A packed auditorium was on hand to celebrate SAR’s achievements and champions of 2006 and to launch the Association’s 99th
year with a bang.
Tracey Saizan’s son Chris Saizan set things in motion, leading the Pledge of Allegiance. Master of Ceremonies Dave Howe
took over by thanking the luncheon’s sponsors, Realty World and
Chicago Title.
Dave followed with the introduction of the very special guests
from MetroList, Yolo Board of REALTORS®, Placer County
Association of REALTORS®, Lodi Association of REALTORS®
and the 11 SAR Past Presidents in attendance: Chuck Manly

The ceremony hit its full stride when incoming President Tracey
Saizan took the podium to honor and thank the Associations’

Down the home stretch, Immediate Past President Leigh
Rutledge had the honor of presenting the Association’s 2006
Service Awards in various categories to individuals for extraordinary efforts to improve the programs and services of SAR.

SAR MISSION STATEMENT
The purpose of the Sacramento Association
of REALTORS® is to enhance the ability
of its Members to practice their profession
ethically and effectively through ongoing
training and accountability.
Keeping Our Profession Strong and Vigilant
February marks the final month of our annual political action
fundraising campaign. I’m very pleased to report that of 115
REALTOR® associations in California, SAR ranked eighth statewide in total 2006 Member investment, with just over $150,000
invested. In that same positive vein, your collective contributions
to the 2007 REALTOR® Action Fund through the dues renewal
process also have some newsworthy highlights. As of mid-January,
over 60% of membership renewals included a contribution to the
REALTOR® Action Fund. Contributions at the “True Cost of Doing
Business” level of $197 were up 62% over last year. That’s with
only about a quarter of our Member renewals tallied!
To those of you who contributed for the first time or increased
your annual contribution in 2007, I applaud you and offer my heartfelt appreciation. For those who have not yet contributed, I would
like to take this one final opportunity to remind you of the extremely
important political work and legal protection that the REALTOR®
Action Fund affords. Here are just a few examples of the very real
political challenges facing Members today:
•
Unnecessary New Fees and Taxes on Real Estate – Elected
and appointed officials in seven cities and the County are constantly seeking new revenue. SAR must be vigilant on fees and
taxes that unfairly burden REALTORS® and property owners.
An unnecessary Sacramento rental inspection fee is just one
we challenged successfully in 2006.
•
Privately negotiated transfer taxes and conveyance fees – New
home developers are hiding fees of up to 1.5%, deep in deed
restrictions, to be levied on future resales. SAR has led the
statewide fight to disclose, restrict or eliminate such fees.

More disclosure liability and costly point-of-sale ordinances
– SAR was instrumental in removing a costly point-of-sale
fireplace retrofit provision from new residential air pollution
control rules approved for Sacramento in September 2006.
The retrofit mandate could be back on the table as soon as this
year.
Support for and access to local elected officials -- the PAC
Trustee Committee interviewed 28 candidates for local public
office prior to the June and November elections in 2006, and
made strategic contributions
in support of a number of
these candidates who will be
influential in future issues
affecting your business.

Here are a few more statistical tidbits that help put our
Association’s REALTOR® Action Fund participation into perspective. While we ranked eighth statewide in total investments, we
are the sixth-largest association in California, so our percentage of
Member participation for 2006 was much further down the ranking
list, at 66th out of 115 associations. This is surely below the median.
Our ranking in average amount invested, spread over the entire
membership, was only 96th out of 115. Our numbers in amount
invested per contributor was no better, at 108th, with an average
contribution of about $53.
What do these figures tell us about ourselves? To me they say
that, collectively, we did a very good job of supporting our SAR
political action program last year. We can, however, do better than
that in 2007 and in the years to come. Even with the correction in
the real estate market, we all need to dig a little deeper to protect the
long term health of the real estate industry.
If you haven’t done so this year, please take a moment to set
aside that small $3.80 a week. Write a check and contribute to the
REALTOR® Action Fund, or increase your contribution.

