T
he Austin Apartment Association is celebrating
their 50th year of serving
the rental housing industry; can you
believe it?
Make sure you take the time to
enjoy all the pictures and memories
on the homepage. As a matter of
fact, we are always looking for more
memories or pictures you would like
to share, so please contact staff or
leadership and they will make sure
to share.
As members of the association
we have benefited and grown over
the past 50 years due to the strength
of our past leadership. Looking forward, who knows what the next 50
years will bring us. Keep your eyes
open in the upcoming months for
more opportunities to reflect on the
past 50 years.
As a matter of fact, let’s take
a minute to reflect on some of the
amazing events, which occurred
over the past couple of months.
In February, a record number of
members gambled the night away
at the annual Vegas Night. Then in
March the association hosted the
Loudest Legs Larry Niemann PAC
Golf Tournament at the Grey Rock
Golf Club. If you haven’t seen the
pictures on Facebook you should
check it out, there were some crazy
pants/outfits. Club M.E.D. members
met for an intimate private reception at the Hyatt Foothills on Lady
Bird Lake. Due to the unbelievable
growth of Club M.E.D. over the
past year, a bigger venue may be
needed for next year. In April, AAA
raised money and awareness for the
Red Cross, with the Talent Show at
a beautiful new venue, Moontower
Saloon. There were 14 amazingly
gifted performers and one opening
act, bless their hearts, which tried to
perform. Last but not least in May
there was May Madness, one of our
most successful kick-offs to summer.
In addition to all the parties and
celebrations, there were also numerous education events, including the
inaugural graduation of our Apartment Maintenance Class. Ten individuals from the class graduated
with their CAMT, CPO and EPA
certifications. This class was created in partnership with the Texas
Apartment Association Education
Foundation, Austin Apartment Association and our partners at Austin
Community College and Goodwill
Industries of Central Texas. After the graduation ceremony, AAA
hosted an on the spot job fair. I can’t
wait to report back and let you know
how many of these individuals were
hired.
In addition, City Council has
kept the members of our Legislative
committee on their toes with a number of potential new resolutions.
Due to their hard work and proactive
measures the Association has been
involved in this process through numerous meetings with council member and stake holder meetings. Way
to go Legislative Committee!
Before you know it, we all will
be gathered on June 6th to recognize
our Property of the Year nominees
and winners, our new Executive
Team, Board members and the new
President. It has been an amazing
year and I am so grateful for the opportunity to serve as the President
of such a remarkable organization.
Although I am sad my tine is coming to a close, I look forward to the
places our new leadership will take
us. Thank you all for your support
over the past year and more importantly for your continued support in
making the Austin Apartment Association the best.

AAA President-elect Robbie Robinson, CAM, CAPS,
IMT Residential, is currently enrolled in the National
Apartment Association Lyceum program. She will attend
these leadership classes through November 2014.
Each year, NAA-affiliated associations may select one
representative to attend the program. The NAA Lyceum
program consists of three modules, each approximately
six hours in length, and are held in conjunction with NAA’s
three major national meetings: the Capitol Conference in
Washington, D.C, the annual Education Conference and
the Fall Assembly of Delegates meeting. The purpose of
the program is to identify and develop well-informed
emerging leaders in the industry.

following individuals for their outstanding contributions to the rental housing industry at the 2014

