Buying a property overseas can add significantly to your
quality of life and give you, your family and friends many

Canaries to return to time and again on an Island you love is
a joy.

Freedom4sale was established in 2001 by a group of likeminded people working in property, who shared a desire

Canaries

Tomas was born in mainland
Spain and has lived in Lanzarote

Spanish Economic Recovery to Boost Property Market

Policy
The start of the big FITUR Tourism Fair in
Madrid brings the news that the Canaries
broke their record for the number of foreign tourists last year.
Figures released ahead of the Fair, which
the islands’ tourism chiefs are hoping will
serve to attract more Spanish visitors,
show that a total of 10.6 million holidaymakers from other countries travelled here
for a vacation. The figure is 400,000 higher
than the previous best, recorded back in
2011. Four months of the year just ended
March, October, November and December, saw the 1 million barrier broken, a feat
which has occurred for the first time. In December, one of every three foreigners who
holidayed in Spain did so in the Canaries.

The Canarian government has used the big
FITUR Tourism Fair in Madrid to give the
first signs that it may be prepared to relax
the current ban on the building of new hotels, except those in the 5-star category.
The controversial freeze has infuriated
the Gran Canaria authorities, who are demanding a relaxation of the ban to allow
new 3 and 4 star hotels which, the island
Cabildo argues, are badly needed in the
resorts in the south to cater for growing
demand in these niches. The government
is adamant that only top-class hotels and
apartment complexes may be built as part
of the drive to improve the image and quality of the tourist industry here. However, a
spokesman said last night in Madrid that
it is prepared to “dialogue” with Gran Canaria over the situation and listen to the
island’s demands.
Expect to see foreign investors from the
likes of the UK, Germany and the Netherlands become the main providers of money coming into the market, helping to keep
sales volumes high. “Coming off the back
of a very strong 2013, Its predicted a further
increase in sales volume in 2014 as buyer
confidence continues to grow. If bank lending finally improves, then the market will
accelerate across the board but, again, it
is not likely for the first three quarters of
2014”
Rajoy Says Tax
Cuts In 2015
Spanish Prime Minister Mariano Rajoy
says the government will approve a tax cut
this year that will take effect in 2015.
Rajoy spoke in a televised interview yesterday, in which he also said, “There will
be no independence move by any Spanish
territory” referring particularly to Catalonia.
The Prime Minister told Antena 3 that he
expects tax reform legislation will be put
forward in March or April.
Rajoy, who has been in office for two years,
is head of the PP party which has ruled
Spain with an absolute majority, taking
harsh austerity measures to try to reduce
the huge deficit in public finances after a
decade long real estate bubble burst, generating an economic crisis that has lasted
five years. The centre-right government
had raised taxes despite repeated previous
statements to the contrary, Rajoy justified
this by saying it was necessary to avoid a
bailout to Spain as in the cases of Greece,
Portugal and Ireland.

Needed For
Resident Travel
Discount
The Spanish Government approved a
measure on Friday, to do away with the
need for travel residence certificates, Certificado de Viaje to be presented in order
to qualify for discounted travel between
the islands and other parts of Spain. In the
future residents will no longer be required
to produce copies of their Certificado de
Empadronamiento para Viajar to receive
the residents discount available in the Canary and Balearic Islands, for travel within
Spain.
You will still need to be registerd on the Padron at your town hall in order to get the
discount, but the onus is now on the travel
agent, airline or ferry company to use the
SARA automated system to check on your
status on line.
Qualifying residents of the Canary Islands
will show as being entitled to the discount,
so you can confirm place of residence automatically at the time of booking.

Self-Employed
Workers Hope
Spain’s government is considering overhauling the Social Security system for the
self-employed after years of complaints by
sole traders and small business owners
that they are being bankrupted by financial
demands from the State.
In what could be a landmark reform that
would provide a much-needed boost to
business for those working for themselves,
the PP may be considering the possibility
of the self-employed paying monthly Social Security National Insurance contributions, according to what they earn, rather
than a flat rate.
Although the government insists it has no
immediate plans, after a meeting between
vice-president Soraya Sáenz de Santamaría and a national association representing
self-employed workers, the latter claims
the cabinet has promised to investigate the
situation in depth and consider a radical
reform.

