “would require you to have an Indiana registration and not an Ohio registration. You will be required to cancel your Ohio Watercraft Registration” and provide proof of its cancellation. If she failed to prove cancellation, he said, the state would pursue the use tax due. Cheryl tried to cancel the Ohio registration without success. She informed the tax agent that the Ohio Department of Natural Resources staff advised her that “the only way to cancel a registration is not to renew the registration upon its expiration.” The agent replied that Cheryl’s response didn’t satisfy the state’s request for proof of tax paid. Thus, in November 2005, the tax commissioner assessed a use tax of $12,000, a $1,800 penalty, and $1,252.93 in interest for the audit period May 1 to June 30, 2003. Cheryl petitioned for reassessment and requested remission of the penalty and interest, asserting that any use of the boat in Ohio constituted “transient use” as defined by law. But the commissioner affirmed the tax, penalty and interest, and determined that Cheryl’s use of the boat in Ohio, combined with her declaration of Cincinnati as the boat’s hailing port and the boat’s Ohio registration, “created nexus between the boat and Ohio” and that she didn’t qualify for the transient use exception. Cheryl appealed to the Board of Tax Appeals (“BTA”), asserting that the commissioner erred by assessing the use tax and by not applying the transient use exception because, she claimed, she “had no substantial nexus with Ohio.” But the BTA affirmed the commissioner’s decision. After that, Cheryl appealed to us – the Ohio Supreme Court. She argued that her registration in Ohio wasn’t sufficient to create a taxable nexus and that she met all the requirements of the transient use exception. The tax commissioner argued that Cheryl’s use of the boat in Ohio waters and the Ohio registration made the boat subject to the use tax, which is a tax “on the storage, use, or other consumption in this state of tangible personal property ...” But there are exceptions. The transient use exception exempts tangible personal property that was “purchased outside this state for use outside this state and is not required to be registered or licensed under the laws of this state.” The BTA ultimately concluded that Cheryl had not established that she wasn’t required to register her boat in Ohio. The law dealing with items that require registration also lists the exemptions from registration. In reviewing this law, we determined that registering a boat in Ohio is not the same as being required to register a boat in Ohio because the law exempts from registration watercraft that have been documented by the Coast Guard as “temporarily transitting.” But the term “temporarily transitting” does not appear in the Coast Guard federal regulations. When the Ohio legislature enacts a law, a just and reasonable result and a result feasible of execution is intended. In this case, because the term “temporarily transitting” does not appear in federal regulations governing the Coast Guard’s documentation of vessels, we determined that the BTA unreasonably and unlawfully interpreted the law when it stated that “we find no evidence” that the Coast Guard has documented the boat as “temporarily transitting.” To require Cheryl to show that her boat has been documented as temporarily transitting by the Coast Guard when the Coast Guard doesn’t even issue temporary transitting endorsements is unreasonable because no one could qualify for this exemption. Furthermore, despite her best efforts, Cheryl wasn’t able to cancel her Ohio registration as ordered by the tax department. And assessment of a use tax on that basis is also unreasonable. From 2002 through 2004, Cheryl operated her boat in Ohio waters fewer than a dozen times. We concluded that it was unreasonable to assess more than $15,000 in taxes and penalties on a Kentucky resident who purchased and harbors a boat in Indiana and who chose to register it in Ohio to reduce the chances of police boarding it on the few occasions she operated it in Ohio waters. Because the BTA acted unreasonably and unlawfully in affirming the tax commissioner’s use tax, we determined – by a four-tothree vote – to reverse its decision. After that, it’s about encouraging teens to get a jump on their job search. The recent job market for American teens has been tough and investigating particular kinds of openings should start months in advance of summer hire. Networking is also important – teens can reach out to friends, neighbors and other trusted adults about po- tential jobs in the community. Also, it is never too early for teens to learn resume writing and job interviewing skills. Technology changes quickly, so tech-savvy teens may be ahead of the game when it comes to searching for work online. Leading job search engines are a destination for seasonal job openings, and many allow users to customize searches for specific positions and employers. However, teens may need to be reminded about their social media activity before they begin any job search – anything a teen posts publicly on the Internet may be seen by a potential employer. Many people don’t understand their withholding even as adults, so