GENERAL TERMS OF SALE
1. VALIDITY OF APPLICATION
The following conditions apply to all commercial contracts for products that are marketed and sold by
AUSA Corporation.
2. PRICES
The prices for products marketed and sold by AUSA Corporation are those that are found in the most
current version of the AUSA Corporation Price List and are valid at the moment of the delivery of goods.
AUSA Corporation reserves the right to modify any price on its products without any previous notice.
3. TERMS OF PAYMENT
All Payments are due net 30 days with a 1% discount if paid in net 10 days from the date of invoicing
(1% net 10 / Net 30) unless otherwise specified by AUSA Corporation.
Payment can be made by cashiers check or corporate check to: AUSA Corporation, 2655 Le Jeune
Road, Suite 808, Coral Gables, FL 33134.

4. CARRIAGE
All AUSA machines will be delivered FOB Houston. It is the responsibility of the customer to arrange and
assume the costs for delivery from the above mentioned location to the final destination. It is the
responsibility of the customer to perform an inspection of the machine(s) at time of delivery and report
any damage at that time to AUSA Corporation.
5. PACKAGING
All machinery will be prepared to protect against damage during transit and will include all corresponding
manuals, certificates and forms that should accompany the machine and are to be delivered to the
owner. It is the responsibility of the customer to dispose of or recycle any packaging material.
6. WARRANTIES
Please see section ‘‘WARRANTY POLICY “.
7. JURISDICTION APPLICABLE
Any grievances or disputes related to this document must be settled in the courts of the state of
Delaware, United States of America.

WARRANTY POLICY
WARRANTY TERMS:
All new and unused (AUSA) products are warranted to be free of defects in material and workmanship
for a period of twelve (12) months from the date of delivery to the first retail purchaser, or 1,500 hours of
use (or otherwise indicated), whichever shall occur first. However, in no event shall the warranty
extended past fifteen (15) months from the date of delivery to the Dealer. AUSA will assume
responsibility for repair or replacement, at its option, of any part of assembly proven to AUSA´s
satisfaction to be defective in normal use and service during that time.
Routine warranty service must be provided by authorized AUSA Dealers or distributors who shall be
reimbursed for the reasonable cost for parts and labour necessary to correct defects covered by this
warranty.
All of AUSA’s Official Agents are required to give the benefit of the following warranty conditions (which
are not transferable) to the FIRST RETAIL PURCHASER of the machine supplied by AUSA:
The selling authorized AUSA Dealer must notify AUSA CORPORATION, within 72 hours, of the date of
sale or date “in service” of the machine, by phone, fax, e-mail, or USPS for the AUSA warranty to
become valid.
The AUSA Warranty Claims must be filed in a timely manner, no later than 60 (sixty) calendar days from
the date of occurrence.
The AUSA warranty may be invalidated where the following has been found to apply (See
WARRANTY EXCLUSIONS):
a) The machine has been used to perform tasks that demand more than the design and strength
limitations of the product.
b) Conditions of usage can be determined to be abnormal.
c) Normal maintenance, with regard to requirements as set out and detailed by the manufacturer, have
not been adhered to.
d) The machine has undergone any modification without the express official consent of AUSA.
e) When the original seals have been broken.
f) The warranty only applies to the owner who is named in the warranty certificate.
g) When the serial number has been altered, defaced, or removed, or if payment for the equipment is in
default
No warranty will be accepted by AUSA in respect of machine or component failure when it can be
determined that such failure is the result of using the equipment with one or more attachments not given
prior application approval by them.
WARRANTY EXCLUSIONS:
This warranty is given in lieu of all other warranties expressed, implied, or statutory, including, but not
limited to, any warranty of merchantability or fitness for a particular purpose.
All faults caused by negligence, accident and misuse are excluded from any warranty. This would
include damage due to collision, corrosion, fire, theft, freezing, vandalism, riot, acts of nature, explosion,
or objects striking the product.
Service Items: filters (air, fuel, hydraulic), hoses, injection elements (if any inadequate fuel is proved to
have been used), belts, batteries, bulbs, tires, pneumatic tubes, brake pads, windscreen wiper, tires,
lubricants and antifreeze.
Soil engaging parts (buckets, etc.), clutch and brake disc, cab glass.

GENERAL CONDITIONS:
It should be noted that normal maintenance services such as engine tuning, brake/clutch adjustments
and the supply of materials used in any service carried out are not covered by the terms of the warranty.
In no event shall the user be entitled to recover under this warranty for incidental or consequential
damages, for loss of profit or for other economic loss caused by the vehicle to people or properties,
rental or replacement equipment.
AUSA reserves the right to make changes in the design of its products without incurring any obligation to
incorporate such changes in any product previously produced.
JURISDICTION APPLICABLE:
Any grievances related to this document must be settled in the courts of the state of Delaware, United
States of America.

WARRANTY CLAIM PROCEDURE
Rules for the administration of warranty claims:
Whenever parts are needed to solve problems covered under warranty, the dealer must use parts from its
stock of recommended parts. These parts must be then itemized on a warranty claim form and submitted to
AUSA Corporation; in return, any part covered under warranty will be replaced by AUSA Corporation at no
extra charge.
In the event that the damage or problem cannot be solved with parts in the dealer’s stock, a Purchase Order
itemizing the parts needed must be faxed to AUSA Corporation. The parts will then be shipped to the dealer
along with the corresponding invoice. Once the parts and invoice are received, a warranty claim form making
reference to the invoice received must be faxed to AUSA Corporation, in order to receive a credit for the
parts covered under warranty.
Regarding labor costs for repairing warranted parts during the warranty period, AUSA will be
willing to accept the following labor cost allowance:
Labor: 50% of posted rate (advertised). Mileage not included.
In this case, Dealer has to send AUSA a detailed labor costs report together with a copy of the AUSA
Warranty Claim Form.
If faults/damages are confirmed to be covered by warranty, AUSA will notify the Dealer in writing about the
acceptance of the claim costs to be invoiced.
Warranty claim forms instructions:
It is the dealer’s responsibility to order claim forms from AUSA Corporation.
Each warranty claim form has a reference which must be quoted in all correspondence.
Dates must be included as these are of great importance for identifying reasons for damage and also for
statistical studies at a later date.
The information system at AUSA identifies a machine by its Serial Number; please also include "Model
Number" in order to eliminate errors.
Any optional "Accessories" mounted on the machine must be included on the form as this gives us some
idea on the type of work that the affected vehicle has been subjected to.
Including the initial "Date of sale" along with the details of the company will link the warranty claim form with
the warranty registration certificate. Remember that the services official is the registered owner.
When the machine is repaired in a "Workshop" authorized by an AUSA Dealer which is not their own, this
must be clearly stated on the form.
The section "Description of fault" must include the date of your first contact with the client.
In the case of repairs which are carried out externally and need to be explained to our After Sales Service
Dept please ensure that a "Telephone number" and the contact information of the technician responsible
for the repair is clearly stated.
Substituted parts which are used in repairs must be noted in the box headed "Orders under warranty"
along with "Parts to be sent" indicating its defect.

Clearly and legibly note the "Quantity", "AUSA reference", a short description of the part and most
important a description of the defect in the part. This will allow a more precise and rapid diagnosis of the
fault.
On the reverse of the form there is a space for further notes or observations.
Parts restocking policy:
Unused parts purchased from AUSA Corporation can be returned, only once per year, no later than October
30th. Shipping costs of returned parts will be the dealer’s sole responsibility.
A restocking fee equal to 15% of the value of the parts will apply. The difference will be credited to the dealer
for future purchases of parts.
