Activities are planned to honor the 100 years of the union’s rich and varied history and to celebrate the workers, both men and women, who have labored within this organization to help make Southeast Texas a leader in construction and maintenance of electrical concerns. “We are indeed excited about the 100th year celebration of our local union,” said Mark Stanton, executive presi- dent of the board of directors for International Brotherhood of IBEW Local Union No. 479. “According to the charter for our organization, IBEW Local Union No. 479 was chartered on March 26, 1913, here in Beaumont, Texas. The names of the charter members are listed on the document, and we are proud of our long and trusted heritage.” According to IBEW docu m e n t s , Local No. 479 was founded to help improve the working conditions of electrical workers in Southeast Texas and to help create higher standards of living for their family members. The charter Stanton referred to is a bit battered and faded. Water spots can clearly be seen on the parchment. It has survived several hurricanes and other storms that have hit the area, but it is a prized and revered document at the union hall. According to organizers, unions are, in general, about a very simple proposition. When workers in any industry or business join together, the men and women gain strength in numbers so that they may have a stronger voice at work concerning the matters that concern them most. The group representatives are able to negotiate a contract with their employer for a fair and safe workplace, better wages, a secure retirement, and familyfriendly policies including sick leave and scheduling hours. Family members of the union employee are always at the forefront of consideration and many of the planned activities for this important celebration center around the entire group. In fact, the IBEW literally takes to heart IBEW Page 2 C Page 12 C Dedicated to Southeast Texas AUTOMOTIVE REVIEW Page 4 C Comfortable utility of 2013 Dodge Durango 2C LIVING THE EXAMINER • March 14-20, 2013 IBEW from page 1 C the “brotherhood” of the group, and many testify to the fact that the workers and their spouses and children become family. Although union activity has been on the decline in some areas, organizers say that the group is always adapting to the challenges of the nation’s evolving workforce, and that local unions are meeting the needs of workers in today’s more flexible and nontraditional work environments. Union members believe that no matter what type of job an employee is in, he or she is best served by being represented by the local union. The representatives are trained to be aware of all legislation, safety measures, and the proper treatment of all employees. Their goals are to speak out for fairness for all working people in their communities and help to create better standards and a strong middle class across our great country. IBEW Local Union No. 479 is proud of its rich history and the work its members have done in Southeast Texas. Workers point to the many jobs they have completed in the 100 years of operation in the area that are woven into the colorful fabric of the exciting lives in the unique communities that make up this region of The Lone Star State. Some of the sites that readily come to mind are: • Lamar University’s Montagne Center • Refineries • Parkdale and Central malls • Edison Plaza • Crockett Street Entertainment District • Texas State Optical Stores • Beaumont Civic Center • Libraries, schools, and other businesses Local Union No. 479 also provides a credit union for its members and friends to utilize, monthly activities for all retirees and their spouses, much needed insurance, the all important continuing education of its members, classroom training, and a dedicated apprenticeship program that works to provide well-trained and trusted electricians. The members are also ready to face storm duty and recovery efforts on the front lines when natural disasters strike. Fellowship, parties, celebrations and strong friendships that stand the test of time are also attributed to the union membership. The IBEW has members in both the United States and Canada and continues to stand out in the AFL-CIO. Stanton added, “Reflecting on our vast heritage, we come to realize once again how the lives of our union members, and their families, are intertwined into the very history of Southeast Texas.” In a greeting to union members and retirees, Stanton said, “Many buildings, institutions, and places of interest bear the mark of IBEW Local Union electricians’ work. But the news isn’t good for all taxpayers. Some upper-income investors will have to pay a higher tax than other individuals. Background: Under prior law, investors were taxed at a maximum 15% rate on long-term capital gains and qualified dividends, reduced to 0% for taxpayers in the two lowest 10% and 15% ordinary income tax brackets. These tax breaks, which had been extended several times, were set to “sunset” after 2012. At that point, the maximum tax rate for long-term capital gains would have increased to JANA URIBE, CPA, IS A PARTNER AT 20%, or 10% for the lower-income POLLANS & COHEN P.C. taxpayers, while qualified dividends would have been taxed at ordinary income rates as high as 39.6%. Now ATRA permanently preserves the lower maximum