A home is made with love and dreams.” Avocado green trim, a bright orange front door and a cyclone fence gate. It was the ugliest house on the street….but it was our ugly house! We saw the potential beyond the red flock dining room wallpaper and the brown, yellow, red and orange indoor/outdoor kitchen carpet. The fact that it was considered the “party house” and everyone in Sacramento had a key to the house was just an added facet. That was 35 years ago. Very few walls are still in their original place, let alone the windows that had been nailed shut. We went from being the “youngsters” on the block to being the “old codgers”. We love our neighbors. We love the fact that our children grew up in this home. Our hands have dug every inch of the yard. We spent a summer putting pavers in our backyard. We have painted the same rooms more times that we care to count. It is home and we just can’t imagine living anywhere else. This is home ownership. Some consider it an investment, others a temporary place to live until they move on or up. I like to think of it as the safe haven to go to when it has been a challenging day. It is the place we celebrate birthdays and anniversaries. It is home. Home ownership is not called the American Dream casually. People save for years, striving to gather enough for a down payment. Even when achieved, it is work…the “welcome to home ownership” phrase came from discovering there is more to a home than just owning it. The kitchen sink leaks, the roof needs replacing, the lawn needs mowing…the list is ongoing. But, it is our list, our priorities, our future dreams for our home that make home ownership the ultimate anchor in our lives. The best news is that as REALTORS®, we have the opportunity to help our clients achieve the American Dream. Roland Benson NMLS ID 353144. 05012014. 8 CEO EXCHANGE CHIEF EXECUTIVE OFFICER DAVE TANNER Following the Rules About 35 years ago, the National Association of REALTORS® developed a policy referred to as the variable dues formula. That policy is required to be included verbatim in the Bylaws of the California (C.A.R.) and Sacramento Associations of REALTORS® (SAR). The policy provides that “the dues of each Designated REALTOR® Member shall be a base amount as established annually by the Board of Directors, plus an amount multiplied by the number of real estate salespersons and licensed or certified appraisers who: (1) are employed by or affiliated as independent contractors, or who are otherwise directly or indirectly licensed or certified with such REALTOR® Member; and (2) are not REALTOR® or Institute Affiliate Members of a REALTOR® association, C.A.R. and NAR, and the designated REALTOR® notifies the SAR in writing of the identity of the association to which dues have been paid, if not SAR.” Since that time, SAR has routinely billed Designated REALTORS® (DRs) each year based on the dues formula. Some DRs have routinely ignored the bills. Times have changed. With the ability to share and update information quickly via linked computer systems, we can no longer allow DRs to ignore these bills. If we do, severe sanctions may be imposed upon SAR. It would be extremely unfair to allow paid SAR members to be sanctioned by a reduction in privileges and services because others chose not to pay. In May, we sent out twenty-day letters to all DRs who had not paid their full dues and advised them that at the end of the twenty-day notice period SAR, C.A.R. and NAR services would be terminated to the DR and all associated licensees. This will be happening over the next few weeks. Once the deadline stated in the notice of suspension or termination of services have been reached, the DR and all associated licensees will lose access to zipForms®. They will also lose the right to use the term REALTOR® or the REALTOR® logo. If they are using the term within a business name or as part of a URL, they must immediately cease to use the name or URL. They may not use the term or logo on business cards, letterhead, etc. To do so would not only place the individual in violation of trademark laws as described in NAR, C.A.R. and SAR Bylaws, it would also make them subject to license revocation by CalBRE for representing membership in an entity of which they are not a member. Several brokers for affiliated businesses, such as property managers, have indicated an intention to terminate their REALTOR® membership rather than pay the dues the rest of the members pay. If you are referring business to one of these businesses, I encourage you to make sure you are referring your clients to a REALTOR®. Otherwise the licensee is not bound by the REALTOR® Code of Ethics and your clients may not receive that protection. As much as a matter of a mandatory policy, this is a matter of equity. Why should some licensees get a free ride on the backs of those who pay their dues? If you know someone who claims to be a REALTOR® without paying their dues, I encourage you to report them to SAR for trademark infringement. If you know someone who uses zipForms® without paying C.A.R. dues, I encouraged you to report them to C.A.R. for copyright infringement. If you know someone using the MLS or using an MLS key without paying their dues, I encourage you to report them to the MLS. If a licensee will cheat in these ways for a few hundred dollars per year, are they a person you want to work with in helping your clients buy or sell their most significant asset? 