There are additional measures that need to be in place to ensure safety and keep the fence even further back, possibly adjacent to a freeway or another business. MROZ stated the proposed ordinance requires electric fences be behind an approved perimeter wall or fence, with a minimum height of six feet. SHUTE added that the reason behind this requirement is for screening from the public right of way. HERNANDEZ asked if the City allows six-foot fences adjacent to th not. The proposed motorcycle dealership would include a small platform for the outdoor display of motorcycles/ and an eight foot high security fence around one of the parking areas at the site. The proposal also includes landscape improvements/ the addition of decorative canopies to the front of the building/ and the addition of a parapet wall with signage over the primary building entrance. Finally/ a 2/200 square foot mezzanine is proposed inside the existing building to provide additional space for offices, storage/ and restrooms. The property is developed with a 20,605 square foot, masonry block commercial building and 75 parking spaces, located in two separate lots on the east and west sides of the building. The building was previously used as a retail furniture store. Landscape planters are located along the Naranca Avenue and North Second Street frontages. However, with the exception of some palm trees and a couple isolated shrubs, all the plants at the site have died. It is worth noting that the eastern-most portion of the parking lot and landscaping adjacent to North Second Street is located within the public right-of-way. As described in the Land Use Element of the General Plan, the GC designation is intended to accommodate general retail shopping and service needs, including vehicle sales and services. Noteworthy among General Plan objectives is Objective 9.4, which states that commercial development shall be subject to sound design requirements and strict standards of performance. Specific Plan (SP) No. 148 SP No. 148 authorized development of the project site with a motel and restaurant in 1970. The restaurant was built, but the motel was never constructed. Eventually the restaurant was demolished. The plan was amended several times, most recently in 1995. The amendment in 1995 resulted in the current configuration of development at the site. SP No. 148 regulates the physical development of the site, but not land use. 2 Planning Commission Agenda Report September 2, 2014 Municipal Code EI Cajon Municipal Code Section 17.145.150 indicates that motorcycle sales and service can be established in the C-G zone by CUP, the intent of which is to ensure compliance with applicable development standards and use restrictions, as well as compatibility with surrounding properties and land uses. The Zoning Code also authorizes fences taller than six feet, subject to consent from adjoining property owners and approval by the Planning Manager (or, in this instance, the Planning Commission). A detailed discussion of applicable Municipal Code requirements is included below in the section of this report titled "Discussion." DISCUSSION General Plan Vey's Powersports is a successful local business seeking to relocate to the subject property from its current site at 660 EI Cajon Boulevard. The proposal to establish motorcycle sales and service at the subject property is consistent with the intent of the GC land use designation, which specifically identifies vehicle sales and services as an appropriate land use. Moreover, the proposed new paint scheme, metal canopies, entry feature, signs, and landscaping, would significantly improve the appearance of the otherwise plain, masonry block, building and barren landscape planters. Such improvements are consistent with General Plan Objective 9.4, which states that commercial development shall be subject to sound design requirements and strict standards of performance. Architecture The existing masonry building would be painted with a light shade of tan along the bottom half and a darker shade of tan along the top half. A red band would be painted around the circumference of the building to separate the lighter lower half from the darker upper half. The proposal also includes the addition of two decorative metal canopies and a decorative entry feature to the front (east end) of the building. The proposed metal canopies would be painted red, and would include suspending metal rods and turnbuckles. The exterior of the proposed entry feature would be a product called Alucabond, making it appear to be crafted from brushed aluminum. The proposed improvements would lend a modern "industrial" look to the front of the otherwise plain, masonry block, commercial building. As such, they are consistent with the architectural guidelines in the Zoning Code. Parking The parking requirement for general retail uses in the C-G zone is one stall per each 250 square feet of floor space for the first 10,000 square feet, then one stall for each additional 300 square feet up to 25,000 square feet. There is no specific parking requirement listed for vehicle display. Therefore, the Planning Commission can 3 Planning Commission Agenda Report September 2, 2014 establish an appropriate parking requirement through the