History of the ADR Plan
On January 1, 2006, this Court’s ADR Plan became effective for the Buffalo
Division of the District under a pilot program authorized for one year by the
WDNY District Judges. The program was extended annually for three years and in
2010 was extended indefinitely by a Standing Order of the Court. All newly filed
civil cases are automatically referred to mediation unless expressly exempted, and
the assigned judge may refer any exempt case to ADR by sua sponte order.
Following his appointment in June 2011, ADR Administrator Barry L. Radlin began
the process of expanding the program to include the Rochester Division and
training 48 new certified federal court mediators for the District’s panel of
neutrals, bringing the total to 96. On July 1, 2012, the expansion became
effective, absorbing over 1,000 civil cases pending on the Rochester docket and
automatically referring all newly filed cases from that date forward.
During the ten years of the program, more than 7,000 cases have been either
automatically referred or sent to mediation by the assigned judges. Once in the
hands of our panelists, the number and rate of resolutions have been exceptional.
That performance, and the innovative components of the Plan, have been
recognized by federal, state and municipal courts and ADR committees around
the country.
Guest Speaker - Hon. Jeremy D. Fogel
Hon. Jeremy D. Fogel is the Director of the Federal Judicial
Center in Washington, DC, a position he has held since
2011. The Center is the education, research and training
center for the federal courts. Judge Fogel continues to
hold the position of Senior United States District Judge for
the Northern District of California, having received his
commission in 1998 as a District Judge. He assumed
senior status on December 31, 2014.
Prior to his appointment to the federal bench, Judge Fogel served as a Municipal
Court Judge for the Santa Clara County Municipal Court from 1981 to1986, and as
Superior Court Judge for the Santa Clara County Superior Court from 1986 to
1998.
Judge Fogel received a Bachelor of Arts degree from Stanford University in 1971
and his law degree from Harvard Law School in 1974.
Judge Fogel was an early proponent of ADR and was the architect and principal
teacher of mediation skills for state judges at California’s Center for Judicial
Education and Research in the 1990s. He remains a strong advocate for the
benefits of mediation in his role as Director of the FJC.
