That’s why for the first time, the NAFS, a respected newspaper that has been serving the Filipino community for many years, is holding this event to Cherylyn Toca recognize the Fil-Can artists who have been recognized by the other communities except ours. Here is the list of honourees: Paul Baluyot — Baluyot is a stand up comedian who recites a fast-paced succession of numerous stories called Paul Baluyot `bits` and one liners which constitute what is typically known as monologue, routine or act. He admitted that there are no formal schools for comedians to study. “It takes pure talent for someone to be a comedian, “ he said. Baluyot added that working as a comedian is fun but not easy. “Stand “Maiara” (Maria Janice Galvez) up comics are expected to deliver a steady stream of laughs. They are always under pressure to deliver. If they cannot make the audience laugh, they could be harassed or booed.” He performs not only in colleges and universities in Ontario and Ottawa but also in comedy clubs in Montreal See Page 4 First Star Awards Statement by the Honourable Rona Ambrose, Minister of Health, on an announcement of a support package for Canadian survivors of Thalidomide March 6, 2015 More than fifty years ago, Thalidomide was approved by Health Canada and prescribed to treat morning sickness in expectant mothers. Tragically, Thalidomide caused serious and permanent physical and emotional damage to mothers, children and families. On behalf of the Government of Canada, Iwould like to express heartfelt sympathy and great regret for the decades of tremendous suffering and personal struggle that exposure to Thalidomide has inflicted on survivors and their loved ones. I have just spoken with Mercedes Benegbi, Executive Director of the Thalidomide Victims Association of Canada, to thank her for her tireless work on behalf of TVAC members and tell her about new assistance the Government of Canada will be providing to Thalidomide survivors. Today, our Government is taking a historic step and announcing a package of financial assistance that will help cover the urgent and ongoing healthcare needs of Thalidomide survivors. See Page 4 Thalidomide 2 E d it o r i a l Recognizing the talent among our community is long overdue Many of our community associations have been giving service awards to people who have done something good to their fellow citizens, As far as we know, no association yet has given any recognition to talented Filipino-Canadians who have achieved a considerable degree of success in their art. The North American Filipino Star, having served the community for the past 33 years and considered to be credible and reliable, is taking the privilege of establishing the first awards recognizing Filipino-Canadian artists. A committee composed of MMTV (Mabuhay Montreal TV) crew members, voted upon the nominated candidates for the awards. As we would like to make these first awards special, we limited our selection to four this year. Our first awardees are all outstanding in their field. We are very proud to have this opportunity to show how we appreciate them. moreover, we want to further their career by letting our fellow citizens know more about them. We are holding the awards ceremony during the Spring Dinner Dance Party of Mabuhay Montreal TV. It is an occasion that will raise awareness about two things - appreciating the talents of our fellow citizens and supporting the only Filipino-Canadian made television show in Quebec. Moreover, we are also highlighting the role that the North American Filipino Star has been fulfilling for many years. Like the television show, it provides a valuable service of informing and educating the public about important March 2015 The North American Filipino Star issues and providing them with timely news locally and internationally.. Both MMTV and the North American Filipino Star are empowering our community. Being in the media, we try to be fair, objective and truthful in our reporting and broadcasting. We are motivated by our desire to create a positive influence over our readers and viewers. By doing our job to the best of our ability, we promote a positive image of Filipinos in Canada. MMTV’s Spring Dinner Dance Party is going to be a very special one for many reasons. First, it will be the first time the North American Filipino Star has initiated this type of award that has not yet been done by any other group. Second, it is going to be the night when Filipinos in Montreal can demonstrate their support of their own television show, and third, it will be an opportunity to know your local artists and start enjoying their works. We salute our awardees Carolyn Fe, Cherylyn Toca, Maria Janice Galvez who is now known as “MIARA” of the famous show “La Voix” on TVA and Paul Baluyot who is known as a stand up