We continue to face increased regulation from MSHA, and IMAA has set up
seminars with Mark Savit of Patton Boggs LLP to discuss these regulations and how
best to protect our industry and your company from increased regulation. These
seminars are scheduled at different locations throughout the state to make it easier
for you to send key personnel from your company to attend. The first seminar is July
26th at Sellersburg Stone Company in Sellersburg, the next seminar is July 27th at
the VU Aviation Technology Center in Indianapolis, and the final seminar is July 28th
at the Ramada Plaza Hotel in Warsaw.

Obituary — Rex F. Kepler, (February 12, 1921 - May 18, 2011), 90, of Lafayette, died at 7:50 a.m.
on Wednesday, May 18, 2011 at Rosewalk Village. Born February 12, 1921 in Crawfordsville, he was
the son of the late George Robert and Fanchon Hollick Kepler. He was a 1939 graduate of Jefferson
High School and received his CPA from Indiana Business College. He served with the 71st Infantry
Division in the US Army from 1944 to 1946 in the European Theatre. He sang in the 5th Infantry
chorus traveling Germany and Austria. He received the Bronze Medal. Mr. Kepler worked for the now
Vulcan Materials for 48 years where he was Vice President of Sales and Marketing, retiring in May
1989. He then became co/owner of Kepler and Associates in 1986 and also was co/owner of the
Come Along Travel Club in 1997. He married Patricia ―Pat‖ Smart Muston on July 17, 1978 in Lafayette, and she
survives. Mr. Kepler was a member of Trinity United Methodist Church where he was a 60 year member of the Trinity
Challengers Class, Musicians Local #162 since joining in 1939, F&AM 50 year member of Lodge #123, 32nd Degree
Mason, Scottish Rite in Indianapolis, a 50 year member of American Legion Post #11, Lafayette Rotary Club where he
played the piano for 32 years, Past President of Indiana Mineral Aggregate Association, and Purdue Presidents Council
member. He sang with the Festival Singers under the direction of Al Stewart, played in the Cherry Lane Dudes, and
accompanied the Ambassadors, a singing group from the Senior Center for 17 years. He began playing in local big
bands in 1938 and the Citizens Band for many years. Surviving with his wife is a son, Robert Kepler (wife, Katherine) of
Russellville, AL. Also surviving are four grandchildren and six great grandchildren. He was preceded in death by a
daughter, Carol Sue Lanfear; a brother, Robert H. Kepler & a nephew: Phillip Kepler. Memorial visitation was Saturday,
May 28, 2011 from 1-2 p.m. at Trinity United Methodist Church. Military honors were presented by the US Army and
American Legion Post #11. The family requests memorial contributions be sent to the American Heart Association or
Charity of Donor’s Choice. Hippensteel Funeral Home entrusted with care.

Plant Operators Committee News— by Kevin Cox, Chair
The Plant Operators Committee held a meeting on April 7th to evaluate the 2011 seminar, ―The Shocking Cost Savings
from Electrical Efficiency‖ and to start planning the 2012 seminar.
Industry experts presented information to 37 attendees that they could take back and apply to their operations to reduce
costs. Participant evaluations were very favorable as to content and applicability to their cost reduction efforts.
We have now started planning for the 2012 seminar. As always, our desire is to present relevant and practical topics
that will assist attendees in improving the efficiency and profitability of their operation. This year we decided to reach out
to the membership during the planning stage with an informal poll of topics that they have a desire to learn more about
to accomplish these goals. If you have topics that you would like to see presented, feel free to contact the IMAA office or
a committee member.
We look forward to seeing you at the 2012 Plant Operators seminar.
Safety Committee News – by Jeff McIntosh, Chair
Greetings, The Safety Committee met on April 28 and was well attended. The committee discussed many items
including the upcoming Fly-In to Washington DC, supervisors training by Mark Savit, recent MSHA activity and
compliance assistance in respect to required documentation paperwork. Please make some time to attend the next
meeting being held at the IMAA Summer Meeting in French Lick on July 14th at 9:00 a.m.
The agenda has been set for the Fly-In and the group has secured a meeting with Neal Merrifield, Administrator for
Metal and Non-Metal division of MSHA, and potentially Assistant Secretary of Labor, Joe Main. As you are all aware,
this is a great opportunity for our group to discuss items with the leaders of our industry enforcement agency. Our focus
is not to come across as complainers, but to discuss the areas that would make our overall goal of improving the safety
of our greatest resource, the miner, a value added, co-operative process. I am troubled by the many stories that I hear,
of how the agency is reacting but remain very optimistic that we will all get our heads together and come up with an
understanding of how this can be accomplished in an efficient manner.
If you haven’t already done so, I would encourage you to register for the upcoming seminar by Mark Savit with Patton
Boggs LLP. This seminar will focus on topics our frontline managers should find very enlightening and helpful. If you
attended the seminar last year, do not hesitate to attend again this year as the topics are different and will no doubt
leave you having ―learned something today.‖