CUP process. There are 75 parking spaces at the project site. If the entire building, including the proposed mezzanine, were dedicated to retail sales, the parking requirement would be 82 spaces. However, almost half of the floor space at the proposed motorcycle dealership would be dedicated to vehicle display and service activities. Given that 8,000 square feet of the building would be used as a motorcycle showroom, 3,430 square feet would be dedicated to motorcycle service and repair, and 1,768 square feet would be used for storage, 75 parking stalls are sufficient to satisfy the parking needs of the proposed dealership. Lastly, the Zoning Code requires that all commercial developments provide bicycle parking equivalent to at least ten percent of the required parking. Therefore, staff has recommended a condition in the attached resolution requiring the provision of a bicycle rack, or racks, sufficient to accommodate at least eight bicycles. Security Fence The Zoning Code limits fence height to six feet, but indicates that higher fences can be approved with the written consent of affected adjoining property owners. The subject proposal includes an eight foot high wrought-iron security fence with sliding vehicle gates to secure the parking area at the west end of the building. The fence would include a six foot high block wall topped by two feet of wrought-iron bars along the west property line, adjacent to a single-family home. The owner of the adjacent singlefamily home has signed a written statement consenting to the eight foot wall/fence combination. Outdoor Display The Zoning Code permits outdoor display for businesses customarily conducted outdoors, such as vehicle sales. The proposed project includes a 180 square foot concrete slab for the outdoor display of motorcycles in front of the existing dealership. No other outdoor display areas are proposed. Staff has recommended a condition of approval in the attached resolution limiting outdoor display to the 180 square foot area depicted on the site plan. The remainder of the outdoor areas at the site would be preserved for customer and employee parking and landscaping. Signs Signs, including limited freeway-oriented signs, may be approved at the staff level by a separate permit. However, the project elevations depict freeway-oriented wall signs and window signs that the Commission should discuss. A red oval sign with "Vey's Powersports" emblazoned in black letters is proposed over the main entrance on the east side of the building, directed toward North Second Street. A similar, but slightly smaller sign is proposed on the back (west-facing) wall of the building. Both signs satisfy the sign area limits and other requirements in the Zoning Code for commercial uses in the C-G zone. The proposed project elevations also indicate two large photographs, applied as window decals on the east side of the building. The photographs depict riders on 4 Planning Commission Agenda Report September 2, 2014 motorcycles, and they meet the definition of a sign in the Zoning Code. The Code permits window signs, without a permit, subject to certain limitations: they may not occupy more than 50 % of the overall window area and they count toward the allowable area of wall signs for the building. Although the Zoning Code includes a very generous allowance for wall signs (four square feet per lineal foot of building face), the combined area of the proposed wall sign above the building entrance and the proposed window signs exceeds the sign area allowance for the east side of the building. As such, the cumulative area of the signs must be reduced by approximately 115 square feet to satisfy the limits imposed by the Zoning Code. The easiest way to comply would be to reduce the area of the window signs by approximately 33%. Therefore, staff has recommended a condition of approval in the attached resolution specifically requiring conformance with the sign regulations in the Zoning Code, including the regulations for window signs. Landscaping Consistent with the requirements of the General Plan, and the Zoning Code, the approved SP No. 148 site plan includes landscaping along North Second Street and Naranca Avenue. The shape of the subject property is such that it has a very long street frontage, resulting in more than 7,000 square feet of landscaping at the site. However, most of the plants in the planter areas have died except for some palm trees and a few isolated shrubs. Therefore, the applicant proposes to completely rehabilitate the landscaped areas at the project site. The Zoning Code states that the installation or rehabilitation of landscaping in excess of 2,500 square feet requires approval of a landscape documentation package. Therefore, staff has recommended a condition of approval in the attached resolution requiring approval of a landscape documentation package, and a corresponding certificate of completion, prior to the granting of final occupancy. Compatibility The vicinity around the proposed project includes a freeway, several detached residential units, and an automotive fueling station. The addition of a motorcycle dealership with indoor service and repair activities would be compatible with the surrounding land uses, as long as the service and repair activities remain indoors. Therefore, staff has recommended a condition of approval in the attached resolution, specifically prohibiting the conduct of motorcycle service and repair activities, including engine testing, outside of the existing building. 