Companies Up
7% in 2013
The number of new companies incorporated in 2013 increased by 7.02%, the
highest rate for business creation since
2006, before the crisis began. In total,
93,756 companies were incorporated,
which represents the highest figure since
2008 when 105,287 were created, according to the Spanish Association of Registrars’ commercial statistics.
In addition, 34,994 capital expansion
transactions were carried out, amounting
to 59,929 million euros, 26.23% more than
in 2012. Although the number of capital
expansions in 2013 fell by 5.07% yearon-year, in the fourth quarter the trend
changed and grew by 11.07% compared
with the same quarter of 2012.
During 2013 the number of company liquidations increased by 12.16%, to 26,720,
however also in the fourth quarter the
trend was reversed with company closures falling by 34.88%.
The number of companies involved in
bankruptcy proceedings during 2013 was
8,049, which represents a 20.71% increase
over 2012, but also represents a moderation in the increase rate since in 2012 the
rate was even higher, at 32.88%. Again, in
the fourth quarter a change in trend was
noted, with the number of recorded bankruptcy proceedings decreasing by 6.83%
over the same quarter of the previous
year. Diario Sur reported that the Registrars’ data seems to confirm the shift in
trend in the economic crisis and the beginning of recovery.

Defining your Spanish Property Needs
...the next step towards a successful purchase lies in analysing
Buying a property in Spain should not
be approached frivolously. It is a big
investment in time and money, and
the result is likely to have a significant
impact on your life.
This means that you need to think hard about why
you are buying and what you should buy given your
circumstances. Doing so helps you get your ideas clear
from the start, and encourages you to do some careful
research. This may sound like stating the obvious
but the truth is that many people allow dreams and
wishful thinking to cloud their judgments. People
who fail to do the hard thinking at the start are more
likely to waste their time and be disappointed.
Once you have done some background research into
the market the next step towards a successful purchase
lies in analysing and defining your needs. Doing so
not only helps you understand and prioritise your
requirements, it also helps you to prepare a clear,
written brief describing the characteristics of the
property you need. This results in a useful document
that helps guide your search and that you can share
with estate agents and other professionals who you
deal with during your search.
Wishful thinking will do you more harm than good
so be dispassionate and realistic when defining your
requirements. Think hard about your circumstances
both now and in the future, try to identify the
property characteristics that will best fit with your

evolving circumstances, and try to challenge your own
assumptions about what you really want and need. Be
honest with yourself during this process, even though
it may involve shooting down a few fantasies. For
example a rural property can be very appealing but
the isolation often proves too much for some people.
You need to identify the important issues at the outset
rather than once you have bought. And be sure to
include everyone affected by the decision and arrive
at a consensus that everyone can support. It is a recipe
for disaster if your children or partner are not fully
supportive.
Example questions to consider
Needs are as varied as the individuals that have them
so it would be impossible to create a complete list of
the issues to consider. However the following are some
suggestions that cover the basic issues that affect most
people.
Will this be a holiday home for a few
weeks a year, or will it be a main
residence for spending all or part of
the year?
A holiday home means you probably not being there
for large parts of the year. Therefore you will need a
property that doesn’t require a great deal of attention
on a regular basis. The last thing you want is for your
holiday home to become a burden that interferes with
your life. Apartments or villas on urbanisations are the
best option in this respect, as security and maintenance
tend to be easier for these types of properties. Perhaps
look for something with good rental potential to earn
income and avoid leaving the property empty most
of the year.
A more permanent home requires greater thought.
You plan to spend large parts of the year living there,
so you need to be somewhere that offers you the
best quality of life. This means considering the local
infrastructure and facilities, community, security,
accessibility, and so on.
What do the family need?
Generally speaking, if you have young or teenage
kids, your life will be a lot easier if you a buy property
that allows them to have fun without you having
to drive them everywhere. Residential estates that
attract families are ideal, as both parents and kids are
happy. On the other hand if you are relocating on a
permanent basis then you need to think about issues
such as schools and healthcare.
What sized property do you need?
Be realistic about the size of property you need. Don’t
buy a property on the assumption that extended
family will always be staying, as you may end up
with something too big for you. Focus on your own
requirements.
What kind of property do you need?

resale, villa/apartment, on a complex or not) suit
different needs, and it is important that you are aware
of their relative merits before deciding what to buy.
This is one of the most important questions that you
need to answer.
How much effort do you want to put
into maintaining the property?
Essentially it is just the beginning when you complete
the purchase. Property in Spain, as anywhere, doesn’t
look after itself, and maintaining property in a foreign
country can be more of a challenge than at home.
Depending upon what you buy, you may find yourself
having to deal with local government, local builders,
cleaners, plumbers, gardeners, and what have you, and

costs and taxes that you need to cover
every year? Don’t assume that either
or both of these will be lower than in
the UK – second homes are viewed
as a luxury in tough times, and ideal
sources of extra revenue in the form of
taxation. Here are the major areas to
consider.