children can benefit greatly from this lesson at the start of their working lives. A: Collective bargaining is the negotiation of matters regarding employees’ wages, benefits and other terms and conditions of their employment. Collective bargaining occurs between the employer’s representatives and the union, which the employees have selected to be their exclusive bargaining representative. Q: What law governs collective bargaining? A: Most private employers are covered by the National Labor Relations Act (NLRA), which is enforced by the National Labor Relations Board (NLRB). Some businesses in the railroad and airline industries are covered under the Railway Labor Act, and some very small enterprises may not be covered at all. Civil servants in the federal government are covered by the Civil Service Reform Act, and state, county and municipal workers fall under state or local laws. Postal workers are covered under the Postal Reorganization Act, the NLRA and the Labor Management Relations Act. Public employers are also governed by the state’s collective bargaining law, which, in Ohio, is enforced by the State Employee Relations Board (SERB). State collective bargaining laws limit the right of certain workers, such as police and firefighters, to strike. These workers are subject to final offer arbitration, known in Ohio as conciliation. Q: What must be included in a collective bargaining agreement? A: The law does not dictate contract terms, and neither the NLRB nor SERB will impose terms upon the parties without their agreement. Rather, the law provides a framework so management and labor can negotiate a contract governing wages, hours and working conditions. The law limits the unilateral power of employers, protects workers’ rights to organize and engage in “concerted activity for mutual aid and protection” and prohibits discrimination against workers who exercise these rights. Q: What does it mean to bargain “in good faith?” A: It means that the parties must negotiate with honest intentions about the wages, hours, terms and conditions of employment and provisions of a collective bargaining agreement. Good faith is mutual obligation to meet at reasonable times and places, and to bargain with the intention of reaching agreement or resolving contract questions. “Hard bargaining” (taking a strong position on an issue) does not violate the law, but the following approaches constitute bad-faith bargaining and do violate the law: Surface bargaining (going through negotiation motions without intending to reach an agreement); a “take-it-or-leave-it” approach; and refusing to meet, delaying meetings or failing to give the chief negotiator sufficient authority to make agreements. If either party fails to bargain in good faith, the other may file an unfair labor practice charge. Good faith is determined based on the totality of circumstances. Q: Must an employer bargain with the employee’s union over everything? A: No. The law recognizes these three types of bargaining subjects: Mandatory subjects involve issues of wages, hours and working conditions. The parties have to bargain over mandatory subjects. Permissive subjects involve subjects other than wages, hours and working conditions (e.g., ground rules for negotiations, settlement of unfair labor practice charges or pension benefits). These may be voluntarily discussed but cannot be bargained to impasse, and either party may refuse to bargain over a permissive subject. If the parties do reach agreement on a permissive subject and incorporate it into a collective bargaining agreement, then they must abide by that agreement. Illegal subjects include any proposal that violates National Labor Relations Act (NLRA), the Public Employees Relations Act (PERA), the Civil Service Reform Act (CSRA) and/or any other federal, state, county or municipal law. Illegal agreements/provisions are void and cannot be enforced. Q: May an employer change employment conditions during bargaining? A: No. Employers must maintain the “status quo” regarding existing wages, hours and working conditions, even if a contract has expired—unless there is an impasse in negotiations. An impasse means that neither party is willing to compromise further to reach an agreement. If a legal impasse has been reached on an issue, the employer may then unilaterally impose on its employees its last offer regarding that issue. For certain public employees (e.g., police and firefighters), the employer must maintain the status quo until an agreement is reached, either mutually or through conciliation. Road trip good for Cavs with wins By KARL BRYANT The Cavaliers started their time in Texas by giving an old-fashioned whuppin to Dallas, but then had to survive in overtime against San Antonio, riding Kyrie Irving’s 57 points to victory. They next moved to the Southeast, where they beat Orlando handily, but then headed down to South Florida, where they came up short vs. Miami. With a 3-1 road trip, the Cavs stayed in 2nd place in the Eastern Conference. After the easy win in San Antonio, the Cavs had to fight tooth and nail, courtesy of Irving, to tie the Spurs at the end of regulation. Irving hit two treys in the final 30 seconds, including one at