5 Planning Commission Agenda Report Septem ber 2, 2014 FINDINGS A. The proposed project is consistent with applicable goals, policies, and programs of the General Plan and applicable Specific Plans. The proposal to establish motorcycle sales and service at the subject property is consistent with the intent of the GC land use designation, which specifically identifies vehicle sales and services as an appropriate land use. The project is also consistent with General Plan Objective 9.4, which states that commercial development shall be subject to sound design requirements and strict standards of performance. The project is also consistent with Specific Plan (SP) No. 148 because it proposes no substantial changes to the approved SP No. 148 site plan. B. The proposed project is consistent with all applicable use anddevelopment standards. The proposed project is consistent with all applicable use and development standards because motorcycle service and repair activities will be conducted completely indoors, there is sufficient off-street parking available, consent was obtained from the adjoining property owner for the eight foot high security fence, the landscaping at the site will be restored, and a bicycle rack will be provided. C. The proposed project will be operated in a manner that is compatible with existing and planned land uses in thevicinity of the proposed use. The proposed motorcycle dealership, including sales, service, and repair activities, will be conducted completely indoors and is subject to conditions intended to ensure compatibility with surrounding uses. As such, the operation of the dealership will be compatible with the surrounding uses. D. The proposed project will not be detrimental to the public health, safety, and general welfare, including but not limited to matters of noise, smoke, dust, fumes, vibration, odors, and hazards orexcessive concentrations of traffic. Such impacts are not anticipated with the indoor conduct of motorcycle sales, service, and repair. Additionally, the City has performance standards for these impacts which are enforced through code compliance actions, if complaints are received. E. The proposed project is in the bestinterestof public convenience andnecessity. The proposed project will redevelop a vacant and underutilized property in accordance with the City's regulatory framework, and create a convenient location for motorcycle products and repair services desired by the public. The motorcycle dealership also provides good jobs and sales tax revenue for the community. 6 Planning Commission Agenda Report September 2, 2014 CALIFORNIA ENVIRONMENTAL QUALITY ACT The project is exempt from the provisions of the California Environmental Quality Act (CEQA) subject to Section 15301 (Existing Facilities) of the CEQ A Guidelines. Section 15301 provides an exemption for the permitting of existing structures in urban environments, involving negligible, or no expansion of use. In this instance the existing building was used as a retail furniture store, and the project would allow the building to be used as a retail motorcycle dealership. Both are retail sales uses and the proposed mezzanine addition is a negligible expansion of the existing retail sales building. None of the exceptions listed under CEQA Guidelines Section 15300.2 exist. PUBLIC NOTICE & INPUT Notice of this public hearing was mailed on August 21, 2014, to all property owners within 300 feet of the project site and to anyone who requested such notice in writing, in compliance with Government Code Sections 65090, 65091, and 65092, as applicable. Additionally, as a public service, the notice was posted in the kiosk at City Hall and on the City's website under "Public Hearings/Public Notices." Approving CUP 2208 PROPOSED PLANNING COMMISSION RESOLUTION A RESOLUTION APPROVING CONDITIONAL USE PERMIT NO. 2208 FOR MOTORCYCLE SALES, SERVICE, REPAIR, AND AN EIGHT FOOT HIGH SECURITYFENCE IN THE GENERAL COMMERCIAL (C-G)ZONE, APN: 484-254-57, GENERAL PLAN DESIGNATION: GENERAL COMMERCIAL (GC) WHEREAS, the EI Cajon Planning Commission duly advertised and held a public hearing on September 2, 2014, to consider Conditional Use Permit (CUP) No. 2208, as submitted by Vey's Powersports, requesting motorcycle sales, service, repair, and an eight foot high fence in the C-G zone, on property located at the southwest corner of North Second Street and Naranca Avenue; and WHEREAS, the following findings of fact have been made in regard to said conditional use permit: A. The project is exempt from the provisions of the California Environmental Quality Act (CEQA) subject to Section 15301 (Existing Facilities) of the CEQA Guidelines. Section 15301 provides an exemption for the permitting of existing structures in urban environments, involving negligible, or no expansion of use. In this instance the existing building was used as a retail furniture store, and the project would allow the building to be used as a retail motorcycle dealership. The proposed