Awards were presented at the Installation & Awards
Brunch on Saturday, April 26 by TAA President Tami Martin, CAM, CAMT, CAPS, NALP and Education Conference
Committee Chair and Incoming TAA President Mike Clark,
HCCP.
Awards history
The Barbara MacManus Apartment Manager of the Year
Award and the Mary Williams Maintenance Professional of
the Year Award have been given to deserving professionals by TAA each year since 1989. The Rita Kirby Regional
Property Manager of the Year Award was first presented in
1991, and the Anita Marcino Leasing Professional of the
Year Award was first presented in 1999. The names of some
awards have changed over time.
An award honoring the outstanding local association staff
executive was added in 1993. In 2010, the first award honoring the outstanding Independent Rental Owner was presented.
The Olin Steele Award for the outstanding Product/Service Member is the oldest industry professional award given
by TAA, and has been presented since 1987. Past Olin Steele
winners narrow the pool of nominees for the award to five
finalists, with the recipient chosen by the TAA Executive
Committee.
Local nominations
Local associations submit nominations for TAA’s industry awards. This year, 18 nominations were received for the
Barbara MacManus Manager of the year, nine each for the
Mary Williams Maintenance Professional of the Year and the
Anita Marcino Leasing Professional of the Year and 10 for
the Rita Kirby Regional Supervisor of the Year.
There were three nominees for the Independent Owner of
the Year Award, including a couple nominated jointly, and
three for the Association Executive of the Year Award.
Twenty-one product/service members were nominated
for the Olin Steele Award; one nominee was nominated by
two different associations. In addition to award recipient
Michelle Bridges-Pahl, CAS, nominated by the Houston
Apartment Association and the Apartment Association of
Southeast Texas, the other finalists for the award this year
were: Thomas Dodd, Dodd Creative Group, nominated by
the Apartment Association of Greater Dallas; Nikki Jorski,
CAS, Rent.com, also nominated by AAGD; Nancy Payne,
CAS, For Rent Media Solutions, nominated by the San
Antonio Apartment Association; and Deborah Vogel, CAS,
Redi Carpet, nominated by the Austin Apartment Association.
The Kirby, MacManus, Williams, Marcino and Independent Owner award recipients are chosen by a subcommittee
of volunteers from the TAA Education Committee and the
AE Council. The AE of the Year Award recipient is chosen
by a panel made up of apartment association AEs from outside of Texas, and other association staff from outside the
industry.
Get recognized
Nominations for these awards are accepted annually from
local apartment associations. The Call for Nominations is
extended in August, and nominations are accepted until January 31 each year.

OFFICE MOVES TO NEW LOCATION
T
he association offices have been many places. The
furthest back is an address from an Apartment News
magazine from 1972, which gives the address simply
as Suite 206, Congress Square, Congress at Riverside, Austin,
Texas 78704. The next address was a bit more formal: 510 S.
Congress, Ste. 310. Next up, in 1984, the association moved to
a converted house at 1702 W. 6th Street. Nearly a decade later,
association leaders decided to purchase the office building at
4107 Medical Pkwy and in 2001, then-President Tami Martin
burned the mortgage, signaling the building was paid for in full!
Another location change for the AAA office occurred
this January. After many, many months of search and renovation, the Austin Apartment Association office has moved
from the building on Medical Parkway to its new location
at 8620 Burnet Rd., Ste. 475. Over double in size, with
dedicated, separate training and meeting spaces, the new
office is quite a sight. Please stop by and we will gladly
give you a tour. In the meantime, here are some pictures of
the new space.

In our industry of property management, we strongly focus on the move in
process to make a good impression for
our newest residents. Like any good book,
movie or meal, we have to remember that
the ending is what can make or break the
overall experience. When a resident is
scheduled to move out, this is a chance to
remind them why they decided to call us
home. Don’t let this final opportunity to
provide great customer service slip away.
We have to keep in mind that during
the move process, it tends to be a stressful time for anyone. We’re all sure that
moving is not usually the weekend choice
of entertainment, but this is where we
can come in and help alleviate some of
the stress. To assist with this process and
make it go as smooth as possible, it’s a
great idea to send a move out reminder
a week prior to their date. Some of the
items to remind them of are:
• All items to be returned, e.g. remotes,
parking stickers, amenity passes, etc.
• Invite them to schedule a time with
you to do a walk through
• For admin purposes, you will complete a move out condition form with
them so all parties are on the same page
with potential charges; having them sign
the form will help minimize any disputes
after move out.
• If you have a freight elevator for
moving, remind them to reserve a time
slot
• Remind them to switch electricity accounts, renter’s insurance, forward
mail with USPS and change any online
shopping sites, etc. with their new address
• Provide them the opportunity to turn
in their forwarding address ahead of time
• Give them their final balance for
their last month prior to moving out
• Recommend maid services or your
own in-house cleaning service as an option at move out; knowing there is inhouse service, and providing the cost up
front, can also work as a stress eliminator
Last note to be mindful of is that short
and sweet is what the residents need at
move out, as it’s already a very busy and
hectic time for them. Providing them the
notes above will line everything up for
their day, they will know what to expect
and the transition will be effortless. In a
time of haste for our valued residents, this
is the perfect ending.

