Rearing Field Housing The Game Bird Engineering Brooder Galvanised Steel Framed Insulated Brooder Huts The Rearing Units are made from 40mm box steel hot dipped galvanised with plastic steel sheets inside and out and insulated in between. The roof is also similarly insulated with a white box profile lining sheet, insulation and then a box profile roof sheet. These are joined on either end to a 3.8m by 3.8m shelter pen, clad in plastic and with a box profile roof. Each insulated rearing unit is 7.6m by 3.8m with a central plastic mesh divider. All units have integrated lifting eyes to move them, and the brooder unit unly weighs 1050kg. A simple rig of spreader beam with three drop chains and hooks can be attached in a few seconds, making it a truly portable system. They can be placed on a trailer and transported between fields. Patrick Pinker (Game Farm) accepts no liability for any damage or loss arising from: (a) delay or failure to deliver stock or goods for any reason whatsoever. (b) the incorrect or improper use of any goods or equipment supplied by it. Where the purchaser is supplied with operating instructions and in particular instructions for the use of incubators, the Sellers recommended procedures and practices must be followed and failure to follow such instructions by the purchaser shall be deemed to be an incorrect or improper use. 4. Goods represented by the buyer to be defective shall not form the subject of any claim for work done by the buyer or for any loss, damage or expense whatsoever arising directly or indirectly from such defects, but such goods, if returned to the Company and accepted by it as defective, will be at the request of the buyer and if practical be replaced as originally ordered. Defects in quality or dimensions in any delivery shall not be a ground for cancellation of the remainder of the order of contract. 5. The property in the goods shall pass to the Buyer and the purchase price shall become due and owing at the time of despatch to the Buyer and all goods are despatched at the Buyer’s risk and the Seller shall not in any circumstances be held liable for any loss or damage to the goods after the same have been despatched. 6. If the place of delivery is a Railway Station the Buyer shall at his own expense and risk make proper provision for collection therefrom. 7. Notwithstanding the passing of the risk in the goods until full payment has been received by the Seller, for all the goods whatsoever supplied at the time by the Seller to the Purchaser, the property of the goods remains in the Seller. The Seller may without prejudice to it’s other rights and remedies recover and/or resell the goods and may come upon the Purchaser’s premises at any time without notice to respossess the goods without any liability. If the Seller ceases to carry on its business or a substantial part thereof or if any distress or execution is levied on any part of the Purchaser’s property or if the Purchaser makes or offers to make arrangements or composition with creditors or commits any act of bankruptcy or if any resolution or petition to wind up the Purchaser’s business is presented or passed or a Receiver is appointed of the Purchaser’s undertaking property or assets or any material part thereof. 8. Whilst every effort is made to ensure that the quality of any bird delivered is as ordered, the Seller shall not be liable for any defect in the quality of any such bird nor does the Seller warrant that the birds delivered shall be free from disease. 9. An additional charge may be made for packing and carriage on all orders. 10. 2% of the total ordered is added free of charge by the Seller on all orders for day old chicks. 11. Where the subject of the contract includes hatching eggs the Seller shall not be responsible if all or any of the same fail to hatch but without prejudice to this 5% of the total order is added to all orders for eggs. 12. In the event of the Buyer setting the eggs or causing the eggs to be set in an incubator this is done entirely at his own risk. EQUIPMENT: 13. No express or implied conditions, statement or warranty whether statutory or otherwise is given or intended to be given as to the suitability of the equipment for any particular purpose and no liability is accepted by the Seller for any loss, damage or injury caused whether directly or indirectly by the use of the equipment. 14.
