Welcome to this edition of METER
magazine.
As I write this report, the people of NSW
are preparing to go to the polls to exercise
their democratic right to choose the
government of this great State for the next
four years. This is an important part of our
society and we should all quietly rejoice in
the fact that we have the ability to choose
who will preside over us in Government.
Throughout the election campaign we have been very active in
highlighting to candidates the issues that we would like a future
government to address to help build a strong and viable future
for our industry. We have been engaging constructively in a nonpartisan way to ensure that we present a credible voice for our
industry and that our issues should be taken seriously.
The decisions that future governments may make in relation to
our industry will be critical in shaping our future and therefore we
need to be fully engaged to maximise this opportunity.
We have included a copy of our election policy objectives in this
edition (please see page 7) so you can see first-hand the issues
that we are fighting for and not surprisingly, the number one issue
is ridesharing.
Nowhere is the impact of government decisions regarding the
taxi industry felt more keenly than at the driver level. Taxi licence
numbers, fare determinations and decisions on ridesharing
impact drivers first and foremost and if a government makes a
‘bad call’ drivers are the first to be negatively impacted. This is

why we are fighting hard for a fair go for our industry and we hope
that the next government has its ‘listening ears’ on in this regard.
Whilst ridesharing remains the biggest issue affecting our
industry, in this edition we pose the question, ‘is the tide turning
for Uber’.
Uber has had what can only be described as a horror month
recently with some major setbacks occurring in recent weeks.
These include its offices being raided in Paris, being banned in
Germany, charges being laid against executives in South Korea
(including its CEO Travis Kalanick), its much vaunted partnership
with the UN on women’s employment being torn up and further
setbacks in its defence of the class action being taken against it
by drivers in the US.
These developments are not surprising, particularly when Uber’s
record of non-compliance with the law is considered. You can only
defy the law for so long before society bites back. Irrespective of
your views on Uber, the upholding of the law in every jurisdiction is
a critical aspect of society and no matter how new your business
model may be, you’ve got to play by the rules or run the risk of
alienation.
These sort of setbacks will continue for Uber. Time and history is
not on their side.
Whether these incidents herald the changing of the tide is yet
to be seen but if they continue to occur investors in Uber will
start asking some hard questions as their projected returns and
collective reputations are all on the line.

A STRONG AND
VIABLE FUTURE
FOR NSW TAXIS
“A strong and viable future” was
the theme for the NSW Taxi Industry
Association (TIA) Special General
Meeting held a Wolli Creek on Monday
9 March, with the industry reinforcing
its commitment to being part of the
public transport system for the people
of NSW.
The meeting was an opportunity to
understand key issues affecting the
industry and discuss the importance of
providing good customer service and
competing on a level playing field.
The industry members demonstrated
their committed to engaging with
parties of all political persuasions in the
lead up to the State election to build
awareness about maintaining a wellregulated and managed taxi industry in
NSW.
The NSW TIA also released its 2015
State Election Policy objectives calling
on all political parties to consider
important issues that are impacting on
the NSW Taxi Industry.
Key objectives include:

NSW STATE ELECTION 2015 - KEY POLICY OBJECTIVES
THE NEW SOUTH WALES TAXI INDUSTRY IS A CRITICAL COMPONENT OF THE STATE’S PUBLIC
TRANSPORT NETWORK, PROVIDING A UNIVERSAL, GOVERNMENT REGULATED, DOOR-TO-DOOR
SERVICE 24 HOURS A DAY, SEVEN DAYS A WEEK.
The taxi industry is unique in the State’s public transport sector
in that it operates within a sustainable, self-funded structure
requiring no subsidies from Government.
In NSW approximately 170 million passenger journeys are
completed via taxis each year. Taxis complement other forms of
public transport, operate on a capped pricing structure in the
public interest and provide essential services to some of the most
vulnerable members of society. This includes people for whom
other forms of public transport are unsuitable due to disability or
other special needs.
There are over 30,000 people that are directly involved in
providing services as part of the NSW Taxi Industry. This includes
24,000 authorised drivers, 5,000 accredited operators, 4,000
licencees and 100 authorised taxi networks and their staff, as
well as hundreds of other downstream organisations relying on a
sustainable and commercially viable industry.
THE FOLLOWING ARE INDUSTRY SPECIFIC POLICY OBJECTIVES OF THE NSW TAXI INDUSTRY