Environmental Committee News — by Doug Lozier, Chair
The Environmental Committee of IMAA met on April 28, 2011 at the IMAA office.
The committee reviewed the environmental presentations that were given at the Winter Workshops. We were very
pleased that the environmental sessions had a much larger attendance than previous years. It is hoped that more plant
managers and supervisors will attend if the environmental topics are those for which the supervisory personnel have
some control in their operations.
Kathy Moore of Keramida provided us with an update of the IDEM Office of Air Quality rulemaking to amend the source
specific operating agreement (SSOA) air permits. While we know that part of their intent is to add provisions for
crushing of broken concrete and for recycled asphalt pavement, there have been no further developments since their
original notice asking for input. The committee will continue to watch this for future developments.
Members are advised that the Spill Prevention Control and Countermeasure Plan (SPCC Plan) revisions continue to be
on target for compliance in November of 2011 unless they are stayed or amended between now and then.
Some members have received a survey form from the Great Lakes Commission. Members are encouraged to complete
the form by updating their preprinted information and verifying the location of the water withdrawal point on their map.
Submitting it to the GLC will allow them to accurately update the US EPA Inland Sensitivity Atlas, which is very important
if you also need to develop an Oil Spill Facility Response Plan.
We look forward to seeing everyone at our next meeting on July 14 at 10:00 am at the French Lick hotel.
The AgLime Council— by Brent Leininger, Chair
The AgLime Council is preparing for the 2011 aglime season. Each member should have already turned in their
samples. The May deadline will allow plenty of time for Bowser-Morner to run the test and have the results back to us
before the advertising deadlines. The AgLime Council is working hard again. We are looking to perform most of our ad
designs and advertising scheduling in house. We plan to use a couple of major farm magazines and news papers as
our main advertising campaign. We had positive feedback from aglime dealers and farmers regarding our 2010 ad
campaign. We have some new ideas that we will be discussing in our next couple of meetings regarding new
advertising.
The Council is also looking at setting goals for the future regarding education, growth and aglime
promotions. Thanks again to our members for their continued work and participation in the Council.
Golf Committee News — by Jerry Irving, Chair
Greetings from the rainy north end of the State. The IMAA Golf team will be headed to Champions Pointe GC on June
12 & 13 for the 4 State Challenge. With any luck at all, the rain and storms will subside so our team will prevail and
bring the trophy back to Indiana for another year. If you know any team members, wish them luck so we may prevail
once again. The 2 State challenge has been set for October 9 & 10 at the Pinnacle GC near Columbus, Ohio. With any
luck at all we will retain that trophy also. Until the next source report when we will give you the results of the 4 State

P.I.E. Committee News — by Dana Boyd, Chair
The PIE Committee has finalized the details for this year’s Teachers Workshop scheduled for June 21st-23rd. Once
again the workshop will be held at Conner Prairie Living History Museum in Fishers, Indiana. We encourage you to
spread the word to your local teachers today and assist them with getting registered. For more information please refer
to the Association website at www.indmaa.org.
The Committee would also like to encourage all plants to continue working toward their 2011 Excellence in Mining and
Community Connection award entries. Please make certain up to date information and photos are submitted for all
entries.
As a reminder to our valued Associate members; please take a look at the new Associate Member Company Award on
the website. This award was developed by the committee to recognize companies who are going above and beyond.
Please start planning for you attendance at the PIE Committee Golf Fundraiser on September 14th. The event will once
again be held at Eagle Creek Golf Course in Indianapolis.
We ask as a committee, that your organizations continue to get involved with local communities to help put a positive
image of our industry in their minds.

