County Council 4 WHITE YOUNG GREEN ENVIRONMENTAL 0.0 EXECUTIVE SUMMARY Aims and Objectives Site Location Current Site Status Geology Hydrogeology Hydrology WYGE 2006 Investigation Works The purpose of this investigation was to assess the prevailing condition of soil, groundwater and land-gas underlying the site. This has been completed in order to provide an evaluation of potential ground contamination risks associated with soil, water and land gas at the site and to assess the impact of the encountered ground conditions on future site use and the potential for any remedial works that may be required. The site is located in the southern areas of Aldershot, approximately 1 km from the town centre at National Grid Reference SU868496. The site is currently disused. It is understood that the site is proposed for residential use with gardens. Our review of the British Geological Survey (BGS) Map (Sheet 285, Scale 1:50,000) indicates that the site is underlain by the London Clay Formation. However, as the southern portion of the site and the area immediately to the south of the site have historically been excavated as a clay pit and more recently backfilled as a refuse tip, it is considered likely that Made Ground may be present on site. The Environment Agency Groundwater Vulnerability Map (Sheet 45, West Sussex & Surrey; Scale 1:100,000) indicates that the underlying London Clay Formation is classified as a non- aquifer. The nearest identified surface water features to the site are a few surface drains and ponds located to the south of the site within the Brickfield Park area. The nearest surface water feature, classified by the Environment Agency, to the site is the Blackwater River and associated ponds. The EA classifies the Blackwater River and associated ponds as River Quality ‘D’ at a location approximately 650m to the south-west of the site. Investigation works at the site were undertaken between the 31st May and 2nd June 2006. The investigation comprised the following scope: ♦ 3no.cable percussive boreholes and 7no. machine excavated trial-pits. ♦ Completions of 2no. return groundwater and land gas monitoring visits. ♦ Laboratory chemical and geotechnical testing of soil and groundwater. The chemical analysis carried out indicates that shallow soil in localised areas beneath the site has been impacted by hydrocarbons. The analysis also indicates that groundwater beneath the site is impacted by hydrocarbons and heavy metals. However, the concentrations identified are only slightly above our Tier 1 Screening Criteria. Significant concentrations of land-gas were not identified in the installed monitoring well at the site. Risk Assessment The overall risk, associated with the identified contamination at the site, is considered to be of a Low order. Conclusions and With the above information in mind and in the context of the proposed use of the Recommendations site, it is unlikely that a QRA and/or subsequent substantial remedial works are required for the site. This sheet is intended to provide a summary only of the initial indicative assessment study of the site in relation to ground contamination. It does not provide a definitive engineering analysis for the purposes of costing or construction, and is subject to the limitation of the agreed brief. Contamination Test Result Summary E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 5 WHITE YOUNG GREEN ENVIRONMENTAL 1.0 INTRODUCTION 1.1 Instruction White Young Green Environmental (WYGE) was commissioned by the Engineering Consultancy Geotechnics Section of Hampshire County Council in April 2006 to undertake a Ground Condition Assessment of a site called the Christmas Lodge located in Aldershot. The purpose of this assessment is to obtain suitable data on the condition of soil, groundwater and land-gas in order to provide an assessment of potential environmental risks associated with soil, groundwater and land-gas at the site. 1.2 Proposed Use It is understood that the site is proposed to be developed for residential use comprising a 2 to 3 storey building. At the moment WYGE are not aware of a more detailed design of the development. A change in intended site use may result in the re-assessment of risk criteria and classification. 1.3 Conditions This report is prepared in line with the agreed brief detailed within our proposal and its terms and conditions, and is subject to the report conditions shown in Appendix A. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 6 WHITE YOUNG GREEN ENVIRONMENTAL 2.0 SITE AREA AND STATUS 2.1 Site Location and Description The site is located in the southern areas of Aldershot, approximately 1 km from the town centre at National Grid Reference SU868496. The site location is shown on SK01. The site is currently disused and secured. The above ground storage tank compound/bund is located in the eastern end of the site. An electrical sub station is located just off the north-western corner of the site. The site is covered by grassed areas with bushes and trees, asphalt hard-standing in the vicinity of the building and the building footprints. The site and surrounding areas generally slopes towards the south. The site layout is shown on SK02 and photographs taken during the investigation are provided in Appendix B. 2.2 Site Boundaries and Adjoining Site Uses The site is set in a predominantly residential area and there are well established residential areas to the immediate east, west and north of the site. The area to the immediate south of the site is a former Clay Pit and Refuse Tip. However, the area has now been converted into Brickfields Park. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 7 WHITE YOUNG GREEN ENVIRONMENTAL 3.0 DESK TOP STUDY The findings of the desktop study are presented below. 3.1 Site History 3.1.1 Summary Extracts of historical Ordnance Survey (OS) maps were reviewed for the period between 1884 and 2005 to establish the recorded sequence of site development. The OS map extracts are included as sketches, SK03 to SK10. The site appears to have remained undeveloped until the 1970’s when the site, with its present day configuration as Christmas Lodge was developed. The area to the immediate south of the site was a Brick Field until the 1960’s/70’s when a Refuse Tip is shown to occupy the area until the 80’s/90’s. The immediate surrounding area to the north was a Brick Field until the early 20th century when the area was developed for residential use. The immediate areas to the east and west of the site appear to have been undeveloped land until the 1960’s when these areas were also developed for residential use. 3.1.2 Ordnance Survey Review The 1884 OS extract (SK03), shows the site to be undeveloped, most likely agricultural land. Aldershot Manor House, St Michael’s Church and associated Grave yard and Vicarage is shown approximately 200m to the north-east of the site. The 1897 OS extract (SK04), shows the site still to be undeveloped. The areas to the immediate north of the site are shown to be occupied by a Brick Field with clay and marl pits and associated kilns. A Brick Field with associated clay pit and kilns is also shown approximately 150m to the south of the site. The 1910 OS extract (SK05), shows the site still to be undeveloped. The areas to the immediate north of the site are no longer shown as a Brick Field. Instead, a residential area with associated roads has been developed across the area, extending further north-east towards the Manor House and Vicarage. Another residential area is shown approximately 200m to the south-east of the site. The Brick Field with associated clay pit and kilns to the south of the site is shown to have been further developed and extended closer towards the study site. The 1931 OS extract (SK06), shows the site still to be undeveloped. The residential areas to the north and south-east of the site are shown to have been further developed. The Brick Field with associated clay pit and kilns to the south of the site is also shown to have been further developed and now extends almost up to the site boundary. The 1962/63 OS extract (SK07), shows the site still to be undeveloped. The surrounding residential areas are now shown to have been developed up to the site northern, eastern and western site boundaries. The Brick Field with associated clay pit and kilns to the south of the site is now shown to extend into the southern most end of the site. However, the clay pits are shown as ponds and the buildings and kilns associated with the previous Brick Field are now shown as ‘works’. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 8 WHITE YOUNG GREEN ENVIRONMENTAL The 1970/71/74/77 OS extract (SK08), first shows the site to be developed as Christmas Lodge in its present day configuration. An electrical sub station is shown to be present just off the north-western corner of the site. No significant changes are shown to the surrounding residential areas. The area to the immediate south of the site previously used as clay pits and ponds are now shown as a Refuse Tip. The buildings and kilns associated with the previous Brick Field are now shown as a depot. The 1960/62/80/82/83/92 OS extract (SK09), shows no significant changes to the site. No significant changes are shown to the residential areas to the east, west and north of the site. The Refuse Tip is still shown to be present to the immediate south of the site. However, the area further south of the Refuse Tip, previously shown as a depot, is now shown to have been developed as a residential area as well. The 2005 OS extract (SK10), shows no significant changes to the site or immediate residential surrounding areas. However, the Refuse Tip is now shown as Brickfield Park. 3.2 Information Provided by Hampshire County Council Based on information provided by Hampshire County Council (HCC) it is understood that in the 1970’s,various material such as top soil, gravel, pieces of concrete and timber had been dumped in mounds across areas of site. Also, the southern most extreme of the site, towards the Refuse Tips, including the bank of the old clay pit was infilled with unknown material in order to allow the steep bank to be regraded. Based on the information provided, it is not clear whether the recommendations made in the 1970’s to re-level and consolidate the infill material and if necessary remove unsuitable infill material were carried out. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 9 WHITE YOUNG GREEN ENVIRONMENTAL 3.3 Ground Conditions Ground conditions encountered on-site during the WYGE 2006 site investigation works are reported in Section 5 of this report. 