9 ABOUT THE MARKET Financing the American Dream – How it Began Owning a home is a goal for many Americans. The instrument commonly used in buying a home is a home loan. Even with today’s tighter guidelines, obtaining a home loan isn’t too difficult provided buyers meet the underwriting criteria. What many don’t know though is how did home financing begin? Prior to the Great Depression most home buyers either paid cash or obtained a loan through a local commercial bank, life insurer, or thrift. Loan terms were not uniform and typically required a 40% - 60 % down payment, had high interest rates with short repayment terms, and typically had a balloon payment due at the end. In 1932 the U.S. Government enacted the Federal Home Loan Bank Act (the Bank Act) to stabilize the housing market which was in turmoil due to high unemployment and mortgage defaults caused by the Great Depression. Out of the Bank Act our current lending institutions of Fannie Mae and the Federal Housing Administration (FHA) were started. FHA allowed lenders to loan with federally backed insurance for home mortgages, therefore lenders had better protection in the event of defaulted loans. Following Fannie Mae and FHA, Veterans Administration (VA) loans were created in 1944 for Veterans. Then in 1970 Freddie Mac began. Fannie Mae, Freddie Mac, FHA, and VA loans are still available today yet their directions have shifted a little over the last 80 years. Those shifts under the guidance of U.S. government are to delicately balance the ability to own a home with a stable housing market. In late May the House of Representatives voted overwhelmingly, 412-4, on the final version of the Water Resources Reform and Development Act (WRRDA) H.R. 3080. Days later the Senate voted 91-7 in support of the measure. Locally Congresswoman Matsui has championed the importance of flood control in Sacramento. She and her staff have spent many years working on this issue, never giving up after hitting numerous roadblocks. After the House of Representatives passed the bill, Congresswoman Matsui said “Today’s vote is a major victory for the people of Natomas and all of Sacramento. This important legislation includes several of our region’s largest flood protection priorities, including authorization of the Natomas Levee Improvement Project, as well as much needed reforms to the Army Corps’ vegetation on levee and crediting policies. The people of Natomas have waited too long for this day, but because of a lot of hard work, we are finally here.” This final version of WRRDA includes language that will allow final levee improvements in Natomas that will restore 100-year flood protection to the area. This language is nearly identical to Congresswoman Matsui’s Natomas Basin Flood Protection Improvements Act of 2013 (H.R. 135). Restoring 100-year flood protection is critical to over 100,000 Natomas residents and the $7 billion in property in the area. A disastrous flood in Natomas would negatively impact the entire Sacramento region, not only those who live and work in the area. Once these improvements are completed, and Natomas once again has 100-year flood protection the currently building moratorium will be lifted. The final WRRDA bill also includes language addressing vegetation on levees. Currently, the Army Corps of Engineers hold a”one-size-fitsall” national standard concerning vegetation on levees. The Corps recently moved a belief that levees should not have any vegetation on them. This legislation will require the Army Corps of Engineers to allow for regional variances with input from the state and local entities regarding levee vegetation. This is important to Sacramento where nearly all of our levees have a vast amount of vegetation on them. This language in this provision is similar to Congresswoman Matsui’s legislation the “Levee Vegetation Review Act” (H.R. 399). This bill is now headed to President Obama’s desk for signature. He is expected to sign it. If you weren’t at the Masters Club Mixer on March 27th you missed out on one fabulous parrrrrtaaaaaay! The Masters Club had one of their semi-annual complimentary “Mixers” at Kim Pacini Hauch’s gorgeous listing at 3031 Morse Avenue and WOW what a great event. Three local wineries, Jeremy, Steiner Family and Rebel Coast all poured wonderful wines. For those preferring beer, New Glory brewery poured generous servings of their local specialities. With professional harpist Elizabeth Bogdonavich playing in the background, it was a perfect setting for this outstanding event. These mixers are open to Masters Club members and their guests and are always complimentary… as in F R E E. Our next mixer will be held in September, so watch for invitations to go out at the end of August. Luis Sumpter is our new Masters Club President and has a full year of events and activities to oversee. Luis is highly visible in midtown and always sets a fine example of how professional exemplary REALTORS® contribute to their local communities. He’s an “honorary” Chair of many of the Masters Club Steering Committees and will actively participate in every event the Masters Club is involved in. Speaking of which, March 31st was the most recent REALTORS® Masters Club day of prepping and serving at Loaves and Fishes. Every month that has a fifth Monday, is the designated Monday for REALTORS® to help out at either the 7:30-10:00 a.m. prep shift or the 10:45 a.m.