Purchase costs can add up to around 10 per cent of
the sales price of a property, depending on where you
buy, so you really need to understand the market you
are buying into.
There are also ongoing or running costs on second
homes – something that is often underestimated and

to keep a property or are forced to rent out their homes.
If you’re buying a €200,000 property in the Canaries,
for example, then you should really automatically
add €20,000 (or 10 per cent) to any sale price when

through at the eleventh hour because buyers cannot
secure their financing.
Holiday homes are often left unoccupied for long
periods, or they are rented out to third parties so
insurance needs to be factored in.
Avoid much wasted time all round by doing your
research and consulting lenders before you start
seriously property hunting.
Beware of local peculiarities too: subsidence cover isn’t
available in every European country .
This will also show agents and vendors that you are a
serious buyer and can move fast to complete a sale so
will also give you an edge.
Typical premiums might be between 250-350 euros for
a two or three-bed property in Spain
Always borrow in the same currency as the source of
funds you plan to use to cover the repayments.
Anyone buying in a community or development should
check what their communal insurance includes. It may
be included in their community fees yet that probably
only covers the communal parts of the development.
So, if you’re going to be paying with a UK salary, your
mortgage should be in sterling, but if you plan to rent
out your property in the Canaries, you could be better
off with a Euro mortgage.

It is likely your chosen lender will require proof of
deposit from you, including how the funds were
accumulated (eg by savings, inheritance or sale of
another property).
Banks’ affordability criteria have also got much stricter
in the last few years and lending varies considerably
between countries.
Whatever you might have seen advertised, most lenders
in Spain will typically offer foreign buyers a maximum
loan to value (LTV) of 50 per cent.
Here, there are currently some good long-term fixed
rate deals available, but the LTV available can vary
according to what type of property you’re trying to
buy, with old, rural properties being seen as more of a

Who does what in the Property in the property buying process?
...Good agents will have your best interests at heart and know the local market thoroughly
Agents exist to sell property for a
client, whether a private vendor or a
developer and in return, they receive
a commission. That commission will
vary, depending on the country and
whether the property is resale or newbuild.
In the UK, estate agents perform a relatively
straightforward hand-holding role, but when you’re
buying abroad they need to play a far more significant
role that encompasses tour guide, chauffeur, translator
and general advisor.
Resales usually involve far more work for the agent.
The commissions that agents abroad command are
also higher. In the Canaries, for example, the average
commission is 5 per cent.
So when choosing an agent you are going to need to
know exactly what they are going to do for you
– a good one should indicate what their role is and
where their obligations stop.

on your behalf by an expert that you have paid to act
on your behalf, namely an independent lawyer

interests for the sale to go through so they earn their
commission.
You should test their knowledge by quizzing them
about the local market and other factors such as local
taxes, crime rates, schools, transport, etc. They should
be happy to spend time helping you with all of this.
You will often have the choice of dealing with a
UK-based company selling abroad, or one locally
based, but you’ll need to decide who you feel more
comfortable with, and who you trust.
To help the sale along, an agent may offer other
services such as obtaining tax numbers, opening a
bank account or introducing the buyer to mortgage
advisors, but their basic role is to sell a property. They
are not there to give legal advice or act for the buyer –
that is where your independent lawyer comes in.
Bear in mind that agents are not always regulated
or accredited in any way – this differs hugely from
country to country. In Spain you do not need a real
estate licence.

The role of the developer
The developer owns the land, obtains the relevant
building licenses and planning permission and then
builds the project. That’s the ideal. When you make
a purchase, this is who you are buying your property
from and who ultimately is responsible for delivering
exactly what appears in the contract.
The first thing to point out is that you can buy a new
home direct from the developer through their on-site
sales office or wherever their own sales team have offices
– but you can also buy their properties via agents.
Buying direct from the developer can sometimes save
you a mark-up, so it is worth researching this as an
option if you’ve got a particular development in mind.
But an agent can often make the purchase process
easier.
When buying a new or off-plan property, buyers (or
their lawyers) should question everything the developer
claims. Are all the building licenses in place? How
are they financing the project? Are the buyer’s stage
payments secured by bank guarantees?