Unauthorised ridesharing is to
remain illegal
The use of unauthorised private motor vehicles by unauthorised drivers represents a clear risk to
the public and therefore should not be legalised
A commitment to a level
regulatory playing field for all
NSW taxis
The NSW Taxi Industry is being disadvantaged as a consequence of unfair and illegal taxi services.
This includes ridesharing, illegal hire car operations and other forms of unregulated transport.
There needs to be a clear set of rules that govern the NSW Taxi Industry and these rules need to be
applied consistently to all industry participants
Building Country Taxi viability as
a matter of urgency
Country taxis form a vital part of the economy and social fabric of rural and regional NSW. Country
taxis are under significant viability pressure arising from declining economic and social conditions
in rural and regional NSW as well the operations of illegal hire cars and other forms of transport.
There is an urgent need to address this issue as some rural and regional towns are facing the loss
of their taxi service altogether
More compliance resources are
required
The maintenance and enforcement of standards requires appropriate resources to ensure
compliance with relevant regulations. There has been a reduction in resources focussed on taxi
services and this must be addressed to ensure standards for the travelling public are maintained
Ensuring that the rights of
existing taxi licence owners are
upheld
Taxi licence owners have invested in taxi plates as a consequence of successive Government
policy for decades. This gives taxi licence owners a right to expect that their investment and
livelihoods are upheld and that they are properly compensated for any negative impacts arising
from a change in government policy
Taxi fares are determined using
a transparent industry cost
model
Taxi fares reflect the cost of providing taxi services and the need to maintain a strong and viable
industry. The best approach to setting fares is through an industry cost index model. IPART has
abandoned this approach which has led to viability concerns across the industry. There is a need
to return to a proper cost based approach for the setting of taxi fares accordingly

The NSW Taxi Council supports the growth in taxi licences to meet genuine increases in demand.
The best method for determining the number of licences is through a growth based model that
considers relevant inputs such as population growth, tourism activity, business growth, etc

The success of ensuring a well regulated and managed industry is contingent upon an effective
and appropriate co-regulatory relationship between the industry and the regulator. The NSW
Taxi Industry and the regulator (RMS) must work in an effective partnership to ensure that proper
standards are set and the heavy burden of compliance is shared in an appropriate manner

ECONOMIC
RHETORIC
The NSW Taxi Council has questioned
the veracity of Uber’s extravagant claims
regarding economic growth and job
creation.
It’s no coincidence that Uber’s claims
of job creation come at a time when its
ridesharing service remains illegal and
Uber X drivers are facing prosecution in
NSW and Victoria.
It’s one thing for Uber’s senior staff to say
that they respect the law and want to be
regulated, but this claim rings hollow in
conjunction with their ongoing policy of
ignoring the law because it doesn’t suit
their business model.
Paying the fines of drivers is just one
example of how Uber is putting the
community at risk by actively encouraging
drivers to break legitimate rules regarding
public safety.
CEO of the NSW Taxi Council Roy WakelinKing said that if Uber really believes it
wants to be regulated, it should meet the
set safety requirements set by the NSW
Government and compete with regulated
services on a level playing field.
“Reputable organisations do not put their
own profits above public safety or openly
encourage people to break the law,” he
said.
Mr Wakelin-King also questioned Uber’s
commitment to proper job creation.
“Uber boasts it can create a lot of jobs,
but what they don’t tell you is that these
jobs are at the mercy of ruthless company
policy including unilateral pay cuts of up to
30% and automatic dismissal without any
procedural fairness.
“In America, Uber has recently reduced
fares while maintaining their own profit
margins, meaning an effective pay cut
for drivers of up to 30% without any
consultation with them,” Mr Wakelin-King
said.