-1:30 p.m. serving shift. It’s a wonderful opportunity to give back to those less fortunate. Our next days to participate are: June 30th, September 29th and lastly December 29th. Please mark your calendar and join us at Loaves and Fishes. Our biggest fundraiser is the Masters Club Golf Tournament held every year on Monday, Columbus Day. To see a complete list, please click here. 14 L E G A L U P D AT E ATTORNEY STEVE BEEDE Solutions for Dealing with Non-Performing Buyers As I do seminars at real estate offices and REALTOR® meetings in the tri-County area, a common concern keeps arising... How to stop nonperforming buyers from tying up a property? This month’s legal update will address that issue and propose a solution that may prevent a listing from being held hostage. While presumably most buyers and their agents are operating in good faith, there are many others who are writing purchase offers on many properties, tying them up, and then failing to timely make their earnest money deposits. Once the seller has accepted the offer, the C.A.R. Residential Purchase Agreement expressly states at Article 14.C.(2): “Seller, after first delivering to Buyer a NBP (Notice to Buyer to Perform) may cancel this Agreement for any of the following reasons: (i) if Buyer fails to deposit funds as required by 3A or 3B; (ii) if the funds deposited pursuant to 3A or 3B are not good when deposited....”. The NBP will give the Buyer at least two days to perform. Significantly, under general contract law for a contract to be valid, it must be supported by valid “consideration,” in this case the purchase deposit. Absent good consideration, there is no binding contract. However, while that argument will work in a courtroom, it will not enable you to immediately disregard the accepted RPA if the Buyer fails to make the required deposit. So here are some possible solutions that may prevent your listing from being tied up in such a situation: 1) Counter-Offer - if the Buyer’s deposit is not delivered with the RPA, counter with a requirement for the deposit to be tendered or there is no deal; 2) Serve NBP with Acceptance - the standard RPA language calls for deposit within three days following acceptance (3.A(1)). NBPs can be served in advance of a performance date, therefore the NBP can be served with the acceptance and require that the funds must be in escrow within the 3 days. If not, the Seller can then terminate. 3) No Escrow without Funds - Do not open escrow without having the funds actually deposited. This avoids the delays of doing a Cancellation. There is no guaranty that non-performing Buyers will go away without a fight. But forcing them to do what they are contractually obligated to do will take away their leverage. More importantly, the listing agent owes a fiduciary duty to the Seller to protect the Seller’s interests and hopefully prevent the Seller’s property from being held hostage while a Buyer shops for deals. The objective of this article is to enable listing agents and Sellers to avoid a bad situation in the first place. Legal claims for recovery of damages are a different matter. Steve Schmidt, who served as a communications strategist for the presidential campaigns of John McCain and George W. Bush, joined David Plouffe, a former senior advisor to President Barack Obama, to offer predictions for the upcoming midterm elections and the impact they will have on Congress’ ability to pass meaningful housing legislation this year. “Over the next six years, neither party will have majorities in the U.S. Senate or House. We’re looking at six to eight Senate races that will be decided within four points or so,” said Plouffe. “Senators are frustrated; they’re serving in an institution that’s less popular than the Ebola virus. At some point, they are going to have to come to the middle and cooperate because that’s what the electorate wants.” Plouffe and Schmidt discussed the chances of Congress taking up tax reform or considering changes to the mortgage interest deduction this year. Both agreed that while a tax package will likely be discussed in 2015, it’s doubtful that it will include language to eliminate the mortgage interest deduction. According to Schmidt, the debate over the mortgage interest deduction will focus around who can benefit from it. “The issue with the deduction is going to be the amount – there’s going to be a lot of debate about whether people with million dollar homes should get the deduction. REALTORS® need to clearly stake out their position now and be firm on it,” he said. As the nation’s leading advocate for housing and homeownership, REALTORS® firmly believe that preserving the mortgage interest