comedian. Congratulations for your fine work in the entertainment field. We hope that by honoring our Filipino Canadian artists they will continue to be successful and be better known for their talent. Zenaida Ferry Kharroubi Harper Government helping internationally educated health professionals work in Canada Improving access to Federal funding for internationally health professionals quality health services for educated reaffirms the Government of Canada's Canadian families commitment to strengthening the March 13, 2015 Toronto, ON Health Canada Today, the Honourable Rona Ambrose, Minister of Health and Member of Parliament for Pickering-Scarborough, Corneliu Chisu, announced almost $8.4 million in federal funding for several initiatives that support bringing internationally educated health professionals into the Canadian health workforce so that Canadian families can have better access to quality healthcare services. Across Canada, access to health professionals continues to be a challenge. Approximately 4.6 million Canadians are without a regular family doctor. At the same time, there are around 10,000 newcomers to Canada that are health related professionals. Many of these individuals face obstacles in finding jobs that best match their skills and experience. This support will help prepare doctors and other health professionals for the Canadian workforce. These initiatives complement the Government of Canada's wider support for improving foreign credential recognition. healthcare system by working with provinces, territories and healthcare professionals to improve access to quality care for Canadians and their families. Quick Facts Since 2006, Canada has welcomed an annual average of more than 250,000 immigrants, the highest sustained level of immigration in Canadian history. The Government of Canada is providing $8.2 million under Health Canada's Internationally Educated Health Professionals Initiative to the Government of Ontario for three initiatives supporting internationally educated health professionals and their potential employers. Canada and the United States sign historic preclearance agreement Key Beyond the Border Action Plan deliverable will further enhance crossborder flow of travellers and goods March 16, 2015 - Washington - Public Safety Canada Today, Canada’s Minister of Public Safety and Emergency Preparedness, the Honourable Steven Blaney; and U.S. Secretary of Homeland Security, Jeh Johnson, signed the Agreement on Land, Rail, Marine and Air Transport Preclearance between the Government of Canada and the Government of the United States of America. The Agreement is a major commitment of the Beyond the Border Action Plan issued by Prime Minister Harper and President Obama in December 2011. The Agreement was signed in Washington following a meeting to discuss border security. Every day, nearly 400,000 people cross the Canada–U.S. land border, along with over $2 billion in goods and services. A highly efficient border that ensures the efficient flow of legitimate goods and people is essential to this trade relationship. When it takes effect, the new Agreement will provide a legal framework that will enable the establishment of new preclearance operations in any of the four modes of transportation. It will allow the market to propose operations when and where it makes sense – facilitating trade and travel, and creating economic benefits for Canadians. Quick Facts Preclearance operations were implemented in Canada for the first time in 1952, when U.S. preclearance officers began screening travellers for U.S.-bound planes at the Toronto International Airport. A formal preclearance agreement with the U.S. did not exist at that time; Canada and the U.S. reached their first air transport preclearance agreement in 1974. Each year, roughly 11 million passengers are pre-cleared for flights to the U.S. at eight Canadian airports under the current bilateral air preclearance framework – reducing wait times for these passengers and often reducing the number of connections they required. This historic new comprehensive Agreement covers all modes of travel, including air. When it enters into force, it would replace the existing air transport Agreement, which was signed in 2001. This single Agreement would ensure a preclearance activities, regardless of the mode of transportation, making it easier to implement and govern preclearance activities in both countries. In the Beyond the Border Action Plan, in addition to negotiating a comprehensive approach to preclearance in the land, rail, marine and air modes, Canada and the U.S. committed to implementing a truck cargo pre-inspection pilot in Canada. Phase I of the pilot was implemented at the Pacific Highway crossing between British Columbia and Washington, from June to December 2013. Phase II