AUSTIN MARKET IN TOP TEN OF APARTMENT
RENT GROWTH LEADERS NATIONWIDE
Oakland takes the top position for pricing power
among the country’s large metros as of first quarter
2014, with rents up 9.1 percent on an annual basis.
This growth slightly exceeds the 8.7 percent upturn in
San Jose and the 8.1 percent increase in San Francisco.
The three Bay Area metros traded off the nation’s No.
1 position during the past year or so. All three illustrate
the general pattern of the strongest performers gaining
even more momentum, since the annual rent growth
pace within the trio registered between 6 and 7 percent
as of late 2013.
Metros in the West also take the next three spots on
the national rent growth leaderboard, with pricing up
7.9 percent in Portland, 7.6 percent in Denver-Boulder
and 6.2 percent in Seattle-Tacoma.
Miami’s 5.7 percent rent growth is the best performance seen among big markets elsewhere across the
country.
Areas posting rent growth between 4 percent and
5 percent include San Diego and Houston (each at 4.7
percent), Austin (4.5 percent), as well as Atlanta and
Nashville (each at 4.3 percent).
Several metros are recording annual rent growth
just shy of the 4-percent mark, with the numbers coming in at 3.6 to 3.9 percent in Dallas, Orange County,
Fort Lauderdale, Detroit and Minneapolis-St. Paul.

As a supplier member of the Austin Apartment Association, you likely
joined to increase your business; more

for your bottom line. However, some
join and see no real reward. Fear not,
AAA members are here to help you
build a successful membership.

business.” She says, “I want to work
with people I trust and people who are
invested in the industry.” For many other Owner/Management Company members AAA relationships matter to their
vendor selection. With that in mind,
here are four basic blocks of membership and how you can start building
your success.
Education – an opportunity
to build your knowledge.
Are you looking for ways to help improve your job performance, your business and your bottom line? Education
truly is important for personal and professional success of AAA supplier members.
Sam Levassar, CAS, Regional Sales
Manager for Church Services, says,
“aside from learning about the industry,
taking advantage of AAA’s educational
opportunities shows commitment to the
multi-family industry.” He says taking
classes shows your customers, “‘I’m not
just here for your business, I want to learn
about you too.’.”
National designations such as the
CAMT and CAS and certification programs such as CPO and EPA are recognized nationally. Not only are they helpful classes if your career path takes you
to places other than Central Texas, but
very helpful when you’re trying to offer
solutions to your customers’ maintenance
problems.
Brooke Mahoney, also a Past President of AAA, urges supplier members
to “utilize the educational opportunities
in AAA.” She says, “participation [in
education classes] shows commitment
to the industry and most members who
go through CAS/CAM become friends.
It’s an easy way to meet people and
learn about your customers.”
The bi-annual Redbook seminar, a
legal seminar covering changes to the
lease, addenda and industry rules made
by the Texas Legislature, may sound inapplicable to the average AAA supplier,
but consider it a chance to gain insight
to your customer’s daily work and woes
and even how the new laws might impact your business. Not to mention that
you’ll be in a room with dozens of prospective customers all day.
Fair Housing seminars are offered
periodically simply because these laws
have an impact that is far-reaching and
apply to each and every member of the
association. Yes, these classes are another opportunity for networking with
your customers, but they also can keep
you and your employees in the clear of
legal problems related to Fair Housing.
Industry Involvement &
Community Outreach – an
opportunity to build your
community.
Few supplier members may realize
the large number of opportunities AAA
members have to get involved in the
legislative process and champion the
multifamily rental housing industry.
The Austin Apartment Association’s history of legislative lobbying
and involvement goes back to the very
beginning when the association was
chartered in 1964. In fifty years, our
leaders and members have helped write
bills, shape ordinances and create processes for City of Austin utilities. Our
members have done their best to keep
legislation adverse to the industry from
gaining traction at the state and national levels, too. Your business expertise
can inform AAA leaders when speaking with elected and city officials on
industry topics.
While the AAA Legislative Committee is invitation only, AAA supplier
members may get involved by attending the Day at City Hall, the Texas
Apartment Association’s bi-annual
Day at the Capitol and even the National Apartment Association’s annual
Capitol Conference in Washington,
D.C. As a supplier member attending
these meetings, you are getting face
time with industry leaders and elected
officials, learning about the industry
and getting first-hand knowledge of
the challenges facing your customers,
not to mention laws and ordinances
that may impact your business as well.
Legislative involvement is a great
opportunity to interact with agencies
outside the AAA family; Community Outreach is another. Not only can
AAA-sponsored outreach events be a
positive personal experience for AAA
supplier members, but involvement
can be good public relations for a company.