deduction is vital to the stability of the American housing market and economy. NAR will remain vigilant in opposing any plan that modifies or excludes the deductibility of mortgage interest. Both strategists offered advice to the thousands of REALTORS® who will be on Capitol Hill this week to advocate for key real estate priorities. “The more personal, local, and shareable a message is the more effective it will be,” said Plouffe. “When you localize something, when it’s about neighbors and family-owned businesses, people pay attention. And remember, REALTORS® are a lot more popular than politicians, people will listen to you.” “Walk softly and carry a big stick,” added Schmidt. “You represent a bipartisan cross section of America, which is very compelling and shows the power of your industry. You have the ability to assemble a diverse coalition of individuals who are vehemently supportive of four or five priorities.” In meetings with U.S. Senators and congressional staff, REALTORS® will promote the value of homeownership and urge lawmakers to advance legislation that strengthens the housing market, protects commercial investment, and bolsters the economic recovery. “No one amplifies the voice of real estate better than REALTORS®,” said NAR President Steve Brown, co-owner of Irongate, Inc., REALTORS® in Dayton, Ohio. “We are on the front lines of issues affecting the housing market and we see the consequences and benefits of the laws that influence it.” REALTORS® will advocate key issues during their Hill meetings, including the importance of the Federal Housing Administration’s loan programs, which helped 500,000 families buy their first home in 2013, and the need to reinstate mortgage debt cancellation relief, which expired at the end of 2013. This crucial tax provision protected underwater homeowners from paying taxes on mortgage debts forgiven by a lender. This marks an 18.6% increase over the 1,244 sales in March. Compared to the 1,550 closed escrows in April 2013, sales are down 4.8%. Making up the sales this month were 106 REOs (7.2% of all sales), 134 short sales (9.1%) and 1,235 equity sales (83.7%). Compared to last month, REO sales have decreased 7.6%, short sales rose 7% and equity sales remained locked at 83.7% of all sales. Comparing types of financing, the Sacramento market continues to see conventional mortgages dominating, accounting for 45.1% of all sales for the month. Cash sales, however, decreased 3.1% month-to-month, accounting for 21.8% of sales. Cash-only sales have decreased markedly since February 2013, when they made up the majority of the market with 39.5% of all sales. Since then, cash-only sales have decreased nearly 45%. The remainder of sales used FHA (22.9%), VA (3.8%) and Other (6.4%) types of financing. See graph below for percentage of types of financing per month from July ‘12 – present. This data is available in full on our stats page. Condominium Resale Market Sacramento condominium sales decreased slightly for the month, down 2.6% to 112 units. This is down 15.2% from the 132 units sold in April 2013. The condominium median sales price increased month-to-month, up 25% from $127,000 to $158,750. PLEASE NOTE: A new, 2-page condominium report is now available. You can access this by viewing the monthly MLS Summary, which is now a 4-page document. The condo report accounts for pages 3-4. The Active Listing Inventory in Sacramento County increased for the month to 2,021 listings, up 6% from 1,907 listings of March. Year-to-year, the current number is up significantly (46.3%) from the 1,381 units of April 2013. The months of inventory decreased 6.7%, down to 1.4 months. The months of inventory reflects the length of time (in months) that it would take to deplete the current inventory at the current sales rate. The month-to-month median sales price increased 1.7% from $262,450 to $267,000. The current level is 20.3% above the $222,000 median sales price of April 2013. The current figure is up 66% from the January 2012 low of $160,000. A few years ago she started taking real estate classes at Sacramento City College in pursuit of information on how to purchase and manage investment properties. As her interest in real estate grew, she discovered the Internship class at SCC and registered for it. A collaborative program between SAR and the Los Rios Community College District, the Internship class allowed Ericka to be matched with REALTOR® Sam Yee at Lyon Real Estate. Ericka worked with Sam ten hours per week while attending classes at SAR twice a month during this past spring semester. The Internship Program provided Ericka with an invaluable opportunity to become familiar with the day-to-day life of a REALTOR®. Schmeling A California court has evaluated allegations made by a buyer against a listing broker over statements made in the MLS that claimed a geologist had found the property “buildable.” In 2006, Yousef Sasa (“Seller”) listed a property for sale with Robert Schmeling (“Listing Broker”). The Listing Broker placed the property into a multiple listing service (“MLS”), and included the following description: “This property is in an earthquake study zone but has had