“Furthermore, drivers are not covered by
workers compensation, have no full time
insurance, no leave entitlements, and are
summarily dismissed with no recourse
for not maintaining unrealistic customer
satisfaction standards via their ratings
system.”
“This is the window on Uber’s working
future; no rights and reduced pay,” Mr
Wakelin-King said.
In contrast, the NSW Taxi Industry has
some of the strictest conditions for
taxi drivers in the world including leave
entitlements and proper procedural
fairness.
In addition, instead of cutting earnings,
the NSW Taxi Council fights for the rights
of taxi drivers and operators to be able to
earn a reasonable living.
“The NSW Taxi Industry has also been
independently assessed by international
accounting firm Deloitte Access
Economics as contributing over $1 billion
each year to the economy, including
compliance with all GST and other critical
statutory charges,” Mr Wakelin-King said.
“Furthermore, we provide over 17,000
genuine full time jobs for not only drivers
but also for industry suppliers such as
taxi training schools, vehicle providers,
authorised taxi vehicle inspection stations
and wheelchair taxi manufacturing
companies.
“These are genuine figures, real full time
jobs and Uber’s hollow statements to
try and curry favour with Governments
is just an attempt to mask the reality of
how it would see Australians working for
them in the future: no cover, no rights and
on the Uber treadmill to increase their
profiteering.”
IPART REPORT A
STEP IN THE RIGHT
DIRECTION
The NSW Taxi Council today welcomed
the recommendations of the IPART draft
report that freezes the release of taxi
licences.
CEO of the NSW Taxi Council Roy WakelinKing said, “Whilst we will be making a
detailed submission, this is a step in the
right direction, particularly as there is
currently an oversupply of taxis in Sydney
and also because of the competitive
issues that are emerging.”
Mr Wakelin-King further said the NSW
Taxi Council would review the other
recommendations and provide a
submission including on the issue of taxi
fares.
“We understand the need to be
competitive from a pricing point of view,
but as we are privately funded and do
not receive any subsidies from the State,
we need to cover our costs and make a
reasonable return.”
Mr Wakelin-King said the NSW Taxi
Council noted the views of IPART
regarding ridesharing, however people
should be aware that this is an illegal
form of transport and therefore does not
constitute fair competition.
“Any review that is to be done on this
should be carried out by Government,” Mr
Wakelin-King said.

RANKS
The NSW Taxi Council today announced
that the authorised Sydney taxi network,
GM Cabs, has joined the NSW Taxi Council
as its latest member. This means that all
authorised taxi networks in Sydney, have
now decided to join the NSW Taxi Council
in a clear commitment towards ensuring
that NSW has the best possible taxi
services for the people of this State.
Being a member of the NSW Taxi Council
will ensure that GM Cabs gets the best
possible representation as a unified
industry partner and it will allow the
network to join the many cross-industry
forums that work towards improved
customer service and the long term
viability and sustainability of the NSW Taxi
Industry.
Chairman of the NSW Taxi Council John
Bowe acknowledged the commitment
shown by GM Cabs General Manager
George Mikhael to seek membership and
extended a warm welcome on behalf of
the NSW Taxi Council Board to the new
Network.
“We appreciate the commitment of GM
Cabs management to be part of a strong
industry and we look forward to their
support and active input as professional
industry members,” Mr Bowe said.
“We believe the addition of another major
network to the NSW Taxi Council is a vote
of confidence in the NSW Taxi Council
and it also demonstrates the strength of
a well regulated and managed industry.
This is an important demonstration of
unity, particularly at a time when there is
a concerted attempt by some overseas
corporations to undermine the benefits
and value that the NSW Taxi Industry
brings to the State of NSW”.

CLASSROOM
WHAT IS A
UNIQUE STUDENT
IDENTIFIER?
From 1 January 2015 if you are undertaking
nationally recognised training delivered by
a registered training organisation, you will
need to have a Unique Student Identifier
(USI).
A USI is an account which will allow students
online access to their training records and
results (transcript) through their online USI
account. It is therefore a requirement that
all students must have a USI for the Taxi
Operator and Wheelchair Accessible Taxi
Driver courses.
One of the main benefits of the USI is that
you will have easy access to your training
records and results throughout your life.
The NSW Taxi Council can assist you through
the process. Remember to bring with you the
correct forms of identification (see break out
box). This is in addition to the ID required
to enrol in the courses (Drivers Licence and
Driver Authority for WATS, Drivers Licence
and either Driver Authority or Passport for
Taxi Operator course).
Once you create your USI you will need to
give your USI to each training organisation
you study with so your training outcomes
can be linked and you will be able to: view
and update your details in your USI account;
give your training organisation permission to
view and/or update your USI account; give
your training organisation view access to your
transcript; control access to your transcript;
and view online and download your training
records and results in the form of a transcript
which will help you with job applications and
enrolment in further training.

