Celebrate the Season
with SABA & SABF —
help support the Bexar
County Children’s Court!
On Thursday, December 9, come enjoy a special
meal with the San Antonio Bar Association and the San
Antonio Bar Foundation at our annual holiday luncheon with special guest speaker, U.S. District Court for
the Western District of Texas Chief Judge Fred Biery!
Attendees are encouraged to bring an unwrapped, new or gently used toy for the Children’s
Court on the third floor of the Bexar County Courthouse. In addition to stocking the children’s educational/play room with toys, computers and Internet
access so that children can keep up with their schoolwork, the Children’s Courts also have an ongoing
need for children’s toys and gift items. If a child is enthralled with a book or has fallen in love with a stuffed
animal, that item is given to the child upon departure.
Each child who goes through the court system is also
given a gift bag containing age-appropriate toys,
snacks and books. There is a particular need for gift
items for older children, such as books, craft supplies
and gift cards. If you’d prefer to give a monetary gift,
please make it payable to SABA, and we will use the
money to purchase gift cards to be used in these gift
bags. Please help us make this our best toy drive yet!
All attorneys who volunteered to “Just Take
One” pro bono case through the Community Justice
Program in 2010 are invited to enjoy a complimentary
lunch at the holiday luncheon. In order to attend free
of charge, you must RSVP on or before December 8
and identify yourself as a CJP volunteer attorney.
The luncheon will take place at the Plaza Club,
located on the 21st floor of the Frost Bank Tower.
The cost to attend is $22 for members and $30 for

President’s Message
Christmas Magic
December was always my favorite time
of the year as a child because it meant that all
the wonders and joys of the Christmas season
were finally here. In fact, one of my most
vivid memories is lying in bed awake at night
counting down the days till Christmas morning.
Back then, our family had very little money but
my wonderful mother somehow worked her
magic so that Christmas morning included an
array of toys and goodies. I could hardly wait.
December remains a special time for me because
I love the kindness, compassion and goodwill
associated with this time of year. Lawyers can
be especially generous. Just look around and
you will see lawyers spearheading a project or
otherwise contributing in a meaningful way.
Adopt a Soldier
Attorney David Stephenson and his lovely
wife Mary organize three dozen volunteers to
send care packages to a military unit, the 2-17
Cavalry Regiment of the 101st Airborne, currently
stationed in Kandahar, Afghanistan. This
particular unit’s primary purpose is to fly
rescue missions in a two-man Kiowa helicopter,
probably one of the most dangerous assignments
of the war. As described in the September
2010 issue of Men’s Journal, “Our job is to put
ourselves between the infantry and the enemy,”
explains Chief Warrant Officer and Kiowa
pilot Krystian McKeown. “If we aren’t getting
shot at, we’re not doing our job.”
Because of their mission, Mary and David
Stephenson wanted to recruit a pen pal for each
and every soldier in the unit. Therefore, they
kept asking people to join their project until
they had 36 volunteers from throughout the
community. The group sends care packages
every two months. Most items sent are directly
for the soldiers; however, the solders have also
requested items that they can use as gifts for the
Afghan children. Small soccer balls and lined
journals with colored markers are especially
popular. “Our next ship date is November
21st so we’ll send home-baked goodies and hot
chocolate and strings of Christmas lights, things
that will hopefully be welcome reminders of
the approaching holidays,” says Mary. “We also
send letters or cards each time we ship. Most
of the troops don’t send a reply, but that’s not
what’s important. I think they need to know that
someone is thinking about them, and that we’re
so grateful for the sacrifices they make every day
to keep the rest of us safe. This has been our very
small attempt to make life a little easier for the
brave men and women who risk so much.”
Toy Drive for the Children’s Court
The San Antonio Bar Association hosts
an annual toy drive for the Bexar County
Children’s Court. Donations of toys or cash
are accepted at the bar offices and during
the December monthly luncheon. Toys are
then donated to Judge Richard Garcia and
Judge Charles Montemayor and their staff
to distribute to children involved in child
protective service cases. The goal is to
provide a book or toy as a gift to each child
involved in a courthouse hearing.
Urban Connection
The Mexican American Bar Association
continues their four year tradition of
networking with Urban Connection, an
organization that seeks to provide strong,
supportive community for the residents
of the San Antonio Housing Authority
properties. MABA matches families living
on the city’s Westside with MABA members
volunteering to provide Christmas gifts and
other necessities such as coats and shoes.
Food Drives
The San Antonio Young Lawyers will host
their 4th Annual Christmas Party and Canned
Food Drive to benefit the San Antonio Food
Bank in mid-December. In the past, this event
has collected hundreds of canned food items
and money for donation to the San Antonio
Food Bank. For every dollar donated several
meals can be purchased by the food bank.
Purses, Pearls, Pumps and Portfolios
The Bexar County Women’s Bar
Association plans to collect the 4 “P”s for
Dress for Success (purses, pearls, pumps and
portfolios) for donation to Dress for Success,
an organization that promotes the economic
independence of disadvantaged women.
The BCWBA also collects toiletries for the
San Antonio Rape Crisis Center. President
Christine Reinhard says, “We’ve been
gathering some sort of item to donate to a
deserving charity each year at our Holiday
Luncheon for as long as I can remember, and
this year will be no exception to that tradition.”
These are just a few examples of how
our legal community gives its time, talent and
money. Other generous souls among us wrap
gifts for Elf Louise, donate to the Battered
Women’s Shelter, provide “Angel Food,”
sponsor the Mission Road Ministries’ fundraiser
(serving developmentally challenged children
and adults), staff the Bexar County Detention
Ministries’ holiday party (for children with a
parent in custody), donate to the St. Vincent de
Paul Bistro at Haven for Hope (serving over 700
meals daily to the homeless of San Antonio),
or host a lonely soldier for Christmas dinner.
I applaud each lawyer who works their own
Christmas magic in our community by focusing
on children, family, generosity and good will.
Heaven knows there is no shortage of need.