the buzzer to tie the game at 110all. He then scored 11 points in OT to lead the Cavs to the 128-125 victory. Irving was unconscious throughout – going a perfect seven for seven from the perimeter and another perfect 10 for 10 from the Charity Stripe. Overall, Irving was 20 of 32 from the field. Irving’s 57 points was a high for the NBA season and broke LeBron James’ team record of 56. Speaking of James, he was no slouch – scoring 31 points on 10 of 20 shooting. Tony Parker also scored 31 while leading the Spurs. After the game, Spurs Coach Gregg Popovich gushed about the first player to score 50 points on one of his San Antonio teams, “Kyrie Irving was unstoppable. I don’t know how to guard that.” A couple of days later, the Cavs manhandled Orlando, and Irving poured in 33 points just to show he’s the real deal. Irving was 12 of 15 from the field, but he did miss a three (5 of 6) and a couple of foul shots (4 of 6). J.R. Smith had 25 points and James added 21 to go with 13 assists. Victor Oladipo led the Magic with 25. The Cavs made 59.2% of their field goals and 51.4% of their treys in the 123-108 win. All good things must come to an end, which the Cavs road winning streak did with a thud against James’ team the last four years, Miami. Kevin Love was missing his second straight game, the Heat, who are fighting for their playoff lives – tied for the final spot, took advantage of it inside. They outrebounded the Cavs, 45-32, and outscored them in the paint, 44-32, in their 106-92 win. Akron’s women basketball join CSU, YSU in WNIT By ANDREW CARTER The Youngstown State and Cleveland State Women each lost in the Horizon League Tournament Semifinals, but secured bids to the Women’s National Invitational Tournament. Akron, which got uncharacteristically clobbered in the quarterfinals of the MidAmerican Conference Tournament at Quicken Loans Arena, also received a WNIT bid. CSU lost to Wright State, 99-87, in the first semifinal in Green Bay. WSU was up by 19 at the half and let CSU get no closer than nine points the rest of the way. Kiersten Green scored 21 points to lead the Lady Vikings and Alexis Eckles added 17, while grabbing a whopping 19 rebounds. Tay’ler Mingo scored 27 points to lead the Raiders. In the nightcap, Youngstown State, which had been annihilated in their last regular season matchup against Horizon League regular season champ WisconsinGreen Bay, fell behind by 16 at the break, but kept cutting into the lead in the 2nd half. The Penguins got to within a possession with 3:25 Al Rosen, who played third base for the Cleveland Indians and who was unanimously named the American League’s most valuable player in 1953, when he came within a hit of winning the batting triple crown, died on Friday in Rancho Mirage, California. He was 91. Rosen led the American League in home runs twice before he retired as a player in 1956. Rosen was the president of the Yankees in the late 1970s and the president and general manager of the Houston Astros and the San Francisco Giants. He helped to build the Giants to win the 1989 pennant. In the early and mid1950s, Rosen joined with the lefty-swinging Luke Easter and Larry Doby to provide the muscle in Cleveland’s lineup. Rosen led the league Rosen in home runs twice as well as runs batted in twice. He played in the All-Star Game every year from 1952 to 1955. Rosen is known for his 1953 season, as he led the league in home runs with 43 and runs batted in with 145 while batting .336. In 2006, he was inducted into the Indians Hall of Fame. Al Rosen dies; at 91 left to play, but Green Bay gradually increased their lead until reaching the final 63-54 margin. Heidi Schlegel led YSU with 19 points and Kaili Lukan led WGB with 27. Eventual Horizon League Tournament Champion Green Bay (28-4) will play undefeated Princeton (30-0) in the 1st round of the NCAA Tournament. CSU (19-12) received a bid to the WNIT and will play at Michigan (16-14). Also receiving WNIT bids, were YSU (2110), who will host Duquesne, and Wright State (25-8), who will play at Toledo (18-13). Akron (22-8), which was throttled, 95-66, by Eastern Michigan in the MAC tourney, received a bid to the WNIT and will play Kansas State (18-13). Five other MAC schools – Buffalo, Ball State, Eastern Michigan, Western Michigan, and Toledo also received WNIT invites. MAC Tournament Champion Ohio University will play Arizona in a 1st Round NCAA Tournament game. Dwyane Wade led Miami with 32. Hassan Whiteside grabbed 11 rebounds, while scoring 16 points. Irving was a bit off on 5 for 15 shooting, yet scored 21 points. James led the Cavs with 26. The Cavs now return to Quicken Loans Arena for a couple of home games, before taking to the road again. They have only five home games in March due to the just-completed exciting Mid-American Conference Tournament and the upcoming NCAA Midwest Regional Tournament. Kyrie Irving named ‘Player of the Week’ The NBA announced Monday that Cleveland Cavaliers guard Kyrie Irving has been named the Eastern Conference Player of Week for games played Monday, March 9, through Sunday, March 15. This marks the second time this season Irving has earned Player of the Week accolades, as well as the fourth time in his career. It is