was implemented at the Peace Bridge, between Ontario and New York, from February 2014 to January 2015. An evaluation of the pilot will be completed by July 31, 2015. In addition he has travelled to the Philippines where he performed in Manila and Quezon City. A versatile artist, Baluyot is not only a stand up comic. He used to write poems and scripts. He did a bit of acting while in Concordia University . He is also a making short films featured in Actra Short Film Festival. Maria Janice Galvez – Galvez, whose stage name is MAIARA, was born and raised in the Philippines. She has been singing most of her life, but her first professional band experience was at the age of 17. Her love and passion in music took her from Taytay, Philippines to China. Canada in 2011, she auditioned in the Quebec`s reality show, La Voix (The Voice). She was selected and coached by renowned singer-songwriter JeanPierre Bertrand. She easily won the hearts of the coaches, mentors and the viewers, carrying her through the Quarter Finals. In the same year, she was recognized by FAMAS during its 50th anniversary for promoting a positive image of Filipinos. In 2013, she began working on album with original materials with producer songwriters Jay Lefebre, Jaren Cert, Wiseman, Sebastian Lefrebre. The album was produced by Jay Lafebre, Rock Voisine, Wilfred Lebouthillier and co-produced by Wiseman. MAIARA, who sings in Tagalog, English and French, has an upcoming album, RISE, to be released this month. Cherylyn Toca – Twenty-five year old Toca, who was born and raised in Montreal, showed interest in music early in life. Her breakthrough was last fall when she was selected to sing the national anthem of the United States and Canada at the Bell Centre during the first pre-game between the Boston Bruins and Montreal Canadiens won 3-2 . Before she was selected to sing the anthems, she had to audition . About 400 auditioned for the spot but only 10 passed, including her. Pat Hickey, a Montreal Gazette reporter, said, “Cherylyn has set the standard for the nine other singers of the national anthems.” Toca, who sings in Tagalog, English, French and Italian, is moving to New York after completing her Bachelor Degree in Management at the John Molson School of Business in September. UMP was the founder andproducer of Miss Global Beauties, and was the owner of 5 beauty pageant franchises responsible for sending Canadian representatives to international competitions. However, the job was not easy. From recruitment of candidates to finding sponsors, the challenges were enormous in a country that loathes beauty pageants. Many Canadians think of beauty pageants as shallow and demeaning to women so that back in 1990, Toronto’s city council voted 10-7 to prohibit beauty contests from being held at Nathan Phillips Square. Because of this by-law, Miss Universe 2005 Natalie Glebova, was barred from attending a "Tastes of Thailand" festival in her home city over concerns of "sexual stereotyping and degradation." She was told by the Toronto officials that she would be allowed in only if she removed her Miss Universe sash and crown. If Natalie Glebova was a Filipina who had won the Miss Universe crown for the Philippines, her homecoming experience would be entirely different. She would have a throng of well-wishers and press conference during her arrival, victory parades, victory dinner parties, TV guestings, a courtesy call with the Philippine President at Malacañang, and commendations from the Senate and the House of Representatives. So why do Filipinos love beauty pageants? Why do we take it seriously? I asked some of the top Filipino pageant experts and writers on their opinion. Joyce Burton Titular – “For me it’s tied to the Fiesta culture that we have. We love to party,we love to celebrate! And we love beautiful women and celebrate them. Pageants are like a marriage of our Fiesta culture with our love for gorgeous women. At the same time, I have to admit that we have high expectations of our beauty queens. They have to be smart and good examples. When they are not, then we love to criticize them. That I believe is another reason why we love pageants. We have free reign to 'make pintas' the contestants and winners. Pinoys are notorious for being 'pintaseros' and enjoy critiquing a whole lot. It may be funny to other cultures but when you start talking about beauty queens in a roomful of Filipinos, the mood changes. Everyone sits forward in their seats, pulses quicken, and the exchange of comments never ends. In general, Pinoys love and respect their beauty queens and find pride in them. Just my thoughts.” Felix Manuel – “The Filipinos high regard for women dates as far back as the pre-Spanish Era Explorers have documented that women were given a special place in society. I believe that the first