FOREWORD
Ordinance 535, s-2014 is enacted for the purpose of improving the efficiency of buildings
in the use of natural resources, contributing to the global efforts in reducing Green House
Gas (GHG) emissions and minimizing impact of buildings on health and environment
through Green Building Regulations.
Applicable to new buildings in selected categories, the five areas of building performances
targeted are as follows: Energy Efficiency,
Water Efficiency, Materials and Waste
Management, Site Sustainability, Indoor Environmental Quality.
Both the Ordinance and its IRR were done in a consultative, participatory and inclusive
manner involving major stakeholders such as developers, property owners, professional
organizations, suppliers, community organizations and home-owners’ associations to
ensure public acceptance.
This handbook is developed in preparation for the establishment and operation of a
Center for Excellence to efficiently share the Mandaluyong experience and other success
stories related to the implementation of the GB Code of the City.

ORDINANCE NO. 535, S–2014
AN ORDINANCE ADOPTING THE 2014 GREEN BUILDING
REGULATIONS OF MANDALUYONG CITY
AND FOR OTHER PURPOSES
WHEREAS, the 1987 Constitution of the Republic of the Philippines recognizes the right
of the people to a balanced and healthful ecology in accord with the rhythm and harmony of
nature;
WHEREAS, Republic Act 7160, or the Local Government Code of 1991 mandates all
Local Government Units to ensure and promote the health and safety of the people, and enhance
their right to a balanced ecology;
WHEREAS, overwhelming scientific evidence shows that global warming is altering the
earth’s normal temperature and rainfall patterns, and that human activities such as burning of
fossil fuel and land use change due to rapid urbanization are considered as significant factors that
contribute to the Green House Gas (GHG) balance of the earth, which in turn leads to climate
change;
WHEREAS, the effects of climate change are now being felt throughout the world in
periods of long drought, abnormal deluges and floods–globally known as
El Niño and La
Niña phenomena and more unpredictable weather conditions; and recent weather–related
environmental catastrophes demonstrate the harmful effects of climate change in the Philippines;
WHEREAS, these intertwined problems of climate change, social inequity, rising energy
prices, and degradation of the natural systems require an integrated response that goes far beyond
reducing carbon emissions;
WHEREAS, climate change adaptation must be inextricably linked with actions to create
and maintain jobs, improve community liveability and public health, address social inequity and
foster strong, resilient natural system;
WHEREAS, it is globally recognized that green building can significantly
improve
energy, water and resource efficiency, reduce waste and pollution generation, protect the
environment, and improve occupants’ health and productivity;
WHEREAS, it has become imperative for both public and private buildings
to
include green building and landscape requirements based on local climatic, geological, and
topographical conditions which, while stricter than current building standards, are shown to be
cost effective over the life of the building;
WHEREAS, in order to ensure environmental sustainability of buildings, reduce its
negative impact to health and environment and consequently drive market transformation, there is
a need for the Local Government as building regulator to formulate, adopt and implement green
building regulations;
WHEREAS, the City of Mandaluyong has a long standing commitment to leadership in
Green Building standards, sustainable design and construction practices, efficient water and other
resource conservation and management and the reduction of Green House Gas Emissions;

NOW, THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod ng
Mandaluyong in a session assembled:
ARTICLE I
TITLE OF THE ORDINANCE
SECTION 1.
TITLE OF THE ORDINANCE. This Ordinance shall be known and referred to
as the “2014 Green Building Regulation of Mandaluyong City”.
ARTICLE II
AUTHORITY AND PURPOSE
SECTION 2.
AUTHORITY. This Ordinance is enacted pursuant to the Local Government
Code which mandates the Local Government Units to ensure and support, among
other things, the preservation and enrichment of culture, promote health and
safety, enhance the right of people to a balanced ecology and preserve the
comfort and convenience of their inhabitants.
SECTION 3.
PURPOSE. This Ordinance is enacted for the purpose of improving
the
efficiency of buildings in the use of natural resources, contributing to the global
efforts in reducing Green House Gas (GHG) emissions and minimizing impact
of buildings on health and environment through Green Building Regulations.
Green Building is the practice
of adopting sustainable features and measures
in the design, construction and operation of buildings.
ARTICLE III
DEFINITION OF TERMS AND PHRASES

APARTELLE. The collaboration or the combination of an apartment and a
hotel. It is a place of accommodation. It is similar to a pension house, a tourism
inn, a guest house and a dormitory.

ASHRAE. American Society of Heating, Refrigerating and Air– Conditioning
Engineers.

BUILDING ENVELOPE. The interface and thermal barrier between the
interior of the building and the outdoor environment including the walls, roof
and foundation.

CARBON EMISSION. The release of carbon into the atmosphere.

COMMERCIAL BUILDING. Building that is used for commercial purposes.
Types can include office buildings, retail, convenience store and shopping
malls.

EDUCATIONAL BUILDING. Building designed for various activities in a
primary, secondary, or higher educational system and often including living
areas for students.

ENERGY. The ability or capacity to do work or to produce change. Forms of
energy include heat, light, sound, electricity and chemical energy.

GREEN BUILDING. An integrated whole-building approach to the planning,
design, construction, operation, and maintenance of buildings and their
surrounding landscape that help mitigate the environmental, economic and
social impacts of buildings through the following: site conservation and
sustainable planning, water conservation and efficiency, energy efficiency and
renewable energy; conservation of materials and resources, and improved
indoor environmental quality and human health.

GREEN HOUSE GAS. Any of the atmospheric gases that contribute to the
greenhouse effect.

GREEN MATERIALS. Includes all construction materials, hardware and
fittings, rough–ins and finishing that are certified environment–friendly and the
practice of optimizing its use such that construction debris and waste generated
are limited to a minimum.

INDOOR ENVIRONMENTAL QUALITY. Refers to indoor air quality that
focuses on airborne contaminants as well as other health, safety and comfort
issues.

MACHINERIES. Refers to machines, equipment mechanical contrivances,
instruments, appliances or apparatus which may or may not be attached,
permanently or temporarily to the real property, it includes the physical
facilities for production, the installation and appurtenant service facilities, those
which are mobile, self–powered or self–propelled, and those not permanently
attached to the real property which are actually directly, and exclusively used
to meet the needs of particular industry, business or activity and which
by
very nature and purpose are designed for, or necessary to its manufacturing,
mining, logging, commercial, industrial or agricultural purposes.

MIXED USED BUILDING. Medium to high rise building that
blends any
combination of residential, commercial, cultural and institutional use.

MODIFICATION/RENOVATION. Rehabilitation or expansion of an existing
building and covers any of the following scope of works:

Construction of additional floor area or renovation of floor area of at least
1,000 sq.m.

OFFICE BUILDING. Building in which business, clerical, or professional
activities are conducted.

RENEWABLE ENERGY. Energy that comes from resources which are
continuously replenished such as sunlight, wind and geothermal heat.

RETAIL. Business dedicated to the sale of goods or commodities in small
quantities directly to the ultimate consumers.

RESIDENTIAL BUILDING. Building/structure for exclusive use as multiple
family dwellings with mixed housing types, may include low, medium or high–
rise residential condominium buildings and apartelle that are already
commercial in nature or scale.

SITE SUSTAINABILITY. The manner by which the building is located and
constructed so as to minimize the use of energy, water and natural resources,
generate less waste, and minimize the
impact on the land compared to
traditional design, construction and maintenance techniques.