‘11 Joe Frazier Brown,
Sr. Award!
Joe Frazier Brown, Sr.
Award of Excellence
Nominations are now being accepted for
the Joe Frazier Brown, Sr. Award of Excellence, created in 1994 for the purpose of recognizing an outstanding lawyer in the community. The award was established as a long-term
tribute in honor of Joe Frazier Brown, Sr., who
had a distinguished career and also taught
and influenced many attorneys throughout
the years. He was the 150th District Court
Judge from 1957 until 1963 and president of
the San Antonio Bar Association from 1964
until 1965. Judge Brown died in 1993.
The award recognizes an attorney (or
attorneys) who exemplifies all that is good
about our profession. He or she should demonstrate the highest level of professionalism,
exceptional skills as a counselor and advocate and such personal attributes as honor,
integrity, service and intelligence. He or she
should be a model of the Texas Lawyer’s
Creed and an inspiration for others in serving our clients and fulfilling our responsibility to the legal system. The first winner of
the award was Solomon Casseb, Jr. in 1994,
and last year’s winner was Charlie Butts.
The Joe Frazier Brown, Sr. Award of Excellence will be presented to the recipient(s)
at the annual Law Day luncheon in May of
2011. Names of all recipients are permanently on display in the San Antonio Bar
Association offices, located on the fifth floor
of the Bexar County Courthouse.

has been selected as
the 2010 American Bar
Association National
Outstanding Young
Lawyer Award recipient, which recognizes
an ABA young lawyer
in good standing who
exhibits: professional excellence; service to
the profession and the bar; service to the
community; and/or a reputation for or the
advancement of legal ethics and professional responsibility. Other finalists included
Jessica King of Wisconsin and Amanda Sansone of Florida. David was selected among
numerous other attorneys from across the
country for his tireless efforts in improving
our profession, his numerous contributions
to our local community and his willingness
to help all those who are in need.
A shareholder with the firm Langley &
Banack, Inc., Dave works primarily in their
litigation section, focusing on employment
and general litigation law. He has served
the San Antonio Bar and community since
graduating from law school. As a director and later as President of the San Antonio Young Lawyers Association, he worked
diligently to increase membership numbers
and participation. Dave also serves as an
officer on the San Antonio Bar Foundation,
member of the local William S. Sessions
Inns of Court, and director on the Habitat
for Humanity Board of Directors.
Dave will be presented this award at
the ABA Midyear Meeting on Saturday,
February 12, 2011 in Atlanta, Georgia. On
behalf of the San Antonio Bar Association, congratulations, Dave! You make the
San Antonio legal community proud!