rates for most investors. However, for single filers with taxable income above $400,000 and joint filers with taxable income above $450,000, the maximum rate for long-term gains and qualified dividends jumps to 20%, beginning in 2013. The other tax rules for capital gains and dividends continue to apply. For instance, you must hold assets for longer than one year to qualify for a long-term gain on a sale, while capital gains and losses are still “netted” at the end of the year. The definition of “qualified dividends” still covers most dividends paid by domestic corporations when you’ve held the stock more than 60 days during the 121-day period beginning 60 days before the ex-dividend date. Summary: Another key tax factor might influence upperincome investors in 2013. A new 3.8% Medicare surtax may apply to a portion of net investment income. Consider all the tax implications as you make investment decisions this year. & POLLANS COHEN, P.C. Certified Public Accountants 470 Orleans Street • Beaumont, TX 77701 (409) 832-7400 Back Again - Phone Scammers Want to Hijack Your Computer by Ira Wilsker Early last year, I wrote a column here warning that telephone scammers, claiming to be from Microsoft, were calling local people, informing them that their computers were infected with malware. The rip-off had seemed to be somewhat dormant for several months, with only occasional inquiries from people asking about a phone call from Microsoft, Norton-Symantec, McAfee, or their ISP alleging that their computers were infected, and that for a fee and with remote access, they could repair the computer. During a few week period in late 2011, I heard from many people that they had received such calls, but for the last 15 months, I only received an occasional inquiry. Now, in just the last few days, I have received several such calls and emails indicating that either by plan or coincidence, local computer users are again receiving those calls in quantity. Last Friday evening, I received a frantic like it was a foreign call. Knowing what would be coming next, I asked him if his virus scan would remove the viruses for me. Very politely he responded no, that this was just a virus scan, but for a "nominal fee" he could remove any viruses that he found from my computer. A follow up inquiry disclosed that this "nominal fee" was $69.95 charged to a credit card number that I would give him over the phone. I told him "no thanks", but before I could hang up the phone, he pleaded with me to trust him, and allow him remote access to my computer. With a stern "NO!", I hung up the phone. This was not just some isolated or random event; in the past few days another coworker received a series of similar phone calls in his office from a very persistent caller who would not take "no" for an answer. Shortly after hanging up on him, he called back again, with the same response. A few minutes later, he called back very angry, demanding remote access to his work computer, which was duly refused. Moments later, someone claiming to be a "supervisor" demanded access "right now" to his computer; he called me over to talk to the scammer. The "supervisor" said that he was with Microsoft in India, and that it was mandatory that I give him remote access to this computer immediately. My curt refusal was met with a somewhat threatening reply that I would be in trouble for refusing him remote access to this computer, and that I would regret it. According to those that have fallen victim to this crude scam, the repeated scenario is the crook asks the victim to allow him remote access to the victim's computer by clicking on some Windows’ commands, allowing the crook complete remote access and control of the computer. Once the crook has control of the victim's computer, he regretfully informs the victim that his computer is heavily infested with malware, and that for a fee, typically $69.95 (but it may vary greatly), he can clean the computer and return control to the victim. Next, perform a complete security scan of your computer using security scanners other than the security software already installed on your computer. Since your current security scanner and protective software may have been neutralized by the cyber crook, perform a scan with one of the major third party security scanners; my personal favorites are the free versions of SuperAntiSpyware (superantispyware. com) and MalwareBytes (malwarebytes.org). Once your computer has been satisfactorily cleaned of any malware that the scammer may have installed, it may be necessary to reinstall your security software. Change the password that you use to logon to your computer, and any other passwords that you use to access your email, financial accounts (including banks and credit cards, as well as such services as PayPal), online retailers (including eBay), and any other passwords that you may have used. The women must be prepared to endure men hovering closely to read the ads. (2) According to news reports in November, New York City physician Jack Berdy was doing a brisk business administering Botox injections (at up to $800) to poker players who were hoping to prevent facial expressions that might tip their hands. • Ingenious: (1) London’s The Independent reported in January that Dean Kamen (who famously invented the Segway, a