TOTAL FLOOR AREA. The total floor space within the building computed by
measuring to the exterior face of the permanent external building walls. Total
Floor Area shall include all floor space within a building, specifically:

Interior walls and columns, and other interior features
Covered areas used for parking and driveways, including vertical
penetrations in parking floors where no residential or office units are present,
plant boxes and residual areas arising from the layout of parking lots.
Uncovered areas for AC cooling towers, overhead water tanks, roof decks,
laundry areas and cages, wading or swimming pools, whirlpools or Jacuzzis,
gardens, courts and function areas.
ARTICLE IV
SCOPE, COVERAGE AND APPLICABILITY

SCOPE. Green Building aims at improving building performance in the

COVERAGE AND APPLICATION. This Green Building Regulation applies to
all buildings to be constructed as specified herein.
5.1
Green Building requirements shall apply entirely to new buildings in the
following categories:

For mixed–use buildings, building requirements for each building type
incorporated into the mixed–use building shall apply.
SECTION 6.
5.2
Green Building requirements apply to scope of works covered by
modification/renovation of existing buildings in the categories above and
covering a floor area of at least 1,000 square meters.
5.3
The Mandaluyong City Green Building Authority (MCGBA) as defined herein
shall review the application of this regulation to building categories and total
floor areas three years from the adoption of this ordinance and every year
thereafter. The Mandaluyong City Green Building Authority (MCGBA) may
broaden the application to include other measures, building categories, existing
buildings and/or lower corresponding total floor areas.
APPROACH.
6.1. Compliance with the National Building Code, its IRR and Reference Codes
and other relevant laws is mandatory.
6.2. This Ordinance prescribes additional mandatory measures that
have been
predetermined through detailed analysis to achieve savings in energy and
water efficiency, materials and waste efficiency, Indoor Environmental
Quality (IEQ) and site sustainability. Other measures not included may be
considered by the applicant/ project in order to achieve greater efficiency and
savings for energy and water consumption.
SECTION 7.
GREEN BUILDING REGULATIONS.
7.1
ENERGY EFFICIENCY
a. Purpose. Energy Efficiency requires the adoption of efficient practices,
designs, methods and technology that reduce energy consumption resulting
in cost savings as well as reduced consumption of non–renewable energy.
b. The applicant/project shall comply with the list of measures indicated in the
table below.

design, materials, fixtures, equipment and methods
that reduce water
consumption resulting in cost savings as well as reduced consumption of
potable water and maximize use thru re–use and re–cycling.
b. The applicant/project shall comply with the list of measures indicated in the

SITE SUSTAINABILITY
a. PURPOSE. Site sustainability requires the adoption of design, construction
and operation practices that minimize the impact of buildings on ecosystems
and water resources.
b. The site sustainability measure below must be complied with.

MANAGEMENT ARRANGEMENTS
SECTION 8.

RESPONSIBILITY FOR ENFORCEMENT.
8.1.
OFFICE OF THE LOCAL CHIEF EXECUTIVE (LCE). This Ordinance shall
be enforced and administered by the LCE.
8.2.
TECHNICAL SUPPORT. The Mandaluyong City Green Building Council and
the Mandaluyong City Green Building Authority, which are herein established,
shall provide technical support to the Local Chief Executive (LCE).
MANDALUYONG CITY GREEN BUILDING COUNCIL (MCGBC). The
Mandaluyong City Green Building Council is hereby established subject to the
arrangements below:
9.1
COMPOSITION. The Mandaluyong City Green Building Council (MCGBC)
shall be composed of the following:

9.2
TECHNICAL SUPPORT. A Technical Working Group and Secretariat shall be
created to provide technical assistance to the Mandaluyong City Green Building
Council.
9.3
HONORARIA. For the effective performance of its functions, the members of
the Mandaluyong City Green Building Council, Technical Working Group and
the Secretariat shall be entitled to a monthly honorarium subject, however, to
change depending on new or
recent legislations, memoranda, circulars or

9.4
MEETINGS. The Mandaluyong City Green Building Council (MCGBC) shall
meet regularly at least once a month. In case of urgent issues, the Mandaluyong
City Green Building Council (MCGBC) may hold a special meeting to address
the said issue.
9.5
DUTIES AND RESPONSIBILITIES. The Mandaluyong City Green Building
Council (MCGBC) shall perform the following duties and responsibilities:

Facilitate the review of this Green Building Ordinance and recommend to
the Sangguniang Panlungsod necessary amendments or adoption of new
Green Building Regulations.
b.
Monitor implementation, conduct study and research to update the
ordinance.
c.
Evaluate and approve incentives to be given to owners/ developers.
d.
Determine and recommend to Sangguniang Panlungsod the annual budget
of a Transitory Green Building Office for the operation and
implementation of the Green Building Ordinance. The budget of such
transitory office shall be sourced from the approved budget of the
MCGBA.
SECTION 10. MANDALUYONG CITY GREEN BUILDING AUTHORITY. To provide
technical assistance and support to the Local Chief Executive, a Mandaluyong
City Green Building Authority (MCGBA) is hereby
created. The Mandaluyong
City Green Building Authority (MCGBA)
shall be headed by the City Green
Building Officer (CGBO), who shall manage and supervise the operations of the
Mandaluyong City Green Building Authority (MCGBA).
10.1
COMPOSITION. The Office of the MCGBA shall be composed of the
following personnel, subject to the Qualification Standards of the Civil Service
Commission. The composition of Mandaluyong City Green Building Authority
(MCGBA) shall not exceed the following staffing structure.

QUALIFICATIONS AND RESPONSIBILITIES OF THE CITY GREEN

10.3
The City Green Building Officer (CGBO) shall be:
1.
Filipino citizen, a resident of the City of Mandaluyong and of good
moral character;
2.
A registered voter of the city of Mandaluyong;
3.
Duly Registered Architect or Civil Engineer, or any other relevant
profession;
4.
Current member of a duly accredited organization of his/her
profession and in good standing for the last two (2) years.
5.
Must have a planning, design and management experience for at
least five (5) years prior to his appointment.
The City Green Building Officer (CGBO) shall perform the following
duties and responsibilities:
1.
Act on all applications for Green Building Compliance Certificate
(GBCC) for all projects, issue the Green Building Pre–Compliance
Certificate (GBPCC) and Green Building Compliance Certificate
(GBCC).
2.
Conduct continuing study in green building trends
and standards
and coordinate with the Mandaluyong
City Green Building
Council (MCGBC) regarding proposed amendments to the
Ordinance prior to the adoption by the Sangguniang Panlungsod.
3.
Monitor projects and issue notices of violation and
show cause
orders to owners, developers, or managers of projects that are in
violation of the Green Building Ordinance and if necessary, refer
subsequent actions thereon to the appropriate agency.
CAPACITY BUILDING. The City Green Building Official (GBO) and the
technical staff of the Mandaluyong City Green Building Authority
(MCGBA) shall be authorized to undergo technical trainings on Green
Building to enhance their capacities to perform their functions in
implementing this Code.
a.
To further enhance capacities, the City Green Building Official (GBO) and
the technical staff shall also have the privilege of receiving support for
training to qualify them as Green Building expert or its equivalent in any
recognized Green Building System, subject to the provision below.
b.
All staff of the Mandaluyong City Green Building Authority (MCGBA)
who receive support for training to qualify as Green Building expert under
the provision above shall submit a sworn statement of commitment to
serve the Mandaluyong City Green Building Authority (MCGBA) in
his/her capacity for a minimum of three (3) years. Any staff who availed
of the above but opted to leave the service in less than three years after
being qualified and for no valid reason as determined by the Local Chief
Executive shall be obliged to pay the cost to the Local Government Unit
for supporting his/her training.