“Food Drive and Community Outreach
to be a part of my personal development.” She says, “It’s my way to give
back,” and “a chance to be a part of
something from start to finish.”
Networking is definitely the name
of the game when it comes to successful supplier members. Community Outreach events offer all involved supplier
members the chance to work side-byside with all kinds of AAA members.

involvement, especially for AAA supplier members.

Meeting new people at events –
your potential customers and future
friends – helps out when it’s time for
you to make the sale. Toni Guggenbickler, CAS, Marketing Manager for
Carpet Warehouse, thinks attending
AAA events can only help you when
making sales calls during the work
week. “Attending events makes it eas-
ier to approach potential customers.”
She says, “Once you share a social
experience, it’s not a cold call anymore!”
What about your “competition” at
events? Sam Levassar says, “I strongly
recommend meeting other vendors.”
He says, “They are some of my best
referrals and they’ve also been the
most wiling to introduce me to other
members.” The association truly is a
group of friends. Remember to treat
others as you wish to be treated and
owners, management companies and
other suppliers alike will help your
business and good reputation grow.

Yet another way to network
within the association is to get
involved at the committee level.
From event planning and education, to community outreach and
even editorial planning for the
Window magazine you’re reading
now, AAA has several standing
committees that meet nearly every
month.
Committee involvement is
your chance to meet other members and the AAA staff – in other
words: networking. If the social
events seem a bit intimidating,
choose a committee and begin
there. Ben Wells, CAS, President
of UCS, advises “…any new supplier member to sample different
committees, discover the one(s)
you are drawn to and then commit
yourself to showing up and being
involved.”
“Being involved in committees
gave me a chance to get to know
my customers, without having to
sell them.” He says, “Over time
we became friends and then they
wanted to use us.”
Brooke Mahoney says, “Networking begins at the committee
level.” She thinks “the large social
events can be a little overwhelming,” and “recommend[s] joining
and participating in a committee.
Once you’ve made a few connections, the social events become
more fun.”
The advice couldn’t be simpler: join a committee. The investment time-wise is minimal – perhaps one hour a month – and you
are helping shape the future of the
association. It must be said that
active involvement is absolutely
necessary to advance to an AAA
leadership position. But even if
leadership is not your intent, AAA
committees need you, your ideas
and your enthusiasm.

Apartment Association and our
partners at Austin Community College
and Goodwill Industries of Central Texas are pleased to celebrate the inaugural class of our Apartment Maintenance
Class with a graduation ceremony and
career fair. We are excited to “graduate” ten individuals from the course with
their CAMT (provisional with one year
of experience), CPO and EPA certification. From the start, this has been a motivated group whom we know will be assets to your company and our industry.
This class has been in the works for
several years and TAAEF has worked
closely with the Austin Apartment Association to have formalized training
programs in Austin for those exploring or new to the industry. We based
the class work on the curriculum for
the CAMT (Certificate for Apartment
Maintenance Technicians), added an
introduction to the apartment industry
and a component on fair housing. We
also partnered with Goodwill Industries
of Central Texas to help us recruit the

Austin Community College.
Much of the success of the program
goes directly to the students but credit
also goes to the collaboration amongst
all four organizations and the support
from TAAEF donors and the Austin
apartment community. The response
to this program and especially the job
shadow component of the class was

be planning a second class for this June.

ow that the Austin Water Utility (AWU) has rolled out the first
rounds of Irrigation Facility Inspections, AAA leadership and staff are
receiving feedback from members and
city staff about how the program is going. This article is a refresher, updated
with new information. If members have
any feedback about their experiences,
they are encouraged to contact AAA staff
or leadership. The first consideration for
most properties is when their inspection
is actually due and how much will it cost.
There has been some confusion with
AWU mailers and notifications; however,
a list of inspection zones and property inspection deadlines is available online at
www.austintexas.gov/sites/default/files/
files/Water/Conservation/Rebates_and_
Programs/Commercial_Irrigation_Assessment_Zones_08-16-2013.pdf.