a Fault Hazard Investigation completed and has been declared buildable by the investigating licensed geologist. Report available for serious buyers” (“Report”). A geologist prepared the Report in 1982, and reached certain conclusions about the effect an earthquake would have on the property. A letter (“Letter”) from the local planning board acknowledged the Report complied with the standards required by local ordinance. The Report did not specifically state that the property was “buildable.” George Saffie, Jr. (“Buyer”) was interested in purchasing an undeveloped commercial parcel and so his representative made him aware of the Seller’s property, including showing him the MLS listing. The Seller eventually accepted the Buyer’s offer to purchase the property. Prior to closing, the Listing Broker gave to the buyer’s representative a copy of the Report and the Letter. The buyer’s representative then gave these documents to the Buyer. Even though the buyer’s representative testified that he told the Buyer that he needed to “check out” the buildability of the property, the trial court found that the buyer’s representative had given the Buyer the impression that the property was ready for building. Following the closing, the Buyer discovered that the property was not “ready to build.” The 1994 Northridge earthquake had caused the county to change the earthquake zone requirements, and so the Report was out of date. The new requirements for building made developing the property impractical for the Buyer. The Buyer filed a lawsuit against the buyer’s representative, the Seller, and the Listing Broker. The trial court found the buyer’s representative liable, and awarded the Buyer $232,147.50 in damages. The trial court did not hold the Seller or the Listing Broker liable. The Buyer appealed the ruling in favor of the Listing Broker. The California Court of Appeal, Fourth District, affirmed the ruling of the trial court in favor of the Listing Broker. The Buyer alleged that the Listing Broker’s statements in the MLS were false or inaccurate; since it failed to clarify that the report was from 1982 and was out of date for purposes of development in 2006. He based his argument on a California statute that specifies the duties of a real estate professional for MLS postings. California has a statute that specifies the responsibilities of a broker when posting information to a MLS. The California statute states that the broker is responsible for the truth of all statements that the licensee “had knowledge or reasonably should have had knowledge” made in the listing and provides a statutory negligence penalty for anyone injured by the falseness or inaccuracy of the statements. The Buyer did not challenge the accuracy of the statements made by the Listing Broker in the MLS, but rather argued that these statements caused him harm and so violated the California statute. The court rejected the Buyer’s argument, finding that the Buyer had failed to allege that there was anything false or inaccurate about the statements made by the Listing Broker in the MLS. The Listing Broker’s MLS listing stated that there was a Report that had met the requirements at the time for developing a property. The court found that it is not the duty of a licensee to correct individuals who may have misconstrued his/her true statements in a listing or assure that a buyer performs proper due diligence before closing a transaction. Further, the court ruled that by delivering the Report to the Buyer and his representative, the Listing Broker further satisfied the Listing Broker’s duty of disclosure to the Buyer. Because the Listing Broker’s statements in the MLS were true, the court affirmed the lower court ruling in favor of the Listing Broker. Saffie v. Schmeling, 168 Cal. Rptr. 3d 766 (Cal. Ct. Less than a month. I was introduced to SAR through the Internship program. ERICKA TATUM 2. What did you do before you became a REALTOR®? Bartending and food service. 3. How did you decide the real estate business was for you? I began by taking a real estate class to help me and my husband purchase and manage investment properties. Once I became exposed to the industry, I realized I could take the social skills I gained working in the hospitality industry and apply them to being a REALTOR®. 4. You recently graduated from the SAR/Los Rios Community College District Internship Program. What was your experience with this program? I was excited to be able to familiarize myself with the real estate industry without having to commit to a particular real estate agency. I availed myself of SAR classes, meetings, and the Expo while learning different parts of real estate. It was really cool. I would definitely refer other students to the program. It gives you the big picture. 5. What do you hope to receive from your membership at SAR? I would like to continue attending classes, the main and regional meetings as well as special events. What would people be surprised to learn about you? I think people would be surprise to know I didn’t graduate high school and took my GED in May of 2009 so I could have a high school diploma before my son Preston graduated in 2010.