(AMES) ENGLISH TESTS
CANCELLATION POLICY UPDATE
AMES conducts English Tests for those wishing to become a taxi driver.
To be a taxi driver in NSW, applicants must pass an English assessment to make
sure their level of English reaches the National Minimum English Standard. This
level has been set by the government to ensure that taxi drivers have sufficient
English to be able to carry out their service effectively and to communicate
comfortably, in English, with the general public.
CANCELLATIONS
Candidates must contact NSW AMES in advance to cancel their assessment
appointment. The following refund policy applies:
1)Where notice of cancellation is received at least three (3) full working
days before the appointment, a $55 (GST inclusive) administrative charge
will be deducted from the fee.
2)Where notice of cancellation is received less than three (3) full working
days before the appointment, no refund will be given.
The Director may approve a variation in exceptional circumstances.

Representatives of the NSW Taxi Council
have attended the Domestic Airport
Taxi Holding Bay in recent months with
information for taxi drivers to send to
their local State members regarding
Uber X and the potential risks to the
NSW Taxi Industry and general public
arising from this illegal service. Upon
reading the draft letters, dozens
of taxi and hire car drivers willingly
signed them, which were addressed
to their respective MP’s. They also
thanked us (as we did them) for this
effort in bringing this critical issue to
the attention of the members of State
Parliament. The overwhelming message
from drivers was that they wanted to see
more of this kind of action to ensure that
Uber X and ridesharing in general was
properly dealt with and their livelihoods
protected.

IMPROVEMENTS
TO TAXI FACILITIES
AT SYDNEY
AIRPORT T1
INTERNATIONAL
Sydney Airport is implementing
improvements for taxi operators and
drivers as part of the upgrades to the
road network and car parks in the T1
International precinct.
T1 PRE-BOOKED TAXI HOLDING AREA
The airport has reconfigured and
moved the pre-booked taxi holding
area outside T1 to provide a four-fold
increase in spaces from six to 24.
The new location is across the road
from the existing pre-booked area,
and is adjacent to the main T1 taxi
holding bay. There is easy access for
passengers from the Arrivals forecourt
via a pedestrian crossing, and clear
signage to help passengers locate the
new area will be installed.
The new area is scheduled for opening
just before Easter.
T1 HOLDING BAY EXPANSION
Expansion of the T1 holding bay was
completed before Christmas and has
helped meet increased demand during
peak periods at the International
terminal.

THE FACILITIES FOR TAXI
DRIVERS, THE AIRPORT
HAS PLANS ON UPGRADING
THE BATHROOM AND NONDENOMINATIONAL PRAYER
ROOM FACILITIES AT THE T1
INTERNATIONAL PRECINCT.
The upgrades, which are scheduled for
completion by June 2015, are being
carried out following consultation with
taxi community representatives.
Improved facilities include:
•Installation of three convenientlylocated footbaths to cater to those
taxi drivers wishing to make use of
ablution facilities prior to using the
prayer room
•Work will be carried out in order to
provide comfortable access to the
footbaths in bad weather
•Privacy panels are being installed
in the bathrooms for the increased
comfort of drivers
•Following the successful installation
of a shoe rack at the entrance to the
Domestic prayer room, a similar rack
will be installed at T1
Capacity was increased by
approximately 40 spaces, while the
expanded bay features an improved
driver breakout area with new shade
awning and seats.