One obvious question to ask is has the developer
completed previous projects successfully? If they are
stating a return on your investment and say they’ve sold
300 properties, returns are 10 per cent and they’ll pay
back in a year, ask them to prove everything.
Clearly the financial hiatus of the last five years has

leaving some purchasers exposed, with some countries
effected more than others. You need to know what will
happen in the worst-case scenario and be comfortable

windows for agents, giving them access to a far larger

Good Deal Or Bad Mistake?
Buying a house usually goes something like this:
work out what you can afford, get a mortgage in
place in principal, find a real estate agent, make a
list of your must-haves, view multiple properties,
make an offer, secure your mortgage, complete on
your new home. Although time consuming and at
times frustrating, viewing properties first-hand is
considered by most buyers to be a fundamental part
of the home buying process, and many would never
dream of purchasing a home without first inspecting
the property itself and the neighborhood.
There are buyers, however, who are willing to
purchase homes without seeing them first. For
various reasons, these buyers and investors are willing
to skip this part of the process, relying instead on
property listing descriptions, Internet photos and
virtual tours. With the number of distressed homes
on the market, some investors purchase homes sight
unseen in an attempt to secure great deals. Buyers
might also snatch up homes while they have the
chance in markets that have a limited supply of
properties. Because of competition – from buyers to
aspiring first-time investors and institutional firms
that buy up entire blocks of property, in this climate
there is an increase in the frequency of sight-unseen
purchases. While you can get lucky and spin a nice
profit when it’s time to sell, there are significant
risks that need to be acknowledged before engaging
in this type of real estate investing.
Properties
Distressed properties are generally damaged or in
poor condition, and are under repossession by the
bank. Most banks try to unload these properties as
quickly as possible, because they are expensive to
hold: between property taxes, maintenance and
legal fees, it can cost banks thousands per day to
maintain each property in its inventory. Because
a quick sale makes financial sense for the bank,
these properties are often offered at a significant
discount. This creates an excellent opportunity for
both buyers and investors to get properties at below
market prices.
Expenses of flights, time off work, hotels and
properties with discounts in limited supply and for
limited time periods only can compel buyers and
investors to purchase houses sight unseen.
Competition
Investors looking for great deals or prime properties
may be up against tough competition from flippers,
wholesalers and institutional buyers. Flippers are
real estate investors who aim, much like stock
market investors, to buy low and sell high. Typically,
flippers purchase properties at a discount, make
repairs and renovations, and sell within a short
time-period for a profit. A property’s after repair
value provides an estimate of its fair market value
after repairs and renovations, it is used to determine
if a property has profit potential. One calculates
potential profits by subtracting the purchase price,
repair and renovation costs, and purchase costs
incurred for holding onto the property. Because
these types of investors depend on these calculations
to determine if they can make a profit, some will not
purchase sight unseen. Others, however, focus on
repossessed properties that can be bought at a steep
discount and with many there is no opportunity to
view before signing the papers.
Institutional investors purchase large inventories
of properties, sometimes entire blocks of distressed
properties. Institutional investors, backed by deep
pockets, can purchase dozens or hundreds of
homes, driving down inventories and consequently
driving up prices in a market (and increasing the
likelihood of selling at a profit). Institutional
investors can have such massive buying power that
they can make it quite difficult, if not impossible,
for smaller investors and individual homebuyers to
find good deals within a target market.
In addition there is a smaller group of buyers who
will purchase homes sight unseen out of necessity.
This most often involves an individual who, for
business or personal reasons, cannot travel abroad
to view but will not miss out on the opportunity.
Typically, these buyers work with real estate agents
who send them detailed descriptions, photos and
videos (or virtual tours) of properties that meet the
buyers’ criteria. The agent essentially becomes the
buyer’s eyes and ears, and trust is the key to success.
Risks
Homebuyers and investors may purchase homes
sight unseen, but the practice is not without
risks. One of the biggest risks is that there will be
something wrong with the property that doesn’t
show up in photos. Furniture and camera angles
can easily hide many defects, including water
damage, infestation, mold and structural damage.
While many properties are in disrepair because the
owners did not have the time, expertise or money
to properly maintain the home, some properties are
intentionally damaged by previous owners. Often,
this is a misguided attempt to “get back at the bank”
by making it more difficult to sell the property.
Other times, people rip out whatever they can –
appliances, fixtures, wiring – for the money.
Regardless of motivation, destruction after
repossession can involve relatively inexpensive
fixes such as holes in the wall, or extensive and
costly repairs. In a particularly ugly incident from
2011, a home in an upscale gated-community
cost thousands in repairs after its previous owners
were repossessed. Chemicals and cement had been
poured down the property’s drains and water was
left running for what may have been months –
leading to extensive mold throughout the property.
Another reason buying sight unseen can be risky
is that photos and virtual tours don’t allow you to
see undesirable features of the home, such as nearby
high-tension wires, traffic, neighborhood noise
levels and unusual odors (from things such as mold
or the 100 cats that used to live in the house). A
visit is the only way to be sure that you’ll like the
house, the garden, the neighbors and the area.
Ways to protect yourself
Buyers and investors can both add a layer of
protection to buying sight unseen with the aid of an
experienced real estate professional. It is important
that the agent be on your side of the deal (working
on your behalf as a buyer’s agent) and not working
on behalf of the seller. The agent should have a
professional responsibility to you to make sure you
get the best deal. Many buyers and investors vet
several agents before finding one who understands
their needs and who they feel they can trust.
The Bottom Line
Some people purchase homes sight unseen out of
necessity, while others do it for the profit potential
of a real estate investment. In any case, buying a
home without first seeing it involves risks: the
property could have defects or damage that may
result in extensive and expensive repairs. Also, the
home might be in an undesirable location (e.g.
next to a busy road) or have other detrimental
features. Whether you are buying sight unseen
out of necessity or as an investment, you can limit
your risks by working closely with a trusted and
experienced real estate agent, and by including
certain contingency clauses in the offer to purchase
real estate.