beauty pageant in the country started in 1908. It became a venue wherein Filipinos can celebrate the beauty and charm of its women. From then up to now, these pageants serve as venues where extraordinary women, representing their regions/ towns/barangays, etc., become national celebrities and role models, thus elevating not only their status, but their hometowns. If they make it internationally, the whole nation takes pride in their victories.” Norman Tinio – “Filipinos are a very patriotic lot. Be it in sports, singing, dancing or pageantry. We love cheering for the representatives carrying the name of the country abroad or even in those hosted in our own backyard. In terms of beauty contests, the level of interest varies depending on the specific sector of society watching or following the same. But where it matters most, the numbers are large enough to make influential steps via social media, online voting and the like. Successful efforts, like making a Philippine contestant win in popularity or fast-track events, further fuel the drive of faithful fans to exceed their previous best. Overall, beauty contest victories are treated like the elusive Olympic Gold Medal that the Philippines has never been able to claim. So the #1 placement in the majors such as Miss Universe, Miss World, Miss International and Miss Earth are tantamount to getting more than our fair share of the same.” Noli Berioso – “Pinoy’s fascination on beauty pageants can be traceable way back at the time of our great Grand-parents. It’s part of our culture and tradition. Beauty contest is also a way of giving honor and pride to Norman Tinio Coco Alinsug Felix Manuel Noli Berioso Raymond Golez our fellow Pinay. Before, we do this contest during town fiestas to honor the most beautiful. But in the recent decades, we began to conduct our national search to select our representative to compete internationally. We are blessed with so many beautiful Filipinas and we can't help but to admire, love and respect them through beauty pageants. That is probably one of the reasons why we arebeing tagged as one of the pageant crazy countries in the world.” Coco Alinsug – “Beauty contests are everywhere in the Philippines, from beauty pageants for kids, to gay beauty pageants, schools, offices, to every corner of major islands in the Philip-pines. Ibeauty pageants have become a national pastime like boxing, basketball, zumba and cockfights. The reason why it's popular boils down to the economic situation of the country. Filipinos love anything beautiful as our way to cover what is bad in the country. We are a third world country, we have few things to be proud of internationally (sad to say), we hardly have any world class athletes, and we could not even compete with our neighboring Southeast Asian countries as far as sports is concerned. But we have something that they don't have - beautiful women and passionate and supportive populace. Filipinos found a way to highlight what we have and we found that formula of looking at beauty pageants as our way to compete internationally.” Raymond Golez – “As the only country to hold titles in the top 5 international beauty competitions, it is safe to say the Philippines excel at the game of pageantry. The country fancies on its queens and ties pride for the Philippines to each crown. In online social media, we witness flare-ups of excitement when Ms. Philippines wins, and outpourings of ire when Ms. Philippines leaves empty handed. It was pretty shocking as I recall. Can you summarize what we’re dealing with here? -- Mitchell Baldwin, Boise, ID Coal combustion plants account for more than half of Americans’ electric power generation. According to Coal's Assault on Human Health, a report by the non-profit Physicians for Social Responsibility (PSR), coal combustion releases mercury, nitrogen oxides, sulfur dioxide and other substances known to be hazardous to human health. The report evaluates the impacts of coal pollution on our respiratory, cardiovascular and nervous systems and concludes that air pollutants produced by coal combustion contribute to asthma, lung cancer, congestive heart failure and strokes. “The findings of this report are clear: While the U.S. relies heavily on coal for its energy needs, the consequences of that reliance for our health are grave,” says Alan Lockwood, a principal author of the report and a professor of neurology at the University at Buffalo. The PSR report further illustrates the adverse effects of the mining of coal on the environment, water and human health. Coal mining March 2015 “Coal ash is a silent killer,” says Barbara Gottlieb, director of environment and health at PSR. “Communities are drinking contaminated water laced with toxic chemicals that poison humans.” According to the U.S. Department of Energy, coal