Vivid Sydney is set to shine even more brightly in
2015 when the world’s largest festival of light, music
and ideas delivers its biggest program yet. For 18
nights, from 22 May – 8 June, Vivid Sydney will again
transform the city and harbour.
The 2015 program includes expansion into new city
precincts Chatswood and Central Park, its biggest
ever music program including Australian exclusives
such as The Hoodoo Gurus at the Powerhouse
Museum and Daniel Johns’ international solo debut at
the Sydney Opera House, and heavy-hitting speakers
at Vivid Ideas.
Vivid Sydney, now in its seventh year, is owned and
managed by Destination NSW.
Destination NSW Chief Executive Officer Sandra
Chipchase said: “Vivid Sydney is an incredible public
event that has seen amazing growth, attracting a
record 1.43 million attendees in 2014. It’s the largest
festival of its kind in the world, and with our biggest
program yet, there’s even more to love about Vivid
Sydney this year.
“With such an amazing festival planned, Destination
NSW will continue to work with the travel industry to
encourage visitation to Sydney from across Australia
and the globe for this incredible event. We aim to
build on the results from last year when more than
20,000 international visitors travelled to Sydney on
dedicated Vivid Sydney travel packages,” she said.
In 2014 the Festival injected $41.3 million into the
NSW visitor economy. It was also named Australia’s
Best Tourism Event In 2014 (and Australian Event of
the Year in 2013) and Helpmann Awards Best Special
Event in 2014.

The First World War touched the lives of
nearly every Australian. For this reason it
is essential to commemorate, remember,
and learn from those who sacrificed their
lives during those four years, 1914 –
1918.
ANZAC Day on April 25 is a national day
of remembrance and commemoration,
marking the anniversary of the first major
military action fought by Australian and
New Zealand forces during the First World
War. This year is particularly important,
as it commemorates the centenary of the
landing on Gallipoli in 1915. On ANZAC
Day, Australians honour those who have
served and died in all wars, conflicts and
peacekeeping operations.
Dawn services, wreath laying, parades
and sunset services form a significant
part of ANZAC Day commemorations and
are held across all of NSW. Sydney’s city
centre hosts the State’s biggest ANZAC
Day services which are free to the public

in Coffs Harbour, Port Macquarie and

Sydney’s ANZAC Day March gives

The ANZAC Day Dawn Service
at The Cenotaph in Sydney’s
Martin Place begins at
4.15am. Thousands gather
in the pre-dawn darkness to
pay their respects and lay
wreaths in honour of fallen
soldiers.
The ANZAC Day March begins at 9am on
the corner of Pitt Street and Martin Place.
It journeys through George and Bathurst
Streets before ending at Elizabeth Street
opposite Hyde Park.
At the conclusion of the parade,
at approximately 12.30pm, a
commemoration service is held next to
The Pool of Remembrance at the ANZAC
War Memorial in Hyde Park South.

CITY OF SYDNEY SUMMARY
THE STAR
We can advise that NSW Taxi Council
Commissionaires are no longer required
at The Star, as their management have
restructured the taxi access and the
matter will be managed by their own
security staff from now on. They extended
their appreciation for our assistance and
assured me that they will not hesitate to
contact us again if the new arrangements
are not successful.
ONE PUNCH – LOCK OUT LAWS
The Taxi Council continues to provide
weekly rank statistics for TfNSW which are
indicating that the number of passengers
in the CBD is slowly picking up due to the
improvement in the weather and special
events that are bringing people into the
city.
CHATSWOOD
Willoughby Council has advised changes
to access in Victor Street. Victor Street
is no longer a shared zone with buses.
Signage has been erected that clearly
shows that the area is a no parking
Council authorised buses and taxis
excepted. This change is a result of
complaints received that private and other
buses have been taking up spaces that
should be reserved for public transport
vehicles and services only.
MACQUARIE STREET
The Taxi Council has been advised that
there is now a taxi zone on the eastern
side of the street and that the existing
taxi rank has been expanded to twice the
original length with operating hours now
being 24-hours-a-day.
IMPROVED SERVICES FOR
CUSTOMERS WITH DISABILITY
STATEMENT FROM THE BAIRD NSW GOVERNMENT
16 February 2015
Minister for Transport Gladys Berejiklian and Minister for
Disability Services John Ajaka today announced a package of
improvements to be rolled out for customers with disability,
including accessible real-time public transport apps, and a new
electronic payment system for taxis.
Ms Berejiklian said the NSW Government carried out a review of
wheelchair accessible taxis and subsidies last year and found
that most customers were satisfied with their service.
“The review included a number of recommendations for the
government and the taxi industry to make services safer,
easier and more comfortable for customers with disability,” Ms
Berejiklian said.
This is a good outcome from a very long
drawn out process. Discussions are now
being instigated regarding a possible taxi
rank on the Opera House Forecourt.
2015 ANZAC DAY COMMEMORATIONS
The Taxi Council continues to work with
the Department of Premier & Cabinet
to ensure that taxi services are made
available for those wishing to attend the
Anzac Day march. This year crowds are
expected to double that of previous years.
Drivers are encouraged to keep an eye on
the NSW Taxi Council website in the lead
up to Anzac Day for more information,
including road closure maps.
Drivers can also expect to receive
information via their networks about when
and where taxis will be required for this
event.
Mr Ajaka said as well as improvements for taxi customers, new
real-time public transport apps would be available this year for
customers with disability.
“Four app developers have been selected to share in $85,000
of seed funding, mentoring and access to real-time transport
data to help them create new apps that will support customers
with a disability to navigate public transport,” Mr Ajaka said.
“The four winners were selected from a pool of 37 national
and international teams who competed in an event last year to
come up with innovative options to improve the public transport
experience for customers with disability.
“Five apps are available now for train, bus, ferry and light rail
customers to help them plan their journey and track their
service in real time. It’s great news that these popular apps are
being improved and expanded for customers with disability.”

