Beginning in 2005, CJJ is also the proud host and sponsor of the growing National Juvenile Justice Network. CJJ’s principal mission is to build safe communities one child at a time by ensuring that all children and families are treated fairly and given the resources and support to be positive and productive contributors to society. CJJ accomplishes its mission by: ◊ Promoting the best policies and practices in delinquency reduction and prevention. ◊ Educating the public and advising policy makers on urgent issues in juvenile justice. ◊ Assisting U.S. states and territories to meet the core requirements of the federal Juvenile Justice and Delinquency Prevention Act. ◊ Instituting effective and needed system reforms to improve the quality, cultural sensitivity and accessibility of community and court-based services for children, youth and families. ◊ Linking national, state and local advocates and organizations together, across many disciplines and circumstances, to pursue a common mission. 1 CJJ EXECUTIVE BOARD The CJJ Executive Board holds legal, fiduciary, strategic and policy-setting authority for CJJ and is empowered to take action between meetings of the Council of SAGs. Recipients Anthony Gobar (Commemorative) 2004 Suzanne Toguchi 2005 Pat Cervera 2006 Larry Carter 2007 Richard Lindahl 2008 35 CJJ FORMAL POSITION STATEMENTS All CJJ positions are formulated by member committees composed of representatives from a diversity of states and must receive the support of a two-thirds majority of the CJJ Council of SAGs to be adopted. Children Detained in Adult Jails (Adopted in 1983; reaffirmed in 1990) Delinquent youth, most of whom are nonviolent offenders, are in physical and emotional danger in adult jails. Furthermore, children placed in isolation cells are at high risk of committing suicide. Placing offenders under the age of 18 in adult lock-ups must be avoided and only done if extenuating circumstances make placement in a juvenile facility impossible and, then, for six hours or less. In such cases, it is imperative that juveniles have no physical, visual or verbal contact with adult inmates. Serve Status Offenders in Their Homes and Communities (Adopted in 1986) Status offenders are best served at home or in community-based settings, close to home, school and community. Status offenders are youth who engage in behavior – such as breaking curfews, running away from home, skipping school, etc. – only considered delinquent because they are minors. These youth often commit such actions in response to underlying problems. CJJ advocates for status offenders to be provided with appropriate services and supports at home, or if not possible, close to home and in a healthy school and community context. It is contrary to both federal law and effective practice to lock up status offenders. Unequal Treatment of Minority Youth in the Juvenile Justice System (Adopted in 1989; updated in 2001) CJJ believes that all children deserve to be treated fairly – regardless of race, ethnicity or other factors. CJJ urges policy makers to craft solutions that motivate police, officers of the court and correctional providers to ensure unbiased and rehabilitative treatment of all youth who come into contact with the justice system. (Continued) 36 CJJ FORMAL POSITION STATEMENTS Youth of color receive harsher sanctions than their similarly-situated white counterparts at every stage of the juvenile court system, from the point of surveillance to disposition/trial, sentencing and incarceration. Youth of color comprise more than two-thirds of the juveniles held in confinement, but less than one-third of the U.S. youth population. African American youth are six times more likely to be locked up for person offenses and nine times more likely to be locked up for violent offenses as compared with white youth charged with the same types of offenses. Latino youth represent approximately 12% of the U.S. population, yet 15% of the youth population sentenced to adult prisons. Such inequalities are startling, prevalent and well documented. Limit Youth Transfers to Adult Criminal Court (Adopted in 1992) CJJ opposes trying and sentencing youth in adult criminal court, except in the rare case of a chronic and violent offender, and then only at the discretion of, and following an assessment by, a juvenile court judge. Under no circumstance does CJJ support sending a child younger than age 15 into the adult criminal justice system. CJJ also opposes giving prosecutors the authority to transfer youth to adult court. It is harmful to community safety, as well as young offenders themselves, to sentence youth to adult jurisdiction. In adult prisons, youth under age 18 are eight times more likely to commit suicide, five times more likely to be sexually assaulted, and, upon release, much more likely to re-offend than youth handled in the juvenile justice system. Children’s Right to Legal Counsel (Adopted in 1994) CJJ agrees with the U.S. Supreme Court decisions In Re Gault and Kent v. United States that guarantee children accused of delinquent offenses and their families a right to counsel. Furthermore, CJJ believes that in no case should a child surrender or waive the right to legal counsel. Access to competent counsel is necessary to ensure that children – particularly those from lowincome families and of racial, ethnic and linguistic minority background – are treated fairly if they come into contact with the juvenile justice system. CJJ calls upon the federal and state governments to provide resources to facilitate training and leadership which will ensure the highest quality of legal representation for all children. 