plants can reduce sulfur oxide, nitrogen oxide and greenhouse-gas emissions by using biomass as a supplemental fuel in existing coal boilers. A Union of Concerned Scientists (UCS) report says that tree limbs and tops normally left behind after timber harvesting operations, and otherwise unmarketable materials like dead, damaged and small-diameter trees, can be collected for biomass energy use. Income from selling biomass can pay for or partially offset the cost of forest management treatments needed to remove invasive species or reduce the threat of fires. Utilities like New Hampshire’s Northern Wood Power are taking a lead in putting biomass energy to work in their power plants. In 2006, the company replaced a 50-megawatt coal-burning boiler in Portsmouth with one that uses wood chips and other wood materials for fuel. The result has been a reduction in coal use by more than 130,000 tons annually, reduced air emissions by more than 400,000 tons annually and the development of a thriving wood chip market for New Hampshire’s forest industry. Some are specialty tools that are only used occasionally, others travel to every shoot but rarely leave the camera bag. Some mics, however, are the go-to, grab-it-every-time, couldn’t-livewithout-it kind of tool that everyone who makes media ought to own. Audio is an incredibly powerful part of your productions. It has the power to make or break a program. Imperfect video will be remembered as better than it really is if the soundtrack is stellar. I don’t know why this is true, but it is. Because of this, one of the best ways to improve the perceived quality of your edits is to improve your audio. That means choosing and using the right microphone. If you can afford a whole host of them, fill your gear bag to the brim and use whichever mic makes the most sense on the set. Here’s a quick overview of your options along with my ratings and recommendations: The Built-In Mic Pros: The microphone that is built into your camcorder is always present, it cannot be lost or left behind, it doesn’t require extra batteries, and the element itself is generally of a pretty good qualityCons: The secret to recording good audio with any type of microphone is getting the mic as close to the subject as possible, usually within a couple inches of the sound source you want to record. Because the built-in mic is stuck on your camera, you can’t get it close enough to record good sound and still frame a usable > > > > > > > shot. The on-board mic also has the terrible tendency to pick up operator noi microphone mounted on a camera shoe. Shotgun mics are arguably at their best when they are mounted on boom poles that are held over the subject’s head just outside the frame. This allows all the benefits of proximity, while still concealing the microphone from view. Cons: The highly directional aspect of a shotgun microphone requires that it be aimed fairly accurately at the subject you want to record, so you need to monitor your audio carefully. An inattentive boom operator can easily let the mike drift or turn in a way that causes the talent’s voice to fall out of the mike’s sweet spot. The mic needs to move with the subject to maintain the best possible signal. Summary: Shotgun mics are outstanding tools for production, but they are cumbersome and require an extra set of qualified hands to operate. Add the wine slowly - it should give a little sizzle and get all the browned bits off the bottom. Add the lentils, potatoes, and broth. Tie the bay leaf, parsley, and thyme together and toss in the pot (the reason for tying is so you can easily remove them at the end - I actually wrapped mine up in a stalk of celery so it would be contained a bit better). Simmer for 30-45 minutes, stirring occasionally, adding more broth as necessary so the lentils are just barely covered in liquid. When the lentils and potatoes are soft, gently mash the potatoes against the side of the pot with the back of the wooden spoon to make the mixture creamy. PerryScope By Perry Diaz Aquino-Resign-MovementIn the aftermath of the Mamasapano Massacre, a groundswell is rising for the resignation of President Benigno “P-Noy” Aquino III. This is reminiscent of the time leading to the uprising in 2001 when a citizens’ movement snowballed into another people power revolution, which came to fruition when the generals of the Armed Forces of the Philippines withdrew their support for then President Joseph “Erap” Estrada. Known as “EDSA Dos,” it was a coup d’état disguised as a people power revolution, which many believed was orchestrated by an elite group who wanted Erap’s vice president, Gloria Macapagal Arroyo, to take over the presidency. Indeed, if EDSA Dos was considered a “revolution,” then it was a revolution of the elite – the oligarchs of the land. And true