here. Inspections must be performed by
AWU Licensed Irrigation Inspectors.
Properties may be solicited by inspectors, or may consult a list of authorized
inspectors by clicking on the Commercial Facility Irrigation Assessment Program link at www.waterwiseaustin.com.
Inspections must take place no sooner
than 90 days before the due date of inspection; in other words your inspection
must be current within 90 days.
Ahead of inspection, properties are
advised to coordinate internally and/or
with your irrigation specialist to review
your system for problems. AWU requires systems to be checked for “critical problems” as well as “non-critical
problems.” Critical items cause a system
to fail, while non-critical items do not.
Just because the system passes does not
mean that it is operating properly, and
non-critical items may create serious
coverage issues but not cause a system
to fail. In addition to the system itself,
facility inspections require properties to
have valid copies of all permits related
to their system. There are three types
of permits typically associated with irrigation systems: backflow prevention
assembly permit, backflow prevention
assembly installation test results, and
an irrigation system permit. These permits can be obtained by calling The

NOTE: Some AWU notification letters
list an incorrect number. The number
in this article is correct.
Once a property is initially inspected,
it may be necessary to make repairs and
have a follow up inspection. Alternately,
if a property experiences critical issues, it
may elect to shut off all or part of their
system. AWU offers compliance plan options for properties unable to successfully
pass inspection, however, properties cannot be legally permitted to operate if it is
wasting water via “critical problems.”

programs…sometimes considered “free
money” for doing the right thing. However, after 16 years of the WashWise
rebates for efficient washing machines,
AWU is ending the program. If members would still like to take advantage

must submit to AWU for rebates before
June 30, 2014. Many AAA members
have taken advantage of such programs,

t is frequently noted that housing in
Austin is becoming less affordable.
News stories abound about new housing developments within the city’s core,
yet that housing often carries an expensive
price tag. With the rising cost of housing,
more emphasis is being placed upon ensuring that lower income people have good
places to live throughout the city.
One program designed to help with
this is the Housing Choice Voucher Program (HCVP). This program is sometimes
known as Section 8. Section 8 is the popular reference to the part of the U.S. Housing and Community Development Act of
1974, which amended the Housing Act of
1937, to create Section 8 housing. It covers subsidized housing for low-income individuals.
According to the U.S. Department of
Housing and Urban Development (HUD),
the Housing Choice Voucher Program is
the federal government’s major program
for assisting very low-income families, the
elderly, and the disabled to afford decent,
safe and sanitary housing in the private
market. Although it is a federal program,
it is frequently administered locally. The
Housing Authority of the City of Austin,
for example, oversees its own version of
the HCVP.
Section 8 assistance takes two forms.
One is “project based,” which this discussion excludes. The other is “voucher based,”
which is the focus of this discussion.
Since voucher based housing assistance
is provided on behalf of a family or individual, participants are able to find their own
housing, including single-family homes,
townhouses and apartments. As noted by
HUD, moreover, the participant is free to
choose any housing that meets the requirements of the program. Section 8 participants
are not restricted to living in units located in
subsidized housing projects.
When administered locally, the admin-
istration occurs through a Public Housing Agency (PHA). These public housing agencies receive federal funds from
HUD to administer the voucher program.
A housing subsidy is paid to the landlord
directly by the PHA. It can be the entirety
of the rent, or only a portion of it. Whatever the amount, it is paid on behalf of the
participating family. If less than a full rent
subsidy is to be provided, the family would
pay the difference between the actual rent
charged by the landlord and the amount
subsidized by the HCVP.
Eligibility for a housing voucher is determined by the PHA based on the total
annual gross income and family size. Participation is limited to U.S. citizens and, on
occasion, specified categories of non-citizens who have eligible immigration status.
From a financial point of view, the general rule for qualification is that the family’s income may not exceed 50% of the
median income for the county or metropolitan area in which the family chooses
to live. HUD points out, moreover, that a
PHA must provide 75% of its vouchers to
applicants whose incomes do not exceed
30% of the area median income.
When one applies for the Housing
Choice Voucher Program, the PHA will
collect information on such matters as
family income, family assets and family
composition. Verification of the information provided occurs and, once verified, the
information is used to determine program