TRANSITORY GREEN BUILDING OFFICE. Upon approval of this
Ordinance, the City Planning and Development Department shall act as the
transitory Mandaluyong City Green Building Authority (MCGBA) under the
supervision of the Mandaluyong City Green Building Council (MCGBC) and
shall remain as such until an official Mandaluyong City Green Building
Authority (MCGBA) is fully organized and established. The City Planning and
Development Coordinator shall act as the temporary City Green Building Officer
and shall appoint or designate any employees of the City Government of
Mandaluyong and/or recommend hiring or hire additional personnel who, in his
discretion, have the technical knowledge and capability to efficiently handle the
work, and occupy the position of the officers and staff of the Mandaluyong City
Green Building Authority (MCGBA). Provided that, the number of temporary
officers and staff does not exceed what is required in the approved structure of
the Mandaluyong City Green Building Authority (MCGBA).
10.5
BUDGETARY ALLOCATION. Upon determination of sufficiency of funds by
the Office of the Local Chief Executive and after complying with the existing
laws, rules and regulations, an annual appropriation for the established MCGBA
shall be included in the regular budgeting procedures to cover the operational
and management expenses as well as other expenses necessary for the proper,
responsive and full operation of the organized and established MCGBA.
The officers and staff of the Transitory Green Building Office shall be
entitled to a monthly compensation not exceeding 25% of their respective
monthly salary without prejudice to other allowances, honoraria or incentives
compensatory to other duties and tasks assigned to them.
ARTICLE VI
GREEN BUILDING (GB) CERTIFICATION PROCESS
SECTION 11. GREEN BUILDING CERTIFICATE. All owners and developers of
projects
within the coverage of this Ordinance shall secure the following certificates:

GB Compliance Certificate (GBCC) in Construction
SECTION 12. GREEN BUILDING PRE–COMPLIANCE CERTIFICATE (GBPCC) IN
BUILDING DESIGN.
12.1
BUILDING PERMIT. For buildings covered by this Ordinance, no building
permit shall be issued without a GBPCC in Design.
12.2
DOCUMENTARY REQUIREMENTS. Proponent shall be required to submit
the following documentary requirements for the evaluation of the MCGBA:

Duly accomplished application form;
2.
At least seven (7) sets of complete plans (Architectural, Structural,
Mechanical, Electrical, Sanitary, and Electronics) signed by the owner or his
duly authorized representative and relevant professionals;

General specification of materials/equipment to be used for
the Green
Building measures duly signed and sealed by professionals concerned and
owner of building or duly authorized representative;

7.
Computation of projected building consumption for energy (kwh/capita or
sq.m) and water (cu.m/capita or sq.m) specifying local design standards
used.
8.
Projected building consumption for energy (kwh/capita or sq.m) and water
(cu.m/capita or sq.m) upon application of Green Building Measures
EVALUATION AND ISSUANCE. Issuance of the GBPCC in the Design shall
be subject to satisfactory finding that the project drawings and specifications
have complied with the requirements of this Code. The GBPCC shall be issued
by the MCGBA only upon presentation of the official receipt of payment.
GREEN BUILDING COMPLIANCE CERTIFICATE IN CONSTRUCTION.
13.1
OCCUPANCY PERMIT. No Occupancy Permit for buildings covered under this
Ordinance shall be issued prior to the issuance of the Green Building
Compliance Certificate in Construction.
13.2
DOCUMENTARY REQUIREMENTS. Proponent shall be required to submit
the following documentary requirements for the evaluation of the MCGBA.
Assessment will be made with the MCGBA Site Inspection Report:

Three (3) sets of As Built plan duly signed by the owner or his duly
authorized representative and relevant professionals.

SECTION 14. REPORTORIAL REQUIREMENTS.

ANNUAL REPORTS. The developer/administrator of the Building shall submit
to the MCGBA an annual report, commencing one year from the issuance of the
occupancy permit. The report shall contain the following information:

CONFIDENTIALITY. All information shall be treated with confidentiality and
shall be aggregated. No specific attribution shall be made to a building or
building owner when data is presented publicly.

SECTION 15. GREEN BUILDING FEES. The rate of filing and processing fees for the Green
Building Certificate shall be as follows:

A surcharge of one hundred percent (100%) of the total Green

proprietor, owner or representative who commences or undertakes
any project without having first secured a Green Building Pre–
Compliance Certificate and which shall be due upon securing of
such certificate.
SECTION 16. PROCEEDS FROM GREEN BUILDING FEES. All payments for
Green
Building Fees shall be made directly to the City Treasurer’s Department, eighty
percent (80%) of which shall accrue to the
General Funds of the City of
Mandaluyong and shall be dedicated
for infrastructure support, environmental
projects of the City Government and shall augment the funds of salaries and
wages of
the MCGBA and twenty percent (20%) from such Green Building
Fees to be deposited into a City Government trust fund to be used as follows:

Fifteen Percent (15%) to fund requirements for transportation expenses, office
supplies and equipment and personnel capacity enhancement activities of the
MCGBA.

Five Percent (5%) as productivity incentives for personnel actually involved in
City Green Building policy formulation and implementation such as members of
the MCGBC, MCGBA, Sangguniang Panlungsod Committee on Engineering
and Public Works and Heads and staff
of the City Planning and Development
Office and Engineering Department involved in green building activities.

ARTICLE VIII
CENTER FOR EXCELENCE
SECTION 17. CENTER FOR EXCELLENCE. The City shall allocate an area to serve as the
Green Building Center for Excellence. The center shall be managed by the
MCGBA and shall showcase Green Building success stories, processes and
reference materials to be open to visitors free of charge. The MCGBA shall be
authorized to host Green Building Learning Events.
ARTICLE IX
INCENTIVES AND PENALTIES
SECTION 18. INCENTIVES. The City shall provide incentives as may be deemed appropriate
by the Mandaluyong City Green Building Council to owners and developers
whose buildings have complied with the provisions of this Ordinance.
18.1
INCREASED BUILDING HEIGHT LIMIT (BHL) AND FLOOR AREA
RATIO (FAR). Any owner or developer who was issued a Green Building Pre–
Compliance Certificate shall automatically be granted Floor Area Ratio or
Building Height Limit as indicated below, whichever is applicable, subject to the
provisions of Section 13 of this Ordinance:

REAL PROPERTY TAX DISCOUNT ON MACHINERY AND
IMPROVEMENT. Any owner or developer who was able to secure a Green
Building Compliance Certificate and Occupancy Permit shall automatically be
given the following:
a.
A discount of fifty percent (50%) on Real Property Tax on Machinery for
every machinery installed in accordance with Section 7 Green Building
Regulations.
b.
A discount of ten percent (10%) on Real Property Tax on Improvement.
Provided:
a.
Such discounts shall be applied directly to the tax due as computed by the
City Assessor’s Department pursuant to the Tax Code of the City of
Mandaluyong;

Such discounts shall apply only to the first year of payment
of taxes;

Such discounts shall be independent of other applicable discounts as
defined in the Tax Code of the City of Mandaluyong.