3.3.1 Geology Reference to the British Geological Survey (BGS) Map (Sheet 285, Scale 1:50,000) indicates that the site is underlain by the Thames Group London Clay Formation. However, as the southern portion of the site and the area immediately to the south of the site has historically been excavated as a clay pit and more recently backfilled as a refuse tip, it is considered likely that Made Ground may be present on site. 3.3.2 Hydrogeology The Environment Agency Groundwater Vulnerability Map (Sheet 45, West Sussex & Surrey 1:100,000) indicates that the underlying Thames Group London Clay Formation is classified as a non-aquifer. Non aquifers are generally regarded as containing insignificant quantities of groundwater. However, groundwater flow through non aquifers, although imperceptible, does take place and needs to be considered in assessing the risk associated with persistent .pollutants. Some non aquifers can yield water in sufficient quantities for domestic use. 3.3.3 Hydrology The nearest identified surface water features to the site are a few drains and ponds located to the south of the site within the Brickfield Park area. The nearest surface water feature, classified by the Environment Agency, to the site is the Blackwater River and associated ponds. The EA classifies the Blackwater River and associated ponds as River Quality ‘D’ at a location approximately 650m to the south-west of the site. 3.4 Environmental Data Search A search of environmental databases was completed to ascertain information relating to the site and its immediate surroundings. The Envirocheck Report is included in Appendix C. The main findings of the Environmental Data Search are summarised overleaf. • There are 3 No recorded (not revoked) discharge consents within 1km of the site. 1. Operator is South East Water Plc located at South East Water Boxells Lane, Aldershot approximately 530m to the south-west. The discharge type is Trade Discharges, receiving water is Freshwater/River, likely to be the Blackwater River. 2. Operator is Mr P. Amond located at Preymead Farm approximately 780m to the south. The discharge type is Sewage Discharges from a domestic property, receiving water is Freshwater/River, a tributary to the Blackwater River. Operator is Thames Water Utilities Limited located at Brook Avenue, Farnham approximately 800m to the south. The discharge type is Discharge of Other Matter, receiving water is Freshwater/River, a tributary to the Blackwater River • There are 13 No groundwater abstractions within 1km of the site. These are all associated with the South East Water Plc pumping station located approximately 500m to the south-west of the site. • A Groundwater Source Protection Zone, Zone I, is located approximately 450m to the south and south-west of the site. • There are no surface water abstractions within 1km of the site. • There are 20 No recorded pollution incidents to controlled waters within 1km of the site. The nearest being: 1. Location: Badshot Lea approximately 115m to the south of site. Incident date: Not given, pollutant was Oils, receiving water: Not given. Incident classified as a Category 3 – Minor Incident. • There are 3 No registered landfill sites within 1km of the site. 1. Authority: Rushmoor Borough Council. Location: Immediate south of site, no further information provided in the Envirocheck Report. 2. Authority: Rushmoor Borough Council. Location: Bus Depot at Halimote Road approximately 540m to the north-west of the site. No further information provided in the Envirocheck Report. 3. Authority: Rushmoor Borough Council. Location: Land to the south-west of Elms Road. Types of waste: Scrap Metal. No further information provided in the Envirocheck Report. • The site is not located within an area, which may be affected by extreme flooding from rivers or sea without defences. • The National Radiological Protection Board indicates that less than 1% of homes in the area are above the action level. The British Geological Survey indicates that no radon protection measures are necessary. • The site is located in area that is not affected by coal mining activity. • The site is located within a Nitrate Vulnerable Zone E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 11 WHITE YOUNG GREEN ENVIRONMENTAL 4.0 FIELDWORK 4.1 Rationale and Summary of Scope Site investigation works were undertaken by White Young Green Environmental between the 31st May and 2nd June 2006. The rationale for the investigation is presented below in Table 4.1. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 12 WHITE YOUNG GREEN ENVIRONMENTAL 5.0 GROUND CONDITIONS ENCOUNTERED 5.1 Soil Conditions Ground conditions encountered during the recent investigation were broadly consistent with those identified in the published literature and in summary comprised Made Ground over Superficial Deposits (BH2), over the London Clay Formation to the full depth of the investigation. Variations in strata thicknesses are summarised in Table 5.1 below, engineering logs are presented in Appendix E. N.E. = Not Encountered Made Ground was encountered at each of the investigation locations. The thickness of the stratum varied across the site ranging from between 0.20m (TP6) and 1.70m (TP1 & TP2). The Made Ground generally ranged from a black sandy clay through to clayey sandy gravel with many roots and rootlets. Frequent fragments of ash, occasional bricks, glass and a clay pipe were also encountered. Further details of the materials encountered during the course of the investigation are detailed on the appended engineering logs (Appendix E). Unidentified Superficial Deposits were encountered in six locations. The stratum had a thickness varying between 0.85 to 2.40m and comprised medium dense to dense very sandy silty/clayey GRAVEL to a clayey silty gravely SAND. Thames Group London Clay Formation was encountered in seven locations. The depth to the surface of the stratum varied across the site from 0.60 (BH3) to 2.70mbgl (BH2). The full thickness of this strata was not proven during the course of this investigation. The near surface London Clay Formation varied in composition from typically soft to stiff slightly sandy SILT to slightly sandy slightly gravelly CLAY. At depth the stratum varied in composition from a firm to stiff slightly sandy CLAY to a firm to stiff slightly sandy SILT. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 13 WHITE YOUNG GREEN ENVIRONMENTAL Overall consistencies for the Thames Group London Clay Formation have been assessed using field observations and SPT ‘N’ values. Using the approximate relationship Cu=4.5 x SPT N value, undrained shear strengths for the London Clay Formation occur in the range of 36 to 108kN/m2, corresponding to consistencies of soft to stiff. 5.2 Obstructions The below ground obstructions encountered during the course of the investigation, are summarised in Table 5.2 below: Table 5.2 Summary of underground obstructions encountered. Not proven. 5.3 Notes Claystone Band Groundwater Conditions Groundwater was encountered during the investigation at two of the investigation locations. Slight seepages were recorded in BH1 at 8.5 and 10.2mbgl within the Thames Group London Clay Formation, with no rise in the water levels being recorded after a 20 minute period. Claystone bands were encountered at both of these depths. Another slight water seepage was observed in TP2 at 1.4mbgl, within the Made Ground. A single combined land gas and groundwater standpipe was installed in BH1 following completion of the exploratory hole. Return monitoring visits to the site were carried out on the 7th and 15th of June 2006, during which a groundwater sample was recovered and sent for laboratory contamination analysis. The monitoring results are summarised in Table 5.3 below. The full monitoring data set is presented in Appendix F. The full range of results are presented in Appendix G. The test procedures used were generally in accordance with the methods described in BS1377:1990. Details of the specific tests carried out are presented in Table 6.1 below. Chemical analyses undertaken on samples obtained from the investigation are summarised below in Table 6.2 below and overleaf. The results of these analyses are given in Appendix G. It is, however, possible that others may exist for which analyses have not been carried out or which were outside the scope of completed exploratory holes. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 17 WHITE YOUNG GREEN ENVIRONMENTAL 7.0 GEOTECHNICAL PARAMETERS 7.1 Made Ground No laboratory geotechnical testing was undertaken on samples obtained form the Made Ground. 7.2 Superficial Deposits This stratum comprised medium dense to dense brown to orange very sandy silty/clayey GRAVEL to a clayey silty gravely SAND. One Particle Size Distribution (PSD) test (wet sieve) was undertaken on a representative sample from the Superficial Deposits at a depth of 2.00mbgl. Gravel contents of 47%, sand content of 34% and silt/clay contents of 19% were recorded. Indicating the Superficial Deposits to comprise a very sandy silty/ clayey GRAVEL. 7.3 Thames Group London Clay Formation The near surface Thames Group London Clay Formation varied in composition from typically soft to stiff slightly sandy SILT to slightly sandy slightly gravelly CLAY. At depth the stratum varied in composition from a firm to stiff slightly sandy CLAY to a firm to stiff slightly sandy SILT. Determination of index properties (Atterberg Limits) were undertaken on seven samples from the fine–grained Thames Group London Clay Formation. Liquid limits varied between 58% to 70%, plastic limits between 21% to 25% and plasticity indices of 37% to 45% (modified plasticity indices (I’p) of 37% to 45%), indicative of medium to high volume change potential clay soils. Corresponding moisture content tests carried out on the same samples varied between 25% to 32%. Three Particle Size Distribution (PSD) tests (wet sieve and pipette) were undertaken on representative samples from the Thames Group London Clay Formation at 2.00mbgl, (BH3), 4.45mbgl (BH1) and 8.70mbgl (BH2). Gravel contents of 2%, sand contents of 2 to 3%, silt contents of 51 to 54% and clay contents of 44 to 45% were recorded. Thereby indicating the Thames Group London Clay Formation, tested at the previously mentioned depths, to range from slightly gravely slightly sandy SILT to slightly sandy SILT. Determination of the water soluble sulfate content (2:1 extract as SO4) on five samples from the Thames Group London Clay Formation indicated concentrations ranging between 0.06 and 0.63g/l. Corresponding pH values ranged between 7.8 and 8.0. These values are indicative of a design sulphate (DS) classification of DS-2 and a ACEC Class for location of AC-2, generally in accordance with BRE SD1 (2005). Undrained shear strength (Cu) values for the Thames Group London Clay Formation are based on field observations and SPT N values. Cu values have been derived from the approximate relationship Cu = 4.5 x ‘N’ value. A plot of undrained shear strength versus depth, indicates an approximate linear increase in Cu with depth for the Thames Group London Clay Formation, albeit with a degree of scatter (Appendix H). The plot indicates undrained shear strengths of around 30KN/m2 at 1.0mbgl increasing to 110KN/m2 at 10.0mbgl. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 18 WHITE YOUNG GREEN ENVIRONMENTAL 8.0 GEOTECHNICAL DISCUSSION 8.1 Introduction It is understood that the site is proposed to be developed for residential use comprising a 2 to 3 storey building. At the moment WYGE are not aware of a more detailed design of the development. Details of proposed loadings were not available at the time of writing this report and for the purposes of this discussion, it has been assumed that proposed development site levels will not differ significantly from those currently present across the site. Near surface ground conditions encountered during the recent investigation typically comprised Made Ground overlying variable fine and coarse–grained Thames Group London Clay formation, which in turn overlaid the more uniform fine grained Thames Group London Clay Formation. 8.2 Spread Foundations Due to variability and the possibility of unpredictable settlement, it is recommended that conventional spread foundations for the proposed development should not bear onto the Made Ground. Likewise due to variability in thickness and composition of the Superficial Deposits there is the potential that under load these soils may also give rise to unacceptable/ unpredictable differential settlements. Additionally, differential settlements may also arise where foundations span across areas where both Superficial Deposits and the Thames Group London Clay Formation occur at founding level. Therefore it is recommended that where possible foundations bear onto the underlying Thames Group London Clay Formation. Laboratory geotechnical testing has identified that the fine-grained Thames Group London Clay Formation comprises high plasticity clay soils with medium to high volume change potential. On this basis, and with reference to NHBC Chapter 4.2, it is advised that minimum founding depths of 1.0mbgl are adopted. These minimum founding levels may need to be increased if the proposed building footprint falls within the zones of Made Ground, Superficial Deposits and/ or influence of existing or proposed trees. The potential affect of trees on foundation levels and design is discussed further, below. It is recommended that the base of all excavations are inspected and any soft or loose materials are removed/ replaced prior to the formation of spread foundations. In consideration of allowable bearing pressures alone, conventional spread foundations bearing onto the fine-grained Thames Group London Clay Formation could be considered for the proposed development. As such, based on a conservative undrained shear strength (Cu) of 40kN/m2 for the soft to firm fine grained soil. It is considered that allowable bearing pressures of the order of 90kN/m2 should be obtainable for conventional shallow footings (pad/ strip), bearing at an approximate depth of 1.0mbgl, limiting settlements to less than 25mm (based on a pad of 2m x 2m). E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 19 WHITE YOUNG GREEN ENVIRONMENTAL Consideration will need to be given to the presence of a number of existing trees within the site, particularly along the existing boundaries. Tree species identified include: Sycamore, Cherry, Maple, Lime, Oak and Hawthorne. It should be noted that tree identification has not been undertaken by a suitably qualified aboriculturist. If proposed building footprints are situated within the zone of influence of these trees, it will be necessary to modify the above founding levels so as to avoid the potentially damaging effects of soil volume changes associated with soil moisture content variation due to continued tree growth. In the absence of any proposed development plans it is not possible to provide any detailed advice on minimum founding depths in the presence of trees. However, broad guidance can be offered in terms of worst case scenario. Should the proposed building footprint be in close proximity to one of the Oak trees on site then using NHBC Chapter 4.2 guidance the ‘zone of influence’ of such a tree is of the order of 24m from the centre of the trunk. Within such a zone of influence, minimum foundation depths will need to be increased (see Table 8.2 for indicative foundation depths at various distances from an Oak tree on high volume change potential soils). Although the complex distribution on trees is likely to result in worst case depth as shown above. Reference should be made to the NHBC guidance chapter 4.2 with regard to heave precautions. In line with good working practice, it is recommended that the base of all foundation excavations are inspected and any soft or loose deleterious strata are replaced with an appropriately compacted granular medium as part of any development works onsite. 8.3 Piled Foundations For more heavily loaded structures, or where minimum founding levels are considered too great for conventional spread foundations, piled foundations could be considered. Depending on foundation load requirements, a range of pile lengths and diameters can be designed to bear into the underlying Thames Group London Clay Formation. Based upon the information obtained from the three cable percussion boreholes carried out at the site, the following preliminary calculations have been based upon the use of continuous flight auger (CFA) piles extending into the Thames Group London Clay Formation, although the use of alternative methods could be considered. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 20 WHITE YOUNG GREEN ENVIRONMENTAL At this stage it is not envisaged that any significant increase in site levels will be incorporated into the proposed works. Consequently the effects of potential negative skin friction have not been considered in this preliminary analysis. Consideration will need to be given to the potential for tensional forces acting on piles in areas of any significant proposed cut as a consequence of overburden removal. This can only be assessed once details of proposed cut levels become available. The competency of the soil profile used for the preceding calculations is based on the engineer’s assessment, in-situ testing (principally SPT’s) and the results of laboratory testing. In order to provide indicative single working pile capacities a series of calculations, based on the total service capacity value (consisting of a base and shaft component), have been undertaken. Assumed pile design parameters include:Made Ground No positive contribution to pile capacity Superficial Deposits No positive contribution to pile capacity Thames Group London Clay Formation Average depth encountered and thickness = 1.5m, and >10.0m Adhesion Factor, α = 0.5 Bearing Capacity Factor, Nc = 9 Shear Strength = increases with depth (40KN/m2 at 1.0mbgl to 110KN/m2 at 11.0mbgl) Groundwater Groundwater at 3mbgl Illustrative calculations for axially loaded pile capacities have been undertaken, based on a single pile. The following pile capacities (Table 8.3) have been calculated for various pile diameters and lengths adopting a factor of safety of 2.5 to derive service capacities. Where preliminary and working pile load tests are undertaken it may be appropriate to reduce Safety Factors, although 2.5 may be a minimum local authority requirement. Should testing not be undertaken it is suggested that a factor of safety of at least 3.0 be adopted. On the basis of the illustrative calculations, settlements are likely to be within permissible tolerances. Working capacities for pile groups should be assessed when final design details are known, although for preliminary design purposes it is likely that piles spaced at least 3 x pile diameter from other piles in any group will behave as single piles. We would recommend that the advice of a specialist foundation contractor is sought to further discuss proposed pile layout and capacity with regards to the encountered ground conditions. Where piles are to be constructed in close proximity to existing trees or proposed areas of planting, and the near surface soils comprise fine-grained soils of silty clay deposits, it is recommended that the sides and pier caps be protected with proprietary void former or compressible material to protect against potential soil movements associated with moisture content variation. Guidance on this matter is given is BRE Digest 241 and NHBC Chapter 4.2. 8.4 Floor Slabs Details of proposed loadings were not available at the time of writing this report and for the purposes of this discussion, it has been assumed that floor slabs will be subjected to low loadings. Near surface soils were variable in composition including coarse grained soils of the Made Ground and Superficial Deposits and fine-grained soils of the Made Ground and Thames Group London Clay Formation. The fine-grained soils, where present, occurred near surface and persisted to depths of over 11m in the case of BH1. Laboratory geotechnical testing has identified that the fine-grained soils of the London Clay Formation comprised clay soils with plasticity indices of between 37% and 45% corresponding to high plasticity clay soils with medium to high volume change potential. Although at the time of writing there are no proposed development plans, the presence of a number of trees around the site could affect the moisture content of the medium to high volume change potential soils and therefore cause potential shrinkage and heave movements. Should proposed developments be situated away from existing or proposed planting, there is still potential that the near surface soils could be susceptible to seasonal variation in moisture content. As previously mentioned in section 8.2 of this report, it is recommended that where possible, foundations bear onto the underlying Thames Group London Clay Formation. In the event that minimum founding levels are less than 1.5mbgl, than the use of ground bearing floor slabs may be adopted. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 22 WHITE YOUNG GREEN ENVIRONMENTAL However in the event that minimum founding levels are greater than1.5mbgl, current guidance on the construction of foundations on clay soils (NHBC Standards – Chapter 4.2, 2003) recommends that all floor slabs are suspended for such ground conditions. It is all also recommended that a compressible void former is placed beneath any proposed suspended floor slab enabling the slab to be cast in-situ and thus keeping costs to a minimum. As with good construction practice it is recommended the formation level be inspected and that any areas of soft or loose deleterious strata are replaced with an appropriately compacted coarse-grained medium. 8.5 Temporary Works It is considered at this stage that temporary works will comprise excavations for service runs through the Made Ground and Thames Group London Clay Formation. Whilst the clay can be expected to be relatively stable, it is recommended that where temporary excavations are proposed that an appropriate risk assessment is carried out and where necessary they are either shored or that the sides of excavations are battered to a safe angle of repose to allow man entry. It is suggested that an angle of 30 degrees from horizontal is not exceeded. Groundwater was not encountered at depths that are likely to affect excavations for services and shallow foundations, hence dewatering of excavations is not expected to be required. 8.6 Concrete Sulfate tests indicated that maximum determined levels correspond to Design Sulfate Class 1 (DS-2) in accordance with BRE Special Digest 1, ‘Concrete in Aggressive Ground 2005’. As mainly natural ground conditions persist and groundwater, if present, is expected to be mobile within the granular Superficial Deposits, the Aggressive Chemical Environment for Concrete (ACEC) is considered to be AC-2 in accordance with the aforementioned document. We would advise that all cements used for sub surface concrete constructions should conform to the advice given within this publication unless other wise specified or required. 8.7 Pavements As the near surface materials were found to be variable in composition, a conservative approach has been taken to using the parameters of the fine grained materials in relation to achievable CBR values. The fine-grained soils were found to be of high plasticity with PI’s of up to 45%, it is anticipated that equilibrium CBR values of the order of 4-5% would be appropriate, with reference to the Highways Agency design guidance HD25/94 (Table 2.2 “Equilibrium Subgrade CBR Estimation” within Volume 7 of the Department of Transport Design Manual for Roads and Bridges). As with good construction practice it is recommended the formation level be inspected and that any areas of soft/loose deleterious strata are replaced with an appropriately compacted coarse-grained medium. Likewise, any hard spots (such as old foundations) should also be removed to guard against reflective cracking in the pavement. Proof rolling/compaction of the formation level should be carried out prior to laying the new pavement. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 23 WHITE YOUNG GREEN ENVIRONMENTAL 8.8 Health and Safety / Contamination The contaminant analysis undertaken has identified exceedances in relation to the relevant screening values. A full qualitative risk assessment has been carried out as part of the remit of the scope of works and can be found in the subsequent sections of this report. However, based on the limited testing undertaken, the following measures should be considered as standard working practice: 1) To minimise risk during site works and in line with good working practice, Duty of Care working procedures should be adopted, in particular it is recommended that: 2) • All works are undertaken by licensed operators • Contaminated waste sent for off-site disposal may be subject to landfill premiums. Appended test results should be presented to the licensed operators for appropriate waste classification and to ensure the appropriate landfill is selected. Health and Safety measures should be adopted to protect the health and safety of site workers during any on-site works. Contractors are under a statutory obligation to take reasonable care to protect the Health & Safety of employees. The following measures are suggested: • All ground workers on site should be issued with Personal Protective Equipment, including footwear and gloves. Good practises relating to personal hygiene should be carried out, including the exclusion of smoking in working areas and no eating or drinking should be allowed in any contaminated areas of the site. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 24 WHITE YOUNG GREEN ENVIRONMENTAL 9.0 GROUND CONTAMINATION RESULTS 9.1 Soils It is recognised by the industry that the Soil Guideline Values (SGV) from the Contaminated Land Exposure Model (CLEA) are those now favoured by the Environment Agency, who prefer a risk-based assessment. The risk assessment carried out according to the proposed use of the site as a residential site comprising a 2 to 3 storey building and most likely with limited soft landscaping. Therefore, where possible, the SGVs for residential site use without plant uptake have been used as an initial screening exercise to assess risks presented by this site. However, SGVs are currently available for only a limited number of contaminants. Due to the absence of further screening criteria, WYGE has developed internal soils screening criteria using the methodology outlined in the latest Contaminated Land Reports for the some of the contaminants where no SGVs exist. The WYGE screening values for residential site use without plant uptake end use were therefore used for contaminants with no SGVs. In the absence of either screening values, Dutch Human Health screening values were utilised. These values are to provide an initial indication of contaminants present but not used as criteria upon which the decision is made to recommend remediation. This decision is based on the evaluation of a number of factors which when combined together present a statutory or non-statutory liability that may require remedial action. The tables (9.1.1 – 9.1.5) below provide an initial screening exercise and highlight the soil results, which exceed the appropriate threshold value. In the absence of the UK Drinking Water Supply criteria Environmental Quality Standards for Freshwaters and the Dutch Integrated SRC (Serious Risk Concentration) values were used. As for soils, this assessment of groundwater quality is only an initial screening exercise and does not imply that remediation is necessarily required. The tables (9.2.1 – 9.2.7) below provide an initial screening exercise and highlight the groundwater results, which exceed the appropriate threshold value. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 26 WHITE YOUNG GREEN ENVIRONMENTAL 10.0 GROUND CONTAMINATION DISCUSSION 10.1 Soil The results of the chemical analysis indicate that only very localised areas beneath the site are impacted by hydrocarbons. Concentrations above our Tier 1 Screening Criteria for PAH’s were identified in soil samples recovered from shallow depth (Made Ground) in BH3, TP2 and TP6. It is considered likely that the slightly elevated concentrations of PAH’s identified in BH2 is associated with the Made Ground and especially with the Asphalt surface, through which the borehole was constructed. Another potential source for the identified PAH’s is from small spills and leaks associated with the above ground storage tank located in the immediate vicinity of BH2. It is considered likely that the slightly elevated concentrations of PAH’s identified in TP6 may have originated from the small spills and leaks associated with the above ground storage tank located in the immediate vicinity of TP6. It is considered likely that the slightly elevated concentrations of PAH’s identified in TP2 is associated with the ash within the Made Ground encountered in TP2. 10.2 Groundwater The results of the chemical analysis indicate that groundwater encountered beneath the site is not significantly impacted by contaminants. Also, groundwater was only identified in one of the investigation locations, BH1, indicating only limited and discrete presence of groundwater beneath the site. However, concentrations above our Tier 1 Screening Criteria for PAH’s, Sulphate, Heavy Metals (Copper and Lead) and Diesel Range Organics (C8-C26) (DRO) were identified in a water sample recovered from BH1. BH1 with the installed monitoring well is located in the southern end of the site, towards the former refuse tip area. As the site and surrounding areas generally slopes towards the south, it is considered likely that groundwater flow beneath the site would be towards the south, where BH1 is located. As such, it is considered plausible that the identified impacted groundwater in BH1 is a result of impacted soil, identified in BH3 and TP6, leaching out into underlying strata and groundwater. 10.3 Land-gas Significant concentrations of land-gas were not detected in the monitoring well installed in BH1. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 27 WHITE YOUNG GREEN ENVIRONMENTAL 11.0 QUALITATIVE RISK ASSESSMENT Current environmental legislation in respect of contaminated land includes the Environment Act 1995, Water Resources Act 1994, Environmental Protection Act 1990, Health and Safety at Work Act 1994, Town and Country Planning Act 1990 and Building Regulations 1985. Part IIA of the EPA 1990 was implemented by Section 57 of the Environment Act (EA) 1995. The regime is detailed in the Department of Environment, Transport and Regions (DETR) circular 02/2000 which includes a statement of government policy, a description of the new regime, the statutory guidance and a guide to the supporting regulations. The regime provides a statutory definition of contaminated land based on the risk of significant harm to human health and the environment, or pollution of controlled waters. By adopting the principles of risk assessment and risk management the intention is to ensure that contaminated land is managed effectively, based on its current use, proposed end use and environmental setting. Under the regime, land is only defined as contaminated if there is a significant 'pollutant linkage'. This requires evidence of the presence of a contaminant (the source), a pathway (or pathways) through which contaminants could travel, and a receptor that could be harmed by the contaminant. In addition the type of receptor and any harm must meet the descriptions of significant harm given in the statutory guidance. A site where a contaminant is causing or is likely to cause pollution of surface water or groundwater (controlled waters) also constitutes contaminated land. This section of the report provides a qualitative assessment of environmental risks associated with the site. The qualitative risk assessment is achieved by the classification of the significance of the potential harm and the probability of a pollutant linkage. The harm and probability of linkage via identified pathways are then compared to indicate the potential environmental risk for a pollutant linkage. The assessment has been developed with cognisance of: • the nature, level and extent of identified contamination (this may include for duration and frequency), • potential contamination receptors, and • regard to the current site status The risk assessment will also reflect the potential sensitivity of the receptors and the significance of the contaminant source (i.e. the volume and concentration of the contaminant source). 