Why you should never buy on Price alone
It is possible to argue that there have
never been so many great deals
available across the overseas property
sector than now.
That’s not sales talk: credible statistics reveal prices
are significantly reduced in many of our favourite
markets, mostly led by Spain.
Whether prices are down from their peak by 20 per
cent or 60 per cent, it is clearly a buyer’s market now
and if you are looking to buy an overseas property
then you must not get swayed by silly prices.
We’ve said it before but we’ll say it again: “if it sounds
too good to be true, it probably is.” How often is it
true that paying a little more for something pays off
in the long run? So always ask yourself the question:
why is something so cheap?
In a market driven by simple rules of supply and
demand, it stands to reason that something that
nobody else wants will be reduced in price to a
greater extent, like many bank-owned properties in
Spain.
This over-supply in some areas has led to massive
discounts and many people would argue it is exactly
the right time to pick yourself up a bargain. What
you shouldn’t do is be attracted by a property
simply because of the size of the discount, you
should remain clear on why you are buying it, for
personal usage or for investment.
In some of the best locations properties may only
be reduced by 10 per cent so if you start out with
a percentage discount in mind, you will end up
disappointed. Clearly a buyer in the current market
is in a strong negotiating position, but you need to
do some research and find out what is a reasonable

Then there are the usual things that one should
always check. Is the property on a healthy and wellestablished development where all the owners are
paying their community fees so that maintenance
on common areas is being carried out?
In tough times, the non-payment of fees by
struggling or too-few owners should ring alarm
bells and any buyer should ask further questions if
in doubt.
So, location, location, location is possibly even
more important than in the boom times, and a
good location, such as frontline beach, will always
be sought-after.
Even if you aren’t buying something as a hard-nosed
investment, you should still think of your exit
strategy. If you had to sell it on in six months, could
you be sure that someone else would want it (ie does
it tick lots of boxes)? Who is likely to buy it? Is there
a strong domestic and/or international market?
To ensure that you make a sound - and safe
investment, you must also use independent legal
advice as well as a finding an agent you can trust.
Your lawyer should investigate thoroughly if a
property has any debts - including utility debts –
especially those in the hands of banks with hundreds
of properties on their books.
Don’t neglect plenty of research on what’s selling
at what prices so you are able to make an educated
decision about whether something is selling at a fair
price.
Equally, don’t forget all the usual issues such
as having a building professional to check for
any structural problems and that the property
comes with relevant planning permissions, as
well as budgeting for any necessary upgrading or
renovation.
If you are promised “assured rentals” or a certain
amount of income from letting out your prospective
property, ask for proof that such levels are likely,
or you might not be able to afford your property’s
upkeep.
What are the ongoing running costs, from
community to local taxes ?
If rental income is your priority, is it within the
crucial hour to 90-minute transfer time of an
airport (depending on the area), and of a type and
size of property in demand in its locality?
Equally, are you allowed to rent it out for holiday
lets?
Needless to say, your finance should also be in place
beforehand and if you are buying with a mortgage
then getting an agreement in principle before you
start searching saves time and heartache at the end.
With many properties languishing on the market
for long periods of time in many areas in Spain, you
should take your time and carefully consider what
you are buying and what it might be possible to
negotiate.
It’s an exciting time for buyers of overseas property,
as long as they don’t forget the fundamentals.
Even if you aren’t buying something as
a hard-nosed investment, you should
still think of your exit strategy.