project will not be detrimental to the public health, safety, and general welfare, including but not limited to matters of noise, smoke, dust, fumes, vibration, odors, and hazards or excessive concentrations of traffic because such impacts are not anticipated with the indoor conduct of motorcycle sales, service, and repair. Additionally, the City has performance standards for these impacts which are enforced through code compliance actions, if complaints are received; and F. The proposed project is in the best interest of public convenience and necessity because the project will redevelop a vacant and underutilized property in accordance with the City's regulatory framework, and create a convenient location for motorcycle products and repair services desired by the public. The motorcycle dealership also provides good jobs and sales tax revenue for the community. NOW, THEREFORE, BE IT RESOLVED that based upon said findings of fact, the EI Cajon Planning Commission hereby APPROVES Conditional Use Permit No. 2208 for motorcycle sales, service, repair, and an eight foot security fence in the C-G zone, on the above described property subject to the following conditions: 1. Prior to the issuance of building permits, the applicant shall submit a revised, 24" by 36" one-page mylar site plan to the Planning Division that includes the following information: a. Add the heading "Storm Water Requirements" above the storm water notes listed on the site plan. b. Add the operational conditions of approval listed below in condition 3, under the heading "Ongoing Conditions of Approval." c. Depict a bicycle rack, or racks, sufficient to accommodate up to eight bicycles. The design and location of the bicycle rack(s) are subject to approval by the Planning Manager. 2. A. B. GENERAL 1. The applicant shall comply with the school impact fee requirements of the Grossmont Union High School Districts, Cajon Valley, and La Mesa-Spring Valley School Districts when applicable. 2. For projects that require a grading permit and excavate more than three feet into native soils, and prior to the issuance of a Building Permit, the applicant shall submit a letter to the Planning Manager agreeing to suspend construction in the vicinity of a cultural resource encountered during development of the site, and leave the resource in place until a qualified archaeologist can examine them and determine appropriate mitigation measures. All fees and expenses for the retaining of a qualified archaeologist shall be paid by the applicant and shall not be at City expense. The applicant shall agree to comply with mitigation measures recommended by the archaeologist and approved by the Planning Manager. PROJECT SITE 1. The applicant shall comply with all regulations and code requirements of the Building and Fire Safety Division, Public Works Department, the Police Department and any other agencies requiring review of the project. If required, these agencies shall be supplied copies of the final building and site plans. 2. All landscape areas that adjoin parking spaces, driveways, vehicular circulation areas, or the public right-of-way shall be protected from encroachment by vehicles in a manner that also complies with state storm water regulations, which require storm water to be discharged to landscaped areas in order to reduce or eliminate the discharge of pollutants. The method of protection shall be determined by the Deputy Director of Public Works. The approved method may include six-inch high curb segments, wheel stops, decorative rock bands, or other methods determined to be acceptable by the Deputy Director of Public Works. 3. Environmental and engineering studies, as directed by the Planning Manager, must be complete and on file prior to commencement to plan checking. Developer shall install off-street improvements determined necessary by the City Engineer to provide safe traffic conditions. 4. Developer shall underground existing and required on and off-site utilities as specified in Chapter 15 of the Municipal Code, or as deemed necessary by the City Engineer. C. D. 5. All development projects shall comply with Title 12 (Streets and Sidewalks), and Title 13 (Water, Sewers, Grading, Erosion and Storm Water) of the EI Cajon Municipal Code as determined by the City Engineer. 6. All retaining walls visible from public right-of-ways shall include decorative elements, subject to approval by the Planning Division. 7. The design of any masonry sound wall shall be approved by the Planning Division. Such walls shall match or be architecturally compatible with existing sound walls of neighboring projects along that street. All masonry walls shall have a trim cap. ARCHITECTURE 1. All exterior materials and colors used in this project shall be in conformance with the materials and color samples approved as a part ofthis application. 2. All mechanical, and/or roof mounted equipment shall be architecturally screened from public view. 3. All trash/recycling enclosures shall be constructed of masonry material with viewobscuring doors. The enclosure shall include materials and colors consistent with the primary building and meet appropriate Storm Water Division requirements. Required roofs shall match elements of the primary building and shall include a fascia trim. 4. All vents, gutters, downspouts, flashing, electrical conduits, etc., shall be painted or finished to match the color of the adjacent surface, unless otherwise directed by the Planning Commission. 