11.1 Sources A number of indicators of potential hazards with regard to possible sources of contamination are identified as a result of historical and current activities on-site: On-site sources – Historic and Current It appears that the site has been undeveloped until the early 1970’s when the site was developed to its present day configuration (Christmas Lodge). As such, heating oil (stored in an above ground storage tank) used on-site is a potential source for contamination such as hydrocarbons and heavy metals, impacting underlying soil and groundwater. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 28 WHITE YOUNG GREEN ENVIRONMENTAL Also, our review of historical maps indicates that the most southern end of the site may have been infilled with various materials of unknown source and composition in order to raise that section of the site prior to the development of Christmas Lodge onsite. As such, the infill material is a potential source for contaminants impacting underlying soil and groundwater. Further, our recent investigation indicates that shallow soils in localised areas and groundwater encountered have been impacted by contaminants. Locations/areas of identified contamination are as follows: • Hydrocarbons (PAH’s) in shallow soil, BH2, TP2 and TP6. • Hydrocarbons (PAH’s and DRO), Sulphate and Heavy Metals (Copper and Lead) in groundwater, BH1. Off-site sources – Historic and Current The area/previous clay pit to the immediate south of the site has been used a Refuse Tip. As such, there is a potential for contaminants originating from the deposited material to impact underlying soil and groundwater. However, the former Refuse Tip has been converted into a Park, indicating that the deposited material may have been excavated and removed. The area is also located down-gradient from the site and as such it is unlikely that contaminants originating from the deposited material would impact soil and groundwater beneath the study site. 11.2 Potential Pathways The key environmental pathways and exposure routes by which the potentially toxic substances can reach the potential receptors (see Section 11.3) are considered to be: Indirect • Vertical migration of contaminants into underlying strata and groundwater. • Surface runoff to adjacent land uses. • Groundwater movement laterally and vertically. • Land-gas and organic vapours movement through permeable ground strata. Direct • Ingestion of soil and dust (plants and humans). • Dermal contact with contaminated surface soil and groundwater. • Inhalation of land gas and vapours. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 29 WHITE YOUNG GREEN ENVIRONMENTAL 11.3 Potential Contamination Receptors Receptors that may be affected by the identified contamination are: 11.4 • Current users of the site and trespassers. • Adjacent land uses (residential properties particularly). • Identified surface water feature. • Construction workers during any redevelopment, remediation and general groundworks. • Flora and Fauna – Future Landscaping. • Future users of the site. • Future Building infrastructure Qualitative Risk Assessment The risk assessment detailed below considers the site in its current state and does not take into account any remedial, mitigation or protective measures which may be incorporated. The risk of contamination to the following receptors listed below has been assessed and a summary is presented at the end of this section in 11.5. Current Site Users/Trespassers The site is currently disused and secured. Also, only fairly low levels of contamination (PAH’s in shallow soil), most only marginally above a conservative Tier one screening value, were identified on-site. Therefore, the potential risk posed to current site users/trespassers from dermal contact, ingestion and volatilisation to indoor and outdoor air from the identified contamination is considered to be of a Low order. Risk from Adjacent Land Uses A refuse tip was identified to have been located immediate south of the site. However, given that the refuse tip has been converted into a park indicating that deposited material is likely to have been translocated during construction. In addition, .the fact that the tip was located down-gradient from the study site it is considered unlikely that any contamination originating from the tip would have migrated towards the study site. As such, the risk from adjacent land uses is considered to be of a Low order. Risk to Adjacent Land Uses Given that part of the site appears to have been infilled and that the site itself has been developed, since the 1970’s, including an above ground storage tank used for heating oil there is a potential for underlying soil and groundwater to have been impacted by contaminants and subsequently migrating off-site. However, as the site is underlain by a non-aquifer and the fact that only very limited groundwater was encountered beneath the site, the risk from contamination identified beneath the site posed to off-site receptors is considered to be of a Low order. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 30 WHITE YOUNG GREEN ENVIRONMENTAL Groundwater There are 13 No of groundwater abstractions within 1km of the site. These are all associated with the South East Water Plc pumping station located approximately 500m to the south-west of the site, most likely within the identified Groundwater Source Protection Zone, Zone I, to the south and south-west of the site. However, due to only fairly low levels of contamination (PAH’s in shallow soil) and the distance between the site and the identified abstractions the potential risk from the identified contamination is considered to be of a Low order. Surface Water There are no surface water abstractions within 1km of the site. The nearest identified surface water features to the site are a few surface drains and ponds located to the south of the site within the Brickfield Park area. However, due to low concentrations of a small number of contaminants identified on-site, the potential risk to the drains and ponds is considered to be of a Low order. The nearest surface water feature, classified by the Environment Agency, to the site is the Blackwater River and associated ponds. The EA classifies the Blackwater River and associated ponds as River Quality ‘D’ at a location approximately 650m to the south-west of the site. However, due to only fairly low levels of contamination (PAH’s in shallow soil) and the distance from the site and the Blackwater River and associated ponds, the potential risk from the identified contamination on-site is considered to be of a Low order. Construction Workers It is understood that the site is proposed for re-development. As such, there is a risk that disturbance of underlying soils could expose ground workers to contaminated materials. The exposure pathways in such instance would include direct dermal contact, ingestion and inhalation of gases, vapours and dust. However, our recent investigation has identified only very localised areas being impacted by contaminants (PAH’s in shallow soil). Disturbance of underlying soils in these areas will provide direct pathways from this contamination to workers on the land, in particular through vapour inhalation and dermal contact. By adoption of suitable precautionary measures relating to methods of work and use of personal protection equipment, the potential pathways are likely to be effectively mitigated. Therefore, the risk to construction workers is assessed to be of a Low order. Flora and Fauna High levels of phytotoxic metals were not identified within underlying soils. As such, the risk posed to flora and fauna is considered as Low. Future Site Users It is understood that the site is proposed to be developed for residential use comprising a 2 to 3 storey building with associated public open space. As such, the risk to future site users is from dermal contact, ingestion and volatilisation to indoor and outdoor air from the identified contamination is considered to be of a Low order. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 31 WHITE YOUNG GREEN ENVIRONMENTAL Future Infrastructure The risks posed to future buildings and services derive from the geotechnical and contamination characteristics of the shallow soils. The presence of contaminants in shallow subsurface soils may impact upon the materials used for pipe-work for services and elevated sulphates may attack concrete. Buildings may also be subject to ingress by land-gas. Our investigations indicate only mildly elevated sulphate concentrations and no significant ground gas concentrations. Any significant alterations to site levels or other conditions would inevitably require evaluation of the overall qualitative risk assessment rating to reflect the modified site conditions. Due to variability and the possibility of unpredictable settlement, it is recommended that conventional spread foundations for the proposed development should not bear onto the Made Ground. Likewise due to variability in thickness and composition of the Superficial Deposits there is the potential that under load these soils may also give rise to unacceptable/ unpredictable differential settlements. Additionally differential settlements may also arise where foundations span across areas where both Superficial Deposits and the Thames Group London Clay Formation occur at founding level. Therefore it is recommended that where possible foundations bear onto the underlying Thames Group London Clay Formation. For more heavily loaded structures, or where minimum founding levels are considered too great for conventional spread foundations, piled foundations could be considered. Depending on foundation load requirements, a range of pile lengths and diameters can be designed to bear into the underlying Thames Group London Clay Formation. The interpretation and assessment detailed in this report has been undertaken