Buy Local: Public Works Contract & Supply, Material & Equipment Purchases — provided by ICA
HB 1004 -- a massive bill that includes everything from decreases in the corporate income tax rate to legalizing a dog licensing ordinance. Provisions
that should concern our members are:
Buy Local – Public Works Contracts
Effective July 1, 2011, a local agency (including cities and towns, counties, public school districts, special taxing districts such as a sewer district and
most other local government bodies) is required to award a public works contract to a ―local Indiana business‖ without regard to price, if a contractor
meeting the criteria set by the law for a ―local Indiana business‖ has bid on the contract, is responsive and responsible, and at least one ―local Indiana
business‖ has claimed a price preference provided in the law. A firm qualifies as a ―local Indiana business‖ by meeting any one of five criteria, two of
which must be defined by the local governmental body. These are:

A business whose principal place of business is located in an ―affected county.‖
A business that pays a majority of its payroll (in dollar volume) to residents of ―affected counties.‖
A business that employs residents of ―affected counties‖ as a majority of its employees.
A business that makes significant capital investments in the ―affected counties‖ as defined in rules adopted by the political subdivision.
A business that has a substantial positive economic impact on the ―affected counties‖ as defined by criteria in rules adopted by the political
subdivision.
An ―affected county‖ includes the county in which the agency awarding the contract is located and any adjacent county. Contractors will need to
contact local agencies to determine if the agency has adopted rules defining the criteria for significant capital investment and positive economic
impact. The law also allows a ―local Indiana business‖ to claim a price preference on a local public works contract. The preference is set at 5% for
contracts expected to be less than $50,000, 3% for contracts expected to be at least $50,000 but less than $100,000, and 1% for contracts expected
to be at least $100,000. To claim the preference, a bidder (or quoter) must state in its bid that it is claiming the preference and must provide the
following specific information to the agency regarding its eligibility under the ―local Indiana business‖ criteria:

The location of the business’s principal place of business and, if the business is claiming principal place of business as justification for the
preference, a statement explaining the reasons the business considers the named location as the business’s principal place of business.
2) The amount of the business’s total payroll and the amount of the business’s payroll paid to residents of affected counties.
3) The number of the business’s employees and the number of the business’s employees who are residents of affected counties.
4) If the business claims the preference based on ―significant capital investments in the affected counties,‖ a description of those capital investments
and a statement of the amount of those investments.
5) If the business claims the preference based on having a ―substantial positive economic impact on the affected counties,‖ a description of that
economic impact.
The law requires award to the lowest responsive and responsible ―local Indiana business‖ claiming the preference unless a ―local Indiana business‖
that hasn’t claimed the preference is the lowest responsive and responsible bidder for the project. It appears that a contractor that doesn’t meet the
―local Indiana business‖ criteria cannot be awarded a local public works contract, regardless of its bid, as long as one or more ―local Indiana
businesses‖ claim the preference. If no bidders satisfy the criteria as a ―local Indiana business,‖ then the award would be to the lowest responsive and
responsible bidder as occurs under current law.
Buy Local – Supply, Material and Equipment Purchases
The provisions affecting purchases also take effect July 1, 2011. While there are many similarities between the price preference provisions in the law
between public works and purchases, there are also some significant differences. The definitions, criteria for being a ―local Indiana business,‖ amount
of the price preference, and process for claiming the preference are the same. For those purchase contracts that are based on price, the statute does
not require award to a ―local Indiana business.‖ The provisions of HB 1004, when considered with existing Indiana law, provide for determining an
adjusted offer for offerors who claim the ―local Indiana business‖ preference. This would be determined by reducing the offer by the applicable price
preference percentage. Since existing law allows a variety of purchasing processes, the applicable process will determine whether the award is made
on the basis of the lowest adjusted offer or if other factors are considered. Other preferences already allowed in state law for purchases could also be
a factor. The provisions taking effect on July 1 also provide that a purchasing agency ―may award (emphasis added) a contract to the lowest
responsive and responsible offeror, regardless of the preference provided in this section, if the lowest responsive and responsible offeror is a local
Indiana business.‖ Suppliers that bid on local supply purchase contracts will need to contact those local agencies to determine if they have adopted
rules defining the criteria for significant capital investment and positive economic impact.