enough; as soon as Gloria took over, the oligarchs placed their people in key government positions. Indeed, EDSA Dos was all about power. Gloria’s usurpation of the presidency in January 2001 positioned her to run for president in 2004, which gave her the “power of the incumbent.” Elected amidst charges of election cheating, Gloria was in power for nine and a half years, which made her the longest serving president since 1986, when EDSA 1 deposed the dictator Ferdinand E. Marcos. As we all know now, Gloria’s reign was the most corrupt since the time of Marcos. People power A q u i n o - R e s i g n Movement.2Although the Resign Movement was gaining momentum, it didn’t reach a critical mass that could have ignited another people power revolution. And after three people power revolutions – EDSA 3 was a failed attempt to bring Erap back to power after Gloria was sworn into office – the people are now tired of “people power” revolutions. So what we’re seeing now is a different tact to bring down the president: the use of the media. Then there is the problem of convincing the international community – particularly the U.S. – that it was not a military takeover. But that would be hard to sell. Anything that comes close to a military coup d’état could compel the U.S. to withhold financial and military aid to the country. It’s becoming apparent that forcing PNoy to resign and replace him with a junta wouldn’t dwell too well with the Filipino people, many of whom have horrendous memories of the Marcos dictatorship. Leaderless and rudderless, the Resign Movement is beginning to show cracks on its façade. The challenge facing the nation is to find an honest and incorruptible leader. There are a few elected men and women who have excelled in the performance of their electoral mandates. Anyone of them could be a better president than Binay. But can they beat Binay who has been campaigning for president since he was elected vice president in 2010? It may have been emotionally draining and costly for Fil-Am Brad Go to embark on a journey around the world interviewing couples and writing tunes. But his ambitious idea paid-off as he was able to produce an album that gave him the break towards a mainstream recording career. Through MCA Music, the singer-songwriter recently released his nine-song pop rock debut album called The HUSH Project, the HUSH being an acronym for “Have U Seen Her” which is the title of the blog he created chronicling an affair that inspired him to travel to select cities and talk to people about love. He shares, “One rainy New York night in September 2012, I met a girl. She didn’t have an umbrella so I offered to share mine. We eventually started dating and although it didn’t work out, I was inspired to travel around the world in search of credible stories to use as inspiration for my album.” The umbrella moment seems like an image straight out of The Hollies’ iconic piece Bus Stop. The New Yorker went to Barcelona (Spain), Melbourne (Australia), Singapore, Palermo (Italy), Berlin (Germany), Paris (France), Manila (Philippines) and Tokyo (Japan) where he met an interracial couple and whose story inspired him to write I Want You Now — the album’s carrier single. For the Manila trip, Brad visited his family’s hometown and interviewed the only grandparent he has left. The latter spoke about her devotion to his grandfather and how different romantic relationships were back in 1950s Philippines. Also working as a freelance video editor and director, the multifaceted act decided to try his luck here and formally launch his album, performing along with two former members of veteran pop band True Faith (Ferdie Marquez and Bimbo Yance) during an afternoon press gathering in Quezon City. He found his travels life- changing, with each trip giving birth to a new song. “On top of the excitement of being in a new place, there was the thrill of trying to find a person receptive to the project and willing to share their story. Those interviews really offered me a chance to share some truly happy moments with people,” he recalls. With the addition of bonus track Carry You Home, the other seven songs in The HUSH Project are All Along, It’s You, Follow Through, Firestarter, Feel This Way, Love Is Love and Time Machine. MCA clearly recognized Brad’s talent as it commissioned him to write a song for rising star Darren Espanto. For that challenge he came out with Makin’ Moves which appears on the latter’s self-titled album. “I’m excited to promote the album in the Philippines and abroad. I’m also excited to start writing my next album and further develop my catalog as a songwriter for other artists as well,” he relates. Brad just did a series of gigs and radio guestings in Metro Manila — a privilege for Manileños who witnessed an artist who has already played