to identify the most significant receptors of the contamination present at the land, based upon a risk assessment of the sources, pathways and receptors (the pollutant linkages) associated with the land. The intrusive investigation has confirmed or identified a number of factors, which were in question prior to the site investigation being undertaken. In particular, the following has been established: • The site is proposed to be developed for residential use with associated public open space. • The encountered ground conditions at the site generally comprise Made Ground overlying, Superficial Deposits, which in turn overlie the Thames Group London Clay Formation, classified as a non-aquifer. • Groundwater was encountered in location, BH1 and TP2. It is considered that encountered groundwater is perched and does not represent regional groundwater. There are 13 No. of groundwater abstractions within 1 km of the site. • The nearest identified surface water features to the site are a few drains and ponds located to the south of the site within the Brickfield Park area. The nearest surface water feature, classified by the Environment Agency, to the site is the Blackwater River and associated ponds. The EA classifies the Blackwater River and associated ponds as River Quality ‘D’ at a location approximately 650m to the south-west of the site. There are no surface water abstractions within 1km of the site. E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 34 WHITE YOUNG GREEN ENVIRONMENTAL • Concentrations above our Tier 1 Screening Criteria for PAH’s were identified in soil samples recovered from shallow depth (Made Ground) in BH3, TP2 and TP6. It is considered likely that the slightly elevated concentrations of PAH’s identified in BH2 are associated with the Made Ground and especially with the Asphalt surface, through which the borehole was constructed. Another potential source for the identified PAH’s are small spills and leaks associated with the above ground storage tank located in the immediate vicinity of BH2. It is considered likely that the slightly elevated concentrations of PAH’s identified in TP6 is originating from the small spills and leaks associated with the above ground storage tank located in the immediate vicinity of TP6. It is considered likely that the slightly elevated concentrations of PAH’s identified in TP2 is associated with the ash within the Made Ground encountered in TP2. • Concentrations generally only slightly above our Tier 1 Screening Criteria for PAH’s, Sulphate, Heavy Metals (Copper and Lead) and Diesel Range Organics (C8-C26) (DRO) were identified in a water sample recovered from BH1. BH1 with the installed monitoring well is located in the southern end of the site, towards the former refuse tip area. As the site and surrounding areas generally slopes towards the south, it is considered likely that groundwater flow beneath the site would be towards the south, where BH1 is located. As such, it is considered plausible that the identified impacted groundwater in BH1 is a result of impacted soil, identified in BH3 and TP6, leaching out into underlying strata and groundwater. • Significant concentrations of land-gas were not detected in the installed monitoring well. With the above information in mind and in the context of the proposed use of the site, it is unlikely that a QRA and/or subsequent substantial remedial works are required for the site. However, as only shallow soils in discrete areas were impacted by contaminants (PAH), localised excavation and subsequent soil removal may prudent and to address this issue. The extensive use of hard landscaping and selective excavation could be used in tandem to minimise the requirement for off site disposal. Also, hydrocarbon and heavy metal impacted groundwater was also identified beneath the site. However, it appears that the impacted groundwater is only present in localised areas. Therefore, it is unlikely that groundwater remediation is required to address the identified groundwater conditions and to further reduce the potential risks posed from site conditions to the local ‘controlled water’ environment and future developers and occupants of the site. However, future monitoring of groundwater conditions on-site may be prudent both during and post redevelopment. The ground conditions have been sampled or monitored in recorded locations and tested for some of the more common chemicals generally expected, including any highlighted in the client’s instructions. Other concentrations or types of chemicals may exist. "Agreement" means the agreement between Ourselves created by Your acceptance of these Terms. "Authorised Reseller" means an agent or reseller of Landmark whom Landmark has duly appointed to resell its Reports and Services. "Client" means the individual or organisation to whom You provide professional services and/or Your professional advisors where applicable. "Content" means any data, computing and information services and software, and other content and documentation or support materials and updates included in and/or supplied by or through the Websites, in Reports or Services or in any other way by Landmark and shall include Landmark developed and Third Party Content. "Designated Users" means individuals appointed by Members to transact across the Member's Account. "Intellectual Property Rights" means all forms of intellectual property or protective rights recognised in law. "Member" means the person, firm or organisation who establishes and/or uses the Account. "Order" means the request for Services from Landmark by You. "Property Site" means a land site on which a Member requests Landmark provide either a Report or any other Service. References to"We", "Us" and "Our" are references to Landmark Information Group Limited ("Landmark"), whose registered office is 7 Abbey Court, Eagle Way, Exeter, EX2 7HY. Where You are not ordering the Services directly from Landmark, but from an Authorised Reseller, references to "Landmark" or "We", "Us" and "Our" shall be construed so as to mean either Landmark and/or the Authorised Reseller as the context shall indicate. References to "You/Your/Yourself" refer to the contracting party who places an Order with Landmark and for whom the Services are to be provided by Landmark. "Report" includes any information that Landmark supplies to You including all reports, services, datasets, software or information contained in them. "Services" means the provision of any service by Landmark pursuant to these Terms which at the sole discretion of Landmark, may be time limited, for the purposes of evaluation only, offer reduced functionality, offer limited access to the Content, or be free of charge including but not limited to the report(s), data, information or other services undertaken by Landmark. "Landmark Fees" means any charges levied by Landmark for Services provided to You "Suppliers" means any organisation who provides data or information of any form to Landmark. "Terms" means these Terms and Conditions. "Third Party Content" means the services, software, information and other content or functionality provided by third parties and linked to or contained in the Services. "Websites" means websites hosted by Landmark and includes the Content and any report, service, document, data-set, software or information contained therein, derived there from or thereby. 1. Terms and Conditions a. These Terms govern the relationship between You and Landmark whether You are an unregistered visitor to the Website or a registered Member purchasing Landmark products or Services from Landmark. b. Where these Terms are not expressly accepted by You they will be deemed to have been accepted by You, and You agree to be bound by these Terms when You place any Order, or pay for any Services provided or Reports ordered. c. If the person communicating with Landmark is an Authorised Reseller, they must ensure that You agree to these Terms. d. The headings in these Terms are for convenience only and shall not affect the meaning or interpretation of any part of these Terms. e. We may modify these Terms, and may discontinue or revise any or all other aspects of the Services at our sole discretion, with immediate effect and without prior notice. Any amendment or variation to these Terms shall be posted on our Websites. Continued use of the Services by You shall be deemed an acceptance by You to be bound by any such amendments to the Terms. f. Landmark reserves the right to refuse to supply Services to You or any other potential client without notice or reason. 2. Reports Whilst Landmark will use reasonable care and skill in providing the Services to You the Services are provided on the express basis that You acknowledge and agree to the following:a. The information and data supplied in the Services are derived from publicly available records and other third party sources and Landmark does not warrant the accuracy or completeness of such information or data; and b. The information and data supplied in the Services are derived solely from those sources specifically cited in the Report Landmark does not claim that these sources represent an exhaustive or comprehensive list of all sources that might be consulted; and c. Landmark does not guarantee that all past or current land uses or features will be identified in the Report; and d. The Services provided by Landmark are professional business to business services and not intended for use or interpretation by persons other than professional persons skilled in the use of property and environmental information; and e. Landmark shall not be responsible for error or corruption in the Report resulting from inaccuracy or omission in primary or secondary information and data, inaccurate processing of information and data by third parties, computer malfunction or corruption of data whilst in the course of conversion, geo-coding, processing by computer or electronic means, or in the course of transmission by telephone or other communication link, or printing. f. Landmark reserves the right, without limitation, to change the Reports or Services on offer at any time. 3. Intellectual Property a. You acknowledge that all Intellectual Property Rights in the Report and Services are and shall remain owned by either Landmark or our Suppliers and nothing in these Terms purports to transfer, assign or grant any rights to You in respect of the Intellectual Property Rights. b. Subject to clause 6.f, You are entitled to make the following use of the Services and Reports subject always to these Terms and You may, without further charge, make the Report or Services available to; i. any person who purchases the whole