standing, battery-powered scooter) had developed, along with a Pennsylvania medical team, what appears to work as a “reverse feeding tube” that will vacuum out up to 30 percent of any food in the stomach before it is digested and converted into calories. After installation of the stomach “port,” the diner could operate the device without daily medical help. (2) The Polish cosmetics company Inglot announced in January a nail polish ideal for Muslim women, in that it can withstand the five-times-daily hand-washing required for prayers. (Normally, devout women wear nail polish only during their menstrual periods, when the hand-washing is not required, but polish thus signals menstruation and therefore embarrasses modest women.) Making Outsourcing Work for You For solutions, see page 13 C A Verizon risk team, looking for data breaches on a client’s computers, discovered that one company software developer was basically idle for many months, yet remained productive — because he had outsourced his projects to a Chinese software developer who would do all the work and send it back. The employee earned several hundred thousand dollars a year, according to a January Los Angeles Times report, but paid the Chinese worker only about $50,000. The risk team eventually learned that sensitive company information was flowing to and from Chinese terminals, leading the company to suspect hackers, but that traffic was merely the U.S. employee (obviously, “ex-employee” now) sending and receiving his workload. The U.S. man showed up for work every day, but spent his time leisurely Web-surfing. Advances in Animal Research • Scientists from Sweden’s Lund University, reporting in a recent issue of Current Biology, explored the burning question of why dung beetles appear to be “dancing” on the tops of the dung balls they roll away. The answer is that the beetles need to roll their treasures away from the heap as quickly as possible (lest competitors swipe them) and that they can best maintain a straight line away by celestial navigation. To test the hypothesis, researchers actually outfitted some beetles with tiny visors to block their view of the sky, and those beetles mostly rolled their balls in irregular routes, whereas the sky-searching beetles moved in straight lines. • Intelligent Design: Japanese researchers learned recently that a species of sea slug may lose its penis after copulating, but then grow another one and use it the next time the occasion arises. Writing in the British journal Biology Letters, the scientists also found that the slugs have both male and female organs and in effect copulate with each other through a simultaneous hook-up. A final breathtaking finding of the team was that the sea slugs’ penis has the ability to remove competitors’ sperm from the female openings of its mate. Leading Economic Indicators • In January, the National Hockey League labor dispute ended and players returned to work, but as usual, some owners resumed claiming that players’ high salaries were killing them financially. The Phoenix Business Journal reported in December that the Phoenix Coyotes, for example, stood to turn a profit for the 20122013 season only if the lockout had continued and wiped out all the games — indicating that, based on the team’s projections, the only way for it to make money was to never play. Write to Annie’s Mailbox, c/o Creators Syndicate, 5777 W. Century Blvd., Ste. 700, Los Angeles, CA 90045 or e-mail your questions to [email protected]. Dear Annie: What do you do when your husband controls the money? I’m 68 years old, and for the past 10 years, “Robert” has paid the bills and has hidden the checkbook from me. Robert told me I need to pay my own bills. He has a retirement income, and he still works. I receive Social Security. I have always been thrifty, and although I have a debit card, I am only allowed to use it for necessary things like groceries. I pay for my clothes, haircuts, etc. I bought a new coat yesterday with my own money. Robert scolded me and told me to watch my spending. Robert does not see how his controlling behavior affects me. Is coping all I can do? — Craving Trust Dear Craving: Controlling the finances can be a form of abuse. Hiding the checkbook also keeps you in the dark about where Robert’s money is going. There is no reason to tolerate such behavior. You are a full partner in this marriage and are entitled to see the checkbook, the bank statements and any other financial business that concerns you. If you are afraid of Robert’s reaction, please contact the National Domestic Violence Hotline (thehotline. org) at 1-800-799-SAFE. Dear Annie: I’m in a quandary about my little girl. She believes her mom’s boyfriend is her father, but a DNA test proves that I am her true biological father. The boyfriend does not know, but just about everyone else does. My daughter is now 6 years old, and I want to tell her the truth. Will I be doing more harm than good? — Perplexed in Poughkeepsie Dear Perplexed: If the little girl has a solid and loving relationship with the man she believes is her father, your sudden assumption of that role might be traumatizing for her. You also will be responsible for child support. However, if “everyone else” knows, it’s only a matter of time before the current boyfriend and your child learn the truth. It