businesses to develop a new electronic payment system for
customers using the Taxi Transport Subsidy Scheme, replacing
the out-dated paper dockets used by customers today.

will help the NSW Government reduce the potential for errors
and misuse within the Taxi Transport Subsidy Scheme.
“Transport for NSW will work closely with taxi customers,
drivers and the taxi industry as the electronic payment project
progresses.
“Disability training for taxi drivers will be improved, more
wheelchair taxis will be encouraged and we will look at ways to
make services more affordable, including investigating whether
the taxi transport subsidy could be increased.”

CBD and South East Light Rail
Major contract awarded for light rail expansion
The CBD and South East Light Rail will transform Sydney by offering fast, reliable journeys from
Circular Quay through the CBD to South East Sydney’s sporting precincts, medical facilities, education
and business precincts, every four minutes during the peak.
The project has recently taken a major step forward with the appointment of ALTRAC Light Rail to
deliver and operate the new light rail line.
Key facts
The CBD and South East Light Rail will:
carry up to 450 people per vehicle, the
same amount as 9 standard buses or 90 cars
provide frequent and reliable services,
operating separate from traffic, every four
minutes in the city during peak hours
provide seamless interchange between
trains, buses, ferries and light rail with the
use of Opal card
feature electric powered light rail vehicles
with air conditioning and a fully accessible
low floor design
generate more than $4 billion for the NSW
economy

USING INCLUSIVE
LANGUAGE
Language is an incredibly powerful
tool, and can be used to create a sense
of empowerment, pride, identity and
purpose. Contrary to the old adage
“sticks and stones may break my
bones, but words will never hurt me,”
improper use can have a devastating
impact, even with the best intentions. It
can be difficult to keep up with what is
the acceptable terminology in relation
to disability, so we’ve compiled a brief
refresher for you.
Focus on the person, not the impairment
In Australia, best practice language is
to use ‘person with disability’ or ‘people
with disability’. Person-first language is
the most widely accepted terminology
in Australia. Examples of person-first
language include: person with disability,
person who is deaf, or people who have
low vision. Put the person first, and the
impairment second (when it’s relevant).
We also prefer to say ‘person without
disability’, and do not recommend the
terms ‘non-disabled’ or ‘able-bodied’.
DON’T USE LANGUAGE THAT IMPLIES
A PERSON WITH DISABILITY IS
INSPIRATIONAL SIMPLY BECAUSE
THEY EXPERIENCE DISABILITY
People with disability are just living their
lives, they are no more super-human
than anyone else. Implying that a
person with disability is courageous or
special just for getting through the day is
patronising and offensive.
Conversely, don’t make out that people
with disability are victims or objects of
pity.
Just because a person experiences
disability does not make them weak,
a victim or someone to be pitied.
Examples of language that can imply
people should be pitied include ‘
suffering from…’, ‘ struck down by…’,
and ‘ afflicted by/with…’. We try to
remove the emotion from the language,
for example, ‘Paul experiences
depression’, ‘Ravi developed Multiple
Sclerosis’, or ‘Katya has epilepsy’.
PEOPLE ARE NOT ‘BOUND’ BY THEIR
WHEELCHAIRS
The term wheelchair-bound is one
that is commonly used in mainstream
media, and it is one that really irritates
(and often offends) many people
with disability. A person who uses a
wheelchair is not bound by the chair;
they are enabled and liberated by it, it
can become an extension of their body.
‘Confined to a wheelchair’ is equally
as negative. Use ‘wheelchair user’ or
‘person who uses a wheelchair’, instead.
RELAX, AND DON’T GET CAUGHT UP IN
SEMANTICS
While the above information may seem
daunting if it’s new to you, the most
important thing you can remember is
to simply focus on the person, rather
than the disability. Don’t be so afraid
of saying the wrong thing that you don’t
say anything at all – relax, and just be
willing to communicate.