of the Property Site, ii. any person who provides funding secured on the whole of the Property Site, iii. any person for whom You act in a professional or commercial capacity, and iv. any person who acts for You in a professional or commercial capacity. Accordingly Landmark shall have the same duties and obligations to those persons in respect of the Services as it has to You. c. Each of those persons referred to in Clause 3.b. shall have the benefit and the burden of Your rights and obligations under these Terms. The limitations of Landmark's liability as set out in Clause 6 shall apply. d. The Report is to be used solely for the benefit of You and Your Client and such persons as are set out in Clause 3.b, and Landmark excludes all liability to all other persons unless Landmark has expressly agreed in writing to the assignment of the benefit of the Report and has been paid Landmark's reasonable fees for so doing. e. All parties given access to the Services agree that they will treat as strictly private and confidential the Services and all information which they obtain from the Services and shall restrict any disclosure to employees or professional advisors to enable the relevant party to conduct its internal business The requirement in this clause to treat the Services as confidential shall include a requirement to maintain adequate security measures to safeguard the Services from unauthorised access, use or copying. f. Each recipient of the Services agrees (and agrees it will cause its employees, agents or contractors who may from time to time have access to the Services to agree) it will not, except as permitted herein or by separate agreement with Landmark:i. effect or attempt to effect any modification, merger or change to the Service, nor permit any other person to do so; or ii. copy, use, market, re-sell, distribute, merge, alter, add to or carry on any redistribution, reproduction, translation, publication, reduction to any electronic medium or machine readable form or commercially exploit or in any other way deal with or utilise or (except as expressly permitted by applicable law) reverse engineer, decompile or disassemble the Services, Reports, Content or Website; or iii. remove, alter or in any way change any trademark or proprietary marking in any element of the Services and You acknowledge the ownership of the Content is as per this Clause, where such Content is incorporated or used into Your own documents, reports, systems or services whether or not these are supplied to any third party. iv. create any product which is derived directly or indirectly from the data contained in the Services g. You shall acknowledge the ownership of the Content where such is incorporated into Your own documents, reports, systems or services whether or not these are supplied to any third party. h. You are permitted to make five copies of any Report, but are not authorised to re-sell the Report, any part thereof or any copy thereof unless you are an Authorised Reseller. Further copies may not be made in whole or in part without the prior written permission of Landmark who shall be entitled to make a charge for each additional copy. i. You hereby agree to fully indemnify Landmark against any claim losses or other damages suffered by Landmark as a result any breach by any recipient of the Services of these Terms. j. You agree that You will comply with any reasonable instructions that We may give from time to time with regard to the use of the Intellectual Property Rights, including but not limited to acknowledging that the Services and Reports are confidential to You, Your Client or the persons set out in Clause 3.b. k. The mapping contained in any Services is protected by Crown Copyright and must not be used for any purpose outside the context of the Services or as specifically provided by these Terms. 4. Charges a. Landmark may grant You a credit limit in order to allow You to transact with it or set up an Account and reserves the right to withdraw any such credit limit at any time without prior notice. b. You are fully responsible for all charges that accumulate on Your Account. c. VAT at the prevailing rate shall be payable in addition to the Landmark Fees. You shall pay any other applicable indirect taxes related to Your use of the Services. d. An individual or a monthly invoice showing all Orders created will be generated subject to these Terms. You will pay the Landmark Fees at the rates set out in Landmark's or its Authorised Reseller's invoice. The Landmark Fees are payable in full within 28 days without deduction, counterclaim or set off. You acknowledge that time is of the essence with respect to the payment of such invoices. Non-payment of Landmark Fees may, at Our sole discretion result in Landmark terminating or limiting the use of Your Account and its provision of Services to You. Landmark reserve the right to amend the Landmark Fees from time to time and the Services will be charged at the Landmark Fee applicable at the date on which the Service is ordered. e. We may charge interest on late payment at a rate equal to 8% per annum above the base lending rate of National Westminster Bank plc. f. Landmark or its Authorised Reseller shall not be obliged to invoice any party other than You for the provision of Services, but where Landmark or its Authorised Reseller does so invoice any third party at Your request, and such invoice is not accepted or remains unpaid, Landmark or its Authorised Reseller shall have the option at any time to cancel such invoice and invoice You direct for such Services. Where Your order comprises a number of Services or severable elements within any one or more Services, any failure by Landmark or its Authorised Reseller to provide an element or elements of the Services shall not prejudice Landmark's or its Authorised Reseller's ability to require payment in respect of the Services delivered to You 5. Termination a. Landmark may suspend or terminate Your rights under these Terms without any liability to You with immediate effect if at any time:i. You fail to make any payment due in accordance with Clause 4; ii. You repeatedly breach or commit or cause to be committed any material breach of these Terms; or iii. You commit a breach and You fail to remedy the breach within 7 days of receipt of a written notice to do so Landmark may remedy the breach and recover the costs thereof from You; or iv. You commit an act of bankruptcy or insolvency, are unable to pay Your debts as or when they fall due or make any composition or arrangement with Your creditors, or go into liquidation whether voluntary or compulsory, or if any order is made or a resolution is passed for Your winding up (except for the purpose of a solvent amalgamation or reconstruction), or if You cease or prepare to cease trading, or if You suffer the appointment of a receiver, administrative receiver, administrator or similar officer over the whole or part of any of Your assets. b. If Your rights are terminated under this Clause and You have made an advance payment We will refund You a reasonable proportion of the balance as determined by Us in relation to the value of Services previously purchased. c. We may suspend the Agreement between You and Landmark for an indefinite period without notice and at any time if in Our opinion You are in breach of any of the provisions of these Terms. 6. Liability a. We provide warranties and accept liability only to the extent stated in this Clause 6. b. Nothing in these Terms excludes either party's liability for death or personal injury caused by that party's negligence or willful default. c. As most of the information contained in the Services is provided to Landmark by others, Landmark cannot control its accuracy or completeness, nor is it within the scope of Landmark's Services to check the information on the ground. Accordingly, subject to clause 6b, Landmark will only be liable to You for any loss or damage caused by its negligence or wilful default and neither Landmark nor any person providing information contained in any Services shall in any other circumstances be liable for any inaccuracies, faults or omissions in the Services nor shall Landmark have any liability if the Services are used otherwise than in accordance with these Terms. d. Save as precluded by law, Landmark shall not be liable for any indirect or consequential loss, damage or expenses (including loss of profits, loss of contracts, business or goodwill) howsoever arising out of any problem, event, action or default by Landmark or any indirect or consequential loss of any nature whatsoever or for any physical damage to or loss of Your tangible property, any other direct loss, damage, cost or expense of any kind or any indirect or consequential loss, damage, cost or expense of any kind, whether any of the above arise under contract, tort (including negligence), an indemnity or contribution or otherwise. e. In any event, and notwithstanding anything contained in these Terms, Landmark's liability in contract, tort (including negligence or breach of statutory duty) or otherwise howsoever arising by reason or in connection with this Contract (except in relation to death or personal injury) shall be limited to an aggregate amount not exceeding £1 million if the complaint is in relation to a Report on residential property and an amount not exceeding £10 million in respect of any other Report or Service purchased from Landmark except in so far as Landmark will not be liable for any defect, failure or omission relating to Services that is not notified to Landmark within six months of the date of the issue becoming apparent and in any event, within one year of the date of the Report if the complaint is in relation to a Report on residential property and within six years of h. the date of the Report in respect of any other Report or Service. Where any claim relates to either a part of the Services that is not chargeable or if You have been in breach of any part of these Terms Landmark's liability shall be limited to £1,000 f. No person may rely on the Report more than 12 months after its original date. g. You acknowledge that:i. You shall have no claim or recourse against any Third Party Content supplier nor any of our other Suppliers. You will not in any way hold us responsible for any selection or retention of, or the acts of omissions of Third Party Content suppliers or other Suppliers (including those with whom We have contracted to operate various aspects or parts of the Service) in connection with the Services (for the avoidance of doubt Landmark is not a Third Party Content supplier). Landmark does not promise that the supply of the