is better if this information comes from her mother in a gentle and compassionate way, so Mom’s support is crucial in making this easier. Please ask the mother to come with you for mediation to see whether you can work on being a part of the child’s life. You can discuss it with your clergyperson or a trained counselor, or contact your local family court for a referral to a family mediation program. Dear Annie: I read the letter from “A Good Man Gone Celibate,” who has given up relationships because he can’t find any good women among the gold diggers, scheming manipulators, entitlement princesses, Toxic Thelmas and serial divorcees. I don’t think it’s fair to blame all women for what is on the dating sites. Most of us are not like that. They may treat you differently at the beginning, but that is not unusual, and over time, their behavior will normalize. (They may already suspect you are gay.) But we don’t recommend you introduce a girlfriend on the same trip where you come out to the relatives. That may be more than any of you can handle, and it is unfair to your girlfriend to put her in the middle of the drama. She was 17, and there was no possibility of carrying the baby to term and having it be adopted. My daughter and I never talk about this, but I have never forgotten it. This child would now be an adult, and I would have a grandchild. I will regret this experience until the day I die. My kids are all grown and on their own. I have little drama in my life. My girlfriends and I have been on most of these sites, and all we get are men who only want sex or those who want to marry you the first time they meet you. We are tired of this. It seems that most men don’t want to take the time to establish any kind of relationship that doesn’t end up in bed after a couple of hours of talking. My profile says, “If you can carry a conversation for more than 10 minutes without using sexual innuendos or sending naked pictures, please contact me.” Needless to say, I don’t get a lot of contact. I have been off and on these sites for six years. I, too, get frustrated and disgusted, but I will walk away for a while and come back with a different attitude. (The faithful were rewarded, though, as the dove, though wounded, managed to elude the irreligious predator.) (2) On Feb. 11, only hours after Pope Benedict had announced his imminent retirement, a rare winter thunderstorm hit Vatican City, and an Agence France-Presse photographer snapped a photo of one powerful lightning bolt from the heavens appearing to strike St. Peter’s Basilica (as if offering a dissenting opinion to the pope’s decision). 34 40 45 83 87 92 110 117 121 125 90 “A men 93 I t’s cle 94 D olt 97 N .Y.C. 99 E ar ly s 100 F ir st- 101 Toasts 102 Respo sheepi 103 Wine 105 F or me I dol” 12 C LIVING THE EXAMINER • March 14-20, 2013 Su•do•ku Yoogi games (www.yoogi.com) By Kevin King Staff Writer Medium — Puzzle No. 3 dent and strong advocate for domestic violence victims, Bill Leger. Family Services presented Tecoo Leger, his widow, with a plaque honoring Bill’s commitment to the organization over the years. The 2013 Family Services Volunteer of the Year has also played a powerful role in breaking the cycle of domestic violence, according to Walker. The Southeast Texas Foster Grandparent Program was named Family Services Volunteer of the Year. Foster grandparents Virginia Thomas and Lynn Julian accepted the award. These participants selflessly give of their time to operate a playroom at Family Services Women and Children’s Shelter where they carefully supervise and lovingly interact with children, Walker said. “We have foster grandparents at the shelter who take care of children while their mothers work on their resumes or look for jobs,” she said. “They are a very important support service at the shelter.” The Family Services resource development committee chose the award recipients. All proceeds from the luncheon went to benefit the programs of Family Services of Southeast Texas Inc., a nonprofit organization working to strengthen families, individuals and the community through services at Family Services Counseling Center and Family Services Women and Children’s Shelter. Easy — Puzzle No. 2 Family Services of Southeast Texas recognized families and organizations that have had an impact on the community at their 11th annual luncheon Thursday, Feb. 28. “This event is to honor families,” said Janet Walker, executive director at Family Services of Southeast Texas. “Our mission is to strengthen families, so we want to recognize people in the community that do work to do that.” Among those honored were Dr. Jimmy Simmons and his wife, Susan. The Simmonses were named Family of the Year. “Not only have Dr. and Mrs. Simmons made a permanent impact on the lives of their three children, but they have also touched the lives of thousands of young adults through 14 years of outstanding leadership as the ‘first family’ of Lamar University,” Walker said in a press release. Dr. Simmons thanked the audience and Family Services for the award and explained that he had a weekend of family togetherness to look forward to. “Speaking of family, I’m looking forward to this weekend (March 2-3),” Dr. Simmons said. “I’ll have all of my nine grandchildren, our three children and their spouses and five dogs all at Lamar