clubs in downtown New York. Confidence and emotions come abound through him on stage, and his laudable effort at translating some English lyrics to Tagalog only added extra flavor to his classy act. MCA A&R manager Francis Guevarra, who happens to be an exTrue Faith member, too, offers his observation as to Brad’s strengths: “He is a very marketable artist. We are looking forward to helping him cultivate and grow his personal brand as a musician and songwriter. First, there is the initial drafting of a quality PCT patent application that will serve as the basis for what will subsequently filed in all desired countries. Conservatively, budget US$20,000 to US$75,000 for drafting and filing of the PCT patent application. This should include costs for a prior art search and analysis and a draftsman for the drawings. Second, applicants have up to 31 months (depending on the country) from their first, original filing to decide in which countries to enter the ‘National Stage’, which is often around US$5,000 per country (plus translation costs where needed). This is because patent protection is country-specific. There is no such thing as an international patent. Third, in any given country, prosecution of the patent application (the process of taking a filed application through issuance, which is never guaranteed) can take a variable amount of time and money— US$20,000 to US$30,000 or more— depending on the difficulty encountered. The time frame ranges typically from two to five years— sometimes more—from when the The North American Filipino Star patent application enters the National Stage of a particular country to when the patent application is prosecuted. Finally, you also have to be aware of payment of maintenance fees, which vary by country. Some countries require annual payments even before the patent issues, some require payments after the patent issues, and others require payment over some other schedule. Enforcement costs of a patent can vary widely, as something as a simple cease-anddesist letter, licensing agreement, or a cross-licensing agreement with a competitor (involving their patents as well) can resolve enforcement issues for as little as a few thousand dollars. Few patents are ever litigated, but for those that are, the costs can run into the millions. For trademarks and copyrights, the costs and time commitment are typically a fraction of those required for patents. Q3: In what kinds of international situations is it better to file a patent vs. keeping IP as a trade secret? Some assets, despite their high value (e.g., customer lists) are not patentable, thus making trade secret protection the obvious decision. For those assets that are patent-eligible subject matter (i.e., process, machine, composition of matter, and article of manufacture), there are several considerations that should be examined in consultation with a patent attorney. First is duration. Patents are of a limited duration (by international treaty, about 20 years from filing) in all countries, whereas a trade secret can retain its status until it is revealed, which may never happen. Thus, if long-term protection is desired beyond the term afforded by a patent, then a trade secret may be best. A great example of this is the formula for Coca Cola from 1886, which is still protected as a trade secret. Second is susceptibility to Reverse-Engineering. A patent must disclose sufficient details to allow others to make and use the invention once the patent expires. By contrast, a trade secret loses its value if competitors can reverse-engineer it, which can leave the trade secret owner without recourse. Generally, the more susceptible something is to reverseengineering, the less it would be a viable trade secret. In addition, if your process involves a combination of elements, some of which are easier to reverse engineer than others, it may be possible to patent those portions of the process that are easier to reverse 19 engineer while maintaining confidentiality on those parts that you can keep secret. Third, if the trade secret is reverse engineered, this can open up the possibility of competitors filing patents on the trade secret. Some countries recognize a prior-use defense, and this scenario could also raise inventorship issues. Nevertheless, having a competitor file a patent on one’s own trade secret is a nightmare, and can be avoided by pursuing patents instead of trade secret protection at the outset. Fourth, it may be possible to obtain a patent on something that is currently a trade secret, thus giving up trade secret status. Conversely, a patented invention cannot later become a trade secret. Fifth, if you have already missed the deadline to allow you to file a patent application on your invention, you may have no choice but to try to keep it as a trade secret.