SECTION 19. PENALTIES. Any person who violates any provision of this Ordinance shall,
upon conviction be penalized with fine from a minimum of
Five Hundred
Pesos (P500.00) up to a maximum of Five Thousand Pesos (P5,000.00) or
imprisonment of two (2) months to one (1) year, or both, at the discretion of the
Court. If the violator is a corporation
or partnership, the penalty prescribed
above shall be imposed upon
the president and/or general manager or the
managing partner, as
the case may be, of the erring entity. These penalties are
without prejudice to the filing of the proper administrative, criminal or civil
actions in the proper court, body or tribunal for violations of other laws.
ARTICLE X
FINAL PROVISION
SECTION 20. IMPLEMENTING RULES AND REGULATIONS. Within six (6) months from
the effectivity of this Ordinance, a team composed of the MCGBA, City Planning
and Development Department, Engineering Department,
City Health
Department, City Assessor, and City Legal Department
shall prepare the
implementing rules and regulations of this Ordinance for approval of the LCE.
The IRR shall be subject to periodic review
of said team. In case of extreme
necessity, said team shall convene immediately to evaluate which portion is
difficult to conform with and/ or is counter to the objective of the City. Said
team shall draft and recommend a revised IRR subject to approval of the LCE.
SECTION 21. REPEALING CLAUSE. All local Ordinances of the Sangguniang Panlungsod
ng Mandaluyong and Executive Orders and Administrative Regulations of the
Local Chief Executive, or parts thereof which are inconsistent with any of the
provisions of this Ordinance are hereby repealed or modified accordingly.
SECTION 22. SEPARABILITY CLAUSE. Should any part or provision of this Ordinance be
held unconstitutional or invalid by a competent court, the other
parts or
provisions hereof which are not affected thereby shall continue to be in full
force and effect.

FOREWORD
The Mandaluyong City Green Building Project commenced with a Cooperation Agreement
signed between the City of Mandaluyong and the International Finance Corporation on
October 2012 that has effectivity until June 30, 2017. The project is focused on developing
and implementing green building regulations in the city of Mandaluyong that will result in
increased efficiency of buildings in the use of resources such as energy, water and materials
thus minimizing the impacts of buildings on human health and the environment. With the
creation of a City Green Building Team through Executive Order No. 04, series of 2012 and
under the technical assistance of the International Finance Corporation, Ordinance No. 535,
s-2014 otherwise known as the “2014 Green Building Regulation of Mandaluyong City” was
adopted on January 27, 2014 during the second and final reading by the Sangguniang
Panlungsod ng Mandaluyong.
Ordinance No. 535, s-2014 is the output of several fora conducted at the national level,
consultation with local government units, massive stakeholders’ consultation at the city
level, ocular inspection of actual buildings certified by established Green Building Rating
Systems, and a market study of at least 60 buildings in Metro Manila, Metro Cebu and Metro
Davao to establish the baseline for determining green measures appropriate for local
investment climate.
The Ordinance is designed for application to new buildings of specific categories but with
provisions for revision and gradual expansion to cover other categories of buildings in the
future. The Ordinance also provides for the preparation of an Implementing Rules and
Regulations to simplify interpretation of its various provisions.
This IRR details technical descriptions, guidelines and approaches for easier compliance to
mandatory measures for energy and water efficiencies. Other building performance areas
mentioned in the Ordinance such as Materials and Waste Management, Site Sustainability,
and Indoor Environmental Quality require simple measures, hence, do not warrant further
detailing and discussion.
The realization of this IRR is made possible through the combined efforts of the
Mandaluyong City Officials and the City Green Building Team, the International Finance
Corporation Team of consultants including the Philippine Green Building Initiative, with
the participation of various stakeholders on building design, construction and operation.

PURSUANT TO THE PROVISIONS OF ARTICLE X, SECTION 20 OF ORDINANCE NO. 535,
S-2014, OTHERWISE KNOWN AS THE “2014 GREEN BUILDING REGULATIONS OF
MANDALUYONG CITY”, THE FOLLOWING RULES AND REGULATIONS ARE HEREBY
ADOPTED IN ORDER TO CARRY OUT THE PROVISIONS OF THIS ORDINANCE.
RULE I
TITLE AND PURPOSE
ARTICLE 1. TITLE. These rules shall be known and cited as the Implementing Rules and
Regulations of Ordinance No. 535, s-2014 otherwise known as 2014 Green Building
Regulations of Mandaluyong City.
ARTICLE. 2. PURPOSE. The purpose of these Implementing Rules and Regulations (IRR)is
to provide detailed guidelines for the effective implementation of the 2014 Green Building
Regulations of Mandaluyong City.
RULE II
DEFINITION OF TERMS AND PHRASES
ARTICLE 3. DEFINITION. For purposes of this IRR, the following definition of terms,
phrases and acronyms shall apply:
Apartelle. The collaboration or the combination of an apartment and a hotel. It is a place of
accommodation. It is similar to a pension house, a tourism inn, a guest house and a
dormitory.
ASHRAE. American Society of Heating, Refrigerating and Air– Conditioning Engineers.
Automatic: Self-acting, operating by its own mechanism when actuated by some nonmanual influence, such as a change in current strength, pressure, temperature, or
mechanical configuration.
Automatic Control Device: A device capable of automatically turning loads off and on
without manual intervention.
BOD: Biological Oxygen Demand (is an indication of organic matter in wastewater)
Building Envelope. The interface and thermal barrier between the interior of the building
and the outdoor environment including the walls, windows, ground floor, roof and
foundation.
Building materials: Any element of the building envelope through which heat flows and
that is included in the component U-factor calculations other than air films and insulation

Carbon Emission. The release of carbon into the atmosphere.
COD: Chemical Oxygen Demand (is an indication of organic matter in wastewater)
Coefficient of Performance (COP) : The ratio of the rate of heat removal to the rate of
energy input, in consistent units, for a complete refrigerating system or some specific
portion of that system under designated operating conditions.
Commercial Building. Building that is used for commercial purposes. Types can include
office buildings, retail, convenience store and shopping malls.
Daylight Zones: A daylight zone is defined as an area with a depth of 5 meters parallel to
any glazed external wall or 1.5 times of the head height of the windows, whichever is
larger.
Educational Building. Building designed for various activities in a primary, secondary, or
higher educational system and often including living areas for students.
Energy. The ability or capacity to do work or to produce change. Forms of energy include
heat, light, sound, electricity and chemical energy.
Energy Efficiency Ratio (EER): The ratio of net cooling capacity in Btu/h to total rate of
electric input in watts under designated operating conditions.
Fan System Power: The sum of the nominal power demand (nameplate horsepower) of
motors of all fans that are required to operate at design conditions to supply air from the
heating or cooling source to the conditioned space(s) and return it to the source or exhaust
it to the outdoors.
Green Building. An integrated whole-building approach to the planning, design,
construction, operation, and maintenance of buildings and their surrounding landscape
that help mitigate the environmental, economic and social impacts of buildings through the
following: site conservation and sustainable planning, water conservation and efficiency,
energy efficiency and renewable energy; conservation of materials and resources, and
improved indoor environmental quality and human health.
Green House Gas. Any of the atmospheric gases that contribute to the greenhouse effect.
Green Materials. Includes all construction materials, hardware and fittings, rough–ins and
finishing that are certified environment–friendly and the practice of optimizing its use such
that construction debris and waste generated are limited to a minimum.
Gross Roof Area: The area of the roof measured from the exterior faces of walls or from
the centerline of party walls.