eligibility as well as the amount of the
housing assistance payment to be made.
More often than not, an eligible family will be placed on a Section 8 waiting
list. If that occurs, once a program participant’s name is reached on the waiting
list, the PHA will contact the applicant and
issue them a housing voucher. That family is then responsible for finding a suitable housing unit of their choice, where
the owner agrees to rent under the HCVP.
Rental units must meet minimum standards of health and safety, as determined
by the PHA. In fact, inspections of the
rental unit will occur from time to time.
Unless the unit passes these inspections,
the program participant cannot take possession and begin their tenancy. Benefits
will be paid only after a unit has passed all
necessary inspections.
When the voucher holder finds a unit
that he wishes to occupy, and reaches an
agreement with the landlord over the
lease terms, the PHA must make an
independent deter-
mination that the rent requested is reasonable. The PHA will determine a payment
standard: the amount generally needed to
rent a moderately priced dwelling unit in
the local housing market. The standard
often varies by location. It is that determination which is then used to calculate the
amount of housing assistance a family will
receive. This amount, as indicated above,
will depend upon, among other things, an
applicant’s total annual gross income and
family size.
According to HUD, since the demand
for housing assistance often exceeds the
limited resources available to HUD and the
local PHA, long waiting periods are common. In fact, a PHA may close its waiting
list when it has more families on the list
than can be assisted in the near future.
In Austin, the wait list for the Housing
Choice Voucher Program administered by
the City of Austin has been closed since
July, 2006. In Austin, the average wait
time to receive a housing choice voucher is
more than five years, according to statistics from the City of Austin.
The Housing Authority
of the City of Austin
currently administers
5,800
housing
choice vouchers, which in turn serve
15,200 people. Included in the demographics of those served are 997 seniors,
3,578 persons with disabilities, and 7,765
children. The average income for a housing choice voucher participant in Austin,
at least those who participate in the City’s
program, is $14,000. All of these statistics
come from the City of Austin.
Despite the fact that the payment standard established by the PHA is a generalized standard, it does not limit and does
not affect the amount of rent a landlord
may charge or the participating family
may pay. For example, a family who receives a housing voucher can select a unit
to rent which has a rent below or above the
PHA payment standard. At a minimum,
the housing choice voucher participant is
expected to pay 30% of monthly adjusted
gross income for rent and utilities. If the
rent for the particular unit is greater than
the payment standard determined by the
local PHA, the participating family is required to pay the additional amount so that
the tenant portion plus the government
portion of the rent equal the full monthly
rent being charged. By law, moreover, if a
family moves to a new unit where the rent
exceeds the local payment standard, the
family may not pay more than 40% of its
adjusted monthly income for rent.
The HCVP provides rent assistance as
a subsidy. The PHA calculates the maximum amount of housing assistance allowable. That is generally the lesser of (1) the
payment standard minus 30% of the family’s monthly adjusted income, or (2) the
gross rent for the unit minus 30% of the
monthly adjusted income.
When a family’s housing needs change
over time, due to changes in family size,
job locations and other reasons, the voucher program beneficiary is allowed to move
without losing their housing assistance.
Such moves are permitted provided the
family notifies the PHA ahead of time,
terminates their existing lease within the
lease provisions, and finds acceptable alternate housing.
When a family selects a housing unit,
and the PHA approves the unit and the
proposed lease, the participating voucher family will then sign a lease with the
landlord for a term of at least one year.
When a security deposit is required, it is
the tenant’s responsibility to pay the full
security deposit to the landlord. Section
8 assistance will not be used to pay the
security deposit. Once the first year of
the tenancy has passed, the landlord may
initiate a new lease, allow the family to
remain in the unit on a month to month
basis, or end the tenancy.