also the 48th time in team history a Cavs player has won the award. Irving led Cleveland to a perfect 3-0 record last week, averaging a team-high 37.3 points on .633 (38-60) shooting from the field, including .867 (13-15) from the three-point line, .885 (2326) from the foul line, 4.0 rebounds, 4.7 assists and 2.3 steals in 38.7 minutes per game. No other player in the East averaged more than 30.0 points besides Irving, who led the NBA in points per game, total points (112) and tied for first in field goals made (38) last week. After beating the Suns on March 7, 79-89, the Cavs continued their winning on the West Coast by beating Dallas, San Antonio and Orlando. In a nip-and-tuck defensive battle, the Zips had taken a two-point lead with seconds left and Kent quickly got the ball downcourt and Kris Brewer started to drive for the tying basket through a scrum, but slipped, and as he hit the floor, threw the ball underhand back behind his body to Devareaux Manley, who shot the ball from beyond the arc. The shot went in, but unfortunately for KSU, came a hair after the final horn sounded. The officials watched the video-review of the bang-bang play, which corroborated that the basket was late. In the defensive struggle, each team was held to 34% shooting from the field. Although Akron made just five of 24 perimeter shots, Kent made a paltry two of 17, including an ohfer in the 2nd half (0 of 9), so can look to that as reason for the loss. Jimmy Hall, who fouled out in the final seconds, led the Golden Flashes with 14 points. Brunswick’s Pat Forsyth led the Zips with 12 points. Playing KSU in this nailbiter and having played and beaten Northern Illinois and Western Michigan in preliminary rounds to get there, the Zips ran out of gas in the semifinals, and lost to MAC East co-titlist Buffalo, 68-59. Boxing Nostalgia By JIM AMATO Jose Legra should be in the Hall of Fame He was a two time world champion and a perrenial contender for the featherweight title for more then a decade. In a 15 year career he amassed 150 fights. He won 134 of them. At one point in his career he reeled off more than 50 straight wins. Are these the credentials for a future Hall Of fame inductee ? Born in Cuba in 1943, Legra turned pro in 1960. Although active, most of his early fights took place in Cuba and Mexico. He made his first appearance in Spain in 1963. It is there that he decided to live and ply his trade. He was tall, lean and very fast. He would befuddle his opponents with his grace and boxing skills. He would emerge as a serious threat for world honors. In 1965 Legra took a big step up meeting future champion Howard Winstone of Wales. The vastly talented Winstone defeated young Jose during ten rounds. Legra would not lose again until 1969. Some 50 plus bouts later. On Legra his march to a title fight Legra would defeat the likes of Love Allotey, Rafiu King, Don Johnson, Yves Desmarets (for the EBU title) and Joe Tetteh.This led to a 1968 title shot against the newly crowned WBC featherweight titleholder, Howard Winstone. The rugged Winstone had failed no less then three times to dethrone the great Vincente Saldivar. All three were great battles. Finally when Saldivar retired Winstone was matched with Japan’s worthy Mitsunori Seki for the WBC version of the vacated crown. Winstone finally cashed in halting the game Seki in round nine. Now it was Legra’s turn. It was sweet revenge for Jose as he dropped Winstone twice in the first round and damaged Howard’s eye badly enough to force a stoppage in round five. Legra’s first tenure as champion would not last long. In 1969 after two non title victories he was outscored by Australia’s under rated Johnny Famechon. Six months later Jose would drop a ten round fight to the returning Vincente Saldivar. This set up Saldivar recapturing the crown by outpointing Famechon in a great fight. Saldivar would then be stopped by Japan’s Kuniaki Shibata in a major upset. In another upset Shibata would be flattened by Mexico’s Clemente Sanchez. Meanwhile Legra won the EBU title by defeating Jimmy Revie. Then in a shocker he was taken out in four by Tahar Ben Hassen. Legra would rebound with EBU defenses against Giovanni Girgenti, Evan Armsrtong and gallent Tommy Glencross. Legra then suffered a 1972 upset decison loss to Jonathan Dele. He added one more EBU defense against Daniel Vermandere and was set to face then WBC champion Sanchez. The champion Sanchez lost his title on the scales but since Legra made weight he made the most of his opportunity and won the crown a second time via a tenth round stoppage. In 1973, Legra lost his championship to the legendary Eder Jofre. Later that year he was stopped in one round by future legend Alexis Arguello. Legra finished his career with a 1975 verdict over Daniel Valdez. His record of 134-12-4 speaks for itself. He met some of the greatest featherweights of his era. Saldivar, Jofre, Famechon, Winstone and Arguello. He was a major player at 126 pounds for what seemed like forever. YesConsidering some of the inductees that are enshrined in the IBHOF. A fourth brother, Jone (born 1911), played guitar and sang bass in the group until his death in 1935 when his father, John Sr. (d. 1967) replaced him.