Indoor Environmental Quality. Refers to indoor air quality that focuses on airborne
contaminants as well as other health, safety and comfort issues.
Infiltration: The uncontrolled inward air leakage through cracks and crevices in any
building element and around windows and doors of a building caused by pressure
differences across these elements due to factors such as wind, inside and outside
temperature differences (stack effect) and imbalance between supply and exhaust air
systems.
Installed Interior Lighting Power: The power in watts of all permanently installed
general, task, and furniture lighting systems and luminaries.
Integrated Part-Load Value (IPLV): A single-number figure of merit based on part-load
EER, COP, or kW/ton expressing part-load efficiency for air-conditioning and heat pump
equipment on the basis of weighted operation at various load capacities for the equipment.
Light Power Density (LPD): The ratio between the total installed lighting power and the
total gross floor area. LPD for car parks is the total lighting power divided by the total car park
area.
Machineries. Refers to machines, equipment mechanical contrivances, instruments,
appliances or apparatus which may or may not be attached, permanently or temporarily to
the real property, it includes the physical facilities for production, the installation and
appurtenant service facilities, those which are mobile, self–powered or self–propelled, and
those not permanently attached to the real property which are actually directly, and
exclusively used to meet the needs of particular industry, business or activity and which
by very nature and purpose are designed for, or necessary to its manufacturing, mining,
logging, commercial, industrial or agricultural purposes.
Mixed Used Building. Medium to high rise building that blends any combination of
residential, commercial, cultural and institutional use.
Modification/Renovation. Rehabilitation or expansion of an existing building and covers
any of the following scope of works:
1. Any of the electrical works, HVAC System and Water Supply.
2. Construction of additional floor area or renovation of floor area of at least 1,000
sq.m.
Non-standard Part-Load Value (NPLV): A single-number part load efficiency figure of
merit calculated and referenced to conditions other than IPLV conditions, for units that are
not designed to operate at ARI Standard Rating Conditions.
Office Building. Building in which business, clerical, or professional activities are
conducted.

Occupancy Rate. For residential buildings, occupancy rate is the % of no. of units occupied
for most part of the year. For retail buildings, occupancy rate is the % of total floor area
that was not left vacant for most part of the year.
Occupancy Sensor: A device that detects the presence or absence of people within an area
and causes lighting, equipment, or appliances to be regulated accordingly.
Orientation: The direction an envelope element faces, i.e., the direction of a vector
perpendicular to and pointing away from the surface outside of the element.
Outdoor or Fresh Air: Air that is outside the building envelope or is taken from outside
the building and has not been previously circulated through the building.
Projection Factor: Projection factor for overhang is the depth of the overhang divided by
the height of the window. Projection factor of fins is the depth or length of fin divided by
the width of the window.
Pump System Power: The sum of the nominal power demand (nameplate horsepower) of
motors of all pumps that are required to operate at design conditions to supply fluid from
the heating or cooling source to all heat transfer devices (e.g. Coils, heat exchanger) and
return it to the source.
Rainwater Harvesting. Diversion and storage of rainwater from roof, terraces and
hardscape area for reuse.
Regularly Occupied Area: All the main areas in the buildings that are used on frequent
bases, such as living rooms, bedrooms, classrooms, lobbies, meeting rooms and office
spaces. Toilets, bathrooms, corridors and storage spaces will not be considered as
frequently occupied area.
Renewable Energy. Energy that comes from resources which are continuously
replenished such as sunlight, wind and geothermal heat.
Retail. Business dedicated to the sale of goods or commodities in small quantities directly
to the ultimate consumers.
Residential Building. Building/structure for exclusive use as multiple family dwellings
with mixed housing types, may include low, medium or high–rise residential condominium
buildings and apartelle that are already commercial in nature or scale.
Roof: The upper portion of the building envelope, including opaque areas and Window,
that is horizontal or tilted at an angle of less than 60° from horizontal.
Seasonal Energy Efficiency Ratio (SEER): The total cooling output of an air conditioner
during its normal annual usage period for cooling (in Btu) divided by the total electric
energy input during the same period (in Wh).

Site Sustainability. The manner by which the building is located and constructed so as to
minimize the use of energy, water and natural resources, generate less waste, and minimize
the impact on the land compared to traditional design, construction and maintenance
techniques.
Skylight: A window surface having a slope of less than 60 degrees from the horizontal
plane.
Set point: Point at which the desired temperature (°C) of the heated or cooled space is set.
Shading Coefficient (SC): The ratio of solar heat gain at normal incidence through glazing
to that occurring through 3 mm thick clear, double-strength glass, and calculated as SC =
SHGC/0.87. Shading coefficient, as used herein, does not include interior, exterior, or
integral shading devices.
Solar Heat Gain Coefficient (SHGC): The ratio of the solar heat gain entering the space
through the Window area to the incident solar radiation, expressed in percentage. Solar
heat gain includes directly transmitted solar heat and absorbed solar radiation, which is
then reradiated, conducted, or convected into the space.
Total Floor Area. The total floor space within the building computed by measuring to the
exterior face of the permanent external building walls. Total Floor Area shall include all
floor space within a building, specifically:

Variable Air Volume (VAV) System: HVAC system that controls the dry-bulb temperature
within a space by varying the volumetric flow of heated or cooled supply air to the space.

Ventilation: The process of supplying or removing air by natural or mechanical means to
or from any space. Such air is not required to have been conditioned.
Variable Speed Drive (VSD). The equipment used to control the speed of machinery by
changing the frequency at which the motor is operated. Where process conditions demand
adjustment of flow from a pump or fan, varying the speed of the drive may save energy
compared with other techniques for flow control.
Wall: That portion of the building envelope, including opaque area and window, that is
vertical or tilted at an angle of 60° from horizontal or greater.
1. Below-grade wall: that portion of a wall in the building envelope that is entirely
below the finish grade and in contact with the ground
2. Above-grade wall: a wall that is not a below-grade wall.
Wall area, gross: The area of the wall measured on the exterior face from the top of the
floor to the bottom of the roof.
Water efficient fittings: Water fittings such as faucets, showerheads and flushes that use less
water in order to perform the same function of cleaning as effectively as standard models.
Window Area: Total area of the Window measure using the opening and including the
glazing, sash and frame
Window to wall ratio: The ratio of the area of the windows or other glazing area to the
gross facade area measured from exterior expressed as a percentage

ARTICLE. 6. COVERAGE AND APPLICATION. This Green Building Regulation applies to
the following:
A. New buildings in the following categories:
1. Residential buildings with total floor area greater than 20,000 sq.m.
2. Office buildings with total floor area greater than 10,000 sq.m.
3. Mixed-use buildings with total floor area greater than 10,000 sq.m.
4. Educational buildings with total floor area greater than 5,000 sq.m
5. Retail buildings with total floor area greater than 15,000 sq.m.
6. Hotel buildings
7. Hospital buildings
8. Government Buildings
B. Modification/renovation of existing buildings in the categories above covering any of
the following scope of works, however, only specific green measures involved in such
renovation/modification shall be required to be consistent with the Ordinance :
1. Any of the electrical works, HVAC System and water supply.
2. Construction of additional floor area or renovation of floor area of at least 1,000
sq.m.
C. For mixed-use buildings, green building measures required for each building type
incorporated into the mixed-use building shall apply.