37 CJJ FORMAL POSITION STATEMENTS The Role of Prevention (Adopted in 1995) CJJ recognizes that prevention is the most constructive way to build safe communities. Effective prevention efforts – in the form of mentoring initiatives, after-school programs, family strengthening services, youth leadership development, etc. – reduce victimization, keep children involved in productive activities and provide for the cost-effective use of public resources. CJJ calls for the balance of federal juvenile justice funding to go toward community-connected prevention and rehabilitation, rather than interdiction and incarceration. Unaddressed Mental Health Needs (Adopted in 1995; updated in 2000) CJJ believes that children require effective and culturally sensitive assessment, diagnosis and treatment, not incarceration, if they suffer with mental health needs. CJJ advocates for non-institutional, community and family-connected services and supports for children with mental illnesses. The juvenile court system is largely ineffective at identifying – much less treating – mental health problems. Yet, data show that fifty to seventy-five percent of youth in juvenile detention facilities may have diagnosable mental illnesses. To the extent that court professionals serve children with mental health needs, they must use culturally sensitive and comprehensive assessments, and, whenever viable, engage in familycentered and community-based interventions to recognize and treat childhood mental illnesses. Juvenile Death Penalty (Adopted in 1994) In March, 2005, in a seminal 5-to-4 decision, the U.S. Supreme Court struck down capital punishment for individuals who committed crimes while under the age of majority. For 11 years prior to this decision, CJJ formally opposed the use of the death penalty for any and all individuals whose offenses were committed before the age of 18 years. In 2004, CJJ filed a brief as amicus curiae before the U.S. Supreme Court to support the abolition of the death penalty in Roper v. Simmons, with counsel from Joseph D. Tydings, Miriam R. Vishio and Erin L. A: There are three categories of CJJ memberships for State Advisory Groups, Affiliate Organization Members and Individual Members at Large, as follows: Category 1: State Advisory Group (SAG) Members. The principal members of CJJ are members of State Advisory Groups (SAGs), citizen volunteers, court services and agency staff, as well as state juvenile justice specialists, DMC coordinators and compliance monitors. Nationwide, 56 such SAGs are appointed by Governors and Chief Executives of all U.S. states, territories and the District of Columbia. A majority of the nation’s SAGs are members in good standing with CJJ. In fact, CJJ was founded by SAG members in the 1980s—to serve as an independent, national nonprofit organization, governed by and for SAGs. SAG Chairs or their Chair-designees form the CJJ Council of SAGs. This Council elects Officers to the CJJ Executive Board from among interested members whose states are members of CJJ. Annual Membership Fee: $5,000, which includes all SAG members and SAG designated state staff. Exceptions apply to non-contiguous states, U.S. territories and states out of compliance with JJDPA who wish to apply for provisional membership. Category 2: Affiliate Organization Members. Affiliate Organization Members are local, state or national organizations whose mission comports with CJJ’s mission, core positions and strategic plan. Affiliate Organization Members have one vote per organization at regional meetings and may be elected by Regions to serve as Regional Representatives on the CJJ Executive Board. How are membership fees used by CJJ? How much of the CJJ budget is funded by membership fees? A. Use of the membership fees is determined by the CJJ Council of SAGs (Chairs of member SAGs) and the Executive Board each year, consistent with CJJ’s long-range strategic plan. In the past three years (2005-current fiscal year), membership fees have constituted approximately 20% of the overall CJJ budget. The remaining 80% is provided by foundation grants, earned income and other charitable contributions. Since NJJN’s inception, the John D. and Catherine T. MacArthur Foundation has supported its growth from six to its current membership of thirty-two state advocacy organizations. Vision The vision of the National Juvenile Justice Network is that juvenile justice systems in all 50 states, U.S. territories and the District of Columbia will have laws, policies and programs that ensure the healthy development and fair and equitable treatment of all children and youth, through the work of a movement of local, state and national advocates for children and youth, working collaboratively to advance a common juvenile justice agenda and through a state-based network that is an effective and respected force for state level juvenile justice reform. Mission The mission of the National Juvenile Justice Network is to enhance the capacity of state-based juvenile justice coalitions and organizations to advocate for state and federal laws, policies and practices that are fair, equitable and developmentally appropriate for all children, youth and families involved in the justice system. Leadership NJJN is guided by a seven-member Executive Committee that is elected by the NJJN Membership.