Services will be uninterrupted i. or error free or provide any particular facilities or functions, or that the Content will always be complete, accurate, precise, free from defects of any other kind, computer viruses, software locks or other similar code although Landmark will use reasonable efforts to correct any inaccuracies within a reasonable period of them becoming known to us; ii. Landmark's only obligation is to exercise the reasonable skill and care in providing environmental property risk information to persons acting in a professional or commercial capacity and You hereby acknowledge that You are such a person; iii. no physical inspection of the Property Site reported on is carried out as part of any Services offered by Landmark and as such We do not warrant that all land uses or features whether past or current will be identified in the Services and the Services do not j. include any information relating to the actual state or condition of any Property Site nor should they be used or taken to indicate or exclude actual fitness or unfitness of a Property Site for any particular purpose nor should it be relied upon for determining saleability or value or used as a substitute for any physical investigation or inspection; iv. You should carefully inspect the Property Site, and take any other advice that would be reasonably prudent to do prior to making any decision about the Property Site to which any Report or Service relates and not rely exclusively on the Report or any other Landmark Services in terms of valuing the Property Site; v. Landmark will not be held liable in any way if a Report on residential property is used for commercial property or more than the one residential property for which it was ordered; Time shall not be of the essence with respect to the provision of the Services. 7. Events Beyond Our Control You acknowledge that Landmark shall not be liable for any delay, interruption or failure in the provision of the Services which are caused or contributed to by any circumstance which is outside our reasonable control including but not limited to, lack of power, telecommunications failure or overload, computer malfunction, inaccurate processing of data, or delays in receiving, loading or checking data, corruption of data whilst in the course of conversion, geocoding, processing by computer in the course of electronic communication, or printing. 8. Severability If any provision of these Terms are found by either a court or other competent authority to be void, invalid, illegal or unenforceable, that provision shall be deemed to be deleted from these Terms and never to have formed part of these Terms and the remaining provisions shall continue in full force and effect. 9. Governing Law This Agreement shall be governed by and construed in accordance with English law and each party agrees irrevocably submit to the exclusive jurisdiction of the English courts as regards any claim or matter arising under this Agreement. If any dispute arises out of or in connection with this agreement (a "Dispute") the parties undertake that, prior to the commencement of Court proceedings, they will seek to have the Dispute resolved amicably by use of an alternative dispute resolution procedure acceptable to both parties with the assistance of the Centre for Dispute Resolution (CEDR) if required, by written notice initiating that procedure. If the Dispute has not been resolved to the satisfaction of either party within 60 days of initiation of the procedure or if either party fails or refuses to participate in or withdraws from participating in the procedure then either party may refer the Dispute to the Court. 10. Entire Agreement a. These Terms, together with the prices and delivery details set out on our Websites and Your Order comprise the whole of our agreement relating to the supply of Services to You by Landmark. No prior stipulation, agreement, promotional material or statement whether written or oral made by any sales or other person or representative on our behalf should be understood as a variation of these Terms or as an authorised representation about the nature or quality of any Services offered for sale by us. Save for fraud or misrepresentation, Landmark shall have no liability for any such representation being untrue or misleading. b. These Terms shall prevail at all times to the exclusion of all other terms and conditions including any terms and conditions which You may purport to apply even if such other provisions are submitted in a later document or purport to exclude or override these Terms and neither the course of conduct between parties nor trade practice shall act to modify these Terms. 11. General a. You shall not without our prior written consent assign, or transfer in any way the benefit of these Terms in whole or in part or any of Your obligations under these Terms save as provided by Clause 3.b. Your right to use the Services, operate Your Account or to designate users is not transferable b. In the event that there is a material defect You will notify us in writing of such defect within seven days of its discovery; xi. without prejudice to any restrictions set out in these Terms, if in the course of Your business or otherwise You use for the benefit of or convey to any third party any part of the Website, Content, or Services You must make such third parties aware of the limitations, obligations and acknowledgements contained herein; xii. any support or assistance provided to You in connection with these Terms is at Your risk; xiii. the information contained in the Services has been extracted from various Crown Copyright and other published sources, and accordingly, Landmark does not accept any responsibility, and expressly disclaims all liability, for any errors, omissions or misstatements, or for any loss occasioned to any person acting, or refraining from action, as a result of, or in reliance upon, the information contained in these Services; All liability for any insurance products purchased by You rests solely with the insurer. Landmark does not endorse any particular product or insurer and no information contained within the Services should be deemed to imply otherwise. You acknowledge that if You Order any such insurance Landmark will deem such as Your consent to forward a copy of the Report to the insurers. Where such policy is purchased, all liability remains with the insurers and You are entirely responsible for ensuring that the insurance policy offered is suitable for Your needs and should seek independent advice. Landmark does not guarantee that an insurance policy will be available on a Property Site. All decisions with regard to the offer of insurance policies for any premises will be made solely at the discretion of the insurers and Landmark accepts no liability in this regard. The provision of a Report does not constitute any indication by Landmark that insurance will be available on the property. If Landmark provides You with any additional service obtained from a third party, including but not limited to any professional opinion, interpretation or conclusion, risk assessment or environmental report or search carried out in relation to a Report on Your Property Site, Landmark will not be liable in any way for any information contained therein or any issues arising out of the provision of those additional services to You or Your Client. Landmark will be deemed to have acted as an agent in these circumstances and the supply of these additional services will be governed by the terms and conditions of those Third Parties. Landmark Information Group Limited, 7 Abbey Court, Eagle Way, Exeter, EX2 7HY © Landmark Information Group Limited Version 5.02 24 Jun 2005 APPENDIX D Site Investigation Method E09559/AUG06/V1 Christmas Lodge, Aldershot Hampshire County Council 40 Cable Percussive Boreholes A total of 3 no. boreholes were sunk on the site using cable percussive methods between 31st May and 2nd June 2006. Borehole locations are shown in Figure SK02 and logs of the encountered conditions in Appendix E. The cable percussive method is the usual means employed for soft ground boring in the UK. All boring operations, sampling of soils, in situ testing has been carried out in accordance with the recommendations of the British Code of Practice, BS 5930 (1999) `Site Investigations'. Whilst the technique allows the maximum data to be obtained in soft ground, some disturbance in variation of soft and layered soils is unavoidable. Sampling and in situ testing was carried out in all boreholes and records of the tests are shown on the logs. The Standard Penetration Test (SPT) consists of driving a split spoon sampler into the ground using an automatic trip hammer to provide a consistent blow energy. The number of blows are recorded over 75mm intervals, the first 150mm being considered as a seating drive and the summation of the blow counts over the following 300mm providing the N value. In granular soils the split spoon sampler is replaced with a solid cone of equivalent diameter and an included angle of 60o (CPT). In areas of unstable ground the sides of the borehole are supported by casing, the depth of which is also shown on the borehole logs. The logs also indicate where water inflows were encountered and where appropriate an estimate of flow is also provided. Upon completion of BH1, a single 50mm diameter dual purpose HDPE land gas and ground water monitoring standpipe was installed to allow subsequent monitoring. Trial Pitting A total of 7no. trial pits were excavated on the site using a mechanical backhoe excavator (JCB-type) on 2nd June 2006. The trial pit locations are shown in Figure SK02 with logs of the encountered conditions presented in Appendix E. All excavations were backfilled with arisings on completion. Sampling Disturbed and undisturbed samples were taken from the exploratory holes at the depths shown on the records. Small disturbed samples were obtained from throughout the boreholes, primarily for identification and laboratory testing purposes. Bulk disturbed samples were recovered from granular deposits for testing and to enable more representative descriptions for coarse-grained soils to be made. Monitoring Land gasses were monitored in standpipes during 2no. return visits to site on 7th and 15th June 2006. Typical land gasses methane, carbon dioxide and oxygen were monitored. Groundwater levels were monitored during 2no return visits 7th and 15th June 2006) using an electronic dual-phase dip meter. Results are presented in Appendix F. Calibration certificates for each item of monitoring equipment, valid during the monitoring period, can be made available on request.