D. The Mandaluyong City Green Building Authority (MCGBA) as defined herein shall
review the application of this regulation to building categories and total floor areas three
years from the adoption of this ordinance and every year thereafter. The Mandaluyong
City Green Building Authority (MCGBA) may broaden the application to include other
measures, building categories, existing buildings and/or lower corresponding total floor
areas.
ARTICLE 7. APPROACH. Compliance with the National Building Code, its IRR and Reference
Codes and other relevant laws is mandatory.
ARTICLE 8. MANDATORY GREEN MEASURES. This are mandatory measures that
have been predetermined through detailed analysis to achieve savings in energy and
water efficiency, materials and waste efficiency, Indoor Environmental Quality (IEQ) and
site sustainability. Other measures not included may be considered by the applicant/
project in order to achieve greater efficiency and savings for
energy and water
consumption.
RULE IV
GREEN BUILDING MEASURES
ARTICLE 9. ENERGY EFFICIENCY. Energy Efficiency requires the adoption of efficient
practices, designs, methods and technology that reduce energy consumption resulting in
cost savings as well as reduced consumption of non-renewable energy in three areas –
Building Envelope, Efficiency in Mechanical System, and Efficiency in Electrical System.
A. Applicability. The applicant/project shall comply with the list of measures indicated
in the Table 1 below:

1. Air Tightness and Vapor Barrier is required only to air conditioned spaces in
buildings. All naturally ventilated buildings and spaces are exempt from this
requirement.
2. For all building types, Variable Speed Drives and High Efficiency Motors are
required in the following:
a. Cooling Towers and Closed Circuit Fluid Coolers
b. Hydronic System Design and Control (for pumps over 7.5 kW)
c. Air Handling Units (over 7.5 kW)
3. Kitchen ventilation fans are exempt from the rule on Variable Speed Drives and High
Efficiency Motors. All buildings without centralized cooling system are not required
to employ variable speed controllers.
4. Industrial kitchen extracts are exempt from the requirement on Enthalpy Recovery
of Exhaust Air.
5. For all buildings, critical spaces like operations theatres in hospitals are exempt from
the requirement on Ceiling Fans or Wall Fans. In other cases the designer will have
to clearly justify the reason for the exemption.
6. Critical zones with specific requirement are exempt from the requirement on
Daylight Controlled Lighting System. The designer will justify the reason for
exemption. In hotels, guest rooms are exempt.
7. Provision for emergency and security lighting are exempted from the requirement
on Occupancy Sensors. In hotels, the requirement applies to meeting rooms and
corridors. In both residential and school buildings, the requirement applies to
covered car parks and corridors.
B. Requirements
1. Building Envelope
a. Air Tightness and Vapor Barrier

(1) Buildings shall be designed with self-closing external doors for all air
conditioned spaces. Complete gaskets, weather-stripping, bottom sweeps
and seals within and around window and door assemblies shall be
provided.
(2) Buildings shall use the minimum fresh air rates in Table 2 as per PSVARE
2010 to ensure indoor air quality.
(3) The buildings shall also use vapor barrier in the external façade to reduce
the vapor migration from external spaces.

c. Operable Windows
(1)
To give building occupants the opportunity to use natural ventilation for
free cooling and fresh air, in frequently occupied areas, a fraction equal to
at least 5% of that floor area occupied shall be specified as open-able
window. Operable balcony doors can be counted for this calculation.
(2) All the operable windows above ground shall be designed with the safety
measures in place such as protection against typhoons and protection for
child safety.
2. Efficiency of Mechanical System
a. Energy Efficiency of Air-conditioning Equipment
(1) The cooling equipment shall meet or exceed the minimum efficiency
requirement of the 2010 PSVARE Standards for Energy Efficiency of
Buildings as shown in Tables 7 and Table 8 below:

c. Enthalpy Recovery of Exhaust Air
All the buildings with centralized air supply system shall use Enthalpy
Recovery Wheels with efficiency of at least 60% on minimum of 90% of exhaust
air.
d. Ceiling Fans or Wall Fans
All the regularly occupied rooms will be equipped with one ceiling or wall fan for
every 25m2 of occupied space.

3. Efficiency of Electrical System
a. Daylight Controlled Lighting System
(1) Daylight zones must be zoned independently and lighting must be
controlled through the use of photoelectric sensors on an auto on-off basis
or continual dimming. The photoelectric sensor shall be located
approximately at half (½) the depth of day-lit zone.
(2)
The light levels control points shall be adjusted as per the space lux
requirements. Dimming is an option in a space with 300 lux luminance
requirement.
(3) If occupancy sensors are installed in the daylight area, the occupancy sensor
shall override the daylight sensor during non-occupancy period.
b. Lighting Power Density (LPD)
(1) The average LPD limits for each building type shall comply with the 2010
PSVARE standards indicated in Table 10 below:

c. Occupancy Sensors.
For covered car parks, minimum 66% of the lighting must be controlled by the
occupancy sensors.

d. Lifts and Escalator Efficiencies
(1) Escalators
(a) Escalators must be fitted with automated controls to reduce to a slower
speed when no activity has been detected for a period of a maximum of
three (3) minutes.
(b)The escalator shall shut down when no activity has been detected for a
period of a maximum of fifteen (15) minutes. These escalators shall be
designed with energy efficient soft start technology. Activation of
reduced speed, power off and power on modes shall be done through
sensors installed in the top or bottom landing areas.
(2) Elevators (lifts). Elevators (lifts) shall be provided with controls to reduce
the energy demand. To meet this requirement, the following features must
be incorporated:
(1) Use of AC Variable-Voltage and Variable-Frequency (VVVF) drives on
non-hydraulic elevators.
(2) The lift car uses energy-efficient lighting and display lighting i.e. an
average lamp efficacy, across all fittings in the car, of >55 lamp lumens/
circuit watt and lighting switches off after the lift has been inactive for a
period of a maximum of five (5) minutes.
(3) The lifts operate in a stand-by condition during off-peak periods.
ARTICLE. 10. WATER EFFICIENCY. The purpose of water efficiency is to adopt efficient
practices, designs, methods and technology that reduce water consumption resulting to
cost savings.
A. Applicability. The applicant/project shall comply with the list of measures indicated in
the table 11 below:

(2) Rainwater Harvesting.
(a) Minimum storage tanks size (in cu.m) shall be calculated by dividing the
building footprint area by 75.
(b) Collected water shall be used for purposes of irrigation, car washing and
cooling tower makeup water (where relevant); or fed into the ground as
ground charging.
(3) Water recycling for cooling towers
Recycled water from sewage treatment plant shall be used for makeup water
for cooling towers. The recycled water produced on site should be used with
required treatment for cooling towers in the retail and hospital buildings. The
collected rain water can be used to dilute the recycled water to make it more
suitable for cooling towers.
ARTICLE. 11. MATERIALS AND WASTE MANAGEMENT. Materials Efficiency requires the
adoption of efficient waste management practices and use of materials that are
environment friendly and locally available.
A. Applicability. The applicant/project shall comply with the list of measures indicated
in the Table 13 below:

B. Requirements
1. Designated Smoking Area
a. All building types shall impose a “NO SMOKING” policy within the building and
property premises, except in special “designated smoking areas”
b. Adequately sized and placed signs shall be in conspicuous areas of the building
and property premises to remind building occupants of the ruling. Measures or
sanctions may be imposed on violators by the building owner if the ban is not
adhered to.
c. If provided, outdoor designated smoking areas shall be naturally ventilated,
outside of the building shell and away from building entrances, windows and
outside supply air (OSA) intakes by at least ten (10) meters
d. If provided, indoor designated smoking areas shall be partitioned from the rest
of the indoor areas. Partitions shall be from floor to soffit of the next floor or roof
structure. Enclosed smoking areas shall be equipped with adequate exhaust
system with exhaust rate as per 2010 PSVARE. Exhaust shall directly vent out to
the outside of the building and away from any building openings or air intakes.
Enclosed smoking area door and windows shall always be closed and wellsealed. Negative pressure within is recommended to prevent smoke infiltration
to adjacent spaces.
2. Designation of pantry or area for staff dining
a. For every 50 full time occupants, a minimum pantry area of 3 sq.m shall be
provided.
ARTICLE 13. SITE SUSTAINABILITY. Site sustainability requires the adoption of
design, construction and operation practices that minimize the impact of buildings on
ecosystems and water resources.