University to celebrate this award.” The Texas Coffee Company was named Family Business of the Year. Started in 1921 by Charles J. Fertitta, Texas Coffee Company products such as TexJoy Seasoning and Seaport Coffee have been household staples for several decades. And while the company has experienced success, it is still proud of its rich heritage and deep roots, Walker said. Joseph Fertitta Jr., vice president and secretary treasurer of the company, accepted the award. “This is truly an honor,” Fertitta said. “I can’t tell you how much this means to our family.” Beaumont PD’s Family Violence Unit was recognized as the Bill Leger Family Advocate of the Year. “We coordinate and work closely with them to keep victims safe and hold batterers accountable,” Walker said. The unit is comprised of one sergeant, five detectives, and one civilian administrative assistant. A press release by Beaumont Police Department expressed Chief James Singletary’s thoughts on the award. “Chief James Singletary is proud of the professionalism and work ethic demonstrated by the men and women of this unit. He is also very appreciative that Family Services took the time to formally recognize this unit’s dedication to its vital mission and service to the citizens of Beaumont.” The award was renamed this year in memory of past Family Services Board presi- Easy — Puzzle No. 1 Family Services celebrates Southeast Texas families • Fill the cells in such a way that each row, column and 3x3 subsquare has digits 1-9. • Some digits are already given as clues. He was found as a stray and brought to us because he didn’t fit in with the finder’s other dogs. (Some older dogs just don’t appreciate the energy of puppies!) Sambo weighs 44 pounds now and will probably grow just a bit more so he will be a large dog or a large/medium dog. He has a soft, fawn colored coat and is very muscular: if dogs had abs, he would definately have a 6 pack! But don’t let all those muscles fool you: he is also a very smart boy, as well as very, very sweet, playful, will fetch until you tire of the game and then is happy to come plop down by your side for belly rubs. He is good with children but may be too strong for very young children, gets along with most other dogs and is learning basic commands. The adoption fee is $95 for mixed breed dogs and puppies, and $150 for pure breed dogs and puppies. This includes first round of vaccinations, bordetella vaccination, worming, flea treatment, spay or neutering and a veterinary wellness exam. All animals will be spayed or neutered before going to their new home. Adoption is a 15-year commitment. Please adopt responsibly. My wife and I have simple wills prepared by an Indiana attorney. Are our wills still valid in Texas? A. Your will might or might not be valid, depending on whether it complies with Texas law. Even if valid, however, it might not have the same effect in Texas because of differences in state law. My suggestion is to simply get a new will prepared in Texas. Shop around and you should be able to find an attorney that prepares a simple will for a reasonable fee. afford to pay. Creditors simply want to be paid, and they know that suing in Texas usually doesn’t help. To see what can happen if you are sued, look at the debt collection section on my website, www.peopleslawyer.net. I suggest you speak with them, explain your financial situation, and let them know you are again able to make regular payments. My guess is they may try to get you to pay more but ultimately will accept what you can afford. Q. My husband left me about two years ago. I don’t know where he is. Can I still get a divorce? A. You can get divorced even if you don’t know where you spouse is. Talk with a family law attorney about how you will need to “serve” him with the papers. If the goose hunters are extremely fortunate, they will plan their hunts when the weather is foggy and with a wind blowing the fog around. Actually when the weather is most uncomfortable, the late season goose hunting is best. I mentioned earlier that the geese are now in smaller groups. It has been my experience that the use of fewer decoys is better than the huge sets. Should you plan to use large numbers of decoys then I suggest that you set them in smaller groups that are separated The geese are more educated by now. Even the younger geese have matured and are following the lead of the older ones. It seems that the groups of geese will be on the ground and then fly up and around for no apparent reason. They remind me of some good athletes that are getting in condition for their marathon flight. By eating more green vegetation and doing more flying to strengthen their muscles for the long flight to the nesting grounds, they are more able to make the long flight. On the subject of strong muscles, the light geese have enough of them for some super table fare. The first thing that comes to mind for cooking goose meat is gumbo. They do make my favorite of all gumbos. Also, the breast may be cut across the grain, seasoned to taste, and deep-fried. I do like to use a tenderizer hammer on the meat before deepfrying. If you would like some good smoked sausage to add to your gumbo, then make it with 50 percent goose breast and 50 percent pork before smoking. The legs and thighs are mild and are good in pot roast.