takes into account the quality, size, type,
age and amenities of the particular rental
unit. This study, moreover, can also include whether and what housing services,
maintenance and utilities will be provided
to someone who lives in that unit.
When a PHA approves a family for
participation in the HCVP, they are not
making a representation about that family’s expected behavior or the family’s suitability for tenancy. Those determinations
must be made by the landlord. The PHA
may provide the owner the current address
or prior address of an applicant as shown
on its records, and on occasion, the name
and address of a past landlord. A landlord
who is considering renting to a Section 8
participant should ask for this information
from the PHA in writing. It will typically
not be given automatically.
There are a few basic lease requirements when renting to someone participating in the HCVP. First, the lease between
the tenant and the owner must be in a standard form used by the owner and generally
used for other unassisted tenants. Second,
the terms and conditions of the lease must
be consistent with state and local law.
Third, the lease must specify what utilities and appliances are to be supplied by
the landlord and which are to be supplied
by the participating family. The lease must
also include the HAP contract. The overall
rent, finally, must be reasonable, as compared to similar unassisted units, and in an
amount approved by the PHA.
The landlord will be required to prove
to the PHA that it is the legal owner of
any property. Often a recorded deed to the
property must be provided to the PHA.
Where there is a professional management firm involved, there must be a fully
executed management agreement verifying the arrangement. For tax purposes, the
landlord will be asked to provide either a
tax identification number or a social security number.
During the term of the lease, if the participating family has a change in income or
family composition, they must report these
changes to the PHA within 10 days of occurrence. A tenant’s rent portion may then
be adjusted, up or down, and a rent change
notice will be mailed to both the participating family and their landlord.
On an annual basis, federal regulations
require PHAs to review a family’s income
and composition. Rent portions will be recalculated, as necessary, and rent change
notices will be mailed, following these annual re-certifications.
It is the obligation of the property
owner or manager to notify the PHA if the
HCVP participant moves out of the unit
before the end of the lease term. Hous-
ing assistance payments can only be made
while the voucher holder lives in the unit.
Early move out is not typically a frequent
occurrence, for families who leave the unit
without notifying the PHA or the owner
may be terminated from the HCVP.
After reading the foregoing, you may be
saying to yourself that being a participating
landlord in a Housing Choice Voucher Program is not your cup of tea. While such a
decision can currently be made exclusively
by you, that may be changing. For quite
some time, efforts have been underway by
tenant advocates to deter landlords from
choosing not to participate in the Housing
Choice Voucher Program.
One way to ensure as many landlords
as possible are on board with the program
is to make source of income a protected
class in the context of housing discrimination. Stated another way, you could be denied the opportunity to reject an applicant
because you do not like the facts of who
pays what amount of the rent you charge.
If this new protected class is created, one
would be prohibited from refusing to rent
to a person solely because they are a participant in the Section 8 Housing Choice
Voucher Program. While no such protected class currently exists, at least in Texas,
one can never predict with certainty what
the future may hold.

pant signs will be the same lease other residents at the community sign. For example,
if the owner uses the Texas Apartment Association lease form, that same lease form
will also be used for Section 8 residents.
When housing subsidies are given, however, there is a document entitled the Housing Assistance Payments Contract, also
known as the HAP Contract, which must
also be used with a Section 8 tenant.
This document supplements the primary lease, which in our example was the
TAA lease. It is not to be used in lieu of the
commonly used form at that property. The
HAP contract imposes additional responsibilities and obligations. There are unique
obligations which exist between the PHA
and the tenant, as well as the PHA and
the landlord. Often, these obligations are
considered onerous to a landlord, for they
impose conditions upon terminating the
tenancy which are more challenging for a
landlord to meet than if those conditions
did not exist.
Admittedly, there are pros and cons relating to participation in the HCVP. Those
who favor participation, point out the large
available pool of potential renters, (often
due to the large waiting list), and generally
prompt and regular payments by the PHA
to the landlord for its share of the rent.
They also point out how regular inspections, and conditions imposed on Section
8 tenants, create an incentive on the part of
the tenant to take good care of the property.
Those opposing participation in the
HCVP raise points like perceived difficulty in evicting Section 8 tenants, whether
for non-payment of rent or conduct. They
also state that they fear Section 8 tenants
and their children will not properly maintain the premises, since they contribute so
little of their own money to the tenancy.
Those in opposition also state that they do
not want the government involved in their
business, primarily by making inspections
and insisting upon mandatory repairs. Another point often raised by opponents of
the HCVP is that there will be restrictions
on their ability to charge a rental amount
above market value.
The funds provided to the PHA by
HUD are primarily used to provide the rent
subsidy on behalf of the eligible participant, whether family or individual. In addition to the rent subsidy, HUD also pays
the PHA a fee for the cost of administering
the program.
When determining the rent amount for
a rental unit participating in the HCVP, the
rent requested must be comparable to similar, unassisted units in the area where the
rental property is located. There is more
to it than location. A rent reasonableness
study will be conducted by the PHA which

Improving the energy efficiency of your community helps you

Upgrading increases resident satisfaction and retention. For a limited
time, the Energy Returns promotion offers attractive rebate incentives
to help you identify improvements, maximize savings and improve
your facility.
Rebates based on the estimated reduction in modeled kWh savings
help to offset the upgrade costs. Rebates start at $500 per unit
and increase up to $1,250 per unit for higher energy savings. Take