All building sites shall have vegetation cover on at least fifty (50%) percent of the required
unpaved surface area (USA) as per National Building Code. This can include application on
building property ground level and/or building deck surfaces dedicated for landscaping or
vegetation cover.
RULE V
MANAGEMENT ARRANGEMENTS
ARTICLE 14. RESPONSIBILITY FOR ENFORCEMENT. This IRR shall be enforced and
administered by the LCE.
Technical Support. The Mandaluyong City Green Building Council and the
Mandaluyong City Green Building Authority, which are herein established, shall provide
technical support to the Local Chief Executive (LCE).
ARTICLE 15. MANDALUYONG CITY GREEN BUILDING COUNCIL (MCGBC). The
Mandaluyong City Green Building Council is hereby established subject to the
arrangements below:

D. Meetings. The Mandaluyong City Green Building Council (MCGBC) shall meet regularly
at least once a month. In case of urgent issues, the Mandaluyong City Green Building
Council (MCGBC) may hold a special meeting to address the said issue.
E. Duties And Responsibilities. The Mandaluyong City Green Building Council (MCGBC)
shall perform the following duties and responsibilities:
1. Facilitate the review of the Green Building Ordinance and recommend to the
Sangguniang Panlungsod necessary amendments or adoption of new Green Building
Regulations.
2. Monitor implementation, conduct study and research to update the ordinance.
3. Evaluate and approve incentives to be given to owners/ developers.
4. Determine and recommend to Sangguniang Panlungsod the annual budget of a
Transitory Green Building Office for the operation and implementation of the Green
Building Ordinance. The budget of such transitory office shall be sourced from the
approved budget of the MCGBA.
ARTICLE 16. MANDALUYONG CITY GREEN BUILDING AUTHORITY. To provide technical
assistance and support to the Local Chief Executive, a Mandaluyong City Green Building
Authority (MCGBA) is hereby created. The Mandaluyong City Green Building Authority
(MCGBA) shall be headed by the City Green Building Officer (CGBO), who shall manage
and supervise the operations of the Mandaluyong City Green Building Authority (MCGBA).
A. Composition. The Office of the MCGBA shall be composed of the following personnel,
as shown in Annex “A” subject to the Qualification Standards of the Civil Service
Commission. The composition of Mandaluyong City Green Building Authority (MCGBA)
shall not exceed the staffing structure shown in Table 17 below:

B. Qualifications and Responsibilities of the City Green Building Officer (CGBO).
1. The City Green Building Officer (CGBO) shall be:
a. Filipino citizen, a resident of the City of Mandaluyong and
character;
of good moral
b. A registered voter of the city of Mandaluyong;
c. Duly Registered Architect or Civil Engineer, or any other relevant profession;
d. Current member of a duly accredited organization of his/her profession and in
good standing for the last two (2) years.
e. Must have a planning, design and management experience for at least five (5)
years prior to his appointment.
2. The City Green Building Officer (CGBO) shall perform the following duties and
responsibilities:
a. Act on all applications for Green Building Compliance Certificate (GBCC) for all
projects, issue the Green Building Pre–Compliance Certificate (GBPCC) and
Green Building Compliance Certificate (GBCC).
b. Conduct continuing study in green building trends and standards and coordinate
with the Mandaluyong
City Green Building Council (MCGBC) regarding
proposed amendments to the Ordinance prior to the adoption by
the
Sangguniang Panlungsod.
c. Monitor projects and issue notices of violation and show cause orders to
owners, developers, or managers of projects that are in violation of the Green
Building Ordinance and if necessary, refer subsequent actions thereon to the
appropriate agency.

C. Capacity Building.
1. The City Green Building Official (GBO) and the technical staff of the Mandaluyong
City Green Building Authority (MCGBA) shall be authorized to undergo technical
trainings on Green Building to enhance their capacities to perform their functions in
implementing this Code.
2. To further enhance capacities, the City Green Building Official (GBO) and the
technical staff shall also have the privilege of receiving support for training to
qualify them as Green Building expert or its equivalent in any recognized Green
Building System, subject to the provision below.
3. All staff of the Mandaluyong City Green Building Authority (MCGBA) who receive
support for training to qualify as Green Building expert under the provision above
shall submit a sworn statement of commitment to serve the Mandaluyong City
Green Building Authority (MCGBA) in his/her capacity for a minimum of three (3)
years.
4. Any staff who availed of the above but opted to leave the service in less than three
years after being qualified and for no valid reason as determined by the Local Chief
Executive shall be obliged to pay the cost to the Local Government Unit for
supporting his/her training.
ARTICLE 17. TRANSITORY GREEN BUILDING OFFICE.
A. The City Planning and Development Department shall function as the transitory MCGBA
until such time that the MCGBA is fully organized and functional;
B. The City Planning and Development Coordinator shall act as the temporary City Green
Building Officer and shall appoint or designate any employees of the City Government of
Mandaluyong and/or recommend hiring or hire additional personnel who, in his discretion,
have the technical knowledge and capability to efficiently handle the work, and occupy the
position of the officers and staff of the Mandaluyong City Green Building Authority
(MCGBA).
C. The number of temporary officers and staff shall not exceed what is required in the
approved structure of the Mandaluyong City Green Building Authority (MCGBA).
ARTICLE 18. BUDGETARY ALLOCATION.
A. Upon determination of sufficiency of funds by the Office of the Local Chief Executive
and after complying with the existing laws, rules and regulations, an annual appropriation
for the established MCGBA shall be included in the regular budgeting procedures to cover
the operational and management expenses as well as other expenses necessary for the
proper, responsive and full operation of the organized and established MCGBA.

B. The officers and staff of the Transitory Green Building Office shall be entitled to a
monthly compensation not exceeding 25% of their respective monthly salary without
prejudice to other allowances, honoraria or incentives compensatory to other duties and
tasks assigned to them.
RULE VI
GREEN BUILDING CERTIFICATION PROCESS
ARTICLE 19. GREEN BUILDING CERTIFICATE. All owners and developers of projects
within the coverage of this Ordinance shall secure the following certificates:
A. GB Pre–Compliance Certificate (GBPCC) in Building Design
B. GB Compliance Certificate (GBCC) in Construction
ARTICLE 20. GREEN
BUILDING DESIGN.
BUILDING PRE – COMPLIANCE CERTIFICATE (GBPCC) IN
A. Building Permit. For buildings covered by this Ordinance, no building permit shall be
issued without a GBPCC in Design.
B. Documentary Requirements. Proponent shall be required to submit the following
documentary requirements for the evaluation of the MCGBA:
1. Duly accomplished Application Form
2. At least seven (7) sets of Complete Plans (Architectural, Structural, Mechanical,
Electrical, Sanitary and Electronics) signed by the owner or his duly authorized
representative and relevant professionals. Out of 7 sets of document required, one (1)
set that provides details on the Green Building measures will be retained by the MCGBA.
3. One (1) copy of lot plan with vicinity map
4. General specification of materials/equipment to be used for the Green Building
measures duly signed and sealed by the owner or his duly authorized representative
and relevant professionals.
5. Bill of Materials for Green Building Measures:
(1) Bill of materials for proposed equipment to be installed for green measures
(2) Bill of materials for proposed other green measures to be installed
(3) Bill of materials for all other materials not included in items 1 and 2
6. Pre-Compliance Checklist of Requirements