CHILD RESTRAINTS
DRIVERS AND OPERATORS, PLEASE NOTE THIS IMPORTANT
REMINDER ABOUT THE RESPONSIBILITIES FOR PASSENGERS
WEARING SEATBELTS.
In terms of the responsibilities for taxi
drivers in relation to passengers under
16 year old and child restraints, there is
very little change. Taxi drivers will remain
responsible for passengers under the age
of 16 years wearing seatbelts and using
child restraints.
Children under 6 months must be in a
rearward facing restraint and children 6
months or older but less than 12 months
must be in either a rearward facing
restraint or a forward facing restraint with
in-built harness. The same rules apply to
all vehicles.
In taxis, children 12 months or older but
under 16 years old must be either on a
booster seat and use a seat belt or must
use a suitable seat belt. This is different to
the rules for non-taxi vehicles.
There are some changes in relation to
children sitting in the front seat, so that no
passenger under the age of 4 years may sit
in the front seat, and no passenger under
the age of 7 years may sit in the front seat,
unless the back seats are also occupied by
children under 7 years.
TRANSLATED FROM THE
AMENDMENTS:
The following tanslated excerpts from the
new rules include changes to explain the
way they are to apply to taxis.
CHILD RESTRAINTS & SEAT
BELTS:
If the passenger (in a taxi or other
vehicles) is less than 6 monlths old, he
or she must be restrained in a suitable
and properly fastened and adjusted
rearward facing approved child
restraint.
If the passenger (in a taxi or other
vehicle) is 6 monlths old or older, but is
less than 12 months old, he or she must
be restrained in a suitable and properly
fastened and adjusted:
(a)rearward facing approved child
restraint, or
(b)forward facing approved child
restraint that has an inbuilt
harness.
COMMENT: This is the effect of
combining new rules 266 (2A) and Rule
266 (5-1) (a).
If the passenger (in a taxi) is at least 12
months old but under 16 years old:
(a)he or she must be placed on a properly
positioned approved booster seat and
be restrained by a seatbelt that is
properly adjusted and fastened, or
(b) he or she:
(i)must occupy a seating position that
is fitted with a suitable seatbelt,
and
(ii)must not occupy the same seating
position as another passenger
(whether or not the other
passenger is exempt from wearing
a seatbelt under rule 267), and
(iii)must wear the seatbelt properly
adjusted and fastened.
NOTE 1. In relation to praagraph (b) (iii),
subrule (4E) permits an approved child
safety harness to be worn instead of the
sash part of a lap and sash seatbelt.
COMMENT: This is the effect of combining
new rules 266 (4) and Rule 266 (5-1) (c).
SEATING POSITION:
A passenger (including in a taxi) who is
under 4 years old must not be in the front
row of a motor vehicle that has 2 or more
rows of seats.
A passenger (including in a taxi) who is 4
years old or older, but is less than 7 years
old, must not be in the front row of a motor
vehicle that has 2 or more rows of seats
unless all of the other seats in the row or
rows behind the front row are occupied
by passengers who are also under 7 years
old.
COMMENT: This is the effect of new rules
266 (3) and Rule 266 (3A).