Advertising Q and A
We frequently get
questions at the SAR
office concerning advertising. It is a
complicated issue, governed by federal
and state law, MetroList and the Code of
Ethics.
Following are excerpts from the California
Association’s legal department to give you
some guidance…
REALTORS® have both a legal and
ethical obligation to be truthful when
advertising property or services. Legally,
licensees may be held liable for fraud,
intentional misrepresentation, or negligent
misrepresentation if they make material
false statements or material omissions
in any medium of advertising. [Cal. Bus.
& Prof. Code § 17500.] In addition,
licensees may face discipline from
the DRE. [Cal. Bus. & Prof. Code §
10177(c)]. Furthermore, licensees
who place listings in a Multiple Listing
Service in expectation of compensation
are responsible for the truth of all
representations in such listings which the
licensees had knowledge or reasonably
should had have knowledge of to anyone
injured by their falseness or inaccuracy.
Similarly, REALTORS® have an ethical
duty under the NAR Code of Ethics to
avoid false advertising. For example,
Article 12 states, “REALTOR® shall
be careful at all times to present a
true picture in their advertising and
representations to the public. . . .”
Additionally, most Multiple Listing Service
(MLS) rules incorporate the provisions of
Article 12, so MLS-only participants are
also bound by its provisions.
Q Are there any guidelines or
descriptions of what is prohibited false or
misleading advertising?
A Here are a few general guidelines:
• Avoid any advertising in which the
advertisement can be interpreted a
number of different ways. In other
words, if a licensee is not willing to
stand behind or live with all possible
interpretations, he/she should not use
the ad.
• Avoid "half truths" or inflated claims.
Courts have consistently held that
half truths are equivalent to lies, and
licensees should be prepared to defend
in court any claim made in their
advertising.
• Licensees should set forth clearly any
limitations intended to be imposed
on offers made in their advertising.
For example, if a licensee advertises
a $500 rebate to the seller for listing
with the licensee, but intends to pay
the full $500 only if the licensee also
represents the buyer in the transaction,
this limitation must be specified in the
advertisement.
Q Has the DRE provided any specific
examples, such as case studies, of false or
misleading advertising?
A Yes. For example, in one edition of the
DRE Bulletin, the Department described
a case where a brokerage company
advertised that it sold $500,000 worth of
property, when in fact the value of the
property had only been $250,000. The
reason the firm had arrived at the figure
of $500,000 was that it had employed
both the listing and selling agents in
the transaction and claimed that it was
standard practice to count both the listing
and selling ends of the transaction. The
Department held this to be a false and
misleading advertisement because, while
it may be common practice for both the
listing and selling agents to count the sale
toward their volume, that would be true
only if those agents were from separate
companies.
Q Are there any limitations on
advertising offers of prizes or gifts, when
the advertiser intends to offer a sales
presentation as well?
A The only requirement is that the intent
to offer such sales presentation be clearly
and unequivocally made along with the
mention of the prize or gift (NAR Code of
Ethics Standard of Practice 12-3).
Q May a real estate licensee who is
soliciting potential buyers advertise a
property that he/she does not have listed?
A Not without permission. A
REALTOR® may not advertise property
without authority. NAR Code of Ethics
Standard of Practice 12-4. That means, a
REALTOR® may not advertise a property
that he/she does not have listed unless
the owner gives his/her permission. It is
highly recommended that this permission
be in writing.

Misrepresentation of Membership
Misrepresentation of Membership provides that the California Department of Real
Estate (DRE) may revoke, suspend or deny a license to anyone who knowingly authorized, directed, connived at or aided in the publication of any material false statement
or representation concerning his or her designation or certification of special education;
credential; or membership in a trade organization. If a licensee puts the REALTOR® “R”
on their card when they do not belong to NAR, falsely state they are a CRS when they
have not earned the designation or paid the renewal fee, or claiming to be a Member of
Masters Club when they are not currently a Member, and they could lose their license.

To receive the Lifetime Service Award,
the recipient must have been a Member of
SAR for at least 15 years and a Member
of NAR for at least 20 years at the time of
selection. The recipient must have actively
contributed to SAR for at least ten of those
years and be a current Member of SAR.
The 2006 Lifetime Service Award was
presented to Geoff Zimmerman, founding Member of the Masters Club and a 30
year SAR Member. She has been a C.A.R.

In the event of contractual disputes or
specific non-contractual disputes as
defined in Standards of Practice 174 between REALTORS® (principals)
associated with different firms, arising
out of their relationship as REALTORS®,
the REALTORS® shall submit the dispute
to arbitration in accordance with the
regulations of their Board or Boards rather
than litigate the matter.
In the event clients of REALTORS®
wish to arbitrate contractual disputes
arising out of real estate transactions,
REALTORS® shall arbitrate those disputes
in accordance with the regulations of their
Board, provided the clients agree to be
bound by the decision.

to all REALTORS® and REALTORASSOCIATE S® by the Board to avoid

the case presented. The Hearing Panel
disallowed the request by REALTOR® A
that he be awarded attorney’s fees or other
administrative expenses.

The obligation to participate in arbitration
contemplated by this Article includes the
obligation of REALTORS® (principals) to
cause their firms to arbitrate and be bound
by any award.
CASE INTERPRETATION: Case #176: Request for Arbitration Expenses
(Reaffirmed Case #14-11 May, 1988.
Transferred to Article 17 November 1994.)
REALTOR® A, the listing broker, and
REALTOR® B, a cooperating broker,
engaged in a heated dispute as to which
REALTOR® was the procuring cause
of a sale and, therefore, entitled to the
commission. Finding that they could not
resolve the matter themselves, they agreed
to arbitrate in accordance with Article 17
of the Code of Ethics.
REALTOR® A initiated the request for
arbitration with a letter to the Board; the
letter was received and reviewed by the
Grievance Committee which agreed that
it was an arbitratable matter. The case
was sent on to the Professional Standards
Committee for a hearing.
The President of the Board, consistent with
the Board’s Code of Ethics and Arbitration
Manual, appointed a five-member Hearing
Panel to hear the case. The proper forms
agreeing to the arbitration were sent
to both REALTORS®, each signed his
agreement and returned it to the Secretary.
Prior to the date set for the hearing,
REALTOR® A learned that REALTOR®
B had practiced law before he entered
the real estate business. REALTOR®
A then decided that he would be at a
disadvantage in presenting his case to the
Hearing Panel without an attorney due
to the legal background of REALTOR®
B. REALTOR® A sent in an amended
arbitration request in which he asked
that he be awarded the commission
and attorney’s fees and any other
administrative expenses that he might incur
in the presentation of his case before the
Hearing Panel. The Chairperson accepted
the amended complaint as part of the case
and mailed REALTOR® B a copy.
The case was set and a hearing was held
at which REALTOR® A appeared with his
attorney and a court reporter. REALTOR®
B acted as his own attorney. The Hearing
Panel had the Board’s attorney and a
secretary with a tape recorder present.
After giving both parties the opportunity
to present their case, the Hearing Panel