Texas Chapter of National Academy of
NACDL Mid-winter
Distinguished Neutrals Launches New
Meeting coming to
Website for Local Firms,TexasNeutrals.org
The NADN is pleased to announce the
launch of our new Texas chapter, the Texas
Academy of Distinguished Neutrals (TADN).
The Texas Academy is an invitation-only statewide association whose membership consists
of mediators and arbitrators distinguished by
their hands-on experience in the field of civil/
commercial conflict resolution and by their commitment to the practice of alternative dispute resolution.
Just 47 attorneys and
judges have been recognized as Charter Members
of the Academy, including a
majority of the state’s most
widely-accepted ADR professionals across all regions
of the state. The Texas chapter has an appointed executive committee of 4
prominent ADR luminaries: Will Pryor (Dallas), Gary McGowan (Houston), Karl Bayer
(Austin) and Don Philbin (San Antonio).
The Academy’s new website is specifically designed to “make life easier” for Texas
attorneys, corporate counsel, adjusters and
perhaps most of all for law firm support staff.
TexasNeutrals.org allows firms to quickly find
a suitable neutral by identifying their preferred
metro-region and dispute type, navigating
straight to a roster of trusted local neutrals. A
majority of the Academy’s members also publish their availability calendars online for the
benefit of clients. This allows the selection of
a neutral and the scheduling of appointments
to be greatly expedited for all parties involved.

database, already in wide use in several other
states but particularly in Florida, where the
software was developed for the local litigation
community. Widely utilized by local law firms,
the Florida Circuit-Civil Mediator Society
(FCCMS), a top-tier association of over 200 of
Florida’s full-time mediators,
receives over 20,000 mediation
bookings each year since 2008.
The National Academy
of Distinguished Neutrals
(NADN) is a national association whose membership consists of mediators and arbitrators distinguished by their
hands-on experience in the
field of civil and commercial
conflict resolution. NADN was
established in 2009 following a conference of
the committees of 5 regional ADR (Alternative
Dispute Resolution) associations from Florida,
California, Georgia, North Carolina and Tennessee. As of August 2010, the association has
over 600 top-tier ADR attorneys and judges confirmed as charter members across more than 40
states, making it the largest online roster of experienced neutrals in the nation. Membership to
the Academy is by invitation-only, with a strict
peer-nomination vote and extensive client-interview vetting procedure, intended to ensure
that only the top 5-10% of qualifying practitioners in each state are invited to join the network.

The Community Justice Program’s November 13 Veterans Clinic was a wonderful success
and a great way to honor Veterans Day — as well as participate in the Texas Lawyers for

We would like to give special thanks to Pat Barsalou with the Attorney General’s Office, VA
Benefits Counselor Jim Sampson, and Monica Bonilla with Catholic Charities for their time and

Bar Auxiliary who donated 100 dozen homemade cookies! They were delicious and a very welcome treat to all of the clients and volunteers. About half of those cookies were delivered to patients in the VA Hospital after the clinic, who were both emotional and delighted by the gesture.

The 2010 CJP Pro Bono Awards, in recognition of National Pro Bono Week, were given out at the October
SABA luncheon at the Frost Bank Plaza Club. The awards are given to the individual attorney and
the firm or organization that took the most cases during the past 12 months, as well as to a person or
organization that has made great contributions to pro bono efforts. This year the winners are:
• CJP Outstanding Volunteer Lawyer: Tammy Wincott for taking 19 pro bono cases through the CJP.
• CJP Outstanding Firm/Organization: Cox Smith for taking 20 pro bono cases through the CJP.
• CJP Excellence in Pro Bono Award: Allan K. DuBois for his work to establish the Veterans Clinics and continued
contribution to furthering pro bono efforts in our community.

In December 2009, Senator Jeff Wentworth
asked the Task Force on Indigent Defense to conduct
a full assessment of Bexar County’s indigent defense
processes. The work has been and compiled and is
available for viewing on the San Antonio Bar Association website at www.sabar.org. The purpose of
this request and assessment was to determine the effectiveness of Bexar County’s indigent defense processes and to determine whether local processes are
in compliance with the Fair Defense Act. The Task
Force, in collaboration with the Office of Court Administration, interviewed representatives from various departments in the criminal justice system, observed a variety of court proceedings, and examined
indigent defense records to determine whether local
processes and practices comported with the requirements of the Fair Defense Act and Task Force rules.