7. Computation of projected building consumption for energy (kwh/capita or sq.m)
and water (cu.m/capita or sq.m) specifying Local Design Standards used
8. Computation of projected building consumption for energy (kwh/capita or sq.m.)
and water (cu.m./capita or sq.m.) upon application of Green Building Measures.
C. Evaluation And Issuance. Issuance of the GBPCC in the Design shall be subject to
satisfactory finding that the project drawings and specifications have complied with the
requirements of this Code. The GBPCC shall be issued by the MCGBA only upon
presentation of the official receipt of payment.
ARTICLE 21. GREEN BUILDING CERTIFICATE PROCESS FLOW. The process flow and
work flow for the application of the Pre-Compliance Certificate and Compliance Certificate
are shown and illustrated in Annexes “B1”, “B2” and “B3” respectively.
ARTICLE 22. GREEN BUILDING CERTIFICATE TIME TABLE. The time table for the
application of the Pre-Compliance Certificate and Compliance Certificate are shown and
illustrated in Annex “C”.
ARTICLE 23. GREEN BUILDING COMPLIANCE CERTIFICATE IN CONSTRUCTION.
A. Occupancy Permit. No Occupancy Permit for buildings covered under this Ordinance
shall be issued prior to the issuance of the Green Building Compliance Certificate in
Construction.
B. Documentary Requirements. Proponent shall be required to submit the following
documentary requirements for the evaluation of the MCGBA. Assessment will be made with
the MCGBA Site Inspection Report:
1. Duly accomplished Application Form and Compliance Checklist of Requirements
2. Three (3) sets of As-Built Plan that provide details on the Green Building measures
duly signed by the owner or his duly authorized representative and relevant
professionals are required. Only one (1) copy will be retained by the MCGBA.
3. Updated Bill of Materials if the actual cost of GB materials installed differs from the
bill of materials submitted for the GBPCC.
C. Evaluation And Issuance. Issuance of the Green Building Compliance Certificate in
Construction shall be subject to satisfactory finding that the project as constructed has
complied with the requirements of this Code
ARTICLE 24. REPORTORIAL REQUIREMENTS.
A. Annual Reports. The developer/administrator of the Building shall submit to the
MCGBA an annual report, in a standard format as prescribed by the MCGBA, commencing

one year from the issuance of the occupancy permit. The report shall contain the following
information:
1. Monthly Energy Consumption (kwh) and bill or equivalent document certified by
concerned utility company;
2. Monthly Water Consumption and bill or equivalent document certified by concerned
utility company;
3. Other Information. The developer/administrator of the Building shall submit to the
MCGBA information on Occupancy rate as well as other relevant data necessary for
building profiling that the MCGBA may request
B. Confidentiality. All information shall be treated with confidentiality and shall be
aggregated. No specific attribution shall be made to a building or building owner when data
is presented publicly.
RULE VII
GREEN BUILDING APPLICATION FORMS
ARTICLE 25. GREEN BUILDING PRE-COMPLIANCE CERTIFICATE IN BUILDING DESIGN.
A Checklist of Requirements and Application Form shall be accomplished by the proponent

RULE IX
CENTER FOR EXCELLENCE
ARTICLE 28. CENTER FOR EXCELLENCE
A. The City shall allocate an area to serve as the Green Building Center for Excellence.
B. The Center shall be managed by the City Green Building Authority and shall showcase
Green Building success stories, processes and reference materials to be open to visitors
free of charge.
C. The MCGBA shall be authorized to host Green Building Learning Events upon request of
other local government units and private sector with corresponding expenses to be borne
by the latter.
RULE X.
INCENTIVES AND PENALTIES
The City shall provide incentives as may be deemed
appropriate by the Mandaluyong City Green Building Council to owners and developers
whose buildings have complied with the provisions of this Ordinance.
ARTICLE 29. INCENTIVES.
A. Increased Building Height Limit (Bhl) And Floor Area Ratio (Far). Any owner or
developer who was issued a Green Building Pre–Compliance Certificate shall
automatically be granted Floor Area Ratio or Building Height Limit as indicated in Table
19 below, whichever is applicable.

B. Real Property Tax Discount On Machinery And Improvement. Any owner or
developer who was able to secure a Green Building Compliance Certificate and Occupancy
Permit shall automatically be given the following:
1. A discount of fifty percent (50%) on Real Property Tax on Machinery for every
machinery installed in accordance with Section 7 Green Building Regulations.
2. A discount of ten percent (10%) on Real Property Tax on Improvement.
3. Such discounts shall be applied directly to the tax due as computed by the City
Assessor’s Department pursuant to the Tax Code of the City of Mandaluyong;
4. Provided, such discounts shall apply only to the first year of payment of taxes;
5. Such discounts shall be independent of other applicable discounts as defined in the
Tax Code of the City of Mandaluyong.
C. Documentary Requirements. The incentives shall be given only upon submission of
the following:
1. Letter of Intent to avail of Green Building incentive to be submitted by the
developer/building administrator to the MCGBC, subject to evaluation and approval
of the MCGBC:
2. List of projects, building owners or developers qualified for tax discount to be
submitted by the MCGBC to the Assessor’s Department with respective documents
listed below:

3. The Assessors’ Department shall apply its normal procedures and requirements for
assessing real property tax due with the inclusion of the tax discount on machinery
and improvement.
ARTICLE 30. PENALTIES.
A. Any person who violates any provision of this Ordinance shall, upon conviction be
penalized with fine from a minimum of Five Hundred Pesos (P500.00) up to a maximum
of Five Thousand Pesos (P5,000.00) or imprisonment of two (2) months to one (1) year,
or both, at the discretion of the Court.

B. If the violator is a corporation or partnership, the penalty prescribed above shall be
imposed upon the president and/or general manager or the managing partner, as the case
may be, of the erring entity.
C. These penalties are without prejudice to the filing of the proper administrative, criminal
or civil actions in the proper court, body or tribunal for violations of other laws.
RULE XI
REVIEW AND REVISION
ARTICLE 31. PERIODIC REVIEW AND REVISION.
A. This IRR shall be subject to periodic review of a team composed of MCGBA, City
Planning and Development Department, Engineering Department, City Health Department,
City Assessor, and City Legal Department .
B. In case of extreme necessity, said team shall convene immediately to evaluate which
portion is difficult to conform with and/or is counter to the objective of the City. Said team
shall draft and recommend a revised IRR subject to approval of the LCE.
RULE XII
FINAL PROVISIONS
ARTICLE 32. AMENDATORY AND REPEALING CLAUSES. Any other issuance, executive
order, administrative order, proclamation, rule or regulation and/or parts thereof contrary
to or inconsistent with the provisions of this IRR is hereby amended, repealed or modified
accordingly.
ARTICLE 33. SEPARABILITY CLAUSES. If for any reason or reasons, any provision in this
IRR, is declared invalid or unconstitutional by a court of competent jurisdiction, the
remaining parts thereof not affected thereby shall continue to be in force and effect.
ARTICLE 34. TRANSITORY AND EXCLUSION CLAUSE. This shall denote that before the
effectivity of this IRR, activities shall continue with regards to evaluation of building
permits, real property tax payments and building inspections until the adoption of the IRR.
ARTICLE 35. EFFECTIVITY CLAUSES. This IRR shall take effect fifteen (15) calendar days
following its complete publication in at least one (1) newspaper of general circulation in
Metro Manila