5. Soffits and other architectural elements visible from view but not detailed on the plans shall be finished in a manner that is architecturally compatible with the exterior of the building. 6. Finish quality of approved exterior design elements shall be subject to approval of the Planning Division prior to issuance of Certificate of Occupancy. 7. Any decorative elements around the base of a building (stone veneer or tile, etc.) shall be finished with a decorative cap or trim piece. LANDSCAPING 1. Specific landscaping for screening shall have an appearance of mature growth subject to a field check and approval by the Planning Division prior to the issuance of a Certificate of Occupancy. 2. All existing trees to remain shall be shown on the grading plan. 2 E. 3. The area under the drip line of all existing trees that are to remain shall be protected during construction by a fence or other acceptable means. Grading shall be restricted under the trees to prevent soil compaction and to prevent root damage. 4. All sloped banks greater than three (3) feet in vertical height and 2:1 or greater slope shall be landscaped and irrigated for erosion control and to soften their appearance as follows: deep-rooting grasses, ground cover and shrubs. Shrubbery shall be a minimum one-gallon size and shall have a minimum separation of one (1) times the mature width and on slopes of 10 feet or more in vertical height shall include, a minimum of one (1) tree for every 600 square feet of the total slope area. Trees shall be a minimum fivegallon size and shall be spaced a minimum of 30 feet apart. Trees and shrubs shall be planted in staggered clusters to soften and vary the slope plane. Slope planting required by this condition shall include a permanent irrigation system to be installed by the developer prior to occupancy. 5. All landscaping shall be maintained in good growing condition. Such maintenance shall include, where appropriate, pruning, mowing, weeding, cleaning of debris and trash, fertilizing and regular watering. Whenever necessary, dead or dying plants shall be replaced with other plant materials to ensure continued compliance with applicable landscaping requirements. Required irrigation systems shall be fully maintained in sound operating condition with heads periodically cleaned and replaced when missing to ensure continued regular watering of landscape areas, and health and vitality of landscape materials. MISCELLANEOUS 1. Final occupancy shall not be granted until all construction and landscaping is complete in accordance with all approved plans. Under certain circumstances, a temporary occupancy may be granted prior to final inspection. 2. It is the responsibility of the applicant or developer to check with each agency for requirements that may pertain to their project. 3. All signs shall be submitted to the Planning Division for review and approval per Section 17.190.060 of the EI Cajon Municipal Code. 4. The site shall be maintained in a neat and clean manner free of trash and debris. 5. Certain outdoor equipment, such as satellite dishes and back-flow prevention devices shall be visually screened or painted to match surroundings upon installation subject to the approval of the Planning Division. Screening devices shall be shown on construction and/or landscape plans. 6. Water backflow protection for new residential and modified residential projects shall include a protection device at the fire service point of connection, or an internal passive purge system. All exterior light fixtures shall be shown on a lighting plan and made part of construction drawings subject to staff review and approval. All lights attached to buildings shall provide a soft "wash" of light against the wall. All building, parking, and yard lights shall conform to the City General Development Standards 17.130.150 and Performance Standards 17.115.130 (G) and shall complement the site and building architecture. 8. The removal of trees shall not take place during the bird-nesting (breeding) season (February 1 through August 15), unless written authorization from a qualified biologist to proceed with tree removal is submitted to the Planning Division. If clearing is proposed to take place during the breeding season, a survey shall be conducted by the qualified biologist to determine if nests are present, or nest building or other breeding/nesting behavior is occurring. Helix Water District serves parcel with APN 484-254-57 with a t-inch commercial water service with a 5/8-inch water meter protected with a backflow device. Fire protection is provided by a 4-inch fire service (not protected with a backflow device) and the nearest fire hydrants are located on site one located just west of the ES driveway and the other located between the two WS driveways each having two 2,5-inch and one 4-inch outlets. Water pressure in the area is approximately 85 psi. Backflow devices will be required for the existing and any proposed water services and shall be installed per current Water Agencies' Standards.