SA Bar Auxilary lends support to Haven for Hope,
CASA and the CJP Veterans Day Clinic

The San Antonio Bar Auxiliary had a remarkable day touring the
Haven for Hope on Tuesday, October 26. Upon arriving, the Auxiliary
members donated outerwear for the residents to help them stay warm
this winter. Volunteers graciously reviewed the background and campus of the facility and then took two groups of Auxiliary members on
a tour. Everyone who attended was overwhelmed by the services the
Haven for Hope provides to the homeless and others, from medical care
to job skills to GED preparation as well as basic necessities for living.
At lunch, Tiffany Denson from CASA thanked the Auxiliary for
its participation in the Angel Tree program last year and provided a
new Angel Tree for this year. Members will choose teenage angels to
provide gift cards to for a Christmas shopping spree led by CASA.
The Auxiliary will meet at the home of Virginia Van Cleave on Sunday
afternoon, December 5, to socialize and wrap the gifts for CASA teens.
On November 13 in honor of Veterans Day the Auxiliary provided about 100 dozen cookies for the Community Justice Clinic at
Audie Murphy Veterans Hospital. The cookies were enjoyed by the
veterans and volunteer lawyers who operate the clinic.
This is truly a season of thanksgiving for the San Antonio Bar
Auxiliary as they open their hearts to those in need.

The Paralegal Division of the State Bar of
Texas is requesting that paralegals across the
State of Texas participate in a salary survey.
Beginning on November 15, 2010, all paralegals will have access to the salary survey via a

District Courts COMMITTEE
On November 4, 2010, the District Courts
Committee held its monthly meeting. The
members welcomed Judge Gabriel, Judge
Noll and Judge Arteaga, and several new
members. Regarding the courthouse update,
the election results were covered briefly. At
next month’s meeting, we should have a
report on the courtroom locations for newly
elected judges and any moves by current
sitting judges. The District Clerk is scheduled
to move to the Justice Center II tower
beginning November 19 and a grand opening
of the new building is set for December 8 at 10
a.m. It is unknown when the District Clerk’s
satellite office will begin operating.
The Committee congratulated the
attorneys or their firms who received
awards at SABA’s monthly luncheon in
October: Tammy Wincott for taking 19 CJP
cases over the last year; the Cox Smith law
firm for taking the most CJP cases; and
Allan Dubois for receiving the Excellence
in Pro Bono Award. In October, eight DCC
members also volunteered on short notice
to take a second CJP case.
Judge Noll spoke on the Veterans Clinic
and Veterans Court programs and how these
programs will help our veterans. Five DCC
members volunteered to participate at the
November 13 Veterans Clinic, which seeks
100 attorney volunteers to provide advice to
100 veterans at this one-day clinic. Beginning
February 2011, and for each month through
October, the Veterans Clinic will be held on
the third Friday of the month, from 2 to 4
p.m., at the Audie Murphy Veterans Memorial
Hospital. In November, the Veterans Clinic
will be held on the second Friday of the month.
The District Courts Committee volunteered to
participate at the Veterans Clinic each April.
The members held a group discussion
regarding attorneys setting multiple hearings
at the same time and causing the opposing
attorney to sit around and wait. The majority
of the members said multiple settings did
not occur that often or when they do occur
they generally do not cause undue delay.
Several members commented multiple
setting seemed to be attorney specific, while
others commented that it seemed to happen
more frequent with family law cases. The
judges recommended instances of undue
delay be brought to the Presiding Court
judge’s attention immediately in order to
resolve the issue. The Presiding Court judge
can make a phone call to the other court to
determine whether the attorney is actually in
that other court and when the attorney will
return to Presiding Court. If the attorney
causing delay cannot be found, the Presiding
Court judge has the discretion to enter an
appropriate Order, including granting or
denying the motion that was set for hearing,
or assessing attorney’s fees against the
party or attorney who caused the delay.
Addressing an incident of undue delay
when it occurs should deter that attorney
from causing future instances of delay. The
members were encouraged to raise the issue
with the Family Law Section or to form a
subcommittee to determine whether the
issue merited further analysis or discussion.
The second group discussion involved
the issue of attorneys who announce a
particular judge heard a “similar motion” (but
it’s not similar) and then ask the Presiding
Court judge to assign the case to the same
judge every time. When it is apparent from the
announcements that an attorney incorrectly
claims a motion is similar to a prior motion,
the Presiding Court judge will assign the case
to a different judge. The Presiding Court
judge does not want any party to attempt
to control the assignment of a hearing to a

will do his/her best to make a decision on
how best to assign a hearing, without having
to rehash all of the prior events and issues in
a case. All assignments are made with the
intent that the parties will obtain a just, fair
and impartial adjudication of the matter while
at the same time maintaining the efficiency of
the Presiding Court docket system.

to celebrate everyone’s successes over the
past year and year to come. The meeting is
